<official-title>To amend the Clean Air Act to increase the renewable content of gasoline, and for other purposes.</official-title>

<section id="idDB3552BF82BC4EBB86F59FC893E4BE33" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Renewable Fuel Standard Extension Act of 2007</short-title></quote>.</text> </section> 
<section id="id4BE73B49E97F467B92E42CA18E82E964"><enum>2.</enum><header>Renewable content of gasoline</header> 
<subsection id="idDD1979C560FF4377930BA45E52730F12"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="IDbaae19e31ffe4269979b154e897eac59"><enum>(1)</enum><text>the renewable fuel standard established under section 211(o) of the Clean Air Act (42 U.S.C. 7545(o)) is one of the most significant steps taken by Congress to increase domestic biofuels production and decrease the dangerous dependence of the United States on foreign oil;</text> </paragraph> 
<paragraph id="ID157f49d197964b0b829e192e1dc8c092"><enum>(2)</enum><text>in the 12 years after 1992, domestic ethanol production increased by 2,000,000,000 gallons;</text> </paragraph> 
<paragraph id="idB899A1C7397541D38A2503B7AF3A9812"><enum>(3)</enum><text>in only 2 years following the establishment of the renewable fuel standard, ethanol production has increased by 5,000,000,000 gallons;</text> </paragraph> 
<paragraph id="IDdcb6cde166d84fbd8374a51e29045281"><enum>(4)</enum><text>the renewable fuel standard has spurred investment and resulted in ethanol production that surpassed Federal targets 5 years ahead of schedule;</text> </paragraph> 
<paragraph id="IDede31829a0ff46d3a4ad51fffe4671c5"><enum>(5)</enum><text>the failure of the petroleum industry to install pumps so that ethanol is available to motorists and the failure of the automotive industry to manufacture ethanol-capable vehicles, as compared to rising ethanol production volumes, has prevented fuel ethanol from reaching consumers;</text> </paragraph> 
<paragraph id="ID1ffce2cf24614a97a82851cb6e9df141"><enum>(6)</enum><text>the resulting excess of ethanol in the marketplace has depressed ethanol prices and jeopardized the financial stability of the domestic renewable fuel infrastructure, particularly smaller, local, and farmer-owned ethanol plants;</text> </paragraph> 
<paragraph id="ID1d63e5a0521148849d36a88ebc085e88"><enum>(7)</enum><text>jeopardizing the existing ethanol infrastructure will put at risk 20 years of progress on a national biofuel industry and destroy the bridge to next-generation biofuel made from cellulosic feedstocks; and</text> </paragraph> 
<paragraph id="ID28a2f632864d4406a36e798abe7831b5"><enum>(8)</enum><text>it is imperative for Congress to increase the renewable fuel standard now to ensure the path towards cellulosic fuel production is not jeopardized in the short term.</text> </paragraph></subsection> 
<subsection id="idD4366470422A42219243633B4C22BA67"><enum>(b)</enum><header>Definitions</header><text>Section 211(o)(1) of the Clean Air Act (42 U.S.C. 7545(o)(1)) is amended—</text> 
<paragraph id="id653AE05F6C9B4577AD6B68F266FB4B2F"><enum>(1)</enum><text>by redesignating subparagraphs (B), (C), and (D) as subparagraphs (F), (D), and (E), respectively, and moving those subparagraphs so as to appear in alphabetical order;</text> </paragraph> 
<paragraph id="idB7821F10D34B45C3A3C16A4B903E37E9"><enum>(2)</enum><text>by striking subparagraph (A) and inserting the following:</text>

<subparagraph id="IDce34b0e97dfb440db3eb8e7dca90b8ba"><enum>(A)</enum><header>Advanced biofuel</header> 
<clause id="ID4940a310d160441681a6317f56c3d756"><enum>(i)</enum><header>In general</header><text>The term <term>advanced biofuel</term> means fuel derived from renewable biomass other than ethanol derived from corn starch.</text> </clause> 
<clause id="IDe0765b714b0e48c9bad7740d8b89e668"><enum>(ii)</enum><header>Inclusions</header><text>The term <term>advanced biofuel</term> includes—</text> 
<subclause id="idA77539AC5C984A3192B3522E38DCA647"><enum>(I)</enum><text>ethanol derived from cellulose, hemicellulose, or lignin;</text> </subclause> 
<subclause id="id332C490F03494794BC38768B75B9F8E9"><enum>(II)</enum><text>ethanol derived from sugar or starch, other than ethanol derived from corn starch;</text> </subclause> 
<subclause id="id880549ED359D42F396BEB6A5394A38C7"><enum>(III)</enum><text>ethanol derived from waste material, including crop residue, other vegetative waste material, animal waste, and food waste and yard waste;</text> </subclause> 
<subclause id="id4B5993014AFA4C50AE973F7F834ACA40"><enum>(IV)</enum><text>diesel-equivalent fuel derived from renewable biomass, including vegetable oil and animal fat;</text> </subclause> 
<subclause id="id81EA4055AC49477F934C5DEF245E1626"><enum>(V)</enum><text>biogas (including landfill gas and sewage waste treatment gas) produced through the conversion of organic matter from renewable biomass;</text> </subclause> 
<subclause id="id3ECC6A3450A9410BAA12D87A49446E73"><enum>(VI)</enum><text>butanol or other alcohols produced through the conversion of organic matter from renewable biomass; and</text> </subclause> 
<subclause id="id171F948AD5F640E8BA9829521832CB11"><enum>(VII)</enum><text>other fuel derived from cellulosic biomass.</text> </subclause></clause></subparagraph> 
<subparagraph id="ID285a0bddac5246a3a419d1e1d292711b"><enum>(B)</enum><header>Cellulosic biomass ethanol</header><text>The term <term>cellulosic biomass ethanol</term> means ethanol derived from any cellulose, hemicellulose, or lignin that is derived from renewable biomass.</text> </subparagraph> 
<subparagraph id="IDf513e9b36cc54753afd3e724bdec2168"><enum>(C)</enum><header>Renewable biomass</header><text>The term <term>renewable biomass</term> means—</text> 
<clause id="ID41d4cbec41a240c1bf6e49f9b078499c"><enum>(i)</enum><text>nonmerchantable materials or precommercial thinnings that—</text> 
<subclause id="idFD63D51108894BB48282ACCABC20491E"><enum>(I)</enum><text>are byproducts of preventive treatments, such as trees, wood, brush, thinnings, chips, and slash, that are removed—</text> 
<item id="id7A061B1F46764F12B1F8BDEB5550A461"><enum>(aa)</enum><text>to reduce hazardous fuels;</text> </item> 
<item id="id0032DE0E514D4817A8409708F61DBC82"><enum>(bb)</enum><text>to reduce or contain disease or insect infestation; or</text> </item> 
<item id="id7F187CFB158E4347B1F80116C2D01DFF"><enum>(cc)</enum><text>to restore forest health;</text> </item></subclause> 
<subclause id="id3C6922330C1B45048FA58D2E716AE72B"><enum>(II)</enum><text>would not otherwise be used for higher-value products; and</text> </subclause> 
<subclause id="idB9FF7C82F6A4405CA249BB10D1439782"><enum>(III)</enum><text>are harvested from National Forest System land or public land (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1702)), where permitted by law and in accordance with—</text> 
<item id="id079C67CB29BA4E85BEACC45F5D88C110"><enum>(aa)</enum><text>applicable land management plans; and</text> </item> 
<item id="id489A3395EC7D49DCB8F4B523BA7B103F"><enum>(bb)</enum><text>the requirements for old-growth maintenance, restoration, and management direction of paragraphs (2), (3), and (4) of subsection (e) and the requirements for large-tree retention of subsection (f) of section 102 of the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6512); or</text> </item></subclause></clause> 
<clause id="ID087e8d1356334109a578a4e31892c70e"><enum>(ii)</enum><text>any organic matter that is available on a renewable or recurring basis from non-Federal land or from land belonging to an Indian tribe, or an Indian individual, that is held in trust by the United States or subject to a restriction against alienation imposed by the United States, including—</text> 
<subclause id="idCCD8ACEEA43644AF897453783419245F"><enum>(I)</enum><text>renewable plant material, including—</text> 
<item id="idFEEBC2B2472E4B15AB872EFACC7F1ADB"><enum>(aa)</enum><text>feed grains;</text> </item> 
<item id="id3C640506690E4C1B96E758D713304758"><enum>(bb)</enum><text>other agricultural commodities;</text> </item> 
<item id="idC3FFCBC28D0F41B0B292E5492D84068F"><enum>(cc)</enum><text>other plants and trees; and</text> </item> 
<item id="idA36D1228861644119FAA79B65342DC32"><enum>(dd)</enum><text>algae; and</text> </item></subclause> 
<subclause id="idC8320B9A16F1402684042E43E6517B48"><enum>(II)</enum><text>waste material, including—</text> 
<item id="id81B6CE621D4A435DB0120F23F5B05973"><enum>(aa)</enum><text>crop residue;</text> </item> 
<item id="id05294C0C768A4A6FBB7F24E8D083EB52"><enum>(bb)</enum><text>other vegetative waste material (including wood waste and wood residues);</text> </item> 
<item id="id1A26C0698A5844DAB48E4AA3DE6CD816"><enum>(cc)</enum><text>animal waste and byproducts (including fats, oils, greases, and manure); and</text> </item> 
<item id="id2555E7FF769A4D6B840819DA77241BC3"><enum>(dd)</enum><text>food waste and yard waste.</text> </item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="id73C28D6A501746F9923B7D38F1FEE7C7"><enum>(3)</enum><text>in clause (ii) of subparagraph (D) (as redesignated by paragraph (1))—</text> 
<subparagraph id="idECC529B57F1D40D08BF9B2527DF310CC"><enum>(A)</enum><text>in subclause (I), by striking <quote>and</quote> at the end;</text> </subparagraph> 
<subparagraph id="id58E23F28A78747C69F5CC8BE1E5F1BB7"><enum>(B)</enum><text>in subclause (II), by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph> 
<subparagraph id="id4FC5AA1A6A3A478CA185B8C4415C4131"><enum>(C)</enum><text>by adding at the end the following:</text>

<subsection id="id3CA94B40777449E8B728519F2E883107"><enum>(c)</enum><header>Renewable content of gasoline</header><text display-inline="yes-display-inline">Section 211(o) of the Clean Air Act (42 U.S.C. 7545(o)) is amended—</text>

<subparagraph id="id7A286FFC44A845AA941991BA34C23650"><enum>(A)</enum><text>by striking clause (i) and inserting the following:</text>
