		  limitations on the transfer of entitlement to basic educational assistance
		  under Montgomery GI Bill, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Montgomery GI Bill Educational
			 Assistance Transferability Act of 2008</short-title></quote>.</text>
		</section><section id="idF6F27AFF978D4BF0846A1C8EBBA1A958"><enum>2.</enum><header>Removal of
			 certain limitations on transfer of entitlement to basic educational
			 assistance</header>
			<subsection id="id6F6C18A89F93496788E9457F35B37EB5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3020 of title
			 38, United States Code, is amended—</text>
				<paragraph id="idAF9B66C1D9FB4D0F8AD0E919DBF9A721"><enum>(1)</enum><text>in the heading,
			 by striking <quote><header-in-text level="section" style="USC">: members of the
			 Armed Forces with critical military skills</header-in-text></quote>;</text>
				</paragraph><paragraph id="id31B06F6ECDFC48A2965986ADFD7A0FFA"><enum>(2)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="id451836CD575F4A2FBEB794C66AF72DC1"><enum>(A)</enum><text>by striking
			 <quote>with critical military skills and at such Secretary's sole
			 discretion</quote>; and</text>
					</subparagraph><subparagraph id="id9BE47B39616C4C17B67078EA28C51862"><enum>(B)</enum><text>by striking
			 <quote>, subject to the limitation under subsection (d)</quote>;</text>
					</subparagraph></paragraph><paragraph id="id415D3B3DC1494B8B9C445ABAE339A9FA"><enum>(3)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="id5CBB1FE8F9E448299134DD66CFDB16A9"><enum>(A)</enum><text>in paragraph (1),
			 by striking the semicolon at the end and inserting <quote>; and</quote>;</text>
					</subparagraph><subparagraph id="idBD8CF1DC05FE4045B8FD4E74A36F2675"><enum>(B)</enum><text>by striking
			 paragraph (2); and</text>
					</subparagraph><subparagraph id="id18B6AAE029514AB3B6C7D1A18161701A"><enum>(C)</enum><text>by redesignating
			 paragraph (3) as paragraph (2);</text>
					</subparagraph></paragraph><paragraph id="idFAC52C4FC4C34477B1A13207D3F29CC1"><enum>(4)</enum><text>by striking
			 subsection (d); and</text>
				</paragraph><paragraph id="id596ECD8305AD48109A8A918F0F75F857"><enum>(5)</enum><text>by redesignating
			 subsections (e) through (m) as subsections (d) through (l),
			 respectively.</text>
				</paragraph></subsection><subsection id="idEA053B3DAA4F4850A72323D93CF240FE"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Such section is further amended—</text>
				<paragraph id="id0D7E83AD5CD5492AB60CC60FB74DB17D"><enum>(1)</enum><text>in subsection
			 (g)(2), as redesignated by subsection (a)(5) of this section, by striking
			 <quote>under subsection (e)(2)</quote> and inserting <quote>under subsection
			 (d)(2)</quote>;</text>
				</paragraph><paragraph id="id75E6FF8DB1644659822464DA77315F80"><enum>(2)</enum><text>in subsection
			 (h)(2), as redesignated by subsection (a)(5) of this section, by striking
			 <quote>under subsection (b)(3)</quote> and inserting <quote>under subsection
			 (b)(2)</quote>; and</text>
				</paragraph><paragraph id="id083813F99AF4458AADBAAC3B79E711A1"><enum>(3)</enum><text>in subsection
			 (j), as redesignated by subsection (a)(5) of this section—</text>
					<subparagraph id="id1BFFD6E19C5C4A458F100412C508AC72"><enum>(A)</enum><text>by striking
			 <quote>under subsection (f)(2)</quote> and inserting <quote>under subsection
			 (e)(2)</quote>; and</text>
					</subparagraph><subparagraph id="idB67C42659F5C4FA5A76A1833FEE3B025"><enum>(B)</enum><text>by striking
			 <quote>in subsection (h)(5)</quote> and inserting <quote>in subsection
			 (g)(5)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id43A3B2A99DB448E4B0059CFCD3310C38"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 30 of
			 such title is amended by amending the item relating to section 3020 to read as
			 follows:</text>

			</subsection></section><section id="H3006D721F858495988FDD74F58846434"><enum>3.</enum><header>Transfer of
			 entitlement to educational assistance under the Reserve Montgomery GI
			 Bill</header>
			<subsection id="H04E6375CD9A44CA39B25F6B6EB34F0BA"><enum>(a)</enum><header>Selected
			 Reserve</header>
				<paragraph id="idE57B36BCE66242B9829DD9EEB21D4D64"><enum>(1)</enum><header>In
			 general</header><text>Chapter 1606 of title 10, United States Code, is amended
			 by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H795372B69932408397A47C038EBC0100" style="USC">
						<section id="H89EF3A27794B41CCB870461FD2CD0E9"><enum>16138.</enum><header>Transfer of
				entitlement to educational assistance</header>
							<subsection id="H62948C414C1E49B085B3CAC8A1CB7976"><enum>(a)</enum><header>In
				general</header><text>An individual described in subsection (b) who is entitled
				to educational assistance under this chapter may elect to transfer to one or
				more of the dependents specified in subsection (c) a portion of such
				individual’s entitlement to such assistance. An individual transferring
				entitlement under this section shall submit written notice to the Secretary
				concerned not later than the expiration date of the period described in section
				16133 of this title that is applicable to such individual.</text>
							</subsection><subsection display-inline="no-display-inline" id="HAD6256E3183C4FE7B6849FB8541952B"><enum>(b)</enum><header>Eligible
				individuals</header><text display-inline="yes-display-inline">An individual
				referred to in subsection (a) is any member of the armed forces who, at the
				time of the approval by the Secretary concerned of the member's request to
				transfer entitlement to basic educational assistance under this section—</text>
								<paragraph id="H2067B0B647E049320068005BBFB9A3BD"><enum>(1)</enum><text display-inline="yes-display-inline">has completed six years of service in the
				Selected Reserve; and</text>
								</paragraph><paragraph id="HD4BB81AFFD17493BBB2545257614BBF9"><enum>(2)</enum><text display-inline="yes-display-inline">enters into an agreement to remain a member
				of the Selected Reserve for a period of not less than four years.</text>
								</paragraph></subsection><subsection id="HE2412157B96A4A5AABA58D416B65BCE8"><enum>(c)</enum><header>Eligible
				dependents</header><text>An individual may transfer entitlement under this
				section as follows:</text>
								<paragraph id="H1E4E38FD9CB24BAEA09457AFBCD29711"><enum>(1)</enum><text>To the
				individual’s spouse.</text>
								</paragraph><paragraph id="HC9B350EA2C664CE987FF2C38F3C68E72"><enum>(2)</enum><text>To one or more of
				the individual’s children.</text>
								</paragraph><paragraph id="H432909F9E35B4DE4982B65E16C03F8B8"><enum>(3)</enum><text>To a combination
				of the individuals referred to in paragraphs (1) and (2).</text>
								</paragraph></subsection><subsection id="HDC64646838B141F099BF00186D5F8CF8"><enum>(d)</enum><header>Designation of
				transferee</header><text>An individual transferring entitlement under this
				section shall—</text>
								<paragraph id="HC4B8E1C365C94E96A56188F5B1562E49"><enum>(1)</enum><text>designate the
				dependent or dependents to whom such entitlement is being transferred;</text>
								</paragraph><paragraph id="HE126B1B926E042199B2346BF65CF35E4"><enum>(2)</enum><text>designate the
				number of months of such entitlement to be transferred to each such dependent;
				and</text>
								</paragraph><paragraph id="H504B05F462454423ABC024A1EFE138B"><enum>(3)</enum><text>specify the period
				for which the transfer shall be effective for each such dependent.</text>
								</paragraph></subsection><subsection id="HE1C621147A5849A3B73756E6D43676B7"><enum>(e)</enum><header>Revocation and
				modification</header><text>An individual transferring entitlement under this
				section may modify or revoke at any time the transfer of any unused portion of
				the entitlement so transferred. The modification or revocation of the transfer
				of entitlement under this subsection shall be made by the submittal of written
				notice of the action to both the Secretary concerned and the Secretary of
				Veterans Affairs.</text>
							</subsection><subsection id="H2872524C006E42F8862CA3456F431494"><enum>(f)</enum><header>Commencement of
				use</header><text>If the dependent to whom entitlement is transferred under
				this section is a child, the use of the transferred entitlement may not
				commence until the child—</text>
								<paragraph id="H33C5C1B595CD42B2A406E022FF73BAB3"><enum>(1)</enum><text>completes the
				requirements of a secondary school diploma (or equivalency certificate);
				or</text>
								</paragraph><paragraph id="H855AAF3FD87B434B9CC83CE6AFCE5FE4"><enum>(2)</enum><text>attains 18 years
				of age.</text>
								</paragraph></subsection><subsection id="H0F740A2396CE488594C3EA9DEA0040FC"><enum>(g)</enum><header>Time limitation
				for use of eligibility and entitlement</header><text>Notwithstanding section
				16133 of this title, and subject to subsection (d)(3), a dependent to whom
				entitlement is transferred under this section may use such entitlement until
				the later of—</text>
								<paragraph id="HF56B66B5351346EC88B95ED980986D9D"><enum>(1)</enum><text>the expiration
				date of a 15-year period beginning on the date on which the individual who
				transferred such entitlement to the dependent becomes entitled to such
				assistance; and</text>
								</paragraph><paragraph id="H8E9DD8C5AEB44ACEB431385552007930"><enum>(2)</enum><text>the date that is
				10 years after the date the individual who transferred such entitlement to the
				dependent is separated from the Selected Reserve.</text>
								</paragraph></subsection><subsection id="HE90DE3230B49433AA61FF13B9B67F134"><enum>(h)</enum><header>Additional
				administrative matters</header>
								<paragraph id="id96C0EAB59C8144B18CA5403836BE719B"><enum>(1)</enum><header>Use of
				entitlement charged to transferring individual</header><text>The use of any
				entitlement transferred under this section shall be charged against the
				entitlement of the individual making the transfer at the rate of one month for
				each month of transferred entitlement that is used.</text>
								</paragraph><paragraph id="idED8A599DE6304B16A8957039A36EB6C7"><enum>(2)</enum><header>Entitlement to
				assistance</header><text>Except as provided under paragraphs (2) and (3) of
				subsection (d) and subsection (g), and subject to paragraph (5), a dependent to
				whom entitlement is transferred under this section is entitled to educational
				assistance under this chapter in the same manner as the individual from whom
				entitlement was transferred.</text>
								</paragraph><paragraph id="id9CDA15A98EAC427F8E996E4BDBB9A75E"><enum>(3)</enum><header>Monthly rate of
				education assistance payable</header><text>The monthly rate of educational
				assistance payable to a dependent to whom entitlement is transferred under this
				section shall be the monthly amount payable under section 16131 of this title
				to the individual making the transfer.</text>
								</paragraph><paragraph id="id487DEDCB5871469AAECA4774BB92C3CC"><enum>(4)</enum><header>Use of
				transferred entitlement not affected by death of transferor</header><text>The
				death of an individual transferring entitlement under this section shall not
				affect the use of the transferred entitlement by the dependent to whom
				entitlement is transferred.</text>
								</paragraph><paragraph id="idD5B34418DA4C449C9675B95DA5B1E299"><enum>(5)</enum><header>Age
				limitation</header><text>Notwithstanding subsection (g) and section 16133 of
				this title, a child to whom entitlement is transferred under this section may
				not use any entitlement so transferred after attaining the age of 26
				years.</text>
								</paragraph><paragraph id="idDB942FBDDBF14BF6B71B5742822237A9"><enum>(6)</enum><header>Transferability
				to non-child of entitlement for purpose of secondary school
				diploma</header><text>Except as provided in subsection (f), the purposes for
				which a dependent to whom entitlement is transferred under this section may use
				such entitlement shall include the pursuit and completion of the requirements
				of a secondary school diploma (or equivalency certificate).</text>
								</paragraph></subsection><subsection id="H2A7BD952B83249D0A0A7DF4F747695E9"><enum>(i)</enum><header>Overpayment</header><text>In
				the event of an overpayment of basic educational assistance with respect to a
				dependent to whom entitlement is transferred under this section, the dependent
				and the individual making the transfer shall be jointly and severally liable to
				the United States for the amount of the overpayment for purposes of section
				3685 of title 38.</text>
							</subsection><subsection id="H097538741FB746119B544E83E8B2CB68"><enum>(j)</enum><header>Regulations</header><text>The
				Secretaries concerned shall prescribe regulations for purposes of this
				section.</text>
							</subsection><subsection id="H9C56F7F316B84A6B841EAC02028CC3FC"><enum>(k)</enum><header>Secretary
				concerned defined</header><text>Notwithstanding section 101(a)(9) of this
				title, in this section the term <term>Secretary concerned</term> means—</text>
								<paragraph id="H37393C9CCE3046FD00F600F5D8976D93"><enum>(1)</enum><text>the Secretary of
				the Army with respect to matters concerning the Army;</text>
								</paragraph><paragraph id="HF1EF1AE795674ECCADEB7C3DAAF2D056"><enum>(2)</enum><text>the Secretary of
				the Navy with respect to matters concerning the Navy or the Marine
				Corps;</text>
								</paragraph><paragraph id="H59C7C3232EB449E2A11E7839D8004963"><enum>(3)</enum><text>the Secretary of
				the Air Force with respect to matters concerning the Air Force; and</text>
								</paragraph><paragraph id="H1065CBD275B0423AB2A17E4DB99855D7"><enum>(4)</enum><text>the Secretary of
				Defense with respect to matters concerning the Coast Guard, or the Secretary of
				Homeland Security when it is not operating as a service in the
				Navy.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HAB71516AD105435DA0986BA94DE6FA15"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>

			 amendments</header>
				<paragraph id="idFF64243D3FD4494C8D003B41E3750028"><enum>(1)</enum><header>Time
			 limitation</header><text>Section 16133(a) of such title is amended by inserting
			 <quote>and section 16138 of this title</quote> after <quote>subsection
			 (b)</quote>.</text>
				</paragraph><paragraph id="id8B934D344B6B4F1786EB66B1214296A9"><enum>(2)</enum><header>Biennial
			 report</header><text>Section 16137 of such title is amended by inserting after
			 the second sentence the following: <quote>Each such report shall also include
			 the number of members of the Selected Reserve of the Ready Reserve of each
			 armed force transferring entitlement to educational assistance under section
			 16138.</quote>.</text>
