			<paragraph id="HAA971E52FE8D4534A7176E1F7C6EF51E"><enum>(1)</enum><text display-inline="yes-display-inline">Communities nationwide are struggling to
			 respond to the high numbers of people with mental illnesses involved at all
			 points in the criminal justice system.</text>
			</paragraph><paragraph id="H26287A549EBC4AF2B7A9D8F6A426C3D4"><enum>(2)</enum><text display-inline="yes-display-inline">A 1999 study by the Department of Justice
			 estimated that 16 percent of people incarcerated in prisons and jails in the
			 United States, which is more than 300,000 people, suffer from mental
			 illnesses.</text>
			</paragraph><paragraph id="H97FF5CECC0024C6E99AD77B5368958F"><enum>(3)</enum><text display-inline="yes-display-inline">Los Angeles County Jail and New York’s
			 Rikers Island jail complex hold more people with mental illnesses than the
			 largest psychiatric inpatient facilities in the United States.</text>
			</paragraph><paragraph id="HAE9999410AA44D758E5E3B8E3F6EAA63"><enum>(4)</enum><text display-inline="yes-display-inline">State prisoners with a mental health
			 problem are twice as likely as those without a mental health problem to have
			 been homeless in the year before their arrest.</text>

			 of the Adult and Juvenile Collaboration Program Grants</header>
			<subsection commented="no" id="HFFFDC870FB344015B92BAC6296A1DF98"><enum>(a)</enum><header>Authorization of
			 appropriations through 2013</header><text display-inline="yes-display-inline">Section 2991(h) of title I of the Omnibus
			 Crime Control and Safe Streets Act of 1968 is amended—</text>
				<paragraph commented="no" id="HA025996B7168464BADCE08EC34058C00"><enum>(1)</enum><text>in paragraph (1),
			 by striking at the end <quote>and</quote>;</text>
				</paragraph><paragraph commented="no" id="H8163E8E752CD4D40979E76B599252F21"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>for fiscal years 2006 through 2009.</quote> and inserting
			 <quote>for each of the fiscal years 2006 and 2007; and</quote>; and</text>
				</paragraph><paragraph commented="no" id="HD19CA55AA89A417CB97DE72EA05D4B27"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>

			 paragraphs (1), (2), and (3) (as added by subsection (a)(3)) as subparagraphs
			 (A), (B), and (C), respectively;</text>

			 <quote>There are authorized</quote> and inserting <quote>(1)

				</paragraph></subsection><subsection commented="no" id="id3F221B7C284E4B5E911D1CBAB876C592"><enum>(c)</enum><header>Additional
			 applications receiving priority</header><text>Subsection (c) of such section is
			 amended to read as follows:</text>

				Attorney General, in awarding funds under this section, shall give priority to
				applications that—</text>
						<paragraph commented="no" id="idB167A46926644926B733B96AB51CB11F"><enum>(1)</enum><text>promote effective
				strategies by law enforcement to identify and to reduce risk of harm to
				mentally ill offenders and public safety;</text>
						</paragraph><paragraph commented="no" id="id0689ED16F74A43C4A15039DDFD50019A"><enum>(2)</enum><text>promote effective
				strategies for identification and treatment of female mentally ill offenders;
				or</text>
						</paragraph><paragraph commented="no" id="id96FB413D32A0472B88394467D098BDDC"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id65CB4170FE5147FBB660732910DED908"><enum>(A)</enum><text>demonstrate the
				strongest commitment to ensuring that such funds are used to promote both
				public health and public safety;</text>
							</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSJU00" id="id2A4F39BA44264AC99C9BF599C8144A08" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>demonstrate the
				active participation of each co-applicant in the administration of the
				collaboration program;</text>
							</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSJU00" id="idB6AF1EA89640444A81DC98E38747B7E5" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text>document, in the
				case of an application for a grant to be used in whole or in part to fund
				treatment services for adults or juveniles during periods of incarceration or
				detention, that treatment programs will be available to provide transition and
				reentry services for such individuals; and</text>
							</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSJU00" id="id689705328A8740C99EF61390D68CAB6C" indent="up1" reported-display-style="strikethrough"><enum>(D)</enum><text>have the support
				of both the Attorney General and the
				Secretary.</text>

			 response to mentally ill offenders improvement grants</header>
			<subsection id="H01D754CED0FE4F0B850064002D9CA774"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part HH of title I of
			 the Omnibus Crime Control and Safe Streets Act of 1968 is amended by adding at
			 the end the following new section:</text>

					<section id="H5EE301FBC6E5465FA6B43C59FCA12CE8"><enum>2992.</enum><header>Law
				enforcement response to mentally ill offenders improvement grants</header>
						<subsection id="H9A89D92D65F14995BD964973C5E86E1"><enum>(a)</enum><header>Authorization</header><text>The
				Attorney General is authorized to make grants to States, units of local
				government, Indian tribes, and tribal organizations for the following
				purposes:</text>
							<paragraph id="H39803DC342E6443C804E9195131B31F9"><enum>(1)</enum><header>Training
				programs</header><text>To provide for programs that offer law enforcement
				personnel specialized and comprehensive training in procedures to identify and
				respond appropriately to incidents in which the unique needs of individuals
				with mental illnesses are involved.</text>
							</paragraph><paragraph id="H4C116C9E0AC54332B1FC6EDD26DBF78B"><enum>(2)</enum><header>Receiving
				centers</header><text>To provide for the development of specialized receiving
				centers to assess individuals in the custody of law enforcement personnel for
				mental health and substance abuse treatment needs.</text>
							</paragraph><paragraph id="HD4513428CAB4404BA341DA4EB6065ECB"><enum>(3)</enum><header>Improved
				technology</header><text>To provide for computerized information systems (or to
				improve existing systems) to provide timely information to law enforcement
				personnel and criminal justice system personnel to improve the response of such
				respective personnel to mentally ill offenders.</text>
							</paragraph><paragraph id="idE31F8108F3BE4D7DA089A1AA07CBE0B1"><enum>(4)</enum><header>Cooperative
				programs</header><text>To provide for the establishment and expansion of
				cooperative efforts by criminal and juvenile justice agencies and mental health
				agencies to promote public safety through the use of effective intervention
				with respect to mentally ill offenders.</text>
							</paragraph><paragraph id="H2038850A586B4294897FF35C7E742995"><enum>(5)</enum><header>Campus security
				personnel training</header><text display-inline="yes-display-inline">To provide
				for programs that offer campus security personnel training in procedures to
				identify and respond appropriately to incidents in which the unique needs of
				individuals with mental illnesses are involved.</text>
							</paragraph></subsection><subsection commented="no" id="HADBE363FB170407000B8CEC8001D56"><enum>(b)</enum><header>BJA training
				models</header><text display-inline="yes-display-inline">For purposes of
				subsection (a)(1), the Director of the Bureau of Justice Assistance shall
				develop training models for training law enforcement personnel in procedures to
				identify and respond appropriately to incidents in which the unique needs of
				individuals with mental illnesses are involved.</text>
						</subsection><subsection id="HC492423F023A42B788E959A25F68B6E1"><enum>(c)</enum><header>Matching
				funds</header><text display-inline="yes-display-inline">The Federal share of
				funds for a program funded by a grant received under this section may not
				exceed 75 percent of the costs of the program unless the Attorney General
				waives, wholly or in part, such funding limitation. The non-Federal share of
				payments made for such a program may be made in cash or in-kind fairly
				evaluated, including planned equipment or services.</text>
						</subsection><subsection id="HC5A46C07B5D34D3A94F4F9C100D611ED"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to the
				Department of Justice to carry out this section $10,000,000 for each of the
				fiscal years 2008 through
				2013.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC2896BDC83C144179CF75EB994778FA5"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Such part is further amended by amending the part
			 heading to read as follows: <quote><header-in-text level="part" style="OLC">Grants to improve treatment of offenders with mental
			 illnesses</header-in-text></quote>.</text>

			 mental health courts grant program</header>
			<subsection commented="no" id="HD5F9D729DE5B45B5989373DA4611C0D2"><enum>(a)</enum><header>Reauthorization
			 of the mental health courts grant program</header><text display-inline="yes-display-inline">Section 1001(a)(20) of title I of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3793(a)(20)) is
			 amended by striking <quote>fiscal years 2001 through 2004</quote> and inserting
			 <quote>fiscal years 2008 through 2013</quote>.</text>
			</subsection><subsection commented="no" id="HF714317242CB43A39BDA2DFF9BC2E400"><enum>(b)</enum><header>Additional grant
			 uses authorized</header><text>Section 2201 of such title (42 U.S.C. 3796ii) is
			 amended—</text>
				<paragraph commented="no" id="HB2CF378E5FB1426BB184512C1879FD56"><enum>(1)</enum><text>in paragraph (1)
			 at the end, by striking <quote>and</quote>;</text>
				</paragraph><paragraph commented="no" id="H7D1C4EEB07334F699B9325147FEAC1CF"><enum>(2)</enum><text>in paragraph (2)
			 at the end, by striking the period and adding <quote>; and</quote>; and</text>
				</paragraph><paragraph commented="no" id="HF6700F729C634CA6B519C7F906AEE35F"><enum>(3)</enum><text>by adding at the
			 end the following new paragraphs:</text>

				offenders with mental

				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSJU00" id="HEA4F8649A50D403D9FA59F32ABDFE128" reported-display-style="strikethrough"><enum>6.</enum><header>Study and report
			 on prevalence of mentally ill offenders</header>
			<subsection commented="no" id="H60DF96C192734E258E6F328860D30594"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Attorney General shall provide for a
			 study of the following:</text>
				<paragraph commented="no" id="H3C450B154D204B7D9EB000FAD9F5ADC5"><enum>(1)</enum><text>The rate of
			 occurrence of serious mental illnesses in each of the following
			 populations:</text>
					<subparagraph commented="no" id="H0E636928E02A426300515D1D997700FB"><enum>(A)</enum><text display-inline="yes-display-inline">Individuals, including juveniles, on
			 probation.</text>
					</subparagraph><subparagraph commented="no" id="HC21C7FA37D1C48718DB0586256B8C075"><enum>(B)</enum><text display-inline="yes-display-inline">Individuals, including juveniles,
			 incarcerated in a jail.</text>
					</subparagraph><subparagraph commented="no" id="HC8FCFB8AF4F84AF3991D45FC81593003"><enum>(C)</enum><text display-inline="yes-display-inline">Individuals, including juveniles,
			 incarcerated in a prison.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB9300E5DD5204BC3B5F22F390080341E"><enum>(D)</enum><text display-inline="yes-display-inline">Individuals, including juveniles, on
			 parole.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H6A93FAF7BDD84730B8B95D23CD063099"><enum>(2)</enum><text display-inline="yes-display-inline">For each population described in paragraph
			 (1), the percentage of individuals with serious mental illnesses who, at the
			 time of the arrest, are eligible to receive Supplemental Security Income
			 benefits, Social Security Disability Insurance benefits, or medical assistance
			 under a State plan for medical assistance under title XIX of the Social
			 Security Act.</text>
				</paragraph><paragraph commented="no" id="HAA56E206EB9A46DCACF2AFD6FE7DB32C"><enum>(3)</enum><text>For each such
			 population, with respect to a year, the percentage of individuals with serious
			 mental illnesses who—</text>
					<subparagraph id="H5293D56E19CA466290C9F3EC7E72791D"><enum>(A)</enum><text>were homeless (as
			 defined in section 103 of the <short-title>McKinney-Vento
			 Homeless Assistance Act </short-title>(42 U.S.C. 11302)) at the time of arrest;
			 and</text>
					</subparagraph><subparagraph id="HC3230997589E4C6495ACDE904085B101"><enum>(B)</enum><text>were homeless (as
			 so defined) during any period in the previous year.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H90D846D3FB694F10BAD3E8C26D14881B"><enum>(b)</enum><header>Report</header><text>Not
			 later than 18 months after the date of the enactment of this Act, the Attorney
			 General shall submit to Congress a report on the results of the study under
			 subsection (a).</text>
			</subsection><subsection commented="no" id="HB3E8758D036A422FBE284BFA3B96B8BF"><enum>(c)</enum><header>Definition of
			 serious mental illness</header><text>For purposes of this section, the term
			 <term>serious mental illness</term> has the meaning given such term for
			 purposes of title V of the Public Health Service Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HAAEC68D97E8D4EEEA3E516AF96BC237"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this section $2,000,000 for
			 2008.</text>

			 estimated that 16 percent of people incarcerated in prisons and jails in the
			 United States, which is more than 300,000 people, suffer from mental
			 illnesses.</text>
			</paragraph><paragraph id="id5b67c5d5-a43e-476c-8632-af9950b85db0"><enum>(3)</enum><text display-inline="yes-display-inline">Los Angeles County Jail and New York’s
			 Rikers Island jail complex hold more people with mental illnesses than the
			 largest psychiatric inpatient facilities in the United States.</text>
			</paragraph><paragraph id="id9e9e00bf-2b35-41fb-bdae-9699b0b2be67"><enum>(4)</enum><text display-inline="yes-display-inline">State prisoners with a mental health
			 problem are twice as likely as those without a mental health problem to have
			 been homeless in the year before their arrest.</text>
			</paragraph></section><section changed="added" commented="no" committee-id="SSJU00" id="idd52f0ef4-ea4e-4648-849a-7f85d247b330" reported-display-style="italic"><enum>3.</enum><header>Reauthorization of the
			 Adult and Juvenile Collaboration Program Grants</header>
			<subsection commented="no" id="id0f535e8c-4bb5-48dc-8040-bdafefaa68e0"><enum>(a)</enum><header>Authorization of
			 appropriations through 2014</header><text display-inline="yes-display-inline">Section 2991(h) of title I of the Omnibus
			 Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3793aa(h)) is
			 amended—</text>
				<paragraph commented="no" id="iddbdd657e-1cbd-47dd-b6cc-d4720eb1d71b"><enum>(1)</enum><text>in paragraph (1), by
			 striking at the end <quote>and</quote>;</text>
				</paragraph><paragraph commented="no" id="id8f226425-85f2-4347-bb8f-7210e72046f7"><enum>(2)</enum><text>in paragraph (2), by
			 striking <quote>for fiscal years 2006 through 2009.</quote> and inserting
			 <quote>for each of the fiscal years 2006 and 2007; and</quote>; and</text>
				</paragraph><paragraph commented="no" id="id11e02c2e-da3b-4c89-bae8-b8f10314fea0"><enum>(3)</enum><text>by adding at the end the

			 are authorized</quote> and inserting <quote>(1)

				</paragraph></subsection><subsection commented="no" id="id46ebf7ee-3b67-44b3-886e-a8f197daf375"><enum>(c)</enum><header>Additional applications
			 receiving priority</header><text>Subsection (c) of such section is amended to
			 read as follows:</text>

				Attorney General, in awarding funds under this section, shall give priority to
				applications that—</text>
						<paragraph commented="no" id="id271382f6-313c-4187-8a4c-21af4edaa851"><enum>(1)</enum><text>promote effective
				strategies by law enforcement to identify and to reduce risk of harm to
				mentally ill offenders and public safety;</text>
						</paragraph><paragraph commented="no" id="idff02e983-ee9f-49cb-9754-3c4d3d09db2f"><enum>(2)</enum><text>promote effective
				strategies for identification and treatment of female mentally ill offenders;
				or</text>
						</paragraph><paragraph commented="no" id="id6f870fb1-8da3-4f3e-ba36-6b267e6dc414"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9c602b28-a96e-47ab-911a-955aeaf6849b"><enum>(A)</enum><text>demonstrate the
				strongest commitment to ensuring that such funds are used to promote both
				public health and public safety;</text>
							</subparagraph><subparagraph changed="added" commented="no" committee-id="SSJU00" id="idd3611894-bdd1-4061-a335-e71ab091d81c" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>demonstrate the active
				participation of each co-applicant in the administration of the collaboration
				program;</text>
							</subparagraph><subparagraph changed="added" commented="no" committee-id="SSJU00" id="iddaad81e9-db2e-47d3-8a84-745a07b87332" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>document, in the case of
				an application for a grant to be used in whole or in part to fund treatment
				services for adults or juveniles during periods of incarceration or detention,
				that treatment programs will be available to provide transition and reentry
				services for such individuals; and</text>
							</subparagraph><subparagraph changed="added" commented="no" committee-id="SSJU00" id="id06deb4c7-d552-40e8-86b6-6b00abb52e55" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>have the support of both
				the Attorney General and the
				Secretary.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 to mentally ill offenders improvement grants</header>
			<subsection id="id251076cb-7039-4205-87ee-16c3d75ca7db"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part HH of title I of
			 the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797aa) is
			 amended by adding at the end the following new section:</text>
				<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idb79aa569-f21e-44a1-82ff-d14022fc4725" reported-display-style="italic" style="OLC">
					<section id="id644f0e37-33b2-47f6-98f2-20709e7708cf"><enum>2992.</enum><header>Law enforcement
				response to mentally ill offenders improvement grants</header>
						<subsection id="id1602d7dc-b62f-4e12-a35e-35111f10c641"><enum>(a)</enum><header>Authorization</header><text>The
				Attorney General is authorized to make grants to States, units of local
				government, Indian tribes, and tribal organizations for the following
				purposes:</text>
							<paragraph id="id70c28582-9607-48a1-b012-c1e9d5564bf3"><enum>(1)</enum><header>Training
				programs</header><text>To provide for programs that offer law enforcement
				personnel specialized and comprehensive training in procedures to identify and
				respond appropriately to incidents in which the unique needs of individuals
				with mental illnesses are involved.</text>
							</paragraph><paragraph id="ID57639d917adf4322a42b35706fcdb220"><enum>(2)</enum><header>Receiving
				centers</header><text>To provide for the development of specialized receiving
				centers to assess individuals in the custody of law enforcement personnel for
				suicide risk and mental health and substance abuse treatment needs.</text>
							</paragraph><paragraph id="id8c8f5a83-90e9-4fa0-aaee-4a585c593782"><enum>(3)</enum><header>Improved
				technology</header><text>To provide for computerized information systems (or to
				improve existing systems) to provide timely information to law enforcement
				personnel and criminal justice system personnel to improve the response of such
				respective personnel to mentally ill offenders.</text>
							</paragraph><paragraph id="id40a07bbf-6786-41de-8a52-7bfa5471d3a7"><enum>(4)</enum><header>Cooperative
				programs</header><text>To provide for the establishment and expansion of
				cooperative efforts by criminal and juvenile justice agencies and mental health
				agencies to promote public safety through the use of effective intervention
				with respect to mentally ill offenders.</text>
							</paragraph><paragraph id="id9a758699-3c5e-488c-80d1-3188d8b908f2"><enum>(5)</enum><header>Campus security
				personnel training</header><text display-inline="yes-display-inline">To provide
				for programs that offer campus security personnel training in procedures to
				identify and respond appropriately to incidents in which the unique needs of
				individuals with mental illnesses are involved.</text>
							</paragraph></subsection><subsection commented="no" id="id2f6cb42a-2446-4f17-a2ee-7e89efb310cf"><enum>(b)</enum><header>BJA training
				models</header><text display-inline="yes-display-inline">For purposes of
				subsection (a)(1), the Director of the Bureau of Justice Assistance shall
				develop training models for training law enforcement personnel in procedures to
				identify and respond appropriately to incidents in which the unique needs of
				individuals with mental illnesses are involved, including suicide
				prevention.</text>
						</subsection><subsection id="ide7cc5374-f937-470a-8ede-91997a9ac033"><enum>(c)</enum><header>Matching
				funds</header><text display-inline="yes-display-inline">The Federal share of
				funds for a program funded by a grant received under this section may not
				exceed 75 percent of the costs of the program unless the Attorney General
				waives, wholly or in part, such funding limitation. The non-Federal share of
				payments made for such a program may be made in cash or in-kind fairly
				evaluated, including planned equipment or services.</text>
						</subsection><subsection id="idc618db45-43ec-417f-9239-bd6f54b912aa"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to the
				Department of Justice to carry out this section $10,000,000 for each of the
				fiscal years 2009 through
				2014.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id3643f986-b926-4e3a-9def-a8aafacdcfab"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Such part is further amended by amending the part
			 heading to read as follows: <quote><header-in-text level="part" style="OLC">Grants to improve treatment of offenders with mental
			 illnesses</header-in-text></quote>.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSJU00" id="id719f4acc-1579-454d-a889-0405752515b2" reported-display-style="italic"><enum>5.</enum><header>Improving the mental
			 health courts grant program</header>
			<subsection commented="no" id="id14c39c5e-7373-43f3-8c9a-3eabd4ce8c33"><enum>(a)</enum><header>Reauthorization of the
			 mental health courts grant program</header><text display-inline="yes-display-inline">Section 1001(a)(20) of title I of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3793(a)(20)) is
			 amended by striking <quote>fiscal years 2001 through 2004</quote> and inserting
			 <quote>fiscal years 2009 through 2014</quote>.</text>
			</subsection><subsection commented="no" id="ida8f95bfc-38a5-4c5f-8499-97877338df68"><enum>(b)</enum><header>Additional grant uses
			 authorized</header><text>Section 2201 of such title (42 U.S.C. 3796ii) is
			 amended—</text>
				<paragraph commented="no" id="id11fe2a03-433a-4205-baf6-9ee27d72eb4f"><enum>(1)</enum><text>in paragraph (1), by
			 striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" id="id77c1eab9-9066-4876-88a0-8df7169e2105"><enum>(2)</enum><text>in paragraph (2) by
			 striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph commented="no" id="id17069664-35b8-4ce5-82e9-551f93e03977"><enum>(3)</enum><text>by adding at the end the
			 following new paragraphs:</text>

				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSJU00" id="id6950b603-8e10-4a40-8d35-5f144d534a86" reported-display-style="italic"><enum>6.</enum><header>Examination and report
			 on prevalence of mentally ill offenders</header>
			<subsection id="IDb2baac32cde349c3a1583079ecd54650"><enum>(a)</enum><header>In general</header>
				<paragraph id="id0FE508D175FD45AE805EF589696F2C80"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall examine and report on mental
			 illness and the criminal justice system.</text>
				</paragraph><paragraph id="idB103B30079FD4EC292749F4A5A3DCB48"><enum>(2)</enum><header>Scope</header><text>Congress
			 encourages the Attorney General to specifically examine the following:</text>
					<subparagraph id="IDcdd911418068411a8dfaaa0d79015bb8"><enum>(A)</enum><header>Populations</header><text>The
			 rate of occurrence of serious mental illnesses in each of the following
			 populations:</text>
						<clause id="ID2e7dd83465f84de2871c81f1720aab3c"><enum>(i)</enum><text>Individuals, including
			 juveniles, on probation.</text>
						</clause><clause id="ID86535dc9b65e4470a896fded94c1ffc4"><enum>(ii)</enum><text>Individuals, including
			 juveniles, incarcerated in a jail.</text>
						</clause><clause id="ID99deb6596c424a4c8352b8a6465319bb"><enum>(iii)</enum><text>Individuals, including
			 juveniles, incarcerated in a prison.</text>
						</clause><clause id="ID0a1a1ed2810a4187853d8f122722d147"><enum>(iv)</enum><text>Individuals, including
			 juveniles, on parole.</text>
						</clause></subparagraph><subparagraph id="ID05efa116e8d24a2c8f3f05169af4ab8e"><enum>(B)</enum><header>Benefits</header><text>The
			 percentage of individuals in each population described in subparagraph (A) who
			 have—</text>
						<clause id="idCD2D7596498644C3937899FA023B61CD"><enum>(i)</enum><text>a serious mental illness;
			 and</text>
						</clause><clause id="id1AABA59ACDFF48509072E34C514B033D"><enum>(ii)</enum><text>received disability
			 benefits under title II or title XVI of the Social Security Act (42 U.S.C. 401
			 et seq. and 1381 et seq.).</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="id5235ebbc-eae4-4f81-9c48-d4b3f95199fb"><enum>(b)</enum><header>Report</header><text>Not
			 later than 36 months after the date of the enactment of this Act, the Attorney
			 General shall submit to Congress the report described in subsection (a).</text>
			</subsection><subsection commented="no" id="id59577D86B5744F5BBA6DB00F437B2C37"><enum>(c)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph commented="no" id="idB944DAA8629B43A19AC8EB31662909A0"><enum>(1)</enum><text>the term <term>serious
			 mental illness</term> means that an individual has, or at any time during the
			 1-year period ending on the date of enactment of this Act had, a covered
			 mental, behavioral, or emotional disorder; and</text>
				</paragraph><paragraph commented="no" id="id7A0D4D668B0A427ABECA717F4AD9AC10"><enum>(2)</enum><text>the term <term>covered
			 mental, behavioral, or emotional disorder</term>—</text>
					<subparagraph commented="no" id="idBFFDAC8382124DB780AD66FB48BE2F68"><enum>(A)</enum><text>means a diagnosable
			 mental, behavioral, or emotional disorder of sufficient duration to meet
			 diagnostic criteria specified within the Diagnostic and Statistical Manual of
			 Mental Disorders, Fourth Edition, or the International Classification of
			 Diseases, Ninth Revision, Clinical Modification equivalent of the Diagnostic
			 and Statistical Manual of Mental Disorders, Fourth Edition; and</text>
					</subparagraph><subparagraph commented="no" id="idBE985C7EDF4E4977B32E6A9444AFA880"><enum>(B)</enum><text>does not include a
			 disorder that has a V code within the Diagnostic and Statistical Manual of
			 Mental Disorders, Fourth Edition, a substance use disorder, or a developmental
			 disorder, unless that disorder cooccurs with another disorder described in
			 subparagraph (A) and causes functional impairment which substantially
			 interferes with or limits 1 or more major life activities.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2cf3fefb-f1f5-4624-875a-d97a6cf49f11"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this section $2,000,000 for
			 2009.</text>
