		<official-title>To encourage the donation of excess food to nonprofit
		  organizations that provide assistance to food-insecure people in the United
		  States in contracts entered into by executive agencies for the provision,
		  service, or sale of food.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Federal Food Donation Act of
			 2007</short-title></quote>.</text>
		</section><section id="ID00b4f021ef034bb4b1c84ddf65a73727"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to encourage
			 executive agencies and contractors of executive agencies, to the maximum extent
			 practicable and safe, to donate excess, apparently wholesome food to feed
			 food-insecure people in the United States.</text>
		</section><section id="ID5d257dc2c1804a8d957750597e39dc9d"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID6bc8c0d0bb304df29b8ff7051c9cb99f"><enum>(1)</enum><header>Apparently
			 wholesome food</header><text>The term <term>apparently wholesome food</term>
			 has the meaning given the term in section 2(b) of the Bill Emerson Good
			 Samaritan Food Donation Act (42 U.S.C. 1791(b)).</text>
			</paragraph><paragraph id="IDb5020dc770fe452db3261fedf12eed81"><enum>(2)</enum><header>Excess</header><text>The
			 term <term>excess</term>, when applied to food, means food that—</text>
				<subparagraph id="id4CC43B2C07C04FC58B78AE4730146D44"><enum>(A)</enum><text>is not required
			 to meet the needs of executive agencies; and</text>
				</subparagraph><subparagraph id="id48FC661CF13E49268D3F07583FE893E7"><enum>(B)</enum><text>would otherwise
			 be discarded.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID615fb5b9c3a648f1b860c197d48ad628"><enum>(3)</enum><header>Food-insecure</header><text>The
			 term <term>food-insecure</term> means inconsistent access to sufficient, safe,
			 and nutritious food.</text>
			</paragraph><paragraph id="IDd15e64fb615e4f28addc621bff8eae40"><enum>(4)</enum><header>Nonprofit
			 organization</header><text>The term <term>nonprofit organization</term> means
			 any organization that is—</text>
				<subparagraph id="idFC2C38FE7416481B9BA8EF96A3075B2A"><enum>(A)</enum><text>described in
			 section 501(c) of the Internal Revenue Code of 1986; and</text>
				</subparagraph><subparagraph id="idC7D57EDA61AC473BA5996ADCA9347C21"><enum>(B)</enum><text>exempt from tax
			 under section 501(a) of that Code.</text>
				</subparagraph></paragraph></section><section id="ID2be5b61fb1eb4549a1e294525d540a00"><enum>4.</enum><header>Promoting
			 Federal food donation</header><text display-inline="no-display-inline">Not
			 later than 180 days after the date of enactment of this Act, the Administrator
			 for Federal Procurement Policy shall revise the Federal Acquisition Regulation
			 described in section 6(a) of the Office of Federal Procurement Policy Act (41
			 U.S.C. 405(a)) to provide that all contracts above $25,000 for the provision,
			 service, or sale of food, or for the lease or rental of Federal property to a
			 private entity for events at which food is provided, shall include a clause
			 that—</text>
			<paragraph id="IDd13da808bd1b4d1ea53a8f51e135d429"><enum>(1)</enum><text>encourages the
			 donation of excess, apparently wholesome food to nonprofit organizations that
			 provide assistance to food-insecure people in the United States;</text>
			</paragraph><paragraph id="ID62e58a4ffe2545f9b91c4caed8eca2ac"><enum>(2)</enum><text>provides that the
			 head of an executive agency shall not assume responsibility for the costs and
			 logistics of collecting, transporting, maintaining the safety of, or
			 distributing excess, apparently wholesome food to food-insecure people in the
			 United States; and</text>
			</paragraph><paragraph id="ID98efdec08b71486f9c3a7cf538fd5f83"><enum>(3)</enum><text>provides that
			 executive agencies and contractors making donations pursuant to this Act are
			 protected from civil or criminal liability under the Bill Emerson Good
			 Samaritan Food Donation Act (42 U.S.C. 1791).</text>
			</paragraph></section><section id="id93F5DB590F2244E48D8E107EFA7941AD"><enum>5.</enum><header>Coordinator of
			 community food security and gleaning</header>
			<subsection id="id4D1D51CB831C4A44ABAFEF04CAF9F266"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture shall establish in the Department of Agriculture a Coordinator of
			 Community Food Security and Gleaning.</text>
			</subsection><subsection id="id05030AFC123745B09A572DD651CBC597"><enum>(b)</enum><header>Duties</header><text>The
			 Coordinator of Community Food Security and Gleaning shall provide technical
			 assistance relating to the activities described in section 4 to—</text>
				<paragraph id="id44A82831D9294F9A902006A52F87DC96"><enum>(1)</enum><text>agencies of
			 Federal, State, and local government;</text>
				</paragraph><paragraph id="id054CDC510A904E9BB0C83E7119FFACC6"><enum>(2)</enum><text>nonprofit
			 organizations;</text>
				</paragraph><paragraph id="idFD979F30243F427F90C6A009778FB604"><enum>(3)</enum><text>agricultural
			 producers; and</text>
				</paragraph><paragraph id="id24CFAB68D3BA46FF84CCB8352B016AA8"><enum>(4)</enum><text>private
			 entities.</text>
