			 purposes</header>
			<subsection id="H8C251C3376B34F12BBF7C593BC06DA00"><enum>(a)</enum><header>Findings</header><text>The
			 Congress finds that—</text>
				<paragraph id="H33E99BDB3D2D475395DCFF16A129795F"><enum>(1)</enum><text>one of the primary
			 missions of the Federal Housing Administration (FHA) single family mortgage
			 insurance program is to reach borrowers who are underserved, or not served, by
			 the existing conventional mortgage marketplace;</text>
				</paragraph><paragraph id="H9CF8B9ACDF2E42EFB2DB6D89D76EB2EC"><enum>(2)</enum><text>the FHA program
			 has a long history of innovation, which includes pioneering the 30-year
			 self-amortizing mortgage and a safe-to-seniors reverse mortgage product, both
			 of which were once thought too risky to private lenders;</text>
				</paragraph><paragraph id="H23C89DB870CF4624869B1623B5FCBDC7"><enum>(3)</enum><text>the FHA single
			 family mortgage insurance program traditionally has been a major provider of
			 mortgage insurance for home purchases;</text>
				</paragraph><paragraph id="H173F1171F7A449A6AEB887F5A400F4CC"><enum>(4)</enum><text>the FHA mortgage
			 insurance premium structure, as well as FHA’s product offerings, should be
			 revised to reflect FHA’s enhanced ability to determine risk at the loan level
			 and to allow FHA to better respond to changes in the mortgage market;</text>
				</paragraph><paragraph id="H79178FAE22924C539DD14D4E223FB7E"><enum>(5)</enum><text>during past
			 recessions, including the oil-patch downturns in the mid-1980s, FHA remained a
			 viable credit enhancer and was therefore instrumental in preventing a more
			 catastrophic collapse in housing markets and a greater loss of homeowner
			 equity; and</text>
				</paragraph><paragraph id="HC2B2FE94ED2840B4BF21A55D5FCF1D88"><enum>(6)</enum><text>as housing price
			 appreciation slows and interest rates rise, many homeowners and prospective
			 homebuyers will need the less-expensive, safer financing alternative that FHA
			 mortgage insurance provides.</text>
				</paragraph></subsection><subsection id="H5C68351B86C543BE95B699B044EF23CF"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="H01473E24C73843E0B4BBBCD12CF3FB26"><enum>(1)</enum><text>to provide
			 flexibility to FHA to allow for the insurance of housing loans for low- and
			 moderate-income homebuyers during all economic cycles in the mortgage
			 market;</text>
				</paragraph><paragraph id="HB99FD74FE23942E2B9607D1C20EC1759"><enum>(2)</enum><text>to modernize the
			 FHA single family mortgage insurance program by making it more reflective of
			 enhancements to loan-level risk assessments and changes to the mortgage market;
			 and</text>
				</paragraph><paragraph id="H89EC4CCAE9C2427FB2CEF773D5DAA966"><enum>(3)</enum><text>to adjust the loan
			 limits for the single family mortgage insurance program to reflect rising house
			 prices and the increased costs associated with new construction.</text>
				</paragraph></subsection></section><section id="H2C5C905490D04A8998D1F17C6BB4B154"><enum>3.</enum><header>Maximum principal
			 loan obligation</header><text display-inline="no-display-inline">Paragraph (2)
			 of section 203(b) of the <act-name parsable-cite="NHA">National Housing
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12
			 U.S.C. 1709(b)(2)</external-xref>) is amended—</text>
			<paragraph id="HB40C7EBD176647B686BAD9D65772C5C3"><enum>(1)</enum><text>by striking
			 subparagraphs (A) and (B) and inserting the following new subparagraphs:</text>
				<quoted-block id="H35A8DF692A2F45508B171FDAD903294E" style="OLC">
					<subparagraph id="H31A250B608044EB0B6CD77D704DC68F9"><enum>(A)</enum><text>not to exceed the
				lesser of—</text>
						<clause id="HCA7C4C550FED417B9C9F33E2DB7F35D0"><enum>(i)</enum><text>in
				the case of a 1-family residence, the median 1-family house price in the area,
				as determined by the Secretary; and in the case of a 2-, 3-, or 4-family
				residence, the percentage of such median price that bears the same ratio to
				such median price as the dollar amount limitation in effect under section
				305(a)(2) of the <act-name parsable-cite="FHLMCA">Federal Home Loan Mortgage
				Corporation Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1454">12 U.S.C. 1454(a)(2)</external-xref>) for a 2-, 3-,
				or 4-family residence, respectively, bears to the dollar amount limitation in
				effect under such section for a 1-family residence; or</text>
						</clause><clause id="HC10BC1C933784BE9880345074183DDFB"><enum>(ii)</enum><text>the dollar amount
				limitation determined under such section 305(a)(2) for a residence of the
				applicable size;</text>
						</clause><continuation-text continuation-text-level="subparagraph">except
				that the dollar amount limitation in effect for any area under this
				subparagraph may not be less than the greater of (I) the dollar amount
				limitation in effect under this section for the area on October 21, 1998, or
				(II) 65 percent of the dollar limitation determined under such section
				305(a)(2) for a residence of the applicable size; and</continuation-text></subparagraph><subparagraph id="HDE084ED5DDF74FC9AE69002D207EF38B"><enum>(B)</enum><text>not to exceed the
				appraised value of the property, plus any initial service charges, appraisal,
				inspection and other fees in connection with the mortgage as approved by the
				Secretary.</text>
					</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HF20B949320424EC1886200E91C12BC54"><enum>(2)</enum><text>in the matter
			 after and below subparagraph (B), by striking the second sentence (relating to
			 a definition of <quote>average closing cost</quote>) and all that follows
			 through <quote>title 38, United States Code</quote>; and</text>
			</paragraph><paragraph id="H10EFAC2D690E4CB3B69C134C63EDE4DF"><enum>(3)</enum><text>by striking the
			 last undesignated paragraph (relating to counseling with respect to the
			 responsibilities and financial management involved in homeownership).</text>
			</paragraph></section><section id="HB254A9D02D6F4F67800170C886854764"><enum>4.</enum><header>Extension of
			 mortgage term</header><text display-inline="no-display-inline">Paragraph (3) of
			 section 203(b) of the <act-name parsable-cite="NHA">National Housing
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12
			 U.S.C. 1709(b)(3)</external-xref>) is amended—</text>
			<paragraph id="HDD219CC867AD46DF8C3168FEB8E89855"><enum>(1)</enum><text>by striking
			 <quote>thirty-five years</quote> and inserting <quote>forty years</quote>;
			 and</text>
			</paragraph><paragraph id="HA207CA4236C3430C83DA12AD97F6086"><enum>(2)</enum><text>by
			 striking <quote>(or thirty years if such mortgage is not approved for insurance
			 prior to construction)</quote>.</text>
			</paragraph></section><section id="H1DD8DB5F237B402A99AED821D8E63D4"><enum>5.</enum><header>Cash investment
			 requirement</header><text display-inline="no-display-inline">Paragraph (9) of
			 section 203(b) of the <act-name parsable-cite="NHA">National Housing
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12
			 U.S.C. 1709(b)(9)</external-xref>) is amended by striking the paragraph
			 designation and all that follows through <quote><italic>Provided
			 further</italic>, That for</quote> and inserting the following:</text>
			<quoted-block act-name="National Housing Act" id="HAE8FEF3CD19048ACBDF8426EE4CEF1D" style="OLC">
				<paragraph id="H90A084FFDBA14A83A559777F8239718F"><enum>(9)</enum><text>Be executed by a
				mortgagor who shall have paid on account of the property, in cash or its
				equivalent, an amount, if any, as the Secretary may determine based on factors
				determined by the Secretary and commensurate with the likelihood of default.

				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H405FD6EA5C31481FAB35E3027F36D355"><enum>6.</enum><header>Temporary
			 reinstatement of downpayment requirement in event of increased
			 defaults</header><text display-inline="no-display-inline">Section 203(b) of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1709(b)) is amended by adding at the end the following new paragraph:</text>
			<quoted-block act-name="National Housing Act" id="HA86775A3DDE5439881B42FE226EE8B6D" style="OLC">
				<paragraph id="HA33E3077EDB842D5BC1E1840E6F0E059"><enum>(10)</enum><header>Effect of
				increased defaults</header>
					<subparagraph id="HA1F9C062C2474737B69ECECEDCE1E5B9"><enum>(A)</enum><header>Annual
				determination</header><text>If, for any calendar year described in subparagraph
				(B)(i), the Secretary determines, pursuant such subparagraph, that—</text>
						<clause id="H657E66C8295341E0B6C7D39EC3E950F6"><enum>(i)</enum><text>the ratio of the
				number of mortgage insurance claims made during such calendar year on mortgages
				insured under this section to the total number of mortgages having such
				insurance in force during such calendar year exceeds, by 25 percent or more,
				such ratio for the 12-month period ending on the effective date of this Act,
				or</text>
						</clause><clause id="HECF3FC182E7B43DE835FCADA508F4255"><enum>(ii)</enum><text>the ratio of the
				aggregate remaining principal obligation under mortgages insured under this
				section for which an insurance claim is made during such calendar year to the
				average, for such calendar year, of the aggregate outstanding principal
				obligation under mortgages so insured exceeds, by 25 percent or more, such
				ratio for the 12-month period ending on such effective date,</text>
						</clause><continuation-text continuation-text-level="subparagraph">during
				the 90-day period beginning upon the submission of the report for such calendar
				year under subparagraph (B)(ii) containing such determination, the Secretary
				may insure a mortgage under this section only pursuant to the requirement under
				subparagraph (C), and the Secretary shall, not later than 60 days after
				submission of the report containing such determination, submit a report to the
				Congress under subparagraph (D) regarding mortgage insurance claims during such
				calendar year.</continuation-text></subparagraph><subparagraph id="H0B742E0CAD8C4D96814651B438D58D33"><enum>(B)</enum><header>5 years of
				annual determinations</header>
						<clause id="H37619F4118A44201B39E7B08DBA7074E"><enum>(i)</enum><header>In
				general</header><text>The Secretary shall, for each of the 5 calendar years
				commencing after the date of the enactment of this Act, compare the ratios
				referred to in subparagraph (A) and make a determination under such
				subparagraph.</text>
						</clause><clause id="H4672AD9A539D480D84263CBDB4120077"><enum>(ii)</enum><header>Annual report
				on defaults</header><text>Not later than 90 days after the conclusion of each
				of the calendar years described in clause (i), the Secretary shall submit a
				report to the Congress containing the determination of the Secretary under such
				clause with respect to such calendar year and setting forth the ratios referred
				to in such clause for such calendar year.</text>
						</clause></subparagraph><subparagraph id="HCB63140EB42A465D9615DC2EABFC351C"><enum>(C)</enum><header>Reinstatement of
				downpayment requirement</header><text>The requirement under this subparagraph
				is that paragraph (9) of this subsection shall apply as such paragraph was in
				effect on the day before the effective date of the Expanding American
				Homeownership Act of 2007.</text>
					</subparagraph><subparagraph id="H6987DC1AC6F144DFAFFFE582C81E9BC2"><enum>(D)</enum><header>Reports
				regarding increased default rate</header><text>A report under this
				subparagraph, as required under subparagraph (A), shall contain—</text>
						<clause id="HB1C21BB0DF444CDBB60575B0214CFCF2"><enum>(i)</enum><text>an
				analysis of mortgage insurance claims, made during the calendar year for which
				the report is submitted, on mortgages insured under this section;</text>
						</clause><clause id="H746A86A24F2844D29C66CEC7B8E15B49"><enum>(ii)</enum><text>an analysis of
				the reasons for the increase during such calendar year in the applicable ratio
				or ratios under subparagraph (A), including an analysis of the extent to which
				such increase is attributable to the amendments made by the Expanding American
				Homeownership Act of 2007;</text>
						</clause><clause id="H6A238EEB27D045EF8FBC92EDDA3B1447"><enum>(iii)</enum><text>the effect of
				such increase on the Mutual Mortgage Insurance Fund;</text>
						</clause><clause id="H193083CBBACF403097E6C738A223592C"><enum>(iv)</enum><text>recommendations
				regarding—</text>
							<subclause id="HD4BF27F185C54FDA99F46F87AF70E6DF"><enum>(I)</enum><text>whether the
				Congress should, to respond to such increase, take legislative action (aa) to
				apply paragraph (9) of this subsection as such paragraph was in effect on the
				day before the effective date of Expanding American Homeownership Act of 2007,
				(bb) to apply paragraph (2)(A)(ii) by substituting <quote>87 percent of the
				dollar amount limitation</quote> for <quote>the dollar amount
				limitation</quote>, or (cc) both; and</text>
							</subclause><subclause id="H4EC46F94C9DF495384D7F5E4EFCE2C00"><enum>(II)</enum><text>whether such
				provisions should be temporary or permanent, and, if temporary, the period
				during which such provisions should apply; and</text>
							</subclause></clause><clause id="HCA66A77A5A9A4E72A14329911CD91EC4"><enum>(v)</enum><text>recommendations
				regarding any other administrative, regulatory, legislative, or other actions
				that should be taken to respond to such increase.</text>
						</clause></subparagraph><subparagraph id="H802B65C986B24B498E6EE1ED66B6F0B4"><enum>(E)</enum><header>Defaults in
				disaster areas not counted for 24 months</header><text>In determining the
				number of mortgage insurance claims made and the aggregate remaining principal
				obligation under mortgages for which an insurance claim is made for purposes of
				subparagraph (A) for any calendar year, the Secretary shall not take into
				consideration any claim made during such period on a mortgage on any property
				that is located in an area for which a major disaster was declared pursuant to
				the Robert T. Stafford Disaster Relief and Emergency Assistance Act if such
				claim was made during the 24-month period beginning upon such
				declaration.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H77B118AA337142BC8F00D02EAEDCBFF4"><enum>7.</enum><header>Mortgage
			 insurance premiums</header><text display-inline="no-display-inline">Section
			 203(c) of the <act-name parsable-cite="NHA">National Housing Act</act-name> (12
			 U.S.C. 1709(c)) is amended—</text>
			<paragraph id="HC2249E03650543C9B8198B134415F37F"><enum>(1)</enum><text>in paragraph (2),
			 in the matter preceding subparagraph (A), by striking
			 <quote>Notwithstanding</quote> and inserting <quote>Except as provided in
			 paragraph (3) and notwithstanding</quote>; and</text>
			</paragraph><paragraph id="H7D0FDB88B8044077AB90615EB7689558"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block id="H3025262611E74D7C0015AB1E924C472D" style="OLC">
					<paragraph id="HE2D73F4C8C39492C9678934673FE9773" indent="up1"><enum>(3)</enum><header>Flexible Risk-Based
				Premiums</header>
						<subparagraph id="H0BCE3C5BA5BC49B6BF79575D7DC100A8"><enum>(A)</enum><header>In general</header><text>For any
				mortgage insured by the Secretary under this title that is secured by a 1- to
				4-family dwelling and for which the loan application is received by the
				mortgagee on or after the date of enactment of the
				<short-title>Expanding American Homeownership Act of
				2007</short-title>, the Secretary may establish a mortgage insurance premium
				structure involving a single premium payment collected prior to the insurance
				of the mortgage or annual payments (which may be collected on a periodic
				basis), or both, subject to the limitations in subparagraphs (B) and (C). The
				rate of premium for such a mortgage may vary during the mortgage term as long
				as the basis for determining the variable rate is established before the
				execution of the mortgage. The Secretary may change a premium structure
				established under this subparagraph but only to the extent that such change is
				not applied to any mortgage already executed.</text>
						</subparagraph><subparagraph id="H6E68C3907EC64F6A00FB87C5CEF2DE"><enum>(B)</enum><header>Maximum up-front premium
				amounts</header><text>For any mortgage insured under a premium structure
				established pursuant to this paragraph, the amount of any single premium
				payment authorized by subparagraph (A), if established and collected prior to
				the insurance of the mortgage, may not exceed the following amount:</text>
							<clause id="H3A5FFF81C4654C59B28678A2A7ADAAE"><enum>(i)</enum><text>Except as provided in clauses (ii)
				and (iii), 3.0 percent of the amount of the original insured principal
				obligation of the mortgage.</text>
							</clause><clause id="H6C0528E4964D4361A525C1FC71914728"><enum>(ii)</enum><text>If the mortgagor has a credit
				score equivalent to a FICO score of 560 or more and has paid on account of the
				property, in cash or its equivalent, at least 3 percent of the Secretary’s
				estimate of the cost of acquisition (excluding the mortgage insurance premium
				paid at the time the mortgage is insured), 2.25 percent of the original insured
				principal obligation of the mortgage.</text>
							</clause><clause id="H5C3EEA1827654E20A7560012C599B8C"><enum>(iii)</enum><text>If the annual premium payment is
				equal to the maximum amount allowable under clause (i) of subparagraph (C), 1.5
				percent of the amount of the original insured principal obligation of the
				mortgage.</text>
							</clause></subparagraph><subparagraph id="H0B62B92B19FB4020A32216A67F42F041"><enum>(C)</enum><header>Maximum annual premium
				amounts</header><text>For any mortgage insured under a premium structure
				established pursuant to this paragraph, the amount of any annual premium
				payment collected may not exceed the following amount:</text>
							<clause id="H319CA070CF864303A7557D2036225547"><enum>(i)</enum><text>Except as provided in clauses (ii)
				and (iii), 2.0 percent of the remaining insured principal obligation of the
				mortgage.</text>
							</clause><clause id="H58D0C687EE524FEEA46D94C5CCF17A3"><enum>(ii)</enum><text>If the mortgagor is a mortgagor
				described in clause (ii) of subparagraph (B), 0.55 percent of the remaining
				insured principal obligation of the mortgage.</text>
							</clause><clause id="H29856A26BA1F49D6A5E8FBDB2EA6AF0"><enum>(iii)</enum><text>If the single premium payment
				collected at the time of insurance is equal to maximum amount allowable under
				clause (i) of subparagraph (B), 1.0 percent of the remaining insured principal
				obligation of the mortgage.</text>
							</clause></subparagraph><subparagraph id="HDD85AE1EDCC94E79005009A0742B98ED"><enum>(D)</enum><header>Payment
				incentive</header><text>Notwithstanding subparagraph (C), for any mortgage
				insured under a premium structure established pursuant to this paragraph and
				for which the annual premium payment exceeds the amount set forth in
				subparagraph (C)(ii), if during the 5-year period beginning upon the time of
				insurance all mortgage insurance premiums for such mortgage have been paid on a
				timely basis, upon the expiration of such period the Secretary shall reduce the
				amount of the annual premium payments due thereafter under such mortgage to an
				amount equal to the amount set forth in subparagraph (C)(ii).</text>
						</subparagraph><subparagraph id="H2762B936D554485FB42D78000039FB31"><enum>(E)</enum><header>Establishment and alteration of
				premium structure</header><text>A premium structure shall be established or
				changed under subparagraph (A) only by providing notice to mortgagees and to
				the Congress, at least 30 days before the premium structure is established or
				changed.</text>
						</subparagraph><subparagraph id="H3BEBC39E22F24B549EB5C92012298B58"><enum>(F)</enum><header>Considerations for premium
				structure</header><text>When establishing a premium structure under
				subparagraph (A) or when changing such a premium structure, the Secretary shall
				consider the following:</text>
							<clause id="HF0CC10BBCE094AD38F1800954E65BB57"><enum>(i)</enum><text>The effect of the proposed premium
				structure on the Secretary’s ability to meet the operational goals of the
				Mutual Mortgage Insurance Fund as provided in section 202(a).</text>
							</clause><clause id="HC440EA9C3707495D0096AC45D01594E5"><enum>(ii)</enum><text>Underwriting variables.</text>
							</clause><clause id="H0C36B5285A164DE583D5A40000E89BA1"><enum>(iii)</enum><text>The extent to which new pricing
				under the proposed premium structure has potential for acceptance in the
				private market.</text>
							</clause><clause id="H5FEEB99EC9324CB08C9DB0FFB1C7DF81"><enum>(iv)</enum><text>The administrative capability of
				the Secretary to administer the proposed premium structure.</text>
							</clause><clause id="H1C9FC6F054C44155AC97BA6DD06EE42B"><enum>(v)</enum><text>The effect of the proposed premium
				structure on the Secretary’s ability to maintain the availability of mortgage
				credit and provide stability to mortgage
				markets.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H9E546E0BC9664244B5BC985000B90437"><enum>8.</enum><header>Rehabilitation
			 loans</header><text display-inline="no-display-inline">Subsection (k) of
			 section 203 of the <act-name parsable-cite="NHA">National Housing

			 Insurance Fund</header>
			<subsection id="H84359C5A85EA4E0CA3976F4CBC00F6DC"><enum>(a)</enum><header>In
			 General</header><text>Subsection (a) of section 202 of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1708(a)) is amended to read as follows:</text>
				<quoted-block act-name="National Housing Act" id="HA0B5E160A1804F75A6FFFBC6821549D" style="OLC">
					<subsection id="H00E3583EA7EE4ED4BBFBC716CE01C1A"><enum>(a)</enum><header>Mutual Mortgage
				Insurance Fund</header>
						<paragraph id="H41073CF5928B49DC81CC1B3CB00272DA"><enum>(1)</enum><header>Establishment</header><text>Subject
				to the provisions of the <act-name parsable-cite="FCRA90">Federal Credit Reform
				Act of 1990</act-name>, there is hereby created a Mutual Mortgage Insurance
				Fund (in this title referred to as the <quote>Fund</quote>), which shall be
				used by the Secretary to carry out the provisions of this title with respect to
				mortgages insured under section 203. The Secretary may enter into commitments
				to guarantee, and may guarantee, such insured mortgages.</text>
						</paragraph><paragraph id="H25EC0125EC8B4E5B8E65CDD5A8221E01"><enum>(2)</enum><header>Limit on loan
				guarantees</header><text>The authority of the Secretary to enter into
				commitments to guarantee such insured mortgages shall be effective for any
				fiscal year only to the extent that the aggregate original principal loan
				amount under such mortgages, any part of which is guaranteed, does not exceed
				the amount specified in appropriations Acts for such fiscal year.</text>
						</paragraph><paragraph id="H198C53E2EF90400584656458BD481655"><enum>(3)</enum><header>Fiduciary
				responsibility</header><text>The Secretary has a responsibility to ensure that
				the Mutual Mortgage Insurance Fund remains financially sound.</text>
						</paragraph><paragraph id="HB8AC3AEB703A4293BE30E57C444D1659"><enum>(4)</enum><header>Annual
				independent actuarial study</header><text>The Secretary shall provide for an
				independent actuarial study of the Fund to be conducted annually, which shall
				analyze the financial position of the Fund. The Secretary shall submit a report
				annually to the Congress describing the results of such study and assessing the
				financial status of the Fund. The report shall recommend adjustments to
				underwriting standards, program participation, or premiums, if necessary, to
				ensure that the Fund remains financially sound.</text>
						</paragraph><paragraph id="H619DB7C878144036B300AE308C715E5C"><enum>(5)</enum><header>Quarterly
				reports</header><text>During each fiscal year, the Secretary shall submit a
				report to the Congress for each quarter, which shall specify for mortgages that
				are obligations of the Fund—</text>
							<subparagraph id="H8E95BBD4827444C58E8C75D1894D3E08"><enum>(A)</enum><text>the cumulative
				volume of loan guarantee commitments that have been made during such fiscal
				year through the end of the quarter for which the report is submitted;</text>
							</subparagraph><subparagraph id="H9006BD6B316B4CDE9C5EF4AB113C6401"><enum>(B)</enum><text>the types of loans
				insured, categorized by risk;</text>
							</subparagraph><subparagraph id="H94F6AC8C2B6E4D679B5095CFC81982B4"><enum>(C)</enum><text>any significant
				changes between actual and projected claim and prepayment activity;</text>
							</subparagraph><subparagraph id="H6CA460C5052E483187F53581773DBA62"><enum>(D)</enum><text>projected versus
				actual loss rates; and</text>
							</subparagraph><subparagraph id="H95765BACA5954CD3AE1D584732009B80"><enum>(E)</enum><text>updated
				projections of the annual subsidy rates to ensure that increases in risk to the
				Fund are identified and mitigated by adjustments to underwriting standards,
				program participation, or premiums, and the financial soundness of the Fund is
				maintained.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">The first
				quarterly report under this paragraph shall be submitted on the last day of the
				first quarter of fiscal year 2008, or upon the expiration of the 90-day period
				beginning on the date of the enactment of the Expanding American Homeownership
				Act of 2007, whichever is later.</continuation-text></paragraph><paragraph id="HE0B41FB10C5E475D9E3257587E9EC5D7"><enum>(6)</enum><header>Adjustment of
				premiums</header><text>If, pursuant to the independent actuarial study of the
				Fund required under paragraph (5), the Secretary determines that the Fund is
				not meeting the operational goals established under paragraph (8) or there is a
				substantial probability that the Fund will not maintain its established target
				subsidy rate, the Secretary may either make programmatic adjustments under
				section 203 as necessary to reduce the risk to the Fund, or make appropriate
				premium adjustments.</text>
						</paragraph><paragraph id="HE3E1F127EEBF4CE2BAA200A4B5C49236"><enum>(7)</enum><header>Operational
				goals</header><text>The operational goals for the Fund are—</text>
							<subparagraph id="H060EB1EEF3C94AE395AEA22F59B400DB"><enum>(A)</enum><text>to charge
				borrowers under loans that are obligations of the Fund an appropriate premium
				for the risk that such loans pose to the Fund;</text>
							</subparagraph><subparagraph id="HEE5C02571F9D4332A070F7A946ACDA7D"><enum>(B)</enum><text>to minimize the
				default risk to the Fund and to homeowners;</text>
							</subparagraph><subparagraph id="H70474113C4414F3AA250875E19F3B094"><enum>(C)</enum><text>to curtail the
				impact of adverse selection on the Fund; and</text>
							</subparagraph><subparagraph id="H58E064B0DC4D4A4992825D7ED774BE00"><enum>(D)</enum><text>to meet the
				housing needs of the borrowers that the single family mortgage insurance
				program under this title is designed to
				serve.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE8DF55D2CE1840F19DD577013DAFB7F3"><enum>(b)</enum><header>Obligations of
			 Fund</header><text>The <act-name parsable-cite="NHA">National Housing
			 Act</act-name> is amended as follows:</text>

				will occupy or occupies one of the units.</text>
							</paragraph><paragraph id="HA4934FA13A00430D0007222B7166DA76"><enum>(2)</enum><header>Limitation on
				principal obligation</header><text>A home equity conversion mortgage insured
				pursuant to paragraph (1) shall involve a principal obligation that does not
				exceed the dollar amount limitation determined under section 305(a)(2) of the
				<act-name parsable-cite="FHLMCA">Federal Home Loan Mortgage Corporation
				Act</act-name> for a residence of the applicable
				size.</text>

			 Cooperatives</header><text>Subsection (b) of section 255 of the

			 1715z–20(b)) is amended—</text>
				<paragraph id="H3302C30B536C4C6798FD61F3F68D716"><enum>(1)</enum><text>in
			 paragraph (4)—</text>
					<subparagraph id="H3777634343F5459EB0D55C57634F5277"><enum>(A)</enum><text>by inserting
			 <quote>a first or subordinate mortgage or lien</quote> before <quote>on all
			 stock</quote>;</text>
					</subparagraph><subparagraph id="H359BD20A65CE4D9BA45B3085A8021145"><enum>(B)</enum><text>by inserting
			 <quote>unit</quote> after <quote>dwelling</quote>; and</text>
					</subparagraph><subparagraph id="H3F5E0F7B353B4BD6934CAC97F0BE4854"><enum>(C)</enum><text>by inserting
			 <quote>a first mortgage or first lien</quote> before <quote>on a
			 leasehold</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H753B86B32F2845008726010650954600"><enum>(2)</enum><text>in paragraph (5),
			 by inserting <quote>a first or subordinate lien on</quote> before <quote>all
			 stock</quote>.</text>
				</paragraph></subsection><subsection id="H0F3185723E8A423FB6CDC200000D8DE"><enum>(c)</enum><header>Study Regarding
			 Mortgage Insurance Premiums</header><text>The Secretary of Housing and Urban
			 Development shall conduct a study regarding mortgage insurance premiums charged
			 under the program under section 255 of the <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C.
			 1715z–20</external-xref>) for insurance of home equity conversion mortgages to
			 analyze and determine—</text>
				<paragraph id="H9C67693DC3C1493BABF86298CBF9567"><enum>(1)</enum><text>the effects of
			 reducing the amounts of such premiums from the amounts charged as of the date
			 of the enactment of this Act on—</text>
					<subparagraph id="H519F56CF0FB440EEA22700C92C15DADC"><enum>(A)</enum><text>costs to
			 mortgagors; and</text>
					</subparagraph><subparagraph id="H797779A7FA8F4A929646EF479CEFBAA4"><enum>(B)</enum><text>the financial
			 soundness of the program; and</text>
					</subparagraph></paragraph><paragraph id="H36BF319895BE437E88B9F82CA321EB7"><enum>(2)</enum><text>the feasibility and
			 effectiveness of exempting, from all the requirements under the program
			 regarding payment of mortgage insurance premiums (including both up-front or
			 annual mortgage insurance premiums under section 203(c)(2) of such Act), any
			 mortgage insured under the program under which part or all of the amount of
			 future payments made to the homeowner are used for costs of a long-term care
			 insurance contract covering the mortgagor or members of the household residing
			 in the mortgaged property.</text>
				</paragraph><continuation-text continuation-text-level="subsection">Not later
			 than the expiration of the 12-month period beginning on the date of the
			 enactment of this Act, the Secretary shall submit a report to the Congress
			 setting forth the results and conclusions of the study.</continuation-text></subsection></section><section id="HC3AB01512D9F4ECFA1320245D887C2DC"><enum>15.</enum><header>Conforming loan
			 limit in disaster areas</header><text display-inline="no-display-inline">Section 203(h) of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709</external-xref>) is
			 amended—</text>
			<paragraph id="H5690BBD430F44AC5AED932F7744BD15D"><enum>(1)</enum><text>by inserting after
			 <quote>property</quote> the following: <quote>plus any initial service charges,
			 appraisal, inspection and other fees in connection with the mortgage as
			 approved by the Secretary,</quote>;</text>
			</paragraph><paragraph id="HBFEF8C5CF0EE46FB8D6908CFEBE9409B"><enum>(2)</enum><text>by striking the
			 second sentence (as added by chapter 7 of the Emergency Supplemental
			 Appropriations Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/211">Public Law
			 103–211</external-xref>; 108 Stat. 12)); and</text>
			</paragraph><paragraph id="HC9C19CC6CC00402D95F30657C4142F77"><enum>(3)</enum><text>by adding at the
			 end the following new sentence: <quote>In any case in which the single family
			 residence to be insured under this subsection is within a jurisdiction in which
			 the President has declared a major disaster to have occurred, the Secretary is
			 authorized, for a temporary period not to exceed 36 months from the date of
			 such Presidential declaration, to enter into agreements to insure a mortgage
			 which involves a principal obligation of up to 100 percent of the dollar
			 limitation determined under section 305(a)(2) of the
			 <act-name parsable-cite="FHLMCA">Federal Home Loan Mortgage Corporation
			 Act</act-name> for a single family residence, and not in excess of 100 percent
			 of the appraised value of the property plus any initial service charges,
			 appraisal, inspection and other fees in connection with the mortgage as
			 approved by the Secretary.</quote>.</text>
			</paragraph></section><section id="H34E41E68754D4A4986A1E694A9F7F982"><enum>16.</enum><header>Participation of
			 mortgage brokers and correspondent lenders</header>
			<subsection id="HCEDE8A73CEA24613B92CD6E8F02E0056"><enum>(a)</enum><header>Definitions</header>
				<paragraph id="H90CC922677604733BB975D47F0CCE74D"><enum>(1)</enum><header>In
			 general</header><text>Section 201 of the <act-name parsable-cite="NHA">National
			 Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707</external-xref>) is amended—</text>
					<subparagraph id="H753D678224474B9BBA33B539B622903F"><enum>(A)</enum><text>by striking
			 <quote>As used in section 203 of this title—</quote> and inserting <quote>As
			 used in this title and for purposes of participation in insurance programs
			 under this title, except as specifically provided otherwise, the following
			 definitions shall apply:</quote>;</text>
					</subparagraph><subparagraph id="HB8D1C1CC718D4B1990249129446E07FD"><enum>(B)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
						<quoted-block id="HFB8FCC77D40146E1A1D1ED85EED4004D" style="OLC">
							<paragraph id="H8BFADB5274EF43818C1F6DDA00486CD5"><enum>(2)</enum><text>The term
				<term>mortgagee</term> means any of the following entities, and its successors
				and assigns, to the extent such entity is approved by the Secretary:</text>
								<subparagraph id="HA4B55088F3EB47ADB85E862DF3565BC1"><enum>(A)</enum><text>A lender or
				correspondent lender, who—</text>
									<clause id="HCB5C8A9081DE4538B3DEBF7894351D8"><enum>(i)</enum><text>makes, underwrites,
				and services mortgages;</text>
									</clause><clause id="HF31D8D00DD104C5C9BC476E3689901B"><enum>(ii)</enum><text>submits to the
				Secretary such financial audits performed in accordance with the standards for
				financial audits of the Government Auditing Standards issued by the Comptroller
				of the United States;</text>
									</clause><clause id="H2253DAD6C0794DA1B629445C75E53358"><enum>(iii)</enum><text>meet the minimum
				net worth requirement that the Secretary shall establish; and</text>
									</clause><clause id="HE0744D3C94F84934AC0413ACA0FCA2C3"><enum>(iv)</enum><text>complies with
				such other requirements as the Secretary may establish.</text>
									</clause></subparagraph><subparagraph id="HA58488EEDAD64C168F548B66B18B4D87"><enum>(B)</enum><text>A correspondent
				lender who—</text>
									<clause id="HB88F65DED3964293A4C2445907E3A280"><enum>(i)</enum><text>closes a mortgage
				in its name but does not underwrite or service the mortgage;</text>
									</clause><clause id="H9F9F0B98D3BD473695B9E734830181B"><enum>(ii)</enum><text>posts a surety
				bond, in lieu of any requirement to provide audited financial statements or
				meet a minimum net worth requirement, in—</text>
										<subclause id="HD5BF899B21E848DD8BA02FC05F8929E"><enum>(I)</enum><text>a form satisfactory
				to the Secretary; and</text>
										</subclause><subclause id="H4CE6C09AD65B46F5950072E72413A599"><enum>(II)</enum><text>an amount of
				$75,000, as such amount is adjusted annually by the Secretary (as determined
				under regulations of the Secretary) by the change for such year in the Consumer
				Price Index for All Urban Consumers published monthly by the Bureau of Labor
				Statistics of the Department of Labor; and</text>
										</subclause></clause><clause id="H5820AAD50BA944B6846E15D6B78DBB58"><enum>(iii)</enum><text>complies with
				such other requirements as the Secretary may establish.</text>
									</clause></subparagraph><subparagraph id="H0232060BA1424A61AD02683EB54DE978"><enum>(C)</enum><text>A mortgage broker
				who—</text>
									<clause id="HA9DBE23A68784307875B00C395E1C709"><enum>(i)</enum><text>closes the
				mortgage in the name of the lender and does not make, underwrite, or service
				the mortgage;</text>
									</clause><clause id="H0A9F2A14F18E40CCA0FFCF8160A53684"><enum>(ii)</enum><text>is licensed,
				under the laws of the State in which the property that is subject to the
				mortgage is located, to act as a mortgage broker in such State;</text>
									</clause><clause id="H289ED076267F456EBDFDA012E3EE60E0"><enum>(iii)</enum><text>posts a surety
				bond in accordance with the requirements of subparagraph (B)(ii); and</text>
									</clause><clause id="H53667BE3E0BD4F309B6E1D516F3B9F20"><enum>(iv)</enum><text>complies with
				such other requirements as the Secretary may establish.</text>
									</clause></subparagraph></paragraph><paragraph id="H15F176D538B4406989F86819018BA34C"><enum>(3)</enum><text>The term
				<term>mortgagor</term> includes the original borrower under a mortgage and the
				successors and assigns of the original
				borrower.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H3B9C583364774EA981C04EC0CCA03108"><enum>(C)</enum><text>in subsection (a),
			 by redesignating clauses (1) and (2) as clauses (A) and (B) respectively;
			 and</text>
					</subparagraph><subparagraph id="H38A1E78AB27740CCB4BE73107A3734E"><enum>(D)</enum><text>by redesignating
			 subsections (a), (c), (d), (e), and (f) as paragraphs (1), (4), (5), (6), and
			 (7), respectively, and realigning such paragraphs two ems from the left
			 margin.</text>
					</subparagraph></paragraph><paragraph id="H0C9352BA919B4E64AB027E00B7F8A245"><enum>(2)</enum><header>Mortgagee
			 review</header><text>Section 202(c)(7) of the <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C.
			 1708(c)(7)</external-xref>) is amended—</text>
					<subparagraph id="H7D3406E6733D42ECA4A03D997E31A45F"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>, as defined in section 201,</quote> after
			 <quote>mortgagee</quote>;</text>

					</subparagraph></paragraph></subsection></section><section id="H6218975B6C3148C6B3FBEB8C1C3CDE"><enum>17.</enum><header>Sense of Congress
			 regarding technology for financial systems</header>
			<subsection id="H6E03CD1DDBA649B2BD4634F0D213FDA0"><enum>(a)</enum><header>Congressional
			 Findings</header><text>The Congress finds the following:</text>
				<paragraph id="HF37B26D26F8E4914BD8D20250619096B"><enum>(1)</enum><text>The Government
			 Accountability Office has cited the FHA single family housing mortgage
			 insurance program as a <quote>high-risk</quote> program, with a primary reason
			 being non-integrated and out-dated financial management systems.</text>
				</paragraph><paragraph id="H1ECA95A5F8AF4D24BAE232BAE2553ED"><enum>(2)</enum><text>The <quote>Audit of
			 the Federal Housing Administration’s Financial Statements for Fiscal Years 2004
			 and 2003</quote>, conducted by the Inspector General of the Department of
			 Housing and Urban Development reported as a material weakness that
			 <quote>HUD/FHA’s automated data processing [ADP] system environment must be
			 enhanced to more effectively support FHA’s business and budget
			 processes</quote>.</text>
				</paragraph><paragraph id="HC7C9002CC0CF4F8D8B6DBC844D679B34"><enum>(3)</enum><text>Existing
			 technology systems for the FHA program have not been updated to meet the latest
			 standards of the Mortgage Industry Standards Maintenance Organization and have
			 numerous deficiencies that lenders have outlined.</text>
				</paragraph><paragraph id="HD3036CA2948649169089FD9DCB8CA463"><enum>(4)</enum><text>Improvements to
			 technology used in the FHA program will—</text>
					<subparagraph id="H4ABE6A5C2F7348D09DFFD5E18DE3C7F"><enum>(A)</enum><text>allow the FHA
			 program to improve the management of the FHA portfolio, garner greater
			 efficiencies in its operations, and lower costs across the program; and</text>
					</subparagraph><subparagraph id="H2E13ECA0E3A948F28E007627DBB9467C"><enum>(B)</enum><text>result in
			 efficiencies and lower costs for lenders participating in the program, allowing
			 them to better use the FHA products in extending homeownership opportunities to
			 higher credit risk or lower-income families, in a sound manner.</text>
					</subparagraph></paragraph><paragraph id="H294C5ACE08DB4828A58FE637B9C13878"><enum>(5)</enum><text>The Mutual
			 Mortgage Insurance Fund operates without cost to the taxpayers and generates
			 revenues for the Federal Government.</text>
				</paragraph></subsection><subsection id="HD7875361059347BEB766E504427F64CC"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of the Congress that—</text>
				<paragraph id="HB709D4047A4C490896E1002EC123A259"><enum>(1)</enum><text>the Secretary of
			 Housing and Urban Development should use a portion of the funds received from
			 premiums paid for FHA single family housing mortgage insurance that are in
			 excess of the amounts paid out in claims to substantially increase the funding
			 for technology used in such FHA program;</text>
				</paragraph><paragraph id="HF4C8144BF1F747579ECDAC1134F9B3C3"><enum>(2)</enum><text>the goal of this
			 investment should be to bring the technology used in such FHA program to the
			 level and sophistication of the technology used in the conventional mortgage
			 lending market, or to exceed such level; and</text>
				</paragraph><paragraph id="H872FFCE9A41E4A4F00DEAD5504AFDA3D"><enum>(3)</enum><text>the Secretary of
			 Housing and Urban Development should report to the Congress not later than 180
			 days after the date of the enactment of this Act regarding the progress the
			 Department is making toward such goal and if progress is not sufficient, the
			 resources needed to make greater progress.</text>
				</paragraph></subsection></section><section id="H9E92CF592A654B6B81D1A22B2817541C"><enum>18.</enum><header>Savings
			 provision</header><text display-inline="no-display-inline">Any mortgage insured
			 under title II of the <act-name parsable-cite="NHA">National Housing
			 Act</act-name> before the date of enactment of this Act shall continue to be
			 governed by the laws, regulations, orders, and terms and conditions to which it
			 was subject on the day before the date of the enactment of this Act.</text>
		</section><section id="H5B94F6090D804C5F8F667F3E729573A8"><enum>19.</enum><header>Implementation</header><text display-inline="no-display-inline">The Secretary of Housing and Urban
			 Development shall by notice establish any additional requirements that may be
			 necessary to immediately carry out the provisions of this Act. The notice shall
			 take effect upon issuance.</text>
