<section commented="no" display-inline="no-display-inline" id="HF3A98D4880814EC1A4C316BC4530BE3E" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Soldiers Accountability Act of 2008</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HF910002D29FF47F4BF725285D9D04295" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Accountability for the recruitment and use of child soldiers</header> 
<subsection id="H908441650BE7448FBC388392E21985BE"><enum>(a)</enum><header>Crime for recruiting or using child soldiers</header> 
<paragraph id="H1DDB1EA15DFD431AB2666BA888FA5C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/118">Chapter 118</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" id="HC1DE807083F14FCAA5436603DF7D25B3" section-type="subsequent-section"><enum>2442.</enum><header display-inline="yes-display-inline">Recruitment or use of child soldiers</header> 
<subsection id="HFEFCB8D85A454B9F0053C47BEBF62EA3"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever knowingly—</text> 
<paragraph id="HD6AE082C04C646C500F3EAD9548D4E2"><enum>(1)</enum><text>recruits, enlists, or conscripts a person to serve while such person is under 15 years of age in an armed force or group; or </text></paragraph> 
<paragraph id="HC3D8D2C1498540749EE15CB90014D9A4"><enum>(2)</enum><text>uses a person under 15 years of age to participate actively in hostilities; </text></paragraph><continuation-text continuation-text-level="subsection">knowing such person is under 15 years of age, shall be punished as provided in subsection (b).</continuation-text></subsection> 
<subsection id="H2A2B51BC1B7349D19E0615D422770023"><enum>(b)</enum><header>Penalty</header><text>Whoever violates, or attempts or conspires to violate, subsection (a) shall be fined under this title or imprisoned not more than 20 years, or both and, if death of any person results, shall be fined under this title and imprisoned for any term of years or for life.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HDB340C13F1DF4179AC134D8EE402D07"><enum>(c)</enum><header display-inline="yes-display-inline">Jurisdiction</header><text display-inline="yes-display-inline">There is jurisdiction over an offense described in subsection (a), and any attempt or conspiracy to commit such offense, if—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H5F448DACA9334B698596FE00CA71767B"><enum>(1)</enum><text display-inline="yes-display-inline">the alleged offender is a national of the United States (as defined in section 101(a)(22) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(22)</external-xref>)) or an alien lawfully admitted for permanent residence in the United States (as defined in section 101(a)(20) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(20)</external-xref>);</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H58C0972CB145437AA301589213CB968B"><enum>(2)</enum><text display-inline="yes-display-inline">the alleged offender is a stateless person whose habitual residence is in the United States;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H566456B3A2BB43A5922C8B60805FE8D3"><enum>(3)</enum><text display-inline="yes-display-inline">the alleged offender is present in the United States, irrespective of the nationality of the alleged offender; or</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H42B9B0F5D86C43B3BE79EB30D9FAA299"><enum>(4)</enum><text display-inline="yes-display-inline">the offense occurs in whole or in part within the United States.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HEA2C4F7C9FC8442281D45E76A14C005E"><enum>(d)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H5523E679D7A64DE800C1EF0088F010F8"><enum>(1)</enum><header display-inline="yes-display-inline">Participate actively in hostilities</header><text display-inline="yes-display-inline">The term <term>participate actively in hostilities</term> means taking part in—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H97A3564D74BC41B7B1CE3900C5793505"><enum>(A)</enum><text display-inline="yes-display-inline">combat or military activities related to combat, including sabotage and serving as a decoy, a courier, or at a military checkpoint; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H45D0B22EB22043DEA6D8DF9114B7DD36"><enum>(B)</enum><text display-inline="yes-display-inline">direct support functions related to combat, including transporting supplies or providing other services.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF1418517269843CD8914F823E9A566A4"><enum>(2)</enum><header display-inline="yes-display-inline">Armed force or group</header><text display-inline="yes-display-inline">The term <term>armed force or group</term> means any army, militia, or other military organization, whether or not it is state-sponsored, excluding any group assembled solely for nonviolent political association.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H793500D5278C4E5C95D8B2AFAEF4539" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Statute of limitations</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/213">Chapter 213</external-xref> of title 18, United States Code is amended by adding at the end the following:</text>

<section commented="no" display-inline="no-display-inline" id="H09BDF42CADAC4CEEBDCB35FCF5A5B1F2" section-type="subsequent-section"><enum>3300.</enum><header display-inline="yes-display-inline">Recruitment or use of child soldiers</header><text display-inline="no-display-inline">No person may be prosecuted, tried, or punished for a violation of section 2442 unless the indictment or the information is filed not later than 10 years after the commission of the offense.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H59D6D30E050A49CDB28515D9AB7D1D27" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">Title 18, United States Code, is amended—</text> 
<subparagraph id="H1D77414FF2034999A8D6CB91F282801B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in the table of sections for chapter 118, by adding at the end the following:</text>

<subsection id="H5A9F5CF8B5AD4FDF98FF7772D5CD699E"><enum>(b)</enum><header>Ground of inadmissibility for recruiting or using child soldiers</header><text>Section 212(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H23906F9E4E224206AD843216963E6F11"><enum>(G)</enum><header>Recruitment or use of child soldiers</header><text>Any alien who has engaged in the recruitment or use of child soldiers in violation of <external-xref legal-doc="usc" parsable-cite="usc/18/2442">section 2442</external-xref> of title 18, United States Code, is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1705F3BC7977491F85041E2E497500DB"><enum>(c)</enum><header>Ground of removability for recruiting or using child soldiers</header><text>Section 237(a)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H568E8FB9657D4C0196F000EEB4CD8BC4"><enum>(F)</enum><header>Recruitment or use of child soldiers</header><text>Any alien who has engaged in the recruitment or use of child soldiers in violation of <external-xref legal-doc="usc" parsable-cite="usc/18/2442">section 2442</external-xref> of title 18, United States Code, is deportable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H54FAD13D5CAD4802AFB190BAE5B2AFCD"><enum>(d)</enum><header>Asylum and withholding of removal</header> 
<paragraph id="H44D0DCEAAE414161BE71BE6003D84EA5"><enum>(1)</enum><header>Issuance of regulations</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Attorney General and the Secretary of Homeland Security shall promulgate final regulations establishing that, for purposes of sections 241(b)(3)(B)(iii) and 208(b)(2)(A)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)(B)(iii)</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)(iii)</external-xref>), an alien who is deportable under section 237(a)(4)(F) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)(F)</external-xref>) or inadmissible under section 212(a)(3)(G) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(G)</external-xref>) shall be considered an alien with respect to whom there are serious reasons to believe that the alien committed a serious nonpolitical crime.</text></paragraph> 
<paragraph id="H0D8D41CA0F46437585A3001677278CA3"><enum>(2)</enum><header>Authority to waive certain regulatory requirements</header><text display-inline="yes-display-inline">The requirements of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code (commonly referred to as the <quote>Administrative Procedure Act</quote>), <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>), or any other law relating to rulemaking, information collection, or publication in the Federal Register, shall not apply to any action to implement paragraph (1) to the extent the Attorney General or the Secretary Homeland of Security determines that compliance with any such requirement would impede the expeditious implementation of such paragraph.</text></paragraph></subsection></section>
