		<official-title>To authorize the Administrator of the Environmental
		  Protection Agency to accept, as part of a settlement, diesel emission reduction
		  Supplemental Environmental Projects, and for other purposes. </official-title>

		<section id="idCCBD8E5DCA214C7497E4C641184FFA08" section-type="section-one"><enum>1.</enum><header>EPA authority to accept
			 diesel emissions reduction Supplemental Environmental Projects</header><text display-inline="no-display-inline">The Administrator of the Environmental
			 Protection Agency (hereinafter, the <quote>Agency</quote>) may accept
			 (notwithstanding sections 3302 and 1301 of title 31, United States Code) diesel
			 emissions reduction Supplemental Environmental Projects if the projects, as
			 part of a settlement of any alleged violations of environmental law—</text>
			<paragraph id="IDcf7ad790acfc4a0bb968cbb1aab3059f"><enum>(1)</enum><text>protect human
			 health or the environment;</text>
			</paragraph><paragraph id="IDb458f75ffeba472d9f3209feb8344ec6"><enum>(2)</enum><text>are related to
			 the underlying alleged violations;</text>
			</paragraph><paragraph id="IDdefcf0c751634559abfe139a5ffbd5c3"><enum>(3)</enum><text>do not constitute
			 activities that the defendant would otherwise be legally required to perform;
			 and</text>
			</paragraph><paragraph id="ID32574309cb194188bd01b7de80ddd419"><enum>(4)</enum><text>do not provide
			 funds for the staff of the Agency or for contractors to carry out the Agency's
			 internal operations.</text>
