			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Native American Omnibus Technical
			 Corrections Act of 2007</short-title></quote>.</text>
		</section><section id="id85505060D6674D45AA2E907DD2318630"><enum>2.</enum><header>Definition of
			 Native American</header><text display-inline="no-display-inline">Section 2(9)
			 of the Native American Graves Protection and Repatriation Act (25 U.S.C.
			 3001(9)) is amended—</text>
			<paragraph id="id2820A61CF0F048158661A8C14A90D6C9"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>or was</quote> after
			 <quote>is</quote>; and</text>
			</paragraph><paragraph id="id08D82C701881410397A818317B7CBF3E"><enum>(2)</enum><text>by inserting
			 after <quote>indigenous to</quote> the following: <quote>any geographic area
			 that is now located within the boundaries of</quote>.</text>

			 justice</header>
			<subsection id="id2ED5CB2076A5441082902EECBAD8B791"><enum>(a)</enum><header>Indian tribal
			 justice technical and legal assistance</header><text display-inline="yes-display-inline">The Indian Tribal Justice Technical and
			 Legal Assistance Act of 2000 is amended—</text>
				<paragraph id="id96837E102623416D9649D6FB0EB7A531"><enum>(1)</enum><text>in section 106
			 (25 U.S.C. 3666), by striking <quote>for fiscal years 2000 through 2004</quote>
			 and inserting <quote>for fiscal years 2008 through 2012</quote>; and</text>
				</paragraph><paragraph id="id0A26C0726EEB495694EC3D567BCDE15E"><enum>(2)</enum><text>in section 201(d)
			 (25 U.S.C. 3681(d)), by striking <quote>for fiscal years 2000 through
			 2004</quote> and inserting <quote>for fiscal years 2008 through
			 2012</quote>.</text>

			 methamphetamine grants</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID57E8D904F1704F82B0DEB14AB8209337"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2996(a) of the
			 <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of
			 1968</act-name> (42 U.S.C. 3797cc(a)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID66B7E919151F43BABDC7548F4AED41E0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID38A9185193304CF3A3F00FB109C90DF4"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 by inserting <quote>, territories, and Indian tribes (as defined in section
			 2704)</quote> after <quote>to assist States</quote>; and</text>

			 children</header><text display-inline="yes-display-inline">Section 755(a) of
			 the USA PATRIOT Improvement and Reauthorization Act of 2005 (42 U.S.C.
			 3797cc–2(a)) is amended by inserting <quote>, territories, and Indian tribes
			 (as defined in section 2704 of the <act-name parsable-cite="OCCSS">Omnibus
			 Crime Control and Safe Streets Act of 1968</act-name> (42 U.S.C.
			 3797d))</quote> after <quote>make grants to States</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDDE3B8869C42E4398B3F6CF6F56FD3B0E"><enum>(c)</enum><header display-inline="yes-display-inline">Grant programs To address methamphetamine
			 use by pregnant and parenting women offenders</header><text display-inline="yes-display-inline">Section 756 of the USA PATRIOT Improvement
			 and Reauthorization Act of 2005 (42 U.S.C. 3797cc–3) is amended—</text>

				improvement) if the parcel was owned, in whole or in part, by the decedent
				immediately prior to the death of the
				decedent.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID41A7C26A37F04E2C8925DC9A59AA2B24"><enum>(b)</enum><header>Descent and
			 distribution</header><text display-inline="yes-display-inline">Section 207 of
			 the Indian Land Consolidation Act (25 U.S.C. 2206) is amended—</text>
				<paragraph id="IDAA2CBB1EF500408D8107C7A8FEDA1A07"><enum>(1)</enum><text>in subsection
			 (a)(2)(D)—</text>
					<subparagraph id="ID365CAEFDFA23483CBA936A101E6E14A2"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>clauses (ii) through (iv)</quote> and inserting <quote>clauses
			 (ii) through (v)</quote>; and</text>

				under the jurisdiction of the Indian tribe, the interest may be devised in fee
				in accordance with subparagraph (A)(ii).</text>

				(I) shall apply with respect to a devise of a trust or restricted interest in
				land by any decedent who dies on or after the date on which the applicable
				Indian tribe adopts the resolution, law, or other enactment described in
				subclause (I), regardless of the date on which the devise is
				made.</text>
								</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDD5689F6E3F8E4C36B887C1371B46C813"><enum>(3)</enum><text>in subsection
			 (c)(2), by striking <quote>the date that is</quote> and all that follows
			 through the period at the end and inserting the following: <quote>September 1,
			 2008.</quote>; and</text>

			 crafts</header>
				<paragraph id="IDB5013E5026FF4D9EAC3A5365AFC6E461"><enum>(1)</enum><header>Criminal
			 proceedings; civil actions; misrepresentations</header><text>Section 5 of the
			 Act entitled <quote>An Act to promote the development of Indian arts and crafts
			 and to create a board to assist therein, and for other purposes</quote> (25
			 U.S.C. 305d) is amended to read as follows:</text>

				investigations</header><text>Any Federal law enforcement officer may conduct an
				investigation relating to a violation of this Act that occurs on land under the
				jurisdiction of the Federal Government.</text>
							</subsection><subsection id="ID7FE0D5466CB8435CA1A958CD98FBD4A1"><enum>(c)</enum><header>Criminal
				proceedings</header>
								<paragraph id="IDE3F5F9EE700C46F7869C05B5BC5EF2E1"><enum>(1)</enum><header>Investigation</header>
									<subparagraph id="id8A0B6BCF3C2F43DCA699251C90198809"><enum>(A)</enum><header>In
				general</header><text>The Board may refer an alleged violation of section 1159
				of title 18, United States Code, to any Federal law enforcement officer for
				appropriate investigation.</text>
									</subparagraph><subparagraph id="idDF1C47841C2A4FA29166AE83C784C906"><enum>(B)</enum><header>Referral not
				required</header><text>A Federal law enforcement officer may investigate an
				alleged violation of section 1159 of that title regardless of whether the
				Federal law enforcement officer receives a referral under subparagraph
				(A).</text>
									</subparagraph></paragraph><paragraph id="ID2DF52163F6EE420F8186CB83B400AB84"><enum>(2)</enum><header>Findings</header><text>The
				findings of an investigation of an alleged violation of section 1159 of title
				18, United States Code, by any Federal department or agency under paragraph
				(1)(A) shall be submitted to—</text>
									<subparagraph id="ID0259548405BB42E69E6F7656CE0545E6"><enum>(A)</enum><text>the Attorney
				General; or</text>
									</subparagraph><subparagraph id="IDB25339A0DBD84507B9CC01B97E5B5298"><enum>(B)</enum><text>the Board.</text>
									</subparagraph></paragraph><paragraph id="ID65931AD26D7B4AE494E1C65117D9BEC5"><enum>(3)</enum><header>Recommendations</header><text>On
				receiving the findings of an investigation under paragraph (2), the Board
				may—</text>
									<subparagraph id="ID57DEFC04ECFF46E4BFD34D7D25C1D291"><enum>(A)</enum><text>recommend to the
				Attorney General that criminal proceedings be initiated under section 1159 of
				title 18, United States Code; and</text>
									</subparagraph><subparagraph id="IDDD430B5E67DB4C50927D39E284A3D88E"><enum>(B)</enum><text>provide such
				support to the Attorney General relating to the criminal proceedings as the
				Attorney General determines to be appropriate.</text>
									</subparagraph></paragraph></subsection><subsection id="ID45D64C1B09894977A347F902805C5F72"><enum>(d)</enum><header>Civil
				actions</header><text>In lieu of, or in addition to, any criminal proceeding
				under subsection (c), the Board may recommend that the Attorney General
				initiate a civil action under section

				an Indian artisan by an Indian tribe.</text>
									</subparagraph></paragraph><paragraph id="IDF067142C88844B378EDBD8AE7FD17B03"><enum>(2)</enum><header>Indian
				product</header><text>The term <term>Indian product</term> has the meaning
				given the term in any regulation promulgated by the Secretary.</text>
								</paragraph><paragraph id="ID45F430BF8B684E258AB5EB3420E3F45B"><enum>(3)</enum><header>Indian
				tribe</header>
									<subparagraph id="ID078D1332364C4E67BA7E72981D704C19"><enum>(A)</enum><header>In
				general</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the <act-name parsable-cite="ISDA">Indian
				Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
				450b).</text>
									</subparagraph><subparagraph id="IDBDBE3CB62D80468F9125C29CD0F112D2"><enum>(B)</enum><header>Inclusion</header><text>The
				term <term>Indian tribe</term> includes, for purposes of this section only, an
				Indian group that has been formally recognized as an Indian tribe by—</text>
										<clause id="ID395EECF271DF4421B3981A1D7D1E1076"><enum>(i)</enum><text>a
				State legislature;</text>
										</clause><clause id="ID60326AF364374FCB88E5A7325AF90E80"><enum>(ii)</enum><text>a State
				commission; or</text>
										</clause><clause id="IDDDD1E82D02FC4265A2148CC079DCAFD0"><enum>(iii)</enum><text>another similar
				organization vested with State legislative tribal recognition authority.</text>
										</clause></subparagraph></paragraph><paragraph id="ID36B23B3B6D954EF08227DDBD675B8750"><enum>(4)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of the
				Interior.</text>
								</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="IDE37753CAB79E474081ED025FEABD2097"><enum>(D)</enum><text>in subsection (b)
			 (as redesignated by subparagraph (B)), by striking <quote>subsection
			 (c)</quote> and inserting <quote>subsection (d)</quote>;</text>

										</clause><clause id="IDD7635AEFF65A4B1EA0BB83D4CC4D4FDD"><enum>(iii)</enum><text>an Indian arts
				and crafts organization;</text>
										</clause></subparagraph><subparagraph id="IDA82722C14C07465EBC4DFD75362B9DA5"><enum>(B)</enum><text>an Indian tribe,
				acting on behalf of—</text>
										<clause id="IDE8D51EE95FA14AC5AC188F2FD8ADFF18"><enum>(i)</enum><text>the Indian
				tribe;</text>
										</clause><clause id="ID04BB6B3558C44A62A77E433C50D07679"><enum>(ii)</enum><text>a member of that
				Indian tribe; or</text>
										</clause><clause id="IDA98D52CEF6F2494F89C6086266C361D2"><enum>(iii)</enum><text>an Indian arts
				and crafts organization;</text>
										</clause></subparagraph><subparagraph id="ID62D539557FE04535AC2F4E4A394F3989"><enum>(C)</enum><text>an Indian;
				or</text>
									</subparagraph><subparagraph id="ID153F3F740451494B89709F92D1CCC12A"><enum>(D)</enum><text>an Indian arts
				and crafts organization.</text>
									</subparagraph></paragraph><paragraph id="ID604B836A0CAD4AB296D4E118BFD0264F"><enum>(2)</enum><header>Disposition of
				amounts recovered</header>
									<subparagraph id="IDE401843B7FB5475482EEBFF42CE1F541"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), an amount
				recovered in a civil action under this section shall be paid to the Indian
				tribe, the Indian, or the Indian arts and crafts organization on the behalf of
				which the civil action was initiated.</text>
									</subparagraph><subparagraph id="ID6C0CA160422D4870B9DEE2F25AD5D6C2"><enum>(B)</enum><header>Exceptions</header>
										<clause id="ID55FD40E1D0524991A2024AE92C32B4BC"><enum>(i)</enum><header>Attorney
				General</header><text>In the case of a civil action initiated under paragraph
				(1)(A), the Attorney General may deduct from the amount—</text>
											<subclause id="IDF8C996F47EDE45539373BB2B15D25EF6"><enum>(I)</enum><text>the amount of the
				cost of the civil action and reasonable attorney’s fees awarded under
				subsection (c), to be deposited in the Treasury and credited to appropriations
				available to the Attorney General on the date on which the amount is recovered;
				and</text>
											</subclause><subclause id="IDC4855962E603427489ECD651E12940B6"><enum>(II)</enum><text>the amount of
				the costs of investigation awarded under subsection (c), to reimburse the Board
				for the activities of the Board relating to the civil action.</text>
											</subclause></clause><clause id="ID15A89BA20D604C1DB68C782245AFEFAF"><enum>(ii)</enum><header>Indian
				tribe</header><text>In the case of a civil action initiated under paragraph
				(1)(B), the Indian tribe may deduct from the amount—</text>
											<subclause id="IDA0F121DF59AE45B9B032A73631D283C3"><enum>(I)</enum><text>the amount of the
				cost of the civil action; and</text>
											</subclause><subclause id="ID5A3DB315E492499B811B11FFCCD18434"><enum>(II)</enum><text>reasonable
				attorney’s fees.</text>
											</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>;

			 subsection (b) and inserting the following:</text>

						<subsection id="id28475696BB39471185D2FB4977A85317"><enum>(b)</enum><header>Penalty</header><text>Any
				person that knowingly violates subsection (a) shall—</text>

				first violation by that person—</text>

				goods are offered or displayed for sale at a total price of $1,000 or more, or
				if the applicable goods are sold for a total price of $1,000 or more—</text>
									<clause id="id2AB6F02B05C7494685CD8C53700B2534"><enum>(i)</enum><text>in the case of an
				individual, be fined not more than $250,000, imprisoned for not more than 5
				years, or both; and</text>
									</clause><clause id="idACBD5CC10AFD41DE9F4F73099FC3132F"><enum>(ii)</enum><text>in the case of a
				person other than an individual, be fined not more than $1,000,000; and</text>
									</clause></subparagraph><subparagraph id="id144961AC8D2A4275AF2BC640CAAB853B"><enum>(B)</enum><text>if the applicable
				goods are offered or displayed for sale at a total price of less than $1,000,
				or if the applicable goods are sold for a total price of less than
				$1,000—</text>
									<clause id="id6713041A293F40F49E4ED8A9333574D1"><enum>(i)</enum><text>in the case of an
				individual, be fined not more than $25,000, imprisoned for not more than 1
				year, or both; and</text>
									</clause><clause id="id89DF1958DD51423E9B44B47C9B1F6C5E"><enum>(ii)</enum><text>in the case of a
				person other than an individual, be fined not more than $100,000; and</text>
									</clause></subparagraph></paragraph><paragraph id="id5502C69F1F1D4959B7C9F3A1354D467A"><enum>(2)</enum><text>in the case of a
				subsequent violation by that person, regardless of the amount for which any
				good is offered or displayed for sale or sold—</text>
								<subparagraph id="id33C65C5E7E204036A6AA163731FB752A"><enum>(A)</enum><text>in the case of an
				individual, be fined under this title, imprisoned for not more than 15 years,
				or both; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7849285FB0234D36AD28ECA32048F0FE"><enum>(B)</enum><text>in the case of a
				person other than an individual, be fined not more than
				$5,000,000.</text>
