		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Preserving United States Attorney
			 Independence Act of 2007</short-title></quote>.</text>
		</section><section id="id1B5AFA3B39664B15B21D9B9874257B3C"><enum>2.</enum><header>Vacancies</header><text display-inline="no-display-inline"><deleted-phrase committee-id="SSJU00" reported-display-style="strikethrough">Section 546 of title 28, United States
			 Code, is amended to read as follows:</deleted-phrase></text>
			<quoted-block display-inline="no-display-inline" id="idD00DB3E1C9EF44D499A72641B5D8E2A1" style="USC">
				<section changed="deleted" committee-id="SSJU00" id="idA7BEA1DD20E34079A34F5F84B31D561B" reported-display-style="strikethrough"><enum>546.</enum><header>Vacancies</header><text display-inline="no-display-inline">The United States district court for a
				district in which the office of the United States attorney is vacant may
				appoint a United States attorney to serve until that vacancy is filled. The
				order of appointment by the court shall be filed with the clerk of the
				court.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
			<subsection id="id0226D0F023524548A2898795FC27989F" reported-display-style="italic"><enum></enum><text>Section 546 of title 28, United States
			 Code, is amended by striking subsection (c) and inserting the following:</text>
				<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id592137ECEA44498D8F0F07EF683EDFFC" reported-display-style="italic" style="OLC">
					<subsection id="ID61587863497b476a9213218bc40cc5cd"><enum>(c)</enum><text>A person appointed as
				United States attorney under this section may serve until the earlier
				of—</text>
						<paragraph id="IDecdbd828add14d9f88d9c7ec491c9011"><enum>(1)</enum><text>the qualification of a
				United States attorney for such district appointed by the President under
				section 541 of this title; or</text>
						</paragraph><paragraph id="ID68368d6ed5cc4179839cd6d5baefff76"><enum>(2)</enum><text>the expiration of 120
				days after appointment by the Attorney General under this section.</text>
						</paragraph></subsection><subsection id="IDb3cad62e23aa4f1d8eb5ad9f607bfc04"><enum>(d)</enum><text>If an appointment expires
				under subsection (c)(2), the district court for such district may appoint a
				United States attorney to serve until the vacancy is filled. The order of
				appointment by the court shall be filed with the clerk of the
				court.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="added" committee-id="SSJU00" id="id0BD90F536E9F4251892A9A579620241B" reported-display-style="italic"><enum>3.</enum><header>Applicability</header>
			<subsection id="idA93737207FD44EDB8EB20F9CA974FAED"><enum>(a)</enum><header>In
			 general</header><text>The amendments made by this Act shall take effect on the
			 date of enactment of this Act.</text>
			</subsection><subsection id="idB5521994C15A4551B68611FFEE2E5A00"><enum>(b)</enum><header>Application</header>
				<paragraph id="idCC01EB03594C434AAA53574F6ACF9E54"><enum>(1)</enum><header>In
			 general</header><text>Any person serving as a United States attorney on the day
			 before the date of enactment of this Act who was appointed under section 546 of
			 title 28, United States Code, may serve until the earlier of—</text>
					<subparagraph id="ID122f4a66f07d46a79c97a2d8da2cd122"><enum>(A)</enum><text>the qualification of a
			 United States attorney for such district appointed by the President under
			 section 541 of that title; or</text>
					</subparagraph><subparagraph id="ID30b7d84268b8445794d4e63ca5ff07af"><enum>(B)</enum><text>120 days after the date
			 of enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="id5F68BC07ECD443E7B1A185BA8C5D3441"><enum>(2)</enum><header>Expired
			 appointments</header><text>If an appointment expires under paragraph (1), the
			 district court for that district may appoint a United States attorney for that
			 district under section 546(d) of title 28, United States Code, as added by this
			 Act.</text>
