		<official-title>To provide for the exchange of certain Federal land in
		  the Santa Fe National Forest and certain non-Federal land in the Pecos National
		  Historical Park in the State of New Mexico.</official-title>

		<section id="ID717AF9C06E884161AEF64E64BD271F89" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Pecos National Historical Park Land
			 Exchange Act of 2007</short-title></quote>.</text>
		</section><section id="IDFC85DF775CAE4A39BA4115A4F260DF67"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDD4A1F705C37A4B0C837D47D7D1979334"><enum>(1)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the approximately
			 160 acres of Federal land within the Santa Fe National Forest in the State, as
			 depicted on the map.</text>
			</paragraph><paragraph id="ID1AC97DF4CDA649CBB0CDC2AEE8CF5583"><enum>(2)</enum><header>Landowner</header><text>The
			 term <term>landowner</term> means the 1 or more owners of the non-Federal
			 land.</text>
			</paragraph><paragraph id="ID5119A47F580A43BFA4711A26AFBAFC70"><enum>(3)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Proposed Land Exchange for
			 Pecos National Historical Park</quote>, numbered 430/80,054, dated November 19,
			 1999, and revised September 18, 2000.</text>
			</paragraph><paragraph id="IDACA5C0ABF6CA457B83B711D6E44C0533"><enum>(4)</enum><header>Non-federal
			 land</header><text>The term <term>non-Federal land</term> means the
			 approximately 154 acres of non-Federal land in the Park, as depicted on the
			 map.</text>
			</paragraph><paragraph id="ID542028A0734C4EA9A67F6369389A1DB9"><enum>(5)</enum><header>Park</header><text>The
			 term <term>Park</term> means the Pecos National Historical Park in the
			 State.</text>
			</paragraph><paragraph id="ID46AB77D0A2EA4268999C387D6C266851"><enum>(6)</enum><header>Secretaries</header><text>The
			 term <term>Secretaries</term> means the Secretary of the Interior and the
			 Secretary of Agriculture, acting jointly.</text>
			</paragraph><paragraph id="IDF5E6877EC313479CB151133EB269FD74"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of New Mexico.</text>
			</paragraph></section><section id="ID215462589FE1452D81AECE3D3F5D5FFA"><enum>3.</enum><header>Land
			 exchange</header>
			<subsection id="ID640BA9C7AE5043C0977B1EEA0DFD4673"><enum>(a)</enum><header>In
			 General</header><text>On conveyance by the landowner to the Secretary of the
			 Interior of the non-Federal land, title to which is acceptable to the Secretary
			 of the Interior—</text>
				<paragraph id="ID6E8E610801C24F7B828EA88547B16B6E"><enum>(1)</enum><text>the Secretary of
			 Agriculture shall, subject to the conditions of this Act, convey to the
			 landowner the Federal land; and</text>
				</paragraph><paragraph id="IDF3822B261ADA48C0AFF292BA646E778E"><enum>(2)</enum><text>the Secretary of
			 the Interior shall, subject to the conditions of this Act, grant to the
			 landowner the easement described in subsection (b).</text>
				</paragraph></subsection><subsection id="ID9B89D24AD14349FA92C284486F02175C"><enum>(b)</enum><header>Easement</header>
				<paragraph id="IDBB71E549A8194C66B7CECDAC22B8BBCB"><enum>(1)</enum><header>In
			 general</header><text>The easement referred to in subsection (a)(2) is an
			 easement (including an easement for service access) for water pipelines to 2
			 well sites located in the Park, as generally depicted on the map.</text>
				</paragraph><paragraph id="ID040514EEFD4B4BE1B5CE0C4DB0A3E168"><enum>(2)</enum><header>Route</header><text>The
			 Secretary of the Interior, in consultation with the landowner, shall determine
			 the appropriate route of the easement through the Park.</text>
				</paragraph><paragraph id="ID0E337B80F4B74A2081200EB5576995A9"><enum>(3)</enum><header>Terms and
			 conditions</header><text>The easement shall include such terms and conditions
			 relating to the use of, and access to, the well sites and pipeline, as the
			 Secretary of the Interior, in consultation with the landowner, determines to be
			 appropriate.</text>
				</paragraph><paragraph id="ID68DC0BCE527B49ADA9B31A13F936B964"><enum>(4)</enum><header>Applicable
			 law</header><text>The easement shall be established, operated, and maintained
			 in compliance with applicable Federal law.</text>
				</paragraph></subsection><subsection id="IDF2B4188374DB4005ADE002AD3C90F898"><enum>(c)</enum><header>Valuation,
			 Appraisals, and Equalization</header>
				<paragraph id="IDF97B51F26F194EADB2452C2CA21EBA37"><enum>(1)</enum><header>In
			 general</header><text>The value of the Federal land and non-Federal
			 land—</text>
					<subparagraph id="ID263430C7A12344089AFA0EEFF3295913"><enum>(A)</enum><text>shall be equal,
			 as determined by appraisals conducted in accordance with paragraph (2);
			 or</text>
					</subparagraph><subparagraph id="IDFD7BF02614024E939FFE7EEE059F5A9B"><enum>(B)</enum><text>if the value is
			 not equal, shall be equalized in accordance with paragraph (3).</text>
					</subparagraph></paragraph><paragraph id="ID18C2AC2579054CD984ABE5774527A037"><enum>(2)</enum><header>Appraisals</header>
					<subparagraph id="IDE5A6BF9BE84E47988FF8A0A88C0335B0"><enum>(A)</enum><header>In
			 general</header><text>The Federal land and non-Federal land shall be appraised
			 by an independent appraiser selected by the Secretaries.</text>
					</subparagraph><subparagraph id="ID6C3401947C42458FBAF17F3C6E643DF2"><enum>(B)</enum><header>Requirements</header><text>An
			 appraisal conducted under subparagraph (A) shall be conducted in accordance
			 with—</text>
						<clause id="ID96106871F4EB4E1199BE212E09EEC739"><enum>(i)</enum><text>the
			 Uniform Appraisal Standards for Federal Land Acquisition; and</text>
						</clause><clause id="ID6C984BA3A2C840FDBE66A042F7CF90FD"><enum>(ii)</enum><text>the Uniform
			 Standards of Professional Appraisal Practice.</text>
						</clause></subparagraph><subparagraph id="IDCB8730F53D9E4BE09CAFB8054C6D5607"><enum>(C)</enum><header>Approval</header><text>The
			 appraisals conducted under this paragraph shall be submitted to the Secretaries
			 for approval.</text>
					</subparagraph></paragraph><paragraph id="IDDBD5061779EF4F85B515B8B8AB5136A3"><enum>(3)</enum><header>Equalization of
			 values</header>
					<subparagraph id="ID27369086863144F695172301A654795F"><enum>(A)</enum><header>In
			 general</header><text>If the values of the non-Federal land and the Federal
			 land are not equal, the values may be equalized by—</text>
						<clause id="ID6080A8432A3641E4A82D97366642B562"><enum>(i)</enum><text>the
			 Secretary of the Interior making a cash equalization payment to the
			 landowner;</text>
						</clause><clause id="IDDAC7F883BACB4AC6A5ADBEAE44CA2326"><enum>(ii)</enum><text>the landowner
			 making a cash equalization payment to the Secretary of Agriculture; or</text>
						</clause><clause id="ID510488E9D9704BBD87FC7A6E79E5BEB7"><enum>(iii)</enum><text>reducing the
			 acreage of the non-Federal land or the Federal land, as appropriate.</text>
						</clause></subparagraph><subparagraph id="ID862C9D773DC2414CB439903D4ADA2DFD"><enum>(B)</enum><header>Cash
			 equalization payments</header><text>Any amounts received by the Secretary of
			 Agriculture as a cash equalization payment under section 206(b) of the
			 <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (43 U.S.C. 1716(b)) shall—</text>
						<clause id="ID10AD4837571E4F248B78555FBC312966"><enum>(i)</enum><text>be
			 deposited in the fund established by Public Law 90–171 (commonly known as the
			 <quote>Sisk Act</quote>) (16 U.S.C. 484a); and</text>
						</clause><clause id="ID4EF63B6049354BB6A41FD9D30E6BCAB3"><enum>(ii)</enum><text>be
			 available for expenditure, without further appropriation, for the acquisition
			 of land and interests in land in the State.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDAB1C7EED019D40A4A881C2055FC2362B"><enum>(d)</enum><header>Costs</header><text>Before
			 the completion of the exchange under this section, the Secretaries and the
			 landowner shall enter into an agreement that allocates the costs of the
			 exchange among the Secretaries and the landowner.</text>
			</subsection><subsection id="IDB72A9FF4FBD04F9AB7BD56FD4E8BAABA"><enum>(e)</enum><header>Applicable
			 Law</header><text>Except as otherwise provided in this Act, the exchange of
			 land and interests in land under this Act shall be in accordance with—</text>
				<paragraph id="ID7A23415E25A44D7780264D4C041C81B5"><enum>(1)</enum><text>section 206 of
			 the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
			 1976</act-name> (43 U.S.C. 1716); and</text>
				</paragraph><paragraph id="IDAAA69194C48645EE913F81F17BB1417B"><enum>(2)</enum><text>other applicable
			 laws, including the <act-name parsable-cite="NEPA69">National Environmental
			 Policy Act of 1969</act-name> (42 U.S.C. 4321 et seq.).</text>
				</paragraph></subsection><subsection id="ID5C0EE75A55EA42C0A53EB0836B7DB5AE"><enum>(f)</enum><header>Additional
			 Terms and Conditions</header><text>The Secretaries may require, in addition to
			 any requirements under this Act, such terms and conditions relating to the
			 exchange of Federal land and non-Federal land and the granting of easements
			 under this Act as the Secretaries determine to be appropriate to protect the
			 interests of the United States.</text>
			</subsection><subsection id="ID18971A2A954E4315B9172464A33D6326"><enum>(g)</enum><header>Completion of
			 the Exchange</header>
				<paragraph id="ID6F0AE9F97DE34623A39EDCB6E98458D4"><enum>(1)</enum><header>In
			 general</header><text>The exchange of Federal land and non-Federal land shall
			 be completed not later than 180 days after the later of—</text>
					<subparagraph id="ID6DDEFBE6029D4454A714FE234445196F"><enum>(A)</enum><text>the date on which
			 the requirements of the <act-name parsable-cite="NEPA69">National Environmental
			 Policy Act of 1969</act-name> (42 U.S.C. 4321 et seq.) have been met;</text>
					</subparagraph><subparagraph id="ID438BF3F641C0429EAEE0F17FA797B11D"><enum>(B)</enum><text>the date on which
			 the Secretary of the Interior approves the appraisals under subsection
			 (c)(2)(C); or</text>
					</subparagraph><subparagraph id="ID63E5D09771C74FEE8FA5E25532BD24EC"><enum>(C)</enum><text>the date on which
			 the Secretaries and the landowner agree on the costs of the exchange and any
			 other terms and conditions of the exchange under this section.</text>
					</subparagraph></paragraph><paragraph id="ID93641EF932874F94BA109F60543B5D11"><enum>(2)</enum><header>Notice</header><text>The
			 Secretaries shall submit to the Committee on Energy and Natural Resources of
			 the Senate and the Committee on Resources of the House of Representatives
			 notice of the completion of the exchange of Federal land and non-Federal land
			 under this Act.</text>
				</paragraph></subsection></section><section id="ID60A7593D010E44CF9A5B819A17DF945F"><enum>4.</enum><header>Administration</header>
			<subsection id="ID5D19912E23FA49D6ACA5BF9A7D9AB18D"><enum>(a)</enum><header>In
			 General</header><text>The Secretary of the Interior shall administer the
			 non-Federal land acquired under this Act in accordance with the laws generally
			 applicable to units of the National Park System, including the Act of August
			 25, 1916 (commonly known as the <quote>National Park Service Organic
			 Act</quote>) (16 U.S.C. 1 et seq.).</text>
			</subsection><subsection id="IDF36AC21B1DA548A8AF0FF0418474453C"><enum>(b)</enum><header>Maps</header>
				<paragraph id="ID562D24FD712E428F92B6F7C3CA9EB52D"><enum>(1)</enum><header>In
			 general</header><text>The map shall be on file and available for public
			 inspection in the appropriate offices of the Secretaries.</text>
				</paragraph><paragraph id="IDAFEC75B2D08E414E8F8D0A22E59794A8"><enum>(2)</enum><header>Transmittal of
			 revised map to congress</header><text>Not later than 180 days after completion
			 of the exchange, the Secretaries shall transmit to the Committee on Energy and
			 Natural Resources of the Senate and the Committee on Resources of the House of
			 Representatives a revised map that depicts—</text>
					<subparagraph id="IDB9C3680AFA5C4384BEC692B889AD2DFE"><enum>(A)</enum><text>the Federal land
			 and non-Federal land exchanged under this Act; and</text>
					</subparagraph><subparagraph id="IDC96200B4C80B419084D979BD674584EB"><enum>(B)</enum><text>the easement
			 described in section 3(b).</text>
					</subparagraph></paragraph></subsection></section></legis-body>
