		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Montana Cemetery Act of
			 2007</short-title></quote>.</text>
		</section><section id="ID62D4136D8D35479FA711F9A43D6CC3CB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID23067BECFE604EDFA0D54196502DAFC2"><enum>(1)</enum><header>County</header><text>The
			 term <term>County</term> means Jefferson County, Montana.</text>
			</paragraph><paragraph id="IDAFF8767471264DAB81DBCF932D91B11B"><enum>(2)</enum><header>Map</header><text>The
			 term <term>map</term> means the map that is—</text>
				<subparagraph id="IDECE34725DC1D4DEFBAAFB301E3F0BEC8"><enum>(A)</enum><text>entitled
			 <quote>Elkhorn Cemetery</quote>;</text>
				</subparagraph><subparagraph id="ID5257962EA68441A6B8B72E493C0007BC"><enum>(B)</enum><text>dated May 9,
			 2005; and</text>
				</subparagraph><subparagraph id="IDF544EA04533045C8B1C81B2393BDDAA7"><enum>(C)</enum><text>on file in the
			 office of the Beaverhead-Deerlodge National Forest Supervisor.</text>
				</subparagraph></paragraph><paragraph id="ID32FFFEF7355C446E84374AD1F16E1609"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph></section><section id="ID416DB1A36FEA4A0790400EB3B7E654BF"><enum>3.</enum><header>Conveyance to
			 jefferson County, Montana</header>
			<subsection id="IDFB09A36C6ABD40778FE24602012810D8"><enum>(a)</enum><header>Conveyance</header><text>Not
			 later than 180 days after the date of enactment of this Act and subject to
			 valid existing rights, the Secretary (acting through the Regional Forester,
			 Northern Region, Missoula, Montana) shall convey by quitclaim deed to the
			 County for no consideration, all right, title, and interest of the United
			 States, except as provided in subsection (e), in and to the parcel of land
			 described in subsection (b).</text>
			</subsection><subsection id="IDCE6AC5B475E44DC0AA3D980BE655EF00"><enum>(b)</enum><header>Description of
			 Land</header><text>The parcel of land referred to in subsection (a) is the
			 parcel of approximately 9.67 acres of National Forest System land (including
			 any improvements to the land) in the County that is known as the <quote>Elkhorn
			 Cemetery</quote>, as generally depicted on the map.</text>
			</subsection><subsection id="ID72EF2704AE8547B28406BAC834460AF1"><enum>(c)</enum><header>Use of
			 Land</header><text>As a condition of the conveyance under subsection (a), the
			 County shall—</text>
				<paragraph id="ID6D248F328D3C4BD59E0D87B0034A898E"><enum>(1)</enum><text>use the land
			 described in subsection (b) as a County cemetery; and</text>
				</paragraph><paragraph id="IDDE2666819376457DBFE0AF6A1A3517E7"><enum>(2)</enum><text>agree to manage
			 the cemetery with due consideration and protection for the historic and
			 cultural values of the cemetery, under such terms and conditions as are agreed
			 to by the Secretary and the County.</text>
				</paragraph></subsection><subsection id="IDEC8D118367C54BA2A2307E9F5C857937"><enum>(d)</enum><header>Easement</header><text>In
			 conveying the land to the County under subsection (a), the Secretary, in
			 accordance with applicable law, shall grant to the County an easement across
			 certain National Forest System land, as generally depicted on the map, to
			 provide access to the land conveyed under that subsection.</text>
			</subsection><subsection id="IDF1D20045B90146AE8BAC505D6E392F14"><enum>(e)</enum><header>Reversion</header><text>In
			 the quitclaim deed to the County, the Secretary shall provide that the land
			 conveyed to the County under subsection (a) shall revert to the Secretary, at
			 the election of the Secretary, if the land is—</text>
				<paragraph id="IDD23DAF3449A74509BDCDEBE8059B7A7A"><enum>(1)</enum><text>used for a
			 purpose other than the purposes described in subsection (c)(1); or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID80D29223891645B39C2413FF8B4C762B"><enum>(2)</enum><text>managed by the
			 County in a manner that is inconsistent with subsection (c)(2).</text>
				</paragraph></subsection></section></legis-body>
