		<official-title>To amend title 38, United States Code, to improve the
		  enforcement of the Uniformed Services Employment and Reemployment Rights Act of
		  1994, and for other purposes.</official-title>

		<section id="idA3A8CA569D834F71804B1CF7BD451626" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>USERRA Enforcement Improvement Act of
			 2007</short-title></quote>.</text>
		</section><section id="idFD09C7CC3F6947169083B766C95D2325" section-type="subsequent-section"><enum>2.</enum><header>Reform of USERRA
			 complaint process</header>
			<subsection id="id4134A51EE6984ECFABF9FEEDD8B1C427"><enum>(a)</enum><header>Notification of
			 rights with respect to complaints</header><text>Subsection (c) of section 4322
			 of title 38, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id282C4545CBF246D7A5090DDA93AC513C" style="OLC">
					<subsection id="id05B5FAC8816842B6A429BA5B6709ADEC"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idA0571CF0D46B42488C0C8D50FB62A3B8"><enum>(1)</enum><text>Not later than 5 days
				after the Secretary receives a complaint submitted by a person under subsection
				(a), the Secretary shall notify such person of his or her rights with respect
				to such complaint under this section and section 4223 or 4224, as the case may
				be.</text>
						</paragraph><paragraph id="id2B8C9953840647F5A6F3467F6D2E54A9" indent="up1"><enum>(2)</enum><text>The Secretary shall, upon request,
				provide technical assistance to a potential claimant with respect to a
				complaint under this subsection, and when appropriate, to such claimant's
				employer.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id4525B9F7E2D6406CB99B9376148DB149"><enum>(b)</enum><header>Expedition of
			 attempts To investigate and resolve complaints</header><text>Section 4322 of
			 such title is amended—</text>
				<paragraph id="idFC1BD17690F04891A2B6A2F69A5E90D1"><enum>(1)</enum><text>by redesignating
			 subsection (f) as subsection (g); and</text>
				</paragraph><paragraph id="id519CE4E756B34FE8AF70735DC392F519"><enum>(2)</enum><text>by inserting
			 after subsection (e) the following new subsection (f):</text>
					<quoted-block display-inline="no-display-inline" id="id44E98063D1B046AB8458AE9D977FDA99" style="OLC">
						<subsection id="idA062D1DB1433430785DEFCD9C96A958A"><enum>(f)</enum><text>Any action
				required by subsections (d) and (e) with respect to a complaint submitted by a
				person to the Secretary under subsection (a) shall be completed by the
				Secretary not later than 90 days after receipt of such
				complaint.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id65BE53091C0A42D5A5EEF25D23181B3F"><enum>(c)</enum><header>Expedition of
			 referrals</header>
				<paragraph id="id1DAFAC9237D14735974736EFACDF0C25"><enum>(1)</enum><header>Expedition of
			 referrals to Attorney General</header><text>Section 4323(a)(1) of such title is
			 amended by inserting <quote>Not later than 15 days after the Secretary receives
			 such a request with respect to a complaint, the Secretary shall refer the
			 complaint to the Attorney General.</quote> after <quote>to the Attorney
			 General.</quote>.</text>
				</paragraph><paragraph id="idDDC8A919CB4547AB9D31C4F357BBAB13"><enum>(2)</enum><header>Expedition of
			 referrals to Special Counsel</header><text>Section 4324(a)(1) of such title is
			 amended by striking <quote>The Secretary shall refer</quote> and inserting
			 <quote>Not later than 15 days after the date the Secretary receives such a
			 request, the Secretary shall refer</quote>.</text>
				</paragraph></subsection><subsection id="idC5C5D56831224E59B5BCF2648EB8C745"><enum>(d)</enum><header>Notification of
			 representation</header>
				<paragraph id="id52D75CC13FAD4D17A109CD15BBEFEC8C"><enum>(1)</enum><header>Notification by
			 Attorney General</header><text>Section 4323(a) of such title is amended—</text>
					<subparagraph id="id39452E2F53224065B71E4A4820678147"><enum>(A)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
					</subparagraph><subparagraph id="idE4F66CC90A59463E884D3D0C056C982F"><enum>(B)</enum><text>by inserting
			 after paragraph (1) the following new paragraph (2):</text>
						<quoted-block display-inline="no-display-inline" id="id717524FAD7F04616B44EDA433D4F908C" style="OLC">
							<paragraph id="ID138498fa57b746ae93d4fcd19cf0aaba" indent="up1"><enum>(2)</enum><text>Not later than 45 days after the date
				the Attorney General receives a referral under paragraph (1), the Attorney
				General shall—</text>
								<subparagraph id="idDD6B675E98AD4C72864125105B623508"><enum>(A)</enum><text>make a decision whether to appear on
				behalf of, and act as attorney for, the person on whose behalf the complaint is
				submitted; and</text>
								</subparagraph><subparagraph id="id074024A3E17F496D817BBE2E865B811A"><enum>(B)</enum><text>notify such person of such
				decision.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idCC75EBC4E2E64031BDEDA83B86F45C14"><enum>(2)</enum><header>Notification by
			 Special Counsel</header><text>Section 4324(a)(2)(B) of such title is amended to
			 read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idA0CFF2A3DF6A468BAFFBD34D3AA4E973" style="OLC">
						<subparagraph id="idA14490A4546C481A8F39D8270EE65F8A" indent="up2"><enum>(B)</enum><text>Not later than 45 days after the date
				the Special Counsel receives a referral under paragraph (1), the Special
				Counsel shall—</text>
							<clause id="id0A673E62A0034774BE2FD2905A2557F1"><enum>(i)</enum><text>make a decision whether to initiate an
				action and represent a person before the Merit Systems Protection Board under
				subparagraph (A); and</text>
							</clause><clause id="id2A6EE10B5569404D9F473D429B5B4CFE"><enum>(ii)</enum><text>notify such person of such
				decision.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H275074F902794AEEBA3F7E0076E22678" section-type="subsequent-section"><enum>3.</enum><header>Expansion of reporting
			 requirements with respect to enforcement of USERRA</header>
			<subsection id="H75872DF00D774794B5694DC358A3EBB2"><enum>(a)</enum><header>Modification of
			 annual report by Secretary</header><text display-inline="yes-display-inline">Section 4332 of title 38, United States
			 Code, is amended—</text>
				<paragraph id="H86FA3674DA8A48E5A441ED5185F13423"><enum>(1)</enum><text>by striking
			 <quote>The Secretary shall</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="USC">Annual report by
			 Secretary.—</header-in-text>The Secretary shall</quote>;</text>
				</paragraph><paragraph id="H7F6522A34E224058B2E467CE031474FC"><enum>(2)</enum><text>by redesignating
			 paragraphs (4) through (6) as paragraphs (7) through (9), respectively, and
			 inserting after paragraph (3) the following new paragraphs (4), (5), and
			 (6):</text>
					<quoted-block display-inline="no-display-inline" id="H265E5C1FA6D5448596C8CBB7BBB71E1" style="USC">
						<paragraph id="H438B4ADB643A438C9B05EDEF28063000"><enum>(4)</enum><text display-inline="yes-display-inline">The number of cases reviewed by the
				Secretary of Defense through the National Committee for Employer Support of the
				Guard and Reserve of the Department of Defense during such fiscal year.</text>
						</paragraph><paragraph id="idA593E21D14BB4F54BA1859A3BAAEB1FD"><enum>(5)</enum><text display-inline="yes-display-inline">The number of cases reviewed by the
				Secretary and the Secretary of Defense through the National Committee for
				Employer Support of the Guard and Reserve of the Department of Defense that
				involve the same person seeking employment or reemployment.</text>
						</paragraph><paragraph id="H2BBB8F2DE4624B87A400E9C9976C008F"><enum>(6)</enum><text display-inline="yes-display-inline">With respect to the cases reported on
				pursuant to paragraphs (1), (2), (3), (4), and (5)—</text>
							<subparagraph id="idBBF6A72EE07E40879D11132DD7C3CB65"><enum>(A)</enum><text display-inline="yes-display-inline">the number of such cases that involve a
				disability-related issue;</text>
							</subparagraph><subparagraph id="idFF0D2831EB4D4027B7C2FBE5F8A34020"><enum>(B)</enum><text display-inline="yes-display-inline">the number of such cases not described by
				subparagraph (A) that involve a person seeking employment or reemployment who
				has a disability; and</text>
							</subparagraph><subparagraph id="idFAB40FD97B9C4D85AEEDF84BFDD48F64"><enum>(C)</enum><text>with respect to
				subparagraphs (A) and (B) separately, the number of each type of such
				disabilities.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA4168CEA184E415BB5EAE9A6027FD9CB"><enum>(3)</enum><text>in paragraph (7),
			 as so redesignated, by striking <quote>or (3)</quote> and inserting <quote>(3),
			 (4), or (5)</quote>; and</text>
				</paragraph><paragraph id="id369B1BA251FD4960ADE57588E1D1968D"><enum>(4)</enum><text>in subsection
			 (a), as designated by paragraph (1), by striking <quote>transmit to the
			 Congress</quote> and inserting <quote>submit to Congress, the Secretary of
			 Defense, the Secretary of Veterans Affairs, the Attorney General, and the
			 Special Counsel,</quote>.</text>
				</paragraph></subsection><subsection id="id9C9D5834440946EFB88337A20A0E8731"><enum>(b)</enum><header>Quarterly
			 report by Comptroller General</header><text>Such section 4332 is further
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id0B9B00B85E784A6F9B7F7539D38DE142" style="OLC">
					<subsection id="id6F912DA556594CBFBF0F1EA24BFC574A"><enum>(b)</enum><header>Quarterly
				report by Comptroller General</header><text>The Comptroller General of the
				United States shall submit each quarter to Congress, the Secretary of Defense,
				the Secretary of Veterans Affairs, the Attorney General, and the Special
				Counsel a report setting forth, for the previous full quarter, the
				following:</text>
						<paragraph id="IDbc83c5642d2e4398bd7f2c87dcc66b1d"><enum>(1)</enum><text>The number of
				cases for which the Secretary did not meet the requirements of section 4322(f)
				of this title.</text>
						</paragraph><paragraph id="idDF97D5AFBC0E4FD998DCC97DC4BD8BA0"><enum>(2)</enum><text>The number of
				cases for which the Secretary received a request for a referral under paragraph
				(1) of section 4323(a) of this title but did not make such referral within the
				time period required by such paragraph.</text>
						</paragraph><paragraph id="ID6b79d41239694c9f8cde1651f0f09838"><enum>(3)</enum><text>The number of
				cases for which the Secretary received a request for a referral under paragraph
				(1) of section 4324(a) of this title but did not make such referral within the
				time period required by such paragraph.</text>
						</paragraph><paragraph id="id042F3D55DF074F4E9EBBA1456D0C1443"><enum>(4)</enum><text>The number of
				cases for which the Attorney General received a referral under paragraph (1) of
				section 4323(a) of this title but did not meet the requirements of paragraph
				(2) of such section 4323(a) for such referral.</text>
						</paragraph><paragraph id="id3BFA8B6D09CD4C0CAF540A9A11D65513"><enum>(5)</enum><text>The number of
				cases for which the Special Counsel received a referral under paragraph (1) of
				section 4324(a) of this title but did not meet the requirements of paragraph
				(2)(B) of such section 4324(a) for such
				referral.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H36B8E4BF519D4BBDAEA0390934D2AED9"><enum>(c)</enum><header>Uniform
			 categorization of data</header><text>Such section 4332 is further amended by
			 adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC21E3B8C600C4187A41C122069AFB13" style="USC">
					<subsection id="H2BBB533F689F40C3A506B0DACDE8C34E"><enum>(c)</enum><header>Uniform
				categorization of data</header><text>The Secretary shall coordinate with the
				Secretary of Defense, the Secretary of Veterans Affairs, the Attorney General,
				and the Special Counsel to ensure that—</text>
						<paragraph id="idB8D5CBC1BC224BA2BF096A34A5423BA6"><enum>(1)</enum><text>the information
				in the reports required by this section is categorized in a uniform way;
				and</text>
						</paragraph><paragraph id="idEE247EEB6C774CACA2D01DAE9F3ED7B7"><enum>(2)</enum><text>the Secretary,
				the Secretary of Defense, the Secretary of Veterans Affairs, the Attorney
				General, and the Special Counsel each have electronic access to the case files
				reviewed under this chapter by the Secretary, the Secretary of Defense, the
				Attorney General, and the Special
				Counsel.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC023ABC9243D40A5A871D15256AEC3AC"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to each report required under such section 4332 after the date of the enactment
			 of this Act.</text>
