		<official-title display="yes">To temporarily extend the programs under
		  the Higher Education Act of 1965, to amend the definition of an eligible
		  not-for-profit holder, and for other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Third Higher Education Extension Act
			 of 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idB744A05473BA49919A0BA0DDAA3DC8EB" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Extension of programs</header><text display-inline="no-display-inline">Section 2(a) of the Higher Education
			 Extension Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/81">Public Law 109–81</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> note) is amended by
			 striking <quote>October 31, 2007</quote> and inserting <quote>March 31,
			 2008</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id46DB6657FCE6488D823195C5DE9DD8FB" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or in the Higher
			 Education Extension Act of 2005 as amended by this Act, shall be construed to
			 limit or otherwise alter the authorizations of appropriations for, or the
			 durations of, programs contained in the amendments made by the Higher Education
			 Reconciliation Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/171">Public Law 109–171</external-xref>) or by the College Cost
			 Reduction and Access Act (<external-xref legal-doc="public-law" parsable-cite="pl/110/84">Public Law 110–84</external-xref>) to the provisions of the Higher
			 Education Act of 1965 and the Taxpayer-Teacher Protection Act of 2004.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDaf76a4074b994e34a29c5addd21d7d07" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definition of eligible not-for-profit
			 holder</header><text display-inline="no-display-inline">Section 435(p) of the
			 Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1085">20 U.S.C. 1085(p)</external-xref>) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDcf255e72af4d447f98cd0c1b8131a190"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking subparagraph
			 (D) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3FCE3CE74587402DB839863ED1FA409E" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="IDabc7842587944dc38766ff8c9e6c0df8"><enum>(D)</enum><text display-inline="yes-display-inline">acting as a trustee on behalf of a State,
				political subdivision, authority, agency, instrumentality, or other entity
				described in subparagraph (A), (B), or (C), regardless of whether such State,
				political subdivision, authority, agency, instrumentality, or other entity is
				an eligible lender under subsection
				(d).</text>
					</subparagraph><after-quoted-block>; and
				</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDCA5680973A4465D8A81AA3F1AC266E1"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id228E5D43DEB84DF291B447AF4C122CCC"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)(i), by striking
			 subclause (II) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD48A0F3B32D042B69B13405DA9690D86" style="OLC">
						<subclause commented="no" display-inline="no-display-inline" id="ID29a0df6624db496b8ec2a5319949b4a3"><enum>(II)</enum><text display-inline="yes-display-inline">is acting as a trustee on behalf of a
				State, political subdivision, authority, agency, instrumentality, or other
				entity described in subparagraph (A), (B), or (C) of paragraph (1), regardless
				of whether such State, political subdivision, authority, agency,
				instrumentality, or other entity is an eligible lender under subsection (d),
				and such State, political subdivision, authority, agency, instrumentality, or
				other entity, on the date of enactment of the College Cost Reduction and Access
				Act, was the sole beneficial owner of a loan eligible for any special allowance
				payment under section
				438.</text>
						</subclause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe18f2fc925d048bb963029779e68ee6e"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (A)(ii), by inserting
			 <quote>of</quote> after <quote>waive the requirements</quote>;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9f8138e167d14814a3cb46504af14e41"><enum>(C)</enum><text display-inline="yes-display-inline">by amending subparagraph (B) to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="id0C5324995666414DBB29B59980472A6E" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="ID4fdde5555b6c492f808029e8508924d1"><enum>(B)</enum><header display-inline="yes-display-inline">No for-profit ownership or control</header>
							<clause commented="no" display-inline="no-display-inline" id="IDbe09c64149534ab58c1745de82f4eaae"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No State, political subdivision, authority,
				agency, instrumentality, or other entity described in paragraph (1)(A), (B), or
				(C) shall be an eligible not-for-profit holder under this Act if such State,
				political subdivision, authority, agency, instrumentality, or other entity is
				owned or controlled, in whole or in part, by a for-profit entity.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID70236d7d42704a919ad44e8b7db3a887"><enum>(ii)</enum><header display-inline="yes-display-inline">Trustees</header><text display-inline="yes-display-inline">A trustee described in paragraph (1)(D)
				shall not be an eligible not-for-profit holder under this Act with respect to a
				State, political subdivision, authority, agency, instrumentality, or other
				entity described in subparagraph (A), (B), or (C) of paragraph (1), regardless
				of whether such State, political subdivision, authority, agency,
				instrumentality, or other entity is an eligible lender under subsection (d), if
				such State, political subdivision, authority, agency, instrumentality, or other
				entity is owned or controlled, in whole or in part, by a for-profit
				entity.</text>
							</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe27a9229ca1d4ce8a94c074b317a8ead"><enum>(D)</enum><text display-inline="yes-display-inline">by amending subparagraph (C) to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="idB7AEEF0BEE6940FBBE13FC6A97F2C3BC" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="IDa3776afd56a44e45911bd88ddc35bdac"><enum>(C)</enum><header display-inline="yes-display-inline">Sole ownership of loans and
				income</header><text display-inline="yes-display-inline">No State, political
				subdivision, authority, agency, instrumentality, trustee, or other entity
				described in paragraph (1)(A), (B), (C), or (D) shall be an eligible
				not-for-profit holder under this Act with respect to any loan, or income from
				any loan, unless—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID4fc4b63fef6d4673ada40e9e525729cf"><enum>(i)</enum><text display-inline="yes-display-inline">such State, political subdivision,
				authority, agency, instrumentality, or other entity is the sole beneficial
				owner of such loan and the income from such loan; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID34a8bbfc1c2845da8be16802383ba8d6"><enum>(ii)</enum><text display-inline="yes-display-inline">such trustee holds the loan on behalf of a
				State, political subdivision, authority, agency, instrumentality, or other
				entity described in subparagraph (A), (B), or (C) of paragraph (1), regardless
				of whether such State, political subdivision, authority, agency,
				instrumentality, or other entity is an eligible lender under subsection (d),
				and such State, political subdivision, authority, agency, instrumentality, or
				other entity is the sole beneficial owner of such loan and the income from such
				loan.</text>
							</clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD65F0FBEA5F049609C1352F2A838EC34"><enum>(E)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>an
			 entity described in described in paragraph (1)(A), (B), or (C)</quote> and
			 inserting <quote>a State, political subdivision, authority, agency,
			 instrumentality, or other entity described in subparagraph (A), (B), or (C) of
			 paragraph (1), regardless of whether such State, political subdivision,
			 authority, agency, instrumentality, or other entity is an eligible lender under
			 subsection (d),</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc91d3da542504b708ff7863a116dd7a5"><enum>(F)</enum><text display-inline="yes-display-inline">by amending subparagraph (E) to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="id073D61D588D54CF2BE557FB2BDE1E219" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="IDbf9b07eef2bf488d80a981c884b6a64e"><enum>(E)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">For purposes of subparagraphs (A), (B),
				(C), and (D) of this paragraph, a State, political subdivision, authority,
				agency, instrumentality, or other entity described in subparagraph (A), (B), or
				(C) of paragraph (1), regardless of whether such State, political subdivision,
				authority, agency, instrumentality, or other entity is an eligible lender under
				subsection (d), shall not—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID57e016b24bcc46e68dce343f2d52f1ce"><enum>(i)</enum><text display-inline="yes-display-inline">be deemed to be owned or controlled, in
				whole or in part, by a for-profit entity; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDef32cbe1dec7478db9f526e36520ce52"><enum>(ii)</enum><text display-inline="yes-display-inline">lose its status as the sole owner of a
				beneficial interest in a loan and the income from a loan,</text>
							</clause><continuation-text commented="no" continuation-text-level="subparagraph">by such State, political
				subdivision, authority, agency, instrumentality, or other entity, or by the
				trustee described in paragraph (1)(D), granting a security interest in, or
				otherwise pledging as collateral, such loan, or the income from such loan, to
				secure a debt obligation for which such State, political subdivision,
				authority, agency, instrumentality, or other entity is the issuer of the debt
				obligation.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section></legis-body>
