2.In this Act:
(1)
(A)The term ecological processes means the
biological, chemical, and physical interactions between the biotic and abiotic
components of an ecosystem.
(B)The
term ecological processes includes—
(i)nutrient
cycling;
(ii)pollination;
(iii)predator-prey
relationships;
(iv)soil
formation;
(v)gene flow;
(vi)hydrologic
cycling;
(vii)decomposition;
and
(viii)disturbance
regimes, such as fire and flooding.
(2)
(A)The term habitat means the physical,
chemical, and biological properties that are used by wildlife for growth,
reproduction, and survival.
(B)The
term habitat includes aquatic and terrestrial plant communities,
food, water, cover, and space on a tract of land, in a body of water, or in an
area or region.
(3)The term Indian tribe has the meaning given
the term in section 4 of the Indian
Self-Determination and Education Assistance Act (25 U.S.C.
450b).
(4)The
term wildlife means—
(A)any species of
wild, free-ranging fauna, including fish and other aquatic species; and
(B)any fauna in a
captive breeding program the object of which is to reintroduce individuals of a
depleted indigenous species into previously occupied range.
<enum>I</enum><header>Natural Resources
and Wildlife Programs</header>
<section id="H2FC8AA010B434CD690E0F0002813173F"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="id4A17F0674460413A84CE0710651C7BD9"><enum>(1)</enum><header>Advisory
Board</header><text>The term <term>Advisory Board</term> means the Advisory
Board established under section 113(a).</text>
</paragraph><paragraph id="H0D0B4EF1040E4AC6958DDECC9CF0D2E7"><enum>(2)</enum><header>Habitat
linkage</header><text>The term <term>habitat linkage</term> means an area
that—</text>
<subparagraph id="idD2AE0F445BD64EA9BACE0326E6FF0173"><enum>(A)</enum><text>connects wildlife
habitat or potential wildlife habitat; and</text>
</subparagraph><subparagraph id="id8BD288245EA14DE3872110ADD7271FD4"><enum>(B)</enum><text>facilitates the
ability of wildlife to move within a landscape in response to the effects of
global warming.</text>
</subparagraph></paragraph><paragraph id="id48F7148D4C2449438AC4879C1B66DF71"><enum>(3)</enum><header>National
strategy</header><text>The term <term>national strategy</term> means the
national strategy established under section 112.</text>
</paragraph><paragraph id="HF6EB74A0110B43FB9C17744E9B00152D"><enum>(4)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of the Interior.</text>
</paragraph></section><subtitle id="H8FF21FE6760D461591681F7EECCD05FC"><enum>A</enum><header>National policy
and strategy for wildlife</header>
<section id="HC72A19EDBFDA44749960494EFF52341F"><enum>111.</enum><header>National policy
on wildlife and global warming</header><text display-inline="no-display-inline">It is the policy of the Federal Government,
in cooperation with State, tribal, and affected local governments, other
concerned public and private organizations, landowners, and citizens to use all
practicable means and measures—</text>
<paragraph id="HA38D1054749C49049C687EAE8644527C"><enum>(1)</enum><text>to assist wildlife
populations and wildlife habitats in adapting to and surviving the effects of
global warming; and</text>
</paragraph><paragraph id="H9731C215A2A94036B7A856EF2B026BFB"><enum>(2)</enum><text>to ensure the
persistence and resilience of the wildlife of the United States, together with
wildlife habitat, as an essential part of the culture, landscape, and natural
resources of the United States.</text>
</paragraph></section><section id="H4021FA4D57344528B3002E7E02A88FEC"><enum>112.</enum><header>National
strategy</header>
<subsection id="HBC51670F84364245BF53E3FB1155AC8"><enum>(a)</enum><header>Requirement</header>
<paragraph id="H658D80254C464345B84525E91251F33C"><enum>(1)</enum><header>In
general</header><text>Not later than 2 years after the date of enactment of
this Act, the Secretary shall implement the national policy under section 111
by establishing a national strategy for assisting wildlife populations and
wildlife habitats in adapting to the impact of global warming.</text>
</paragraph><paragraph id="H2F9588E0354C4BCC9FAB142539C63BBD"><enum>(2)</enum><header>Administration</header><text>In
establishing the national strategy, the Secretary shall—</text>
<subparagraph id="id0E59433754604DEDB709516973AA455C"><enum>(A)</enum><text>base the national
strategy on the best available science, as provided by the Advisory
Board;</text>
</subparagraph><subparagraph id="idE9CDE140DBDB4283A845EE55F7D25652"><enum>(B)</enum><text>develop the
national strategy in cooperation with State fish and wildlife agencies and
Indian tribes;</text>
</subparagraph><subparagraph id="H63CA0C71203C40E5AEA300B77C1C0030"><enum>(C)</enum><text>consult
with—</text>
<clause id="id0835891BDC8C423188A085CE0105AAAA"><enum>(i)</enum><text>the
Secretary of Agriculture;</text>
</clause><clause id="id28C0763686E1423AB56109ADE1741FB8"><enum>(ii)</enum><text>the Secretary of
Commerce;</text>
</clause><clause id="id753D534F72104A2F93B37DD70E97E336"><enum>(iii)</enum><text>the
Administrator of the Environmental Protection Agency;</text>
</clause><clause id="idA9B493F66551447FB0E848C92547B8DB"><enum>(iv)</enum><text>local
governments;</text>
</clause><clause id="id77308384AEE244B4B46649211A7A711C"><enum>(v)</enum><text>conservation
organizations;</text>
</clause><clause id="id198CB0D90A6E4257B7C8A0A7CF51ECCF"><enum>(vi)</enum><text>scientists;
and</text>
</clause><clause id="idBA5B8E0F81FC4B0D8C3D5B47EC7226FA"><enum>(vii)</enum><text>other
interested stakeholders; and</text>
</clause></subparagraph><subparagraph id="H9A208018D3BB4D29AC9DC378A01FB2"><enum>(D)</enum><text>provide public
notice and opportunity for comment.</text>
</subparagraph></paragraph></subsection><subsection id="H4323581847E14FC3001ECEACF714A036"><enum>(b)</enum><header>Contents</header>
<paragraph id="HD4D431A857984907ADAFF833A492BA66"><enum>(1)</enum><header>In
general</header><text>The Secretary shall include in the national strategy
prioritized goals and measures and a plan for implementation (including a
timeframe)—</text>
<subparagraph id="HCE749F7DAD00445AA6C3DB6754C51DF"><enum>(A)</enum><text>to identify and
monitor wildlife populations, including game species, that are likely to be
adversely affected by global warming, with particular emphasis on wildlife
populations with the greatest need for conservation;</text>
</subparagraph><subparagraph id="H5E0D4D959E934C5D00D807312DAB0031"><enum>(B)</enum><text>to identify and
monitor coastal, marine, terrestrial, and fresh water habitats that are at the
greatest risk of being damaged by global warming;</text>
</subparagraph><subparagraph id="HDF65440959DA41C10053D92DAF56ABE4"><enum>(C)</enum><text>assist species in
adapting to the impact of global warming;</text>
</subparagraph><subparagraph id="H58D6CC46F53A41188832132DD6B8BFE1"><enum>(D)</enum><text>protect, acquire,
and restore wildlife habitat to build resilience to global warming;</text>
</subparagraph><subparagraph id="HF224283BEEFE40738C25FA6DCDE7CA00"><enum>(E)</enum><text>provide habitat
linkages and corridors to facilitate wildlife movements in response to global
warming;</text>
</subparagraph><subparagraph id="HCB3666A91AEC41E2A605D2F400F959D8"><enum>(F)</enum><text>restore and
protect ecological processes that sustain wildlife populations that are
vulnerable to global warming; and</text>
</subparagraph><subparagraph id="HDA8FA1521AD44D9BBA84EED51DCCC545"><enum>(G)</enum><text>incorporate
consideration of climate change in, and integrate climate change adaptation
strategies for wildlife and wildlife habitat into, the planning and management
of Federal land administered by the Department of the Interior and land
administered by the Forest Service.</text>
</subparagraph></paragraph><paragraph id="H7AA90ABD79584272B431419908B09272"><enum>(2)</enum><header>Coordination
with other plans</header><text>In developing the national strategy, the
Secretary shall, to the maximum extent practicable—</text>
<subparagraph id="HB4DE86CB61A043E49DF2B99448C0F333"><enum>(A)</enum><text>take into
consideration research and information contained in—</text>
<clause id="id20C2BF6AC8B149C1A647AE05B1F59371"><enum>(i)</enum><text>State
comprehensive wildlife conservation plans;</text>
</clause><clause id="id87540A96C0ED434AB57D28682F0393A2"><enum>(ii)</enum><text>the North
American Waterfowl Management Plan;</text>
</clause><clause id="id0F14EFB0442E4C37A652FACD0066DAB4"><enum>(iii)</enum><text>the National
Fish Habitat Action Plan; and</text>
</clause><clause id="id69E8CD4552374FF7992B89EBA9ECBC14"><enum>(iv)</enum><text>other relevant
plans; and</text>
</clause></subparagraph><subparagraph id="H6C79E269A53A4CC69E23F1ED065505B7"><enum>(B)</enum><text>coordinate and
integrate, to the extent consistent with the policy established under section
111, the goals and measures identified in the national strategy with goals and
measures identified in those plans.</text>
</subparagraph></paragraph></subsection><subsection id="H75DFF6A0B6F04F148EA4FB9C35254951"><enum>(c)</enum><header>Revisions</header><text>Not
later than 5 years after the date of the initial establishment of the national
strategy and every 10 years thereafter, the Secretary shall revise the national
strategy to reflect—</text>
<paragraph id="id0789F7851BEA460DA1F8A773C184934D"><enum>(1)</enum><text>new information
on the impact of global warming on wildlife and wildlife habitat; and</text>
</paragraph><paragraph id="idB03AF6B97E1E469DB6E89A20605A9F3F"><enum>(2)</enum><text>advances in the
development of strategies for adapting to or mitigating the impact.</text>
</paragraph></subsection><subsection id="HE4C475BED1664DCEBB9196F587B4EC6"><enum>(d)</enum><header>Implementation</header>
<paragraph id="H71088192A9414E89BE76A41205242347"><enum>(1)</enum><header>Implementation
on Federal land systems</header><text>To achieve the goals of the national
strategy and to implement measures for the conservation of wildlife and
wildlife habitat identified in the national strategy—</text>
<subparagraph id="H44BBC820F82341DDBD60D58C77444F53"><enum>(A)</enum><text>the Secretary of
the Interior shall exercise the authority of the Secretary under this title and
other laws within the jurisdiction of the Secretary pertaining to the
administration of land; and</text>
</subparagraph><subparagraph id="HF8A9C40B64E54B8CB50089439BCE94CB"><enum>(B)</enum><text>the Secretary of
Agriculture shall exercise the authority of the Secretary of Agriculture under
this title and other laws within the jurisdiction of the Secretary pertaining
to the administration of land.</text>
</subparagraph></paragraph><paragraph id="H6D3F04BF6DB247C5B0D4F2003D7E2556"><enum>(2)</enum><header>Wildlife
conservation programs</header><text>To the maximum extent practicable, the
Secretary, the Secretary of Agriculture, and the Secretary of Commerce shall
use the authorities of the respective Secretary under other laws to achieve the
goals of the national strategy.</text>
</paragraph></subsection><subsection id="H0E579848EA614A659B9303276C227EA9"><enum>(e)</enum><header>Limitation on
effect</header><text>Nothing in this section creates new authority or expands
any existing authority for the Secretary to regulate the use of private
property.</text>
</subsection></section><section id="H252B5F0C5A8A40AE8252DE2DF4A29E03"><enum>113.</enum><header>Advisory Board;
National Global Warming and Wildlife Science Center</header>
<subsection id="H10CF70C788B944D8B09E28D2B776B100"><enum>(a)</enum><header>Advisory
Board</header>
<paragraph id="H3D87D9B2F30E4D5EADD5EDCE7EBE81B5"><enum>(1)</enum><header>In
general</header><text>The Secretary shall establish and appoint the members of
an Advisory Board that is composed of—</text>
<subparagraph id="id2A0E00E6E63448AB91B7D2D1A4F08D07"><enum>(A)</enum><text>not less than 10,
and not more than 20, members recommended by the President of the National
Academy of Sciences with expertise in wildlife biology, ecology, climate
change, and other relevant disciplines; and</text>
</subparagraph><subparagraph id="id03FB348D46D04F1FBA717129305367FF"><enum>(B)</enum><text>the Director of
the National Global Warming and Wildlife Science Center established under
subsection (b), who shall be an ex officio member of the Advisory Board.</text>
</subparagraph></paragraph><paragraph id="H9C894F5DC25748239DCCE77333C0004"><enum>(2)</enum><header>Functions</header><text>The
Advisory Board shall—</text>
<subparagraph id="H8D056852DF7C46E59477C1221C15AA21"><enum>(A)</enum><text>provide scientific
and technical advice and recommendations to the Secretary on—</text>
<clause id="idBDEE85D57B73475584E894338F03802A"><enum>(i)</enum><text>the
impact of global warming on wildlife and wildlife habitat;</text>
</clause><clause id="idD300C0FA09A04E589505E3E152B652CB"><enum>(ii)</enum><text>areas of habitat
of particular importance for the conservation of wildlife populations affected
by global warming; and</text>
</clause><clause id="id1FC1595E2BF84A11A33E996F1CEFA248"><enum>(iii)</enum><text>strategies and
mechanisms to assist wildlife populations and wildlife habitats in adapting to
the impact of global warming on the management of Federal land and in other
Federal programs for wildlife conservation;</text>
</clause></subparagraph><subparagraph id="H43F52848D58D4C9BB56CC6012B79BC9B"><enum>(B)</enum><text>advise the
National Global Warming and Wildlife Science Center established under
subsection (b) and review the research programs of the Center; and</text>
</subparagraph><subparagraph id="H4035C3642BFB4994A3049E23AFBC291D"><enum>(C)</enum><text>advise the
Secretary regarding the best science available for purposes of developing and
revising the national strategy established under section 112.</text>
</subparagraph></paragraph><paragraph id="H0D275026C962473A89E6636ACCE08C6"><enum>(3)</enum><header>Public
availability</header><text>The advice and recommendations of the Advisory Board
shall be available to the public.</text>
</paragraph></subsection><subsection id="HE4AAD247CB734DAA8F197EF235F00715"><enum>(b)</enum><header>National Global
Warming and Wildlife Science Center</header>
<paragraph id="H90E9E5D9EA5F47CF889926081CFBF122"><enum>(1)</enum><header>In
general</header><text>The Secretary shall establish a National Global Warming
and Wildlife Science Center within the United States Geological Survey.</text>
</paragraph><paragraph id="id851FE119539A4B25A489D65F2E105B81"><enum>(2)</enum><header>Director</header><text>The
Center shall be headed by a Director, appointed by the Secretary.</text>
</paragraph><paragraph id="HB56881E25267450EAFB29319417D7B36"><enum>(3)</enum><header>Functions</header><text>The
Center shall—</text>
<subparagraph id="H874907B4316546D4A7E274219CF9E6B"><enum>(A)</enum><text>conduct scientific
research on national issues relating to the impact of global warming on
wildlife and wildlife habitat and mechanisms for adaptation to, mitigation of,
or prevention of the impact;</text>
</subparagraph><subparagraph id="HE0D17B3A9C2440529D6701BCA6F8D945"><enum>(B)</enum><text>consult with and
advise Federal land management agencies and Federal wildlife agencies
on—</text>
<clause id="id9CE353F35ED243E3A3F166E3A3DAE951"><enum>(i)</enum><text>the
impact of global warming on wildlife and wildlife habitat and mechanisms for
adaptation to or mitigation of the impact; and</text>
</clause><clause id="id645A090F576B47459221803296CA5ED0"><enum>(ii)</enum><text>the
incorporation of information regarding the impact and the adoption of
mechanisms for adaptation or mitigation of the impact in the management and
planning for Federal land and in the administration of Federal wildlife
programs; and</text>
</clause></subparagraph><subparagraph id="H8A54C61D841D4C6C9971A0C8908FDABA"><enum>(C)</enum><text>consult and, to
the maximum extent practicable, collaborate with State and local agencies,
institutions of higher education, and other public and private entities
regarding research, monitoring, and other efforts to address the impact of
global warming on wildlife and wildlife habitat.</text>
</subparagraph></paragraph><paragraph id="HC03979377E74475F90B9C7D4DC8FD43D"><enum>(4)</enum><header>Integration with
other Federal activities</header><text>The Secretary, the Secretary of
Agriculture, and the Secretary of Commerce shall ensure that research and other
activities carried out under this section are integrated with climate change
program research and activities carried out under other Federal law.</text>
</paragraph></subsection><subsection id="H3ADE76859C914218B8DC001781140000"><enum>(c)</enum><header>Detection of
changes</header><text>The Secretary, the Secretary of Agriculture, and the
Secretary of Commerce shall use existing authorities to each carry out programs
to detect changes in wildlife abundance, distribution, and behavior related to
global warming, including—</text>
<paragraph id="H185C3690EB6D4D16B6B1800A94044B1"><enum>(1)</enum><text>conducting species
inventories on Federal land and in marine areas within the exclusive economic
zone of the United States; and</text>
</paragraph><paragraph id="H1A6CE317054A423896ED2DEB3FE14272"><enum>(2)</enum><text>establishing and
implementing robust, coordinated monitoring programs.</text>
</paragraph></subsection></section><section id="HED772E03AC324E04B8CBF21C63D2027"><enum>114.</enum><header>Authorization of
appropriations</header>
<subsection id="idC9A8F5CC088F40359C6FB427CFB52D96"><enum>(a)</enum><header>In
general</header><text>There are authorized to be appropriated such sums as are
necessary to carry out this subtitle.</text>
</subsection><subsection id="HE44460EA839B4186B86DA800FDC86EB"><enum>(b)</enum><header>Implementation of
national strategy</header><text>Of the amount that is made available to carry
out this subtitle for each fiscal year—</text>
<paragraph id="H48F3648EB2104FD7A13510C695BBE9D3"><enum>(1)</enum><text>45 percent of the
amount shall be made available to Federal agencies to develop and implement the
national strategy established under section 112 in the administration of
Federal land systems, of which not less than—</text>
<subparagraph id="H9D90B3574C9F46019F48C1432F146FF2"><enum>(A)</enum><text>35 percent shall
be allocated to the Department of the Interior—</text>
<clause id="HCC9E64A2392E4FBABE74DEFBD186868F"><enum>(i)</enum><text>to
operate the National Global Warming and Wildlife Science Center established
under section 113(b); and</text>
</clause><clause id="H2817BC46513F4C0DB176696265873033"><enum>(ii)</enum><text>to
carry out the policy established under section 111, and implement the national
strategy, in the administration of—</text>
<subclause id="id20A58C762F2C4842984AB801C8E7FCE3"><enum>(I)</enum><text>the National Park
System;</text>
</subclause><subclause id="id5D16BDD6BAD646779EA87250DCB12713"><enum>(II)</enum><text>the National
Wildlife Refuge System; and</text>
</subclause><subclause id="id548CD326E4D84B999A392D29C7EE4C3A"><enum>(III)</enum><text>public land of
the Bureau of Land Management; and</text>
</subclause></clause></subparagraph><subparagraph id="H85BB644A8B2D491CA3CCC0F6193C8029"><enum>(B)</enum><text>10 percent shall
be allocated to the Department of Agriculture to carry out the policy
established under section 111, and implement the national strategy, in the
administration of the National Forest System;</text>
</subparagraph></paragraph><paragraph id="H021B31443E8A4F0290F267821B91593E"><enum>(2)</enum><text>25 percent of the
amount shall be made available to Federal agencies to carry out the policy
established under section 111, and to implement the national strategy, in the
administration of fish and wildlife programs (other than for the operation and
maintenance of Federal land), of which—</text>
<subparagraph id="H98D4F9F4F0E74C1F9351B5F2D1DEB15"><enum>(A)</enum><text>10 percent shall be
allocated to the Department of the Interior to carry out endangered species,
migratory bird, and other fish and wildlife programs administered by the United
States Fish and Wildlife Service, other than operations and maintenance of the
National Wildlife Refuges; and</text>
</subparagraph><subparagraph id="H4B8A0EFC1E6342748F55B57B9D1F13C1"><enum>(B)</enum><text>15 percent shall
be allocated to the Department of the Interior to implement or fund activities
that assist wildlife and wildlife habitat in adapting to the impact of global
warming under applicable cooperative grant programs, including—</text>
<clause id="id55BFC657711741E6849A31E1B807DE6C"><enum>(i)</enum><text>grants from the
cooperative endangered species conservation fund established under section 6(i)
of the Endangered Species Act of 1973 (16 U.S.C. 1535(i));</text>
</clause><clause id="idF3FDECA764E54086AA750A8D10FE6203"><enum>(ii)</enum><text>Private
Stewardship Grants;</text>
</clause><clause id="id09AB98EA8CE442E08D648B18C3187915"><enum>(iii)</enum><text>grants from the
North American Wetlands Conservation Act (16 U.S.C. 4401 et seq.);</text>
</clause><clause id="id01BB3ACC53934B4BB8E45EB788C45D32"><enum>(iv)</enum><text>grants from the
multinational species conservation fund established under the heading
<quote><header-in-text level="appropriations-small" style="OLC">multinational
species conservation fund</header-in-text></quote> of title I of the Department
of the Interior and Related Agencies Appropriations Act, 1999 (16 U.S.C.
4246);</text>
</clause><clause id="idAEC81474852A4372924CE458F1580A37"><enum>(v)</enum><text>grants from the
Neotropical Migratory Bird Conservation Fund established by section 9(a) of the
Neotropical Migratory Bird Conservation Act (16 U.S.C. 6108(a)); and</text>
</clause><clause id="idB7213F8F655C4834A9C5CD1938CB9148"><enum>(vi)</enum><text>grants under the
National Fish Habitat Action Plan; and</text>
</clause></subparagraph></paragraph><paragraph id="H82C21C9D2A7C4EDB9728F350F6585F67"><enum>(3)</enum><text>30 percent of the
amount shall be made available for grants to States and Indian tribes through
the State and tribal wildlife grants program authorized under section
121—</text>
<subparagraph id="H6CB9960ABD664178878E96A0F993407F"><enum>(A)</enum><text>to carry out
activities that assist wildlife and wildlife habitat in adapting to the impact
of global warming in accordance with State comprehensive wildlife conservation
plans developed and approved under the program; and</text>
</subparagraph><subparagraph id="H31CB3B7C329742EF9B496EC75EA228CD"><enum>(B)</enum><text>to revise or
supplement existing State comprehensive wildlife conservation plans as
necessary to include specific strategies for assisting wildlife and wildlife
habitat in adapting to the impact of global warming.</text>
</subparagraph></paragraph></subsection><subsection id="H6AF937A4A01242899CF71133B4446121"><enum>(c)</enum><header>Availability to
States and Indian tribes</header>
<paragraph id="HEFC9F59EA7FF444BA02C659E15FBD6"><enum>(1)</enum><header>In
general</header><text>Subject to paragraphs (2) and (3), funding under this
section may be made available to States and Indian tribes in accordance with
this section.</text>
</paragraph><paragraph id="H8CB2226212854A62AB7C981685935985"><enum>(2)</enum><header>Initial 5-year
period</header><text>During the 5-year period beginning on the date of
enactment of this Act, a State shall not be eligible to receive funds under
this section unless the head of the wildlife agency of the State has—</text>
<subparagraph id="HAE1211CDEFF44EB085645DB0C7B9C0C9"><enum>(A)</enum><text>approved, and
provided to the Secretary, an express strategy to assist wildlife populations
in adapting to the impact of global warming in the State; and</text>
</subparagraph><subparagraph id="H0AEBE616E13A49838120D04C3B8D00FF"><enum>(B)</enum><text>incorporated the
strategy as a supplement to the comprehensive wildlife conservation plan of the
State.</text>
</subparagraph></paragraph><paragraph id="H7F9648D858964D7C835B26E356051515"><enum>(3)</enum><header>Subsequent
period</header><text>After the 5-year period described in paragraph (2), a
State shall not be eligible to receive funds under this section unless the
State has submitted to the Secretary, and the Secretary has approved, a
revision to the comprehensive wildlife conservation plan of the State
that—</text>
<subparagraph id="HC4A228789A9E4815A16D6CE00AC8140"><enum>(A)</enum><text>describes the
impact of global warming on the diversity and health of the wildlife
populations and habitat of the State;</text>
</subparagraph><subparagraph id="H68B9EEAC90C74CE980CAA4DBC300CFD"><enum>(B)</enum><text>describes and
prioritizes proposed conservation actions to assist wildlife populations in
adapting to the impact;</text>
</subparagraph><subparagraph id="H32F1BE5E84214FB48F93791400E1897E"><enum>(C)</enum><text>establishes
programs for monitoring the impact of global warming on wildlife populations
and wildlife habitat; and</text>
</subparagraph><subparagraph id="HDD1C312E5C2D4F1EA62B5D13D95EC424"><enum>(D)</enum><text>establishes
methods for—</text>
<clause id="id205DA080BE1D4DD8808C792090B0ED1E"><enum>(i)</enum><text>assessing the
effectiveness of conservation actions taken to assist wildlife populations in
adapting to the impact; and</text>
</clause><clause id="id461A1E69EBBD4E3394F33C3EE7462F8A"><enum>(ii)</enum><text>adapting the
actions to respond appropriately to new information or changing
conditions.</text>
</clause></subparagraph></paragraph></subsection><subsection id="H4FF5DBA91B184479B1ACBF1836A6DC86"><enum>(d)</enum><header>Maintenance of
effort</header><text>It is the intent of Congress that funding provided under
this subtitle supplements (and not supplants) existing sources of funding for
wildlife conservation.</text>
</subsection></section></subtitle><subtitle id="H28A81F0ECC004519A614001D09F88D2D"><enum>B</enum><header>State and tribal
wildlife grants program</header>
<section id="HF2D4F986591C4A618C19A548D41D6690"><enum>121.</enum><header>State and
tribal wildlife grants program</header>
<subsection id="H211C0DCDDE0346BFA4472C5DB8906800"><enum>(a)</enum><header>Authorization of
program</header><text>The Secretary shall establish a State and tribal wildlife
grants program under which the Secretary shall provide wildlife conservation
grants to States, the District of Columbia, the Commonwealth of Puerto Rico,
Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the
United States Virgin Islands, and Indian tribes for the planning, development,
and implementation of programs for the benefit of wildlife and wildlife
habitat, including species that are not hunted or fished.</text>
</subsection><subsection id="H82BBB69881A842AC82C25D02007EEA05"><enum>(b)</enum><header>Allocation of
funds</header>
<paragraph id="HD237D5F6871542AEAB86C6A0B1407571"><enum>(1)</enum><header>In
general</header><text>Subject to paragraph (2), of the amount that is made
available to carry out this section for each fiscal year—</text>
<subparagraph id="HF7AF6B27B0AC4D0BB72C27C0041EC347"><enum>(A)</enum><text>10 percent shall
be used to conduct a competitive grant program for Indian tribes that are not
subject to any other provision of this section;</text>
</subparagraph><subparagraph id="H2EF2C63EF15645E181CFF161040B843"><enum>(B)</enum><text>of the amount
remaining after the application of subparagraph (A) and after the deduction of
the administrative expenses incurred by the Secretary to carry out this
section—</text>
<clause id="H4E62B15B70294EF194A05B171FF6202"><enum>(i)</enum><text>not
more than ½ of 1 percent shall be allocated to provide grants to each
of—</text>
<subclause id="id6F25EAA28E974869BDE732605F7115DA"><enum>(I)</enum><text>the District of
Columbia; and</text>
</subclause><subclause id="id9700056EE9AD41D18900ED609B95DA9B"><enum>(II)</enum><text>the Commonwealth
of Puerto Rico; and</text>
</subclause></clause><clause id="H35270B73B7D445B0973768C4386DA926"><enum>(ii)</enum><text>not
more than ¼ of 1 percent shall be allocated to each of—</text>
<subclause id="idB5911DB6C4304C12B0183D17E8E770DA"><enum>(I)</enum><text>Guam;</text>
</subclause><subclause id="id921B579AA4AE4ED98B5B94F65FD956CF"><enum>(II)</enum><text>American
Samoa;</text>
</subclause><subclause id="idBE4717DBD7B84679A5D6CA70A2CC8635"><enum>(III)</enum><text>the
Commonwealth of the Northern Mariana Islands; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id370106E714324559988508B4EFFDA6BC"><enum>(IV)</enum><text>the United
States Virgin Islands; and</text>
</subclause></clause></subparagraph><subparagraph id="H95917EDED729487FB62B9498E6D0E1D3"><enum>(C)</enum><text>of the amount
remaining after the application of subparagraphs (A) and (B), the Secretary
shall apportion among the States—</text>
<clause id="HE9FE005D35DB4378A7BB6BB28D80FA02"><enum>(i)</enum><text><fraction>1/3</fraction>
based on the ratio that the land area of each State bears to the total land
area of all States; and</text>
</clause><clause id="H6258722668C1426BBF7CD5D1A901B367"><enum>(ii)</enum><text><fraction>2/3</fraction>
based on the ratio that the population of each State bears to the total
population of all States.</text>
</clause></subparagraph></paragraph><paragraph id="H05C39B362B41482A80A98237E1B8E882"><enum>(2)</enum><header>Adjustments</header><text>The
amount apportioned under paragraph (1)(C) for a fiscal year shall be adjusted
equitably so that no State is apportioned under that subparagraph an amount
that is—</text>
<subparagraph id="HC0F625DFEACC4FD800D5B86D611CEFB"><enum>(A)</enum><text>less than 1 percent
of the amount available for apportionment under that subparagraph for the
fiscal year; or</text>
</subparagraph><subparagraph id="H71B92ABC4A894EE7A213C840CC66F407"><enum>(B)</enum><text>more than 5
percent of the amount.</text>
</subparagraph></paragraph></subsection><subsection id="HD18EB2C2F7CB477583E008C099CBE77"><enum>(c)</enum><header>Cost
sharing</header>
<paragraph id="HF92D5168785C4E39BEE97D7B8381AD58"><enum>(1)</enum><header>Plan development
grants</header><text>The Federal share of the costs of developing or revising a
comprehensive wildlife conservation plan shall not exceed 75 percent of the
total costs of developing or revising the plan.</text>
</paragraph><paragraph id="H1F7A3F1762FF4ABE865C50632ED76E2C"><enum>(2)</enum><header>Plan
implementation grants</header><text>The Federal share of the costs of carrying
out an activity under an approved comprehensive wildlife conservation plan
carried out with a grant under this section shall not exceed 50 percent of the
total costs of carrying out the activity.</text>
</paragraph><paragraph id="HD067CBFB977541F2BAED936823AB7C9F"><enum>(3)</enum><header>Prohibition on
use of Federal funds</header><text>The non-Federal share of costs of an
activity carried out under this section shall not be paid with amounts derived
from any Federal grant program.</text>
</paragraph></subsection><subsection id="H1425FFE8211441A9BE61AFBAD3DF42A6"><enum>(d)</enum><header>Requirement for
plan</header>
<paragraph id="H104BE2A7959344E1B382C3590060E46E"><enum>(1)</enum><header>In
general</header><text>No State, territory, possession, or other jurisdiction
(referred to in this subsection as an <quote>eligible jurisdiction</quote>)
shall be eligible for a grant under this section unless the eligible
jurisdiction submits to the Secretary a comprehensive wildlife conservation
plan that—</text>
<subparagraph id="H74EB2ABC06D944980065763282F23BAE"><enum>(A)</enum><text>complies with
paragraph (2); and</text>
</subparagraph><subparagraph id="H3764E4B406A948BBA04B32F5511E47FB"><enum>(B)</enum><text>considers the
broad range of wildlife and associated habitats of the eligible jurisdiction,
with appropriate priority placed on species with the greatest conservation need
and taking into consideration the relative level of funding available for the
conservation of those species.</text>
</subparagraph></paragraph><paragraph id="H16D00C3FB02F471AACA9D0DEB0F29B2C"><enum>(2)</enum><header>Contents</header><text>The
comprehensive wildlife conservation plan of an eligible jurisdiction shall
contain—</text>
<subparagraph id="H66A0E8AA9A614ABEB47F034C09A685EC"><enum>(A)</enum><text>information on the
distribution and abundance of species of wildlife (including low and declining
populations as the fish and wildlife agency of the eligible jurisdiction
considers appropriate) that are indicative of the diversity and health of the
wildlife of the eligible jurisdiction;</text>
</subparagraph><subparagraph id="H7C1ED4A82A0A4E00BDAA892B8087CC31"><enum>(B)</enum><text>information on the
location and relative condition of key habitats and community types essential
to the conservation of species identified under subparagraph (A);</text>
</subparagraph><subparagraph id="H72B6355AFB2045689C88596290498F07"><enum>(C)</enum><text>a description
of—</text>
<clause id="id3268E76E809B452AAC2B21F6470B20FB"><enum>(i)</enum><text>problems that may
adversely affect species identified under subparagraph (A) or the habitats of
the species; and</text>
</clause><clause id="id09202A3B97DC45488F881C4862BB5C33"><enum>(ii)</enum><text>priority
research and survey efforts that are needed to identify factors that may assist
in the restoration and improved conservation of those species and
habitats;</text>
</clause></subparagraph><subparagraph id="H3B6FA1450CAA4D1E928E7D38CC4D0184"><enum>(D)</enum><text>a description of
conservation actions proposed to conserve the identified species and habitats
and priorities for implementing the actions;</text>
</subparagraph><subparagraph id="H6E46622E5F88401F84B797F320889DCD"><enum>(E)</enum><text>a proposed plan
for monitoring species identified under subparagraph (A) and the habitats of
the species, for—</text>
<clause id="id1C296CFAD8814FAABA6D65D76044B8D1"><enum>(i)</enum><text>monitoring the
effectiveness of the conservation actions proposed under subparagraph (D);
and</text>
</clause><clause id="id40EF238C26194A5689A0230935C3CB23"><enum>(ii)</enum><text>adapting the
conservation actions to respond appropriately to new information or changing
conditions;</text>
</clause></subparagraph><subparagraph id="HEA1B9173BA8749A3B3008C6800A2D6D"><enum>(F)</enum><text>a description of
procedures to review the comprehensive wildlife conservation plan at intervals
of not to exceed 10 years;</text>
</subparagraph><subparagraph id="H7F4AA4985EAE413B86D15449A6CAD540"><enum>(G)</enum><text>a plan for
coordinating the development, implementation, review, and revision of the
comprehensive wildlife conservation plan with Federal, State, and local
agencies and Indian tribes that manage significant land and water areas within
the jurisdiction or administer programs that significantly affect the
conservation of identified species and habitats; and</text>
</subparagraph><subparagraph id="H94DDC79F691C4B80AD87EB59B3DE95EA"><enum>(H)</enum><text>provisions that
provide an opportunity for broad public participation as an essential element
of the development, revision, and implementation of the comprehensive wildlife
conservation plan.</text>
</subparagraph></paragraph></subsection><subsection id="HFEAC03341E4F440AA1C3B72529BE8C7B"><enum>(e)</enum><header>Existing
strategies and activities</header>
<paragraph id="id892843B678BF417AA9BB413C0CC7DC9A"><enum>(1)</enum><header>Strategies</header><text>A
State comprehensive wildlife strategy that was approved by the Secretary
pursuant to a provision of law in effect on the day before the date of
enactment of this Act shall remain in effect until the authority for the
strategy expires or is revised in accordance with the terms of the
strategy.</text>
</paragraph><paragraph id="idDB84DFA3086343938F2B31598E7C01DD"><enum>(2)</enum><header>Activities</header><text>Except
as specified in section 114(c), funds made available under this section may be
used to carry out conservation and education activities conducted or proposed
to be conducted pursuant to a strategy described in paragraph (1).</text>
</paragraph></subsection><subsection id="H94BF2DDFE33D40A4B566AEC51F257B9C"><enum>(f)</enum><header>Authorization of
appropriations</header><text>There are authorized to be appropriated such sums
as are necessary to carry out this section.</text>
</subsection></section></subtitle><enum>II</enum><header>Ocean
programs</header>
<section id="IDcf73ceea3d07483786b2978b5d3786ec"><enum>201.</enum><header>Short
title</header><text display-inline="no-display-inline">This title may be cited
as the <quote><short-title>Global Warming and
Acidification Coastal and Ocean Resiliency Act</short-title></quote>.</text>
</section><section id="ID0e706ca65b1443f080bf18327ab8b10a"><enum>202.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="IDa3a7fdc063ce45ffb81167c2dc2cad27"><enum>(1)</enum><text>healthy, diverse,
and productive coastal, ocean, and Great Lakes ecosystems, communities, and
habitats are critical to securing the full range of natural resource benefits
for the United States;</text>
</paragraph><paragraph id="ID753843e5d03545ff9bb4a4d1c58bec22"><enum>(2)</enum><text>healthy
ecosystems are more resilient than degraded ecosystems;</text>
</paragraph><paragraph id="IDd01e6ab741bf4d249526b13db12feee0"><enum>(3)</enum><text>resilient
ecosystems can better adapt to changing environmental conditions, including
global warming and ocean acidification;</text>
</paragraph><paragraph id="ID5ef977ff5c6f473f9839250b28400995"><enum>(4)</enum><text>the effects of
global warming, including relative sea level rise and ocean acidification pose
significant threats to healthy ocean, coastal, and Great Lakes ecosystems;
and</text>
</paragraph><paragraph id="IDad1f2b6270804571bb01c1d2eafb813f"><enum>(5)</enum><text>policies and
programs designed to ensure the recovery, resilience, and health of coastal,
ocean, and Great Lakes ecosystems and the resources of the ecosystems in the
face of environmental change are an urgent national priority.</text>
</paragraph></section><subtitle id="id8EA29FF336B84954BA2B1F7AACA9DD4F"><enum>A</enum><header>National policy
for ocean, coastal, and Great Lakes ecosystem health and resiliency</header>
<section id="ID8dd9c391c76343c48fc6c431695caf44"><enum>211.</enum><header>National
policy on ocean, coastal, and great lakes ecosystem health and
resiliency</header><text display-inline="no-display-inline">It is the policy of
the Federal Government, in cooperation with State, tribal, and affected local
governments, other concerned public and private organizations, coastal and
ocean resource users, and citizens to take effective measures—</text>
<paragraph id="ID5b3239c1ed134c8794ef7738d335a146"><enum>(1)</enum><text>to ensure the
recovery, resiliency, and health of ocean, coastal, and Great Lakes
ecosystems;</text>
</paragraph><paragraph id="ID0ca1e093cb6e463d85e150a671e94e1d"><enum>(2)</enum><text>to predict, plan
for, and mitigate the impact on coastal, ocean, and Great Lakes ecosystems from
global warming, including relative sea level rise, and from ocean
acidification;</text>
</paragraph><paragraph id="id4E596E2CAED045E599E4292513D12830"><enum>(3)</enum><text>to plan for and
mitigate the impact of the development of offshore alternative energy resources
and appropriate carbon capture and sequestration activities; and</text>
</paragraph><paragraph id="IDa50cef554ed04ec294430a482733883b"><enum>(4)</enum><text>to cooperate and
collaborate to support improved and enhanced ocean and coastal management in
the United States.</text>
</paragraph></section><section id="HCB916E6C4BEC46C7A6E1D88495232321"><enum>212.</enum><header>
National ocean, coastal, and Great Lakes resiliency strategy</header>
<subsection id="HD52240B99859414CA709A593FC78274F"><enum>(a)</enum><header>Requirement</header>
<paragraph id="id2BF928FB571D450EBF9E3E99A922E086"><enum>(1)</enum><header>In
general</header><text>Not later than 2 years after the date of enactment of
this Act, the Secretary of Commerce (referred to in this title as the
<quote>Secretary</quote>) shall implement the national policy under section 211
by establishing a national strategy to protect, maintain, and restore coastal
and marine ecosystems so that the ecosystems are more resilient and better able
to withstand the additional stresses associated with global warming, including
relative sea level rise, and with ocean acidification.</text>
</paragraph><paragraph id="id206F52463BD64509AAED00518D27299E"><enum>(2)</enum><header>Measures</header><text>In
establishing the national strategy, the Secretary shall provide for research
and design of practical measures—</text>
<subparagraph id="idC86AAFC3969F45C6861E8CA4D380B5FE"><enum>(A)</enum><text>to avoid,
alleviate, or mitigate the impact of global warming, including relative sea
level rise, and of ocean acidification on ocean, coastal, and Great Lakes
ecosystems and resources in the United States; and</text>
</subparagraph><subparagraph id="id98C3A85924FB49409BE175829190C0BC"><enum>(B)</enum><text>to ensure the
recovery, resiliency, and health of ocean, coastal, and Great Lakes
ecosystems.</text>
</subparagraph></paragraph><paragraph id="H94743FA4AFE2413699EBA41C386B37"><enum>(3)</enum><header>Administration</header><text>Before
and during the development of the national strategy, the Secretary
shall—</text>
<subparagraph id="id9A8C1F0227D74A4F933D6C24D0EA3AB6"><enum>(A)</enum><text>base the national
strategy on the best available science;</text>
</subparagraph><subparagraph id="H34FAC82C714D422BA0A2594420CB1F9"><enum>(B)</enum><text>consult
with—</text>
<clause id="id1DE24F921AED4501A6DD96A03907633A"><enum>(i)</enum><text>the
Secretary of the Interior;</text>
</clause><clause id="id0C23F07EDEC047BC917C978B6CD75948"><enum>(ii)</enum><text>the
Administrator of the Environmental Protection Agency;</text>
</clause><clause id="id2B36BFB7479941979CE1E2B99E2A602E"><enum>(iii)</enum><text>Regional
Fishery Management Councils;</text>
</clause><clause id="id45C439819B004652B9F6F957AF39B0F9"><enum>(iv)</enum><text>State coastal
management and fish and wildlife agencies;</text>
</clause><clause id="idFEAFD5E413D544FFA0F087090EBAF70A"><enum>(v)</enum><text>Indian
tribes;</text>
</clause><clause id="idAD994AC3CC3E4167B6215710EDA11DCC"><enum>(vi)</enum><text>local
governments;</text>
</clause><clause id="id251A0ACF99B64F95B6EAF1EA735CCE0B"><enum>(vii)</enum><text>conservation
organizations;</text>
</clause><clause id="idBF7C5798FA4242F9B7C9D287CF2A0DC4"><enum>(viii)</enum><text>scientists;
and</text>
</clause><clause id="idAC93B8E8D7E84A4DB4823659EF422186"><enum>(ix)</enum><text>other interested
stakeholders; and</text>
</clause></subparagraph><subparagraph id="HBBBD599ABCBF418DA55C50CFE03B95BD"><enum>(C)</enum><text>provide public
notice and opportunity for comment.</text>
</subparagraph></paragraph></subsection><subsection id="HBD8AE39BC7F14278A960383B3DA31527"><enum>(b)</enum><header>Contents</header>
<paragraph id="id64C544A916F541738586285E1DCA3DA7"><enum>(1)</enum><header>In
general</header><text>The Secretary shall include in the national strategy
prioritized goals and measures and a plan for implementation (including a
timeframe)—</text>
<subparagraph id="H0C74436EDB1540A9B04F695119DFB5C1"><enum>(A)</enum><text>to incorporate
climate change adaptation strategies into the planning and management of ocean
and coastal programs and resources administered by the Department of
Commerce;</text>
</subparagraph><subparagraph id="IDbf41149be1394a07819009c09790f59f"><enum>(B)</enum><text>to incorporate
the strategies into the planning and management of ocean and coastal resources
administered by Federal and non-Federal governmental entities other than the
Department of Commerce;</text>
</subparagraph><subparagraph id="ID796c9ea41ac74f61a620ed1b254d6cc9"><enum>(C)</enum><text>to support
predictions of relative sea level rise;</text>
</subparagraph><subparagraph id="ID96340ae5d04a49c0aef6d143829916c9"><enum>(D)</enum><text>to protect,
maintain, and restore coastal and marine ecosystems so that the ecosystems are
more resilient and better able to withstand the additional stresses associated
with global warming, including relative sea level rise, and with ocean
acidification;</text>
</subparagraph><subparagraph id="ID48aee2449feb42f6815c279221c2308f"><enum>(E)</enum><text>to protect ocean
and coastal species from the impact of global warming and ocean
acidification;</text>
</subparagraph><subparagraph id="ID35dfb44efcc44f21bad2b60b734c6b7e"><enum>(F)</enum><text>to incorporate
adaptation strategies for relative sea level rise into coastal zone
planning;</text>
</subparagraph><subparagraph id="IDbe6b409222254680bee0869e25b5b50e"><enum>(G)</enum><text>to protect and
restore ocean and coastal habitats to build healthy and resilient ecosystems,
including the purchase of coastal and island land; and</text>
</subparagraph><subparagraph id="IDc95724f68d634b469a3d42185232fab9"><enum>(H)</enum><text>to promote the
development of plans to mitigate at the community level the economic
consequences of global warming, including relative sea level rise and ocean
acidification.</text>
</subparagraph></paragraph><paragraph id="HB80A8649E830441F88239E3CF0998231"><enum>(2)</enum><header>Coordination
with other plans</header><text>In developing the national strategy, the
Secretary shall, to the maximum extent practicable—</text>
<subparagraph id="HADDAF5E90FE140F287BBDC81B288A201"><enum>(A)</enum><text>take into
consideration research and information contained in—</text>
<clause id="idBF5B60C3590E4714A400255E294D55D1"><enum>(i)</enum><text>Federal,
regional, and State management and restoration plans;</text>
</clause><clause id="idE873AE79C8D0420CAB044116E131E668"><enum>(ii)</enum><text>the reports of
the Pew Oceans Commission and the United States Commission on Ocean Policy;
and</text>
</clause><clause id="idCCBCB36DF19C446CBE9ACE2B82C812B4"><enum>(iii)</enum><text>any other
relevant reports and information; and</text>
</clause></subparagraph><subparagraph id="HABAD6DF2D3D54649885B07567C2DF8C1"><enum>(B)</enum><text>encourage and take
into account regional plans for protecting and restoring the health and
resilience of ocean and coastal ecosystems, including the Great Lakes.</text>
</subparagraph></paragraph></subsection><subsection id="H82BE1F2034B3493198E6A70400935CDC"><enum>(c)</enum><header>Revisions</header><text>Not
later than 5 years after the date of the initial establishment of the national
strategy and each 10 years thereafter, the Secretary shall revise the national
strategy to reflect—</text>
<paragraph id="idD68A8CD5E123475AB2977636B4365206"><enum>(1)</enum><text>new information
on the impact of global warming, including relative sea level rise, and of
acidification on ocean, coastal and Great Lakes ecosystems and the resources of
the ecosystems; and</text>
</paragraph><paragraph id="idB2538463A6464BDFB6295CBDAA382E54"><enum>(2)</enum><text>advances in the
development of strategies for adapting to or mitigating for the impact.</text>
</paragraph></subsection><subsection id="ID10aea45718b64092b9058a829be09bb7"><enum>(d)</enum><header>Implementation</header><text>To
achieve the goals of the national strategy, each Federal agency shall (directly
and in cooperation with other agencies) implement measures for the conservation
of ocean, coastal, and Great Lakes ecosystems under the jurisdiction of the
Federal agency that promote the national strategy established under this
section.</text>
</subsection></section><section id="H8D86EAED476F426F9327B5E770511BC8"><enum>213.</enum><header>Advisory
Board</header>
<subsection id="ID2c5f17acb469482c9c47705b7efdce6d"><enum>(a)</enum><header>In
general</header><text>The Secretary shall establish and appoint the members of
an Advisory Board that is composed of not less than 10, and not more than 20,
members recommended by the President of the National Academy of Sciences with
expertise in ocean, coastal, and Great Lakes biology, ecology, fisheries,
climate change, ocean acidification, and other relevant disciplines, including
economics at the community level.</text>
</subsection><subsection id="ID6e3f1057cf2c48a49b164d1d6815702b"><enum>(b)</enum><header>Function</header><text>The
Advisory Board shall—</text>
<paragraph id="ID7842919163fa433189f03733a51043e6"><enum>(1)</enum><text>provide
scientific and technical advice and recommendations to the Secretary on—</text>
<subparagraph id="id13AB158EA2434D11AF37829C8A0501F6"><enum>(A)</enum><text>the impact of
global warming, including relative sea level rise, and of acidification on
ocean and coastal ecosystems, resources, ecological and coastal communities,
and habitats; and</text>
</subparagraph><subparagraph id="ID1a3143ffc74949b397235d5d008bf51e"><enum>(B)</enum><text>strategies and
mechanisms to mitigate the impact of global warming, including relative sea
level rise, and of acidification on ocean and coastal ecosystems;</text>
</subparagraph></paragraph><paragraph id="IDdca6e97b073f4a9ca6eb291ea46076d2"><enum>(2)</enum><text>advise the
Secretary on priorities for research or information collection; and</text>
</paragraph><paragraph id="IDddf048b80ee143de8b888dbbe9588c61"><enum>(3)</enum><text>advise the
Secretary on priority needs for achieving systematic improvements in ocean and
coastal resiliency for the purposes of section 212.</text>
</paragraph></subsection></section><section id="ID47d00b322b3b415aabd5d7b687bf5753"><enum>214.</enum><header>Implementation
of national strategy</header>
<subsection id="IDed4dc16f2569411a9aa1f1e0d68c5f29"><enum>(a)</enum><header>In
general</header><text>Of the amount that is made available to carry out this
subtitle for each fiscal year—</text>
<paragraph id="id4D7E834F2F704440AB25FEB96550FC22"><enum>(1)</enum><text>40 percent shall
be made available for the carrying out of Federal responsibilities to develop
and implement the national strategy established under section 212; and</text>
</paragraph><paragraph id="id9E3FF95E7F5C452C9C6DEDD862A28801"><enum>(2)</enum><text>60 percent shall
be used to make grants under subsection (b).</text>
</paragraph></subsection><subsection id="ID0b5e77b2a09c496896723d90d1125007"><enum>(b)</enum><header>Grants</header>
<paragraph id="ID1551ff772fed4848a379ed0a392e4481"><enum>(1)</enum><header>In
general</header><text>The Secretary shall make grants to eligible entities to
pay the Federal share (as determined by the Secretary) to carry out activities
that contribute to or result in protecting, maintaining, or restoring the
resilience and health of coastal, ocean, and Great Lakes ecosystems and
resources, including planning and scientific research to support such
purposes.</text>
</paragraph><paragraph id="IDc402342ad0f4457e9bfc341130a43f00"><enum>(2)</enum><header>Eligible
entities</header><text>To be eligible to receive a grant under this subsection,
an entity shall be—</text>
<subparagraph id="idC61AE29E329147CE911B46CE366B2A21"><enum>(A)</enum><text>a Federal
agency;</text>
</subparagraph><subparagraph id="id6965CE1238A94551AFA0B3E090F38CBA"><enum>(B)</enum><text>an agency of a
State or political subdivision;</text>
</subparagraph><subparagraph id="idE72F4634F0074F828A8C0AABEA42890B"><enum>(C)</enum><text>a regional
partnership;</text>
</subparagraph><subparagraph id="idB6A7E01EE2384A0C82EB5A8D70485866"><enum>(D)</enum><text>an Indian
tribe;</text>
</subparagraph><subparagraph id="id217FAC85292643AFAA8F409B0DE94715"><enum>(E)</enum><text>an institution of
higher education; or</text>
</subparagraph><subparagraph id="idC72DE3A584784D538E3EE95222A050C5"><enum>(F)</enum><text>a nongovernmental
organization.</text>
</subparagraph></paragraph><paragraph id="ID67f7056acd814aad96290391f357b5d4"><enum>(3)</enum><header>Eligible
uses</header><text>A grant provided under this subsection may only be used to
carry out an activity described in paragraph (1) that is approved by the
Secretary.</text>
</paragraph><paragraph id="IDf6da82a2e5cd45bc860464f327198d47"><enum>(4)</enum><header>Prioritization</header><text>In
approving applications under this subsection, the Secretary shall give priority
to proposals that—</text>
<subparagraph id="IDe5a335a0d3fb4ba79d72761114f6dedc"><enum>(A)</enum><text>implement
measures to enhance the health or resilience of coastal, ocean, or Great Lakes
areas of national significance, including biological, historical, and cultural
measures;</text>
</subparagraph><subparagraph id="ID63f17bc92de244bd88e214db87fce57c"><enum>(B)</enum><text>result in
systematic improvements to the resilience and health of coastal and ocean
ecosystems and resources;</text>
</subparagraph><subparagraph id="IDf6d14433b3fa4affba76b55c19c379d6"><enum>(C)</enum><text>are sufficiently
cooperative and broad in geographic scope to address the problem or need;
and</text>
</subparagraph><subparagraph id="ID81e515515bdf47a5ae74ccf340c5e572"><enum>(D)</enum><text>demonstrate
cost-effectiveness based on ecosystems services provided per dollar of Federal
expenditure, including consideration of the potential for a funding
match.</text>
</subparagraph></paragraph><paragraph id="ID024ef2d4b8594f5ea2c906f2eaec6d2b"><enum>(5)</enum><header>Guidance</header><text>The
Secretary shall issue guidance regarding a process for—</text>
<subparagraph id="idD06567B7D748480093A3F154CCD7A140"><enum>(A)</enum><text>the approval or
disapproval of applications for grants under this subsection, including
opportunities for public comment; and</text>
</subparagraph><subparagraph id="id885834203137479486E2B096FEB8C721"><enum>(B)</enum><text>the establishment
of annual and multiyear national funding priorities.</text>
</subparagraph></paragraph><paragraph id="ID6b9ad2a617b84558adf19df41a6e2511"><enum>(6)</enum><header>Evaluation</header>
<subparagraph id="id2A1F604555A2452E8EB245C9E2DC9021"><enum>(A)</enum><header>In
general</header><text>The Secretary shall establish a system to provide for an
annual external evaluation of each grant that measures the progress of
implementation of the grant against the goals and objectives of the grant
project.</text>
</subparagraph><subparagraph id="id36E38D360E074A2AA8C5C057DADDADD0"><enum>(B)</enum><header>Public
availability</header><text>The Secretary shall make the results of the
evaluations publicly available.</text>
</subparagraph></paragraph></subsection></section><section id="id2E338B4941704B4F91D036661F56FE93"><enum>215.</enum><header>Reports</header>
<subsection id="IDd68ab5b871694e16b20e6c83bf33f18e"><enum>(a)</enum><header>National
academy of sciences</header><text>The Secretary shall enter into an arrangement
with the National Academy of Sciences under which the Academy shall report to
Congress, not later than 2 years after the date of enactment of this Act, on
the current and projected impact of global warming, including relative sea
level rise, of ocean acidification, and on effective mitigation strategies for
the ocean, coastal, and Great Lakes ecosystems and resources of the United
States.</text>
</subsection><subsection id="HAEAE51418EC748FDBA6549492D13A000"><enum>(b)</enum><header>Report to
Congress</header><text>The Secretary shall make available to Congress a copy of
the strategy and implementation plan established under this subtitle (including
any updates to the strategy and plan).</text>
</subsection></section><section id="ID7fb12db014b8445a9e5c72f46f93961c"><enum>216.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated such sums as are necessary to carry out this
subtitle.</text>
</section></subtitle><subtitle id="idDC85943316C44B609A9052BF0DA5AF73"><enum>B</enum><header>Planning for
climate change in coastal zone</header>
<section id="H40DEB29C06214AA885E2C7EFE700975F"><enum>221.</enum><header>Planning for
climate change in coastal zone</header>
<subsection id="HEF34CC35C3284BCA859D6432C23E0002"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Coastal Zone
Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451 et seq.</external-xref>) is amended
by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="id4631A64732D64C56AF602C97AC7C5A73" style="OLC">
<section id="id465158CB8B434D928739C620532F9F4E"><enum>320.</enum><header>Climate change
resiliency planning</header>
<subsection id="id036E63B1B06F4D60825F3C651F4E7267"><enum>(a)</enum><header>Definitions</header><text>In
this section, the terms <term>ecological processes</term>,
<term>habitat</term>, and <term>wildlife</term> have the meanings given those
terms in section 2 of the <short-title>Global Warming
Wildlife Survival Act</short-title>.</text>
</subsection><subsection id="id9FB41880703142F190CA6ABBF685D5BF"><enum>(b)</enum><header>Program</header><text>The
Secretary shall establish, consistent with the national policies established
under section 303, a coastal climate change resiliency planning and response
program to—</text>
<paragraph id="H9E2770734D10426CA1E7B9F7A8EFFA28"><enum>(1)</enum><text>provide assistance
to coastal states to develop and implement coastal climate change resiliency
plans pursuant to approved management programs approved under section 306, to
prepare for and reduce, in an environmentally sensitive manner, the negative
consequences to the coastal zone that may result from global warming and ocean
acidification; and</text>
</paragraph><paragraph id="HA7DF5A69CDE34C1DBB58C4ABEE97BDF9"><enum>(2)</enum><text>provide financial
and technical assistance and training to enable coastal states to implement
plans developed pursuant to this section through enforceable policies of the
coastal states.</text>
</paragraph></subsection><subsection id="HD7FBDE11324449F1A7F8B922CE512468"><enum>(c)</enum><header>Guidelines</header><text>Not
later than 180 days after the date of enactment of this section, the Secretary,
in consultation with the coastal states, shall issue guidelines for the
implementation of the grant program established under subsection (d).</text>
</subsection><subsection id="HAC16CF58382F4355A00638D566915EB7"><enum>(d)</enum><header>Climate change
resiliency planning grants</header>
<paragraph id="H1CCC7435B09B452C849573EE3F981700"><enum>(1)</enum><header>In
general</header><text>Subject to the availability of appropriations, the
Secretary may make a grant to any coastal state for the purpose of developing
and implementing climate change resiliency plans pursuant to guidelines issued
by the Secretary under subsection (c).</text>
</paragraph><paragraph id="H8CD331CFA49645A49E46135F05007BF0"><enum>(2)</enum><header>Plan
content</header>
<subparagraph id="id04EF8E9132184E35AE2C97425A8D8FF4"><enum>(A)</enum><header>In
general</header><text>A plan developed with a grant under this section shall
include adaptation strategies for fish and wildlife, fish and wildlife habitat,
and associated ecological process as are necessary to assist fish and wildlife,
fish and wildlife habitat, and associated ecological processes to adapt to,
become resilient to, and mitigate the impact of, global warming and ocean
acidification.</text>
</subparagraph><subparagraph id="id7E56F3EEE5894BB8969B8C603C1E6574"><enum>(B)</enum><header>Inclusions</header><text>The
plans shall specifically include—</text>
<clause id="H15792DD1A0A54A999E4762D1385C13D2"><enum>(i)</enum><text>adaptive
management strategies for land and water use to respond or adapt to changing
environmental conditions, including strategies to protect biodiversity and
establish habitat buffer zones, migration corridors, and climate refugia;
and</text>
</clause><clause id="H8744A1DACB8B493CA03E767679508386"><enum>(ii)</enum><text>requirements—</text>
<subclause id="id98D5818E2F90468E8805190F10010446"><enum>(I)</enum><text>to initiate and
maintain long-term monitoring of environmental change to assess coastal zone
resiliency; and</text>
</subclause><subclause id="id507F24293C2B4EB496C9266284AA2D85"><enum>(II)</enum><text>if necessary, to
adjust adaptive management strategies and new planning guidelines to attain the
policies under section 303.</text>
</subclause></clause></subparagraph></paragraph><paragraph id="HD6CFFE02F2AF4FA79E10FFE95BB457E2"><enum>(3)</enum><header>Allocation</header><text>Grants
under this section shall be—</text>
<subparagraph id="id708E7707DFB0443295C6296E752EAD97"><enum>(A)</enum><text>available only to
coastal states with management programs approved by the Secretary under section
306; and</text>
</subparagraph><subparagraph id="id7F694C5F49C34D97A09D16F74F73A8DD"><enum>(B)</enum><text>allocated among
the coastal states in a manner consistent with regulations promulgated pursuant
to section 306(c).</text>
</subparagraph></paragraph><paragraph id="H7A61C4BD41D148F7B0461E7CF247000"><enum>(4)</enum><header>Priority</header><text>In
the awarding grants under this subsection, the Secretary may give priority to
any coastal state that has received grant funding to develop program changes
pursuant to paragraphs (1), (2), (3), (5), (6), (7), and (8) of section
309(a).</text>
</paragraph><paragraph id="H4F572C1FC2634D7896A13BBA253C5924"><enum>(5)</enum><header>Technical
assistance</header><text>The Secretary may provide technical assistance to a
coastal state (consistent with section 310) to ensure the timely development of
plans supported by grants awarded under this subsection.</text>
</paragraph><paragraph id="HFE17E96ECD0348CCB84254EAE15C6FD3"><enum>(6)</enum><header>Federal
approval</header><text>In order to be eligible for a grant under subsection
(e), a coastal state shall have the plan of the coastal state developed under
this section approved by the Secretary.</text>
</paragraph></subsection><subsection id="H6EC856B9B2974845B5B55B371311DB1F"><enum>(e)</enum><header>Coastal
resiliency project grants</header>
<paragraph id="HBBE4AC6258CE40309400D88B7E78AB31"><enum>(1)</enum><header>In
general</header><text>Subject to the availability of appropriations, the
Secretary may make grants to any coastal state that has a climate change
resiliency plan approved under subsection (d)(6) for implementation of the
plan.</text>
</paragraph><paragraph id="HE72918EFF3A749ECB19459FED62E0131"><enum>(2)</enum><header>Program
requirements</header>
<subparagraph id="id498493ACF2574030B25E86BAB51B823C"><enum>(A)</enum><header>In
general</header><text>Not later than 90 days after the date of approval of the
first plan approved under subsection (d)(6), the Secretary shall publish in the
Federal Register requirements regarding applications, allocations, eligible
activities, and all terms and conditions for grants awarded under this
subsection.</text>
</subparagraph><subparagraph id="idE285524583D14D9987F92C172D54744A"><enum>(B)</enum><header>Merit-based
awards</header><text>No less than 30 percent of the funds made available for
any fiscal year for grants under this subsection shall be awarded through a
merit-based competitive
process.</text>
</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="HBDB783A01941483EB6FE9E357FFB21AD"><enum>(b)</enum><header>Authorization of
appropriations</header><text display-inline="yes-display-inline">Section 318(a)
of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1464">16 U.S.C. 1464(a)</external-xref>) is
amended—</text>
<paragraph id="id8AF8A4ACD265463B9B4F7AF369D90A32"><enum>(1)</enum><text>in paragraph (1),
by striking <quote>and</quote> at the end;</text>
</paragraph><paragraph id="id0147D17355F4450AA50D55B54B1D21F2"><enum>(2)</enum><text>in paragraph (2),
by striking the period at the end and inserting <quote>; and</quote>;
and</text>
</paragraph><paragraph id="id11D827455A4D40D6A72A6C8F33D67AA6"><enum>(3)</enum><text>by adding by
adding at the end the following:</text>

</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection></section></subtitle><enum>III</enum><header>Special
imperiled species programs</header>
<section id="id07A83833591943A48D5E4CC8EF64295B"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="ID2f541c5e22b140d48c40c1795b9e08a6"><enum>(1)</enum><header>Director</header><text>The
term <term>Director</term> means the Director of the United States Geological
Survey.</text>
</paragraph><paragraph id="id2FA168D2DAD24DB7A69C01A95FA21D97"><enum>(2)</enum><header>Ecosystem</header><text>The
term <term>ecosystem</term> means any complex of a plant, animal, fungal, and
microorganism community and the associated nonliving environment of the
community that interacts as an ecological unit, including the species and the
viability of species within the community.</text>
</paragraph><paragraph id="IDfea9e237dd3e45f4ab4df24de914043f"><enum>(3)</enum><header>Imperiled
species</header><text>The term <term>imperiled species</term> means—</text>
<subparagraph id="id72759C010D2A4C02ACDF38CEF3B25686"><enum>(A)</enum><text>a species listed
as an endangered species or threatened species under the
<act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16
U.S.C. 1531 et seq.);</text>
</subparagraph><subparagraph id="id6CEB32863850428C8FE2F32D46AF8C77"><enum>(B)</enum><text>a species
proposed for listing under that Act;</text>
</subparagraph><subparagraph id="idB7B29D04D2D743F891A9676B042D3A2F"><enum>(C)</enum><text>a candidate
species under that Act.;</text>
</subparagraph><subparagraph id="id94AE2A00E4CE4F82B4F35AB478649D98"><enum>(D)</enum><text>a species listed
as an endangered species under any State law; and</text>
</subparagraph><subparagraph id="id9437E30C87814B9D9673CB043AE1FD73"><enum>(E)</enum><text>a species, the
population of which is declining at a significant rate.</text>
</subparagraph></paragraph></section><section id="id13164EBA498B4FCEBEF6A913C230E129"><enum>302.</enum><header>Regional
ecological symposia</header>
<subsection id="ID3ad39cac555345379c5bfc31ee91490e"><enum>(a)</enum><header>In
general</header><text>Not later than 18 months after the date of enactment of
this Act, the Director, in coordination with the Director of the United States
Fish and Wildlife Service and the Director of the National Marine Fisheries
Service, shall convene multiple regional scientific symposia to examine the
ecological impact of global warming on each imperiled species in each ecosystem
of the United States.</text>
</subsection><subsection id="id4326449695ED40D283027ABA014432EA"><enum>(b)</enum><header>Composition</header><text>A
symposium convened in a region shall include—</text>
<paragraph id="IDbc95916735f84817addd2469b7bc9655"><enum>(1)</enum><text>scientific
representatives from Federal agencies with species- or ecosystem-related
activities in the region;</text>
</paragraph><paragraph id="id8932B78BED784596909BF0D9C3C470B2"><enum>(2)</enum><text>if appropriate,
scientists or technical experts representing State, local, and tribal
governments; and</text>
</paragraph><paragraph id="IDda8602f54f90435788bee1d4ae2b717f"><enum>(3)</enum><text>scientific
experts from institutions of higher education and scientific societies, and any
other independent scientists with sufficient qualifications and credentials,
particularly with respect to site-specific ecological conditions and the status
of species and ecological communities of concern in the region.</text>
</paragraph></subsection><subsection id="id93FBB4263A874AB5BA9E732CAC85D947"><enum>(c)</enum><header>Duties</header><text>A
symposium convened in a region shall—</text>
<paragraph id="ID150ffef3881b4ab297aac0bf2933c41e"><enum>(1)</enum><text>identify and
assess fish, wildlife, and plant species, the habitats of the species, and the
natural processes, ecosystems, and landscapes that support the habitats, that
are most imperiled by global warming; and</text>
</paragraph><paragraph id="id725FFF34FEBD4D5D8E99F789C3069E05"><enum>(2)</enum><text>focus on
imperiled species that are located on public land, declining migratory birds
species, and other species that are protected by treaty or international
agreement.</text>
</paragraph></subsection></section><section id="id72BE0B3BB5B14279973DE3E056AB19B5"><enum>303.</enum><header>National
Academy of Sciences report</header>
<subsection id="IDb05c2558cebd436682a19b9f7f5f9a73"><enum>(a)</enum><header>In
general</header><text>As soon as practicable after the date of enactment of
this Act, the Secretary of the Interior shall enter into an arrangement with
the National Academy of Sciences under which the Academy shall convene a
panel—</text>
<paragraph id="idBD694869034848F290488E0923343095"><enum>(1)</enum><text>to examine and
analyze the reports, data, documents, and other information created by the
multiple regional scientific symposia convened in accordance with section
302(a); and</text>
</paragraph><paragraph id="id4C6B2166C4D74E41BBD9662E14C4B5DB"><enum>(2)</enum><text>to prepare a
report that takes into consideration each report, data, document, and other
item of information described in paragraph (1).</text>
</paragraph></subsection><subsection id="id9E4B5FE98C8C427488B71034807DA9CF"><enum>(b)</enum><header>Contents of
report</header><text>The report required under subsection (a)(2) shall
include—</text>
<paragraph id="ID56a55ad128bc4886af4778dced0bda8c"><enum>(1)</enum><text>an identification
and assessment of—</text>
<subparagraph id="id58E17E6B76F64DC193F0D8FCEBD9A348"><enum>(A)</enum><text>the impact of
global warming on each imperiled species and ecosystem in the United States
(including the territories of the United States); and</text>
</subparagraph><subparagraph id="ID270719337a564a7681782195871a6250"><enum>(B)</enum><text>different
ecological scenarios that may result from different intensities, rates, and
other critical manifestations of global warming;</text>
</subparagraph></paragraph><paragraph id="IDcda82cccc6e94307859a723b7e2fe20a"><enum>(2)</enum><text>recommendations
for specific roles to be played by Federal, State, local, and tribal agencies
and private parties in assisting imperiled species in adapting to, and
surviving the impacts of, climate change, including a recommended list of
prioritized remediation actions by those agencies and parties; and</text>
</paragraph><paragraph id="ID63bb6a0423ff439e81bb43ae6fc5125f"><enum>(3)</enum><text>other relevant
ecological information.</text>
</paragraph></subsection><subsection id="IDc8126efa15af4c60bb1e9f3c62e2936e"><enum>(c)</enum><header>Public
availability</header><text>The recommendations and report required under this
section shall be made available to the public as soon as practicable after the
recommendations and report are complete.</text>
</subsection><subsection id="idBDB08D65AF2146BAB5AE0BC8E595DABE"><enum>(d)</enum><header>Use of report
by certain heads of Federal agencies</header><text>The Secretary of
Agriculture, the Secretary of Commerce, and the Secretary of the Interior, in
carrying out each national policy described in sections 111 and 211, shall take
into account the recommendations and report required under this section.</text>
</subsection></section>
