			 reference</header>
			<subsection id="H031398399F274A16A17506E245BB47A5"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Government Accountability
			 Office Act of 2008</short-title></quote>.</text>
			</subsection><subsection id="H9F1FF15EF6124D68A3409009422ECA2B"><enum>(b)</enum><header>Reference</header><text>Except
			 as otherwise expressly provided, whenever in this Act an amendment is expressed
			 in terms of an amendment to a section or other provision, the reference shall
			 be considered to be made to a section or other provision of title 31, United
			 States Code.</text>
			</subsection></section><section id="HB5AA2C565BEC4ACFBFB7B9DFE45076FF"><enum>2.</enum><header>Appointment
			 processes</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/703">Section 703</external-xref> is
			 amended—</text>
			<paragraph id="H0A8AF8E4FFC44A3F9E6B218FE0462873"><enum>(1)</enum><text>by striking the
			 term <term>and Deputy Comptroller General are</term> and inserting
			 <quote>is</quote> in subsection (a)(1),</text>
			</paragraph><paragraph id="H52104C5FC9A449DAA41B04EB4F264333"><enum>(2)</enum><text>by striking the
			 first sentence in subsection (a)(2) and inserting the following: <quote>A
			 commission shall be established 12 months in advance of an upcoming vacancy in
			 the office of Comptroller General to recommend individuals to the President for
			 appointment to the office, except that if the vacancy is unanticipated, the
			 commission shall be established when the vacancy occurs.</quote>,</text>
			</paragraph><paragraph id="HAC6D0FDDAAB546CEA7B9F4108B001722"><enum>(3)</enum><text>by inserting
			 <quote>and</quote> at the end of subsection (a)(2)(C),</text>

			 subsections (b), (c), (d), (e), and (f) as subsections (c), (d), (e), (f) and
			 (g) and inserting a new subsection (b) as follows:</text>

					<subsection id="HAF96674F8447490AB0E67B94D8D7E008"><enum>(b)</enum><text>The Comptroller
				General shall appoint the Deputy Comptroller General in consultation with those
				individuals listed in clauses (A), (B), (C) and (D) of this subsection and in
				so doing shall choose an individual solely on the basis of integrity and
				demonstrated ability related to the auditing, financial and management
				analysis, public administration, investigative and legal functions of the
				Office.</text>
					</subsection><after-quoted-block>,</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HB8E08F360A7F42F69697B4C820998200"><enum>(6)</enum><text>in subsection (c),
			 as redesignated by this section, by striking <quote>(e)</quote> and inserting
			 <quote>(f)</quote>,</text>
			</paragraph><paragraph id="H495C05AFFB02496AB665344481DCFF85"><enum>(7)</enum><text>in subsection (d),
			 as redesignated by this section, by renumbering subsections (1) and (2) as
			 subsections (2) and (3) and inserting a new subsection (1) as follows:</text>

				pleasure of the Comptroller General;</text>

			</paragraph><paragraph id="H2B7BA4CD0E6F47FBAA827828A7B0EE5E"><enum>(8)</enum><text>in subsection (f),
			 as redesignated by this section, by deleting the term <term>or Deputy
			 Comptroller General</term> wherever it appears and by deleting in subsection
			 (1) the words <quote>(as the case may be). Either</quote> and inserting
			 <quote>and</quote>.</text>
			</paragraph></section><section id="H9DEB1596336A49019CE7E12C42E88948"><enum>3.</enum><header>Inspector
			 General</header>
			<subsection id="HC8775C450D894F3FAC7801C92100CFED"><enum>(a)</enum><header>In
			 general</header><text>Title 31, United States Code, is amended by inserting
			 after section 704 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HB3F1C7A230BB46A5B3DC52694F2C7DAA" style="USC">
					<section id="H77F7B38CB02A43128D5003C722533CFD"><enum>705.</enum><header>Inspector
				General for the United States Government Accountability Office</header>
						<subsection id="H5C13C387C41C40EEB087D763F16709DE"><enum>(a)</enum><header>Establishment of
				office</header><text>There is established an Office of the Inspector General in
				the United States Government Accountability Office, to—</text>
							<paragraph id="H8AB2B53866F1401D9448819FBE7361D3"><enum>(1)</enum><text>conduct and
				supervise audits consistent with generally accepted government auditing
				standards and investigations relating to the United States Government
				Accountability Office;</text>
							</paragraph><paragraph id="HA02AF2A9C1D2457DBE470019E8347ED1"><enum>(2)</enum><text>provide leadership
				and coordination and recommend policies, to promote economy, efficiency, and
				effectiveness in the United States Government Accountability Office; and</text>
							</paragraph><paragraph id="HFE6B15CAB4C14532AB7F698997662C63"><enum>(3)</enum><text>keep the
				Comptroller General and Congress fully and currently informed concerning fraud
				and other serious problems, abuses, and deficiencies relating to the
				administration of programs and operations of the United States Government
				Accountability Office.</text>
							</paragraph></subsection><subsection id="HF769CCCA73F746E68322F44DA737DF86"><enum>(b)</enum><header>Appointment,
				supervision, and removal</header>
							<paragraph id="H178096EF4B2A458BB6BEAA5BDC25CB25"><enum>(1)</enum><text>The Office of the
				Inspector General shall be headed by an Inspector General, who shall be
				appointed by the Comptroller General without regard to political affiliation
				and solely on the basis of integrity and demonstrated ability in accounting,
				auditing, financial analysis, law, management analysis, public administration,
				or investigations. The Inspector General shall report to, and be under the
				general supervision of, the Comptroller General.</text>
							</paragraph><paragraph id="HFC2E6856A6AC42F3B3FD00E1752CEA"><enum>(2)</enum><text>The Inspector
				General may be removed from office by the Comptroller General. The Comptroller
				General shall, promptly upon such removal, communicate in writing the reasons
				for any such removal to each House of the Congress.</text>
							</paragraph></subsection><subsection id="H1A50D20DCF5D42D7999364955C70DEEA"><enum>(c)</enum><header>Authority of
				inspector general</header><text>In addition to the authority otherwise provided
				by this section, the Inspector General, in carrying out the provisions of this
				section, is authorized—</text>
							<paragraph id="H5E1D0E11C12D42869D08092CFF2DDB8D"><enum>(1)</enum><text>to have access to
				all records, reports, audits, reviews, documents, papers, recommendations, or
				other material that relate to programs and operations of the United States
				Government Accountability Office;</text>
							</paragraph><paragraph id="HA1F0AA7B59614C7DBFE402E38EFD9D1D"><enum>(2)</enum><text>to make such
				investigations and reports relating to the administration of the programs and
				operations of the United States Government Accountability Office as are, in the
				judgment of the Inspector General, necessary or desirable;</text>
							</paragraph><paragraph id="HAEF4803776BE432C83DA3CE397754CBA"><enum>(3)</enum><text>to request such
				documents and information as may be necessary for carrying out the duties and
				responsibilities provided by this section from any Federal agency;</text>
							</paragraph><paragraph id="H56A2BD3F0C364878A551FD82CED69083"><enum>(4)</enum><text>in the performance
				of the functions assigned by this section, the Inspector General shall use the
				authority and procedures provided in
				<external-xref legal-doc="usc" parsable-cite="usc/31/716">section
				716</external-xref> of this title to obtain all information, documents,
				reports, answers, records, accounts, papers, and other data and documentary
				evidence from a person not in the United States Government or from a Federal
				agency, to the same extent and in the same manner as the Comptroller
				General;</text>
							</paragraph><paragraph id="H897B7BB5C7C840E8BDFAE927C7DFA81"><enum>(5)</enum><text>to administer to or
				take from any person an oath, affirmation, or affidavit, whenever necessary in
				the performance of the functions assigned by this section, which oath,
				affirmation, or affidavit when administered or taken by or before an employee
				of an Office of Inspector General designated by the Inspector General shall
				have the same force and effect as if administered or taken by or before an
				officer having a seal;</text>
							</paragraph><paragraph id="HA18042810D4D48BEAA00ED00466352E7"><enum>(6)</enum><text>to have direct and
				prompt access to the Comptroller General when necessary for any purpose
				pertaining to the performance of functions and responsibilities under this
				section;</text>
							</paragraph><paragraph id="HCD3E62106751416C8193E39CE85E3C64"><enum>(7)</enum><text>to report
				expeditiously to the Attorney General whenever the Inspector General has
				reasonable grounds to believe there has been a violation of Federal criminal
				law; and</text>
							</paragraph><paragraph id="H6ABDBE70F9BF41B8A2B3E353D0CF5B05"><enum>(8)</enum><text>to provide copies
				of all reports to the United States Government Accountability Office’s Audit
				Advisory Committee and to provide such additional information in connection
				with such reports as is requested by the Committee.</text>
							</paragraph></subsection><subsection id="HCFBD69161F26444C8B2766BEDF00979F"><enum>(d)</enum><header>Complaints by
				employees</header>
							<paragraph id="HE54A37B368F144979239B400DB61907D"><enum>(1)</enum><text>The Inspector
				General may receive, review, and investigate, as the Inspector General deems
				appropriate, complaints or information from an employee of the United States
				Government Accountability Office concerning the possible existence of an
				activity constituting a violation of law, rules, or regulations, mismanagement,
				or gross waste of funds, provided that the IG shall refer complaints or
				information concerning violations of personnel law, rules, or regulations to
				established investigative and adjudicative entities of the United States
				Government Accountability Office.</text>
							</paragraph><paragraph id="HFB3F513981FD428A9008EB6BAB4300E6"><enum>(2)</enum><text>The Inspector
				General shall not, after receipt of a complaint or information from an
				employee, disclose the identity of the employee without the consent of the
				employee, unless the Inspector General determines such disclosure is
				unavoidable during the course of the investigation.</text>
							</paragraph><paragraph id="H5BAA57A6670649C1ACE7312705FBEE0"><enum>(3)</enum><text>Any employee who
				has authority to take, direct others to take, recommend, or approve any
				personnel action, shall not, with respect to such authority, take or threaten
				to take any action against any employee as a reprisal for making a complaint or
				disclosing information to the Inspector General, unless the complaint was made
				or the information disclosed with the knowledge that it was false or with
				willful disregard for its truth or falsity.</text>
							</paragraph></subsection><subsection id="H292A007D177D402F91A6D81762F5B6EE"><enum>(e)</enum><header>Semiannual
				reports</header><paragraph commented="no" display-inline="yes-display-inline" id="H9BE4E77ECC55447D9D0097ACFDC1C900"><enum>(1)</enum><text>The Inspector General
				shall submit semiannual reports summarizing the activities of the Office of the
				Inspector General to the Comptroller General. Such reports shall include, but
				need not be limited to—</text>
								<subparagraph id="H73C36647E678457D913F004ED000B1F8" indent="up1"><enum>(A)</enum><text>a summary of each significant report,
				including a description of significant problems, abuses, and deficiencies
				disclosed by such report during the reporting period;</text>
								</subparagraph><subparagraph id="H8373A1C845AE4101A1025078C28575BE" indent="up1"><enum>(B)</enum><text>a description of the recommendations
				for corrective action made with respect to significant problems, abuses, or
				deficiencies identified in subparagraph (A);</text>
								</subparagraph><subparagraph id="H79A736BA6A4E41C0B015F5291456D406" indent="up1"><enum>(C)</enum><text>a summary of the progress made in
				implementing such corrective action identified in subparagraph (B); and</text>
								</subparagraph><subparagraph id="HFFDF2BC9B71445908BA4F09064619F3" indent="up1"><enum>(D)</enum><text>information concerning any
				disagreement the Comptroller General has with a recommendation of the Inspector
				General.</text>
								</subparagraph></paragraph><paragraph id="H54D99C35DEE845F49DEE7BD330C76C1B" indent="up1"><enum>(2)</enum><text>The Comptroller General shall
				transmit the semiannual reports of the Inspector General, together with any
				comments the Comptroller General considers appropriate, to the Congress within
				60 days of receipt of such reports.</text>
							</paragraph></subsection><subsection id="H7B8ADC9D02BD496DB676744EF8E42291"><enum>(f)</enum><header>Independence in
				carrying out duties and responsibilities</header><text>The Comptroller General
				is not authorized to prevent or prohibit the Inspector General from carrying
				out any of the duties or responsibilities assigned to the Inspector General
				under this section.</text>
						</subsection><subsection id="H389AE3D53ADF4938A0F1DDBE29079100"><enum>(g)</enum><header>Authority for
				staff</header>
							<paragraph id="H35CBC2A09EDD4E1B83BDEFD8B1DDF716"><enum>(1)</enum><header>In
				general</header><text>The Inspector General shall select, appoint, and employ
				such personnel as may be necessary to carry out the provisions of this section
				consistent with the provisions of this title governing selections,
				appointments, and employment in the United States Government Accountability
				Office. Such personnel shall be appointed, promoted, and assigned only on the
				basis of merit and fitness, but without regard to those provisions of title 5
				governing appointments and other personnel actions in the competitive service,
				except that no personnel of the Office may be paid at an annual rate greater
				than $1,000 less than the annual rate of pay of the Inspector General.</text>
							</paragraph><paragraph id="HB4B59814C6FC43B0A0654F5BF0B72B37"><enum>(2)</enum><header>Experts and
				consultants</header><text>The Inspector General may procure temporary and
				intermittent services under
				<external-xref legal-doc="usc" parsable-cite="usc/5/3109">section
				3109</external-xref> of title 5, United States Code at rates not to exceed the
				daily equivalent of the annual rate of basic pay for level V of the Executive
				Schedule under <external-xref legal-doc="usc" parsable-cite="usc/31/5315">section 5315</external-xref> of such title.</text>
							</paragraph><paragraph id="HD0958F96685C4CE5A2DC4C65A287F370"><enum>(3)</enum><header>Independence in
				appointing staff</header><text>No individual may carry out any of the duties or
				responsibilities of the Office of the Inspector General unless the individual
				is appointed by the Inspector General, or provides services procured by the
				Inspector General, pursuant to this paragraph.</text>
							</paragraph><paragraph id="H85B71A28DDD64CE38857BDDC892516B5"><enum>(4)</enum><text>The Inspector
				General and any individual carrying out any of the duties or responsibilities
				of the Office of the Inspector General are prohibited from performing any
				program responsibilities.</text>
							</paragraph></subsection><subsection id="H873A0590C7B8449E9C1BB02659E0815C"><enum>(h)</enum><header>Office
				space</header><text>The Comptroller General shall provide the Office of the
				Inspector General with appropriate and adequate office space, together with
				such equipment, office supplies, and communications facilities and services as
				may be necessary for the operation of the Office of the Inspector General, and
				shall provide necessary maintenance services and the equipment and facilities
				located therein.</text>
						</subsection><subsection id="HA5ED826AE5CB48E1AFACEEAB2C96D606"><enum>(i)</enum><header>Definition</header><text>As
				used in this section, the term <term>Federal agency</term> means a department,
				agency, instrumentality or unit thereof of the Federal
				Government.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA59E542C311F4E93B5B731A1D2D2B345"><enum>(b)</enum><header>Incumbent</header><text>The
			 individual who serves in the position of Inspector General of the United States
			 Government Accountability Office on ____, 2008, shall continue to serve in such
			 position subject to the removal in accordance with this section.</text>
			</subsection><subsection id="H9D24CF256A0340D2A5E68EA09CC8E11"><enum>(c)</enum><header>Effective
			 date</header><text>This section shall be effective upon enactment of this
			 Act.</text>
			</subsection><subsection id="H1208AA23EFE340D19DDE312459DD7B03"><enum>(d)</enum><header>Clerical
			 amendment</header><text>The table of contents of chapter 7, of title 31, United
			 States Code, is amended by adding at the end of subchapter I the
			 following:</text>

			</subsection></section><section id="H7164B31FA7054D07A4EF47BB7BC7F17"><enum>4.</enum><header>Administering
			 oaths</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/711">Section 711</external-xref> is
			 amended—</text>
			<paragraph id="HD8BA07F96C5D45A48262E345C786AAF8"><enum>(1)</enum><text>by striking
			 <quote>when auditing and settling accounts</quote> in paragraph 4, and</text>
			</paragraph><paragraph id="HBB44948661C64332A6CDB31824BEDA9C"><enum>(2)</enum><text>by adding to the
			 end of paragraph 4, as amended, <quote>upon the specific approval only of the
			 Comptroller General or the Deputy Comptroller General.</quote></text>
			</paragraph></section><section id="HF21FD5CF5C6345E9AA172BFC7D001662"><enum>5.</enum><header>Comptroller
			 General reports</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/719">Section 719</external-xref> is
			 amended—</text>
			<paragraph id="HD7B873BB52B048F588E76E7C0772CCA8"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of clause (B) in subsection (b)(1),</text>
			</paragraph><paragraph id="HBE8F5FE4170E4567B600AF9440671847"><enum>(2)</enum><text>by striking the
			 period at the end of clause (C) in subsection (b)(1) and inserting <quote>;
			 and</quote>,</text>
			</paragraph><paragraph id="H6CC2C7CF08584EBEB95935F64949C0D5"><enum>(3)</enum><text>by adding a new
			 clause at the end of subsection (b)(1) as follows:</text>

				section 711, granting access to records, providing timely comments to draft
				reports, adopting recommendations in reports and responded to such other
				matters as the Comptroller General deems
				appropriate.</text>
					</subparagraph><after-quoted-block>,</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H0D419D1A307243318BE55F2387DA9EB3"><enum>(4)</enum><text>by striking
			 <quote>and</quote> at the end of clause (B) in subsection (c)(2),</text>
			</paragraph><paragraph id="H2E99D9F27816483BAD3D01B70075D8DC"><enum>(5)</enum><text>by striking the
			 period at the end of subsection (c)(3) and inserting <quote>; and</quote>,
			 and</text>
			</paragraph><paragraph id="H36AF2243FD0B4EA00078B086CD7B0016"><enum>(6)</enum><text>by adding a new
			 subsection at the end of section (c) as follows:</text>

				practicable when an agency or other entity does not, within a reasonable time
				of a request by the Comptroller General, make personnel available for
				interview, provide written answers to questions, or submit to an oath
				authorized by the Comptroller General under section
				711.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HE83FF168A7B94216A4891E94EC332445"><enum>6.</enum><header>Reimbursement of
			 audit costs</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/3521">Section 3521</external-xref> is
			 amended by inserting after subsection (h) the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H21DE6FA34D014D9C91E62AD05BC77DD" style="USC">
				<subsection id="HFAD011C40D9342B4A236C058CE7B001C"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HCF3D9C5793AC4DE2BB383CCBBC53FACA"><enum>(1)</enum><text>Any executive agency or
				component thereof that prepares an audited financial statement or any related
				schedules under section 3515 shall reimburse the Government Accountability
				Office the cost of any audit of the financial statements or related schedules
				of such agency or component performed by the Comptroller General of the United
				States.</text>
					</paragraph><paragraph id="H2DC8C6305F91492BBCDDEA667DFB4BF5" indent="up1"><enum>(2)</enum><text>Reimbursements required by paragraph
				(1) shall be credited to the appropriation account <quote>Salaries and
				Expenses, Government Accountability Office</quote> current when the
				reimbursement is received and shall remain available until
				expended.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H25227B1C41A443198F080025E01C9700"><enum>7.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Section 1401 of
			 title I of Public Law No. 108–83 is repealed.</text>
		</section><section id="H9224BA03AC8E444496B1C784CFE8B4E9"><enum>8.</enum><header>Financial
			 disclosure requirements</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/109">Section 109</external-xref> of title
			 5, United States Code, Appendix 4, is amended—</text>
			<paragraph id="H49C21ECF450D46A98BE0FFB062A772C8"><enum>(1)</enum><text>by inserting
			 <quote>except officers or employees of the Government Accountability
			 Office,</quote> at the beginning of subparagraph (13)(B)(i),</text>
			</paragraph><paragraph id="H3035317F53C045E4815B69D567A30061"><enum>(2)</enum><text>by redesignating
			 subparagraph (13)(B)(ii) as (13)(B)(iii),</text>
			</paragraph><paragraph id="H2AFB2B61357A48B28C193711255D8CEB"><enum>(3)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (13)(B)(i), and</text>

			 amended by striking <quote>highest basic rate for GS–15</quote> and inserting
			 <quote>rate for Executive Level III, provided that the total amount of cash
			 compensation in any year shall be subject to the limitations provided under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5307">section
			 5307(a)(1)</external-xref> of title 5, United States Code;</quote>.</text>
		</section><section id="H64087F98D65D46E6B8A35E88F9966EE2"><enum>11.</enum><header>Pay
			 adjustments</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/732">Section 732(c)</external-xref> is
			 amended—</text>
			<paragraph id="H664532506FE94B8FA530C9D4CAB00855"><enum>(1)</enum><text>in clause (2) by
			 striking <quote>(4)</quote> and inserting <quote>(5)</quote>;</text>

			 clause (4) as clause (5); and</text>

			 amended in the first sentence by striking <quote>of the Comptroller
			 General</quote> and inserting <quote>for level II of the Executive
