		<official-title>To facilitate the development, demonstration, and
		  implementation of technology for use in removing carbon dioxide and other
		  greenhouse gases from the atmosphere.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Greenhouse Gas Emission
			 Atmospheric Removal Act</short-title></quote> or the <quote>GEAR
			 Act</quote>.</text>
		</section><section id="id4BDE389259F64C599DD100F9EF072B3E"><enum>2.</enum><header>Statement of
			 policy</header><text display-inline="no-display-inline">It is the policy of the
			 United States to provide incentives to encourage the development and
			 implementation of technology to permanently remove greenhouse gases from the
			 atmosphere on a significant scale.</text>
		</section><section id="ID190de44ba7b54ece9594162abfe0feca"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id0E7E2B31D67047A9AEC49833EBA60491"><enum>(1)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Greenhouse Gas Emission Atmospheric
			 Removal Commission established by section 5(a).</text>
			</paragraph><paragraph id="idBFF6D12C85764C099BC8E9A701955563"><enum>(2)</enum><header>Greenhouse
			 gas</header><text>The term <term>greenhouse gas</term> means—</text>
				<subparagraph id="id9EF6654DE6C8492EA670CF2AD224DAA6"><enum>(A)</enum><text>carbon
			 dioxide;</text>
				</subparagraph><subparagraph id="id26594D85CCB04FF5B3654EA4C5BB54A8"><enum>(B)</enum><text>methane;</text>
				</subparagraph><subparagraph id="id441C348EB75347DA8574E042CCD1069B"><enum>(C)</enum><text>nitrous
			 oxide;</text>
				</subparagraph><subparagraph id="id1A452028FE0C45EEACEE29451C80AD6D"><enum>(D)</enum><text>sulfur
			 hexafluoride;</text>
				</subparagraph><subparagraph id="idD1591132F44C445598A04CD360C2A86C"><enum>(E)</enum><text>a
			 hydrofluorocarbon;</text>
				</subparagraph><subparagraph id="idEA54ADCFF794477D893516147F245136"><enum>(F)</enum><text>a
			 perfluorocarbon; and</text>
				</subparagraph><subparagraph id="idF1C5C20428044975B265ED6230E93C6B"><enum>(G)</enum><text>any other gas
			 that the Commission determines is necessary to achieve the purposes of this
			 Act.</text>
				</subparagraph></paragraph><paragraph id="idA2D57CC9CB7C48F3A3CE00F0BFAD9748"><enum>(3)</enum><header>Intellectual
			 property</header><text>The term <term>intellectual property</term>
			 means—</text>
				<subparagraph id="idB4D754F46E474744B17C3570ABF85139"><enum>(A)</enum><text>an invention that
			 is patentable under title 35, United States Code; and</text>
				</subparagraph><subparagraph id="id58F7D8F4DEEE4E0BAC0AECAF5FBB99BA"><enum>(B)</enum><text>any patent on an
			 invention described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="id5AB7C83416B243449349E863D2B86A54"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
			</paragraph></section><section id="id0E9C5A9B65814E51B53C64571782E9A0"><enum>4.</enum><header>Greenhouse Gas
			 Emission Atmospheric Removal Program</header><text display-inline="no-display-inline">The Secretary, acting through the
			 Commission, shall provide to public and private entities, on a competitive
			 basis, financial awards for the achievement of milestones in developing and
			 applying technology that could significantly slow or reverse the accumulation
			 of greenhouse gases in the atmosphere by permanently capturing or sequestrating
			 those gases without significant countervailing harmful effects.</text>
		</section><section id="ID2902917ff03c47d3a86fadc4b025b212"><enum>5.</enum><header>Greenhouse Gas
			 Emission Atmospheric Removal Commission</header>
			<subsection id="IDFF26917619E146A894A6DDD0521C8CC3"><enum>(a)</enum><header>Establishment</header><text>There
			 is established within the Department of Energy a commission to be known as the
			 <quote>Greenhouse Gas Emission Atmospheric Removal Commission</quote>.</text>
			</subsection><subsection id="IDE66DED6B9FD448588D810E13AEF3D4FD"><enum>(b)</enum><header>Membership</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID85686DDB8C2C416F8A8E7FAB7C30F02E"><enum>(1)</enum><header>Composition</header><text>The
			 Commission shall be composed of 11 members appointed by the President, by and
			 with the advice and consent of the Senate, who shall provide expertise
			 in—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idFD78CEF96AA94E8E958760EA9733BB47"><enum>(A)</enum><text>climate
			 science;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5801B64800BA459DAAFA0F0DAEAD0483"><enum>(B)</enum><text>physics;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6CBF6B5F7ED142D9A2CDED527D70EC53"><enum>(C)</enum><text>chemistry;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBD839A28BFCC4EB289545559B05EAD6B"><enum>(D)</enum><text>biology;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB30D8E3CC3F04357BA3AFD7166DEF03F"><enum>(E)</enum><text>engineering;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBEE44E98B5C24435A5D7E94D90268697"><enum>(F)</enum><text>economics;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDD383B99EBA7400788CE8A85C4FED6D4"><enum>(G)</enum><text>business
			 management; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFD476BF2573542228C1493E0CB43C540"><enum>(H)</enum><text>such other
			 disciplines as the Commission determines to be necessary to achieve the
			 purposes of this Act.</text>
					</subparagraph></paragraph><paragraph id="ID3273B8FC42DA4116888CF5C5B78C3EE2"><enum>(2)</enum><header>Term;
			 vacancies</header>
					<subparagraph id="IDB24D11E1E20D4B2395171A2E56662091"><enum>(A)</enum><header>Term</header><text>A
			 member of the Commission shall serve for a term of 6 years.</text>
					</subparagraph><subparagraph id="IDF9EBBD586A6D43A2814C9D7D8FAF76A8"><enum>(B)</enum><header>Vacancies</header><text>A
			 vacancy on the Commission—</text>
						<clause id="IDA9631872155B4CE58B499962B1D0217B"><enum>(i)</enum><text>shall not affect
			 the powers of the Commission; and</text>
						</clause><clause id="ID22AE9E5E9568490B908023D1C2BCBD2E"><enum>(ii)</enum><text>shall be filled
			 in the same manner as the original appointment was made.</text>
						</clause></subparagraph></paragraph><paragraph id="IDED55AC0EF5C749C293B8CB5FAD68FE4C"><enum>(3)</enum><header>Initial
			 meeting</header><text>Not later than 30 days after the date on which all
			 members of the Commission have been appointed, the Commission shall hold the
			 initial meeting of the Commission.</text>
				</paragraph><paragraph id="IDD209FD1ED0F9443ABD8B94A9D757B60B"><enum>(4)</enum><header>Meetings</header><text>The
			 Commission shall meet at the call of the Chairperson.</text>
				</paragraph><paragraph id="IDFA8C485DEF7E44919228ECD7C7403119"><enum>(5)</enum><header>Quorum</header><text>A
			 majority of the members of the Commission shall constitute a quorum, but a
			 lesser number of members may hold hearings.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E82C49D916F4B068A2D96CD14B3CCEF"><enum>(6)</enum><header>Chairperson and
			 Vice Chairperson</header><text>The Commission shall select a Chairperson and
			 Vice Chairperson from among the members of the Commission.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3CD9D6333B934B779F46FE7ACDD87D37"><enum>(7)</enum><header>Compensation</header><text>A
			 member of the Commission shall be compensated at level III of the Executive
			 Schedule.</text>
				</paragraph></subsection><subsection id="ID69c17566304b49cfa4ef9b8280756a39"><enum>(c)</enum><header>Duties</header><text>The
			 Commission shall—</text>
				<paragraph id="id4FE1232C7DCB4682AF9EF4B02B871364"><enum>(1)</enum><text>subject to
			 subsection (d), develop specific requirements for—</text>
					<subparagraph id="id52C98A88808D4F99AF112232D1CFB9F9"><enum>(A)</enum><text>the competition
			 process;</text>
					</subparagraph><subparagraph id="id8DACA7DB362C4FB98ABB7A095F43535A"><enum>(B)</enum><text>minimum
			 performance standards;</text>
					</subparagraph><subparagraph id="id062D3F7B0C384843B210DD59399E03C1"><enum>(C)</enum><text>monitoring and
			 verification procedures; and</text>
					</subparagraph><subparagraph id="id3D0B25AB277247CF977BC14752958BAC"><enum>(D)</enum><text>the scale of
			 awards for each milestone identified under paragraph (3);</text>
					</subparagraph></paragraph><paragraph id="idB7C34B194FEF4BABA9253978F6600AE5"><enum>(2)</enum><text>establish minimum
			 levels for the capture or net sequestration of greenhouse gases that are
			 required to be achieved by a public or private entity to qualify for a
			 financial award described in paragraph (3);</text>
				</paragraph><paragraph id="idDBCE8BA492714813A6B6A77B82ADE272"><enum>(3)</enum><text>in coordination
			 with the Secretary, offer those financial awards to public and private entities
			 that demonstrate—</text>
					<subparagraph id="IDa11b50d5f4fd4c9787e0042dad352e76"><enum>(A)</enum><text>a design document
			 for a successful technology;</text>
					</subparagraph><subparagraph id="IDfbb6dc61e929406ba755688cceea15f9"><enum>(B)</enum><text>a bench scale
			 demonstration of a technology;</text>
					</subparagraph><subparagraph id="IDaec36a139e644288b26ce99bf399d2ff"><enum>(C)</enum><text>technology
			 described in subparagraph (A) that—</text>
						<clause id="idCC7F91AA788745218DB70DB54E5B7A1B"><enum>(i)</enum><text>is
			 operational at demonstration scale; and</text>
						</clause><clause id="idBADAC232E3EC4E2BA6AA8E39F84CF2D5"><enum>(ii)</enum><text>achieves
			 significant greenhouse gas reductions; and</text>
						</clause></subparagraph><subparagraph id="IDc70740d2a6784360864f874796f3229c"><enum>(D)</enum><text>operation of
			 technology on a commercially viable scale that meets the minimum levels
			 described in paragraph (2); and</text>
					</subparagraph></paragraph><paragraph id="IDc829ada160514d9fa15e012bba323373"><enum>(4)</enum><text>submit to
			 Congress—</text>
					<subparagraph id="idB9A60F40030C4FA5B706765FBD8A499A"><enum>(A)</enum><text>an annual report
			 that describes the progress made by the Commission and recipients of financial
			 awards under this section in achieving the demonstration goals established
			 under paragraph (3); and</text>
					</subparagraph><subparagraph id="id071FC681F79C472F830D9652013030F7"><enum>(B)</enum><text>not later than 1
			 year after the date of enactment of this Act, a report that describes the
			 levels of funding that are necessary to achieve the purposes of this
			 Act.</text>
					</subparagraph></paragraph></subsection><subsection id="idBD43484F5595437093CD616A32E345DC"><enum>(d)</enum><header>Public
			 participation</header><text>In carrying out subsection (c)(1), the Commission
			 shall—</text>
				<paragraph id="id68B2BCBC26A64C71919D53C494DDC4EE"><enum>(1)</enum><text>provide notice of
			 and, for a period of at least 60 days, an opportunity for public comment on,
			 any draft or proposed version of the requirements described in subsection
			 (c)(1); and</text>
				</paragraph><paragraph id="idD59A29F71DE1454B910DC09E27D6E773"><enum>(2)</enum><text>take into account
			 public comments received in developing the final version of those
			 requirements.</text>
				</paragraph></subsection><subsection id="id92AF50C5F26F4DB3B6DB668EFE72F0E9"><enum>(e)</enum><header>Peer
			 review</header><text>No financial award may be provided under this Act until
			 such time as the proposal for which the award is sought has been peer reviewed
			 in accordance with such standards for peer review as the Commission shall
			 establish.</text>
			</subsection></section><section id="ID46ae4825692447e298942ee8790b8f18"><enum>6.</enum><header>Intellectual
			 property considerations</header>
			<subsection id="id62130896CF2942DDACBB1449DBA404F1"><enum>(a)</enum><header>In
			 general</header><text>Title to any intellectual property arising from a
			 financial award provided under this Act shall vest in 1 or more entities that
			 are incorporated in the United States.</text>
			</subsection><subsection id="id6A9CE3AB539448E9B80BB4B5B66926A7"><enum>(b)</enum><header>Reservation of
			 license</header><text>The United States—</text>
				<paragraph id="id1F11EA26C37C43FB8810151DB844FF36"><enum>(1)</enum><text>may reserve a
			 nonexclusive, nontransferable, irrevocable, paid-up license, to have practiced
			 for or on behalf of the United States, in connection with any intellectual
			 property described in subsection (a); but</text>
				</paragraph><paragraph id="id2A0F48900E5F49799D05E2C1AE1E52B1"><enum>(2)</enum><text>shall not, in the
			 exercise of a license reserved under paragraph (1), publicly disclose
			 proprietary information relating to the license.</text>
				</paragraph></subsection><subsection id="idDF2137989C6047BAA991132A68BB9DEA"><enum>(c)</enum><header>Transfer of
			 title</header><text>Title to any intellectual property described in subsection
			 (a) shall not be transferred or passed, except to an entity that is
			 incorporated in the United States, until the expiration of the first patent
			 obtained in connection with the intellectual property.</text>
			</subsection></section><section id="id76D79A7DFB154F35871A50F63E720C5B"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
		</section><section id="id174F0E77673447C98C7D4FF74D52433C"><enum>8.</enum><header>Termination of
			 authority</header><text display-inline="no-display-inline">The Commission and
			 all authority of the Commission provided under this Act terminate on December
			 31, 2020.</text>
