		<section display-inline="no-display-inline" id="H4C54B022AE6E4387B5689B000072C219" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fitness Integrated with Teaching Kids
			 Act</short-title></quote> or the <quote><short-title>FIT
			 Kids Act</short-title></quote>.</text>
		</section><section id="H40259777D4884F4E00000041008321D8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H4ED6521D733944728E7B7FAF960392F"><enum>(1)</enum><text>Obesity-related
			 diseases cost the United States economy more than $100,000,000,000 every
			 year.</text>
			</paragraph><paragraph id="H66E8EC60304F4158BA77F704D8691156"><enum>(2)</enum><text>Of all United
			 States deaths from major chronic disease, 23 percent are linked to sedentary
			 lifestyles that now begin at childhood.</text>
			</paragraph><paragraph id="H169112ADA27E48F0B6F686E84D199E00"><enum>(3)</enum><text>Overweight
			 adolescents have a 70-percent chance of becoming overweight adults, increasing
			 their risk for chronic disease, disability, and death.</text>
			</paragraph><paragraph id="HC7A2FA822C3F4A85AC9BA492BED1B0F8"><enum>(4)</enum><text>Childhood obesity
			 has reached epidemic proportions in the United States.</text>
			</paragraph><paragraph id="H8A3D1C971623468B97A467D663EF009"><enum>(5)</enum><text>In
			 2004, an estimated 9,900,000 children and adolescents ages 6 through 19 were
			 considered overweight.</text>
			</paragraph><paragraph id="HAB9B17E0A665401489F83952FE02A524"><enum>(6)</enum><text>The Department of
			 Health and Human Services estimates that, by 2010, 20 percent of children and
			 youth in the United States will be obese.</text>
			</paragraph><paragraph id="HD3DCB37356B842A094DAE8AF984FBB31"><enum>(7)</enum><text>A
			 decline in physical activity has contributed to the unprecedented epidemic of
			 childhood obesity.</text>
			</paragraph><paragraph id="H196ECC935A594EC08FA23E75B0F608E5"><enum>(8)</enum><text>Part of the
			 decline in physical activity has been in our Nation’s schools, where physical
			 education programs have been cut back in the past 2 decades.</text>
			</paragraph><paragraph id="HDAD0401E82AC46478B4577C17444F514"><enum>(9)</enum><text>Between 1991 and
			 2003, enrollment of high school students in daily physical education classes
			 fell from 41.6 percent to 28.4 percent.</text>
			</paragraph><paragraph id="HB7BF391924DD4B31996C1B7241BB86C0"><enum>(10)</enum><text>Among children
			 ages 9 to 13, 61.5 percent do not participate in any organized physical
			 activity during out-of-school hours.</text>
			</paragraph><paragraph id="H3DEEDE4179E441E09DAA80F2DDD582AB"><enum>(11)</enum><text>In a 2005
			 Government Accountability Office report on key strategies to include in
			 programs designed to target childhood obesity, <quote>increasing physical
			 activity</quote> was identified as the most important component in any such
			 program.</text>
			</paragraph><paragraph id="HCF6BF9E7866B464CA107CB40F9B567D"><enum>(12)</enum><text>The Dietary
			 Guidelines for Americans recommend that children engage in at least 60 minutes
			 of physical activity on most, preferably all, days of the week.</text>
			</paragraph><paragraph id="HEAB010793BE649AC9E87576CFDCACB05"><enum>(13)</enum><text>The national
			 standard for physical education frequency is 150 minutes per week in elementary
			 school and 225 minutes per week in middle and high school.</text>
			</paragraph><paragraph id="HA03A0680AE0847E7B9EE62D7FAF6D00"><enum>(14)</enum><text>Regular physical
			 activity is associated with a healthier, longer life and a lower risk of
			 cardiovascular disease, high blood pressure, diabetes, obesity, and some
			 cancers.</text>
			</paragraph><paragraph id="HB5703E8DC4BD433ABB3C1B483DBE66C8"><enum>(15)</enum><text>Evidence suggests
			 that physical activity may have a positive impact on academic performance,
			 self-concept, and symptoms of anxiety and depression.</text>
			</paragraph><paragraph id="H1BEE7EBABC7C49AEA0D736C4E144DC65"><enum>(16)</enum><text>Approximately 81
			 percent of adults believe daily physical education should be mandatory in
			 schools.</text>
			</paragraph></section><section id="HEB6579729D43460AB2FE787B155C1096"><enum>3.</enum><header>Report
			 cards</header><text display-inline="no-display-inline">Section 1111(h) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311(h)) is
			 amended—</text>
			<paragraph id="HA1F0211A85984E9383961D85EA1BA8C5"><enum>(1)</enum><text>in paragraph
			 (1)(C)—</text>
				<subparagraph id="HBDDC123C0288448484002DD187EBD7D3"><enum>(A)</enum><text>in clause (vii),
			 by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="H1489F993B8AD4971A2FCA5274D541B00"><enum>(B)</enum><text>in clause (viii),
			 by striking the period at the end and inserting a semicolon; and</text>
				</subparagraph><subparagraph id="H203FDCFDE4CB48BEA56753A5553F4DD1"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA8A7390B92D643329CD6A9D7BEF92FD" style="OLC">
						<clause id="H97E349724A074FE49BC105D56458C100"><enum>(ix)</enum><text>the amount of
				time students spend in required physical education as measured against the
				national standards of 150 minutes per week of required physical education for
				students in elementary school and 225 minutes per week of required physical
				education for students in middle school and secondary school;</text>
						</clause><clause id="H010B4CAB35E4450983A0B5F78CBF66D"><enum>(x)</enum><text display-inline="yes-display-inline">the percentage of local educational
				agencies in the State that have a required, age-appropriate physical education
				curriculum for all students in elementary schools, middle schools, and
				secondary schools that adheres to national guidelines adopted by the Centers
				for Disease Control and Prevention and State standards;</text>
						</clause><clause id="HF93F9DAF969F49E0BA32F9F4F58C9803"><enum>(xi)</enum><text display-inline="yes-display-inline">the percentage of elementary school and
				secondary school physical education teachers who are State licensed or
				certified as physical education teachers; and</text>
						</clause><clause id="H24A089FEC82C47BBB5FBD8E1312D5855"><enum>(xii)</enum><text>the percentage
				of schools that have a School Health Council that includes parents, students,
				representatives of the school food authority, representatives of the school
				board, school administrators and members of the public and that meets monthly
				to promote a healthy school
				environment.</text>
						</clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H626DD6378B3B45658505BE005899696E"><enum>(2)</enum><text>in paragraph
			 (2)(B)(i)—</text>
				<subparagraph id="HF96933634E734A05B12713BA00EE2696"><enum>(A)</enum><text>in subclause (I),

				outdoor facilities that are primarily used for physical education and the

				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HEF38F8273A0A41BAB1D18EB3A806955C"><enum>(3)</enum><text>in paragraph
			 (2)(B)(ii)—</text>
				<subparagraph id="H21F35F4BCEC04B1589210368E1FF497D"><enum>(A)</enum><text>in subclause (I),
			 by striking <quote>and</quote> after the semicolon;</text>

						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H166EE6E572234270A8B24517B46F6FB0"><enum>4.</enum><header>Promoting
			 physical education and activity in school programs</header>
			<subsection id="idA27CE972BD6C4208A84F54A6C611401A"><enum>(a)</enum><header>Elementary and
			 secondary school counseling programs</header><text>Section 5421 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7245) is
			 amended—</text>
				<paragraph id="idD7138B11FE3A47F38F61F6E088179347"><enum>(1)</enum><text>in subsection
			 (b)(2)(H), by inserting <quote>, which design and implementation shall take
			 into consideration the overall emotional and physical well-being of
			 students</quote> after <quote>the program</quote>; and</text>
				</paragraph><paragraph id="id353AB34B153345AE9751AAB9AA8DED80"><enum>(2)</enum><text>in subsection
			 (c)(2)(E), by inserting <quote>health, the importance of regular physical
			 activity,</quote> after <quote>relationships,</quote>.</text>
				</paragraph></subsection><subsection id="H9FB8792F4A1B46E7BF6ECF8FCF95F6F6"><enum>(b)</enum><header>Smaller learning
			 communities</header><text display-inline="yes-display-inline">Section 5441(b)
			 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7249(b)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H740493F67BD540D2B16FD03324D8E213" style="OLC">
					<paragraph id="H6E6D222D4AAD4AC09B8849FF5FF742BF"><enum>(14)</enum><text>How the local
				educational agency will ensure that smaller learning communities support
				healthy lifestyles including participation in physical education and physical
				activity by all students and access to nutritious food and nutrition
				education.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H98F6C7FE23154DD398859F9BF28600A2"><enum>(c)</enum><header>21st Century
			 Community Learning Centers</header>
				<paragraph id="H24D222048A864AD8AE02528D7044F8C"><enum>(1)</enum><header>Purpose;
			 definitions</header><text>Section 4201 of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7171) is amended—</text>
					<subparagraph id="H60454E8885734A2CAE26DBEF02C8E51"><enum>(A)</enum><text>in subsection
			 (a)(2), by inserting <quote>nutrition education programs, structured physical
			 activity programs,</quote> after <quote>recreation programs,</quote>;
			 and</text>
					</subparagraph><subparagraph id="H59C3C9A4A86343D380DC735CF1779F14"><enum>(B)</enum><text>in subsection
			 (b)(1)(A), by inserting <quote>nutrition education, structured physical
			 activity,</quote> after <quote>recreation,</quote>.</text>
					</subparagraph></paragraph><paragraph id="HF686628C93B54468804C8FDAE45629A9"><enum>(2)</enum><header>Local
			 competitive grant program</header><text>Section 4204(b)(2) of the Elementary
			 and Secondary Education Act of 1965 (20 U.S.C. 7174(b)(2))—</text>
					<subparagraph id="HA9E10DCDA3564E71A1B733A53CBC431B"><enum>(A)</enum><text>in subparagraph
			 (M), by striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="HAED58906B1A04ABDABBDB22A8249CAD"><enum>(B)</enum><text>by redesignating
			 subparagraph (N) as subparagraph (O); and</text>
					</subparagraph><subparagraph id="H7F351CEB0BDE4272A588E9B53458B1F0"><enum>(C)</enum><text>by inserting after

					</subparagraph></paragraph><paragraph id="HDA0A170A5DD046F7A09F779D6E9F8F36"><enum>(3)</enum><header>Local
			 activities</header><text>Section 4205(a) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7175(a))—</text>
					<subparagraph id="ID50ed5eaa1f7f4c3c96cc37854cee3917"><enum>(A)</enum><text>in paragraph
			 (11), by striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="IDfdbdd65134cd488d9cbb0a1d013d5c20"><enum>(B)</enum><text>in paragraph
			 (12), by striking the period at the end and inserting <quote>; and</quote>;

					</subparagraph></paragraph></subsection><subsection id="IDd66d38032d774e4886dde22bd05d45aa"><enum>(d)</enum><header>Parental
			 involvement</header><text>Section 1118 of the Elementary and Secondary
			 Education Act of 1965 is amended—</text>
				<paragraph id="ID54d62e4ead2d4de59dc03342e8ff2d38"><enum>(1)</enum><text>in subsection
			 (a)(2)—</text>
					<subparagraph id="ID932c0321f668466dbef443ed9c9ed242"><enum>(A)</enum><text>in subparagraph
			 (E), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="IDcf66bb778c3f4ee5a1f7c8d2ad72d35f"><enum>(B)</enum><text>by redesignating
			 subparagraph (F) as subparagraph (G); and</text>
					</subparagraph><subparagraph id="IDdb96b6f57fe64c5e81166afcab5f2f6e"><enum>(C)</enum><text>by inserting
			 after subparagraph (E) the following:</text>

					</subparagraph></paragraph><paragraph id="ID3f3f8b2e8d3f49638fca4b312c7ac415"><enum>(2)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="ID852e5760a3b94e1284eb921607f52d34"><enum>(A)</enum><text>in the subsection
			 heading, by inserting after <quote><header-in-text level="subsection" style="OLC">Achievement</header-in-text></quote> the following:
			 <quote><header-in-text level="subsection" style="OLC">by Healthy, Active
			 Students</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="ID197ab3fc71a54c15a697ae462218be02"><enum>(B)</enum><text>in the matter

			 after <quote>extracurricular time</quote> the following: <quote>and supporting
			 their children in leading a healthy and active life, such as by providing
			 healthy meals and snacks, encouraging participation in physical education, and
			 sharing in physical activity outside the school day</quote>;</text>
						</clause></subparagraph></paragraph><paragraph id="IDdb6ab58e6458468bb7d4be72c42651d1"><enum>(3)</enum><text>in subsection
			 (e)—</text>
					<subparagraph id="ID47f33a2e02a44742bbc662b9fadafccb"><enum>(A)</enum><text>by redesignating
			 paragraphs (6) through (14) as paragraphs (7) through (15), respectively;
			 and</text>
					</subparagraph><subparagraph id="ID117e7cd7e448452a963a48358faa18df"><enum>(B)</enum><text>by inserting
			 after paragraph (5) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id3D7B4E5EEF2544B38F44CEA025DD8565" style="OLC">
							<paragraph id="ID3197ff0baabd4d4c8d26e9180371c437"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id55654DC7011246E8836AC1B81A077E1D"><enum>(A)</enum><text>shall ensure that
				parents and teachers have information about the importance of a healthy
				lifestyle, including nutritional eating habits, physical education, and
				physical activity, to an effective learning environment; and</text>
								</subparagraph><subparagraph id="id5846C289F9854F58A57BD78177ACC9C9" indent="up1"><enum>(B)</enum><text>shall coordinate activities with
				parents and teachers to ensure that children are provided with nutritious meals
				and snacks, and have ample opportunities for physical education and physical
				activity during and outside the school
				day;</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="H21DA404749F04E35A06E33BB8708F33E"><enum>5.</enum><header>Professional
			 development for teachers and principals</header>
			<subsection id="HE9D018112AA342A194C2141593A4EDA8"><enum>(a)</enum><header>State
			 applications</header><text>Section 2112(b) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6612(b)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HB393EF56A0734571867EEDE6E3CDB618" style="OLC">
					<paragraph id="HDE7F0589D33142B8BA22BA5C845D09B7"><enum>(13)</enum><text>A description of
				how the State educational agency will use funds under this part to provide
				professional development that is directly related to the fields of physical
				education and health education to physical education teachers and health
				education teachers to ensure that children are leading healthy, active
				lifestyles that are conducive to effective
				learning.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE41F03B1E90042AE8E337D2000198982"><enum>(b)</enum><header>State use of
			 funds</header><text>Section 2113(c)(6) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6613(c)(6)) is amended—</text>
				<paragraph id="idBCACDD7874424BD0A4753D5C2D4DDF99"><enum>(1)</enum><text>by striking
			 <quote>, in cases in which a State educational agency determines support to be
			 appropriate,</quote>; and</text>
				</paragraph><paragraph id="id4A0A353DE7DA40A2972DB3A039AD952B"><enum>(2)</enum><text>by inserting
			 <quote>, physical education teachers, and health education teachers</quote>
			 after <quote>pupil services personnel</quote>.</text>
				</paragraph></subsection><subsection id="H222E13B435224CA5A3B21C7C84839EE5"><enum>(c)</enum><header>Local
			 applications and needs assessment</header><text>Section 2122(b)(9) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6622(b)(9)) is
			 amended—</text>
				<paragraph id="HBCA3A3169F814ABAB86DF1D72868BE7C"><enum>(1)</enum><text>in subparagraph
			 (C), by striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="H2FBC17AE42234E9AA78180093336016F"><enum>(2)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H9F7E953A834B4E3B92C8E85D003F209B"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HFAE4D8874C7948C0A710CC43EB308756" style="OLC">

				</paragraph></subsection><subsection id="H6D5C72A804DE4CD6856E87386CB1CBC8"><enum>(d)</enum><header>Local use of
			 funds</header><text>Section 2123(a)(3) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6623(a)(3)) is amended—</text>

					</subparagraph></paragraph></subsection></section><section id="idF3BFEAA3B04E4157B32A96130EE97513"><enum>6.</enum><header>Institute of
			 Medicine study</header><text display-inline="no-display-inline">The Secretary
			 of Health and Human Services shall collaborate with the Secretary of Education
			 and the Director of the Centers for Disease Control and Prevention, to fund a
			 study conducted by the Institute of Medicine of the National Academy of
			 Sciences that will—</text>
			<paragraph id="idAFB30C19F0BD42F3B5D33E4157322750"><enum>(1)</enum><text display-inline="yes-display-inline">examine and make recommendations
			 regarding—</text>
				<subparagraph id="id1446B772B41946F3A309AABF5EE0B766"><enum>(A)</enum><text display-inline="yes-display-inline">various means that may be employed to
			 incorporate physical activity into Head Start and childcare settings,
			 elementary, middle, and high school settings, and before- and after-school
			 programs; and</text>
				</subparagraph><subparagraph id="id89FCF84D300442C08D205B34939D2B9D"><enum>(B)</enum><text>innovative and
			 effective ways to increase physical activity for all students;</text>
				</subparagraph></paragraph><paragraph id="ID1ce577ec601c46f79da4c4080b26dbe0"><enum>(2)</enum><text>study the impact
			 of health, level of physical activity, and amount of physical education on
			 students’ ability to learn and maximize performance in school; and</text>
			</paragraph><paragraph id="ID329d9dd14c39427fb2025f8f330a28cf"><enum>(3)</enum><text>study and provide
			 specific recommendations for—</text>
				<subparagraph id="ID8be281b7fc1e4575a6de739dae0d73f4"><enum>(A)</enum><text>effectively
			 measuring the progress of students, at the school level, in improving their
			 health and well-being, including improving their—</text>
					<clause id="ID84a74a18545546ad97a5569c84446c4d"><enum>(i)</enum><text>knowledge,
			 awareness, and behavior changes, related to nutrition and physical
			 activity;</text>
					</clause><clause id="ID043fa6860d0b4cadacb40515b73843db"><enum>(ii)</enum><text>cognitive
			 development, and fitness improvement, in physical education;</text>
					</clause><clause id="IDe7fe46597f2f4cb080c48fbd14863a55"><enum>(iii)</enum><text>knowledge of
			 lifetime physical activity and health promotion;</text>
					</clause><clause id="ID9376cd61327743e4b9a5648917504bc5"><enum>(iv)</enum><text>decrease in
			 obesity; and</text>
					</clause><clause id="ID97f1c5a1bfe54900a66c499850832776"><enum>(v)</enum><text>levels on overall
			 health indicators; and</text>
					</clause></subparagraph><subparagraph id="ID4a7849ea01ea49d3b45aef08947184a4"><enum>(B)</enum><text>effectively
			 measuring the progress of students, at the school level, in increasing physical
			 activity.</text>
				</subparagraph></paragraph></section></legis-body>
