		<official-title>To require a licensee to notify the Nuclear Regulatory
		  Commission, and the State and county in which a facility is located, whenever
		  there is an unplanned release of radioactive substances.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Nuclear Release Notice Act of
			 2007</short-title></quote>.</text>
		</section><section id="idD7DC48EBBF5D45F985BCBB51316E6405"><enum>2.</enum><header>Nuclear release
			 notice requirement</header><text display-inline="no-display-inline">Section 103
			 of the Atomic Energy Act of 1954 (42 U.S.C. 2133) is amended by inserting after
			 subsection d. the following:</text>
			<quoted-block display-inline="no-display-inline" id="id5F6989EDB5B7494CB2749E4FCE1FC683" style="OLC">
				<subsection id="IDd7d30628add949c6aae2be7742d99497"><enum>e.</enum><header>Notice of
				unplanned release of radioactive substances</header>
					<paragraph id="IDb93bedfb3f3844b09bdcf7c12e1e0b31"><enum>(1)</enum><header>Regulations</header>
						<subparagraph id="ID75a95ec239734980a2d521203e5f7b94"><enum>(A)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of the
				<short-title>Nuclear Release Notice Act of
				2007</short-title>, the Commission shall promulgate regulations that require
				civilian nuclear power facilities licensed under this section or section 104b.
				to provide notice of any release to the environment of quantities of fission
				products or other radioactive substances.</text>
						</subparagraph><subparagraph id="idFB943B9F1D154C17B73A1BAE708501DF"><enum>(B)</enum><header>Considerations</header><text>In
				developing the regulations under subparagraph (A), the Commission shall
				consider requiring licensees of civilian nuclear power facilities to provide
				notice of the release—</text>
							<clause id="IDea33fb16756246dbbd74f0440d5efb84"><enum>(i)</enum><text>not later than 24
				hours after the release;</text>
							</clause><clause id="IDca6ef9443bd846c6951f530a9856089c"><enum>(ii)</enum><text>to the
				Commission and the governments of the State and county in which the civilian
				nuclear power facility is located, if the unplanned release—</text>
								<subclause id="ID3c6f23770afc46618bdd69e2bbd534f6"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id850BF68DD49D49FFB99A16E520437992"><enum>(aa)</enum><text>exceeds allowable
				limits for normal operation established by the Commission; and</text>
									</item><item id="idC5820D804F4D4046AC4D972CD07089DF" indent="up1"><enum>(bb)</enum><text>is not subject to more stringent
				reporting requirements established in existing regulations of the Commission;
				or</text>
									</item></subclause><subclause id="ID2a437b283c2e4afa8a7a0c19761eec32"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="idA6EF9EF0EC474BDBBAB8897559182E1F"><enum>(aa)</enum><text>enters into the
				environment; and</text>
									</item><item id="idAA099757DE2748E3BDB5C4C99AF8496F" indent="up1"><enum>(bb)</enum><text>may cause drinking water sources to
				exceed a maximum contaminant level established by the Environmental Protection
				Agency for fission products or other radioactive substances under the Safe
				Drinking Water Act (42 U.S.C. 300f et seq.); and</text>
									</item></subclause></clause><clause id="IDcec2b002bdd34add9503f369a5b1e698"><enum>(iii)</enum><text>to the
				governments of the State and county in which the civilian nuclear power
				facility is located if the unplanned release reaches the environment by a path
				otherwise not allowed or recognized by the operating license of the civilian
				nuclear power facility and falls within the allowable limits specified in
				clause (ii), including—</text>
								<subclause id="ID1e4c94f287564ff18749ce9ff311ebb5"><enum>(I)</enum><text>considering any
				recommendations issued by the Liquid Radioactive Release Lessons-Learned Task
				Force;</text>
								</subclause><subclause id="ID5ea7dbec7ded473181a9f4bf0a5365b3"><enum>(II)</enum><text>the frequency
				and form of the notice; and</text>
								</subclause><subclause id="IDe11c1cbfb93e4b168f4b93472161910b"><enum>(III)</enum><text>the threshold,
				volume, and radiation content that trigger the notice.</text>
								</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID18e8a0cc8e5b43dfa697b3442fa6f97b"><enum>(2)</enum><header>Effect</header><text>Nothing
				in this subsection provides to any State or county that receives a notice under
				this subsection regulatory jurisdiction over a licensee of a civilian nuclear
				power
				facility.</text>
