		  advisory committee to develop recommendations regarding the national aquatic
		  animal health plan developed by the National Aquatic Animal Health Task Force,

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>National Aquatic Animal Health Act
			 of 2007</short-title></quote>.</text>
		</section><section id="id25726B52C2BA439DAC59F573598FF059"><enum>2.</enum><header>Oversight of
			 national aquatic animal health plan</header>
			<subsection id="id393DF9AD083C4834BC99D1A1745F0DCF"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="idB3618A0670FA4C8791CE19D253CE21AB"><enum>(1)</enum><header>Advisory
			 committee</header><text>The term <term>advisory committee</term> means the
			 General Advisory Committee for Oversight of National Aquatic Animal Health
			 established under subsection (b)(1).</text>
				</paragraph><paragraph id="idB546351650F041608091A5F9E19A11D9"><enum>(2)</enum><header>Plan</header><text>The
			 term <term>plan</term> means the national aquatic animal health plan developed
			 by the National Aquatic Animal Health Task Force, composed of representatives
			 of the Department of Agriculture, the Department of Commerce (including the
			 National Oceanic and Atmospheric Administration), and the Department of the
			 Interior (including the United States Fish and Wildlife Service).</text>
				</paragraph><paragraph id="idB49E1128C4EC4074A0C9DA6905DB826C"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture, acting through
			 the Administrator of the Animal and Plant Health Inspection Service.</text>
				</paragraph></subsection><subsection id="id527F2DF7B5174E839C0447F43A092DE2"><enum>(b)</enum><header>General
			 Advisory Committee for Oversight of National Aquatic Animal Health</header>
				<paragraph id="id9C6FA3939C814930A58C60A6F0C5004B"><enum>(1)</enum><header>Establishment</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary, in
			 consultation with States and the private sector, shall establish an advisory
			 committee, to be known as the <quote>General Advisory Committee for Oversight
			 of National Aquatic Animal Health</quote>.</text>
				</paragraph><paragraph id="id7417F2E3AD8643CE9D30B000DDFE5903"><enum>(2)</enum><header>Membership</header>
					<subparagraph id="idB3B9526AAFDB464AB2F1F5889B730DE0"><enum>(A)</enum><header>Composition</header><text>The
			 advisory committee shall—</text>
						<clause id="id38149919CAFD4454B952712A8CDA93A8"><enum>(i)</enum><text>be
			 composed equally of representatives of—</text>
							<subclause id="idB1553E0D491C4E428D8D5445064EB3EF"><enum>(I)</enum><text>State and tribal
			 governments; and</text>
							</subclause><subclause id="id571BFF47881744EC81D7F3D113072D8C"><enum>(II)</enum><text>commercial
			 aquaculture interests; and</text>
							</subclause></clause><clause id="id79C3A2A1BC964DE59A276405688E3DE2"><enum>(ii)</enum><text>consist of not
			 more than 20 members, to be appointed by the Secretary, of whom—</text>
							<subclause id="idCF2B856AC6684A96AA319F0BC600B490"><enum>(I)</enum><text>not less than 3
			 shall be representatives of Federal departments or agencies;</text>
							</subclause><subclause id="idB1E4D26E8D6E43928EF63BFC9F638CDB"><enum>(II)</enum><text>not less than 6
			 shall be representatives of State or tribal governments that elect to
			 participate in the plan under subsection (d);</text>
							</subclause><subclause id="idF82C844218C648BD971F32A8EB4DCDFE"><enum>(III)</enum><text>not less than 6
			 shall be representatives of affected commercial aquaculture interests;
			 and</text>
							</subclause><subclause id="idCBCDD3527B0E438496BB4818E583CF24"><enum>(IV)</enum><text>not less than 2
			 shall be aquatic animal health experts, as determined by the Secretary.</text>
							</subclause></clause></subparagraph><subparagraph id="idEDA40E939CB14B1A8B6C9140549349C9"><enum>(B)</enum><header>Nominations</header><text>The
			 Secretary shall publish in the Federal Register a solicitation for, and may
			 accept, nominations for members of the advisory committee from appropriate
			 entities, as determined by the Secretary.</text>
					</subparagraph></paragraph></subsection><subsection id="id95D878596ED84DD19B3B333C531CCBB3"><enum>(c)</enum><header>Recommendations</header>
				<paragraph id="id5D957FEBA7D44BDCBC4EAB051933027F"><enum>(1)</enum><header>In
			 general</header><text>Not later than 18 months after the date of enactment of
			 this Act, the advisory committee shall develop and submit to the Secretary
			 recommendations regarding—</text>
					<subparagraph id="idD22E52DFE3304DEE9F91F16C9405118C"><enum>(A)</enum><text>the establishment
			 and membership of appropriate expert and representative commissions to
			 efficiently implement and administer the plan;</text>
					</subparagraph><subparagraph id="idE6EF155FE9F44210B19D587852FB16E9"><enum>(B)</enum><text>disease- and
			 species-specific best management practices relating to activities carried out
			 under the plan; and</text>
					</subparagraph><subparagraph id="id82D725C9BA544C64B59B4776961BFB11"><enum>(C)</enum><text>the establishment
			 and administration of the indemnification fund under subsection (e).</text>
					</subparagraph></paragraph><paragraph id="idE895D4D95FAE4C49A55609DAE6B00E44"><enum>(2)</enum><header>Factors for
			 consideration</header><text>In developing recommendations under paragraph (1),
			 the advisory committee shall take into consideration all emergency
			 aquaculture-related projects that have been or are being carried out under the
			 plan as of the date of submission of the recommendations.</text>
				</paragraph></subsection><subsection id="idE0285A73058142ECB2B9E290FF86E32E"><enum>(d)</enum><header>Participation
			 by State and tribal governments and private sector</header>
				<paragraph id="id1511ACE87E1E4FFC8CA5EEAF84BE43C9"><enum>(1)</enum><header>In
			 general</header><text>Any State or tribal government, and any entity in the
			 private sector, may elect to participate in the plan.</text>
				</paragraph><paragraph id="id69CF81B0278E48D68666AF2063F96EEC"><enum>(2)</enum><header>Duties</header><text>On
			 election by a State or tribal government or entity in the private sector to
			 participate in the plan under paragraph (1), the State or tribal government or
			 entity shall—</text>
					<subparagraph id="id417F308E18D64135B5A3FA2E52FA328D"><enum>(A)</enum><text>submit to the
			 Secretary—</text>
						<clause id="idB7C6086FC8E6410AAAD42BC738619195"><enum>(i)</enum><text>a
			 notification of the election; and</text>
						</clause><clause id="id0F2875E0BCFA43A5917A782885A3A53E"><enum>(ii)</enum><text>nominations for
			 members of the advisory committee, as appropriate; and</text>
						</clause></subparagraph><subparagraph id="idB2958F2D245E40C091FC6D8CF5D14EB5"><enum>(B)</enum><text>as a condition of
			 participation, enter into an agreement with the Secretary under which the State
			 or tribal government or entity—</text>
						<clause id="idF7ED440077BB476DA7594D97CA9844FD"><enum>(i)</enum><text>assumes
			 responsibility for a portion of the non-Federal share of the costs of carrying
			 out the plan, as described in paragraph (3); and</text>
						</clause><clause id="id86BD2C875F51483C947B0AF002BC1E4B"><enum>(ii)</enum><text>agrees to act in
			 accordance with applicable disease- and species-specific best management
			 practices relating to activities carried out under the plan by the State or
			 tribal government or entity, as the Secretary determines to be
			 appropriate.</text>
						</clause></subparagraph></paragraph><paragraph id="idBFFEFBAACB7D429EB489B5817047E038"><enum>(3)</enum><header>Non-Federal
			 share</header>
					<subparagraph id="idB1D0EBD7E9874EEB9D048BBC309E0566"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the non-Federal share of the
			 cost of carrying out the plan—</text>
						<clause id="id07ED6987567A4E4AA8973CA54422A37C"><enum>(i)</enum><text>shall be
			 determined—</text>
							<subclause id="id5553D9B8AA1E484EB3516C72041AC9C4"><enum>(I)</enum><text>by the Secretary,
			 in consultation with the advisory committee; and</text>
							</subclause><subclause id="id8BC2FBB1E2604B2CBF02D0BDB27AC2C3"><enum>(II)</enum><text>on a
			 case-by-case basis for each project carried out under the plan; and</text>
							</subclause></clause><clause id="idDA41D4323B11442383D8F6792F89103C"><enum>(ii)</enum><text>may be provided
			 by State and tribal governments and entities in the private sector in cash or
			 in-kind.</text>
						</clause></subparagraph><subparagraph id="id82B6DEB71BBE446EAE18858FF6301DD8"><enum>(B)</enum><header>Deposits into
			 indemnification fund</header><text>The non-Federal share of amounts in the
			 indemnification fund under subsection (e) provided by each State or tribal
			 government or entity in the private sector shall be—</text>
						<clause id="idFFA69D8388854D1288BBD19BE3E4E821"><enum>(i)</enum><text>zero with respect
			 to the initial deposit into the fund; and</text>
						</clause><clause id="idA43AD2480252420C81F1D53EAFA8FE77"><enum>(ii)</enum><text>determined on a
			 case-by-case basis for each project carried out under the plan.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id3C0DDF34A4D74E528C224AD8AC7D6B3B"><enum>(e)</enum><header>Indemnification
			 fund</header>
				<paragraph id="idCF709EAF6DF347F58CB2B5003E0EAB7C"><enum>(1)</enum><header>Establishment</header><text>The
			 Secretary, in consultation with the advisory committee, shall establish a fund,
			 to be known as the <quote>indemnification fund</quote>, consisting of—</text>
					<subparagraph id="id40EF70C4DCCD460AAD757FBF7AB882E6"><enum>(A)</enum><text>such amounts as
			 are initially deposited into the fund by the Secretary under subsection (g)(1);
			 and</text>
					</subparagraph><subparagraph id="idDC7433D722EC44749A9E3E9213ED1E8A"><enum>(B)</enum><text>such amounts as
			 are deposited into the fund by the Secretary, State and tribal governments, and
			 entities in the private sector for specific activities under the plan.</text>
					</subparagraph></paragraph><paragraph id="id2BD9D192238A4492B3FDFFF7185122D7"><enum>(2)</enum><header>Uses</header><text>The
			 Secretary shall use amounts in the indemnification fund only to compensate
			 aquatic farmers—</text>
					<subparagraph id="id3E3B2F9162844D41925DBBCB35D4F349"><enum>(A)</enum><text>the entire
			 inventory of livestock or agricultural products of which is eradicated as a
			 result of a disease control or eradication measure carried out under the plan;
			 or</text>
					</subparagraph><subparagraph id="id2D86C778F6FC4B678574A90626F80366"><enum>(B)</enum><text>for the cost of
			 disinfecting and cleaning products or equipment in response to a depopulation
			 order carried out under the plan.</text>
					</subparagraph></paragraph><paragraph id="idB642213A688E46D3BB97B2F90215AD4A"><enum>(3)</enum><header>Unused
			 amounts</header><text>Amounts remaining in the indemnification fund on
			 September 30 of the fiscal year for which the amounts were appropriated—</text>
					<subparagraph id="idCB66663EB2994011A49AC0C191280790"><enum>(A)</enum><text>shall remain in
			 the fund;</text>
					</subparagraph><subparagraph id="id9D47E5CC1AEE4AD5A88FCBC3DB65D21D"><enum>(B)</enum><text>may be used in
			 any subsequent fiscal year in accordance with paragraph (2); and</text>
					</subparagraph><subparagraph id="idAB98E81A9D5C443D9088198B2B80C105"><enum>(C)</enum><text>shall not be
			 reprogrammed by the Secretary for any other use.</text>
					</subparagraph></paragraph></subsection><subsection id="id7EC91C6062C241EAB18299B8F19EFF9F"><enum>(f)</enum><header>Review</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Secretary, in
			 consultation with the advisory committee, shall review, and submit to Congress
			 a report regarding—</text>
				<paragraph id="idBD9DCD46C1B94F58962F08702A1F3C2F"><enum>(1)</enum><text>activities
			 carried out under the plan during the preceding 2 years;</text>
				</paragraph><paragraph id="id1D42EAB33C80472885802CC9835AE52E"><enum>(2)</enum><text>activities
			 carried out by the advisory committee; and</text>
				</paragraph><paragraph id="id79B47BEE69BA449A88A839E71F715E88"><enum>(3)</enum><text>recommendations
			 for funding for subsequent fiscal years to carry out this section.</text>
				</paragraph></subsection><subsection id="id58CFB01E68DE45C6A08325F4C3FB45A3"><enum>(g)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $15,000,000 for each of fiscal years 2008 and 2009, of
			 which—</text>
				<paragraph id="idA02ED244644945CB8172D41B449AF7F3"><enum>(1)</enum><text>not less than 50
			 percent shall be deposited into the indemnification fund established under
			 subsection (e) for use in accordance with that subsection; and</text>
				</paragraph><paragraph id="id0B6A06B6F29D431D806DC20A1AB72D4C"><enum>(2)</enum><text>not more than 50
			 percent shall be used for the costs of carrying out the plan, including the
			 costs of—</text>
					<subparagraph id="id0DB526A36A4B4B3AB47B7AC2FCE1FE7F"><enum>(A)</enum><text>administration of
			 the plan;</text>
					</subparagraph><subparagraph id="idD331FA5B640042D49257758D1B0B1E1F"><enum>(B)</enum><text>implementation of
			 the plan;</text>
					</subparagraph><subparagraph id="id51CACF2A945040F8A5C1AA52947DDC0E"><enum>(C)</enum><text>training and
			 laboratory testing;</text>
					</subparagraph><subparagraph id="ID423884e52a2143f0813dea8d3f1fa5f4"><enum>(D)</enum><text>cleaning and
			 disinfection associated with depopulation orders; and</text>
					</subparagraph><subparagraph id="id24C0887A42524E7A90441488CF8F0252"><enum>(E)</enum><text>public education
			 and outreach activities.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
