		<official-title display="yes">To prohibit the recruitment or use of child
		  soldiers, to designate persons who recruit or use child soldiers as
		  inadmissible aliens, to allow the deportation of persons who recruit or use
		  child soldiers, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id9234CDC69695499C9E94014E76A23FF5" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Child Soldiers Accountability Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id68FADA16D3154742B4E1E639036889AB" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Accountability for the recruitment and use
			 of child soldiers</header>
			<subsection commented="no" display-inline="no-display-inline" id="idBFF41F19C1A6436DB5924920B6B021BC"><enum>(a)</enum><header display-inline="yes-display-inline">Crime for recruiting or using child
			 soldiers</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID48e22a397a354e128d5eae9b2f6489fc"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/118">Chapter 118</external-xref> of title 18, United States
			 Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBCD562CAD40F438FAA65EC88EA8BC12F" style="USC">
						<section commented="no" display-inline="no-display-inline" id="ID76f1ed7e214943bfa6c9f4fae91b9988" section-type="subsequent-section"><enum>2442.</enum><header display-inline="yes-display-inline">Recruitment or use of child
				soldiers</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID83f4d7cdb3734d74b981e6bdd6228dd4"><enum>(a)</enum><header display-inline="yes-display-inline">Offense</header><text display-inline="yes-display-inline">Any person who knowingly recruits, enlists,
				or conscripts a person under 15 years of age into an armed force or group or
				knowingly uses a person under 15 years of age to participate actively in
				hostilities—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id454172DCFABC4A02AB1844B639037E10"><enum>(1)</enum><text display-inline="yes-display-inline">shall be fined under this title, imprisoned
				not more than 20 years, or both; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C0AF70551A646FCBCCABCB5295F45FE"><enum>(2)</enum><text display-inline="yes-display-inline">if the death of any person results, shall
				be fined under this title and imprisoned for any term of years or for
				life.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFB6F2A931FF9407B8F71EA94741BD85A"><enum>(b)</enum><header display-inline="yes-display-inline">Attempt and conspiracy</header><text display-inline="yes-display-inline">Any person who attempts or conspires to
				commit an offense under this section shall be punished in the same manner as a
				person who completes the offense.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4135fbd463d24c69ad2f80b917198dcc"><enum>(c)</enum><header display-inline="yes-display-inline">Jurisdiction</header><text display-inline="yes-display-inline">There is jurisdiction over an offense
				described in subsection (a), and any attempt or conspiracy to commit such
				offense, if—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID013cea3079fd494e94438ac345429423"><enum>(1)</enum><text display-inline="yes-display-inline">the alleged offender is a national of the
				United States (as defined in section 101(a)(22) of the Immigration and
				Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>)) or an alien lawfully admitted for
				permanent residence in the United States (as defined in section 101(a)(20) of
				such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(20)</external-xref>);</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0149bdeeaf4940b5a0e8ea90194ae5b1"><enum>(2)</enum><text display-inline="yes-display-inline">the alleged offender is a stateless person
				whose habitual residence is in the United States;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDda7a64636cdc4dc490b2f72d03b87fb6"><enum>(3)</enum><text display-inline="yes-display-inline">the alleged offender is present in the
				United States, irrespective of the nationality of the alleged offender;
				or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53030ad85e794155a5f85176ed6897d1"><enum>(4)</enum><text display-inline="yes-display-inline">the offense occurs in whole or in part
				within the United States.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC9C4F9D9E4F34AECB86CEBF981D43A7A"><enum>(d)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idA5328087109A4EB19DFF52C93E75689E"><enum>(1)</enum><header display-inline="yes-display-inline">Participate actively in
				hostilities</header><text display-inline="yes-display-inline">The term
				<term>participate actively in hostilities</term> means taking part in—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id071C7614A5654FDBAE46A2F3F7CBCEC5"><enum>(A)</enum><text display-inline="yes-display-inline">combat or military activities related to
				combat, including scouting, spying, sabotage, and serving as a decoy, a
				courier, or at a military checkpoint; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id504ABF697D584885B1DE18086589F154"><enum>(B)</enum><text display-inline="yes-display-inline">direct support functions related to combat,
				including taking supplies to the front line and other services at the front
				line.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC72D94CB5D714CAF9AFA9D67D3EAB5D1"><enum>(2)</enum><header display-inline="yes-display-inline">Armed force or group</header><text display-inline="yes-display-inline">The term <term>armed force or group</term>
				means any army, militia, or other military organization, whether or not it is
				state-sponsored, excluding any group assembled solely for nonviolent political
				association.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8463d7748fc048db9dadf0d29f3bb7fe"><enum>(2)</enum><header display-inline="yes-display-inline">Statute of limitations</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/213">Chapter 213</external-xref> of title 18, United States Code
			 is amended by adding at the end the following:</text>

						<section commented="no" display-inline="no-display-inline" id="idE0952248824D4F2595FF3ECE0D9EC878" section-type="subsequent-section"><enum>3300.</enum><header display-inline="yes-display-inline">Recruitment or use of child
				soldiers</header><text display-inline="no-display-inline">No person may be
				prosecuted, tried, or punished for a violation of section 2442 unless the
				indictment or the information is filed not later than 10 years after the
				commission of the
				offense.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCBAA1B471C64ECE8FF37E1F7A76179A"><enum>(3)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">Title 18, United States Code, is
			 amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idD418E63DA76049C7ACA9B1F619230FFE"><enum>(A)</enum><text display-inline="yes-display-inline">in the table of sections for chapter 118,
			 by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id39939605-1b0a-4a10-9a6a-4d3c275aef8c" style="USC">

			 by adding at the end the following:</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2E1A3C70067A42359F0E4B55C91B84A4"><enum>(b)</enum><header display-inline="yes-display-inline">Ground of inadmissibility for recruiting or
			 using child soldiers</header><text display-inline="yes-display-inline">Section
			 212(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id58078648AC0F4E01857630636786DF76" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="ID07ab4c67dba24f00a77885fc94691a85"><enum>(G)</enum><header display-inline="yes-display-inline">Recruitment or use of child
				soldiers</header><text display-inline="yes-display-inline">Any alien who has
				committed, ordered, incited, assisted, or otherwise participated in the
				commission of the recruitment or use of child soldiers in violation of section
				2442 of title 18, United States Code, is
				inadmissible.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID26a22b5652b343ac96c75307cc93c379"><enum>(c)</enum><header display-inline="yes-display-inline">Ground of removability for recruiting or
			 using child soldiers</header><text display-inline="yes-display-inline">Section
			 237(a)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idAC71193C005440328F8613D9926A54A7" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="ID005bf774aa2f43ecb5b45631c074e8a4"><enum>(F)</enum><header display-inline="yes-display-inline">Recruitment or use of child
				soldiers</header><text display-inline="yes-display-inline">Any alien described
				in section 212(a)(3)(G) is
				deportable.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8A7F5884B84342F894563A1F4DBF39DE"><enum>(d)</enum><header display-inline="yes-display-inline">Withholding of removal</header><text display-inline="yes-display-inline">Section 241(b)(3)(B) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)(B)</external-xref>) is amended by adding at the end the
			 following: <quote>For purposes of clause (iii), an alien who is removable under
			 section 237(a)(4)(F) or inadmissible under section 212(a)(3)(G) shall be
			 considered an alien with respect to whom there are serious reasons to believe
			 that the alien committed a serious nonpolitical crime.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD2F85B0CF6214C5DA7F9C0117A01048C"><enum>(e)</enum><header display-inline="yes-display-inline">Asylum</header><text display-inline="yes-display-inline">Section 208(b)(2)(B) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(B)</external-xref> is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idD5F45CD01E9B42458CC6E5D6BBA81F7D" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="IDb52460810bcd44eca56264bda1d3fe42"><enum>(iii)</enum><header display-inline="yes-display-inline">Recruitment and use of child
				soldiers</header><text display-inline="yes-display-inline">For purposes of
				clause (iii) of subparagraph (A), an alien who is removable under section
				237(a)(4)(F) or inadmissible under section 212(a)(3)(G) shall be considered an
				alien with respect to whom there are serious reasons to believe that the alien
				committed a serious nonpolitical
				crime.</text>
