		  program to provide incentives for projects to produce synthetic gas, liquid
		  fuels, and other products from coal and other feedstocks while simultaneously
		  reducing greenhouse gas emissions and reliance of the United States on
		  petroleum and natural gas, and for other purposes.</official-title>

		<section id="id793289FC362445B0868284E2C4D8DF68" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Coal Fuels and Industrial Gasification
			 Demonstration and Development Act of 2007</short-title></quote>.</text>
		</section><section id="idBA802E15C79247E093453143ABE9650C"><enum>2.</enum><header>Coal innovation
			 program</header>
			<subsection id="ID6c20d02534854ec394f5d68d313dfc34"><enum>(a)</enum><header>In
			 general</header><text>Title XXXI of the Energy Policy Act of 1992 (42 U.S.C.
			 13571 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBA5BCB5272D74FA79841E23579A3BA5C" style="OLC">
					<section id="id69A49776676647ACB4D92281F98E70C2"><enum>3105.</enum><header>Coal
				innovation program</header>
						<subsection id="ID6b0f863701a54133b3ab3f64bb46dc76"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="ID958269b2230847669e85cd17c60b8ddc"><enum>(1)</enum><header>Administrator</header><text>The
				term <term>Administrator</term> means the Administrator of the Environmental
				Protection Agency.</text>
							</paragraph><paragraph id="id0572C659251B4F909689700406E2F8F5"><enum>(2)</enum><header>Carbon
				capture</header><text>The term <term>carbon capture</term> means the capture,
				separation, and compression of carbon dioxide that would otherwise be released
				to the atmosphere at a facility in the production of end products of a project
				prior to transportation of the carbon dioxide to a long-term storage
				site.</text>
							</paragraph><paragraph id="id85474E6CB7474AC584ED25BC58FE8BC0"><enum>(3)</enum><header>Coal-to-liquid
				product</header><text>The term <term>coal-to-liquid product</term> means a
				liquid fuel resulting from the conversion of a feedstock, as described in this
				section.</text>
							</paragraph><paragraph id="ID9c00129586574228a0a6a15169c4aa5e"><enum>(4)</enum><header>Combustible end
				product</header><text>The term <term>combustible end product</term> means any
				product of a facility intended to be used as a combustible fuel.</text>
							</paragraph><paragraph id="IDd265615dd09b4848a3f2d647e34a6491"><enum>(5)</enum><header>Conventional
				baseline emissions</header><text>The term <term>conventional baseline
				emissions</term> means—</text>
								<subparagraph id="ID8ebf49a4db064ad7aaab5c83b23307e4"><enum>(A)</enum><text>the lifecycle
				greenhouse gas emissions of a facility that produces combustible end products,
				using petroleum as a feedstock, that are equivalent to combustible end products
				produced by a facility of comparable size through an eligible project;</text>
								</subparagraph><subparagraph commented="no" id="ID257f698f082049eebb0c41eb584b5374"><enum>(B)</enum><text>in the case of
				noncombustible products produced through an eligible project, the average
				lifecycle greenhouse gas emissions emitted by projects that—</text>
									<clause commented="no" id="id7E7DB128D7F648C7B6AB2498D68A963F"><enum>(i)</enum><text>are of comparable
				size; and</text>
									</clause><clause commented="no" id="id258236F98D43477AB3B44A63228CBFFB"><enum>(ii)</enum><text>produce
				equivalent products using conventional feedstocks; and</text>
									</clause></subparagraph><subparagraph commented="no" id="IDa9f584d1326b410bb629582f9012684a"><enum>(C)</enum><text>in the case of
				synthesized gas intended for use as a combustible fuel in lieu of natural gas
				produced by an eligible project, the lifecycle greenhouse gas emissions that
				would result from equivalent use of natural gas.</text>
								</subparagraph></paragraph><paragraph commented="no" id="id2BCEC63674B74672AB77F042BC77AA10"><enum>(6)</enum><header>Conventional
				feedstock</header>
								<subparagraph commented="no" id="idD1220DFB23C2476993BCF48C2D09DA08"><enum>(A)</enum><header>In
				general</header><text>The term <term>conventional feedstock</term> means a
				traditional carbon-based feedstock that—</text>
									<clause commented="no" id="idBC8A1AC978E345BBA6376A0936770655"><enum>(i)</enum><text>is supplied to
				any powerplant, oil refinery, or petrochemical production facility that is
				located in the United States as of the date of enactment of this section;
				and</text>
									</clause><clause commented="no" id="id55BCFBEB51394B7E9C08E51C9581DFCF"><enum>(ii)</enum><text>could be made
				available in large quantities under a long-term contract.</text>
									</clause></subparagraph><subparagraph commented="no" id="id37A89F9E827E45C4BBE15D240FA7CF09"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>conventional feedstock</term> includes—</text>
									<clause commented="no" id="idF51A0B173034494A84D593C70D0BFACB"><enum>(i)</enum><text>coal;</text>
									</clause><clause commented="no" id="id42E456DF04E44D309016D5BC17893CBC"><enum>(ii)</enum><text>natural gas;
				and</text>
									</clause><clause commented="no" id="id8A855A5C561A403CB0D6FB401DF673ED"><enum>(iii)</enum><text>crude
				oil.</text>
									</clause></subparagraph><subparagraph commented="no" id="id285C72D981FB4EEE9C03FCC34969B74A"><enum>(C)</enum><header>Exclusions</header><text>The
				term <term>conventional feedstock</term> does not include—</text>
									<clause commented="no" id="idA9602948A583496995D8085230F82EC7"><enum>(i)</enum><text>petroleum coke;
				and</text>
									</clause><clause commented="no" id="idEA0EB07414EB4849A6EEEE146BA49421"><enum>(ii)</enum><text>biomass.</text>
									</clause></subparagraph></paragraph><paragraph id="ID8cbc54da38454f22ac5620ecdfa1dc1e"><enum>(7)</enum><header>Deep saline
				formation</header><text>The term <term>deep saline formation</term> means a
				measurable unit of rock that contains nonpotable water that is—</text>
								<subparagraph id="idCDC3324FE8674F9E9A941E9088952855"><enum>(A)</enum><text>present in a
				stratigraphic column located beneath any fresh potable water aquifer;
				and</text>
								</subparagraph><subparagraph id="id970CF6C93BB34838A3FCDE3766280759"><enum>(B)</enum><text>of a sufficient
				depth to store carbon dioxide in a supercritical phase.</text>
								</subparagraph></paragraph><paragraph id="id263803EBD15F4FFC92735439242BF8F1"><enum>(8)</enum><header>Eligible
				feedstock</header><text>The term <term>eligible feedstock</term>
				includes—</text>
								<subparagraph id="id92FE060C1BA64EF68D37B2415173A409"><enum>(A)</enum><text>coal;</text>
								</subparagraph><subparagraph id="idFA599379609C4B808B7D6A0CBC273A8D"><enum>(B)</enum><text>petroleum
				residue;</text>
								</subparagraph><subparagraph id="idD30D943A61EE4F70BFD99C1275F54EC0"><enum>(C)</enum><text>renewable
				biomass; and</text>
								</subparagraph><subparagraph id="id2B1A9EB0FE79440E82929C21BBB4FA3E"><enum>(D)</enum><text>any other
				combination of materials of which coal is the predominant component with
				respect to energy content.</text>
								</subparagraph></paragraph><paragraph id="id56B6C117AAE042CA903398A8573E983B"><enum>(9)</enum><header>Eligible
				project</header><text>The term <term>eligible project</term> means a
				project—</text>
								<subparagraph id="idBDD0B13524C647ADBF3637D6B669FDE6"><enum>(A)</enum><text>that produces
				liquid transportation fuels, industrial chemicals, or electricity; and</text>
								</subparagraph><subparagraph id="idBB9735868E754228989A39CA966534DD"><enum>(B)</enum><text>for which—</text>
									<clause id="ID76720ead92cf4ff78c81100693123e83"><enum>(i)</enum><text>with respect to a
				project that is selected by the Secretary during a period described in
				subsection (b)(2)(C)(i) or subsection (c)(3)(C)(i)—</text>
										<subclause id="idBC9FC1D392214248B5CA33555E308282"><enum>(I)</enum><text>the annual
				lifecycle greenhouse gas emissions are not greater than conventional baseline
				emissions;</text>
										</subclause><subclause id="id7A0AF656A7DF4E61817F3973893675B7"><enum>(II)</enum><text>at least 70
				percent of the carbon dioxide that would otherwise be released to the
				atmosphere at the facility in the production of end products from the project
				is captured for long-term storage; and</text>
										</subclause><subclause id="id94B38118013E412F9877E83C31C396C6"><enum>(III)</enum><text>the individual
				or entity carrying out the eligible project has entered into an enforceable
				agreement with the Secretary to implement carbon capture at the percentage
				that, by the end of the 5-year period after commencement of commercial
				operation of the eligible project achieves a reduction in carbon emissions that
				is not less than 70 percent;</text>
										</subclause></clause><clause id="id55888BBA9FC64819BA12EAD0C82CF963"><enum>(ii)</enum><text>with respect to
				a project that is selected by the Secretary during a period described in
				subsection (b)(2)(C)(ii) or subsection (c)(3)(C)(ii)—</text>
										<subclause id="idA9BC0F6DB25A4FDD9E1041E287F8A04A"><enum>(I)</enum><text>the annual
				lifecycle greenhouse gas emissions are at least 15 percent lower than
				conventional baseline emissions;</text>
										</subclause><subclause id="id1837F32740194389BE50370467F60E7E"><enum>(II)</enum><text>at least 80
				percent of the carbon dioxide that would otherwise be released to the
				atmosphere at the facility in the production of end products from the project
				is captured for long-term storage; and</text>
										</subclause><subclause id="ID24cbbbaafeea49c6910a446030106229"><enum>(III)</enum><text>the individual
				or entity carrying out the eligible project has entered into an enforceable
				agreement with the Secretary to implement carbon capture at the percentage
				that, by the end of the 5-year period after commencement of commercial
				operation of the eligible project achieves a reduction in carbon emissions that
				is not less than 80 percent; and</text>
										</subclause></clause><clause id="ID2f4892bf4a5144c08110a70d5fb88a34"><enum>(iii)</enum><text>in the opinion
				of the Secretary, sufficient commitments have been secured to achieve long-term
				storage of captured carbon dioxide beginning as of the date of commencement of
				commercial operation of the project.</text>
									</clause></subparagraph></paragraph><paragraph id="ID0ddea4e281444266a7d3ed83c58695ea"><enum>(10)</enum><header>Facility</header><text>The
				term <term>facility</term> means a facility at which the conversion of
				feedstocks to end products takes place.</text>
							</paragraph><paragraph id="IDbfd6b71a850b483e881e8a121e60df70"><enum>(11)</enum><header>Gasification
				technology</header><text>The term <term>gasification technology</term> means
				any process that—</text>
								<subparagraph id="id473EC613745A4DAE86160D74A7BFD476"><enum>(A)</enum><text>converts coal,
				petroleum residue, renewable biomass, or other material that is recovered for
				energy or feedstock value into a synthesis gas composed primarily of carbon
				monoxide and hydrogen for direct use or subsequent chemical or physical
				conversion; and</text>
								</subparagraph><subparagraph id="id8542ECB426F9499A83FB97DF61FE0788"><enum>(B)</enum><text>produces oxygen
				for the gasification, conditioning, or cleanup of synthetic gas to prepare the
				synthetic gas for downstream use.</text>
								</subparagraph></paragraph><paragraph id="IDa2ed033f12974d78b25ad72bba667eb2"><enum>(12)</enum><header>Greenhouse
				gas</header><text>The term <term>greenhouse gas</term> means any of—</text>
								<subparagraph id="ID72c26c587de8440a85b50dbf621f32e9"><enum>(A)</enum><text>carbon
				dioxide;</text>
								</subparagraph><subparagraph id="ID66070ce3fb2c48fcb553ca462e8e271e"><enum>(B)</enum><text>methane;</text>
								</subparagraph><subparagraph id="ID35b7184501d04e4ca0178272c9ebaecf"><enum>(C)</enum><text>nitrous
				oxide;</text>
								</subparagraph><subparagraph id="ID8b5cf7e159fb43a99b5461b14a930de8"><enum>(D)</enum><text>hydrofluorocarbons;</text>
								</subparagraph><subparagraph id="IDec76890b2903413cbe9c4ec5e73dba7d"><enum>(E)</enum><text>perfluorocarbons;
				and</text>
								</subparagraph><subparagraph id="ID64fc342de44e426e8a32037699b8dabd"><enum>(F)</enum><text>sulfur
				hexafluoride.</text>
								</subparagraph></paragraph><paragraph id="IDa811b95a55894179ba0b9018ad88aef6"><enum>(13)</enum><header>Lifecycle
				greenhouse gas emissions</header><text>The term <term>lifecycle greenhouse gas
				emissions</term> means the aggregate quantity of greenhouse gases directly
				attributable to the production and transportation of end products at a
				facility, including the production, extraction, cultivation, distribution, and
				transportation of feedstocks, and the subsequent distribution and use of any
				combustible end products, as modified by deducting, as determined by the
				Administrator—</text>
								<subparagraph id="ID2aca57f7c2b5413d986f75e68b12b26c"><enum>(A)</enum><text>any greenhouse
				gases captured at the facility and sequestered;</text>
								</subparagraph><subparagraph id="IDb5ec7ba762ce43faa2d50769d03ed488"><enum>(B)</enum><text>the carbon
				content, expressed in units of carbon dioxide equivalent, of any feedstock that
				is renewable biomass;</text>
								</subparagraph><subparagraph id="ID052155215f02416d9add67298804bafe"><enum>(C)</enum><text>the carbon
				content, expressed in units of carbon dioxide equivalent, of any end products
				that do not result in the release of carbon dioxide to the atmosphere;
				and</text>
								</subparagraph><subparagraph id="idC0F2BCEE505344D2883F7464CE5C0657"><enum>(D)</enum><text>the acreage of
				terrestrial sequestration that is used to grow feedstocks to be used at the
				facility, including soil-root carbon storage areas at which—</text>
									<clause id="idF90EAB8F066B43CFBCB4732EB8B0F59D"><enum>(i)</enum><text>biomass is grown
				on carbon-depleted soils; and</text>
									</clause><clause id="id26161AB6853845DFB3FBAC63AB1D2D72"><enum>(ii)</enum><text>carbon is stored
				in the soil under which the biomass is grown.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" id="IDbbaf1893e98043c7bd8902d27d20a81c"><enum>(14)</enum><header>Long-term
				storage</header><text>The term <term>long-term storage</term> means
				sequestration with an expected maximum rate of carbon dioxide leakage over a
				specified period of time that is consistent with the objective of reducing
				atmospheric concentrations of carbon dioxide, subject to a permit issued
				pursuant to law in effect as of the date of the sequestration.</text>
							</paragraph><paragraph id="IDEDF62C774D264008AD0242E38FE733FB"><enum>(15)</enum><header>Renewable
				biomass</header><text>The term <term>renewable biomass</term> means—</text>
								<subparagraph id="IDE47109BD933E40389B8F36285E93DC25"><enum>(A)</enum><text>nonmerchantable
				materials or precommercial thinnings that—</text>
									<clause id="ID7E693777931942A99BF78C2C9AF92D36"><enum>(i)</enum><text>are byproducts of
				preventive treatments, such as trees, wood, brush, thinnings, chips, and slash,
				that are removed—</text>
										<subclause id="IDA3B7114F5DE742BFBA5E5745C955CB15"><enum>(I)</enum><text>to reduce
				hazardous fuels;</text>
										</subclause><subclause id="IDAB0D85B083B542A3BF7454A8368B86AD"><enum>(II)</enum><text>to reduce or
				contain disease or insect infestation; or</text>
										</subclause><subclause id="IDBF8153BAA21C412ABF0375DF50853E78"><enum>(III)</enum><text>to restore
				forest health;</text>
										</subclause></clause><clause id="ID0DB661EB58B54D12AE3E48299EFEC2C7"><enum>(ii)</enum><text>would not
				otherwise be used for higher-value products; and</text>
									</clause><clause id="IDF7C3004199FA4332B8191E5035752221"><enum>(iii)</enum><text>are harvested
				from National Forest System land or public lands (as defined in section 103 of
				the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of
				1976</act-name> (43 U.S.C. 1702))—</text>
										<subclause id="IDF8190DDB94614DA585C8502B4FDD92E9"><enum>(I)</enum><text>where permitted
				by law; and</text>
										</subclause><subclause id="IDE8835A7DFFEB400484955B10E726A7B5"><enum>(II)</enum><text>in accordance
				with—</text>
											<item id="ID0CD60778396F4B4A83E0E8B8AE4D0294"><enum>(aa)</enum><text>applicable land
				management plans; and</text>
											</item><item id="ID0B5EB86989144CF88032206CECC01EA9"><enum>(bb)</enum><text>the requirements
				for old-growth maintenance, restoration, and management direction of paragraphs
				(2), (3), and (4) of subsection (e), and the requirements for large-tree
				retention of subsection (f), of section 102 of the Healthy Forests Restoration
				Act of 2003 (16 U.S.C. 6512); or</text>
											</item></subclause></clause></subparagraph><subparagraph id="ID4F789F3025CF44CAB56718A1A97EDA8D"><enum>(B)</enum><text>any organic
				matter that is available on a renewable or recurring basis from non-Federal
				land or from land belonging to an Indian tribe, or an Indian individual, that
				is held in trust by the United States or subject to a restriction against
				alienation imposed by the United States, including—</text>
									<clause id="IDBC4E462E11BA4784A96E26F9B978B272"><enum>(i)</enum><text>renewable plant
				material, including—</text>
										<subclause id="ID2B19F04DFE1944F3994DEC715ADDF295"><enum>(I)</enum><text>feed
				grains;</text>
										</subclause><subclause id="ID3A6E25FDB37F44D095009C5604E52063"><enum>(II)</enum><text>agricultural
				commodities (including any crop that is planted as an energy crop);</text>
										</subclause><subclause id="ID5F8022A65F024A7AABB06A25FFEAA990"><enum>(III)</enum><text>plants and
				trees; and</text>
										</subclause><subclause id="ID406AACEB2DAD45A3BA14EF7A67E7143B"><enum>(IV)</enum><text>algae;
				and</text>
										</subclause></clause><clause id="IDF30457E2F5934C8FB0AD4119E811E5A5"><enum>(ii)</enum><text>waste material,
				including—</text>
										<subclause id="ID7ECD6D155CAF4AA6957C68FC4C655435"><enum>(I)</enum><text>crop
				residue;</text>
										</subclause><subclause id="ID4069B6897A274CA48DD1168D8DE44241"><enum>(II)</enum><text>vegetative waste
				material (including wood waste and wood residues);</text>
										</subclause><subclause id="IDB6675C11D92B42F3A7E714FF3AA68BE1"><enum>(III)</enum><text>animal waste
				and byproducts (including fats, oils, greases, and manure); and</text>
										</subclause><subclause id="ID894099ADAA0343A9849D84F8CCAEC932"><enum>(IV)</enum><text>food waste and
				yard waste.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="ID1175ee8abf23498bbb3b61eda7fee751"><enum>(16)</enum><header>Sequestration</header><text>The
				term <term>sequestration</term> means the placement of carbon dioxide in a
				geological formation, including—</text>
								<subparagraph id="ID51cbd3988591469dbff36988db15cc24"><enum>(A)</enum><text>an operating oil
				and gas field;</text>
								</subparagraph><subparagraph id="ID7597abed52b843f99cd864cdc6cd7b2c"><enum>(B)</enum><text>coal bed methane
				recovery;</text>
								</subparagraph><subparagraph id="IDcde4bcf9f5424bc499d426fe18e4434a"><enum>(C)</enum><text>a depleted oil
				and gas field;</text>
								</subparagraph><subparagraph id="IDbb8a1bdaa9c64dd8936cd5d5d1b84ad6"><enum>(D)</enum><text>an unmineable
				coal seam;</text>
								</subparagraph><subparagraph id="ID649d1a7b0da245bcbb629700024825f2"><enum>(E)</enum><text>a deep saline
				formation; and</text>
								</subparagraph><subparagraph id="ID89c937bc130149c1b661d95da62871f8"><enum>(F)</enum><text>a deep geological
				system.</text>
								</subparagraph></paragraph><paragraph id="id0EF4E246A86645009B6BFA3FD2DA093D"><enum>(17)</enum><header>Unmineable
				coal seam</header><text>The term <term>unmineable coal seam</term> means a coal
				seam that is—</text>
								<subparagraph id="id52D9CD1A8E7047BDA2D48B109E515FC8"><enum>(A)</enum><text>determined by the
				Secretary of the Interior to be economically unrecoverable (including by any
				foreseeable advance in mining technology); and</text>
								</subparagraph><subparagraph id="idDE99870B71644452AD71ED03538C16FA"><enum>(B)</enum><text>located at a
				depth at which the temperature and pressure at the coal seam are sufficient to
				maintain carbon dioxide in a supercritical phase.</text>
								</subparagraph></paragraph></subsection><subsection id="ID5988b8dee4d348578106b841210de8ca"><enum>(b)</enum><header>Financial
				assistance cooperative agreement program</header>
							<paragraph id="IDcb75dbe59af846c4961d6ca17edfaeca"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (3), not later than 1 year after the
				date of the enactment of this section, the Secretary shall carry out a program
				to provide grants for use in obtaining or carrying out any services necessary
				for the planning and permitting of an eligible project.</text>
							</paragraph><paragraph id="ID6d44cabf1d7f4cd38b62ee68a59190a4"><enum>(2)</enum><header>Selection of
				eligible projects</header>
								<subparagraph id="id71BCCD1EA4B34C7BA728CC3535130BA2"><enum>(A)</enum><header>In
				general</header><text>In accordance with subparagraphs (B) and (C), the
				Secretary shall select eligible projects to receive grants under this
				subsection—</text>
									<clause id="IDdbc6a657a5e54b48967644af96e26d98"><enum>(i)</enum><text>through the
				conduct of a reverse auction, in which eligible projects proposed to be carried
				out that have the greatest percentage reduction of lifecycle greenhouse gas
				emissions in comparison to facilities that use conventional feedstocks and do
				not use carbon capture and sequestration technologies, are given
				priority;</text>
									</clause><clause id="ID51ddf188e7504dc9a93a974bb09771fd"><enum>(ii)</enum><text>that, taken
				together, would—</text>
										<subclause id="ID1e724303fc7c4e2580958d2e966352c0"><enum>(I)</enum><text>represent a
				variety of geographical regions;</text>
										</subclause><subclause id="id09997FA99DB648899BD07650E6967277"><enum>(II)</enum><text>represent a
				variety of facilities, each of which is capable of producing a different
				quantity of synthetic gas, liquid fuel, or other product from coal and other
				feedstocks;</text>
										</subclause><subclause id="IDe0057f8ab9df4447be3ca8de5732aebb"><enum>(III)</enum><text>use a variety
				of feedstocks and types of coal; and</text>
										</subclause><subclause id="idD276E43C8A41439496D74C0625A7D6FF"><enum>(IV)</enum><text>to the extent
				consistent with achieving long-term storage, represent a variety of geological
				formations; and</text>
										</subclause></clause><clause id="ID4ce6bb524145499c971f0796fab269ad"><enum>(iii)</enum><text>for which
				eligible projects, in the opinion of the Secretary—</text>
										<subclause id="ID8b525dc68b234bde94ad953aa4b54703"><enum>(I)</enum><text>each award
				recipient is financially viable without the receipt of additional Federal
				funding associated with the proposed project;</text>
										</subclause><subclause id="ID4bcf94eb2a9c42b78bcfc35e77ab1ccf"><enum>(II)</enum><text>each recipient
				will provide sufficient information to the Secretary for the Secretary to
				ensure that the qualified investment is expended efficiently and
				effectively;</text>
										</subclause><subclause id="IDbd3e54ccaa5b4d4db7dedc6c6bdcac07"><enum>(III)</enum><text>a market exists
				for the products of the proposed project, as evidenced by contracts or written
				statements of intent from potential customers;</text>
										</subclause><subclause id="IDa379e02757d444a4ad2f8799fa1fc067"><enum>(IV)</enum><text>the project team
				of each recipient is competent in the construction and operation of the
				gasification technology proposed; and</text>
										</subclause><subclause id="IDdd3a132ef6444ebbaf2bba538addafc3"><enum>(V)</enum><text>each recipient
				has met such other criteria as may be established and published by the
				Secretary.</text>
										</subclause></clause></subparagraph><subparagraph id="id6866180AAF064E1F829BE16610866A70"><enum>(B)</enum><header>Special
				consideration</header><text>In selecting eligible projects under subparagraph
				(A), the Secretary shall give special consideration to projects that—</text>
									<clause id="id95C2372274524F8EBE7081F04700586D"><enum>(i)</enum><text>include a
				feedstock that is comprised of a quantity of biomass that is greater than 5
				percent of the total quantity of the feedstock (as measured by the weight of
				the feedstock); or</text>
									</clause><clause id="idCB83F86A3DA742B285435B3D45882690"><enum>(ii)</enum><text>participate in a
				regional carbon sequestration partnership, as described in the notice entitled
				<quote>Notice of Availability of a Financial Assistance Solicitation</quote>
				(67 Fed. Reg. 71540 (December 2, 2002<added-phrase reported-display-style="italic"></added-phrase>)).</text>
									</clause></subparagraph><subparagraph id="id2519107B3A46497EA1D0508170483B6A"><enum>(C)</enum><header>Authorized
				quantity of eligible projects</header><text>In carrying out subparagraph (A),
				the Secretary shall—</text>
									<clause id="id0EE90DFC46C04C32ACA1944B87F1B47D"><enum>(i)</enum><text>for the 5-year
				period beginning on the date that is 1 year after the date of enactment of this
				section, select a quantity of not more than 3 eligible projects; and</text>
									</clause><clause id="id42CA42BB509B4C4BAE158F4C5009C68C"><enum>(ii)</enum><text>for the 5-year
				period beginning on the date that is 6 years after the date of enactment of
				this section, select a quantity of not more than 3 eligible projects.</text>
									</clause></subparagraph></paragraph><paragraph id="id341D14925FCB4C98B5C6DD7E11EDA4DE"><enum>(3)</enum><header>Maximum amount
				of grants</header><text>In carrying out this subsection, the Secretary shall
				provide not more than—</text>
								<subparagraph id="id4D87B3AED0264C2A901889A01BBA5DD8"><enum>(A)</enum><text>$20,000,000 in
				grant funds for any eligible project; and</text>
								</subparagraph><subparagraph id="idE74F7F12954148D0878981BAEC086259"><enum>(B)</enum><text>$120,000,000 in
				grant funds, in the aggregate, for all eligible projects.</text>
								</subparagraph></paragraph></subsection><subsection id="IDeb19650bf73045f8ae18b4f79a4f62f3"><enum>(c)</enum><header>Direct loan
				program</header>
							<paragraph id="IDb4e6b0a95d66430e9bf0603a03d8f57a"><enum>(1)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of this
				section, and subject to funds being made available in advance through
				appropriations Acts, the Secretary shall carry out a program to provide a total
				of not more than $10,000,000,000 in loans to eligible individuals and entities
				(as determined by the Secretary) for use in carrying out eligible
				projects.</text>
							</paragraph><paragraph id="IDFD7FCBBFC994434884A6C3B8CB761E1F"><enum>(2)</enum><header>Application</header><text>To
				receive a loan from the Secretary under paragraph (1), an applicant shall
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require, including a written
				assurance that—</text>
								<subparagraph id="ID3952548AFF6C4D80995E3EA4BB182421"><enum>(A)</enum><text>all laborers and
				mechanics employed by contractors or subcontractors during construction,
				alteration, or repair that is financed, in whole or in part, by a loan under
				this subsection shall be paid wages at rates that are not less than those
				prevailing on similar construction in the locality, as determined by the
				Secretary of Labor in accordance with sections 3141 through 3144, 3146, and
				3147 of title 40, United States Code; and</text>
								</subparagraph><subparagraph id="IDF0B814A869B748B685235D768147D47A"><enum>(B)</enum><text>the Secretary of
				Labor shall, with respect to the labor standards described in this paragraph,
				have the authority and functions set forth in Reorganization Plan Numbered 14
				of 1950 (5 U.S.C. App.) and section 3145 of title 40, United States
				Code.</text>
								</subparagraph></paragraph><paragraph id="ID9248c537bc8840bf89cde082468c0280"><enum>(3)</enum><header>Selection of
				eligible projects</header>
								<subparagraph id="idF19A7477543D49628086D3CAF6C8E096"><enum>(A)</enum><header>In
				general</header><text>In accordance with subparagraphs (B) and (C), the
				Secretary shall select eligible projects to receive loans under this
				subsection—</text>
									<clause id="IDb27c2db242324c7ab7aaf256c0809c05"><enum>(i)</enum><text>through the
				conduct of a reverse auction, in which eligible projects proposed to be carried
				out that have the greatest percentage reduction of lifecycle greenhouse gas
				emissions in comparison to facilities that use conventional feedstocks and do
				not use carbon capture and sequestration technologies, are given
				priority;</text>
									</clause><clause id="IDd04acf167ae14beca9da4cd2f674cd16"><enum>(ii)</enum><text>that, taken
				together, would—</text>
										<subclause id="ID1f66d0c31bb54fe39ab59276c7c8cc99"><enum>(I)</enum><text>represent a
				variety of geographic regions;</text>
										</subclause><subclause id="id590A29C37315433BB306B21FD1940E54"><enum>(II)</enum><text>represent a
				variety of facilities, each of which is capable of producing a different
				quantity of synthetic gas, liquid fuel, or other product from coal and other
				feedstocks;</text>
										</subclause><subclause id="IDbf26792eadb64e55bda6c40b92c264a5"><enum>(III)</enum><text>use a variety
				of types of feedstocks and coal; and</text>
										</subclause><subclause id="id5B9C914BF2A8479DBB71A784A666B59A"><enum>(IV)</enum><text>to the extent
				consistent with achieving long-term storage, represent a variety of geological
				formations; and</text>
										</subclause></clause><clause id="id87A3A939BA8D450FB0EAB14F039A53C5"><enum>(iii)</enum><text>for which
				eligible projects, in the opinion of the Secretary—</text>
										<subclause id="id447DD4857FB04543B3CF602B8367FB9D"><enum>(I)</enum><text>each award
				recipient is financially viable without the receipt of additional Federal
				funding associated with the proposed project;</text>
										</subclause><subclause id="idFF1900CC67FD41DCAD54EF038FD8C24B"><enum>(II)</enum><text>each recipient
				will provide sufficient information to the Secretary for the Secretary to
				ensure that the qualified investment is expended efficiently and
				effectively;</text>
										</subclause><subclause id="idCAF86B1D8DA241D4BBC62D2E2801CA64"><enum>(III)</enum><text>a market exists
				for the products of the proposed project, as evidenced by contracts or written
				statements of intent from potential customers;</text>
										</subclause><subclause id="id9A526D3BE4DC4BF5994791D519FFF341"><enum>(IV)</enum><text>the project team
				of each recipient is competent in the construction and operation of the
				gasification technology proposed; and</text>
										</subclause><subclause id="idF0E58D9F58DE4EB1887C4D7CB10C8F25"><enum>(V)</enum><text>each recipient
				has met such other criteria as may be established and published by the
				Secretary.</text>
										</subclause></clause></subparagraph><subparagraph id="id32AC3E3E291E4520B993788486B5B71E"><enum>(B)</enum><header>Special
				consideration</header><text>In selecting eligible projects under subparagraph
				(A), the Secretary shall give special consideration to projects that—</text>
									<clause id="id3641B2CD81F94D24B36E471E95061A63"><enum>(i)</enum><text>include a
				feedstock that is comprised of a quantity of biomass that is greater than 5
				percent of the total quantity of the feedstock (as measured by the weight of
				the feedstock); or</text>
									</clause><clause id="id0E81C5543845482B990D633B5ADF9A89"><enum>(ii)</enum><text>participate in a
				regional carbon sequestration partnership, as described in the notice entitled
				<quote>Notice of Availability of a Financial Assistance Solicitation</quote>
				(67 Fed. Reg. 71540 (December 2, 2002<added-phrase reported-display-style="italic"></added-phrase>)).</text>
									</clause></subparagraph><subparagraph id="id0105B7FAE90846E4AC6C633F6B607EF6"><enum>(C)</enum><header>Authorized
				quantity of eligible projects</header><text>In carrying out subparagraph (A),
				the Secretary shall—</text>
									<clause id="idB78D4AEA51C042B4B500C40DE2946374"><enum>(i)</enum><text>for the 5-year
				period beginning on the date that is 1 year after the date of enactment of this
				section, select a quantity of not more than 3 eligible projects; and</text>
									</clause><clause id="id1349C43D982543D8B60A6ACBE687CACB"><enum>(ii)</enum><text>for the 5-year
				period beginning on the date that is 6 years after the date of enactment of
				this section, select a quantity of not more than 3 eligible projects.</text>
									</clause></subparagraph></paragraph><paragraph id="ID2b87f5b9383d4025b6c459a4f1de7f42"><enum>(4)</enum><header>Use of loan
				funds</header>
								<subparagraph id="ID2ef454aadce34c03b2c6c7ebbc5bf84b"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), funds from a loan provided
				under this subsection may be used to pay up to 100 percent of the costs of
				capital associated with reducing lifecycle greenhouse gas emissions at the
				facility (including carbon dioxide capture, compression, and long-term storage,
				cogeneration, and gasification of biomass) carried out as part of an eligible
				project, including—</text>
									<clause id="id7B401F367C374CB1AD41A6A86F48683A"><enum>(i)</enum><text>equipment
				relating to—</text>
										<subclause id="id1A34ACD863104814AA2516537400E70A"><enum>(I)</enum><text>the air
				separation unit of the facility;</text>
										</subclause><subclause id="id0A66F7F75CE6456F9241E7C911258AC8"><enum>(II)</enum><text>the separation
				or capture of carbon dioxide;</text>
										</subclause><subclause id="id6E74A4309BD04F6AB1071360831F09CE"><enum>(III)</enum><text>the
				purification or drying of carbon dioxide;</text>
										</subclause><subclause id="id104D0E95B4934D568E1922083889EF51"><enum>(IV)</enum><text>the compression
				of carbon dioxide;</text>
										</subclause><subclause id="id8FA740C97C9D45B4BC80BA99333F1531"><enum>(V)</enum><text>the long-term
				storage of carbon dioxide;</text>
										</subclause><subclause id="id88382D31D34149048C673D1A33C05808"><enum>(VI)</enum><text>the cogeneration
				of electric power;</text>
										</subclause><subclause id="id49914347425C49B3907F7036115D53C2"><enum>(VII)</enum><text>the cleanup of
				synthetic gas at the facility; and</text>
										</subclause><subclause id="idF8FD447C051F45C0A7D79BE94567BE74"><enum>(VIII)</enum><text>the water-gas
				shift reactor of the facility;</text>
										</subclause></clause><clause id="id1ECFBC2C72E549908A941EA6086814A8"><enum>(ii)</enum><text>fuel handling
				equipment that is used for—</text>
										<subclause id="id4D43D4A428AE43E89EB3963777E9982A"><enum>(I)</enum><text>cofeeding coal
				and biomass to a gasification system; and</text>
										</subclause><subclause id="id1A76C2CA2CCE4AB2AB27A028814A5A73"><enum>(II)</enum><text>feeding biomass
				to a gasification system; and</text>
										</subclause></clause><clause id="id0369E6F273BC4A3B843CD23CC021372D"><enum>(iii)</enum><text>a gasification
				system that is designed—</text>
										<subclause id="id5CD13DD815534320A4CE67A20944847C"><enum>(I)</enum><text>to operate with
				equipment that is used for the cofeeding of coal and biomass in producing an
				acceptable syngas for the production of liquid fuels, industrial chemicals, or
				electronic power; and</text>
										</subclause><subclause id="idE20EE62784B84C6894D16780FC2D34EC"><enum>(II)</enum><text>to operate with
				biomass.</text>
										</subclause></clause></subparagraph><subparagraph id="IDd952dd1cb08c460f812fd7f8f292da80"><enum>(B)</enum><header>Total project
				cost</header><text>Funds from a loan provided under this subsection may not be
				used to pay more than 50 percent of the total cost of an eligible
				project.</text>
								</subparagraph></paragraph><paragraph id="IDaf13c570973449c5a85e250d868b5216"><enum>(5)</enum><header>Rates, terms,
				and repayment of loans</header><text>A loan provided under this
				subsection—</text>
								<subparagraph id="IDae2dff408dd14937af6e898f0d675305"><enum>(A)</enum><text>shall have an
				interest rate that, as of the date on which the loan is made, is equal to the
				cost of funds to the Department of the Treasury for obligations of comparable
				maturity;</text>
								</subparagraph><subparagraph id="ID949be1fb77d54bda8788d9690bcdc65e"><enum>(B)</enum><text>shall have a term
				equal to the lesser of—</text>
									<clause id="ID234e7fba2eda49538643a609fe653cbe"><enum>(i)</enum><text>the projected
				life, in years, of the eligible project to be carried out using funds from the
				loan, as determined by the Secretary; and</text>
									</clause><clause id="ID53b8769724204545bec82c47a927ed1e"><enum>(ii)</enum><text>25 years;</text>
									</clause></subparagraph><subparagraph id="ID274373c347a04f11bf66f08586d4b50d"><enum>(C)</enum><text>may be subject to
				a deferral in repayment for not more than 5 years after the date on which the
				eligible project carried out using funds from the loan first begins operations,
				as determined by the Secretary; and</text>
								</subparagraph><subparagraph commented="no" id="ID21770365c880441d86831907ce86b684"><enum>(D)</enum><text>shall be made on
				the condition that the Secretary shall be subrogated to the rights of the
				recipient of the payment as specified in the loan or related agreements,
				including, as appropriate, the authority (notwithstanding any other provision
				of law)—</text>
									<clause commented="no" id="IDf621c2d60c6c48b6a43eed07dbd0a185"><enum>(i)</enum><text>to complete,
				maintain, operate, lease, or otherwise dispose of any property acquired
				pursuant to the guarantee or a related agreement; or</text>
									</clause><clause commented="no" id="ID3a8aa787f5fd456e977e0d62f9f46d10"><enum>(ii)</enum><text>to permit the
				borrower, pursuant to an agreement with the Secretary, to continue to pursue
				the purposes of the project, if the Secretary determines the pursuit to be in
				the public interest.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="IDea6d32efca0d4765b07b2dbc8279c49a"><enum>(d)</enum><header>Methodology</header>
							<paragraph id="id05791390F24746D8877F1F1CB32F7F58"><enum>(1)</enum><header>In
				general</header><text>Not later than 18 months after the date of enactment of
				this section, in accordance with paragraph (2), the Administrator, in
				consultation with the Secretary and the Secretary of Defense, shall, by
				regulation, establish a methodology for use in determining the lifecycle
				greenhouse gas emissions of coal-derived liquid transportation fuels and other
				products produced using—</text>
								<subparagraph id="id0C3E8A8204AC47B696C4E5F3B22B62A0"><enum>(A)</enum><text>coal gasification
				technology;</text>
								</subparagraph><subparagraph id="idD855DEEAC46849018EED989A96CBDAEE"><enum>(B)</enum><text>coal and biomass
				gasification technology;</text>
								</subparagraph><subparagraph id="idCD46D67D6BFC4B3788654C44EC31C452"><enum>(C)</enum><text>the
				Fischer-Tropsch technology; and</text>
								</subparagraph><subparagraph id="id4B0B2880BDED4776AB36E0FAAE539D06"><enum>(D)</enum><text>any other
				technology that is in commercial use.</text>
								</subparagraph></paragraph><paragraph id="id1F9F709716D2424481688EABFFE5EACC"><enum>(2)</enum><header>Participation
				of certain individuals and entities</header><text>In establishing the
				methodology described in paragraph (1), the Administrator, in consultation with
				the Secretary and the Secretary of Defense, shall seek the participation of,
				and consider comments provided by—</text>
								<subparagraph id="id7FB78F68155E47B58C9AEBC2E8ECE12A"><enum>(A)</enum><text>individuals
				representing private sector organizations that may be affected by the
				methodology; and</text>
								</subparagraph><subparagraph id="idA9EADF524E52476DB1DD6E645FC9877C"><enum>(B)</enum><text>any other
				individual or entity that represents an interested organization.</text>
								</subparagraph></paragraph></subsection><subsection id="id378415955C66404185D36B18E05FD85B"><enum>(e)</enum><header>Reporting
				requirements</header>
							<paragraph id="ID254cea9bec374e22926afbe57fad272b"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the date on which an
				eligible project receives from the Secretary funds from a grant under
				subsection (b) or a loan under subsection (c), and each 90-day period
				thereafter, in accordance with paragraph (2), the individual or entity carrying
				out the eligible project shall submit to the Administrator a report that
				contains, for the period covered by the report—</text>
								<subparagraph id="id01A1E8BAEAC34F2398E7080452F988BE"><enum>(A)</enum><text>a description
				of—</text>
									<clause id="ID1b3a3fa48a2a4e859adedb77488afa96"><enum>(i)</enum><text>the quantity and
				type of fossil fuels and non-carbon dioxide greenhouse gases produced, refined,
				imported, exported, and consumed by the eligible project;</text>
									</clause><clause id="ID4c0353495bc84f3f801e6f36a59cd8f3"><enum>(ii)</enum><text>the greenhouse
				gas emissions in metric tons of each greenhouse gas emitted and in metric tons
				of carbon dioxide equivalent of each greenhouse gas emitted by the eligible
				project, measured using monitoring systems for fuel flow or emissions that
				use—</text>
										<subclause id="idA32F7B27359D46729E79FED8368D0130"><enum>(I)</enum><text>continuous
				emission monitoring; or</text>
										</subclause><subclause id="idBE22724112BE439BA64BA1C5AE204FAF"><enum>(II)</enum><text>an equivalent
				system of comparable rigor, accuracy, and quality; and</text>
										</subclause></clause><clause id="ID7f1e1acf59344273bcb6aded8ec72156"><enum>(iii)</enum><text>the quantity
				and type of—</text>
										<subclause id="ID5d40df3d727a46bfa675e599401b2df7"><enum>(I)</enum><text>feedstock fossil
				fuel consumption of the eligible project; and</text>
										</subclause><subclause id="IDa4a1699ef66e43f6835a266b7248cd45"><enum>(II)</enum><text>process
				emissions of the eligible project; and</text>
										</subclause></clause></subparagraph><subparagraph id="IDd1992859f3b34146965ea8d1bb1c2500"><enum>(B)</enum><text>any other data
				necessary for accurate accounting of greenhouse gas emissions, as determined by
				the Administrator.</text>
								</subparagraph></paragraph><paragraph id="idC967E63CE3564003A7FADA8C72A452F6"><enum>(2)</enum><header>Electronic
				submission of report</header><text>An individual or entity carrying out an
				eligible project described in paragraph (1) shall electronically submit to the
				Administrator each report required under that paragraph in such form and in
				such manner as may be required by the Administrator.</text>
							</paragraph><paragraph id="ID118388b497044543b7dcb61f62273db9"><enum>(3)</enum><header>No effect on
				other requirements</header><text>Nothing in this subsection affects any
				requirement in effect as of the date of enactment of this section relating to
				the reporting of—</text>
								<subparagraph id="idDD034EE98EF946F7AB5038C16729D67B"><enum>(A)</enum><text>fossil fuel
				production, refining, importation, exportation, or consumption data;</text>
								</subparagraph><subparagraph id="idEF9A529728034F0CB8EE1770354A99BF"><enum>(B)</enum><text>greenhouse gas
				emission data; or</text>
								</subparagraph><subparagraph id="id5CA2BCC7EFE24E589E821FCD57463E4C"><enum>(C)</enum><text>other relevant
				data.</text>
								</subparagraph></paragraph></subsection><subsection id="id33072F8365DC40EBA3C07003FE9F6412"><enum>(f)</enum><header>Study of
				maintaining coal-to-liquid products in Strategic Petroleum
				Reserve</header><text>Not later than 1 year after the date of enactment of this
				section, the Secretary and the Secretary of Defense shall—</text>
							<paragraph id="idA996E342D3E340F0B62945ED25EACA7C"><enum>(1)</enum><text>conduct a study
				of the feasibility and suitability of maintaining coal-to-liquid products in
				the Strategic Petroleum Reserve; and</text>
							</paragraph><paragraph id="idF0266C439B1B4A10AF2E460DEA5E3761"><enum>(2)</enum><text>submit to the
				Committee on Energy and Natural Resources and the Committee on Armed Services
				of the Senate and the Committee on Energy and Commerce and the Committee on
				Armed Services of the House of Representatives a report describing the results
				of the study.</text>
							</paragraph></subsection><subsection id="idFE63B7098C9D40BD85BC37438E2998F3"><enum>(g)</enum><header>Report on
				emissions of coal-to-liquid products used as transportation fuels</header>
							<paragraph id="ID99df27535f444adb8151c2b896ff1ae8"><enum>(1)</enum><header>In
				general</header><text>The Administrator, in cooperation with the Secretary, the
				Secretary of Defense, and the Administrator of the Federal Aviation
				Administration, shall—</text>
								<subparagraph id="ID55939aef97cf4e5ab2f343f8f14351ea"><enum>(A)</enum><text>carry out a
				research and demonstration program to evaluate the emissions of the use of
				coal-to-liquid fuel for transportation, including gasoline, diesel, marine, and
				jet fuel;</text>
								</subparagraph><subparagraph id="ID8d1c53c8669449c285f321ef09d75086"><enum>(B)</enum><text>evaluate the
				effect of using coal-to-liquid transportation fuel on emissions of vehicles,
				including motor vehicles and nonroad vehicles, and aircraft (as those terms are
				defined in sections 216 and 234, respectively, of the Clean Air Act (42 U.S.C.
				7550, 7574)); and</text>
								</subparagraph><subparagraph id="IDbc0ee3a15fec40e5a82e0486263b0676"><enum>(C)</enum><text>in accordance
				with paragraph (4), and not later than 540 days after the date of enactment of
				this section, submit to Congress a report on the effect on air and water
				quality, water scarcity, land use, and public health of using coal-to-liquid
				fuel in the transportation sector.</text>
								</subparagraph></paragraph><paragraph id="ID98cff714e3284eb1bdb973e4b26a0138"><enum>(2)</enum><header>Guidance and
				technical support</header><text>The Administrator, in consultation with the
				Secretary, shall issue any guidance or technical support documents necessary to
				facilitate the effective use of coal-to-liquid fuel and blends under this
				subsection.</text>
							</paragraph><paragraph id="IDa85479ce84a74f889d830ca0626f47ad"><enum>(3)</enum><header>Requirements</header><text>The
				program described in paragraph (1)(A) shall take into consideration—</text>
								<subparagraph id="IDc091400b431c48b2b5f7384f247c40e4"><enum>(A)</enum><text>the use of neat
				(100 percent) coal-to-liquid fuel and blends of coal-to-liquid fuels with
				conventional crude oil-derived fuel for heavy-duty and light-duty diesel
				engines, gasoline engines, marine propulsion, and the aviation sector;</text>
								</subparagraph><subparagraph id="IDde00b7ac9b1b425f874a0138be7c383b"><enum>(B)</enum><text>the production
				costs associated with domestic production of those fuels and prices for
				consumers; and</text>
								</subparagraph><subparagraph id="id04548F1EA38F4A2BAF4E6E0BA6C6DBDD"><enum>(C)</enum><text>the overall
				greenhouse gas effects of—</text>
									<clause id="id6E604655D7F84446BF51A57D677B2672"><enum>(i)</enum><text>substituting
				coal-derived fuels for crude oil-derived fuels;</text>
									</clause><clause id="idD1F153C9C1004E26B3415036F9C0F785"><enum>(ii)</enum><text>using carbon
				capture and storage technologies; and</text>
									</clause><clause id="id9BF3C7FC6A2D45179A5F8976A1C3F75A"><enum>(iii)</enum><text>including
				biomass as a feedstock in the production process of the fuels.</text>
									</clause></subparagraph></paragraph><paragraph id="ID54b06b83866f4d0dba2d2a57e3da1d66"><enum>(4)</enum><header>Reports</header><text>The
				Administrator shall submit to the Committee on Energy and Natural Resources of
				the Senate and the Committee on Energy and Commerce of the House of
				Representatives—</text>
								<subparagraph id="ID53a2eb18dbc445449df65e23b8dc8718"><enum>(A)</enum><text>not later than
				180 days after the date of enactment of this section, an interim report on
				actions taken to carry out this subsection; and</text>
								</subparagraph><subparagraph id="ID431b05d3b307493295014923721b6dfa"><enum>(B)</enum><text>not later than 1
				year after the date of enactment of this section, a final report on actions
				taken to carry out this subsection.</text>
								</subparagraph></paragraph></subsection><subsection id="ID38cda517e34942af95f570156bcbde73"><enum>(h)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated such
				sums as are necessary to carry out this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDc51f81c7015c4b1fb385c190587d09e6"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Energy Policy Act of 1992
			 (42 U.S.C. prec. 13201) is amended by adding at the end of the items relating
			 to title XXXI the following:</text>

			 dioxide sequestration</header>
			<subsection id="H87D43C561BCA49839FB78DF4ADCA8302"><enum>(a)</enum><header>In
			 general</header><text>Subpart D of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 (relating to business credits) is amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H3D79B4EFE31B45EC812E3BFD4705B7BF" style="OLC">
					<section id="HF5E23CB2FF764CB7AC91433DC9C74041"><enum>45O.</enum><header>Credit for
				carbon dioxide sequestration</header>
						<subsection id="H25F3AFFFBF8E4B05A46195BC007C8B00"><enum>(a)</enum><header>General
				rule</header><text display-inline="yes-display-inline">For purposes of section
				38, the carbon dioxide sequestration credit for any taxable year is an amount
				equal to the sum of—</text>
							<paragraph id="H89C81ADC3C7143B38C9CA286619C76D9"><enum>(1)</enum><text>$20 per metric ton
				of qualified carbon dioxide which is—</text>
								<subparagraph id="idDB514CA58837484EA3E673BB953FC5A4"><enum>(A)</enum><text>captured by the
				taxpayer at a qualified facility, and</text>
								</subparagraph><subparagraph id="idABCC8B10A9FC40168284204941DBB6A8"><enum>(B)</enum><text>disposed of by
				the taxpayer in secure geological storage, and</text>
								</subparagraph></paragraph><paragraph id="id263AD663F2594D57A3300270AC74031A"><enum>(2)</enum><text>$10 per metric
				ton of qualified carbon dioxide which is—</text>
								<subparagraph id="idC8E8BD4C8A534351A8F63D3862D12400"><enum>(A)</enum><text>captured by the
				taxpayer at a qualified facility, and</text>
								</subparagraph><subparagraph id="H8016984DDEBC47EE8CE3F2BCB7551243"><enum>(B)</enum><text>used by the
				taxpayer as an injectant in a qualified enhanced oil or natural gas recovery
				project.</text>
								</subparagraph></paragraph></subsection><subsection id="H0061877E3CF54F818E427E3B64CB355E"><enum>(b)</enum><header>Qualified carbon
				dioxide</header><text>For purposes of this section—</text>
							<paragraph id="HE84CD6BFBFDD4D3C9FFDF9298334451D"><enum>(1)</enum><header>In
				general</header><text>The term <term>qualified carbon dioxide</term> means
				carbon dioxide captured from an industrial source which—</text>
								<subparagraph id="H7B84409BC36D43F5AFF785089BF1040"><enum>(A)</enum><text>would otherwise be
				released into the atmosphere as industrial emission of greenhouse gas,
				and</text>
								</subparagraph><subparagraph id="HC58A46A9B6F3445384D2EBDEAD37ABF4"><enum>(B)</enum><text>is measured at the
				source of capture and verified at the point of disposal or injection.</text>
								</subparagraph></paragraph><paragraph id="idCBDE052431154D4A930A4F9AEDFF1DA1"><enum>(2)</enum><header>Recycled carbon
				dioxide</header><text>The term <term>qualified carbon dioxide</term> includes
				the initial deposit of captured carbon dioxide used as a tertiary injectant.
				Such term does not include carbon dioxide that is re-captured, recycled, and
				re-injected as part of the enhanced oil and natural gas recovery
				process.</text>
							</paragraph></subsection><subsection id="id0553C3DF939A4CBA9F59AD8298BC9A32"><enum>(c)</enum><header>Qualified
				facility</header><text>For purposes of this section, the term <term>qualified
				facility</term> means any industrial facility—</text>
							<paragraph id="id2CE9573E671047DA8CF67B3F37263B96"><enum>(1)</enum><text>which is owned by
				the taxpayer,</text>
							</paragraph><paragraph id="id3810173AA4954895A4C47400D0BF4BDF"><enum>(2)</enum><text>at which carbon
				capture equipment is placed in service, and</text>
							</paragraph><paragraph id="id7E77E577A9234D1CAD4F8DD211D7CCE3"><enum>(3)</enum><text>which captures
				not less than 500,000 metric tons of carbon dioxide during the taxable
				year.</text>
							</paragraph></subsection><subsection id="H7DC1B431575D4F57B3856D56F5F86E03"><enum>(d)</enum><header>Special rules
				and other definitions</header><text>For purposes of this section—</text>
							<paragraph id="H2681E1EB7517454CBE74630050962129"><enum>(1)</enum><header>Only carbon
				dioxide captured within the United States taken into account</header><text>The
				credit under this section shall apply only with respect to qualified carbon
				dioxide the capture of which is within—</text>
								<subparagraph id="HB09BFD384843402C91A5ADA4DF4CFAF"><enum>(A)</enum><text>the United States
				(within the meaning of section 638(1)), or</text>
								</subparagraph><subparagraph id="H9DEEED622C4E4A34955D049B55AFCFFD"><enum>(B)</enum><text>a possession of
				the United States (within the meaning of section 638(2)).</text>
								</subparagraph></paragraph><paragraph id="id48FDEA44EBA54047A961272830007EE2"><enum>(2)</enum><header>Secure
				geological storage</header><text>The Secretary, in consultation with the
				Administrator of the Environmental Protection Agency, shall establish
				regulations for determining adequate security measures for the geological
				storage of carbon dioxide under subsection (a)(1)(B) such that the carbon
				dioxide does not escape into the atmosphere. Such term shall include storage at
				deep saline formations and unmineable coal seems under such conditions as the
				Secretary may determine under such regulations.</text>
							</paragraph><paragraph id="idA3F1534E845144B992680156FF28A07B"><enum>(3)</enum><header>Qualified
				enhanced oil or natural gas recovery project</header><text>The term
				<term>qualified enhanced oil or natural gas recovery project</term> has the
				meaning given the term <term>qualified enhanced oil recovery project</term> by
				section 43(c)(2), by substituting <quote>crude oil or natural gas</quote> for
				<quote>crude oil</quote> in subparagraph (A)(i) thereof.</text>
							</paragraph><paragraph id="HBE91DF5EFA4F4A33B29B6DA3515C2DB"><enum>(4)</enum><header>Credit
				attributable to taxpayer</header><text>Any credit under this section shall be
				attributable to the person that captures and physically or contractually
				ensures the disposal of or the use as a tertiary injectant of the qualified
				carbon dioxide, except to the extent provided in regulations prescribed by the
				Secretary.</text>
							</paragraph><paragraph id="idC7C30075053043DE8A7890BC8BD89A8E"><enum>(5)</enum><header>Recapture</header><text>The
				Secretary shall, by regulations, provide for recapturing the benefit of any
				credit allowable under subsection (a) with respect to any qualified carbon
				dioxide which ceases to be captured, disposed of, or used as a tertiary
				injectant in a manner consistent with the requirements of this section.</text>
							</paragraph><paragraph id="HD113CEA3ADE04B2287B2CCAED72CDD70"><enum>(6)</enum><header>Inflation
				adjustment</header><text display-inline="yes-display-inline">In the case of any
				taxable year beginning in a calendar year after 2008, there shall be
				substituted for each dollar amount contained in subsection (a) an amount equal
				to the product of—</text>
								<subparagraph id="H382DB68DAE824237B13F2290A42D4B79"><enum>(A)</enum><text display-inline="yes-display-inline">such dollar amount, multiplied by</text>
								</subparagraph><subparagraph id="H6842CA44F1E44F6E927BEE7E97905F5"><enum>(B)</enum><text>the inflation
				adjustment factor for such calendar year determined under section 43(b)(3)(B)
				for such calendar year, determined by substituting <quote>2007</quote> for
				<quote>1990</quote>.</text>
								</subparagraph></paragraph></subsection><subsection id="idCA4DEBC90DD243B6A3F0D35E5CB8BFA8"><enum>(e)</enum><header>Application of
				section</header><text>The credit under this section shall apply with respect to
				qualified carbon dioxide before the end of the calendar year in which the
				Secretary, in consultation with the Administrator of the Environmental
				Protection Agency, certifies that 75,000,000 metric tons of qualified carbon
				dioxide have been captured and disposed of or used as a tertiary
				injectant.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H90F013324FAD48A996EF9E00C41C00DB"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 38(b) of the Internal Revenue Code of 1986
			 (relating to general business credit) is amended by striking
			 <quote>plus</quote> at the end of paragraph (30), by striking the period at the
			 end of paragraph (31) and inserting <quote>, plus</quote>, and by adding at the
			 end of following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H5FC90DE844174AB48F7371193241F516" style="OLC">
					<paragraph id="H0A552DB24A7146259D7686CFB7AEC15"><enum>(32)</enum><text display-inline="yes-display-inline">the carbon dioxide sequestration credit

			</subsection><subsection id="HBEAD3BDDF74B42A1A55814C78B32539E"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart B of part IV of
			 subchapter A of chapter 1 of the Internal Revenue Code of 1986 (relating to
			 other credits) is amended by adding at the end the following new
			 section:</text>

			 date</header><text>The amendments made by this section shall apply carbon
			 dioxide captured after the date of the enactment of this Act.</text>
			</subsection></section><section id="idB8CFDF4FE9754B6BAB20182AD4605B9E" section-type="subsequent-section"><enum>4.</enum><header>Seven-year applicable
			 recovery period for depreciation of qualified carbon dioxide pipeline
			 property</header>
			<subsection id="id28590A66CEF14846A382F95DEB3E4CEF"><enum>(a)</enum><header>In
			 general</header><text>Section 168(e)(3)(C) of the Internal Revenue Code of 1986
			 (defining 7-year property) is amended by striking <quote>and</quote> at the end
			 of clause iv), by striking the period at the end of clause (vi)(III) and
			 inserting <quote>, and</quote>, and by inserting after clause (vi) the
			 following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="idB722AE7B7D894CBD870B0B8410CEC3D0" style="OLC">
					<clause id="id8C20A98471D9462D92E46AC2625F4E65"><enum>(vii)</enum><text>any qualified
				carbon dioxide pipeline property—</text>
						<subclause id="id83553EDE2FBE45FEBA987D508ACE14C6"><enum>(I)</enum><text>the original use
				of which commences with the taxpayer after the date of the enactment of this
				clause,</text>
						</subclause><subclause id="id2D1E120BB41C41B49A8BC6A79E11BAF0"><enum>(II)</enum><text>the original
				purpose of which is to transport carbon dioxide, and</text>
						</subclause><subclause id="id1E2FF53070214471951E6E8535A160FA"><enum>(III)</enum><text>which is placed
				in service before January 1,
				2014.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id58EC40EBD1114D449BC98C9BD9F2D916"><enum>(b)</enum><header>Definition of
			 qualified carbon dioxide pipeline property</header><text>Section 168(e) of the
			 Internal Revenue Code of 1986 (relating to classification of property) is
			 amended by inserting at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="id8AC5FBEF62F642859EF4970117703BC6" style="OLC">
					<paragraph id="id2DB28B14027E48D78E7E10D1748A9860"><enum>(8)</enum><header>Qualified
				carbon dioxide pipeline property</header><text>The term <term>qualified carbon
				dioxide pipeline property</term> means property which is used in the United
				States solely to transmit qualified carbon dioxide (as defined in section
				45O(b)) from the point of capture to the point of disposal (as described in
				section 45O(a)(1)(B)) or the point at which such qualified carbon dioxide is
				used as a tertiary injectant (as described in section
				45O(a)(2)(B)).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id5BE9EC4771D349BAA362F98BF6282336"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to property
			 placed in service after the date of the enactment of this Act.</text>
			</subsection></section><section id="id3F5D4D4A3F164411BB68199BFBE47144"><enum>5.</enum><header>Certain income
			 and gains relating to industrial source carbon dioxide treated as qualifying
			 income for publicly traded partnerships</header>
			<subsection id="id6DE7E58A2D18442EA104620A2AF90CBA"><enum>(a)</enum><header>In
			 general</header><text>Subparagraph (E) of section 7704(d)(1) of the Internal
			 Revenue Code of 1986 (defining qualifying income) is amended by inserting
			 <quote>or industrial source carbon dioxide</quote> after
			 <quote>timber)</quote>.</text>
			</subsection><subsection id="id466C0FC8B41D467882C1BBC3D7A06A76"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall take effect on the
			 date of the enactment of this Act, in taxable years ending after such
			 date.</text>
			</subsection></section><section id="id684D8F188BDB44E7A4497DA8E9339F0B"><enum>6.</enum><header>Extension and
			 modification of alternative fuel credit</header>
			<subsection id="id86303A6D85694AAE9BC275FCE9DC7663"><enum>(a)</enum><header>Extension</header>
				<paragraph id="id8A71FA406C114D139714A33CB1F63EFF"><enum>(1)</enum><header>Alternative
			 fuel credit</header><text>Paragraph (4) of section 6426(d) of the Internal
			 Revenue Code of 1986 (relating to alternative fuel credit) is amended by
			 striking <quote>September 30, 2009</quote> and inserting <quote>September 30,
			 2019</quote>.</text>
				</paragraph><paragraph id="id3CA99BBBECE048CCAA1886E43DD19D71"><enum>(2)</enum><header>Alternative
			 fuel mixture credit</header><text>Paragraph (3) of section 6426(e) of such Code
			 (relating to alternative fuel mixture credit) is amended by striking
			 <quote>September 30, 2009</quote> and inserting <quote>September 30,
			 2019</quote>.</text>
				</paragraph><paragraph id="idE3F6B374A6E24BB79D7E2623B2252FB7"><enum>(3)</enum><header>Payments</header><text>Subparagraph
			 (C) of section 6427(e)(5) of such Code (relating to termination) is amended by
			 striking <quote>September 30, 2009</quote> and inserting <quote>September 30,
			 2019</quote>.</text>

			 fuel to include compressed or liquified biomass gas</header><text>Paragraph (2)
			 of section 6426(d) of the Internal Revenue Code of 1986 (relating to
			 alternative fuel credit) is amended by striking <quote>and</quote> at the end
			 of subparagraph (E), by redesignating subparagraph (F) as subparagraph (G), and
			 by inserting after subparagraph (E) the following new subparagraph:</text>

				</paragraph></subsection><subsection id="id00FBE43B9806491299B03A30955B05AE"><enum>(c)</enum><header>Carbon capture
			 requirement for certain fuels</header>
				<paragraph id="idB8BC1138780147E19CD00BEEA90E2AA5"><enum>(1)</enum><header>In
			 general</header><text>Subsection (d) of section 6426 of the Internal Revenue
			 Code of 1986, as amended by subsection (a), is amended by redesignating
			 paragraph (4) as paragraph (5) and by inserting after paragraph (3) the
			 following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="id952F7E5EAF33498AA5A6549A5432EF4C" style="OLC">
						<paragraph id="idDCA83DD036434F1999A85FC0B34FFECD"><enum>(4)</enum><header>Carbon capture
				requirement</header>
							<subparagraph id="idEAEC39476CC44E14B739AC429B423517"><enum>(A)</enum><header>In
				general</header><text>The requirements of this paragraph are met if the fuel is
				certified, under such procedures as required by the Secretary, as having been
				produced at a facility which separates and sequesters not less than the
				applicable percentage of such facility's total carbon dioxide emissions.</text>
							</subparagraph><subparagraph id="id87B45DBE756F4FDF95FC68DE8A1FF8E5"><enum>(B)</enum><header>Applicable
				percentage</header><text>For purposes of subparagraph (A), the applicable
				percentage is—</text>
								<clause id="id89DD22D7E2284C21804F4FB2F8990DB8"><enum>(i)</enum><text>in the case of
				fuel produced after the date of enactment of this paragraph and before January
				1, 2014, 70 percent, and</text>
								</clause><clause id="id3C367005A87D475F8A5953EFAEFC19C0"><enum>(ii)</enum><text>in the case of
				fuel produced after December 31, 2013, 80
				percent.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id550659311C4E47DF8A9E504386E40233"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Subparagraph (E) of section 6426(d)(2) of such Code is
			 amended by inserting <quote>which meets the requirements of paragraph (4) and
			 which is</quote> after <quote>any liquid fuel</quote>.</text>
				</paragraph></subsection><subsection id="idC367692EEDC84E5587388CEAD1552F7B"><enum>(d)</enum><header>Effective
			 dates</header>
				<paragraph id="id94F75188FDA0432884D569CC8419ADF1"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by this section shall apply to fuel sold or used after the date of the
			 enactment of this Act.</text>
				</paragraph><paragraph id="id12FE5711D5CB441B8E79429000A58367"><enum>(2)</enum><header>Carbon capture
			 requirements</header><text>The amendments made by subsection (c) shall apply to
			 fuel sold or used after December 31, 2007.</text>
