</section><section id="id25EF0A0728E541778587938427F73039"><enum>606.</enum><subsection commented="no" display-inline="yes-display-inline" id="id2488D911CE054D909493C82C90BB3FA1"><enum>(a)</enum><header>Availability of funds
for CERP</header><text>From funds made available in this Act to the Department
of Defense, not to exceed $500,000,000 may be used, notwithstanding any other
provision of law, to fund the Commander's Emergency Response Program, for the
purpose of enabling military commanders in Iraq to respond to urgent
humanitarian relief and reconstruction requirements within their areas of
responsibility by carrying out programs that will immediately assist the Iraqi
people, and to fund a similar program to assist the people of
Afghanistan.</text>
</subsection><subsection id="id2F245484F03145218A72DFA53F16DA71"><enum>(b)</enum><header>Quarterly
reports</header><text display-inline="yes-display-inline">Not later than 15
days after the end of each fiscal year quarter (beginning with the first
quarter of fiscal year 2008), the Secretary of Defense shall submit to the
congressional defense committees a report regarding the source of funds and the
allocation and use of funds during that quarter that were made available
pursuant to the authority provided in this section or under any other provision
of law for the purposes of the programs under subsection (a).</text>
</subsection></section><section id="id48DF82D9191F4DFBB147F817920BB230"><enum>607.</enum><text>During the
current fiscal year, funds available to the Department of Defense for operation
and maintenance may be used, notwithstanding any other provision of law, to
provide supplies, services, transportation, including airlift and sealift, and
other logistical support to coalition forces supporting military and stability
operations in Iraq and Afghanistan: <italic>Provided,</italic> That the
Secretary of Defense shall provide quarterly reports to the congressional
defense committees regarding support provided under this section.</text>
</section><section id="idFE1AC3AF576644569BA6D666E253094E"><enum>608.</enum><text>During fiscal
year 2008, supervision and administration costs associated with projects
carried out with funds appropriated to <quote>Afghanistan Security Forces
Fund</quote> or <quote>Iraq Security Forces Fund</quote> in this Act may be
obligated at the time a construction contract is awarded:
<italic>Provided,</italic> That for the purpose of this section, supervision
and administration costs include all in-house Government costs.</text>
</section><section id="id14487225F5C34F94B028F05E7792B3A2"><enum>609.</enum><subsection commented="no" display-inline="yes-display-inline" id="id54C572F3F8894FE6B281F1488B42CDAC"><enum>(a)</enum><header>Reports on progress
toward stability in Iraq</header><text>Not later than 60 days after the date of
the enactment of this Act and every 90 days thereafter through the end of
fiscal year 2008, the Secretary of Defense shall set forth in a report to
Congress a comprehensive set of performance indicators and measures for
progress toward military and political stability in Iraq.</text>
</subsection><subsection id="idAC55B614884B4CCFA43215BFDA6AA045"><enum>(b)</enum><header>Scope of
reports</header><text display-inline="yes-display-inline">Each report shall
include performance standards and goals for security, economic, and security
force training objectives in Iraq together with a notional timetable for
achieving these goals.</text>
</subsection><subsection id="id0004E5AB0C034FD29CB9783F282A93E2"><enum>(c)</enum><header>Specific
elements</header><text display-inline="yes-display-inline">In specific, each
report shall require, at a minimum, the following:</text>
<paragraph id="id4AF78422AD9548AC97146A8DBED34EDB"><enum>(1)</enum><text>With respect to
stability and security in Iraq, the following:</text>
<subparagraph id="id6D96FFD49BC24E1C96DFC9BC3A63852A"><enum>(A)</enum><text>Key measures of
political stability, including the important political milestones that must be
achieved over the next several years.</text>
</subparagraph><subparagraph id="id179EF04820BC494DA683465D8EEDDC31"><enum>(B)</enum><text>The primary
indicators of a stable security environment in Iraq, such as number of
engagements per day, numbers of trained Iraqi forces, and trends relating to
numbers and types of ethnic and religious-based hostile encounters.</text>
</subparagraph><subparagraph id="idA172C59BE6BB4AE8B0F5A5811BC44D61"><enum>(C)</enum><text>An assessment of
the estimated strength of the insurgency in Iraq and the extent to which it is
composed of non-Iraqi fighters.</text>
</subparagraph><subparagraph id="IDf2e228089ab34de6973828f0fd0f57fb"><enum>(D)</enum><text>A description of
all militias operating in Iraq, including the number, size, equipment strength,
military effectiveness, sources of support, legal status, and efforts to disarm
or reintegrate each militia.</text>
</subparagraph><subparagraph id="IDbaec34505b6b45b3be36c32c6ed5dd02"><enum>(E)</enum><text>Key indicators of
economic activity that should be considered the most important for determining
the prospects of stability in Iraq, including—</text>
<clause id="ID95af3a560f2a4e77aa0a0adb26da47f6"><enum>(i)</enum><text>unemployment
levels;</text>
</clause><clause id="ID4ceb726ff47f4325930ac06c4bda9bd0"><enum>(ii)</enum><text>electricity,
water, and oil production rates; and</text>
</clause><clause id="IDf0ae1a3b0e3a441fbffbf2291c9298b1"><enum>(iii)</enum><text>hunger and
poverty levels.</text>
</clause></subparagraph><subparagraph id="ID8fe5141cebc24c6a85cd22aa400ab6a1"><enum>(F)</enum><text>The criteria the
Administration will use to determine when it is safe to begin withdrawing
United States forces from Iraq.</text>
</subparagraph></paragraph><paragraph id="id549520187BB444CA90B70755EC5BA974"><enum>(2)</enum><text>With respect to
the training and performance of security forces in Iraq, the following:</text>
<subparagraph id="ID1a8ff1669dc3427fae0f75acff578928"><enum>(A)</enum><text>The training
provided Iraqi military and other Ministry of Defense forces and the equipment
used by such forces.</text>
</subparagraph><subparagraph id="ID10d4752165da468385f95a4623d8d634"><enum>(B)</enum><text>Key criteria for
assessing the capabilities and readiness of the Iraqi military and other
Ministry of Defense forces, goals for achieving certain capability and
readiness levels (as well as for recruiting, training, and equipping these
forces), and the milestones and notional timetable for achieving these
goals.</text>
</subparagraph><subparagraph id="ID0ff5e84b0c4a4f1fac49015f1dcb4932"><enum>(C)</enum><text>The operational
readiness status of the Iraqi military forces, including the type, number,
size, and organizational structure of Iraqi battalions that are—</text>
<clause id="ID778ad5bf3f7341859cbaf9c9a09bf871"><enum>(i)</enum><text>capable of
conducting counterinsurgency operations independently;</text>
</clause><clause id="ID6a3caeb67ddf4566af69358ccaa439fa"><enum>(ii)</enum><text>capable of
conducting counterinsurgency operations with the support of United States or
coalition forces; or</text>
</clause><clause id="IDf7fdde2de6854254b1c3c017272b75c8"><enum>(iii)</enum><text>not ready to
conduct counterinsurgency operations.</text>
</clause></subparagraph><subparagraph id="ID7730fda63e774ecd8a6e0d0e12a1cc30"><enum>(D)</enum><text>The rates of
absenteeism in the Iraqi military forces and the extent to which insurgents
have infiltrated such forces.</text>
</subparagraph><subparagraph id="ID384868fb2f814775a2fe280604af6b9a"><enum>(E)</enum><text>The training
provided Iraqi police and other Ministry of Interior forces and the equipment
used by such forces.</text>
</subparagraph><subparagraph id="ID0340041b8bee4134b9f2d0ab07869081"><enum>(F)</enum><text>Key criteria for
assessing the capabilities and readiness of the Iraqi police and other Ministry
of Interior forces, goals for achieving certain capability and readiness levels
(as well as for recruiting, training, and equipping), and the milestones and
notional timetable for achieving these goals, including—</text>
<clause id="IDbc809b008b1e46b686bb1f74e110e2cf"><enum>(i)</enum><text>the
number of police recruits that have received classroom training and the
duration of such instruction;</text>
</clause><clause id="ID1766211fed4d4f0d8b666ff232c1a31e"><enum>(ii)</enum><text>the number of
veteran police officers who have received classroom instruction and the
duration of such instruction;</text>
</clause><clause id="IDa77a2d2f281a463c8f5fc58ea611e75c"><enum>(iii)</enum><text>the number of
police candidates screened by the Iraqi Police Screening Service, the number of
candidates derived from other entry procedures, and the success rates of those
groups of candidates;</text>
</clause><clause id="IDf1a00c7fe89b4208a58e27e6beccc911"><enum>(iv)</enum><text>the number of
Iraqi police forces who have received field training by international police
trainers and the duration of such instruction; and</text>
</clause><clause id="IDe0b848c314ab4a2182490811a349f285"><enum>(v)</enum><text>attrition rates
and measures of absenteeism and infiltration by insurgents.</text>
</clause></subparagraph><subparagraph id="ID1a92248cc97f433292fbcc51c022e956"><enum>(G)</enum><text>The estimated
total number of Iraqi battalions needed for the Iraqi security forces to
perform duties now being undertaken by coalition forces, including defending
the borders of Iraq and providing adequate levels of law and order throughout
Iraq.</text>
</subparagraph><subparagraph id="ID30eb1e53271046d59087452c19ea2355"><enum>(H)</enum><text>The effectiveness
of the Iraqi military and police officer cadres and the chain of
command.</text>
</subparagraph><subparagraph id="ID94c8b697600746019d97626913bcbd85"><enum>(I)</enum><text>The number of
United States and coalition advisors needed to support the Iraqi security
forces and associated ministries.</text>
</subparagraph><subparagraph id="ID289fd7e878e144ac92e3f8b20352c702"><enum>(J)</enum><text>An assessment, in
a classified annex if necessary, of United States military requirements,
including planned force rotations, through the end of calendar year
2008.</text>
</subparagraph></paragraph></subsection></section><section id="idEA5D937BD277475ABBDD60CB75F2359D"><enum>610.</enum><text>Each amount
appropriated or otherwise made available in this Act is designated as an
emergency requirement and necessary to meet emergency needs pursuant to
subsections (a) and (b) of section 204 of S. Con. Res. 21 (110th Congress), the
concurrent resolution on the budget for fiscal year 2008.</text>
</section><section id="id4674E251BA10497CA6BAE11FFC042060"><enum>611.</enum><text>None of the
funds appropriated or otherwise made available by this Act may be obligated or
expended to provide award fees to any defense contractor for performance that
does not meet the requirements of the contract.</text>
</section><section id="id561B50D934B545E9AA3961FA40242106"><enum>612.</enum><text>No funds
appropriated or otherwise made available by this Act may be used by the
Government of the United States to enter into an agreement with the Government
of Iraq that would subject members of the Armed Forces of the United States to
the jurisdiction of Iraq criminal courts or punishment under Iraq law.</text>
</section><section id="id88D4A6A0E1B84B80AC09E3C84555395E"><enum>613.</enum><text>Notwithstanding
any other provision of law, the Secretary of the Army may reimburse a member
for expenses incurred by the member or family member when such expenses are
otherwise not reimbursable under law: <italic>Provided,</italic> That such
expenses must have been incurred in good faith as a direct consequence of
reasonable preparation for, or execution of, military orders: <italic>Provided
further,</italic> That reimbursement under this section shall be allowed only
in situations wherein other authorities are insufficient to remedy a hardship
determined by the Secretary, and only when the Secretary determines that
reimbursement of the expense is in the best interest of the member and the
United States.</text>
</section><section id="id32D42146571844BFA0F04AE3764361F9"><enum>614.</enum><text display-inline="yes-display-inline">In this Act, the term <term>congressional
defense committees</term> means—</text>
<paragraph id="id8E982559FC584B7297551972297FEACC"><enum>(1)</enum><text>the Committees on
Armed Services and Appropriations of the Senate; and</text>
</paragraph><paragraph id="id1D21C0B4008B47F68F0B9283DE57286B"><enum>(2)</enum><text>the Committees on
Armed Services and Appropriations of the House of Representatives.</text>
</paragraph></section><section id="id71DC068FA6994B3598096756D38FB860"><enum>615.</enum><text display-inline="yes-display-inline">This Act may be cited as the
<quote><short-title>Emergency Supplemental Appropriations
Act for Defense, 2008</short-title></quote>.</text>
