		<official-title>To amend the Public Health Service Act to improve
		  immunization rates by increasing the supply of vaccines.</official-title>

		<section id="idFF1F46C50C4E451FBED3D6D16F107BA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Improved Vaccine Supply
			 Act</short-title></quote>.</text>
		</section><section id="ID24601318BEDC4769B55E3B048570777C"><enum>2.</enum><header>Supply of
			 vaccines</header><text display-inline="no-display-inline">Title XXI of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 300aa–1 et seq.) is amended by adding at the end the following:</text>
			<quoted-block act-name="Public Health Service Act" id="ID0678762154144FDEB485727933C21118" style="OLC">
				<subtitle id="ID50F6D84D28164CE5A670B9FDADA9D79D"><enum>3</enum><header>Adequate Vaccine
				Supply</header>
					<section id="ID06C9B2F875D4482EAFA4E167D3EDDFCD"><enum>2141.</enum><header>Supply of
				vaccines</header>
						<subsection id="IDAA1F9A6EBE5148AC84A194F19CA5DBCD"><enum>(a)</enum><header>In
				General</header>
							<paragraph id="ID2A795B59619842C79E77461F9AD4E373"><enum>(1)</enum><header>Plan</header><text>Not
				later than 3 months after the date of enactment of this section, the Secretary,
				acting through the Director of the Centers for Disease Control and Prevention,
				shall develop a plan for the purchase, storage, and rotation of a supply of
				vaccines sufficient to provide routinely recommended vaccinations for a 6-month
				period for—</text>
								<subparagraph id="IDAAACA1CC2A5549918309415CE57E0454"><enum>(A)</enum><text>a national
				stockpile of vaccines for all children as authorized under section 1928(d)(6)
				of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
				1396s(d)(6)); and</text>
								</subparagraph><subparagraph id="IDC68F4A3553FD4D9FB806ACA338BF9466"><enum>(B)</enum><text>adults.</text>
								</subparagraph></paragraph><paragraph id="ID95AAFBBD4558433599D7ED36FB31A9C6"><enum>(2)</enum><header>Supply</header><text>The
				supply of vaccines under paragraph (1) shall—</text>
								<subparagraph id="IDDC8E74403D7348EDBF6EFE3B1A8A34A2"><enum>(A)</enum><text>include all
				vaccines routinely recommended for children by the Advisory Committee on
				Immunization Practices;</text>
								</subparagraph><subparagraph id="ID4418D0A9B54A49F1B1EE5FD444B8A355"><enum>(B)</enum><text>include all
				vaccines routinely recommended for adults by the Advisory Committee on
				Immunization Practices; and</text>
								</subparagraph><subparagraph id="ID8fd2e149095842bc83f801f215ac2fda"><enum>(C)</enum><text>include other
				vaccines, as designated by the Secretary, that contribute to public health
				preparedness efforts.</text>
								</subparagraph></paragraph><paragraph id="ID679FAB7EB8D6410DAAC3E102758C18F2"><enum>(3)</enum><header>Supply
				authority</header><text>The Secretary shall carry out—</text>
								<subparagraph id="IDA16BBFADD92847F89F53326BB6A64FC4"><enum>(A)</enum><text>paragraph (2)(A)
				using the authority provided for under section 1928(d)(6) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
				1396s(d)(6)); and</text>
								</subparagraph><subparagraph id="ID7450EDFE10BD4DB2986669FAFE65AC98"><enum>(B)</enum><text>paragraph (2)(B)
				using—</text>
									<clause id="IDF38C3436A2EC4C5293208A08B9BC209F"><enum>(i)</enum><text>the authority
				provided for under section 317; and</text>
									</clause><clause id="IDAE0DB1FF14914598820021A24A16DF6A"><enum>(ii)</enum><text>any other
				authority relating to the vaccines described in such paragraph.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="IDF534F97E94614A429A388065DD839B8B"><enum>(b)</enum><header>Submission of
				Plan</header>
							<paragraph id="IDE5F1821C0EE64BDEA259F657454963FA"><enum>(1)</enum><header>In
				general</header><text>Not later than 6 months after the date of enactment of
				this section, the Secretary shall submit the plan developed under subsection
				(a) to—</text>
								<subparagraph id="ID09A431AE1D99473D85EB520DFD114A7A"><enum>(A)</enum><text>the Committee on
				Health, Education, Labor, and Pensions of the Senate;</text>
								</subparagraph><subparagraph id="ID0638CE62303D4407BAA8DC56A01CF123"><enum>(B)</enum><text>the Committee on
				Finance of the Senate; and</text>
								</subparagraph><subparagraph id="ID93490EAEC0354BD9B726C1D41733F1B0"><enum>(C)</enum><text>the Committee on
				Energy and Commerce of the House of Representatives.</text>
								</subparagraph></paragraph><paragraph id="ID7DFFCE737D214BCA8532728B1844A0F7"><enum>(2)</enum><header>Inclusions</header><text>The
				plan shall include a discussion of the considerations that formed—</text>
								<subparagraph id="ID21D1D5A6252A433685C805CE188888C0"><enum>(A)</enum><text>the basis for the
				plan; and</text>
								</subparagraph><subparagraph id="ID44221FC2B9DB4FA2BD6BE68166C204CF"><enum>(B)</enum><text>the
				prioritization of the schedule for purchasing vaccines set forth in the
				plan.</text>
								</subparagraph></paragraph></subsection><subsection id="ID396BCEE1C2A543ADA50556B638C6D9F7"><enum>(c)</enum><header>Implementation
				of the Plan</header><text>Not later than September 30, 2008, the Secretary
				shall fully implement the plan developed under subsection (a).</text>
						</subsection><subsection id="ID9B5A96CC90B94287BDE82F1A44126BDB"><enum>(d)</enum><header>Notice</header>
							<paragraph id="ID819EE688C15F4AC5BF0773155ADC9C06"><enum>(1)</enum><header>In
				general</header><text>For the purposes of maintaining and administering the
				supply of vaccines described under subsection (a), the Secretary shall require
				by contract that the manufacturer of a vaccine included in such supply provide
				not less than 1 year notice to the Secretary of a discontinuance of the
				manufacture of the vaccine, or of other factors, that may prevent the
				manufacturer from providing vaccines pursuant to an arrangement made to carry
				out this section.</text>
							</paragraph><paragraph id="IDBD4BBCD4AECE4332B5CDEC37FF3F16D7"><enum>(2)</enum><header>Reduction of
				period of notice</header><text>The notification period required under paragraph
				(1) may be reduced if the manufacturer certifies to the Secretary that good
				cause exists for reduction, under the conditions described in section 506C(b)
				of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic
				Act</act-name> (21 U.S.C. 356c).</text>
							</paragraph></subsection><subsection id="ID6732769FE3F44B4180D67460449F44CF"><enum>(e)</enum><header>Proceeds</header><text>Any
				proceeds received by the Secretary from the sale of vaccines contained in the
				supply maintained pursuant to this section, shall be available to the Secretary
				for the purpose of purchasing additional vaccines for the supply. Such proceeds
				shall remain available until expended.</text>
						</subsection><subsection id="ID95CF1B4B59464F498FBFA5150953C867"><enum>(f)</enum><header>Ongoing
				Reports</header>
							<paragraph id="ID423406CAB79E483581A97492F696BC1B"><enum>(1)</enum><header>In
				general</header><text>Not later than 2 years after submitting the plan pursuant
				to subsection (b), and periodically thereafter, the Secretary shall submit a
				report to the Committees identified in subsection (b)(1) that—</text>
								<subparagraph id="IDAAC95B02633F40D4BFD681B64AA9DB6B"><enum>(A)</enum><text>details the
				progress made in implementing the plan developed under subsection (a);
				and</text>
								</subparagraph><subparagraph id="IDA5CC77D44C424836A5FA8ACFC9E05B2E"><enum>(B)</enum><text>notes
				impediments, if any, to implementing the plan developed under subsection
				(a).</text>
								</subparagraph></paragraph><paragraph id="ID0FFBE83C6A88480B80AAAF12CB03A42F"><enum>(2)</enum><header>Recommendation</header><text>The
				Secretary shall include in the first of such reports required under paragraph
				(1)—</text>
								<subparagraph id="IDC5512678ED684F8D993E7DC040BE6CBD"><enum>(A)</enum><text>a recommendation
				as to whether the vaccine supply should be extended beyond the 6-month period
				provided in subsection (a); and</text>
								</subparagraph><subparagraph id="ID503ED2431A9B4E5C933509E32343B9F7"><enum>(B)</enum><text>a discussion of
				the considerations that formed the recommendation under subparagraph
				(A).</text>
								</subparagraph></paragraph></subsection><subsection id="ID2D48F16D1A6F4BF1B15138B40CBB839C"><enum>(g)</enum><header>Authorization
				of Appropriations</header><text>There are authorized to be appropriated to
				carry out this section such sums as may be necessary for each of fiscal years
				2008 through
				2012.</text>
						</subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
