			</subsection></section><section id="idDDCE5EC2E650452E93ABFDFE5C934DA0"><enum>2.</enum><header>Reference to
			 title 38, United States Code</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of title 38, United
			 States Code.</text>
		</section><title id="id4FB6D4803F0844E0B0346E13DD0DE1E4"><enum>I</enum><header>INSURANCE
			 MATTERS</header>
			<section id="id5d6910c2-d802-4044-99ee-eb618a5eba3a"><enum>101.</enum><header>Level-premium
			 term life insurance for veterans with service-connected disabilities</header>
				<subsection id="id48b1a815-8918-4976-bd5e-5e010bf354f7"><enum>(a)</enum><header>In
			 general</header><text>Chapter 19 is amended by inserting after section 1922A
			 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="idc0303ad6-b630-4a58-aa0d-e0d4cfc1a8e6" style="USC">
						<section id="id3065694d-bcae-4ab8-bef1-5daf5f60da0f"><enum>1922B.</enum><header>Level-premium
				term life insurance for veterans with service-connected disabilities</header>
							<subsection id="id1e52a53d-dff0-437d-967b-93025f473eca"><enum>(a)</enum><header>In
				general</header><text>In accordance with the provisions of this section, the
				Secretary shall grant insurance to each eligible veteran who seeks such
				insurance against the death of such veteran occurring while such insurance is
				in force.</text>
							</subsection><subsection id="id593f74de-26af-4b89-b4fb-20126a2f914e"><enum>(b)</enum><header>Eligible
				veterans</header><text>For purposes of this section, an eligible veteran is any
				veteran less than 65 years of age who has a service-connected
				disability.</text>
							</subsection><subsection id="idb02684eb-4052-45a2-8abf-76b9073ddbfa"><enum>(c)</enum><header>Amount of
				insurance</header><paragraph commented="no" display-inline="yes-display-inline" id="id102a2e45-d5d6-4b13-a7cd-b34c8f9d735d"><enum>(1)</enum><text>Subject to
				paragraph (2), the amount of insurance granted an eligible veteran under this
				section shall be $50,000 or such lesser amount as the veteran shall elect. The
				amount of insurance so elected shall be evenly divisible by $10,000.</text>
								</paragraph><paragraph id="id4c93a2f7-af28-44a4-a9c2-10195baec447" indent="up1"><enum>(2)</enum><text>The aggregate amount of insurance of
				an eligible veteran under this section, section 1922 of this title, and section
				1922A of this title may not exceed $50,000.</text>
								</paragraph></subsection><subsection id="id97dc8370-90a8-4449-b3eb-0a261c4684f5"><enum>(d)</enum><header>Reduced
				amount for veterans age 70 or older</header><text>In the case of a veteran
				insured under this section who turns age 70, the amount of insurance of such
				veteran under this section after the date such veteran turns age 70 shall be
				the amount equal to 20 percent of the amount of insurance of the veteran under
				this section as of the day before such date.</text>
							</subsection><subsection id="iddf7c80b4-8399-4281-85f1-7485bab012e9"><enum>(e)</enum><header>Premiums</header><paragraph commented="no" display-inline="yes-display-inline" id="id222a4808-318c-42b3-984f-7e8e9a847084"><enum>(1)</enum><text>Premium rates for
				insurance under this section shall be based on the 2001 Commissioners Standard
				Ordinary Basic Table of Mortality and interest at the rate of 4.5 per centum
				per annum.</text>
								</paragraph><paragraph id="id021fc262-3232-400f-83b1-213f296d7739" indent="up1"><enum>(2)</enum><text>The amount of the premium charged a
				veteran for insurance under this section may not increase while such insurance
				is in force for such veteran.</text>
								</paragraph><paragraph id="idbbeee0ed-e05f-4fab-a23c-9ee420d12147" indent="up1"><enum>(3)</enum><text>The Secretary may not charge a
				premium for insurance under this section for a veteran as follows:</text>
									<subparagraph id="idc21e57e3-197b-4701-bafa-c7b58bfa8dc6"><enum>(A)</enum><text>A veteran who has a service-connected
				disability rated as total and is eligible for a waiver of premiums under
				section 1912 of this title.</text>
									</subparagraph><subparagraph id="id72a9d52c-f152-41f1-9664-326279c30823"><enum>(B)</enum><text>A veteran who is 70 years of age or
				older.</text>
									</subparagraph></paragraph><paragraph id="id4ab03779-dc5e-4112-8aed-42c1d4d275ce" indent="up1"><enum>(4)</enum><text>Insurance granted under this section
				shall be on a nonparticipating basis and all premiums and other collections
				therefor shall be credited directly to a revolving fund in the Treasury of the
				United States, and any payments on such insurance shall be made directly from
				such fund. Appropriations to such fund are hereby authorized.</text>
								</paragraph><paragraph id="id0f617d21-a38e-4a65-9cab-a14da5804a94" indent="up1"><enum>(5)</enum><text>Administrative costs to the
				Government for the costs of the program of insurance under this section shall
				be paid from premiums credited to the fund under paragraph (4), and payments
				for claims against the fund under paragraph (4) for amounts in excess of
				amounts credited to such fund under that paragraph (after such administrative
				costs have been paid) shall be paid from appropriations to the fund.</text>
								</paragraph></subsection><subsection id="id7a0f3381-01b0-4b5e-8b14-8c3bc622ca87"><enum>(f)</enum><header>Application
				required</header><text>An eligible veteran seeking insurance under this section
				shall file with the Secretary an application therefor. Such application shall
				be filed not later than the earlier of—</text>
								<paragraph id="id584661b0-2712-47fc-8f10-f3881fada78b"><enum>(1)</enum><text>the end of
				the two-year period beginning on the date on which the Secretary notifies the
				veteran that the veteran has a service-connected disability; and</text>
								</paragraph><paragraph id="idb9d82ce0-7233-429f-864c-74b5d1a41012"><enum>(2)</enum><text>the end of
				the 10-year period beginning on the date of the separation of the veteran from
				the Armed Forces, whichever is
				earlier.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id7d70bcf4-859c-452c-b482-6a34b33184c2"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 19 is
			 amended by inserting after the item related to section 1922A the following new
			 item:</text>

				</subsection><subsection id="id17b2a457-a9c2-47e8-a23b-ea848b1f5555"><enum>(c)</enum><header>Exchange of
			 service disabled veterans' insurance</header><text>During the one-year period
			 beginning on the effective date of this section under subsection (d), any
			 veteran insured under section 1922 of title 38, United States Code, who is
			 eligible for insurance under section 1922B of such title (as added by
			 subsection (a)), may exchange insurance coverage under such section 1922 for
			 insurance coverage under such section 1922B.</text>
				</subsection><subsection id="id4F45F4122D914288A3D5517523BFBF84"><enum>(d)</enum><header>Effective
			 date</header><text>This section, and the amendments made by this section, shall
			 take effect on June 1, 2008.</text>
				</subsection></section><section id="idde216fbf-d9f7-406d-a27e-c025c395134e"><enum>102.</enum><header>Administrative
			 costs of service disabled veterans' insurance</header><text display-inline="no-display-inline">Section 1922(a) is amended by striking
			 <quote>directly from such fund</quote> and inserting <quote>directly from such
			 fund; and (5) administrative costs to the Government for the costs of the
			 program of insurance under this section shall be paid from premiums credited to
			 the fund under paragraph (4), and payments for claims against the fund under
			 paragraph (4) for amounts in excess of amounts credited to such fund under that
			 paragraph (after such administrative costs have been paid) shall be paid from
			 appropriations to the fund</quote>.</text>
			</section><section id="idd916bf3d-f44c-4d7f-a518-266deaa5d878"><enum>103.</enum><header>Modification
			 of servicemembers' group life insurance coverage</header>
				<subsection id="id26f0c5a3-b608-4582-8c35-31fad8637b16"><enum>(a)</enum><header>Expansion
			 of servicemembers' group life insurance To include certain members of
			 Individual Ready Reserve</header>
					<paragraph id="id3ebc8696-ede9-49b1-9d90-09dc78ac73a3"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (1)(C) of
			 section 1967(a) is amended by striking <quote>section 1965(5)(B) of this
			 title</quote> and inserting <quote>subparagraph (B) or (C) of section 1965(5)
			 of this title</quote>.</text>
					</paragraph><paragraph id="idaf75a60a-1af7-428f-864b-f65e1ef9f4dc"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Paragraph (5)(C) of such section 1967(a) is amended by
			 striking <quote>section 1965(5)(B) of this title</quote> and inserting
			 <quote>subparagraph (B) or (C) of section 1965(5) of this title</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8ca0aff1-fc82-47f4-ad61-8144b1c67c2c"><enum>(b)</enum><header>Reduction
			 in period of coverage for dependents after member
			 separates</header><text>Section 1968(a)(5)(B)(ii) is amended by striking
			 <quote>120 days after</quote>.</text>
				</subsection></section><section id="idB6726DAFA944401EBCC18E9FA7EE5065"><enum>104.</enum><header>Supplemental
			 insurance for totally disabled veterans</header>
				<subsection id="idDF00E9E730234B9E9C46ADC28CFE937A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1922A(a) is
			 amended by striking <quote>$20,000</quote> and inserting
			 <quote>$30,000</quote>.</text>
				</subsection><subsection id="idBB3ADBA6AFA144B49DA8CF4DAA7823C8"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall take effect on
			 January 1, 2008.</text>
				</subsection></section><section id="id24F76C5E92B94D90AE6193DBAFF3ADFA" section-type="subsequent-section"><enum>105.</enum><header>Expansion of
			 individuals qualifying for retroactive benefits from traumatic injury
			 protection coverage under Servicemembers' Group Life Insurance</header>
				<subsection id="id564FD92F34084764A990990951F73F21"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (1) of
			 section 501(b) of the Veterans' Housing Opportunity and Benefits Improvement
			 Act of 2006 (Public Law 109–233; 120 Stat. 414; 38 U.S.C. 1980A note) is
			 amended by striking <quote>, if, as determined by the Secretary concerned, that
			 loss was a direct result of a traumatic injury incurred in the theater of
			 operations for Operation Enduring Freedom or Operation Iraqi
			 Freedom</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE743CB43D4E84210A3C432D3E28EF8F4"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The heading of such section is amended by striking
			 <quote><header-in-text level="subsection" style="OLC">in Operation Enduring
			 Freedom and Operation Iraqi Freedom</header-in-text></quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idCC931ACCBABC48CAB96883925A6734F1"><enum>(c)</enum><header>Effective

					</paragraph></subsection><subsection id="id8CCE5AEE951D4ADEB5EDAF7869C9D26A"><enum>(b)</enum><header>Payments for
			 qualifying losses incurred before date of enactment</header>
					<paragraph id="id536498098A94426EB4574FF2C353FDD9"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Veterans Affairs shall prescribe in
			 regulations mechanisms for payments under section 1980A of title 38, United
			 States Code, for qualifying losses incurred before the date of the enactment of
			 this Act by reason of the requirements of paragraph (2) of subsection (d) of
			 such section (as amended by subsection (a)(2) of this section).</text>
					</paragraph><paragraph id="idE27A6210D9D24D2F9813D8C888302D51"><enum>(2)</enum><header>Qualifying loss
			 defined</header><text>In this subsection, the term <term>qualifying loss</term>
			 means—</text>
						<subparagraph id="idE6DCEA9E00B54793AFC35B62621424C9"><enum>(A)</enum><text>a loss specified
			 in the second sentence of subsection (b)(1) of section 1980A of title 38,
			 United States Code; and</text>
						</subparagraph><subparagraph id="id9BB38C91F53D4E8692B638BEC23C73BC"><enum>(B)</enum><text>any other loss
			 specified by the Secretary of Veterans Affairs pursuant to the first sentence
			 of that subsection.</text>
						</subparagraph></paragraph></subsection></section><section id="id3CA24D987F814B0F8AB14ED3262AC916"><enum>107.</enum><header>Designation of
			 fiduciary for traumatic injury protection coverage under Servicemembers' Group
			 Life Insurance in case of lost mental capacity or extended loss of
			 consciousness</header>
				<subsection id="idE31A15E9215D4B41BB15A0F847AE3ED9"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Defense shall, in consultation with the
			 Secretary of Veterans Affairs, develop a form for the designation of a
			 recipient for the funds distributed under section 1980A of title 38, United
			 States Code, as the fiduciary of a member of the Armed Forces in cases where
			 the member is mentally incapacitated (as determined by the Secretary of Defense
			 in consultation with the Secretary of Veterans Affairs) or experiencing an
			 extended loss of consciousness.</text>
				</subsection><subsection id="idFF2B7CCB33554E2F87AE00639017772B"><enum>(b)</enum><header>Elements</header><text>The
			 form under subsection (a) shall require that a member may elect that—</text>
					<paragraph id="idF477FABB682A41508E09F9CBC70A4A0B"><enum>(1)</enum><text>an individual
			 designated by the member be the recipient as the fiduciary of the member;
			 or</text>
					</paragraph><paragraph id="idA6B35B04F0C0473188450F372231DC0C"><enum>(2)</enum><text>a court of proper
			 jurisdiction determine the recipient as the fiduciary of the member for
			 purposes of this subsection.</text>
					</paragraph></subsection><subsection id="idB87634A910D443D5AC7B7B117D7F1A55"><enum>(c)</enum><header>Completion and
			 update</header><text>The form under subsection (a) shall be completed by an
			 individual at the time of entry into the Armed Forces and updated periodically
			 thereafter.</text>
				</subsection></section><section id="idb36485b0-10d2-4f54-8d50-a0caa43f66c2"><enum>108.</enum><header>Enhancement
			 of veterans' mortgage life insurance</header><text display-inline="no-display-inline">Section 2106(b) is amended by striking
			 <quote>$90,000</quote> and inserting <quote>$150,000, or $200,000 after January
			 1, 2012,</quote>.</text>
			</section></title><title id="id467C6AFDFB9540E1B54CB40EBE1D8734"><enum>II</enum><header>HOUSING
			 MATTERS</header>
			<section id="id793B62CFE6E045168A8644D1E37E84B8"><enum>201.</enum><header>Home
			 improvements and structural alterations for totally disabled members of the
			 Armed Forces before discharge or release from the Armed Forces</header><text display-inline="no-display-inline">Section 1717 is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="idC17987B6198C473E9DB2459EE0F0E579" style="OLC">
					<subsection id="id1B64528C7A2E44828C05280D90207E54"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idD50AD331F9D049BEB11D8A7BCDC5D9D1"><enum>(1)</enum><text>In the case of a member
				of the Armed Forces who, as determined by the Secretary, has a disability
				permanent in nature incurred or aggravated in the line of duty in the active
				military, naval, or air service, the Secretary may furnish improvements and
				structural alterations for such member for such disability or as otherwise
				described in subsection (a)(2) while such member is hospitalized or receiving
				outpatient medical care, services, or treatment for such disability if the
				Secretary determines that such member is likely to be discharged or released
				from the Armed Forces for such disability.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5E9D289AC1F9495BB28C7CE9FE4AD011" indent="up1"><enum>(2)</enum><text>The furnishing of improvements and
				alterations under paragraph (1) in connection with the furnishing of medical
				services described in subparagraph (A) or (B) of subsection (a)(2) shall be
				subject to the limitation specified in the applicable
				subparagraph.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id4CE8A1AA1BA846CB86288E33E6474801"><enum>202.</enum><header>Eligibility
			 for specially adapted housing benefits and assistance for members of the Armed
			 Forces with service-connected disabilities and individuals residing outside the
			 United States</header>
				<subsection id="idB16B1C32714744D9A18E26CF0E733DFC"><enum>(a)</enum><header>Eligibility</header><text>Chapter
			 21 is amended by inserting after section 2101 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="id163757EF99C641FD944B2D5A3931B809" style="USC">
						<section id="id995483CC2F8D42C9A772BDAC34FA5243"><enum>2101A.</enum><header>Eligibility
				for benefits and assistance: members of the Armed Forces with service-connected
				disabilities; individuals residing outside the United States</header>
							<subsection commented="no" display-inline="no-display-inline" id="id133C87EDEA2F4588AFD21E277171ED7D"><enum>(a)</enum><header display-inline="yes-display-inline">Members with service-connected
				disabilities</header><paragraph commented="no" display-inline="yes-display-inline" id="id37E6C80BBDEA4A5CB2980A96CCD85097"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary may provide assistance under
				this chapter to a member of the Armed Forces serving on active duty who is
				suffering from a disability that meets applicable criteria for benefits under
				this chapter if the disability is incurred or aggravated in line of duty in the
				active military, naval, or air service. Such assistance shall be provided to
				the same extent as assistance is provided under this chapter to veterans
				eligible for assistance under this chapter and subject to the same requirements
				as veterans under this chapter.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0517F3D57AE843638A8DA7215E66F054" indent="up1"><enum>(2)</enum><text>For purposes of this chapter, any
				reference to a veteran or eligible individual shall be treated as a reference
				to a member of the Armed Forces described in subsection (a) who is similarly
				situated to the veteran or other eligible individual so referred to.</text>
								</paragraph></subsection><subsection id="idF5EFEF6ECFCD4E8AB87CE13E91FE2DD7"><enum>(b)</enum><header>Benefits and
				assistance for individuals residing outside the United States</header><paragraph commented="no" display-inline="yes-display-inline" id="id2B7E429A70C04FEDB75589B67A4CFFF0"><enum>(1)</enum><text>Subject to paragraph
				(2), the Secretary may, at the Secretary's discretion, provide benefits and
				assistance under this chapter (other than benefits under section 2106 of this
				title) to any individual otherwise eligible for such benefits and assistance
				who resides outside the United States.</text>
								</paragraph><paragraph id="idEE52889251D8421C9A5249F12B397EF3" indent="up1"><enum>(2)</enum><text>The Secretary may provide benefits
				and assistance to an individual under paragraph (1) only if—</text>
									<subparagraph id="idBF936B28864B4BD78FFD43BAD1B4CAB6"><enum>(A)</enum><text>the country or political subdivision
				in which the housing or residence involved is or will be located permits the
				individual to have or acquire a beneficial property interest (as determined by
				the Secretary) in such housing or residence; and</text>
									</subparagraph><subparagraph id="id28627079515E45638054E517A610C293"><enum>(B)</enum><text>the individual has or will acquire a
				beneficial property interest (as so determined) in such housing or
				residence.</text>
									</subparagraph></paragraph></subsection><subsection id="id72A245413FDB4293ADE25490AEA86DD7"><enum>(c)</enum><header>Regulations</header><text>Benefits
				and assistance under this chapter by reason of this section shall be provided
				in accordance with such regulations as the Secretary may
				prescribe.</text>

			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="id0EEA7DCF01524D8883C68029E82DB77E" style="OLC">
							<subsection id="id5F728843D3564B18BC53E00426D3D6D2"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idF30EBD71E22A4F8891DC8542AD507FD1"><enum>(1)</enum><text>Effective on October 1
				of each year (beginning in 2009), the Secretary shall increase the amounts
				described in subsection (b)(2) and paragraphs (1) and (2) of subsection (d) in
				accordance with this subsection.</text>
								</paragraph><paragraph id="id0406F7E1BDF64F64BBE38DFA66B98681" indent="up1"><enum>(2)</enum><text>The increase in amounts under
				paragraph (1) to take effect on October 1 of a year shall be by an amount of
				such amounts equal to the percentage by which—</text>
									<subparagraph id="id5AD12F57E7454F7A84AD00B2CB8EB0A1"><enum>(A)</enum><text>the residential home
				cost-of-construction index for the preceding calendar year, exceeds</text>
									</subparagraph><subparagraph id="id8D2F597CB6664D75B6C6C7C34A941217"><enum>(B)</enum><text>the residential home
				cost-of-construction index for the year preceding the year described in
				subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="idB9F7A686DBE64C94A92293EA8E630805" indent="up1"><enum>(3)</enum><text>The Secretary shall establish a
				residential home cost-of-construction index for the purposes of this
				subsection. The index shall reflect a uniform, national average change in the
				cost of residential home construction, determined on a calendar year basis. The
				Secretary may use an index developed in the private sector that the Secretary
				determines is appropriate for purposes of this
				subsection.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id8CE5BBA6E0504CB4AA84E3FB895C561A"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 July 1, 2008, and shall apply with respect to payments made in accordance with
			 section 2102 of title 38, United States Code, on or after that date.</text>
				</subsection></section><section id="id83DA8A78500240EE95F1D7CBC2B80D54"><enum>206.</enum><header>Report on
			 specially adapted housing for disabled individuals</header>
				<subsection id="id028E3B39F5714433B5EF096245A14647"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2008, the Secretary of Veterans Affairs shall submit to the
			 Committee on Veterans' Affairs of the Senate and the Committee on Veterans'
			 Affairs of the House of Representatives a report that contains an assessment of
			 the adequacy of the authorities available to the Secretary under law to assist
			 eligible disabled individuals in acquiring—</text>
					<paragraph id="id23FFEFB41E7343CEAA2D4595C2BF856A"><enum>(1)</enum><text display-inline="yes-display-inline">suitable housing units with special
			 fixtures or movable facilities required for their disabilities, and necessary
			 land therefor;</text>
					</paragraph><paragraph id="id4FC8B8E02A5F4CD5980693DF9FE120F1"><enum>(2)</enum><text>such adaptations
			 to their residences as are reasonably necessary because of their disabilities;
			 and</text>
					</paragraph><paragraph id="id738EF92516474574A665BDB3584FF098"><enum>(3)</enum><text>residences
			 already adapted with special features determined by the Secretary to be
			 reasonably necessary as a result of their disabilities.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA349D9AE9B70490AB305479F41E486E1"><enum>(b)</enum><header>Focus on
			 particular disabilities</header><text>The report required by subsection (a)
			 shall set forth a specific assessment of the needs of—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id7316C8F3A78B4601B1A8A95EF63B53C1"><enum>(1)</enum><text>veterans who have
			 disabilities that are not described in subsections (a)(2) and (b)(2) of section
			 2101 of title 38, United States Code; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55C53CC83D184EDD810C71E38BD2BE60"><enum>(2)</enum><text>other disabled
			 individuals eligible for specially adapted housing under chapter 21 of such
			 title by reason of section 2101A of such title (as added by section 202(a) of
			 this Act) who have disabilities that are not described in such
			 subsections.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id7A265D2CFAF94A25B88FF60AE2602434"><enum>207.</enum><header>Report on
			 specially adapted housing assistance for individuals who reside in housing
			 owned by a family member on permanent basis</header><text display-inline="no-display-inline">Not later than December 31, 2008, the
			 Secretary of Veterans Affairs shall submit to the Committee on Veterans'
			 Affairs of the Senate and the Committee on Veterans' Affairs of the House of
			 Representatives a report on the advisability of providing assistance under
			 section 2102A of title 38, United States Code, to veterans described in
			 subsection (a) of such section, and to members of the Armed Forces covered by
			 such section 2102A by reason of section 2101A of title 38, United States Code
			 (as added by section 202(a) of this Act), who reside with family members on a
			 permanent basis.</text>
			</section></title><title id="id4AE5C8D4BC0E43AA9E3923D29B46A4CB"><enum>III</enum><header>LABOR AND
			 EDUCATION MATTERS</header>
			<section id="idEB21333B1BA54E3698B76EDCDD3B88B7"><enum>301.</enum><header>Coordination
			 of approval activities in the administration of education benefits</header>
				<subsection id="id2CDFB6A7E7794A9CB2F02F81B608AC05"><enum>(a)</enum><header>Coordination</header>
					<paragraph id="id61FA0C7938BD428091289467B43AE510"><enum>(1)</enum><header>In
			 general</header><text>Section 3673 is amended—</text>
						<subparagraph id="idC149AE704FF047C4A748B81E1491F1E3"><enum>(A)</enum><text>by redesignating
			 subsection (b) as subsection (c); and</text>

					<paragraph id="idD1C21C5FFD5B42F19ACA49CA54B5FAAE"><enum>(1)</enum><text>The actions taken
			 to establish outcome-oriented performance standards for State approving
			 agencies created or designated under section 3671 of title 38, United States
			 Code, including a description of any plans for, and the status of the
			 implementation of, such standards as part of the evaluations of State approving
			 agencies required by section 3674A of title 38, United States Code.</text>
					</paragraph><paragraph id="id04682C3CF46D4B48AB5C524BE25E87FE"><enum>(2)</enum><text>The actions taken
			 to implement a tracking and reporting system for resources expended for
			 approval and outreach activities by such agencies.</text>
					</paragraph><paragraph id="idA6724A40ACAB48B99421EFF11F22D0E0"><enum>(3)</enum><text>Any
			 recommendations for legislative action that the Secretary considers appropriate
			 to achieve the complete implementation of the standards described in paragraph
			 (1).</text>
					</paragraph></subsection></section><section id="idB88CCE34AFA746D590D0173C5BE8B175" section-type="subsequent-section"><enum>302.</enum><header>Enhanced authority
			 for reimbursement of State approving agencies for expenses</header><text display-inline="no-display-inline">Section 3674(a) is amended—</text>
				<paragraph id="idC5977529F0D54B9291B62106044AEE5D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)—</text>
					<subparagraph id="idC81424FA6E694691966B2EB3428F960F"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>, out of amounts
			 available for the payment of readjustment benefits,</quote>; and</text>
					</subparagraph><subparagraph id="id5CC399752BE944FD93130D1D2A1F73B8"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 sentence: <quote>Subject to paragraph (4), such payments shall be made first
			 out of amounts available for the payment of readjustment benefits and then from
			 other amounts made available to make such payments.</quote>; and</text>
					</subparagraph></paragraph><paragraph id="idBD9DD95C67E34AF78D9DEAB0CA994DF7"><enum>(2)</enum><text display-inline="yes-display-inline">by amending paragraph (4) to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="id6ADA7047BC734740A1F11A1C85C17EA0" style="OLC">

				purposes of this section from amounts available for the payment of readjustment
				benefits may not exceed $13,000,000 in each of fiscal years 2008 through 2012;
				and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id2C7C3AF4FC35423B8FF9ED94E40FC28E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">no amount may be made available for such
				purposes from amounts available for the payment of readjustment benefits after
				fiscal year 2012.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A0FB8DF93FA4565B47B33C81FB31CD5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For any fiscal year in which the total
				amount that would be made available under this section would exceed the amount
				applicable to that fiscal year under subparagraph (A) except for the provisions
				of this paragraph, the Secretary shall provide that each agency shall receive
				the same percentage of the amount applicable to that fiscal year under
				subparagraph (A) as the agency would have received of the total amount that
				would have been made available without the limitation of this
				paragraph.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idB9DC173A6A1048319135C356C6D510DC"><enum>303.</enum><header>Waiver of
			 residency requirement for Directors for Veterans' Employment and
			 Training</header><text display-inline="no-display-inline">Section 4103(a)(2) is
			 amended—</text>

			 <quote>(A)</quote> after <quote>(2)</quote>; and</text>

			 special unemployment study to cover veterans of Post 9/11 Global

			 study</header><text display-inline="yes-display-inline">Subsection (a)(1) of
			 section 4110A is amended—</text>

			 striking <quote>a study every two years</quote> and inserting <quote>an annual

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id39A54161E46B45F6A46048095B32517B" section-type="subsequent-section"><enum>305.</enum><header>Extension of
			 increase in benefit for individuals pursuing apprenticeship or on-job
			 training</header><text display-inline="no-display-inline">Section 103 of the
			 Veterans Benefits Improvement Act of 2004 (Public Law 108–454; 118 Stat. 3600)
			 is amended by striking <quote>2008</quote> each place it appears and inserting
			 <quote>2010</quote>.</text>

			 supplemental educational assistance for members of the Selected Reserve with

			 eligibility for benefits provided by Department of Veterans Affairs for certain
			 service in the organized military forces of the Commonwealth of the Philippines
			 and the Philippine Scouts</header>
				<subsection id="id972F16B76734416884EB53DBA23B0831"><enum>(a)</enum><header>Modification of
			 status of certain service</header>
					<paragraph id="id3020C76E2FE740199B0C5077424C603D"><enum>(1)</enum><header>In
			 general</header><text>Section 107 is amended to read as follows:</text>

				have been active military, naval, or air service for purposes of any law of the
				United States conferring rights, privileges, or benefits upon any individual by
				reason of the service of such individual or the service of any other individual
				in the Armed Forces.</text>
								</subsection><subsection id="idFB49402F855040079B485AA9FD9536E8"><enum>(b)</enum><header>Service
				described</header><text display-inline="yes-display-inline">Service described
				in this subsection is service—</text>
									<paragraph id="id705DAF4B60C542C9B16FC1BE9CD5BB3E"><enum>(1)</enum><text display-inline="yes-display-inline">before July 1, 1946, in the organized
				military forces of the Government of the Commonwealth of the Philippines, while
				such forces were in the service of the Armed Forces of the United States
				pursuant to the military order of the President dated July 26, 1941, including
				among such military forces organized guerrilla forces under commanders
				appointed, designated, or subsequently recognized by the Commander in Chief,
				Southwest Pacific Area, or other competent authority in the Army of the United
				States; or</text>
									</paragraph><paragraph id="id3F13AC11A75B47C39839EC99F6FDD40A"><enum>(2)</enum><text display-inline="yes-display-inline">in the Philippine Scouts under section 14
				of the Armed Forces Voluntary Recruitment Act of 1945 (59 Stat. 538).</text>
									</paragraph></subsection><subsection id="id97000A3F963D4727BC4C99E298120ECD"><enum>(c)</enum><header>Dependency and
				indemnity compensation for certain recipients residing outside the United
				States</header><paragraph commented="no" display-inline="yes-display-inline" id="id24C1D31F859D4CFF92B88759C9203121"><enum>(1)</enum><text>Dependency and
				indemnity compensation provided under chapter 13 of this title to an individual
				described in paragraph (2) shall be made at a rate of $0.50 for each dollar
				authorized.</text>
									</paragraph><paragraph id="id7C4762637B31422B97DB98B13DAE2377" indent="up1"><enum>(2)</enum><text>An individual described in this
				paragraph is an individual who resides outside the United States and is
				entitled to dependency and indemnity compensation under chapter 13 of this
				title based on service described in subsection (b).</text>
									</paragraph></subsection><subsection id="id5A6895E8633844E1B555B36A51A666A5"><enum>(d)</enum><header>Exception on
				pension and death pension for individuals residing outside the United
				States</header><text>An individual who resides outside the United States shall
				not, while so residing, be entitled to a pension under subchapter II or III of
				chapter 15 of this title based on service described in subsection (b).</text>

			 enactment of this Act. No benefits are payable or are required to be provided
			 by reason of such amendment for any period before such date.</text>
					</paragraph></subsection><subsection id="id4BBA895A42174E9FB871FC87AED1CD17"><enum>(b)</enum><header>Pension and
			 death pension benefit protection</header><text>Notwithstanding any other
			 provision of law, a veteran with service described in section 107(b) of title
			 38, United States Code (as added by subsection (a)), who is receiving benefits
			 under a Federal or federally assisted program as of the date of the enactment
			 of this Act, or a survivor of such veteran who is receiving such benefits as of
			 the date of the enactment of this Act, may not be required to apply for or
			 receive benefits under chapter 15 of such title if the receipt of such benefits
			 would—</text>
					<paragraph id="id025FA3C1844C44E9AE89C4B741640E44"><enum>(1)</enum><text display-inline="yes-display-inline">make such veteran or survivor ineligible
			 for any Federal or federally assisted program for which such veteran or
			 survivor qualifies; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEAF1F6A26F0F4A33BF59E7390325ADD2"><enum>(2)</enum><text display-inline="yes-display-inline">reduce the amount of benefit such veteran
			 or survivor would receive from any Federal or federally assisted program for
			 which such veteran or survivor qualifies.</text>
					</paragraph></subsection></section><section id="id5F995946B89A49B6BBAA6399EBC02985"><enum>402.</enum><header>Eligibility of
			 children of certain Philippine veterans for educational assistance</header>
				<subsection commented="no" display-inline="no-display-inline" id="idCD53C705CD6642EAB41A445FA6233B15"><enum>(a)</enum><header>In
			 general</header><text>Subsection (b) of section 3565 is amended by striking
			 <quote>except that—</quote> and all that follows and inserting <quote>except

			 States Court of Appeals for Veterans Claims</header>
				<subsection commented="no" display-inline="no-display-inline" id="id6A5F6D7C14D64778ABD917AE6001547F"><enum>(a)</enum><header display-inline="yes-display-inline">Repeal of limit on service of recalled
			 retired judges who voluntarily serve more than 90 days</header><text display-inline="yes-display-inline">Section 7257(b)(2) is amended by striking
			 <quote>or for more than a total of 180 days (or the equivalent) during any
			 calendar year</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idF0950774C3064049AC8F383D3075DEAB"><enum>(b)</enum><header display-inline="yes-display-inline">New judges recalled after retirement
			 receive pay of current judges only during period of recall</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id030129CE3919491CA4197E07CB10D717"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7296(c) is amended by striking
			 paragraph (1) and inserting the following new paragraph:</text>

				date of the enactment of the <short-title>Veterans'
				Benefits Enhancement Act of 2008</short-title> and who retires under subsection
				(b) and elects under subsection (d) to receive retired pay under this
				subsection shall (except as provided in paragraph (2)) receive retired pay as
				follows:</text>
									<clause commented="no" display-inline="no-display-inline" id="id2C3A9365F9144E67A1F3AC98CFA4F1FF" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">In
				the case of a judge who is a recall-eligible retired judge under section 7257
				of this title, the retired pay of the judge shall (subject to section
				7257(d)(2) of this title) be the rate of pay applicable to that judge at the
				time of retirement, as adjusted from time to time under subsection
				(f)(3).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id4DEBD6388FC144898E4168D3F826091E" indent="up1"><enum>(ii)</enum><text>In the case of a judge other than a
				recall-eligible retired judge, the retired pay of the judge shall be the rate
				of pay applicable to that judge at the time of retirement.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12C2275470D7412B8EC01F579B00102D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A
				judge who retired before the date of the enactment of the
				<short-title>Veterans' Benefits Enhancement Act of
				2008</short-title> and elected under subsection (d) to receive retired pay
				under this subsection, or a judge who retires under subsection (b) and elects
				under subsection (d) to receive retired pay under this subsection, shall
				(except as provided in paragraph (2)) receive retired pay as follows:</text>
									<clause commented="no" display-inline="no-display-inline" id="HE7EA998E49596E53FFB8B2946E46E85"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of a judge who is a
				recall-eligible retired judge under section 7257 of this title or who was a
				recall-eligible retired judge under that section and was removed from recall
				status under subsection (b)(4) of that section by reason of disability, the
				retired pay of the judge shall be the pay of a judge of the court.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HB03279D44B9F14F8EF55B5BB50CAFF2"><enum>(ii)</enum><text display-inline="yes-display-inline">In the case of a judge who at the time of
				retirement did not provide notice under section 7257 of this title of
				availability for service in a recalled status, the retired pay of the judge
				shall be the rate of pay applicable to that judge at the time of
				retirement.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H38521DC74D9C01FCF140FEA707A912E"><enum>(iii)</enum><text display-inline="yes-display-inline">In the case of a judge who was a
				recall-eligible retired judge under section 7257 of this title and was removed
				from recall status under subsection (b)(3) of that section, the retired pay of
				the judge shall be the pay of the judge at the time of the removal from recall
				status.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFD2A9ABE9D8B4C5FBAFB3A718AC67450"><enum>(2)</enum><header>Cost-of-living

				of pay in effect under section 7253(e) of this title for a judge performing
				active service, less the amount of the judge's annuity under the applicable
				provisions of chapter 83 or 84 of title 5 or the judge's annuity under section
				7296(c)(1)(A) of this title, whichever is
				applicable.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idED982A7C39E14500887F4C1FCE152DB4"><enum>(4)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">The last sentence of section 7257(a)(1) is
			 amended to read as follows: <quote>Such a notice provided by a retired judge to
			 whom section 7296(c)(1)(B) of this title applies is
			 irrevocable.</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5119F7AA62694BCD9705D246A81FDE43"><enum>(c)</enum><header>Limitation on
			 involuntary recalls</header><text>Section 7257(b)(3) is amended by adding at
			 the end the following new sentence: <quote>This paragraph shall not apply to a
			 judge to whom section 7296(c)(1)(A) or 7296(c)(1)(B) of this title applies and
			 who has, in the aggregate, served at least five years of recalled service on
			 the Court under this section.</quote>.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idAD7513794CC540378775C12B816AE806" section-type="subsequent-section"><enum>502.</enum><header display-inline="yes-display-inline">Additional discretion in imposition of
			 practice and registration fees</header><text display-inline="no-display-inline">Section 7285(a) is amended—</text>

				annually to the appropriate committees of Congress a report summarizing the
				workload of the Court for the last fiscal year that ended before the submission
				of such report. Such report shall include, with respect to such fiscal year,
				the following information:</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEA8EB990D63C4BF4A7547FE6A39A5252"><enum>(3)</enum><text display-inline="yes-display-inline">The number of applications filed under
				section 2412 of title 28.</text>

				<subsection commented="no" display-inline="no-display-inline" id="id193A2E77C3F04F5ABCD85401AD89FDB4"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDb7e009e225ac4874a06260e0b840802d"><enum>(1)</enum><text display-inline="yes-display-inline">The United States Court of Appeals for
			 Veterans Claims is currently located in the District of Columbia in a
			 commercial office building that is also occupied by other Federal
			 tenants.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf269c94d3fa44134bd22832176cc8598"><enum>(2)</enum><text display-inline="yes-display-inline">In February 2006, the General Services
			 Administration provided Congress with a preliminary feasibility analysis of a
			 dedicated Veterans Courthouse and Justice Center that would house the Court and
			 other entities that work with the Court.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdcf5bcc692574247bf323da0d5e66c65"><enum>(3)</enum><text display-inline="yes-display-inline">In February 2007, the Court notified
			 Congress that the <quote>most cost-effective alternative appears to be leasing
			 substantial additional space in the current location</quote>, which would
			 <quote>require relocating other current government tenants</quote> from that
			 building.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb8750a46078446979fa6c903a247affb"><enum>(4)</enum><text display-inline="yes-display-inline">The February 2006 feasibility report of the
			 General Services Administration does not include an analysis of whether it
			 would be feasible or desirable to locate a Veterans Courthouse and Justice
			 Center at the current location of the Court.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDda8809a6e07a4e5b8d27b3cba449650e"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID1ed4921cf2f44f0e9106ea6d6e2e156c"><enum>(1)</enum><text display-inline="yes-display-inline">the United States Court of Appeals for
			 Veterans Claims should be provided with appropriate office space to meet its
			 needs, as well as to provide the image, security, and stature befitting a court
			 that provides justice to the veterans of the United States; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5d31f226c28a451c82509bf4d116258b"><enum>(2)</enum><text display-inline="yes-display-inline">in providing that space, Congress should
			 avoid undue disruption, inconvenience, or cost to other Federal
			 entities.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id723E8CF606234933BDB8B8DB0F6A564F"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id3773C900FDA44D7E8E0B8D07D597C623"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Administrator of General Services shall submit
			 to the Committee on Veterans’ Affairs of the Senate and the Committee on
			 Veterans’ Affairs of the House of Representatives a report on the feasibility
			 of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id2AFACF14C42D469F9C35FEA2E0E075E1"><enum>(A)</enum><text display-inline="yes-display-inline">leasing additional space for the United
			 States Court of Appeals for Veterans Claims within the building where the Court
			 was located on the date of the enactment of this Act; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id276A1973C458451F9F5A2947DD8BA989"><enum>(B)</enum><text display-inline="yes-display-inline">using the entirety of such building as a
			 Veterans Courthouse and Justice Center.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBDC064263EEC41128B3830ABDD994B23"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall
			 include a detailed analysis of the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id4D41D0B5FE0C49C1B24481FEF3D121BB"><enum>(A)</enum><text display-inline="yes-display-inline">The impact that the matter analyzed in
			 accordance with paragraph (1) would have on Federal tenants of the building
			 used by the Court.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC7ABF551CC2546EB9A52C4BAB77E51B8"><enum>(B)</enum><text display-inline="yes-display-inline">Whether it would be feasible to relocate
			 such Federal tenants into office space that offers similar or preferable cost,
			 convenience, and usable square footage.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF9D15493F7D74DF4B0B77839357C79BF"><enum>(C)</enum><text display-inline="yes-display-inline">If relocation of such Federal tenants is
			 found to be feasible and desirable, an analysis of what steps should be taken
			 to convert the building into a Veterans Courthouse and Justice Center and a
			 timeline for such conversion.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id010E1FA4F6CA417CBBD191639BCDB912"><enum>(3)</enum><header display-inline="yes-display-inline">Comment
			 period</header><text display-inline="yes-display-inline">The Administrator
			 shall provide an opportunity to such Federal tenants—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idA7835A457A4A43C2AC60C739E5C9E8BE"><enum>(A)</enum><text display-inline="yes-display-inline">before the completion of the report
			 required by paragraph (1), to comment on the subject of the report required by
			 such paragraph; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA1B6C0BFC8B84739B6B2C300A39D90A8"><enum>(B)</enum><text display-inline="yes-display-inline">before the Administrator submits the report
			 required by paragraph (1) to the congressional committees specified in such
			 paragraph, to comment on a draft of such report.</text>
						</subparagraph></paragraph></subsection></section></title><title id="id7E82FFA6BA124AB38B87E81916D3E387"><enum>VI</enum><header>COMPENSATION AND
			 PENSION MATTERS</header>
			<section id="id5CE4F9EEDB394E6082F0C3211E19007C"><enum>601.</enum><header>Addition of
			 osteoporosis to disabilities presumed to be service-connected in former
			 prisoners of war with post-traumatic stress disorder</header><text display-inline="no-display-inline">Section 1112(b)(2) is amended by adding at
			 the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="id52472AC1F3DB49658A5441AEF8B9BB9B" style="OLC">
					<subparagraph id="id95041D4CBDDC400091A46F371D989AF9" indent="up1"><enum>(F)</enum><text>Osteoporosis, if the Secretary
				determines that the veteran was diagnosed with post-traumatic stress disorder
				(PTSD).</text>

			</section><section id="id7E587EB287B24B568C736CAF1F3FE081"><enum>602.</enum><header>Cost-of-living
			 increase for temporary dependency and indemnity compensation payable for
			 surviving spouses with dependent children under the age of 18</header><text display-inline="no-display-inline">Section 1311(f) is amended by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="id757B3209CBE04443BC4234C5FF6E0630" style="OLC">
					<paragraph id="idF07CC90641F34E7B877692477297F420" indent="up1"><enum>(5)</enum><text>Whenever there is an increase in
				benefit amounts payable under title II of the Social Security Act (42 U.S.C.
				401 et seq.) as a result of a determination made under section 215(i) of such
				Act (42 U.S.C. 415(i)), the Secretary shall, effective on the date of such
				increase in benefit amounts, increase the amount payable under paragraph (1),
				as such amount was in effect immediately prior to the date of such increase in
				benefit amounts, by the same percentage as the percentage by which such benefit
				amounts are increased. Any increase in a dollar amount under this paragraph
				shall be rounded down to the next lower whole dollar
				amount.</text>

			</section><section id="idBBBB8DC86F4C41CBB48BBFAE8BA45B07" section-type="subsequent-section"><enum>603.</enum><header>Clarification of
			 eligibility of veterans 65 years of age or older for service pension for a
			 period of war</header><text display-inline="no-display-inline">Section 1513 is
			 amended—</text>

				retail cost of new automobiles for the preceding calendar year.</text>
								</paragraph><paragraph id="idC3E1228B927247E599BB87C969B89856" indent="up1"><enum>(2)</enum><text>The Secretary shall establish the
				method for determining the average retail cost of new automobiles for purposes
				of this subsection. The Secretary may use data developed in the private sector
				if the Secretary determines the data is appropriate for purposes of this
				subsection.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idCE7A81B24C3F4DF38188A2757457DBAB"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 July 1, 2008, and shall apply with respect to payments made in accordance with
			 section 3902 of title 38, United States Code, on or after that date.</text>

			 of purpose of the outreach services program of the Department of Veterans
			 Affairs</header>
				<subsection id="id9240690C4C2E4EB7B9F64C0D5B616B35"><enum>(a)</enum><header>Clarification
			 of inclusion of members of the National Guard and Reserve in
			 program</header><text display-inline="yes-display-inline">Subsection (a)(1) of
			 section 6301 is amended by inserting <quote>, or from the National Guard or
			 Reserve,</quote> after <quote>active military, naval, or air
			 service</quote>.</text>
				</subsection><subsection id="id3CCD655357DD49D1BB8553274ED5271B"><enum>(b)</enum><header>Definition of
			 outreach</header><text>Subsection (b) of such section is amended—</text>

				for, any benefits and programs under such
				laws;</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="idC6D8B010C9EF4E05A6411602EDB44034"><enum>804.</enum><header>Termination or
			 suspension of contracts for cellular telephone service for servicemembers
			 undergoing deployment outside the United States</header>
				<subsection id="id4A1C82461FEF4C0FB71D57767381E713"><enum>(a)</enum><header>In
			 general</header><text>Title III of the Servicemembers Civil Relief Act (50
			 U.S.C. App. 531 et seq.) is amended by inserting after section 305 the
			 following new section:</text>
					<quoted-block display-inline="no-display-inline" id="idA09C96105D2D4074B9DDDDABC1B63431" style="OLC">
						<section id="idBDD4E7274526487596AA58DE640E08CA"><enum>305A.</enum><header>Termination
				or suspension of contracts for cellular telephone service</header>
							<subsection id="idC83A646AECCD4048AC4FBAC94C636202"><enum>(a)</enum><header>In
				general</header><text>A servicemember who receives orders to deploy outside of
				the continental United States for not less than 90 days may request the
				termination or suspension of any contract for cellular telephone service
				entered into by the servicemember before that date if the servicemember’s
				ability to satisfy the contract or to utilize the service will be materially
				affected by that period of deployment. The request shall include a copy of the
				servicemember's military orders.</text>
							</subsection><subsection id="idABAD1A8198C34D769FFFE775F5067A1E"><enum>(b)</enum><header>Relief</header><text>Upon
				receiving the request of a servicemember under subsection (a), the cellular
				telephone service contractor concerned shall, at the election of the
				contractor—</text>
								<paragraph id="idDADCD16552204ADFBB007C055FC9472C"><enum>(1)</enum><text>grant the
				requested relief without imposition of an early termination fee for termination
				of the contract or a reactivation fee for suspension of the contract; or</text>
								</paragraph><paragraph id="idB30B9A9390EE4F6691D9B89CC544B835"><enum>(2)</enum><text>permit the
				servicemember to suspend the contract at no charge until the end of the
				deployment without requiring, whether as a condition of suspension or
				otherwise, that the contract be
				extended.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id01C5EC86A4544B7F8D9FFBDE8CDD0A43"><enum>(b)</enum><header>Clerical

			 management, and availability for research of assets of Air Force Health
			 Study</header>
				<subsection id="id13A3DE819CFD4A3F8E52DE8D28288BAB"><enum>(a)</enum><header>Purpose</header><text>The
			 purpose of this section is to ensure that the assets transferred to the Medical
			 Follow-Up Agency from the Air Force Health Study are maintained, managed, and
			 made available as a resource for future research for the benefit of veterans
			 and their families, and for other humanitarian purposes.</text>
				</subsection><subsection id="idFA7A017C01CE4FD18C6C579E38DCA51B"><enum>(b)</enum><header>Assets from Air
			 Force Health Study</header><text>For purposes of this section, the assets
			 transferred to the Medical Follow-Up Agency from the Air Force Health Study are
			 the assets of the Air Force Health Study transferred to the Medical Follow-Up
			 Agency under section 714 of the John Warner National Defense Authorization Act
			 for Fiscal Year 2007 (Public Law 109–364; 120 Stat. 2290), including electronic
			 data files and biological specimens on all participants in the study (including
			 control subjects).</text>
				</subsection><subsection id="id4F20C97769884CB9AFA79D8C1C7E2409"><enum>(c)</enum><header>Maintenance and
			 management of transferred assets</header><text>The Medical Follow-Up Agency
			 shall maintain and manage the assets transferred to the Agency from the Air
			 Force Health Study.</text>
				</subsection><subsection id="idDC71E176C3B54BBD9BC0ACEB7F1BC10B"><enum>(d)</enum><header>Additional
			 near-term research</header>
					<paragraph id="id97ECEC2B07344021A94482EBE7CEDEFA"><enum>(1)</enum><header>In
			 general</header><text>The Medical Follow-Up Agency may, during the period
			 beginning on October 1, 2007, and ending on September 30, 2011, conduct such
			 additional research on the assets transferred to the Agency from the Air Force
			 Health Study as the Agency considers appropriate toward the goal of
			 understanding the determinants of health, and promoting wellness, in
			 veterans.</text>
					</paragraph><paragraph id="id38680590D8A3404EA8564145A9F69FBD"><enum>(2)</enum><header>Research</header><text>In
			 carrying out research authorized by this subsection, the Medical Follow-Up
			 Agency may, utilizing amounts available under subsection (f)(1)(B), make grants
			 for such pilot studies for or in connection with such research as the Agency
			 considers appropriate.</text>
					</paragraph></subsection><subsection id="id7DBAE9BC5B834150AFE3604107EE4E68"><enum>(e)</enum><header>Additional
			 medium-term research</header>
					<paragraph id="id7F8E263FE2674406B68B95E68F2F992B"><enum>(1)</enum><header>Report</header><text>Not
			 later than March 31, 2011, the Medical Follow-Up Agency shall submit to
			 Congress a report assessing the feasability and advisability of conducting
			 additional research on the assets transferred to the Agency from the Air Force
			 Health Study after September 30, 2011.</text>
					</paragraph><paragraph id="id5AF7CACB91A341BB9B966825CF3F5EBE"><enum>(2)</enum><header>Disposition of
			 assets</header><text>If the report required by paragraph (1) includes an
			 assessment that the research described in that paragraph would be feasible and
			 advisable, the Agency shall, utilizing amounts available under subsection
			 (f)(2), make any disposition of the assets transferred to the Agency from the
			 Air Force Health Study as the Agency considers appropriate in preparation for
			 such research.</text>
					</paragraph></subsection><subsection id="id4C4C12D193FF4D62927262431D93CCCF"><enum>(f)</enum><header>Funding</header>
					<paragraph id="id239CA2A8E96441DB8BC0FEBD5F4E3E83"><enum>(1)</enum><header>In
			 general</header><text>From amounts available for each of fiscal years 2008
			 through 2011 for the Department of Veterans Affairs for Medical and Prosthetic
			 Research, amounts shall be available as follows:</text>
						<subparagraph id="id0779AF5ED7EF4363A6AC9E8A7CC05697"><enum>(A)</enum><text>$1,200,000 shall
			 be available in each such fiscal year for maintenance, management, and
			 operation (including maintenance of biological specimens) of the assets
			 transferred to the Medical Follow-Up Agency from the Air Force Health
			 Study.</text>
						</subparagraph><subparagraph id="idAA78B8AE3D2F4525BCC149FD47F06731"><enum>(B)</enum><text>$250,000 shall be
			 available in each such fiscal year for the conduct of additional research
			 authorized by subsection (d), including the funding of pilot studies authorized
			 by paragraph (2) of that subsection.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id421B73C621F74EB28C1072BCADE12025"><enum>(2)</enum><header>Medium-term
			 research</header><text>From amounts available for fiscal year 2011 for the
			 Department of Veterans Affairs for Medical and Prosthetic Research, $200,000
			 shall be available for the preparation of the report required by subsection
			 (e)(1) and for the disposition, if any, of assets authorized by subsection
			 (e)(2).</text>
					</paragraph></subsection></section><section id="idFEF1482BD08343C88FE3C8464B938C16"><enum>806.</enum><header>National
			 Academies study on risk of developing multiple sclerosis as a result of certain
			 service in the Persian Gulf War and Post 9/11 Global Operations
			 theaters</header>
				<subsection id="idDD07E6550E6A4D6FAE0420353B4502E9"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Veterans Affairs shall enter into a
			 contract with the Institute of Medicine of the National Academies to conduct a
			 comprehensive epidemiological study for purposes of identifying any increased
			 risk of developing multiple sclerosis as a result of service in the Armed
			 Forces during the Persian Gulf War in the Southwest Asia theater of operations
			 or in the Post 9/11 Global Operations theaters.</text>
				</subsection><subsection id="id0E36ECBA747D42BCB230499556D47962"><enum>(b)</enum><header>Elements</header><text>In
			 conducting the study required under subsection (a), the Institute of Medicine
			 shall do the following:</text>
					<paragraph id="id2E8A08EDE61645FC9F80B4F346DB0983"><enum>(1)</enum><text>Determine whether
			 service in the Armed Forces during the Persian Gulf War in the Southwest Asia
			 theater of operations, or in the Post 9/11 Global Operations theaters,
			 increased the risk of developing multiple sclerosis.</text>
					</paragraph><paragraph id="idD6DA6164FDB54721BFA216AC894517DE"><enum>(2)</enum><text>Identify the
			 incidence and prevalence of diagnosed neurological diseases, including multiple
			 sclerosis, Parkinson's disease, amyotrophic lateral sclerosis, and brain
			 cancers, as well as central nervous system abnormalities that are difficult to
			 precisely diagnose, in each group as follows:</text>
						<subparagraph id="id09E2545638B14F7998A3F4CE340FD655"><enum>(A)</enum><text>Members of the
			 Armed Forces who served during the Persian Gulf War in the Southwest Asia
			 theater of operations.</text>
						</subparagraph><subparagraph id="idA919ADDAA9004266848528AE248185D9"><enum>(B)</enum><text>Members of the
			 Armed Forces who served in the Post 9/11 Global Operations theaters.</text>
						</subparagraph><subparagraph id="id8AE4E0795916444CB1FCBA76F3499C2A"><enum>(C)</enum><text>A non-deployed
			 comparison group for those who served in the Persian Gulf War in the Southwest
			 Asia theater of operations and the Post 9/11 Global Operations theaters.</text>
						</subparagraph></paragraph><paragraph id="id96ECD4B778074EDDB03719C8713D9566"><enum>(3)</enum><text>Compare the
			 incidence and prevalence of the named diagnosed neurological diseases and
			 undiagnosed central nervous system abnormalities among veterans who served
			 during the Persian Gulf War in the Southwest Asia theater of operations, or in
			 the Post 9/11 Global Operations theaters, in various locations during such
			 periods, as determined by the Institute of Medicine.</text>
					</paragraph><paragraph id="idE7093BC65B844F929A8A195107539F25"><enum>(4)</enum><text>Collect
			 information on risk factors, such as pesticide and other toxic exposures, to
			 which veterans were exposed while serving during the Persian Gulf War in the
			 Southwest Asia theater of operations or the Post 9/11 Global Operations
			 theaters, or thereafter.</text>
					</paragraph></subsection><subsection id="id2E2DF739C8EB4963BC6C751E2D2A44F4"><enum>(c)</enum><header>Reports</header>
					<paragraph id="id089A5E1FE16E4C1A85B2CC05937F7D86"><enum>(1)</enum><header>Interim
			 report</header><text>The contract required by subsection (a) shall require the
			 Institute of Medicine to submit to the Secretary, and to appropriate committees
			 of Congress, interim progress reports on the study required under subsection
			 (a). Such reports shall not be required to include a description of interim
			 results on the work under the study.</text>
					</paragraph><paragraph id="id49E2B1F6282A4010A24639CF55A7FE9A"><enum>(2)</enum><header>Final
			 report</header><text>The contract shall require the Institute of Medicine to
			 submit to the Secretary, and to appropriate committees of Congress, a final
			 report on the study by not later than December 31, 2010. The final report shall
			 include such recommendations for legislative or administrative action as the
			 Institute considers appropriate in light of the results of the study.</text>
					</paragraph></subsection><subsection id="idDE115F44510B4A3FA07BFCE70A1CB19C"><enum>(d)</enum><header>Funding</header><text>The
			 Secretary shall provide the Institute of Medicine with such funds as are
			 necessary to ensure the timely completion of the study required under
			 subsection (a).</text>
				</subsection><subsection id="idB85DFE034F414917AFEC38C06FA4FCC2"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="id01BF08115BC8467EB411872FE95897AA"><enum>(1)</enum><text>The term
			 <term>appropriate committees of Congress</term> means—</text>
						<subparagraph id="idCD4DA53ABE934AD7B845A5674D2C5C52"><enum>(A)</enum><text>the Committee on
			 Veterans' Affairs of the Senate; and</text>
						</subparagraph><subparagraph id="id535CE89E6E2F40F7BC9E9893E7BDD383"><enum>(B)</enum><text>the Committee on
			 Veterans' Affairs of the House of Representatives.</text>
						</subparagraph></paragraph><paragraph id="id6B56BAB6A2224482ABAAEAB34E1F0C7F"><enum>(2)</enum><text>The term
			 <term>Persian Gulf War</term> has the meaning given that term in section
			 101(33) of title 38, United States Code.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21DBA269D43F4D369BA35A4914E69CBC"><enum>(3)</enum><text>The term
			 <term>Post 9/11 Global Operations theaters</term> means Afghanistan, Iraq, or
			 any other theater in which the Global War on Terrorism Expeditionary Medal is
			 awarded for service.</text>
					</paragraph></subsection></section><section id="id489088AEE32140EC992F005C8DAE5AF1"><enum>807.</enum><header>Comptroller
			 General report on adequacy of dependency and indemnity compensation to maintain
			 survivors of veterans who die from service-connected disabilities</header>
				<subsection id="id5E3B01CC1BD646BBA5A10386FA0AC166"><enum>(a)</enum><header>Report
			 required</header><text display-inline="yes-display-inline">Not later than 10
			 months after the date of the enactment of this Act, the Comptroller General of
			 the United States shall submit to the Committees on Veterans' Affairs and
			 Appropriations of the Senate and the Committees on Veterans' Affairs and
			 Appropriations of the House of Representatives a report on the adequacy of
			 dependency and indemnity compensation payable under chapter 13 of title 38,
			 United States Code, to surviving spouses and dependents of veterans who die as
			 a result of a service-connected disability in replacing the deceased veteran's
			 income.</text>
				</subsection><subsection id="idAE734DAB12A04067AD194246291D8BF5"><enum>(b)</enum><header>Elements</header><text>The
			 report required by subsection (a) shall include—</text>
					<paragraph id="id67A9524A75EB4BD1B200A0F8066851E1"><enum>(1)</enum><text>a description of
			 the current system for the payment of dependency and indemnity compensation to
			 surviving spouses and dependents described in subsection (a), including a
			 statement of the rates of such compensation so payable;</text>
					</paragraph><paragraph id="id79D945C6F7C6415188FA37BFB9F4CFD1"><enum>(2)</enum><text>an assessment of
			 the adequacy of such payments in replacing the deceased veteran's income;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4468ADC00142467AAD480BFFE1E18D85"><enum>(3)</enum><text>such
			 recommendations as the Comptroller General considers appropriate in order to
			 improve or enhance the effects of such payments in replacing the deceased
			 veteran's income.</text>
