<official-title display="yes">To authorize the Administrator of the Environmental Protection Agency to accept, as part of a settlement, diesel emission reduction Supplemental Environmental Projects, and for other purposes.</official-title>

<section commented="no" display-inline="no-display-inline" id="H7165A1F274DA424A8E00811283E2BFC3" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">EPA authority to accept diesel emissions reduction Supplemental Environmental Projects</header><text display-inline="no-display-inline">The Administrator of the Environmental Protection Agency (hereinafter, the <quote>Agency</quote>) may accept (notwithstanding sections <external-xref legal-doc="usc" parsable-cite="usc/31/3302">3302</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/1301">1301</external-xref> of title 31, United States Code) diesel emissions reduction Supplemental Environmental Projects if the projects, as part of a settlement of any alleged violations of environmental law—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H7F830B3D068647D2BE577D3000D1A101"><enum>(1)</enum><text display-inline="yes-display-inline">protect human health or the environment;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5EF0C74DED4F4EE6BE8FDCFBA8793211"><enum>(2)</enum><text display-inline="yes-display-inline">are related to the underlying alleged violations;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA9770744702B45879300695DD751F528"><enum>(3)</enum><text display-inline="yes-display-inline">do not constitute activities that the defendant would otherwise be legally required to perform; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H79725F7F2F9F45D6B9B8FDDA35462F16"><enum>(4)</enum><text display-inline="yes-display-inline">do not provide funds for the staff of the Agency or for contractors to carry out the Agency's internal operations.</text> </paragraph></section>
<section id="H4C7993219296478B93FD89EA60A67F9B"><enum>2.</enum><header>Settlement agreement provisions</header><text display-inline="no-display-inline">In any settlement agreement regarding alleged violations of environmental law in which a defendant agrees to perform a diesel emissions reduction Supplemental Environmental Project, the Administrator of the Environmental Protection Agency shall require the defendant to include in the settlement documents a certification under penalty of law that the defendant would have agreed to perform a comparably valued, alternative project other than a diesel emissions reduction Supplemental Environmental Project if the Administrator were precluded by law from accepting a diesel emission reduction Supplemental Environmental Project. A failure by the Administrator to include this language in such a settlement agreement shall not create a cause of action against the United States under the Clean Air Act or any other law or create a basis for overturning a settlement agreement entered into by the United States.</text> </section>
<section id="HCB923B33E3814BE08530BAF8E839728C"><enum>3.</enum><header>Inclusion of the District of Columbia in certain State and local grant programs for diesel emission reductions</header> 
<subsection id="H5F4AE3C029A84993951E7D3473EC2367"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 791 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16131">42 U.S.C. 16131</external-xref>) is amended by adding at the end thereof the following:</text>

<paragraph id="H7F54E7847D284D0EA8D4C6A8E22CC69F"><enum>(9)</enum><header>Definition of State</header><text display-inline="yes-display-inline">The term <quote>State</quote> includes the District of Columbia.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection display-inline="no-display-inline" id="H489C2E072AD447E9B3EA611FFDF5CA01"><enum>(b)</enum><header>Conforming Amendments</header>
<paragraph commented="no" display-inline="yes-display-inline" id="HA367A9E0F5CC42D78344CE0278A447A6"><enum>(1)</enum><text>Section 793(d)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16133">42 U.S.C. 16133(d)(2)</external-xref>) is amended by striking <quote>Governor</quote> and inserting <quote>chief executive</quote>.</text> </paragraph>
<paragraph id="HB22DE2B6DDBC4E3DB9302C3924DC6C00" indent="up1"><enum>(2)</enum><text>Subparagraphs (A) and (B) of section 793(c)(2) of such Act are each amended by striking <quote>50</quote> and inserting <quote>51</quote> and by striking <quote>2 percent</quote> and inserting <quote>1.96 percent</quote> in each place such terms appear.</text> </paragraph></subsection></section>
