		<official-title>To amend the Higher Education Act of 1965 to make

		<section id="id4A450B0C58DD4EA5AD357B9E7DCE1DB3" section-type="section-one"><enum>1.</enum><header>Definition of untaxed income
			 and benefits</header>
			<subsection id="id62F9C8EAC2224A7AA1566397C6CBC489"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 480(b) of the Higher Education Act
			 of 1965 (20 U.S.C. 1087vv(b)) is amended by striking paragraph (2) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id50BDB740A5D747BF9CFCC7C510A9C9B6" style="OLC">
					<paragraph id="idAEDD01A9184743BC896F9374E223F8F4"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>untaxed income and
				benefits</term> shall not include—</text>
						<subparagraph id="id2885003EC849428F8D9DFD0D326CF015"><enum>(A)</enum><text>the amount of
				additional child tax credit claimed for Federal income tax purposes;</text>
						</subparagraph><subparagraph id="id22651A1B77E442F9A441F474737981D5"><enum>(B)</enum><text>welfare benefits,
				including assistance under a State program funded under part A of title IV of
				the Social Security Act and aid to dependent children;</text>
						</subparagraph><subparagraph id="idD7871C19A4624CD58F2C0ACACA3A2E44"><enum>(C)</enum><text>the amount of
				earned income credit claimed for Federal income tax purposes;</text>
						</subparagraph><subparagraph id="idCE0A148176AA4EE4B0F1CCA18A9582F5"><enum>(D)</enum><text>the amount of
				credit for Federal tax on special fuels claimed for Federal income tax
				purposes;</text>
						</subparagraph><subparagraph id="idE569FF3B82F649E28C7AA4FEF05FC210"><enum>(E)</enum><text>the amount of
				foreign income excluded for purposes of Federal income taxes; or</text>
						</subparagraph><subparagraph id="id47CBC9E3C03F47C79ADC64798CFC7A8A"><enum>(F)</enum><text>untaxed social
				security
				benefits.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id83CA8A4C45724710803404F96D7EF374"><enum>(b)</enum><header>Effective
			 date</header><text>This section and the amendment made by this section shall
			 take effect on July 1, 2009.</text>
			</subsection></section><section id="idEF018BF002E0428D95286B0B609C2AC8"><enum>2.</enum><header>Income-based
			 repayment for married borrowers filing separately</header><text display-inline="no-display-inline">Section 493C of the Higher Education Act of
			 1965 (20 U.S.C. 1098e) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idD23A2F914B624FF08F4F0633BF01A385" style="OLC">
				<subsection id="id702886CA414540598DD4EC50A9A5FC75"><enum>(d)</enum><header>Special rule
				for married borrowers filing separately</header><text>In the case of a married
				borrower who files a separate Federal income tax return, the Secretary shall
				calculate the amount of the borrower's income-based repayment under this
				section solely on the basis of the borrower's student loan debt and adjusted
				gross
				income.</text>
