		<official-title>To amend titles 17 and 18, United States Code, and the
		  Trademark Act of 1946 to strengthen and harmonize the protection of
		  intellectual property, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Intellectual Property Enforcement
			 Act of 2007</short-title></quote>.</text>
		</section><section id="id42838A8F77C74660A3825E9B49F0542E"><enum>2.</enum><header>Authorization of
			 civil copyright enforcement by Attorney General</header>
			<subsection id="id6E5B5EF11374402BB5077735139F2C56"><enum>(a)</enum><header>In
			 general</header><text>Chapter 5 of title 17, United States Code, is amended by
			 inserting after section 506 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB6A459F0CB9F4AD8A4D6A929BB4BD960" style="USC">
					<section id="idD2D0E25966824CB197DFFF33288F2794"><enum>506a.</enum><header>Civil
				penalties for violations of section 506</header>
						<subsection id="id9C211A1D227E46F4907FE67FC524782E"><enum>(a)</enum><header>In
				general</header><text>In lieu of a criminal action under section 506, the
				Attorney General may commence a civil action in the appropriate United States
				district court against any person who engages in conduct constituting an
				offense under section 506. Upon proof of such conduct by a preponderance of the
				evidence, such person shall be subject to a civil penalty under section 504
				which shall be in an amount equal to the amount which would be awarded under
				section 3663(a)(1)(B) of title 18 and restitution to the copyright owner
				aggrieved by the conduct.</text>
						</subsection><subsection id="idCD711BA696644372905E98F952444DD7"><enum>(b)</enum><header>Other
				remedies</header>
							<paragraph id="idF136422D88934F4C9598B96D484AD6AD"><enum>(1)</enum><header>In
				general</header><text>Imposition of a civil penalty under this section does not
				preclude any other criminal or civil statutory, injunctive, common law, or
				administrative remedy, which is available by law to the United States or any
				other person.</text>
							</paragraph><paragraph id="id1CCBDF20AED14811A37AA5645164E974"><enum>(2)</enum><header>Offset</header><text>Any
				restitution received by a copyright owner as a result of a civil action brought
				under this section shall be offset against any award of damages in a subsequent
				copyright infringement civil action by that copyright owner for the conduct
				that gave rise to the civil action brought under this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idA36EB881F22542919C77E5D7FCAC66C1"><enum>(b)</enum><header>Damages and
			 profits</header><text>Section 504 of title 17, United States Code, is
			 amended—</text>
				<paragraph id="id7095A33FBAC54BDB8E5624C76E8EFACB"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="id5B60B5109AEA47F0A7F37C8DF8AC0617"><enum>(A)</enum><text>in the first
			 sentence—</text>
						<clause id="idB5E508E724814676A0AEADA7ECD7316A"><enum>(i)</enum><text>by
			 inserting <quote>, or the Attorney General in a civil action,</quote> after
			 <quote>The copyright owner</quote>; and</text>
						</clause><clause id="id0FD36FAC43C54FE0A8FDC1F250060E81"><enum>(ii)</enum><text>by
			 striking <quote>him or her</quote> and inserting <quote>the copyright
			 owner</quote>; and</text>

			 sentence by inserting <quote>, or the Attorney General in a civil

					</subparagraph></paragraph><paragraph id="id0CEC8A9135B94D71A2894560E367886F"><enum>(2)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="id312EBF467C5C40B8B7909F04DC4D1243"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>, or the Attorney General in a civil action,</quote> after
			 <quote>the copyright owner</quote>; and</text>

					</subparagraph></paragraph></subsection><subsection id="id037301FD512D4D06808F07E703C90B31"><enum>(c)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 5 of title
			 17, United States Code, is amended by inserting after the item relating to
			 section 506 the following:</text>

			</subsection></section><section id="id927A59F6F46A453AB2CF1650C2CFDE38"><enum>3.</enum><header>Improved
			 investigative and forensic resources for enforcement of laws related to
			 intellectual property crimes</header>
			<subsection id="H638BFEAE65164C5888FA923B9DF2313C"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General, in consultation with the Director
			 of the Federal Bureau of Investigation, shall, with respect to crimes related
			 to the theft of intellectual property—</text>
				<paragraph id="H09416C91F00C4640B451B9B963C718B9"><enum>(1)</enum><text>create an
			 operational unit of the Federal Bureau of Investigation—</text>
					<subparagraph id="H6B367B2311FB496DA0A2C1C132070400"><enum>(A)</enum><text>to work with the
			 Computer Crime and Intellectual Property section of the Department of Justice
			 on the investigation and coordination of intellectual property crimes that are
			 complex, committed in more than 1 judicial district, or international;</text>
					</subparagraph><subparagraph id="HA2B7DD530E2F483396B3DD94B87571FF"><enum>(B)</enum><text>that consists of
			 at least 10 agents of the Bureau; and</text>
					</subparagraph><subparagraph id="H97897C7FB838427FB2DB1497BD025DB7"><enum>(C)</enum><text>that is located at
			 the headquarters of the Bureau;</text>
					</subparagraph></paragraph><paragraph id="H6440FA90CF204688B5D3C4B2C4A4DED9"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that any unit in the Department of
			 Justice responsible for investigating computer hacking or intellectual property
			 crimes is assigned at least 2 agents of the Federal Bureau of Investigation (in
			 addition to any agent assigned to such unit as of the date of the enactment of
			 this Act) to support such unit for the purpose of investigating or prosecuting
			 intellectual property crimes; and</text>
				</paragraph><paragraph id="HA74B189237184003A83920DFC5045F08"><enum>(3)</enum><text>implement a
			 comprehensive program—</text>
					<subparagraph id="HA1B10E8D5CFA4F8CB3564DF0269D15EE"><enum>(A)</enum><text display-inline="yes-display-inline">the purpose of which is to train agents of
			 the Federal Bureau of Investigation in the investigation and prosecution of
			 such crimes and the enforcement of laws related to intellectual property
			 crimes;</text>
					</subparagraph><subparagraph id="H99B3F48B440B4B469627D023F8B89BD6"><enum>(B)</enum><text display-inline="yes-display-inline">that includes relevant forensic training
			 related to investigating and prosecuting intellectual property crimes;
			 and</text>
					</subparagraph><subparagraph id="H04E545D464AE4B16B2A9DDA4FEFEBCBA"><enum>(C)</enum><text display-inline="yes-display-inline">that requires such agents who investigate
			 or prosecute intellectual property crimes to attend the program
			 annually.</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HDB3DDBA310D846ADB6B427399C7EC5D"><enum>(b)</enum><header>Intellectual
			 property law enforcement coordinators</header><text>Not later than 120 days
			 after the date of the enactment of this Act, the Attorney General shall assign
			 1 Federal prosecutor to the appropriate office of the Department of Justice
			 located in Hong Kong and 1 Federal prosecutor to such an office located in
			 Budapest, Hungary, to assist in the coordination of the enforcement of
			 intellectual property laws between the United States and foreign
			 nations.</text>
			</subsection><subsection id="HA517B996C2E34D4C82F99F90A16FE7D"><enum>(c)</enum><header>Organized crime
			 task force</header><text>Not later than 120 days after the date of the
			 enactment of this Act, the Attorney General, through the United States
			 Attorneys’ Offices, the Computer Crime and Intellectual Property section, and
			 the Organized Crime and Racketeering section of the Department of Justice, and
			 in consultation with the Federal Bureau of Investigation and other Federal law
			 enforcement agencies, shall create a Task Force to develop and implement a
			 comprehensive, long-range plan to investigate and prosecute international
			 organized crime syndicates engaging in or supporting crimes relating to the
			 theft of intellectual property.</text>
			</subsection><subsection id="H029E08513B5D40E59BC3F8D0859860E5"><enum>(d)</enum><header>Authorization</header><text>There
			 are authorized to be appropriated to carry out this section $12,000,000 for
			 each of fiscal years 2008 through 2011.</text>
			</subsection></section><section display-inline="no-display-inline" id="H9A90E871B560476C874DD6EEEBEB00CA"><enum>4.</enum><header>Additional
			 funding for resources to investigate and prosecute criminal activity involving
			 computers</header>
			<subsection id="HCA38C8EE513A4E47A394200041F2FEC2"><enum>(a)</enum><header>Additional
			 funding for resources</header>
				<paragraph id="HBD696B0E4DB04548A346B0D35E3D5C68"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">In addition to amounts otherwise authorized
			 for resources to investigate and prosecute criminal activity involving
			 computers, there are authorized to be appropriated for each of the fiscal years
			 2008 through 2011—</text>
					<subparagraph id="H0B5791E1739B43D1BB8FBC104F2C8F8"><enum>(A)</enum><text>$10,000,000 to the
			 Director of the Federal Bureau of Investigation; and</text>
					</subparagraph><subparagraph id="H00F6351AF3AF4090000008BF29361336"><enum>(B)</enum><text>$10,000,000 to the
			 Attorney General for the Criminal Division of the Department of Justice.</text>
					</subparagraph></paragraph><paragraph id="HD28D233BCB7B436EA26739D2EB75B9EB"><enum>(2)</enum><header>Availability</header><text>Any
			 amounts appropriated under
			 <internal-xref idref="HBD696B0E4DB04548A346B0D35E3D5C68" legis-path="9.(a)(1)">paragraph (1)</internal-xref> shall remain available
			 until expended.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H75D7776C566246E7B9BBD38D029B493D"><enum>(b)</enum><header>Use of
			 additional funding</header><text display-inline="yes-display-inline">Funds made
			 available under <internal-xref legis-path="9.(a)">subsection
			 (a)</internal-xref> shall be used by the Director of the Federal Bureau of
			 Investigation and the Attorney General, for the Federal Bureau of Investigation
			 and the Criminal Division of the Department of Justice, respectively,
			 to—</text>
				<paragraph id="HC8A95D7872FC46B990ABD0623740F4F7"><enum>(1)</enum><text display-inline="yes-display-inline">hire and train law enforcement officers
			 to—</text>
					<subparagraph id="H2469380CD8E9409999285300674BEE25"><enum>(A)</enum><text>investigate crimes
			 committed through the use of computers and other information technology,
			 including through the use of the Internet; and</text>
					</subparagraph><subparagraph id="HFC8205D985A24F878E06861F210163D"><enum>(B)</enum><text>assist in the
			 prosecution of such crimes; and</text>
					</subparagraph></paragraph><paragraph id="HFF24AEBF69774A53886F9C533D4CFD02"><enum>(2)</enum><text>procure advanced
			 tools of forensic science to investigate, prosecute, and study such
			 crimes.</text>
				</paragraph></subsection></section><section id="HE00E758F2F614A0B8261C3ECD9516B80" section-type="subsequent-section"><enum>5.</enum><header>Registration in civil
			 infringement actions</header>
			<subsection id="H49A72335407E4F5AAC493DBAC55872AF"><enum>(a)</enum><header>Limitation to
			 civil actions; harmless error</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/411">Section 411</external-xref> of title 17, United
			 States Code, is amended—</text>
				<paragraph id="HA29ADC7222174B20B5BDF53B3223D166"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="USC">civil</header-in-text></quote> before <quote><header-in-text level="section" style="USC">infringement</header-in-text></quote>;</text>
				</paragraph><paragraph id="HCB5DD52DF59D4608A2F151A8DCE3CD89"><enum>(2)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="HAB20CD1058324A9A8B4C244C504D4F07"><enum>(A)</enum><text>in the first
			 sentence, by striking <quote>no action</quote> and inserting <quote>no civil
			 action</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="H06D3145742E54D769CDA95C897E4DA5B"><enum>(B)</enum><text>in the second

					<subparagraph id="H6CA4FA4AD95246EEA0ECFFAE2C81BF8C"><enum>(A)</enum><text>by redesignating
			 that subsection as subsection (c); and</text>
					</subparagraph><subparagraph id="H7F73ABB12EAE498F9DBF79CA2EC4354F"><enum>(B)</enum><text>by striking
			 <quote>506 and sections 509 and</quote> and inserting <quote>505 and

				requirements of this section and section 412, regardless of whether the
				certificate contains any inaccurate information, unless—</text>
								<subparagraph id="H2A2E82C5BB2F429D877F661F5260B3A6" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the inaccurate information was included on
				the application for copyright registration with knowledge that it was
				inaccurate; and</text>
								</subparagraph><subparagraph id="H18C14D3063304F8900EBF9A0ACC6E93E" indent="up1"><enum>(B)</enum><text>the inaccurate information, if known,
				would have caused the Register of Copyrights to refuse registration.</text>
								</subparagraph></paragraph><paragraph id="H1452C936AF2F4328B2D0B2E89430123" indent="up1"><enum>(2)</enum><text>In any case in which inaccurate
				information described under paragraph (1) is alleged, the court shall request
				the Register of Copyrights to advise the court whether the inaccurate
				information, if known, would have caused the Register of Copyrights to refuse
				registration.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE93C42B499F042C5BD3D0062769F00A"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
				<paragraph id="H56B9272CF6EB4389B010F355C085D5C4"><enum>(1)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/412">Section 412</external-xref> of title 17, United
			 States Code, is amended by striking ‘‘411(b)’’ and inserting ‘‘411(c)’’.</text>
				</paragraph><paragraph id="HE7EAE0DE298945F18E45614B64D1539"><enum>(2)</enum><text>The item relating
			 to section 411 in the table of sections for
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/17/4">chapter
			 4</external-xref> of title 17, United States Code, is amended to read as

			 for infringement</header>
			<subsection id="id62BA7EAE2F114BCCACE0BB61F7569AAB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 503(a) of
			 title 17, United States Code, is amended—</text>
				<paragraph id="H21BE6488F9D14D44BD66D9556E576625"><enum>(1)</enum><text>by striking
			 <quote>and of all plates</quote> and inserting <quote>, of all plates</quote>;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBAEF8B9FC6384DF3BD71B5646949B782"><enum>(2)</enum><text>by striking the
			 period and inserting <quote>, and of records documenting the manufacture, sale,
			 or receipt of things involved in such violation. The court shall enter an
			 appropriate protective order with respect to discovery of any records that have
			 been seized. The protective order shall provide for appropriate procedures to
			 assure that confidential information contained in such records is not
			 improperly disclosed to any party.</quote>.</text>
				</paragraph></subsection><subsection id="id67A5E2F0C739413F80B63ADDF74676EB"><enum>(b)</enum><header>Protective
			 orders for seized records</header><text display-inline="yes-display-inline">Section 34(d)(1)(A) of the Act entitled
			 <quote>An Act to provide for the registration and protection of trademarks used
			 in commerce, to carry out the provisions of certain international conventions,
			 and for other purposes.</quote>, approved July 5, 1946 (commonly referred to as
			 the Trademark Act of 1946) (15 U.S.C. 1116(d)(1)(A)) is amended by adding
			 <quote>The court shall enter an appropriate protective order with respect to
			 discovery of any records that have been seized. The protective order shall
			 provide for appropriate procedures to assure that confidential information
			 contained in such records is not improperly disclosed to any party.</quote>
			 after the first sentence.</text>
			</subsection></section><section id="id135EB3A4A7E84A1C8A4751F56D0E6E34"><enum>7.</enum><header>Criminal
			 infringement</header>
			<subsection id="H8431E5AEB5E045A48366C1FDEE0074CF"><enum>(a)</enum><header>Forfeiture and
			 destruction; restitution</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/506">Section 506(b)</external-xref> of title 17, United
			 States Code, is amended to read as follows:</text>

					<subsection id="HF90D62CEF73D45BD8770722278ABA1F2"><enum>(b)</enum><header>Forfeiture,

			 forfeitures</header>

			 509 of title 17, United States Code, is repealed.</text>
				</paragraph><paragraph id="id5AA4CBA43D754DBCB7A2441B9ECDABCF"><enum>(2)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 5 of title
			 17, United States Code, is amended by striking the item relating to section
			 509.</text>
				</paragraph></subsection></section><section id="id5774108214DA462682933E780BBCAEC5"><enum>8.</enum><header>Importation and
			 exportation</header>
			<subsection id="H500432ED3116494A8314DDB191B4F9AC"><enum>(a)</enum><header>Importation and
			 exportation of infringing items</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/602">Section 602(a)</external-xref> of title 17, United
			 States Code, is amended—</text>

			 paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C);</text>

				to—</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB3C0E6F6870B4234BFBCE4ADC2BD7DDB"><enum>(5)</enum><text>in subparagraph
			 (A), as redesignated, by inserting <quote>or exportation</quote> after
			 <quote>importation</quote>;</text>

						<subsection id="H043E20E677304F87AC0076C2750837F5"><enum>(a)</enum><header>Civil
				forfeiture</header>
							<paragraph id="HE815407A54FA4DC399E1F942A58D561B"><enum>(1)</enum><header>Property subject
				to forfeiture</header><text>The following property is subject to forfeiture to
				the United States:</text>
								<subparagraph id="H4949810CA7154B57845B12159E5F7D91"><enum>(A)</enum><text display-inline="yes-display-inline">Any article the making or trafficking of
				which is prohibited under section 506 or 1204 of title 17, or section 2318,
				2319, 2319A, 2319B, or 2320, or chapter 90, of this title.</text>
								</subparagraph><subparagraph id="H1306C4FE725143240087556F0400CD1B"><enum>(B)</enum><text display-inline="yes-display-inline">Any property used, or intended to be used,
				in any manner or part to commit or facilitate the commission of an offense
				referred to in subparagraph (A).</text>
								</subparagraph><subparagraph id="H8D261DE7762041BC808EF15802919641"><enum>(C)</enum><text>Any property
				constituting or derived from any proceeds obtained directly or indirectly as a
				result of the commission of an offense referred to in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="HE97C557FE1C343A49F4641F082B6895F"><enum>(2)</enum><header>Procedures</header><text>The
				provisions of chapter 46 relating to civil forfeitures shall extend to any
				seizure or civil forfeiture under this section. At the conclusion of the
				forfeiture proceedings, unless otherwise requested by an agency of the United
				States, the court shall order that any property forfeited under paragraph (1)
				be destroyed, or otherwise disposed of according to law.</text>
							</paragraph></subsection><subsection id="H2B61BD2DD7E948D494B9B0C65599F632"><enum>(b)</enum><header>Criminal
				forfeiture</header>
							<paragraph id="HC82B228B78A04FADAF00F2F3C64EAAF"><enum>(1)</enum><header>Property subject
				to forfeiture</header><text display-inline="yes-display-inline">The court, in
				imposing sentence on a person convicted of an offense under section 506 or 1204
				of title 17, or section 2318, 2319, 2319A, 2319B, or 2320, or chapter 90, of
				this title, shall order, in addition to any other sentence imposed, that the
				person forfeit to the United States any property subject to forfeiture under
				subsection (a) for that offense.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H9EF3D596E5D046F1B4A900163E19D8CD"><enum>(2)</enum><header>Procedures</header>
								<subparagraph id="H4E966F823B2243DD8F54BA6DF59CD683"><enum>(A)</enum><header>In
				general</header><text>The forfeiture of property under paragraph (1), including
				any seizure and disposition of the property and any related judicial or
				administrative proceeding, shall be governed by the procedures set forth in
				section 413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970
				(<external-xref legal-doc="usc" parsable-cite="usc/21/853">21 U.S.C.
				853</external-xref>), other than subsection (d) of that section.</text>
								</subparagraph><subparagraph id="HBE9E050C838E480180153F879074009D"><enum>(B)</enum><header>Destruction</header><text>At
				the conclusion of the forfeiture proceedings, the court, unless otherwise
				requested by an agency of the United States—</text>
									<clause commented="no" id="H522F4AE1300046468E5D94769DB98800"><enum>(i)</enum><text display-inline="yes-display-inline">shall order that any forfeited article or
				component of an article bearing or consisting of a counterfeit mark be
				destroyed or otherwise disposed of according to law; and</text>
									</clause><clause id="H722C7476AEAA4C428891745B121E2931"><enum>(ii)</enum><text>shall order that
				any infringing items or other property described in subsection (a)(1)(A) and
				forfeited under paragraph (1) of this subsection be destroyed or otherwise
				disposed of according to law.</text>
									</clause></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HB6A86506B5DD435AB100B34297614E54"><enum>(c)</enum><header>Restitution</header><text display-inline="yes-display-inline">When a person is convicted of an offense
				under section <external-xref legal-doc="usc" parsable-cite="usc/17/506">506</external-xref> or
				<external-xref legal-doc="usc" parsable-cite="usc/17/1204">1204</external-xref>
				of title 17 or section 2318, 2319, 2319A, 2319B, or 2320, or chapter 90, of
				this title, the court, pursuant to sections 3556, 3663A, and 3664 of this
				title, shall order the person to pay restitution to any victim of the offense
				as an offense against property referred to in section 3663A(c)(1)(A)(ii) of
				this
				title.</text>
