			</subsection></section><section id="id96EEF906856049DD9248AB39E20F626B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID72eb954894924c6f9b9194b3b6a1e2be"><enum>(1)</enum><header>Advanced
			 glazing</header><text>The term <term>advanced glazing</term> means glazing
			 installed in a portal on the side or the roof of a motorcoach that is designed
			 to be highly resistant to partial or complete occupant ejection in all types of
			 motor vehicle crashes.</text>
			</paragraph><paragraph id="ID355a5f86803b45788a5547d5f7d82c76"><enum>(2)</enum><header>Bus</header><text>The
			 term <term>bus</term> has the meaning given such term in section 571.3(b) of
			 title 49, Code of Federal Regulations (as in effect on the day before the date
			 of the enactment of this Act).</text>
			</paragraph><paragraph id="ID5d18008d93d34afd861e4c2941c3a3fa"><enum>(3)</enum><header>Commercial
			 motor vehicle</header><text>The term <term>commercial motor vehicle</term> has
			 the meaning given such term in section 31132(1) of title 49, United States
			 Code.</text>
			</paragraph><paragraph id="id8C2776A2E27D4952962C034C7838E318"><enum>(4)</enum><header>Manufacturer</header><text>The
			 term <term>manufacturer</term> has the meaning given such term in section
			 30102(a) of title 49, United States Code.</text>
			</paragraph><paragraph id="ID46f62ad9a279479d9da4493e62bd1128"><enum>(5)</enum><header>Motor
			 carrier</header><text>The term <term>motor carrier</term> has the meaning given
			 such term in section 13102(14) of title 49, United States Code.</text>
			</paragraph><paragraph id="ID944ec708bcf04f92a28332af9a7ed8f7"><enum>(6)</enum><header>Motorcoach</header><text>The
			 term <term>motorcoach</term> has the meaning given the term
			 <quote>over-the-road bus</quote> in section 3038(a)(3) of the Transportation
			 Equity Act for the 21st Century (Public Law 105–178; 49 U.S.C. 5310 note), but
			 does not include the following:</text>
				<subparagraph id="ID839956fb69cd49a995f136c0988d831c"><enum>(A)</enum><text>Buses used in
			 public transportation provided by a State or local government.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc582a53c18cf466fb08a62afd9a9266c"><enum>(B)</enum><text>School buses,
			 including multifunction school activity buses.</text>
				</subparagraph></paragraph><paragraph id="IDb77fbb399574468d94a1039c798c0e3a"><enum>(7)</enum><header>Motorcoach
			 manufacturer</header><text>The term <term>motorcoach manufacturer</term> means
			 a manufacturer that manufactures, assembles, or imports motorcoaches for resale
			 in the United States.</text>
			</paragraph><paragraph id="ID140833a8316540baa4b9fbd0db420611"><enum>(8)</enum><header>Motorcoach
			 services</header><text>The term <term>motorcoach services</term> means
			 passenger transportation by motorcoach for compensation.</text>
			</paragraph><paragraph id="IDcb62b72b7152463492520a2fdd337b89"><enum>(9)</enum><header>Multifunction
			 school activity buses</header><text>The term <term>multifunction school
			 activity buses</term> has the meaning given such term in section 571.3(b) of
			 title 49, Code of Federal Regulations (as in effect on the day before the date
			 of the enactment of this Act).</text>
			</paragraph><paragraph id="ID2209843b6ba84940a52e47dd313a1603"><enum>(10)</enum><header>Portal</header><text>The
			 term <term>portal</term> means any opening on the front, sides, rear, or roof
			 of a motorcoach that could, in the event of a crash involving the motorcoach,
			 permit the partial or complete ejection of any occupant from the motorcoach,
			 including a young child.</text>
			</paragraph><paragraph id="IDa58f432eab5e4636a1f855092547132d"><enum>(11)</enum><header>Provider of
			 motorcoach services</header><text>The term <term>provider of motorcoach
			 services</term> means a motor carrier that provides passenger transportation
			 services with a motorcoach for compensation, including per-trip compensation
			 and contracted or chartered compensation.</text>
			</paragraph><paragraph id="IDe432a4f7784149359d536935346cfaa4"><enum>(12)</enum><header>Public
			 transportation</header><text>The term <term>public transportation</term> has
			 the meaning given such term in section 5302(a)(10) of title 49, United States
			 Code.</text>
			</paragraph><paragraph id="ID5196505da45845529b20126d8cbdfdfc"><enum>(13)</enum><header>Safety
			 belt</header><text>The term <term>safety belt</term> has the meaning given such
			 term in section 153(i)(4)(B) of title 23, United States Code.</text>
			</paragraph><paragraph id="IDb1b1f71e17fa4fc9ac9ad126f44eba7f"><enum>(14)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Transportation.</text>
			</paragraph></section><section id="id186E874EEB524EEF80AAFFCA83C37CA8"><enum>3.</enum><header>Regulations for
			 improved occupant protection and motorcoach crash avoidance</header>
			<subsection id="idF04C1837E4A748869CBF71ED18C6906A"><enum>(a)</enum><header>Regulations
			 required 1 year after the date of the enactment of this Act</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Secretary
			 shall prescribe regulations as follows:</text>
				<paragraph id="ID53c1c8c65bb244bcbc14236e9a1cc4b7"><enum>(1)</enum><header>Safety
			 belts</header><text>The Secretary shall require safety belts be installed in
			 motorcoaches at each designated seating position.</text>
				</paragraph><paragraph id="IDbc26c208891246658e5c7a5864afd931"><enum>(2)</enum><header>Anti-ejection
			 safety countermeasures</header><text>The Secretary shall require motorcoaches
			 have advanced glazing installed in each motorcoach portal to prevent partial or
			 complete ejection of passengers of motorcoaches, including such passengers that
			 are children.</text>
				</paragraph><paragraph id="ID6f8b638f07e142628857baa0b8ca5920"><enum>(3)</enum><header>Firefighting
			 equipment</header><text>The Secretary shall require installation in
			 motorcoaches of improved firefighting equipment for the purpose of effectively
			 suppressing fires in motorcoaches to prevent passenger deaths and
			 injuries.</text>
				</paragraph></subsection><subsection id="id0CDD9E2287AE48D0B47CF83A6B47E807"><enum>(b)</enum><header>Regulations
			 required 2 years after the date of the enactment of this Act</header><text>Not
			 later than 2 years after the date of the enactment of this Act, the Secretary
			 shall prescribe regulations as follows:</text>
				<paragraph id="ID071b4788c4794486956f4968f83d12c6"><enum>(1)</enum><header>Compartmentalization
			 safety countermeasures</header><text>The Secretary shall require enhanced
			 compartmentalization safety countermeasures for motorcoaches, including
			 enhanced seating designs, to reduce substantially the risk of passengers being
			 thrown from their seats and colliding with other passengers, interior surfaces,
			 or components in the event of a crash involving a motorcoach.</text>
				</paragraph><paragraph id="IDa2bc320b19704f33bff0556512cd61ed"><enum>(2)</enum><header>Interior impact
			 protection</header><text>The Secretary shall establish enhanced occupant impact
			 protection standards for motorcoach interiors to reduce substantially serious
			 injuries for all passengers of motorcoaches.</text>
				</paragraph><paragraph id="IDc6afed2d4062481bafb9e78c53de80aa"><enum>(3)</enum><header>Reduced
			 rollover crashes</header><text>The Secretary shall require motorcoaches be
			 equipped with stability enhancing technologies, such as electronic stability
			 control, roll stability control, and torque vectoring, to reduce substantially
			 the number and frequency of rollover crashes among motorcoaches.</text>
				</paragraph><paragraph id="ID7079dcc182fa4991a3f795d59af974ea"><enum>(4)</enum><header>Roof strength
			 and crush resistance</header><text>The Secretary shall establish improved roof
			 standards for motorcoaches that substantially improve the resistance of
			 motorcoach roofs to deformation and intrusion to prevent serious occupant
			 injury in rollover crashes involving motorcoaches.</text>
				</paragraph><paragraph id="ID9eef8d80f3454449bbfdb6e3d5f136b7"><enum>(5)</enum><header>Enhanced
			 conspicuity</header><text>The Secretary shall require enhanced conspicuity of
			 motorcoaches to enable other motor vehicle operators, cyclists, and pedestrians
			 to better detect motorcoaches in order to reduce the risk of collisions
			 involving motorcoaches.</text>
				</paragraph><paragraph id="idBA76551ABB0D408FB317CCEDC4C6C3CF"><enum>(6)</enum><header>Smoke
			 suppression</header><text>The Secretary shall amend Federal motor vehicle
			 safety standard number 302 (49 CFR 571.302; relating to flammability of
			 interior materials) to require realistic tests to improve the resistance of
			 motorcoach interiors and components to burning, prevent inhalation by
			 passengers of toxic smoke and vapors, and permit sufficient time for the safe
			 evacuation of passengers from the motorcoach.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0593e514b35d4866b94e2915f0ac41d1"><enum>(7)</enum><header>Resistance to
			 fuel system fires</header><text>The Secretary shall amend Federal motor vehicle
			 safety standard number 301 (49 CFR 571.301; relating to fuel system integrity)
			 to require that motorcoaches have improved fuel systems in order to suppress
			 fuel-fed fires and substantially reduce occupant deaths and injuries from fuel
			 fires.</text>
				</paragraph><paragraph id="IDaa4dc399a2c642778da320497d811936"><enum>(8)</enum><header>Passenger
			 evacuation</header><text>The Secretary shall require motorcoaches be equipped
			 with the following:</text>
					<subparagraph id="ID230e9ad2f98e4f8e85d906592d9f85ce"><enum>(A)</enum><header>Improved
			 emergency evacuation designs</header><text>Improved emergency exit window,
			 door, and roof hatch designs to expedite access and use by passengers of
			 motorcoaches to ensure rapid evacuation from a motorcoach under all emergency
			 circumstances, including crashes and fires.</text>
					</subparagraph><subparagraph id="ID3cae0afd09f74b7fb10701ade2d9f7fe"><enum>(B)</enum><header>Emergency
			 interior lighting</header><text>Emergency interior lighting systems, including
			 luminescent or retroreflectorized delineation of evacuation paths and exits,
			 that are triggered by a crash or other emergency incidents to accomplish more
			 rapid and effective evacuation of passengers.</text>
					</subparagraph></paragraph></subsection><subsection id="id450BA11D9A8C4FD98B3430B4C2B2642A"><enum>(c)</enum><header>Regulations
			 required 3 years after the date of the enactment of this Act</header><text>Not
			 later than 3 years after the date of the enactment of this Act, the Secretary
			 shall prescribe regulations as follows:</text>
				<paragraph id="IDd517439fd5c846e5a42351646e5b71a0"><enum>(1)</enum><header>Adaptive cruise
			 control</header><text>Require motorcoaches be equipped with adaptive cruise
			 control for maintaining safe trailing distances when underway and a collision
			 warning system that provides sufficient advance notice to the operator of a
			 motorcoach of any imminent impact.</text>
				</paragraph><paragraph id="ID8a429d505ea942e7ab05587bad2f1a18"><enum>(2)</enum><header>Automatic fire
			 suppression</header><text>Require motorcoaches be equipped with highly
			 effective fire suppression systems that automatically respond to and suppress
			 all fires in such motorcoaches.</text>
				</paragraph></subsection><subsection id="ID3bacc91db21843f9973f58497f73d0d1"><enum>(d)</enum><header>Application of
			 regulations</header>
				<paragraph id="id9C7FEE0CCC7F43C5B4245D5586759A12"><enum>(1)</enum><header>Prospective
			 application</header><text>Except as provided in paragraph (2), a regulation
			 prescribed in accordance with subsection (a), (b), or (c) shall apply to all
			 motorcoaches that are manufactured on or after the effective date of such
			 regulation.</text>
				</paragraph><paragraph id="idD3ADC38748CE4B58AABEB56F9AE9AD0F"><enum>(2)</enum><header>Retrofit safety
			 requirements for in-service motorcoaches</header>
					<subparagraph id="idF7DA54A67DCF4306B4ED98F42B1F305B"><enum>(A)</enum><header>In
			 general</header><clause commented="no" display-inline="yes-display-inline" id="idA6F7FA94B5394FB3AE9C6CB82A728480"><enum>(i)</enum><text>Except as provided in
			 subparagraph (B), a regulation prescribed in accordance with subsection (a)(1)
			 shall apply to all motorcoaches used for motorcoach services on or after the
			 effective date of such regulation.</text>
						</clause><clause id="id562FD86B58EC4DBBADF961FCE6A26CE6" indent="up1"><enum>(ii)</enum><text>Except as provided in subparagraph
			 (B), a regulation prescribed in accordance with subsection (a)(3) shall apply
			 to all motorcoaches used for motorcoach services on or after the effective date
			 of such regulation.</text>
						</clause><clause id="id13D0033A48DD47D28D51606F1BE4BA30" indent="up1"><enum>(iii)</enum><text>Except as provided in
			 subparagraph (B), a regulation prescribed in accordance with subsection (b)(5)
			 shall apply to all motorcoaches used for motorcoach services on or after the
			 effective date of such regulation.</text>
						</clause></subparagraph><subparagraph id="id685C49073F664A1CB09478BDCEAC5130"><enum>(B)</enum><header>Exception</header><text>In
			 the case of a motorcoach that was used for motorcoach services before the
			 effective date of a regulation described in subparagraph (A), such regulation
			 shall not apply to such motorcoach until—</text>
						<clause id="idD9B41C3295EF40BFBBB2279CF79DC8F3"><enum>(i)</enum><text>2
			 years after the effective date of such regulation; or</text>
						</clause><clause id="idBCE1F22585BF4C5E884B251F73420F24"><enum>(ii)</enum><text>if
			 the Secretary determines that the application date described in clause (i)
			 would cause undue hardship, 5 years after the effective date of such
			 regulation.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="idA3F9DE510117489399FA85977DF08260"><enum>4.</enum><header>Study and report
			 on improved bus crashworthiness and crash avoidance</header>
			<subsection id="ID2e1b535783d3438da8bab1fa621dd65c"><enum>(a)</enum><header>Study</header><text>Not
			 later than September 30, 2008, the Secretary shall complete a study of the
			 following, with respect to buses that are more than 10,000 pounds gross vehicle
			 weigh rating (GVWR):</text>
				<paragraph id="IDe74c7a00c9e343e6b4821949336110e5"><enum>(1)</enum><text>Bus safety design
			 improvements and countermeasures for improving bus crashworthiness to achieve
			 substantial improvements in occupant protection in all types of crashes,
			 including the following:</text>
					<subparagraph id="idBBD305CB11004CC7AD296312AFAA8D10"><enum>(A)</enum><text>Active and
			 passive restraint systems.</text>
					</subparagraph><subparagraph id="id31929937E80C47B98ED6C73A11779145"><enum>(B)</enum><text>Enhanced
			 passenger compartmentalization.</text>
					</subparagraph><subparagraph id="id2500EA85664B424AADC44A67B0093F8E"><enum>(C)</enum><text>Upper and lower
			 interior occupant impact protection.</text>
					</subparagraph><subparagraph id="id2F37D6BAEF624075A28C039D6BF5F9DE"><enum>(D)</enum><text>Improved
			 resistance to roof failures leading to deformation and intrusion that result in
			 occupant injury.</text>
					</subparagraph><subparagraph id="id745493E5331A48CD8DB650F5D1F088E1"><enum>(E)</enum><text>Improved
			 resistance to occupant partial and complete ejection.</text>
					</subparagraph><subparagraph id="id243140FCD69D4BA78E62146329A7D790"><enum>(F)</enum><text>Improved crash
			 compatibility with other types and weights of motor vehicles in order to reduce
			 both the number and severity of crashes and the number and severity of occupant
			 injuries both in buses and in the other vehicles.</text>
					</subparagraph></paragraph><paragraph id="ID6220e452c04e43f58fab4a38f6fbad4f"><enum>(2)</enum><text>Crash avoidance
			 improvements to reduce the number and severity of bus crashes, including the
			 following:</text>
					<subparagraph id="idB30AFB8D3E4A45A3BD8A7C9C36F45D02"><enum>(A)</enum><text>Collision warning
			 systems.</text>
					</subparagraph><subparagraph id="idF493F8E80D2F4FAC96555065DCA16A12"><enum>(B)</enum><text>Improved braking
			 capabilities.</text>
					</subparagraph><subparagraph id="idD3AAF43126FE47DBA131988350B78C56"><enum>(C)</enum><text>Enhanced bus
			 conspicuity.</text>
					</subparagraph><subparagraph id="idEECA3C7F35ED44A1B2687C9159342B05"><enum>(D)</enum><text>Increased
			 resistance to loss-of-control crashes.</text>
					</subparagraph><subparagraph id="id68F6ADF6FD9A4491BD4AB106AC0D12C6"><enum>(E)</enum><text>Improved
			 resistance to rollover crashes.</text>
					</subparagraph></paragraph><paragraph id="IDc63cc705997447f2925df9fabcc59c43"><enum>(3)</enum><text>Bus fire
			 protection and passenger evacuation improvements, including the
			 following:</text>
					<subparagraph id="id870808F1B9CC43AAA2482EBE56009B17"><enum>(A)</enum><text>Effective
			 emergency exit design.</text>
					</subparagraph><subparagraph id="id195297A840BC4B938DDFC9D23E56F529"><enum>(B)</enum><text>Effective
			 emergency evacuation of passengers.</text>
					</subparagraph><subparagraph id="id46CA377CB8294161A1A3126D8795D44A"><enum>(C)</enum><text>Effective manual
			 and automated fire suppression systems.</text>
					</subparagraph><subparagraph id="id7AF3BD75F43641DCA1EAC2E14ABCD6C6"><enum>(D)</enum><text>Increased vehicle
			 resistance to fire propagation, including both exterior and interior resistance
			 to burning.</text>
					</subparagraph><subparagraph id="id9DDD07B1743C4C6F93BBC8031764EEBA"><enum>(E)</enum><text>Suppression of
			 toxic smoke and vapors in bus fires.</text>
					</subparagraph><subparagraph id="idA2F77D512B34454B99131D07B7C0D195"><enum>(F)</enum><text>Resistance to bus
			 fuel system fires.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAC64380231D24D168C85406C7DF2249F"><enum>(G)</enum><text>Training of bus
			 operators in the use of firefighting equipment and the safe evacuation of
			 passengers.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA08D368B7FC14C748682E7A2053D542C"><enum>(4)</enum><text>Such other
			 occupant protection safety countermeasures as the Secretary considers
			 appropriate.</text>
				</paragraph></subsection><subsection id="id7D844BD463074F44AAB347C40EC91F3B"><enum>(b)</enum><header>Report</header><text>Not
			 later than September 30, 2008, the Secretary shall submit to the Committee on
			 Commerce, Science, and Transportation of the Senate and the Committee on Energy
			 and Commerce of the House of Representatives a report setting forth the
			 findings of the Secretary with respect to the study required by subsection (a)
			 and recommendations for legislative and regulatory changes.</text>
			</subsection></section><section id="id47686B4D0A37442A8CA36125386AF7E2"><enum>5.</enum><header>Improved
			 oversight of providers of motorcoach services and of other motor carriers of
			 passengers</header>
			<subsection id="id22F5E6339D6147F7BDA81CB62907B40A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 31144 of
			 title 49, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id8F61C875A2314441B419EE1B6FE4AA6B" style="OLC">
					<subsection id="ID8e0bffc089ce41928d691dcc31041b06"><enum>(h)</enum><header>Periodic safety
				reviews of providers of motorcoach services</header>
						<paragraph id="idA2301F9FB80B4B2387FFB85E8DC5D279"><enum>(1)</enum><header>Safety
				review</header><text>Not later than 3 years after the date of the enactment of
				this subsection, the Secretary shall require, by regulation, each provider of
				motorcoach services registered with the Federal Motor Carrier Safety
				Administration on or after the date of the enactment of this subsection to
				undergo a periodic safety review.</text>
						</paragraph><paragraph id="id373AF43B693D4A84A4DA5F979716AA72"><enum>(2)</enum><header>Elements of
				review</header><text>In the regulations prescribed pursuant to paragraph (1),
				the Secretary shall establish the elements of the periodic safety review,
				including basic safety management controls.</text>
						</paragraph><paragraph id="id7330C574238D4AF1A86693B409B8D446"><enum>(3)</enum><header>Safety fitness
				ratings</header><text>As part of the safety review required by this subsection,
				the Secretary shall assign a safety fitness rating to each provider of
				motorcoach services and shall reassess such rating not less frequently than
				every 3 years.</text>
						</paragraph><paragraph id="id90F7D56E8DAA4123B04605A81411E156"><enum>(4)</enum><header>Motorcoach
				services defined</header><text>In this subsection, the term <term>provider of
				motorcoach services</term> has the meaning provided such term in section 2 of
				the <short-title>Motorcoach Enhanced Safety Act of
				2007</short-title>.</text>
						</paragraph></subsection><after-quoted-block></after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="ID89cb83fe7eca4e3d8c64d24262e31f08"><enum>(b)</enum><header>Revision of
			 safety audit system</header><text>Not later than September 30, 2008, the
			 Secretary shall revise the safety fitness audit system of the Department of
			 Transportation established pursuant to section 31144 of title 49, United States
			 Code, to conform with safety recommendation H–99–6 of the National
			 Transportation Safety Board issued February 26, 1999.</text>
			</subsection></section><section id="idB13585E2233A4EFF89E9B14C726F6B17"><enum>6.</enum><header>Motorcoach
			 driver training</header>
			<subsection id="ID2bb2e7ff979349f0b63d93fdba1c0d28"><enum>(a)</enum><header>Establishment
			 of training curriculum</header>
				<paragraph id="idEC23E1FA1756431B8E9F0CBA8E83CBFA"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of the enactment of
			 this Act, the Secretary shall establish, by regulation, a training curriculum
			 for drivers of motorcoaches to be adopted by public and private schools and
			 motor carriers that provide training for drivers of motorcoaches.</text>
				</paragraph><paragraph id="id9D647CB3A06A4DAFB686D7D8BEF2AD3E"><enum>(2)</enum><header>Curriculum
			 requirements</header><text>The training curriculum required by paragraph (1)
			 shall include the following:</text>
					<subparagraph id="id705FE74BBFD148BFB9C454D3B30CB1A9"><enum>(A)</enum><text>Classroom and
			 behind-the-wheel instruction that is adequate for all new drivers of
			 motorcoaches to operate safely motorcoaches and respond effectively to
			 emergency situations.</text>
					</subparagraph><subparagraph id="id1B54ADF543CC4890950E5C4095621934"><enum>(B)</enum><text>Instruction in
			 advanced knowledge and skills that are necessary to operate motorcoaches
			 safely, including the knowledge and skills necessary—</text>
						<clause id="id87C3C741BB68495A8C0F5E98C9DB7E7A"><enum>(i)</enum><text>to
			 suppress motorcoach fires; and</text>
						</clause><clause id="idF11B7C725B4C4120A645CD8E47262AEF"><enum>(ii)</enum><text>to
			 evacuate passengers from motorcoaches safely.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDcfb3954bb735414d871501ec90d4d299"><enum>(b)</enum><header>Training
			 required</header>
				<paragraph id="id4EA052EEF1AF442BB0FA120C4CE241BF"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall require each motorcoach driver
			 seeking a commercial driver’s license (CDL) passenger endorsement to undergo a
			 training program that includes the training curriculum established pursuant to
			 subsection (a) before taking a test for a commercial driver’s license passenger
			 endorsement.</text>
				</paragraph><paragraph id="ID054748f16e014b6eb960e27f4fb6250a"><enum>(2)</enum><header>Certificate of
			 completion required</header><text>The Secretary shall require that each driver
			 seeking to take the test for the commercial driver’s license passenger
			 endorsement shall present a certificate to a State licensing authority
			 certifying that the driver has—</text>
					<subparagraph id="idA1C5F91C34304AFF9208924754EEA8B5"><enum>(A)</enum><text>successfully
			 completed a motorcoach driver training course that includes the curriculum
			 established in accordance with subsection (a); and</text>
					</subparagraph><subparagraph id="idA8582ACEF43948B5B52B982D38AFDCD2"><enum>(B)</enum><text>received a
			 passing grade for an examination at the culmination of such training
			 course.</text>
					</subparagraph></paragraph></subsection><subsection id="IDe7361a25649e4cb5afe2411da49fa9d5"><enum>(c)</enum><header>Report on
			 feasibility of establishing a system of certification of training
			 programs</header><text>Not later than September 30, 2008, the Secretary shall
			 submit to the Committee on Commerce, Science, and Transportation of the Senate
			 and the Committee on Transportation and Infrastructure of the House of
			 Representatives a report on the feasibility of establishing a system of
			 certification of public and private schools and of motor carriers that provide
			 motorcoach driver training in accordance with the curriculum established by the
			 Secretary pursuant to subsection (a).</text>
			</subsection></section><section id="id4EA7525B0073484396B5CF6C4BD3D397"><enum>7.</enum><header>Improved
			 commercial driver's license testing</header>
			<subsection id="ID336b15e041d343839d7c8d613823bc8c"><enum>(a)</enum><header>Increased
			 stringency of examination for commercial driver's license passenger-carrying
			 endorsement</header>
				<paragraph id="id03A6B913A987425CA642F733A6A64AB2"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall prescribe standards that improve the
			 quality and stringency of the examination for the commercial driver’s license
			 passenger-carrying endorsement. Such standards shall require—</text>
					<subparagraph id="id0246EAE1C1CE40C4BA23C872CCC741F0"><enum>(A)</enum><text>a more stringent
			 knowledge test than the test in effect on the day before the date of the
			 enactment of this Act; and</text>
					</subparagraph><subparagraph id="id2D96C403359444E599528BF4AE8A7FF1"><enum>(B)</enum><text>a more stringent
			 examination of the driving skills necessary to operate safely a commercial
			 motor vehicle with passengers than the examination of such skills in effect on
			 the day before the date of the enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="id4BFB9E28E0E54064B7AF4B14422A8934"><enum>(2)</enum><header>Cooperation</header><text>In
			 prescribing the standards required by paragraph (1), the Secretary shall
			 cooperate with the American Association of Motor Vehicle Administrators.</text>
				</paragraph></subsection><subsection id="id768883059A5F44FD974C585630FBDDBE"><enum>(b)</enum><header>Modification of
			 requirements for commercial driver's license passenger-carrying
			 endorsement</header><text>The Secretary shall establish by regulation a
			 requirement that a driver shall have a commercial driver's license
			 passenger-carrying endorsement in order to operate a commercial motor vehicle
			 and transport not less than 9 and not more than 15 passengers (including a
			 driver) in interstate commerce for compensation.</text>
			</subsection></section><section id="id9B65D33C2A9744B2922B5171F800980B"><enum>8.</enum><header>Improved
			 physical fitness oversight and commercial driver medical certificates</header>
			<subsection id="idF26F4AFA30644EBDA9181CE60EF1545A"><enum>(a)</enum><header>Require passage
			 of rigorous examination To be listed in National Registry of Medical
			 Examiners</header><text>Section 31149(c)(1)(D) of title 49, United States Code,
			 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id8105F4884CB64B4085C4C9EC241DEEAC" style="OLC">
					<subparagraph id="idAFCC4F29892140AC80C555D8E894184A"><enum>(D)</enum><text>develop, as
				appropriate, specific courses and materials for medical examiners who wish to
				be listed in the national registry established under this section and develop a
				rigorous examination for which a passing grade must be achieved to be listed in
				such national
				registry;</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID973295aeb2a144f3ac41be66c5c49dbd"><enum>(b)</enum><header>Integration of
			 Federal medical qualification certificate and commercial driver’s
			 license</header><text>Not later than 2 years after the date of the enactment of
			 this Act, the Secretary shall prescribe the regulations required by section 215
			 of the Motor Carrier Safety Improvement Act of 1999 (49 U.S.C. 31305
			 note).</text>
			</subsection><subsection id="ID913e3c5257c04ba8b1d48d760f15c64d"><enum>(c)</enum><header>Medical
			 examination form comparisons</header><text>Not later than 2 years after the
			 date of the enactment of this Act, the Secretary shall require by regulation
			 that—</text>
				<paragraph id="idA897BE8AA1CC45DDB9360AF8EB886BD3"><enum>(1)</enum><text>each time a
			 medical examiner performs a medical examination to certify an applicant for a
			 commercial driver's license under section 391.43 of title 49, Code of Federal
			 Regulations, such medical examiner shall submit to the appropriate State
			 licensing agency the form for such examination required by section 391.43(f) of
			 such title (as in effect on the day before the date of the enactment of this
			 Act); and</text>
				</paragraph><paragraph id="idE768E66FB49B4AB7969C6B06C94717C2"><enum>(2)</enum><text>as a condition of
			 approval of a State plan under section 31102(d) of title 49, United States Code
			 (as added by<internal-xref idref="id62B80118D6CD4B0FAE725D3B99EA8834"> section
			 10(b)</internal-xref>), State licensing authorities compare the forms they
			 receive pursuant to paragraph (1) with the medical examiner's certificate
			 required by section 391.43(g) of title 49, Code of Federal Regulations (as in
			 effect on the day before the date of the enactment of this Act) to determine
			 the accuracy and validity of the information contained in such forms and
			 certificates.</text>
				</paragraph></subsection><subsection id="id1FA76A1F968E454DAABDAD0082E068F5"><enum>(d)</enum><header>Additional
			 oversight of licensing authorities</header>
				<paragraph id="id6EA461B291AC4CEDA6306D7E7D4B8BF3"><enum>(1)</enum><header>In
			 general</header><text>Section 31149(c)(1) of title 49, United States Code, is
			 amended—</text>
					<subparagraph id="id951CDC38A6354350A30BF4CECAB9A693"><enum>(A)</enum><text>in subparagraph
			 (E), by striking <quote>basis; and</quote> and inserting
			 <quote>basis;</quote>;</text>
					</subparagraph><subparagraph id="id7D9C684C805B4913B0E10B9091CF5890"><enum>(B)</enum><text>in subparagraph
			 (F), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="idF28F7C7326594B879C4481D59A3F8B8D"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idAB17A224172C4F3FAEFD50627AF6FBE5" style="OLC">
							<subparagraph id="idB70AAEC9D56F4DFDA4B27A4F8122A120"><enum>(G)</enum><text>each year, review
				the licensing authorities of 10 States to assess the accuracy and validity of
				physical examination reports and medical certificates submitted by certified
				medical examiners to such State licensing
				agencies.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idF81D92161F0D4C6DAA8303EB92D2DA88"><enum>(2)</enum><header>Internal
			 oversight policy</header>
					<subparagraph id="id7A0196A42EBB4298AF35291ED577BD05"><enum>(A)</enum><header>In
			 general</header><text>Not later than 2 years after the date of the enactment of
			 this Act, the Secretary shall establish an oversight policy and process within
			 the Department of Transportation for purposes of carrying out the requirement
			 of subparagraph (G) of such section 31149(c)(1), as added by paragraph
			 (1).</text>
					</subparagraph><subparagraph id="idC515DB3121BB4635A801183CD598BA28"><enum>(B)</enum><header>Effective
			 date</header><text>The requirement of subparagraph (G) of section 31149(c)(1)
			 of title 49, United States Code, shall take effect on the date that the
			 oversight policies and processes are established pursuant to subparagraph
			 (A).</text>
					</subparagraph></paragraph></subsection><subsection id="ID28165b43b4bd4010b4eea526c50e8e75"><enum>(e)</enum><header>Deadline for
			 establishment of national registry of medical examiners</header><text>Not later
			 than 1 year after the date of the enactment of this Act, the Secretary shall
			 establish the national registry of medical examiners required by section
			 31149(d)(1) of title 49, United States Code.</text>
			</subsection><subsection id="id66499B30F7844880853AD1C595C4733D"><enum>(f)</enum><header>Additional
			 function of Medical Review Board</header><text>Section 31149(a)(1) of title 49,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id5B0FB39A3BBE43BAB9813CAFDB1DEC8F" style="OLC">
					<paragraph id="idE94039E91E87425596F22594CD1E575B"><enum>(1)</enum><header>Establishment
				and function</header><text>The Secretary of Transportation shall establish a
				Medical Review Board with the following functions:</text>
						<subparagraph id="idBABB7E5767F54F9F977D4F501C79E375"><enum>(A)</enum><text>Providing the
				Federal Motor Carrier Safety Administration with medical advice and
				recommendations on medical standards and guidelines for the following:</text>
							<clause id="idBA92985AE1D64EA2BEBF9D2D02739664"><enum>(i)</enum><text>The physical
				qualifications of operators of commercial motor vehicles.</text>
							</clause><clause id="idE1105E1C9DDF4B2CB20FAC488654AC38"><enum>(ii)</enum><text>Medical examiner
				education.</text>
							</clause><clause id="idD8E512FC40154A909CB89B0E8E62EC2D"><enum>(iii)</enum><text>Medical
				research.</text>
							</clause></subparagraph><subparagraph id="id9295A001EEFA40A08D6B054C1DD537C2"><enum>(B)</enum><text>Providing the
				Secretary with advice and recommendations concerning the criteria to be used
				for evaluating medical examiners for admission to the national registry
				established under this
				section.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id7540B0F3814843C096AFB5CEB33A3496"><enum>9.</enum><header>Safety
			 enforcement technology to reduce driver fatigue</header>
			<subsection id="id197B4E270FB84900BD28E6416D211FDE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the Secretary shall prescribe
			 regulations requiring that all commercial motor vehicles used by a motor
			 carrier in interstate commerce be equipped with electronic on-board recorders
			 linked with vehicle engine functions and electronic control modules that
			 accurately record commercial driver hours of service and provide real-time
			 tracking of driver and vehicle location.</text>
			</subsection><subsection id="id746128EF6141425686F5FB4164B4B552"><enum>(b)</enum><header>Applicability</header><text>The
			 regulations prescribed under subsection (a) shall apply to all commercial motor
			 vehicles used by motor carriers in interstate commerce beginning on the date
			 that is 3 years after the date of the enactment of this Act.</text>
			</subsection></section><section id="idC90DA184809F4BB180C29D25602F6794"><enum>10.</enum><header>Commercial
			 motor vehicle safety inspection programs</header>
			<subsection id="IDb74d3dfacc514ab1b4c6785fea24afe0"><enum>(a)</enum><header>In
			 general</header><text>Section 31142 of title 49, United States Code, is amended
			 by striking subsections (a) and (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id405ABAC879BE41ED952EFC06D52D8923" style="OLC">
					<subsection id="id0088207F84514E2B9FF55936028CB4CB"><enum>(a)</enum><header>Annual safety
				inspection program</header>
						<paragraph id="id5048BB098B85420698FDA18499415776"><enum>(1)</enum><header>Program
				required</header><text>In order to receive a grant pursuant to section 31102 of
				this title, a State shall carry out an annual safety inspection program for
				commercial motor vehicles, including motor carriers transporting not less than
				9 and not more than 15 passengers (including a driver), that receives approval
				from the Secretary pursuant to paragraph (3).</text>
						</paragraph><paragraph id="id1FB0AE1A35D840A9A7AA66526B2425AB"><enum>(2)</enum><header>Inspection of
				safety equipment</header><text>A commercial motor vehicle inspected under a
				program established pursuant to paragraph (1) is required to pass an inspection
				of all safety equipment required under the regulations prescribed under section
				31136 of this title.</text>
						</paragraph><paragraph id="id3D9CAF7B9A21451097484B305F89F63A"><enum>(3)</enum><header>Periodic review
				of State safety inspection programs</header><text>Not less frequently than once
				every 3 years, the Secretary shall review and approve or disapprove each safety
				inspection program established pursuant to paragraph (1).</text>
						</paragraph></subsection><subsection id="idE5E8DBC0B6BF4D9DB273323EA220A8AF"><enum>(b)</enum><header>Regulations for
				inspection of vehicles and record retention</header>
						<paragraph id="idC452281FED2244A5B4EA9481553D209F"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall prescribe regulations on Government
				standards for—</text>
							<subparagraph id="id0B650B16663F40C6B30F2FE478069964"><enum>(A)</enum><text>inspection of
				commercial motor vehicles under programs established pursuant to subsection
				(a); and</text>
							</subparagraph><subparagraph id="id95A7CCCFA72F4C0FAB091BFF762EB79A"><enum>(B)</enum><text>retention by
				employers of records of such an inspection.</text>
							</subparagraph></paragraph><paragraph id="id0A35D258A73E4067BC812002684DEA87"><enum>(2)</enum><header>Authority</header><text>Regulations
				prescribed under this subsection are treated as regulations prescribed under
				section 31136 of this
				title.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id62B80118D6CD4B0FAE725D3B99EA8834"><enum>(b)</enum><header>Condition on
			 State grants</header><text>Section 31102(d) of such title is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="id9BA886972DD74829B88F4BEC19070D92" style="OLC">
					<subsection id="id430E29A5ADE34E08A8975BFF51154E6E"><enum>(d)</enum><header>Continuous
				evaluation of plans</header>
						<paragraph id="id5D9ECD4E9DDD4A419638A711EA34B221"><enum>(1)</enum><header>In
				general</header><text>On the basis of reports submitted by a State motor
				vehicle safety agency of a State with a plan approved under this section and
				the Secretary's own investigations, the Secretary shall make a continuing
				evaluation of the way the State is carrying out the plan. If the Secretary
				finds, after notice and opportunity for comment, the State plan previously
				approved is not being followed or has become inadequate to ensure enforcement
				of the regulations, standards, or orders, the Secretary shall withdraw approval
				of the plan and notify the State.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6C21CA68B2ED4EB393BEB0137B5CE4DE"><enum>(2)</enum><header display-inline="yes-display-inline">Approval of annual commercial motor vehicle
				inspection programs</header><text display-inline="yes-display-inline">If, under
				paragraph (3) of section 31142(a) of this title, the Secretary disapproves of
				an annual safety inspection program of a State established pursuant to
				paragraph (1) of such section 31142(a), the Secretary shall withdraw approval
				of the plan of such State and notify the State.</text>
						</paragraph><paragraph id="idB5DEBB289E384C54A6928414A92E250B"><enum>(3)</enum><header>Effective date
				of plan disapproval</header><text>A State plan stops being effective under this
				subsection when notice is received by the State under this subsection.</text>
						</paragraph><paragraph id="id2C084731FE3D47269BAA440779D4EF51"><enum>(4)</enum><header>Judicial
				review</header><text>A State adversely affected by a withdrawal of approval
				under this subsection may seek judicial review under chapter 7 of title
				5.</text>
						</paragraph><paragraph id="id377792706817494EB7CF0BBDE4940945"><enum>(5)</enum><header>Retention of
				jurisdiction</header><text>Notwithstanding a withdrawal of approval under this
				subsection, the State may retain jurisdiction in administrative or judicial
				proceedings begun before the withdrawal if the issues involved are not related
				directly to the reasons for the
				withdrawal.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id32FE5C238A584243B32BB9C2271E65EF"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect 1 year
			 after the date of the enactment of this Act.</text>
			</subsection></section><section id="idF6D34F4B59D24B258521D68151F299BB"><enum>11.</enum><header>Regulations</header><text display-inline="no-display-inline">Any standard or regulation prescribed or
			 modified pursuant to this Act shall be done in accordance with section 553 of
			 title 5, United States Code.</text>
