		<official-title display="yes">To amend title 18, United States Code, to
		  enable increased federal prosecution of identity theft crimes and to allow for
		  restitution to victims of identity theft.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Identity Theft Enforcement and
			 Restitution Act of 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID6ee4bf4ab7fa452e8320c0064a896ec4" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Criminal restitution</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3663">Section 3663(b)</external-xref> of title 18, United States
			 Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID613e3fccc6cb4c4297e081d5b1b5af33"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>;
			 and</quote> and inserting a semicolon;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd33833e31410463181899d40c0a33374"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking the period at
			 the end and inserting <quote>; and</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbd2ad4e1e5bc4908aae60106a9b2eb24"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID2318cfa00559478084fae19c895e837f"><enum>(6)</enum><text display-inline="yes-display-inline">in the case of an offense under sections
				1028(a)(7) or 1028A(a) of this title, pay an amount equal to the value of the
				time reasonably spent by the victim in an attempt to remediate the intended or
				actual harm incurred by the victim from the
				offense.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDbf559d538c7340c490f4179bf4dd7958" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Predicate offenses for aggravated identity
			 theft and misuse of identifying information of organizations</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID129624e35663470ea7a6b051eb779f9e"><enum>(a)</enum><header display-inline="yes-display-inline">Identity
			 theft</header><text display-inline="yes-display-inline">Section 1028 of title
			 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID958f92b8892c46d08ef4e0850ddb3899"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(7), by inserting
			 <quote>(including an organization as defined in section 18 of this
			 title)</quote> after <quote>person</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaf5470dc87c245d090d749c3f4545bbf"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)(7), by inserting
			 <quote>or other person</quote> after <quote>specific individual</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDeaa145c9e0094258864c349ff2ca9219"><enum>(b)</enum><header display-inline="yes-display-inline">Aggravated identity theft</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1028A">Section 1028A</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID27014edda5d1464ba30690ad4a37ffdd"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by inserting
			 <quote>(including an organization as defined in section 18 of this
			 title)</quote> after <quote>person</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf341987c92104581afb6794f285597f3"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID34798305b5484cb4a75acea1fb70fbb2"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by
			 inserting <quote>, or a conspiracy to commit such a felony violation,</quote>
			 after <quote>any offense that is a felony violation</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe3f73031d2b445fb9338045cc7eee63e"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating—</text>

			 sensitive identity information</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(a)(2)(C)</external-xref> of title 18, United
			 States Code, is amended by striking <quote>if the conduct involved an
			 interstate or foreign communication</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID8891c442b4ff4ba394f06b094e28b0f0" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Malicious spyware, hacking and
			 keyloggers</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID4fe823511b05451eaca611fb045a85af"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDe67aaa49278444c791f4829b41bcac4e"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(5)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idCF7BF000B01C4A95A4C8CAFE10C5DA56"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraph (B); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56E260441307483DBF96EA4DC64FC570"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>

				(F), a fine under this title, imprisonment for not more than 5 years, or both,
				in the case of—</text>
									<clause commented="no" display-inline="no-display-inline" id="id1FBEFB9CE0D34216A9E5E049EFB680BD" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">an offense under subsection (a)(5)(B),
				which does not occur after a conviction for another offense under this section,
				if the offense caused (or, in the case of an attempted offense, would, if
				completed, have caused)—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID09b51dc1bdea4369a829966224efbaa4"><enum>(I)</enum><text display-inline="yes-display-inline">loss to 1 or more persons during any 1-year
				period (and, for purposes of an investigation, prosecution, or other proceeding
				brought by the United States only, loss resulting from a related course of
				conduct affecting 1 or more other protected computers) aggregating at least
				$5,000 in value;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7883cee3a5a64e889449caf0bb46ad9f"><enum>(II)</enum><text display-inline="yes-display-inline">the modification or impairment, or
				potential modification or impairment, of the medical examination, diagnosis,
				treatment, or care of 1 or more individuals;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID54865e164af244c08c51e1a6f200fd62"><enum>(III)</enum><text display-inline="yes-display-inline">physical injury to any person;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID471d4e05b7574d9494bd394e10bbdc5b"><enum>(IV)</enum><text display-inline="yes-display-inline">a threat to public health or safety;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDc86933ef507e4ceebf97c88d6ad34cd5"><enum>(V)</enum><text display-inline="yes-display-inline">damage affecting a computer used by or for
				an entity of the United States Government in furtherance of the administration
				of justice, national defense, or national security; or</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID8fb3599c02f24ae481f01ec847ec54bd"><enum>(VI)</enum><text display-inline="yes-display-inline">damage affecting 10 or more protected
				computers during any 1-year period; or</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7C9D06A323EC48A098A19CFCD8AF2786" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">an attempt to commit an offense punishable
				under this subparagraph;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDebba3ec0a7924342ba9125940e6f5f94" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided in subparagraphs (E) and
				(F), a fine under this title, imprisonment for not more than 10 years, or both,
				in the case of—</text>
									<clause commented="no" display-inline="no-display-inline" id="id6CA86C869630440BA5EDBDABD8407E53"><enum>(i)</enum><text display-inline="yes-display-inline">an offense under subsection (a)(5)(A),
				which does not occur after a conviction for another offense under this section,
				if the offense caused (or, in the case of an attempted offense, would, if
				completed, have caused) a harm provided in subclauses (I) through (VI) of
				subparagraph (A)(i); or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idB4EED1A6854140E292FC2EF79D4693FF"><enum>(ii)</enum><text display-inline="yes-display-inline">an attempt to commit an offense punishable
				under this subparagraph;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf6773a8df62b4766af157ce0dfaee114" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">except as provided in subparagraphs (E) and
				(F), a fine under this title, imprisonment for not more than 20 years, or both,
				in the case of—</text>
									<clause commented="no" display-inline="no-display-inline" id="idD2FB504D102E4C6784A836D8A010971A"><enum>(i)</enum><text display-inline="yes-display-inline">an offense or an attempt to commit an
				offense under subparagraphs (A) or (B) of subsection (a)(5) that occurs after a
				conviction for another offense under this section; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id65F121D73DFE416B9B66729B65B2CBE5"><enum>(ii)</enum><text display-inline="yes-display-inline">an attempt to commit an offense punishable
				under this subparagraph;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8adcca0931fe489caf303aec751978af" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">a
				fine under this title, imprisonment for not more than 10 years, or both, in the
				case of—</text>
									<clause commented="no" display-inline="no-display-inline" id="id4EDD4241478D412EB59EC148FD5E0AF3"><enum>(i)</enum><text display-inline="yes-display-inline">an offense or an attempt to commit an
				offense under subsection (a)(5)(C) that occurs after a conviction for another
				offense under this section; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idDEAF1AF29DC44BD1863EC91DC5F86D6F"><enum>(ii)</enum><text display-inline="yes-display-inline">an attempt to commit an offense punishable
				under this subparagraph;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe3b8bf71ce7643c7be22ed8273c97068" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">if
				the offender attempts to cause or knowingly or recklessly causes serious bodily
				injury from conduct in violation of subsection (a)(5)(A), a fine under this
				title, imprisonment for not more than 20 years, or both;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID592be49bdc7340a6a823b50ad17b91bd" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">if
				the offender attempts to cause or knowingly or recklessly causes death from
				conduct in violation of subsection (a)(5)(A), a fine under this title,
				imprisonment for any term of years or for life, or both; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf56812826aaf45b38998736582b6d16f" indent="up1"><enum>(G)</enum><text display-inline="yes-display-inline">a
				fine under this title, imprisonment for not more than 1 year, or both,
				for—</text>
									<clause commented="no" display-inline="no-display-inline" id="idF55DA3E5141E4A28B2410D8E748B2B1F"><enum>(i)</enum><text display-inline="yes-display-inline">any other offense under subsection (a)(5);
				or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id2B1E29F275FB4750BF12D9A7F9D30369"><enum>(ii)</enum><text display-inline="yes-display-inline">an attempt to commit an offense punishable
				under this subparagraph.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID18bbda8e75114145a441edf9ca5d0a68"><enum>(D)</enum><text display-inline="yes-display-inline">by striking paragraph (5); and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf9e0c4652473445c9b0e54fdc0bbb5c3"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (g)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idBF54013258C04D879E560D31A016C290"><enum>(A)</enum><text display-inline="yes-display-inline">in the second sentence, by striking
			 <quote>in clauses (i), (ii), (iii), (iv), or (v) of subsection
			 (a)(5)(B)</quote> and inserting <quote>in subclauses (I), (II), (III), (IV), or
			 (V) of subsection (c)(4)(A)(i)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF9A8AB3F13B04A7280B8058BC039ED5D"><enum>(B)</enum><text display-inline="yes-display-inline">in the third sentence, by striking
			 <quote>subsection (a)(5)(B)(i)</quote> and inserting <quote>subsection
			 (c)(4)(A)(i)(I)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0706fe881a7e4085af400c068874a965"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming changes</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2332b">Section 2332b(g)(5)(B)(i)</external-xref> of title 18,
			 United States Code, is amended by striking <quote>1030(a)(5)(A)(i) resulting in
			 damage as defined in 1030(a)(5)(B)(ii) through (v)</quote> and inserting
			 <quote>1030(a)(5)(A) resulting in damage as defined in 1030(c)(4)(A)(i)(II)
			 through (VI)</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDe8a207d5a5c24500aabc2efb792ef524" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Cyber-extortion</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(a)(7)</external-xref> of title 18, United
			 States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id9B560C1932434F03AB7BF9485FF19F80" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="ID3e417080a0c34f7da3fa9342a4b46704"><enum>(7)</enum><text display-inline="yes-display-inline">with intent to extort from any person any
				money or other thing of value, transmits in interstate or foreign commerce any
				communication containing any—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDc093dd8c912347e897de7a975e8b0e7b"><enum>(A)</enum><text display-inline="yes-display-inline">threat to cause damage to a protected
				computer;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbe8c222af0d6495aa8622fc121d6e1dc"><enum>(B)</enum><text display-inline="yes-display-inline">threat to obtain information from a
				protected computer without authorization or in excess of authorization or to
				impair the confidentiality of information obtained from a protected computer
				without authorization or by exceeding authorized access; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe57fa739d41f4b039f8ee35ae5d38d29"><enum>(C)</enum><text display-inline="yes-display-inline">demand or request for money or other thing
				of value in relation to damage to a protected computer, where such damage was
				caused to facilitate the
				extortion;</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id1C79757015C8493C92AA870B697D3269" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Conspiracy to commit
			 cyber-crimes</header><text display-inline="no-display-inline">Section 1030(b)
			 of title 18, United States Code, is amended by inserting <quote>conspires to
			 commit or</quote> after <quote>Whoever</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id2F4042A02AE04809B8C3D69B61887A62" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Use of full interstate and foreign commerce
			 power for criminal penalties</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(e)(2)(B)</external-xref> of title 18, United
			 States Code, is amended by inserting <quote>or affecting</quote> after
			 <quote>which is used in</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id7004D3A965DD4FCDAC999F3D32D74E4B" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Forfeiture for section 1030
			 violations</header><text display-inline="no-display-inline">Section 1030 of
			 title 18, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idADEAA40B02B94F28B5BC59AB87B3E871" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="idAB27E5749E8749F6926D9FB1C177756B"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idA647C598E0F043F6B21ECF131D406450"><enum>(1)</enum><text display-inline="yes-display-inline">The court, in imposing sentence on any
				person convicted of a violation of this section, or convicted of conspiracy to
				violate this section, shall order, in addition to any other sentence imposed
				and irrespective of any provision of State law, that such person forfeit to the
				United States—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idB39E0DA237C748D09BF0239350B817D9" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">such person’s interest in any personal
				property that was used or intended to be used to commit or to facilitate the
				commission of such violation; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDD4D58CA74FB4784892F34BA054D7151" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">any property, real or personal,
				constituting or derived from, any proceeds that such person obtained, directly
				or indirectly, as a result of such violation.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id383BE155A34E42ED930AB711688A6060" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The criminal forfeiture of property under
				this subsection, any seizure and disposition thereof, and any judicial
				proceeding in relation thereto, shall be governed by the provisions of section
				413 of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21
				U.S.C. 853), except subsection (d) of that section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0DDC7663ACB04B67A5FA95524AF7BC39"><enum>(j)</enum><text display-inline="yes-display-inline">For purposes of subsection (i), the
				following shall be subject to forfeiture to the United States and no property
				right shall exist in them:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idE915DE4A823544218B39F955FBF08F88"><enum>(1)</enum><text display-inline="yes-display-inline">Any personal property used or intended to
				be used to commit or to facilitate the commission of any violation of this
				section, or a conspiracy to violate this section.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1103DD6B22034E20B97ABF0FBF76FAF9"><enum>(2)</enum><text display-inline="yes-display-inline">Any property, real or personal, which
				constitutes or is derived from proceeds traceable to any violation of this
				section, or a conspiracy to violate this
				section</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id277B3EEB3C6143688620B02CFDCB819D" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Directive to United States Sentencing
			 Commission</header>
			<subsection commented="no" display-inline="no-display-inline" id="id3C679033079342EAB8D0FD9E6CACC6B4"><enum>(a)</enum><header display-inline="yes-display-inline">Directive</header><text display-inline="yes-display-inline">Pursuant to its authority under section
			 994(p) of title 28, United States Code, and in accordance with this section,
			 the United States Sentencing Commission shall review its guidelines and policy
			 statements applicable to persons convicted of offenses under sections 1028,
			 1028A, 1030, 2511, and 2701 of title 18, United States Code, and any other
			 relevant provisions of law, in order to reflect the intent of Congress that
			 such penalties be increased in comparison to those currently provided by such
			 guidelines and policy statements.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idB1873CB8405A4EF482D3778E907C0E79"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In determining its guidelines and policy
			 statements on the appropriate sentence for the crimes enumerated in subsection
			 (a), the United States Sentencing Commission shall consider the extent to which
			 the guidelines and policy statements may or may not account for the following
			 factors in order to create an effective deterrent to computer crime and the
			 theft or misuse of personally identifiable data:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idD56CB1B126F148FD80A299FC51B87B36"><enum>(1)</enum><text display-inline="yes-display-inline">The level of sophistication and planning
			 involved in such offense.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id926231F593D84869B9311F75ADAFEF4C"><enum>(2)</enum><text display-inline="yes-display-inline">Whether such offense was committed for
			 purpose of commercial advantage or private financial benefit.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE7F4967743704DDEA985DDC6C3CC143B"><enum>(3)</enum><text display-inline="yes-display-inline">The potential and actual loss resulting
			 from the offense including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idE1FC3F8067B64322ADF1CAD43EC3D8BE"><enum>(A)</enum><text display-inline="yes-display-inline">the value of information obtained from a
			 protected computer, regardless of whether the owner was deprived of use of the
			 information; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7972BD435DA64D969EB3E578EB7E6DBB"><enum>(B)</enum><text display-inline="yes-display-inline">where the information obtained constitutes
			 a trade secret or other proprietary information, the cost the victim incurred
			 developing or compiling the information.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DD2D54E04D94731A6892D03541C31DA"><enum>(4)</enum><text display-inline="yes-display-inline">Whether the defendant acted with intent to
			 cause either physical or property harm in committing the offense.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDA2F798709A945FF96164D854550FED4"><enum>(5)</enum><text display-inline="yes-display-inline">The extent to which the offense violated
			 the privacy rights of individuals.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0522F735F27547FE93F10555ACDCE574"><enum>(6)</enum><text display-inline="yes-display-inline">The effect of the offense upon the
			 operations of an agency of the United States Government, or of a State or local
			 government.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id420309A7F1C9410599E026B5DE158F1A"><enum>(7)</enum><text display-inline="yes-display-inline">Whether the offense involved a computer
			 used by the United States Government, a State, or a local government in
			 furtherance of national defense, national security, or the administration of
			 justice.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38AADBCB886940B295293B767D9623DF"><enum>(8)</enum><text display-inline="yes-display-inline">Whether the offense was intended to, or had
			 the effect of, significantly interfering with or disrupting a critical
			 infrastructure.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6C14308E0FCE47D687965088A145B8B5"><enum>(9)</enum><text display-inline="yes-display-inline">Whether the offense was intended to, or had
			 the effect of, creating a threat to public health or safety, causing injury to
			 any person, or causing death.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01F95C5FB56C42769036592305CC0867"><enum>(10)</enum><text display-inline="yes-display-inline">Whether the defendant purposefully involved
			 a juvenile in the commission of the offense.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1348C1F40F1B4DA5A7D2030D14AF43DE"><enum>(11)</enum><text display-inline="yes-display-inline">Whether the defendant's intent to cause
			 damage or intent to obtain personal information should be disaggregated and
			 considered separately from the other factors set forth in USSG
			 2B1.1(b)(14).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA48D3B4E20EF42F48558865E45561017"><enum>(12)</enum><text display-inline="yes-display-inline">Whether the term <quote>victim</quote> as
			 used in USSG 2B1.1, should include individuals whose privacy was violated as a
			 result of the offense in addition to individuals who suffered monetary harm as
			 a result of the offense.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id826603A636904AEEBC171D85886147FE"><enum>(13)</enum><text display-inline="yes-display-inline">Whether the defendant disclosed personal
			 information obtained during the commission of the offense.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9DCB72397F0D40998DC3ECE6A6A3C348"><enum>(c)</enum><header display-inline="yes-display-inline">Additional requirements</header><text display-inline="yes-display-inline">In carrying out this section, the United
			 States Sentencing Commission shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1BACD2C30BDD4E98B78D7450C5F489FD"><enum>(1)</enum><text display-inline="yes-display-inline">assure reasonable consistency with other
			 relevant directives and with other sentencing guidelines;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E94EB6133824C30AC137B2B444F8E09"><enum>(2)</enum><text display-inline="yes-display-inline">account for any additional aggravating or
			 mitigating circumstances that might justify exceptions to the generally
			 applicable sentencing ranges;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9150B633CB8A4BDFBF515DCBD2A8CC66"><enum>(3)</enum><text display-inline="yes-display-inline">make any conforming changes to the
			 sentencing guidelines; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB1435B30E0BC4AEB8DB106C31B7F4CCD"><enum>(4)</enum><text display-inline="yes-display-inline">assure that the guidelines adequately meet
			 the purposes of sentencing as set forth in <external-xref legal-doc="usc" parsable-cite="usc/18/3553">section 3553(a)(2)</external-xref> of title 18,
			 United States Code.</text>
				</paragraph></subsection></section></legis-body>
