		<official-title display="yes">To encourage the donation of excess food to
		  nonprofit organizations that provide assistance to food-insecure people in the
		  United States in contracts entered into by executive agencies for the
		  provision, service, or sale of food.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id77d6e29d-43bd-4ea5-8043-378fe120293f" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Food Donation Act of
			 2008</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id2b77836a-bc63-4070-b7e0-8f2efb55dda0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to encourage
			 executive agencies and contractors of executive agencies, to the maximum extent
			 practicable and safe, to donate excess, apparently wholesome food to feed
			 food-insecure people in the United States.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id20c4374d-c4ac-4566-9c3c-0e2783e8cc49" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id6b50ca02-adc1-481e-9099-1f11e0e2dfda"><enum>(1)</enum><header display-inline="yes-display-inline">Apparently wholesome food</header><text display-inline="yes-display-inline">The term <term>apparently wholesome
			 food</term> has the meaning given the term in section 2(b) of the Bill Emerson
			 Good Samaritan Food Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791(b)</external-xref>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10aa62c8-268b-4a19-8391-bb809678bff0"><enum>(2)</enum><header display-inline="yes-display-inline">Excess</header><text display-inline="yes-display-inline">The term <term>excess</term>, when applied
			 to food, means food that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idcb3d077b-0859-47cd-bdce-a08fa361d352"><enum>(A)</enum><text display-inline="yes-display-inline">is not required to meet the needs of
			 executive agencies; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc1b437e-94e4-463b-8cfd-be6c8f46e5ff"><enum>(B)</enum><text display-inline="yes-display-inline">would otherwise be discarded.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide323d813-4ab3-4972-9dfb-7cdc1a228490"><enum>(3)</enum><header display-inline="yes-display-inline">Food-insecure</header><text display-inline="yes-display-inline">The term <term>food-insecure</term> means
			 inconsistent access to sufficient, safe, and nutritious food.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94820a7e-1d23-4a90-ae1c-d57d8434abe4"><enum>(4)</enum><header display-inline="yes-display-inline">Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit
			 organization</term> means any organization that is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id6d41a546-86ff-4ca0-a792-387a5443eb8a"><enum>(A)</enum><text display-inline="yes-display-inline">described in section 501(c) of the Internal
			 Revenue Code of 1986; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb7fd2353-7320-4b9c-8ff4-a14f358720cb"><enum>(B)</enum><text display-inline="yes-display-inline">exempt from tax under section 501(a) of
			 that Code.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id642ba92f-d444-4936-9318-71e77864ed90" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Promoting Federal food donation</header>
			<subsection commented="no" display-inline="no-display-inline" id="idE333503646A9420EA0C48A5A27586FA6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Federal Acquisition Regulation issued in accordance
			 with section 25 of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/421">41 U.S.C. 421</external-xref>)
			 shall be revised to provide that all contracts above $25,000 for the provision,
			 service, or sale of food in the United States, or for the lease or rental of
			 Federal property to a private entity for events at which food is provided in
			 the United States, shall include a clause that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id729bc741-d1e3-4ba4-bb9e-fda4148b3d94"><enum>(1)</enum><text display-inline="yes-display-inline">encourages the donation of excess,
			 apparently wholesome food to nonprofit organizations that provide assistance to
			 food-insecure people in the United States; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96CE51F3EBE54E13BEEA5515BA3B9C40"><enum>(2)</enum><text display-inline="yes-display-inline">states the terms and conditions described
			 in subsection (b).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8482A0AB804144058A61E50A9E0B7955"><enum>(b)</enum><header display-inline="yes-display-inline">Terms and conditions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ida71bfee4-d1df-4ee8-a828-70cf32501307"><enum>(1)</enum><header display-inline="yes-display-inline">Costs</header><text display-inline="yes-display-inline">In any case in which a contractor enters
			 into a contract with an executive agency under which apparently wholesome food
			 is donated to food-insecure people in the United States, the head of the
			 executive agency shall not assume responsibility for the costs and logistics of
			 collecting, transporting, maintaining the safety of, or distributing excess,
			 apparently wholesome food to food-insecure people in the United States under
			 this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb6304c6a-89c1-47e7-8d40-1d0e73f46131"><enum>(2)</enum><header display-inline="yes-display-inline">Liability</header><text display-inline="yes-display-inline">An executive agency (including an executive
			 agency that enters into a contract with a contractor) and any contractor making
			 donations pursuant to this Act shall be exempt from civil and criminal
			 liability to the extent provided under the Bill Emerson Good Samaritan Food
			 Donation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1791">42 U.S.C. 1791</external-xref>).</text>
				</paragraph></subsection></section></legis-body>
