		<section changed="deleted" committee-id="SSEG00" id="idC98CD58F69954B0CBD9E4FFB0C67A138" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wallowa Lake Dam Rehabilitation and
			 Water Management Act of 2007</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="IDDC8CC0D9BA4045A3BFA2400DCB0E400C" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDFD0E3502A6A54124B9C2E4B8EC30AD2B"><enum>(1)</enum><header>Associated ditch
			 companies, incorporated</header><text>The term <term>Associated Ditch
			 Companies, Incorporated</term> means the nonprofit corporation established
			 under the laws of the State of Oregon that operates Wallowa Lake Dam.</text>
			</paragraph><paragraph id="ID4B705A2DB58846209CBB81FC9BCBA89E"><enum>(2)</enum><header>Phase ii and
			 phase iii of the wallowa valley water management plan</header><text>The term
			 <term>Phase II and Phase III of the Wallowa Valley Water Management Plan</term>
			 means the Phase II program for fish passage improvements and water conservation
			 measures, and the Phase III program for implementation of water exchange
			 infrastructure, developed for the Wallowa River watershed, as contained in the
			 document entitled <quote>Wallowa Lake Dam Rehabilitation and Water Management
			 Plan Vision Statement</quote>, dated February 2001, and on file with the Bureau
			 of Reclamation.</text>
			</paragraph><paragraph id="ID79288DAB016C4AE585CAC92937AC3E21"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Commissioner of Reclamation.</text>
			</paragraph><paragraph id="ID27E0AD0DE1324D38942D61E2EA83C865"><enum>(4)</enum><header>Wallowa lake dam
			 rehabilitation program</header><text>The term <term>Wallowa Lake Dam
			 Rehabilitation Program</term> means the program for the rehabilitation of the
			 Wallowa Lake Dam in Oregon, as contained in the engineering document entitled,
			 <quote>Phase I Dam Assessment and Preliminary Engineering Design</quote>, dated
			 December 2002, and on file with the Bureau of Reclamation.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="IDB95276AA1D464CB4A429627A653D36E1" reported-display-style="strikethrough"><enum>3.</enum><header>Authorization to
			 participate in program</header>
			<subsection id="ID828AB65308D946268FBB1ED3901F5E64"><enum>(a)</enum><header>Grants and
			 Cooperative Agreements</header><text>The Secretary may provide grants to, or
			 enter into cooperative or other agreements with, tribal, State, and local
			 governmental entities and the Associated Ditch Companies, Incorporated, to
			 plan, design, and construct facilities needed to implement the Wallowa Lake Dam
			 Rehabilitation Program and Phase II and Phase III of the Wallowa Valley Water
			 Management Plan.</text>
			</subsection><subsection id="IDDD21E03899944D80A7072465B10BF8F3"><enum>(b)</enum><header>Conditions</header><text>As
			 a condition of providing funds under subsection (a), the Secretary shall ensure
			 that—</text>
				<paragraph id="ID6128C021323245E29C88E06A1055D9BB"><enum>(1)</enum><text>the Wallowa Lake
			 Dam Rehabilitation Program meets the standards of the dam safety program of the
			 State of Oregon;</text>
				</paragraph><paragraph id="IDD6B64A2BCD15408FA98A30F334CDB39B"><enum>(2)</enum><text>the Associated
			 Ditch Companies, Incorporated, agrees to assume liability for any work
			 performed, or supervised, with funds provided to it under this Act; and</text>
				</paragraph><paragraph id="ID6EE893AB499A43D3BB9EE0B210DEE437"><enum>(3)</enum><text>the United States
			 shall not be liable for damages of any kind arising out of any act, omission,
			 or occurrence relating to a facility rehabilitated or constructed under this
			 Act.</text>
				</paragraph></subsection><subsection id="IDE9D2896B7DEA494A86E00AAD0476BA28"><enum>(c)</enum><header>Cost
			 Sharing</header>
				<paragraph id="IDBFD28223AFDF4A8BAB2A04B34161A977"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the costs of activities authorized
			 under this Act shall not exceed 80 percent.</text>
				</paragraph><paragraph id="ID9637B2CAE4324509802D158272088BFA"><enum>(2)</enum><header>Exclusions from
			 federal share</header><text>There shall not be credited against the Federal
			 share of such costs—</text>
					<subparagraph id="IDB27CB23A68B545D7A4F638B7035A0560"><enum>(A)</enum><text>any expenditure by
			 the Bonneville Power Administration in the Wallowa River watershed; and</text>
					</subparagraph><subparagraph id="IDF09FECD7AE10417FAFF5FEEBBB9DA1BC"><enum>(B)</enum><text>expenditures made
			 by individual agricultural producers in any Federal commodity or conservation
			 program.</text>
					</subparagraph></paragraph></subsection><subsection id="ID0CCD0CC0647F48AE8EC657D79584DCF4"><enum>(d)</enum><header>Compliance With
			 State Law</header><text>In carrying out this Act, the Secretary shall comply
			 with otherwise applicable State water law.</text>
			</subsection><subsection id="ID32F64159A6B040339E72CB6E3D6DBCBA"><enum>(e)</enum><header>Prohibition on
			 Holding Title</header><text>The Federal Government shall not hold title to any
			 facility rehabilitated or constructed under this Act.</text>
			</subsection><subsection id="ID7F52D69D6F0242BAB2CDB1FB5E26EC1A"><enum>(f)</enum><header>Prohibition on
			 Operation and Maintenance</header><text>The Federal Government shall not be
			 responsible for the operation and maintenance of any facility constructed or
			 rehabilitated under this Act.</text>
			</subsection><subsection id="ID175242BEC29E42E3BCC7D7FF18E5D2B4"><enum>(g)</enum><header>Ownership and
			 Operation of Fish Passage Facility</header><text>Any facility constructed using
			 Federal funds authorized by this Act located at Wallowa Lake Dam for trapping
			 and transportation of migratory adult salmon may be owned and operated only by
			 the Nez Perce Tribe.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="IDCC8416BB712448AABEA4EEF745875215" reported-display-style="strikethrough"><enum>4.</enum><header>Relationship to
			 other law</header><text display-inline="no-display-inline">An activity funded
			 under this Act shall not be considered a supplemental or additional benefit
			 under Federal reclamation law (the Act of June 17, 1902 (32 Stat. 388, chapter
			 1093), and Acts supplemental to and amendatory of that Act (43 U.S.C. 371 et
			 seq.)).</text>
		</section><section changed="deleted" committee-id="SSEG00" id="ID2329E9317A4E41D9B51F3E904F3F5CA9" reported-display-style="strikethrough"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Secretary to the pay the Federal share of
			 the costs of activities authorized under this Act $25,600,000.</text>

	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="idc3595fb6-3732-4bc3-96a3-bcde9166ca81" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wallowa Lake Dam Rehabilitation and
			 Water Management Act of 2007</short-title></quote>.</text>
		</section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id956edf80-f20d-4c3e-927c-79a187107540" reported-display-style="italic" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID5ea7c86b9a4a438a8d72e377e0ca33a7"><enum>(1)</enum><header>Associated ditch
			 companies, incorporated</header><text>The term <quote>Associated Ditch
			 Companies, Incorporated</quote> means the nonprofit corporation established
			 under the laws of the State of Oregon that operates Wallowa Lake Dam.</text>
			</paragraph><paragraph id="ID09e40060155b4d84a445a3410421510d"><enum>(2)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior, acting
			 through the Commissioner of Reclamation.</text>
			</paragraph><paragraph id="IDeffafd08810f4e0ab995ea6d882d1387"><enum>(3)</enum><header>Wallowa lake dam
			 rehabilitation program</header><text>The term <quote>Wallowa Lake Dam
			 Rehabilitation Program</quote> means the program for the rehabilitation of the
			 Wallowa Lake Dam in Oregon, as contained in the engineering document entitled,
			 <quote>Phase I Dam Assessment and Preliminary Engineering Design</quote>, dated
			 December 2002, and on file with the Bureau of Reclamation.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="ID41f566c3062e4acd9b974fa2e8b5a9d0" reported-display-style="italic"><enum>3.</enum><header>Authorization to
			 Participate in Program</header>
			<subsection id="IDf950264128e84b15bd7911221cfaf8de"><enum>(a)</enum><header>Grants and cooperative
			 agreements</header><text>The Secretary may provide grants to, or enter into
			 cooperative or other agreements with, tribal, State, and local governmental
			 entities and the Associated Ditch Companies, Incorporated, to plan, design, and
			 construct facilities needed to implement the Wallowa Lake Dam Rehabilitation
			 Program.</text>
			</subsection><subsection id="ID932f7c5e8e304b7db9afa32a0cf01a08"><enum>(b)</enum><header>Conditions</header><text>As
			 a condition of providing funds under subsection (a), the Secretary shall ensure
			 that—</text>
				<paragraph id="ID810d7edadd0a434bb06eef6e8747233e"><enum>(1)</enum><text>the Wallowa Lake Dam
			 Rehabilitation Program and any activities under this Act meet the standards of
			 the dam safety program of the State of Oregon;</text>
				</paragraph><paragraph id="ID7ad3edb8631d4345a995d845a9b90789"><enum>(2)</enum><text>the Associated Ditch
			 Companies, Incorporated, agrees to assume liability for any work performed, or
			 supervised, with Federal funds provided to Associated Ditch Companies,
			 Incorporated, under this Act; and</text>
				</paragraph><paragraph id="IDc6590ab839544502a93695cb3ff764aa"><enum>(3)</enum><text>the United States shall
			 not be liable for damages of any kind arising out of any act, omission, or
			 occurrence relating to a facility rehabilitated or constructed with Federal
			 funds provided under this Act, regardless of whether the damages arose during
			 or after the rehabilitation or construction.</text>
				</paragraph></subsection><subsection id="ID6b6689a8647045bb9f78c6b3a8628de1"><enum>(c)</enum><header>Cost sharing</header>
				<paragraph id="ID2b5c67cd10424ddeada6f3c8903bf933"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the costs of activities authorized
			 under this Act shall not exceed 50 percent.</text>
				</paragraph><paragraph id="ID15a967c3f34d49728097ab578c0d08ee"><enum>(2)</enum><header>Exclusions from Federal
			 share</header><text>There shall not be credited against the Federal share of
			 the costs of activities authorized under this Act—</text>
					<subparagraph id="ID5d70ba5538d64cb7a4ea7daa25085bc3"><enum>(A)</enum><text>any expenditure by the
			 Bonneville Power Administration in the Wallowa River watershed; and</text>
					</subparagraph><subparagraph id="IDa4a98faeb99c4cad9f3e3084dd6df1a0"><enum>(B)</enum><text>expenditures made by
			 individual agricultural producers in any Federal commodity or conservation
			 program.</text>
					</subparagraph></paragraph></subsection><subsection id="IDbf950d209bc740c5ba4445a508f28a1f"><enum>(d)</enum><header>Compliance with State
			 law</header><text>In carrying out this Act, the Secretary shall comply with
			 applicable Oregon State water law.</text>
			</subsection><subsection id="ID269a7ed7954a442b8542570a930ae2a6"><enum>(e)</enum><header>Prohibition on holding
			 title</header><text>The Federal Government shall not hold title to any facility
			 rehabilitated or constructed under this Act.</text>
			</subsection><subsection id="ID7f84d33c7c9f40de965f85833200271f"><enum>(f)</enum><header>Prohibition on
			 operation and maintenance</header><text>The Federal Government shall not be
			 responsible for the operation and maintenance of any facility constructed or
			 rehabilitated under this Act.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="IDd6c9bc45c90148a99fabcf181230b9cd" reported-display-style="italic"><enum>4.</enum><header>Relationship to other
			 law</header><text display-inline="no-display-inline">Activities funded under
			 this Act shall not be considered a supplemental or additional benefit under
			 Federal reclamation law (the Act of June 17, 1902 (32 Stat. 388, chapter 1093),
			 and Acts supplemental to and amendatory of that Act (43 U.S.C. 371 et
			 seq.)).</text>
		</section><section changed="added" committee-id="SSEG00" id="ID94614c7b73a342e9881a5f0ee80d2153" reported-display-style="italic"><enum>5.</enum><header>Authorization of
			 Appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Secretary to pay the Federal share of the
			 costs of activities authorized under this Act $6,000,000.</text>
		</section><section changed="added" committee-id="SSEG00" id="ID9d1478a5fd804ef0a4234c743fdcac0a" reported-display-style="italic"><enum>6.</enum><header>Termination of
			 authority</header><text display-inline="no-display-inline">The authority of the
			 Secretary to carry out any provisions of this Act shall terminate 10 years
			 after the date of enactment of this Act.</text>
