		<official-title>To promote accessibility, accountability, and openness in
		  Government by strengthening section 552 of title 5, United States Code
		  (commonly referred to as the Freedom of Information Act), and for other
		  purposes.</official-title>

		<section id="ID54DB683145734534A87DC1C09529E9D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Openness Promotes Effectiveness in our
			 National Government Act of 2007</short-title></quote> or the
			 <quote><short-title>OPEN Government Act of
			 2007</short-title></quote>.</text>
		</section><section id="ID3FDA6E77F2B24181A6D3AA0EBCD46C9F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID7F699C55AFAE4FBB94670AA1C7A79FCC"><enum>(1)</enum><text>the Freedom of
			 Information Act was signed into law on July 4, 1966, because the American
			 people believe that—</text>
				<subparagraph id="IDA22839919B81478E81E2B7F3CB97E739"><enum>(A)</enum><text>our
			 constitutional democracy, our system of self-government, and our commitment to
			 popular sovereignty depends upon the consent of the governed;</text>
				</subparagraph><subparagraph id="ID89D64CDF81F14C73A6FA83B0CB8C4C32"><enum>(B)</enum><text>such consent is
			 not meaningful unless it is informed consent; and</text>
				</subparagraph><subparagraph id="ID99C222C767494F7A8FFFC252FC5A981D"><enum>(C)</enum><text>as Justice Black
			 noted in his concurring opinion in Barr v. Matteo (360 U.S. 564 (1959)),
			 <quote>The effective functioning of a free government like ours depends largely
			 on the force of an informed public opinion. This calls for the widest possible
			 understanding of the quality of government service rendered by all elective or
			 appointed public officials or employees.</quote>;</text>
				</subparagraph></paragraph><paragraph id="ID6DC4307737384B679B8DBCEB75A3671D"><enum>(2)</enum><text>the American
			 people firmly believe that our system of government must itself be governed by
			 a presumption of openness;</text>
			</paragraph><paragraph id="ID85F898D326B647A8845A2F3D21BA5CD6"><enum>(3)</enum><text>the Freedom of
			 Information Act establishes a <quote>strong presumption in favor of
			 disclosure</quote> as noted by the United States Supreme Court in United States
			 Department of State v. Ray (502 U.S. 164 (1991)), a presumption that applies to
			 all agencies governed by that Act;</text>
			</paragraph><paragraph id="ID1222EFBEC92B44F4BCEF4FFA2A94E756"><enum>(4)</enum><text><quote>disclosure,
			 not secrecy, is the dominant objective of the Act,</quote> as noted by the
			 United States Supreme Court in Department of Air Force v. Rose (425 U.S. 352
			 (1976));</text>
			</paragraph><paragraph id="ID4CE850F861004E12ABC8D0C2998E3B27"><enum>(5)</enum><text>in practice, the
			 Freedom of Information Act has not always lived up to the ideals of that Act;
			 and</text>
			</paragraph><paragraph id="ID351D45125EF14952BADE13CB58BCEB88"><enum>(6)</enum><text>Congress should
			 regularly review section 552 of title 5, United States Code (commonly referred
			 to as the Freedom of Information Act), in order to determine whether further
			 changes and improvements are necessary to ensure that the Government remains
			 open and accessible to the American people and is always based not upon the
			 <quote>need to know</quote> but upon the fundamental <quote>right to
			 know</quote>.</text>
			</paragraph></section><section id="IDA4A9DD519B9D461BB9427D66E65C8436"><enum>3.</enum><header>Protection of
			 fee status for news media</header><text display-inline="no-display-inline">Section 552(a)(4)(A)(ii) of title 5, United
			 States Code, is amended by adding at the end the following:</text>
			<quoted-block id="ID90C5F1DAA7074B9C82821BAC64D731EB" style="OLC">
				<subsection id="ID8AF3353CD0434D44BFC9FD20EDB5FECA"><enum></enum><text>In this
				clause, the term <term>a representative of the news media</term> means any
				person or entity that gathers information of potential interest to a segment of
				the public, uses its editorial skills to turn the raw materials into a distinct
				work, and distributes that work to an audience. In this clause, the term
				<term>news</term> means information that is about current events or that would
				be of current interest to the public. Examples of news-media entities are
				television or radio stations broadcasting to the public at large and publishers
				of periodicals (but only if such entities qualify as disseminators of
				<term>news</term>) who make their products available for purchase by or
				subscription by or free distribution to the general public. These examples are
				not all-inclusive. Moreover, as methods of news delivery evolve (for example,
				the adoption of the electronic dissemination of newspapers through
				telecommunications services), such alternative media shall be considered to be
				news-media entities. A freelance journalist shall be regarded as working for a
				news-media entity if the journalist can demonstrate a solid basis for expecting
				publication through that entity, whether or not the journalist is actually
				employed by the entity. A publication contract would present a solid basis for
				such an expectation; the Government may also consider the past publication
				record of the requester in making such a
				determination.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDF06EB7C5AE7047829FC127FD7D6E1CD4"><enum>4.</enum><header>Recovery of
			 attorney fees and litigation costs</header>
			<subsection id="id86AE36C00D9541AFBA744FA0EF84BAAE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 552(a)(4)(E)
			 of title 5, United States Code, is amended—</text>
				<paragraph id="ID730116DABE91417EB63F7017C7A5AD58"><enum>(1)</enum><text>by inserting
			 <quote>(i)</quote> after <quote>(E)</quote>; and</text>
				</paragraph><paragraph id="ID0C85FC79D51B4175B5761A3283DDB46D"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="ID135506A7E2774FFB8F91E43A141717A1" style="OLC">
						<clause id="ID50DD56EC41DC4E368C38D6A5EE358994"><enum>(ii)</enum><text>For purposes of
				this subparagraph, a complainant has substantially prevailed if the complainant
				has obtained relief through either—</text>
							<subclause id="ID2ABDB7222D8C4F9E90C3E7D394443D13" indent="up2"><enum>(I)</enum><text>a judicial order, or an enforceable
				written agreement or consent decree; or</text>
							</subclause><subclause id="IDBCC4FFAA50F3438DA767D9711DE0EAF8" indent="up2"><enum>(II)</enum><text>a voluntary or unilateral change
				in position by the agency, if the complainant’s claim is not
				insubstantial.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2C688FA4F6624BB9A355626637BACD75"><enum>(b)</enum><header>Limitation</header><text>Notwithstanding
			 section 1304 of title 31, United States Code, no amounts may be obligated or
			 expended from the Claims and Judgment Fund of the United States Treasury to pay
			 the costs resulting from fees assessed under section 552(a)(4)(E) of title 5,
			 United States Code. Any such amounts shall be paid only from funds annually
			 appropriated for any authorized purpose for the Federal agency against which a
			 claim or judgment has been rendered.</text>
			</subsection></section><section id="ID153A01B5CA8A4BE1902A5FFEBF158D6C"><enum>5.</enum><header>Disciplinary
			 actions for arbitrary and capricious rejections of requests</header><text display-inline="no-display-inline">Section 552(a)(4)(F) of title 5, United
			 States Code, is amended—</text>
			<paragraph id="ID34B4A59E90E0460383021ED6F2C8DB4B"><enum>(1)</enum><text>by inserting
			 <quote>(i)</quote> after <quote>(F)</quote>; and</text>
			</paragraph><paragraph id="IDC918284CA6EC44F992EE83411558337E"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="ID54A6F5A597BE4A68B7B18C0202DF18C0" style="OLC">
					<clause id="ID265EA254C25040F891BAD4F0C5B6FB2E" indent="up3"><enum>(ii)</enum><text>The Attorney General shall—</text>
						<subclause id="ID577087B7916C45878ADD9F215774C74F"><enum>(I)</enum><text>notify the Special Counsel of each
				civil action described under the first sentence of clause (i); and</text>
						</subclause><subclause id="IDBC0C18763A8E4A88BCC709C01E724441"><enum>(II)</enum><text>annually submit a report to Congress
				on the number of such civil actions in the preceding year.</text>
						</subclause></clause><clause id="IDF8E1CB3C045E4B3CA9C728B0945674BA" indent="up3"><enum>(iii)</enum><text>The Special Counsel shall annually
				submit a report to Congress on the actions taken by the Special Counsel under
				clause
				(i).</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="IDDFED8335B9DC4818B14000DAF3B11141"><enum>6.</enum><header>Time limits for
			 agencies to Act on requests</header>
			<subsection id="IDC255E9BE84E5418FA054AEDF0D754C58"><enum>(a)</enum><header>Time
			 Limits</header>
				<paragraph id="IDF2236D2B772446BFB8CE1E55472E7B5A"><enum>(1)</enum><header>In
			 General</header><text>Section 552(a)(6)(A) of title 5, United States Code, is
			 amended by inserting after clause (ii) the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID43B26531152D4946849B16BFA7CF9EDE" style="OLC">
						<paragraph id="id9D7CC4CC1E4C4450B92C6B3B2FE080E4"><enum></enum><text>The 20-day
				period under clause (i) shall commence on the date on which the request is
				first received by the appropriate component of the agency, but in any event not
				later than ten days after the request is first received by any component of the
				agency that is designated in the agency’s regulations under this section to
				receive requests under this section. The 20-day period shall not be tolled by
				the agency except—</text>
							<subparagraph id="IDF06C805F27F942E8BFD7CAFDDDFEA60B" indent="down1"><enum>(I)<?LEXA-Enum (I)?></enum><text>that the agency may make one
				request to the requester for information and toll the 20-day period while it is
				awaiting such information that it has reasonably requested from the requester
				under this section; or</text>
							</subparagraph><subparagraph id="IDCCC4E97563ED49779AC59163E45476F4" indent="down1"><enum>(II)<?LEXA-Enum (II)?></enum><text>if necessary to clarify
				with the requester issues regarding fee assessment. In either case, the
				agency’s receipt of the requester’s response to the agency’s request for
				information or clarification ends the tolling
				period.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDD3BDED9A1E3540A285685C6C544FBE9D"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by this subsection shall take effect 1
			 year after the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="ID98C4F51694624BAD9A3FA16CE5ADF9FE"><enum>(b)</enum><header>Compliance with
			 Time Limits</header>
				<paragraph id="ID2D217441EFDF46DC8045A4427144052B"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="idB24782E228A8450DB3A084BE676497DF"><enum>(A)</enum><header>Search
			 fees</header><text>Section 552(a)(4)(A) of title 5, United States Code, is
			 amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idB5714C2C0D9B4F9799B5210AA83E6996" style="OLC">
							<clause id="ID11C91F1B8A7440E1A1079E56503DAA12"><enum>(viii)</enum><text>An agency
				shall not assess search fees (or in the case of a requester described under
				clause (ii)(II), duplication fees) under this subparagraph if the agency fails
				to comply with any time limit under paragraph (6), if no unusual or exceptional
				circumstances (as those terms are defined for purposes of paragraphs (6)(B) and
				(C), respectively) apply to the processing of the
				request.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id1381F6CD833E41539E808DE591D5F715"><enum>(B)</enum><header>Public
			 Liaison</header><text>Section 552(a)(6)(B)(ii) of title 5, United States Code,
			 is amended by inserting after the first sentence the following: <quote>To aid
			 the requester, each agency shall make available its FOIA Public Liaison, who
			 shall assist in the resolution of any disputes between the requester and the
			 agency.</quote>.</text>
					</subparagraph></paragraph><paragraph id="ID10B4343C245D4499B57F41E44FA15AE9"><enum>(2)</enum><header>Effective date
			 and application</header><text>The amendment made by this subsection shall take
			 effect 1 year after the date of enactment of this Act and apply to requests for
			 information under section 552 of title 5, United States Code, filed on or after
			 that effective date.</text>
				</paragraph></subsection></section><section id="ID8B9A206A704140CCBB1EF50A6264E33A"><enum>7.</enum><header>Individualized
			 tracking numbers for requests and status information</header>
			<subsection id="IDBE5F225E24F44319B0E1B103EB4B9E45"><enum>(a)</enum><header>In
			 General</header><text>Section 552(a) of title 5, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block id="ID1FD3620DA13F4AB3B5232492C3C8D99B" style="OLC">
					<paragraph id="ID17C1B8C08FC34C3FBEEC609800AE52C2" indent="up1"><enum>(7)</enum><text>Each agency shall—</text>
						<subparagraph id="ID58FEA5C343344E689DF6FC93C34437B0"><enum>(A)</enum><text>establish a system to assign an
				individualized tracking number for each request received that will take longer
				than ten days to process and provide to each person making a request the
				tracking number assigned to the request; and</text>
						</subparagraph><subparagraph id="IDD7B85671A2B246D2AC7BE633A725766B"><enum>(B)</enum><text>establish a telephone line or Internet
				service that provides information about the status of a request to the person
				making the request using the assigned tracking number, including—</text>
							<clause id="ID43223FECB8D84A1AA1B3DE137FF6CE48"><enum>(i)</enum><text>the date on which the agency
				originally received the request; and</text>
							</clause><clause id="ID3FAA71FD25C24DF3BB7ADA895A4EDB13"><enum>(ii)</enum><text>an estimated date on which the
				agency will complete action on the
				request.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID31E06041F92A422D9A5156D8038E1DC1"><enum>(b)</enum><header>Effective Date
			 and Application</header><text>The amendment made by this section shall take
			 effect 1 year after the date of enactment of this Act and apply to requests for
			 information under section 552 of title 5, United States Code, filed on or after
			 that effective date.</text>
			</subsection></section><section id="IDC23E4EE20CF342439C9EF84031A5022B"><enum>8.</enum><header>Reporting
			 requirements</header>
			<subsection id="IDF58FD1836B114882AB3F779A3EFC1D44"><enum>(a)</enum><header>In
			 General</header><text>Section 552(e)(1) of title 5, United States Code, is
			 amended—</text>
				<paragraph id="ID099321998B954152881AEAE9BC8A1351"><enum>(1)</enum><text>in subparagraph
			 (B)(ii), by inserting after the first comma <quote>the number of occasions on
			 which each statute was relied upon,</quote>;</text>
				</paragraph><paragraph id="IDADB49C492C2A4742AF9AA79D3EE3838B"><enum>(2)</enum><text>in subparagraph
			 (C), by inserting <quote>and average</quote> after
			 <quote>median</quote>;</text>
				</paragraph><paragraph id="IDD50ED798A0A440C590BF68450BA2064F"><enum>(3)</enum><text>in subparagraph
			 (E), by inserting before the semicolon <quote>, based on the date on which the
			 requests were received by the agency</quote>;</text>
				</paragraph><paragraph id="IDC275EF32D2A64DA59F3A471D62C33D1C"><enum>(4)</enum><text>by redesignating
			 subparagraphs (F) and (G) as subparagraphs (N) and (O), respectively;
			 and</text>
				</paragraph><paragraph id="ID90929C62E3C6430AB8D42BC09659BC42"><enum>(5)</enum><text>by inserting
			 after subparagraph (E) the following:</text>
					<quoted-block id="ID8D76B703C4044805BE1DD7BCB3F4282D" style="OLC">
						<subparagraph id="IDBA253B8C332B4DFAB5D9BC7FC4A50E54"><enum>(F)</enum><text>the average
				number of days for the agency to respond to a request beginning on the date on
				which the request was received by the agency, the median number of days for the
				agency to respond to such requests, and the range in number of days for the
				agency to respond to such requests;</text>
						</subparagraph><subparagraph id="IDC2F4636E372E421195516C6264EC4BAB"><enum>(G)</enum><text>based on the
				number of business days that have elapsed since each request was originally
				received by the agency—</text>
							<clause id="ID34A08475C19043B1A91AFEDCBF5AE0D4"><enum>(i)</enum><text>the number of
				requests for records to which the agency has responded with a determination
				within a period up to and including 20 days, and in 20-day increments up to and
				including 200 days;</text>
							</clause><clause id="ID298B186B100D4861B409350CEB6E2232"><enum>(ii)</enum><text>the number of
				requests for records to which the agency has responded with a determination
				within a period greater than 200 days and less than 301 days;</text>
							</clause><clause id="IDC56FA155360D418BAA81585EF8723F25"><enum>(iii)</enum><text>the number of
				requests for records to which the agency has responded with a determination
				within a period greater than 300 days and less than 401 days; and</text>
							</clause><clause id="IDE25F262990284D158A463BB567532A85"><enum>(iv)</enum><text>the number of
				requests for records to which the agency has responded with a determination
				within a period greater than 400 days;</text>
							</clause></subparagraph><subparagraph id="ID2AEDAF7D1AAC45F7853AEA475C8D6CFD"><enum>(H)</enum><text>the average
				number of days for the agency to provide the granted information beginning on
				the date on which the request was originally filed, the median number of days
				for the agency to provide the granted information, and the range in number of
				days for the agency to provide the granted information;</text>
						</subparagraph><subparagraph id="IDE961CA8F8DB74B9E8DFB5B230D6A8BEB"><enum>(I)</enum><text>the median and
				average number of days for the agency to respond to administrative appeals
				based on the date on which the appeals originally were received by the agency,
				the highest number of business days taken by the agency to respond to an
				administrative appeal, and the lowest number of business days taken by the
				agency to respond to an administrative appeal;</text>
						</subparagraph><subparagraph id="ID7CA0CF144A7E477C905D8627B4E4EFE1"><enum>(J)</enum><text>data on the 10
				active requests with the earliest filing dates pending at each agency,
				including the amount of time that has elapsed since each request was originally
				received by the agency;</text>
						</subparagraph><subparagraph id="IDC69C34A0F37E43B791C49CF5FC943F57"><enum>(K)</enum><text>data on the 10
				active administrative appeals with the earliest filing dates pending before the
				agency as of September 30 of the preceding year, including the number of
				business days that have elapsed since the requests were originally received by
				the agency;</text>
						</subparagraph><subparagraph id="IDF1499AF5322D401780987E7AC81F4E1C"><enum>(L)</enum><text>the number of
				expedited review requests that are granted and denied, the average and median
				number of days for adjudicating expedited review requests, and the number
				adjudicated within the required 10 days;</text>
						</subparagraph><subparagraph id="ID9E9821DCF37946E48B8C877A5A091E50"><enum>(M)</enum><text>the number of fee
				waiver requests that are granted and denied, and the average and median number
				of days for adjudicating fee waiver
				determinations;</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID985C7EC645834C60ABD07D0A4B885BB7"><enum>(b)</enum><header>Applicability
			 to Agency and Each Principal Component of the Agency</header><text>Section
			 552(e) of title 5, United States Code, is amended—</text>
				<paragraph id="IDFC6B255511E2487AB47109E4205EBDE3"><enum>(1)</enum><text>by redesignating
			 paragraphs (2) through (5) as paragraphs (3) through (6), respectively;
			 and</text>
				</paragraph><paragraph id="IDF7BD9C49B0A4499B8CBB223F7518F409"><enum>(2)</enum><text>by inserting
			 after paragraph (1) the following:</text>
					<quoted-block id="ID77178DC640B7456B99A5EE34FF4148B3" style="OLC">
						<paragraph id="ID624C62585F0A47EEB23916EC77FF3511"><enum>(2)</enum><text>Information in
				each report submitted under paragraph (1) shall be expressed in terms of each
				principal component of the agency and for the agency
				overall.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDC3A264654E7942B095A38DF949169E4A"><enum>(c)</enum><header>Public
			 Availability of Data</header><text>Section 552(e)(3) of title 5, United States
			 Code, (as redesignated by subsection (b) of this section) is amended by adding
			 at the end <quote>In addition, each agency shall make the raw statistical data
			 used in its reports available electronically to the public upon
			 request.</quote>.</text>
			</subsection></section><section id="IDB4F03CDD425C4F3DA23BF40A00B2B4C0"><enum>9.</enum><header>Openness of
			 agency records maintained by a private entity</header><text display-inline="no-display-inline">Section 552(f) of title 5, United States
			 Code, is amended by striking paragraph (2) and inserting the following:</text>
			<quoted-block id="IDF7C6BC4FEA774F748EFC465AA37B896F" style="OLC">
				<paragraph id="IDF5BFA0EB6AE2486AB30A9BAB8C28A1A5"><enum>(2)</enum><text><quote>record</quote>
				and any other term used in this section in reference to information
				includes—</text>
					<subparagraph id="ID83AE18B0D1C7441DB9198882B8341805"><enum>(A)</enum><text>any information
				that would be an agency record subject to the requirements of this section when
				maintained by an agency in any format, including an electronic format;
				and</text>
					</subparagraph><subparagraph id="IDD250D68D12C24305917506326D4D920C"><enum>(B)</enum><text>any information
				described under subparagraph (A) that is maintained for an agency by an entity
				under Government contract, for the purposes of records
				management.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID6D39B06F5EC44C09A1F89F7967948186"><enum>10.</enum><header>Office of
			 Government Information Services</header>
			<subsection id="IDE161C93C3C2E4A80850A428E1F0B5F44"><enum>(a)</enum><header>In
			 General</header><text>Section 552 of title 5, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block id="ID15039E695C0F43F980EC78EB99BE4AA9" style="OLC">
					<subsection id="ID310698FA4F374CF2BA3B3D5C3D262F69"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id6AAE9978BE6E4AC3B25D42DCE4DA4D9D"><enum>(1)</enum><text>There is established
				the Office of Government Information Services within the National Archives and
				Records Administration.</text>
						</paragraph><paragraph id="id90FC40C5409B4119B2700DBE52468241" indent="up1"><enum>(2)</enum><text>The Office of Government Information
				Services shall—</text>
							<subparagraph id="id395B8355EB244E4FB5D9DEF4708781E2"><enum>(A)</enum><text>review policies and procedures of
				administrative agencies under this section;</text>
							</subparagraph><subparagraph id="id0A9263D6C5D2464C8D909C2DFDB81CA7"><enum>(B)</enum><text>review compliance with this section by
				administrative agencies; and</text>
							</subparagraph><subparagraph id="id785675EB9B6F45ABB3670A28503C5997"><enum>(C)</enum><text>recommend policy changes to Congress
				and the President to improve the administration of this section.</text>
							</subparagraph></paragraph><paragraph id="id3FF23AFB00214B38953BDEF542277B81" indent="up1"><enum>(3)</enum><text>The Office of Government Information
				Services shall offer mediation services to resolve disputes between persons
				making requests under this section and administrative agencies as a
				non-exclusive alternative to litigation and, at the discretion of the Office,
				may issue advisory opinions if mediation has not resolved the dispute.</text>
						</paragraph></subsection><subsection id="IDDD6A04BE002C4DBAAA50FF9D59267FCF"><enum>(i)</enum><text>The Government
				Accountability Office shall conduct audits of administrative agencies on the
				implementation of this section and issue reports detailing the results of such
				audits.</text>
					</subsection><subsection id="ID6DA478158DFA4423A0A761623FE21183"><enum>(j)</enum><text>Each agency shall
				designate a Chief FOIA Officer who shall be a senior official of such agency
				(at the Assistant Secretary or equivalent level).</text>
					</subsection><subsection id="ID7C06CDE136A042578D46D014DC55AB42"><enum>(k)</enum><text>The Chief FOIA
				Officer of each agency shall, subject to the authority of the head of the
				agency—</text>
						<paragraph id="ID9EC6771B8CFC49DDA82C7E3F1660EDEC"><enum>(1)</enum><text>have agency-wide
				responsibility for efficient and appropriate compliance with this
				section;</text>
						</paragraph><paragraph id="ID5EC907374B6E45329A056FFE4EE8AC65"><enum>(2)</enum><text>monitor
				implementation of this section throughout the agency and keep the head of the
				agency, the chief legal officer of the agency, and the Attorney General
				appropriately informed of the agency’s performance in implementing this
				section;</text>
						</paragraph><paragraph id="IDAC54355E9B034B4986855AAD333AD748"><enum>(3)</enum><text>recommend to the
				head of the agency such adjustments to agency practices, policies, personnel,
				and funding as may be necessary to improve its implementation of this
				section;</text>
						</paragraph><paragraph id="ID5807C6FAA0444E4A8F38F8FA0FB2ACE3"><enum>(4)</enum><text>review and report
				to the Attorney General, through the head of the agency, at such times and in
				such formats as the Attorney General may direct, on the agency’s performance in
				implementing this section;</text>
						</paragraph><paragraph id="IDE9DBA0D303F5475BA9677CE80B1DBD30"><enum>(5)</enum><text>facilitate public
				understanding of the purposes of the statutory exemptions of this section by
				including concise descriptions of the exemptions in both the agency’s handbook
				issued under subsection (g), and the agency’s annual report on this section,
				and by providing an overview, where appropriate, of certain general categories
				of agency records to which those exemptions apply; and</text>
						</paragraph><paragraph id="ID72AB3BAA9C3A484696226D629484A77C"><enum>(6)</enum><text>designate one or
				more FOIA Public Liaisons.</text>
						</paragraph></subsection><subsection id="ID38641E5C51D849B2986869CB1B0D1FAF"><enum>(l)</enum><text>FOIA Public
				Liaisons shall report to the agency Chief FOIA Officer and shall serve as
				supervisory officials to whom a requester under this section can raise concerns
				about the service the requester has received from the FOIA Requester Center,
				following an initial response from the FOIA Requester Center Staff. FOIA Public
				Liaisons shall be responsible for assisting in reducing delays, increasing
				transparency and understanding of the status of requests, and assisting in the
				resolution of
				disputes.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID95109FAA8E824EC6A455A284106F765B"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall take effect on the
			 date of enactment of this Act.</text>
			</subsection></section><section id="IDC696903D5F1E48C1A411DE72A40B0FF8"><enum>11.</enum><header>Report on
			 personnel policies related to FOIA</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Office of Personnel Management shall submit to
			 Congress a report that examines—</text>
			<paragraph id="ID3DEEE7D5C3C54EFB9A0A106FF6121AED"><enum>(1)</enum><text>whether changes
			 to executive branch personnel policies could be made that would—</text>
				<subparagraph id="ID2AE902388EE84778AA3CEF2470A8112F"><enum>(A)</enum><text>provide greater
			 encouragement to all Federal employees to fulfill their duties under section
			 552 of title 5, United States Code; and</text>
				</subparagraph><subparagraph id="IDC8113A95C7E54954B45619EC548831AA"><enum>(B)</enum><text>enhance the
			 stature of officials administering that section within the executive
			 branch;</text>
				</subparagraph></paragraph><paragraph id="ID34D2D58B204C4E9B83B97E9BB78B88F4"><enum>(2)</enum><text>whether
			 performance of compliance with section 552 of title 5, United States Code,
			 should be included as a factor in personnel performance evaluations for any or
			 all categories of Federal employees and officers;</text>
			</paragraph><paragraph id="ID582DD91A70034E1EA16514F3C27424E0"><enum>(3)</enum><text>whether an
			 employment classification series specific to compliance with sections 552 and
			 552a of title 5, United States Code, should be established;</text>
			</paragraph><paragraph id="IDA7268E1FC727461FA499CD5386B1CD5D"><enum>(4)</enum><text>whether the
			 highest level officials in particular agencies administering such sections
			 should be paid at a rate of pay equal to or greater than a particular minimum
			 rate; and</text>
			</paragraph><paragraph id="ID4F29E2E8F25340ECB605FB0F13A328FD"><enum>(5)</enum><text>whether other
			 changes to personnel policies can be made to ensure that there is a clear
			 career advancement track for individuals interested in devoting themselves to a
			 career in compliance with such sections; and</text>
			</paragraph><paragraph id="IDBCE165C27E47437F9B9B560504098B89"><enum>(6)</enum><text>whether the
			 executive branch should require any or all categories of Federal employees to
			 undertake awareness training of such sections.</text>
			</paragraph></section><section id="IDb4c8387a18cc45d88d4f760c9c3565c7"><enum>12.</enum><header>Requirement to
			 describe exemptions authorizing deletions of material provided under
			 FOIA</header><text display-inline="no-display-inline">Section 552(b) of title
			 5, United States Code, is amended in the matter after paragraph (9)—</text>
			<paragraph id="IDf99c11970b8445059f6fb60f5415ecf7"><enum>(1)</enum><text>in the second
			 sentence, by inserting after <quote>amount of information deleted</quote> the
			 following: <quote>, and the exemption under which the deletion is
			 made,</quote>; and</text>
			</paragraph><paragraph id="ID5d01750c2bd247dab30cfde7f586c78c"><enum>(2)</enum><text>in the third
			 sentence, by inserting after <quote>amount of the information deleted</quote>
