		  Environmental Protection Agency to accept, as part of a settlement, diesel
		  emission reduction Supplemental Environmental Projects, and for other purposes.

		<section commented="no" display-inline="no-display-inline" id="idCCBD8E5DCA214C7497E4C641184FFA08" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">EPA authority to accept diesel emissions
			 reduction Supplemental Environmental Projects</header><text display-inline="no-display-inline">The Administrator of the Environmental
			 Protection Agency (hereinafter, the <quote>Agency</quote>) may accept
			 (notwithstanding sections <external-xref legal-doc="usc" parsable-cite="usc/31/3302">3302</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/1301">1301</external-xref> of title 31, United States Code) diesel
			 emissions reduction Supplemental Environmental Projects if the projects, as
			 part of a settlement of any alleged violations of environmental law—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDcf7ad790acfc4a0bb968cbb1aab3059f"><enum>(1)</enum><text display-inline="yes-display-inline">protect human health or the
			 environment;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb458f75ffeba472d9f3209feb8344ec6"><enum>(2)</enum><text display-inline="yes-display-inline">are related to the underlying alleged
			 violations;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdefcf0c751634559abfe139a5ffbd5c3"><enum>(3)</enum><text display-inline="yes-display-inline">do not constitute activities that the
			 defendant would otherwise be legally required to perform; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID32574309cb194188bd01b7de80ddd419"><enum>(4)</enum><text display-inline="yes-display-inline">do not provide funds for the staff of the
			 Agency or for contractors to carry out the Agency's internal operations.</text>
