		<official-title>To authorize the voluntary purchase of certain properties
		  in Treece, Kansas, endangered by the Cherokee County National Priorities List
		  Site, and for other purposes.</official-title>

		<section id="id0A7369525FC84627AF2E4E8EC1D59819" section-type="section-one"><enum>1.</enum><header>Environmental Protection
			 Agency authority</header>
			<subsection id="id1560CF6D9DE14653AE7182500C0D4E0B"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency shall make available to the State of Kansas in fiscal year
			 2009 not more than $6,000,000 for use by the State in accordance with
			 subsection (b).</text>
			</subsection><subsection id="id659695CBE3214268B88DB12B2464D4E6"><enum>(b)</enum><header>Use of funds by
			 State</header>
				<paragraph id="idBB0138F5F9314C088E32CE4BB76DCD62"><enum>(1)</enum><header>In
			 general</header><text>The State of Kansas shall—</text>
					<subparagraph id="idBC34ECA3D927425DBF2AA9212C6E6463"><enum>(A)</enum><text>deposit the
			 amounts received under subsection (a) into the fund established under Kansas
			 House Bill 2168 (2007), entitled <quote>An Act concerning certain communities
			 within superfund sites; providing for relocation and other assistance.</quote>
			 and enacted on July 13, 2007 (2007 Kan. Sess. Laws 17); and</text>
					</subparagraph><subparagraph id="id3A8DD8E12F1F474D80C526686F24727D"><enum>(B)</enum><text>use the amounts
			 in accordance with that bill for the purpose of—</text>
						<clause id="idEB13C0375D1A4C3E926207B6A26E5C69"><enum>(i)</enum><text>purchasing, with
			 the consent of the property owners, the properties described in paragraph (2);
			 and</text>
						</clause><clause id="idA5ADFB9D61DA425FB32B4A74436091E4"><enum>(ii)</enum><text>providing
			 relocation assistance to the residents of those properties.</text>
						</clause></subparagraph></paragraph><paragraph id="id599FCF1375D443829F6B03F0860C935D"><enum>(2)</enum><header>Description of
			 properties</header><text>The properties referred to in paragraph (1)
			 are—</text>
					<subparagraph id="id177C722BB89547D2B0AE5F9A1ECB41C4"><enum>(A)</enum><text>properties in
			 Treece, Kansas, that are in danger of being destroyed by subsidence relating
			 to, and that may endanger the health of occupants as a result of risks posed
			 by, the Cherokee County National Priorities List Site; and</text>
					</subparagraph><subparagraph id="id2433BF28EE734DFF9565AA450033D5C3"><enum>(B)</enum><text>residential
			 properties of water customers of Picher, Oklahoma, residing in or near Treece,
			 Kansas.</text>
					</subparagraph></paragraph></subsection><subsection id="id23F4843201C245AA9F59BF4BF2E99677"><enum>(c)</enum><header>Limitation</header><text>The
			 Uniform Relocation Assistance and Real Property Acquisition Policies Act of
			 1970 (42 U.S.C. 4601 et seq.) shall not apply to any use of funds in accordance
			 with this section.</text>
