		<official-title>To improve disclosures for charitable giving, protect
		  charities, inform consumers, and for other purposes.</official-title>

		<section id="id175817B3A14E400E9C3FEB593D09E70D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting the Spirit of Giving
			 Act</short-title></quote>.</text>
		</section><section id="id0AF3DFE44EF04174AC3F9234D2A9634C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idF291FCF7FE424097ACAC61813046BACD"><enum>(1)</enum><header>Charitable
			 organization</header><text>The term <term>charitable organization</term> means
			 any organization described in section 170 or 501(c) of the Internal Revenue
			 Code of 1986.</text>
			</paragraph><paragraph id="idF0BA9B4F83E84072B7875394D847A79A"><enum>(2)</enum><header>Manufacturer;
			 product; retailer</header><text>The terms <term>manufacturer</term>,
			 <term>product</term>, and <term>retailer</term> have the meanings given the
			 terms <term>manufacturer</term>, <term>consumer product</term>, and
			 <term>retailer</term>, respectively, in section 3(a) of the Consumer Product
			 Safety Act (15 U.S.C. 2052(a)).</text>
			</paragraph></section><section id="id6ED7C59D559447068B0B3AC168388182" section-type="subsequent-section"><enum>3.</enum><header>Charitable
			 organization notification requirement</header><text display-inline="no-display-inline">A retailer or manufacturer may not use the
			 name of a charitable organization to solicit donations for that charitable
			 organization, sell or market a product that is linked to the charitable
			 organization or to which a portion of proceeds is dedicated to the charitable
			 organization, or sell or market a product on behalf of a charitable
			 organization, unless the retailer or manufacturer, for each such solicitation,
			 sale, or promotion—</text>
			<paragraph id="id1455FF1285324AA9989154B91F796503"><enum>(1)</enum><text display-inline="yes-display-inline">notifies the charitable
			 organization—</text>
				<subparagraph id="id6F7F459D5874410092CD68C3BBD6E02F"><enum>(A)</enum><text display-inline="yes-display-inline">of the manner in which such retailer or
			 manufacturer intends to use the charitable organization’s name, emblem, or logo
			 to solicit donations or to sell or market a product; and</text>
				</subparagraph><subparagraph id="idC53877F4B6A54B24A2CBAC8D7A115A4A"><enum>(B)</enum><text display-inline="yes-display-inline">the amount or percentage of the donation or
			 purchase price that the retailer or manufacturer intends to remit to the
			 charitable organization;</text>
				</subparagraph></paragraph><paragraph id="id97A9A4953A524DC3921D800F87C53EF2"><enum>(2)</enum><text>obtains written
			 approval, in advance, from the charitable organization to use the charitable
			 organization’s name in the manner requested; and</text>
			</paragraph><paragraph id="idAD6181DCDF7A499BA739F00D897BBEF0"><enum>(3)</enum><text>limits the use of
			 the charitable organization’s name to the scope approved in advance by the
			 charitable organization.</text>
			</paragraph></section><section id="ID3d197652cbf349168caa1eced302549c"><enum>4.</enum><header>Consumer
			 disclosure requirement</header><text display-inline="no-display-inline">A
			 retailer or manufacturer that sells or markets a product with the intention of
			 remitting a portion of the proceeds from the sale of such product to a
			 charitable organization shall provide clear, written disclosure to the
			 purchaser of such product of this intention, including—</text>
			<paragraph id="idEDC8981C45034D468A9BA1C81C1160FE"><enum>(1)</enum><text>the actual or
			 anticipated portion of the purchase price that will be remitted to the
			 charitable organization;</text>
			</paragraph><paragraph id="idBB4A0CE8781A4C078543F2450ADBB1EE"><enum>(2)</enum><text>the maximum
			 amount that will be remitted to the charitable organization, if
			 applicable;</text>
			</paragraph><paragraph id="id4848B45C82C440829860141F0E1CF851"><enum>(3)</enum><text>the time period
			 during which donations for the charitable organization will be collected, if
			 known; and</text>
			</paragraph><paragraph id="id1964E8F0EE5C4B35BE3AB679AD852A5F"><enum>(4)</enum><text>the phone number
			 or other contact information for the charitable organization.</text>
			</paragraph></section><section id="id505EE8EC64994526808E859AE16B2188"><enum>5.</enum><header>Enforcement</header>
			<subsection id="id759A2E3386F9459C9C63EAB33D56A4B7"><enum>(a)</enum><header>Unfair or
			 deceptive act or practice</header><text display-inline="yes-display-inline">A
			 violation of section 3 or 4 shall be treated as a violation of a rule defining
			 an unfair or deceptive act or practice described under section 18(a)(1)(B) of
			 the Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id148E3B5A971042A5AF582A28942D133A"><enum>(b)</enum><header>Actions by the
			 Federal Trade Commission</header><text display-inline="yes-display-inline">The
			 Federal Trade Commission shall enforce the provisions of this Act in the same
			 manner, by the same means, and with the same jurisdiction, powers, and duties
			 as though all applicable terms and provisions of the Federal Trade Commission
			 Act (15 U.S.C. 41 et seq.) were incorporated into and made part of this
			 Act.</text>
