<enum>XXX</enum><header>Coordinated Environmental Public Health Network</header> <section id="ID5F44750E842244A991A12A59CA0CD29D"><enum>3000.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="IDC0A7D4F83095442E9F979448EE88A252"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph><paragraph id="IDA599BB89916F4524A8337B9AADE344BD"><enum>(2)</enum><header>Committee</header><text>The term <term>Committee</term> means the Advisory Committee established under section 3001(d).</text> </paragraph><paragraph id="id911ADE1F24C34346BD07D60189E227F4"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Centers for Disease Control and Prevention.</text> </paragraph><paragraph id="IDD48F85A400C949EE8CA29D9EEA7D7226"><enum>(4)</enum><header>Director of center</header><text>The term <term>Director of Center</term> means the Director of the National Center for Environmental Health at the Centers for Disease Control and Prevention.</text> </paragraph><paragraph id="ID0050415D43F14264B601A788AE0FCA57"><enum>(5)</enum><header>Medical privacy regulations</header><text>The term <term>medical privacy regulations</term> means the regulations promulgated under section 264(c) of the <act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability Act of 1996</act-name>.</text> </paragraph><paragraph id="IDAB4EBD68FBDE4C37B2B1A28BE0A81CA8"><enum>(6)</enum><header>Coordinated network</header><text>The term <term>Coordinated Network</term> means the Coordinated Environmental Public Health Network established under section 3001(a).</text> </paragraph><paragraph id="ID1023C92AA4FA4F0FA7D84F2DBAAAB533"><enum>(7)</enum><header>Priority chronic conditions and health effects</header><text>The term <term>priority chronic conditions and health effects</term> means the conditions to be tracked in the Coordinated Network and the State Networks, such as birth defects, developmental disabilities (such as cerebral palsy, autism, and mental retardation), asthma and chronic respiratory diseases, neurological diseases (such as Parkinson’s disease, multiple sclerosis, Alzheimer’s disease, and amyotrophic lateral sclerosis), autoimmune diseases (such as lupus), cancer, juvenile diabetes, and such other priority chronic conditions and health effects as the Secretary may specify.</text> </paragraph><paragraph id="IDE0168A430AD34EF894F370E0D48CC9EA"><enum>(8)</enum><header>State network</header><text>The term <term>State Network</term> means a State Environmental Public Health Network established under section 3001(b).</text> </paragraph><paragraph id="ID1791377BF5A647F29B75CC784E592B83"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means a State, local government, territory, or Indian tribe that is eligible to receive a health tracking grant under section 3001(b).</text> </paragraph></section><section id="IDF8ACF493C5FE43EA94859401647034CD"><enum>3001.</enum><header>Establishment of Coordinated and State Environmental Public Health Networks</header> <subsection id="ID21790965725641CF9A544A868CBD9FAE"><enum>(a)</enum><header>Coordinated Environmental Public Health Network</header> <paragraph id="IDA01B16DC149A47DE87F17AFAFC3785BB"><enum>(1)</enum><header>Establishment</header><text>Not later than 36 months after the date of the enactment of this title, the Secretary, acting through the Director, in consultation with the Administrator and the Director of Center, and with the involvement of other Federal agencies, State and local health departments, and the Committee, shall establish and operate a Coordinated Environmental Public Health Network. In establishing and operating the Coordinated Network, the Secretary shall, as practicable—</text> <subparagraph id="ID92DFDBBFFD0349DEBF933396D5988993"><enum>(A)</enum><text>identify, build upon, expand, and coordinate among existing data and surveillance systems, surveys, registries, and other Federal public health and environmental infrastructure as practicable, including—</text> <clause id="ID0D10BF5645FD404989DA648FCF398311"><enum>(i)</enum><text>the Public Health Information Network;</text> </clause><clause id="ID6DEE8E0927F1486FAEF0349822524BF6"><enum>(ii)</enum><text>State birth defects surveillance systems as supported under section 317C;</text> </clause><clause id="IDFC7B57D6024E4785A39B91F5CED7BCB2"><enum>(iii)</enum><text>State cancer registries as supported under part M of title III;</text> </clause><clause id="ID11CB1D03679E4F35BD9B31AE4B75D334"><enum>(iv)</enum><text>State asthma surveillance systems as supported under section 317I;</text> </clause><clause id="ID5BE6F093C2A34BFB9D7258D1990E48A5"><enum>(v)</enum><text>the National Health and Nutrition Examination Survey;</text> </clause><clause id="ID2322E3D164FD4D7093B853D62B36F0A7"><enum>(vi)</enum><text>the Behavioral Risk Factor Surveillance System;</text> </clause><clause id="ID2BECEC5228FF473895941F617CE6A838"><enum>(vii)</enum><text>the Hazardous Substance Release/Health Effects Database;</text> </clause><clause id="IDFF806DA10AF5420FBD46BF6BE4F16F21"><enum>(viii)</enum><text>the Hazardous Substances Emergency Events Surveillance System; and</text> </clause><clause id="IDFDBD8F75F6C34D76A6435ED0D275A76B"><enum>(ix)</enum><text>the State vital statistics systems as supported under section 306;</text> </clause></subparagraph><subparagraph id="IDF17A2C5766084C7183FD1355FE71960A"><enum>(B)</enum><text>provide for public access to an electronic national database that accepts data from the State Networks on the incidence and prevalence of priority chronic conditions and health effects and relevant environmental and other factors, in a manner which protects personal privacy consistent with the medical privacy regulations;</text> </subparagraph><subparagraph id="ID18578CC97F944809ACA00A94835E2797"><enum>(C)</enum><text>prepare and publish, in accordance with paragraph (2)—</text> <clause id="ID3d841e5aea894e9cb61e3c10b7d861fd"><enum>(i)</enum><text>not later than 12 months after the date of enactment of this title, and annually thereafter, a Coordinated Environmental Public Health Network Status Report (referred to in this title as the <quote>Status Report</quote>) to provide to Congress and the public an update on the progress made toward developing and further expanding the Coordinated Network and State Networks, with such report to be made available to the public on the websites of the Centers for Disease Control and Prevention and the Environmental Protection Agency; and</text> </clause><clause id="IDf3aad26d57064cafbebac4b5f98732ea"><enum>(ii)</enum><text>not later than 2 years after the date of enactment of this title, and biennially thereafter, a Coordinated Network Health and Environment Report describing environmental and other factors potentially relevant to the Nation's health, in order to allow the public to access and understand information about environmental health at the Federal, State, and, where practicable, local level;</text> </clause></subparagraph><subparagraph id="IDF0731ECB88994C6CB77B0D178A543FCC"><enum>(D)</enum><text>operate and maintain National Environmental Health Rapid Response Services through the Epidemic Intelligence Service, and other mechanisms available through the National Center for Environmental Health of the Centers for Disease Control and Prevention, and the Agency for Toxic Substances and Disease Registry, to carry out the activities described in paragraph (3), as practicable;</text> </subparagraph><subparagraph id="IDF9B13D32E0ED4AB78E99AFDDB32B2EBA"><enum>(E)</enum><text>provide for the establishment of State Networks, and coordinate the State Networks as provided for under subsection (b);</text> </subparagraph><subparagraph id="ID411C888031184C67BD77ED78749CA207"><enum>(F)</enum><text>provide technical assistance to support the State Networks, including providing—</text> <clause id="ID47497D83D7714646988F817D67446677"><enum>(i)</enum><text>training for environmental health investigators appointed or hired under subsection (b)(3)(D);</text> </clause><clause id="ID446F314C7FA04DFEA65F4F1854BAB576"><enum>(ii)</enum><text>technical assistance as needed to States to build necessary capacity and infrastructure for the establishment of a State Network, including a computerized data collection, reporting, and processing system, and additional assistance identified by the States under subsection (b)(5)(C) as necessary for infrastructure development, such as assistance to improve the expertise of personnel in responding to environmental health concerns; and</text> </clause><clause id="IDF092DBCBAE9F46E7874FC6DF3214B07C"><enum>(iii)</enum><text>such other technical assistance as the Secretary, in consultation with the Administrator and the Director of Center, determines to be necessary;</text> </clause></subparagraph><subparagraph id="ID97DD2343E3B34335A6D78C75EEC9BB67"><enum>(G)</enum><text>not later than 12 months after the date of the enactment of this title, develop minimum standards and procedures in accordance with paragraph (4) for data collection and reporting for the State Networks, to be updated not less than annually thereafter; and</text> </subparagraph><subparagraph id="IDC0A3EBDFF2A44F8E8171F221303223A0"><enum>(H)</enum><text>in developing the minimum standards and procedures under subparagraph (G), include mechanisms for allowing the States to set priorities, and allocate resources accordingly, among the factors described in subparagraphs (A), (B), and (C) of paragraph (4).</text> </subparagraph></paragraph><paragraph id="IDDD8F9765A49A43CBA3683B099FDEDE2F"><enum>(2)</enum><header>Reports</header> <subparagraph id="id896F7259B7D44B3E9FE3AC6009AE4455"><enum>(A)</enum><header>Annual reports</header><text>Each Status Report prepared under paragraph (1)(C)(i) shall include—</text> <clause id="ID02a956735b59462585ae4cc49e6328a4"><enum>(i)</enum><text>a statement of the activities carried out under this title;</text> </clause><clause id="ID1161865568f948068af01a7b36e87033"><enum>(ii)</enum><text>the identification of gaps in the data of the Coordinated Network, including diseases of concern and environmental exposures not tracked; and</text> </clause><clause id="ID9395a2bf23814db3b606bc76f45e9de1"><enum>(iii)</enum><text>identification of key milestones achieved in the preceding year.</text> </clause></subparagraph><subparagraph id="IDe8a4c1fcd7274d32b3d32a3af92cb0df"><enum>(B)</enum><header>Biennial reports</header><text>Each Coordinated Network Health and Environment Report prepared under paragraph (1)(C)(ii) shall include—</text> <clause id="IDb1c329f813394df5841d345959f3b706"><enum>(i)</enum><text>a statement of the activities carried out under this title;</text> </clause><clause id="ID7f4f49c044544607aa26d440977fe2ee"><enum>(ii)</enum><text>an analysis of the most currently available incidence, prevalence, and trends of priority chronic conditions and health effects, and potentially relevant environmental and other factors, by State and, as practicable, by local areas such as a census tract or other political or administrative subdivision, as determined appropriate by the Secretary in consultation with the Administrator;</text> </clause><clause id="ID8744ccf6f3ea4d8e8ee235fe48698743"><enum>(iii)</enum><text>recommendations regarding high risk populations, public health concerns, response and prevention strategies, and additional tracking needs; and</text> </clause><clause id="IDfb0c840c1bf74cefbcc26c5fdcf13701"><enum>(iv)</enum><text>to the extent practicable, a discussion of genetic risk factors that have been shown to be associated with environmental factors and these priority chronic conditions and health effects.</text> </clause></subparagraph></paragraph><paragraph id="IDD431A32429B5437E87625682E223CDFA"><enum>(3)</enum><header>National environmental health rapid response services</header> <subparagraph id="idE2E3C5D7BCA548D3B02CDD04A9BB669F"><enum>(A)</enum><header>In general</header><text>The National Environmental Health Rapid Response Services operated under paragraph (1)(D) shall—</text> <clause id="ID897A2B7C32FC4CFAA81A2E63A9D82CC1"><enum>(i)</enum><text>work with environmental health investigators appointed or hired under subsection (b)(3)(D) to develop and implement strategies, protocols, and guidelines for the coordinated, rapid responses to actual and perceived higher than expected incidence and prevalence rates of priority chronic conditions and health effects and to acute and potential environmental hazards and exposures;</text> </clause><clause id="ID6E7BBA584FCB4CB9A560C69F9FB2DA9C"><enum>(ii)</enum><text>provide assistance in the conduct of investigations into higher than expected incidence and prevalence rates of priority chronic conditions and health effects or environmental exposures after a State requests assistance, through a process established by the Secretary;</text> </clause><clause id="IDAA958ED95B9D4F41AAAE2C489EF23AF9"><enum>(iii)</enum><text>coordinate activities carried out under this title with activities carried out under sections 319 through 319G; and</text> </clause><clause id="ID8313BD11C8A84B4787A05C57ACA3A75D"><enum>(iv)</enum><text>coordinate activities carried out under this title with other Federal and State agencies, as appropriate.</text> </clause></subparagraph><subparagraph id="id75484300BA814B3EADC119EABEEA2DED"><enum>(B)</enum><header>Coordination with existing efforts</header><text>The National Environmental Health Rapid Response Services operated under paragraph (1)(D) shall incorporate the efforts, strategies, and protocols of the Centers for Disease Control and Prevention with respect to rapidly responding to and investigating possible increases in priority chronic conditions and other health effects and environmental health threats.</text> </subparagraph></paragraph><paragraph id="ID8FD30DCBBA60463D8398C90C3265D7EB"><enum>(4)</enum><header>Data collection and reporting by state networks</header><text>The minimum standards and procedures referred to in paragraph (1)(G) shall include—</text> <subparagraph id="ID413750DEB0984E169F5C877A00D02C94"><enum>(A)</enum><text>a list and definitions of the priority chronic conditions and health effects to be tracked through the State Networks;</text> </subparagraph><subparagraph id="ID90165956B3914C009AF9373428A544A8"><enum>(B)</enum><text>a list and definitions of relevant environmental exposures of concern to be tracked, to the extent practicable, through the State Networks, including—</text> <clause id="ID96CDA9E99EA747ADB08558993583D884"><enum>(i)</enum><text>hazardous air pollutants (as defined in section 302(g) of the <act-name parsable-cite="CAA">Clean Air Act</act-name>);</text> </clause><clause id="ID715A9671E52D4509A0F4097BB03B4BE2"><enum>(ii)</enum><text>air pollutants for which national primary ambient air quality standards have been promulgated under section 109 of the <act-name parsable-cite="CAA">Clean Air Act</act-name>;</text> </clause><clause id="ID650306DB2C024C3AA320A6E9BC9F8ED3"><enum>(iii)</enum><text>pollutants or contaminants (as defined in section 101 of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name>);</text> </clause><clause id="ID3D85F379F6764747B44AF6076A7C75A7"><enum>(iv)</enum><text>toxic chemicals (as described in section 313 of the Emergency Planning and Community Right-to-Know Act of 1986);</text> </clause><clause id="IDAB7DBF738B5D41A2BACE1E898D280DEF"><enum>(v)</enum><text>substances reported under the <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name> Inventory Update Rule as provided for in part 710 of title 40, Code of Federal Regulations, or successor regulations;</text> </clause><clause id="ID98FDD011C0C5426087CBF858561B8141"><enum>(vi)</enum><text>pesticides (as defined in section 2(u) of the <act-name parsable-cite="FIFRA">Federal Insecticide, Fungicide, and Rodenticide Act</act-name>); and</text> </clause><clause id="IDDB8411D6DE374486ABE2D59FB8147D73"><enum>(vii)</enum><text>such other potentially relevant environmental factors as the Secretary may specify;</text> </clause></subparagraph><subparagraph id="ID51E79CA19ACB48A3B74C5E45F7066366"><enum>(C)</enum><text>a list and definitions of potentially relevant behavioral, socioeconomic, demographic, and genetic factors known to be associated with these priority chronic conditions and health effects and other risk factors, such as race, ethnic status, gender, age, occupation, and primary language, to be tracked through the State Networks;</text> </subparagraph><subparagraph id="IDE985743F67A0430AA43AC00ED9CD221D"><enum>(D)</enum><text>procedures for the complete and timely collection and reporting of data to the Coordinated Network by local areas, such as a census tract or other political subdivision determined appropriate by the Secretary, in consultation with the Administrator, regarding the factors described in subparagraphs (A), (B), and (C);</text> </subparagraph><subparagraph id="ID53C61CAD3925425C8D0CE607F286544D"><enum>(E)</enum><text>procedures for making data available to the public and researchers, and for reporting to the Coordinated Network, while protecting the confidentiality of all personal data reported, in accordance with medical privacy regulations;</text> </subparagraph><subparagraph id="ID6A650E09C65A4B4191BC35C3A398D1DE"><enum>(F)</enum><text>standards and procedures for the establishment, operation, and maintenance of laboratories conducting biomonitoring, in order to expand the scope and amount of biomonitoring data collected by the Centers for Disease Control and Prevention as described in section 3004;</text> </subparagraph><subparagraph id="IDA067C5FEEE0B4A7E9456E86C4C791694"><enum>(G)</enum><text>criteria for the environmental health investigators as required under subsection (b)(3)(D);</text> </subparagraph><subparagraph id="IDDF94F2CE8E324698B18335380CEA0C2F"><enum>(H)</enum><text>procedures for record and data maintenance and verification; and</text> </subparagraph><subparagraph id="ID7F1603FD3A5F480F8FECF9FB4851DE03"><enum>(I)</enum><text>a framework for coordinating genetic studies on these priority chronic conditions and health effects associated with environmental factors including privacy protections, informed consent, and contact information for patients wishing to enroll in clinical trials.</text> </subparagraph></paragraph></subsection><subsection id="IDC8B3C7BEDF2D4FA48B42B7F2777020DC"><enum>(b)</enum><header>State Environmental Public Health Networks</header> <paragraph id="ID33076F8686774395BAC81B72DF94F1A2"><enum>(1)</enum><header>Grants</header><text>Not later than 12 months after the date of the enactment of this title, the Secretary, acting through the Director, in consultation with the Administrator and the Director of Center, and taking into consideration the findings of the Committee, shall award grants to States for the establishment, maintenance, and operation of State Environmental Public Health Networks in accordance with the minimum standards and procedures established by the Secretary under subsection (a)(4).</text> </paragraph><paragraph id="ID3D67C258D11E4E6C912002535E44E29C"><enum>(2)</enum><header>Specialized assistance</header><text>The Coordinated Network shall provide specialized assistance to grantees in the establishment, maintenance, and operation of State Networks.</text> </paragraph><paragraph id="ID58D1C9D470184CC9AA4B501F4D167DDA"><enum>(3)</enum><header>Requirements</header><text>A State receiving a grant under this subsection shall use the grant—</text> <subparagraph id="IDF192C4429BF7498397EE7E6E366CA3C4"><enum>(A)</enum><text>to establish an environmental public health network that will provide—</text> <clause id="ID7151F1F14D3A43EAA0374CA3104840A7"><enum>(i)</enum><text>for the tracking of the incidence, prevalence, and trends of priority chronic conditions and health effects, and potentially relevant environmental and other factors as set forth in subsection (a), as well as any additional priority chronic conditions and health effects and potentially related environmental exposures of concern to that State;</text> </clause><clause id="ID19D0BAE5D63848119D627E50000019BE"><enum>(ii)</enum><text>for identification of priority chronic conditions and health effects and potentially relevant environmental, genetic, and other factors that disproportionately impact low income and minority communities;</text> </clause><clause id="IDCF3A599B1E274306AA87F26DAB2B88D5"><enum>(iii)</enum><text>for the protection of the confidentiality of all personal data reported, in accordance with the medical privacy regulations;</text> </clause><clause id="ID7EDDA961D6EA43DC94AB4FE77DE7F2DC"><enum>(iv)</enum><text>a means by which confidential data may, in accordance with Federal and State law, be disclosed to researchers for the purposes of public health research;</text> </clause><clause id="ID915C85C8225C477FA917064104D1DDFD"><enum>(v)</enum><text>the fullest possible public access to data collected by the State Network or through the Coordinated Network, while ensuring that individual privacy is protected in accordance with subsection (a)(1)(B); and</text> </clause><clause id="IDE6EA77AE642C4EB590FD9AA6153EDF8F"><enum>(vi)</enum><text>for the collection of exposure data through biomonitoring and other methods, which may include the entering into of cooperative agreements as described in section 3004;</text> </clause></subparagraph><subparagraph id="IDFD68B3DE79D046E99963FCD13F446C56"><enum>(B)</enum><text>to develop a publicly available plan for establishing the State Network in order to meet minimum standards and procedures as developed by the Coordinated Network under subsection (a)(4), including the State’s priorities within the minimum standards, a timeline by which all the standards will be met, and a plan for coordinating and expanding existing data and surveillance systems within the State including any pilot projects established through the Centers for Disease Control and Prevention prior to the date of the enactment of this title;</text> </subparagraph><subparagraph id="IDBB8CFC5D780A4D52A22FCAD929B2137D"><enum>(C)</enum><text>to appoint a lead public health department or agency that will be responsible for the development, operation, and maintenance of the State Network, and ensure the appropriate coordination among State and local agencies, including environmental agencies, regarding the development, operation, and maintenance of the State Network;</text> </subparagraph><subparagraph id="ID54BEE0F4B5CE4ED6AA6AFA928AE57EEC"><enum>(D)</enum><text>to appoint or hire an environmental health investigator who meets criteria established by the Secretary under subsection (a)(4)(G) and who will coordinate the development and maintenance of the rapid response protocol established under subparagraph (E);</text> </subparagraph><subparagraph id="ID17BC272EAE414E3CABF613BC265EA57B"><enum>(E)</enum><text>to establish a rapid response protocol, coordinated by the grantee’s environmental health investigator, in order to respond in a timely manner to actual and perceived incidence and prevalence rates of priority chronic diseases that are higher than expected, acute and potential environmental hazards and exposures, and other environmental health concerns, including warning the public when emergent public health concerns are detected through the State Network, and concerns regarding vulnerable subpopulations and disproportionately impacted subpopulations;</text> </subparagraph><subparagraph id="ID17939D922E9642DBA9753DEF8497F9DE"><enum>(F)</enum><text>to establish an advisory committee to ensure local community input to the State Network; and</text> </subparagraph><subparagraph id="IDA2FD9B8E2C7D4FB38083F4A79F94659E"><enum>(G)</enum><text>to recruit and train public health officials to continue to expand the State Network.</text> </subparagraph></paragraph><paragraph id="ID5E9E5D687CCF4B5B8C3A8FE4EE9D9DF3"><enum>(4)</enum><header>Limitation</header><text>A State that receives a grant under this section may not use more than 10 percent of the funds made available through the grant for administrative costs.</text> </paragraph><paragraph id="ID1AF60B41BEC241AFAAF23CE23E59DB0A"><enum>(5)</enum><header>Application</header><text>To seek a grant under this section, a State shall submit to the Secretary an application at such time, in such form and manner, and accompanied by such information as the Secretary may specify. The Secretary may not approve an application for a grant under this subsection unless the application—</text> <subparagraph id="IDBB2EE125D7AE4C2494A5D0B06C781B82"><enum>(A)</enum><text>contains assurances that the State will—</text> <clause id="ID3FC67F35BD214477A47E6E0AA17AAC5B"><enum>(i)</enum><text>use the grant only in compliance with the requirements of this title; and</text> </clause><clause id="ID48E84324C99349C3B0F283595CDB0AD8"><enum>(ii)</enum><text>establish such fiscal control and fund accounting procedures as may be necessary to ensure the proper disbursement and accounting of Federal funds paid to the State under the grant;</text> </clause></subparagraph><subparagraph id="ID755A80F5689A440AB5F81CC8659C9135"><enum>(B)</enum><text>contains the assurance that the State will establish a State Network as required by this subsection; and</text> </subparagraph><subparagraph id="ID4D23600C856B4EC6B73FEAD284F7FAA5"><enum>(C)</enum><text>contains assurances that if the State is unable to meet all of the requirements described in this subsection within the prescribed time period, the State will use grant funds to increase the public health infrastructure of the State, acting in cooperation with the Coordinated Network, in order to implement and maintain a State Network within 24 months of the receipt of such grant.</text> </subparagraph></paragraph></subsection><subsection id="ID54BB85282D78478792B897A666E7802F"><enum>(c)</enum><header>Pilot Projects</header> <paragraph id="ID8277C89FB03F4462B6025BD428A2BA25"><enum>(1)</enum><header>In general</header><text>A State may apply for a grant under this subsection to implement a pilot project that is approved by the Secretary, acting through the Director and in consultation with the Administrator, the Director of Center, and the Committee.</text> </paragraph><paragraph id="ID332BAC0E6E3F4A07A3D90EEEA2488797"><enum>(2)</enum><header>Activities</header><text>A State shall use amounts received under a grant under this subsection to carry out a pilot project designed to develop State Network enhancements and to develop programs to address specific local and regional concerns, including—</text> <subparagraph id="IDAC9717E56ED0437BA5F3AEAEDE8A71B4"><enum>(A)</enum><text>the expansion of the State Network to include additional chronic diseases or environmental exposures;</text> </subparagraph><subparagraph id="ID9B360E84E6A9429F9BE18DC61CF327EC"><enum>(B)</enum><text>the conduct of investigations of local concerns of increased incidence or prevalence of priority chronic conditions and health effects and environmental exposures; and</text> </subparagraph><subparagraph id="IDC15CE930080E444AB32608C36CA0F705"><enum>(C)</enum><text>the carrying out of other activities as determined to be a priority by the State or consortium of regional States and the Secretary.</text> </subparagraph></paragraph><paragraph id="ID1421E967642A4DF89A35C4C762E9A6C3"><enum>(3)</enum><header>Results</header><text>The Secretary may consider the results of the pilot projects under this subsection for inclusion into the Coordinated Network.</text> </paragraph></subsection><subsection id="IDEF8C0AFBAA8041CB8B8E61816ABCF00C"><enum>(d)</enum><header>Advisory Committee</header> <paragraph id="IDF0E2BB4272354437BEA22CA4608241D4"><enum>(1)</enum><header>Establishment</header><text>Not later than 9 months after the date of the enactment of this title, the Secretary acting jointly with the Administrator and the Director of Center, shall establish an Advisory Committee in accordance with the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name>.</text> </paragraph><paragraph id="ID17E9F30B3A784AA292DB0E1079477E73"><enum>(2)</enum><header>Composition</header> <subparagraph id="id8D945A40445C4052BAEAAA3EE284E037"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall be composed of 16 members to be appointed by the Secretary. Each member of the Advisory Committee shall serve a 3-year term, except that the Secretary may appoint the initial members of the Advisory Committee for lesser terms in order to comply with the following sentence. In appointing the members of the Advisory Committee, the Secretary shall ensure that the terms of 5 or 6 members expire each year.</text> </subparagraph><subparagraph id="id720DDFD7DF3D46F8B96BAEA7972E8045"><enum>(B)</enum><header>Qualifications</header><text>The Advisory Committee shall include at least—</text> <clause id="idA798FBC16CCE4DB5A959B3C766C4E467"><enum>(i)</enum><text>9 members that have experience in the areas of—</text> <subclause id="ID5278179EE6CD455D9244527A31E7B42D"><enum>(I)</enum><text>public health;</text> </subclause><subclause id="ID280C6EA9171A4978A6C94A7F50CE6A57"><enum>(II)</enum><text>the environment, especially toxic chemicals and human exposure;</text> </subclause><subclause id="IDE8E4407A9B784D069B7243DECD29B3CA"><enum>(III)</enum><text>epidemiology;</text> </subclause><subclause id="ID852DA82F8FE9466F9CD20EE2B7F89BEA"><enum>(IV)</enum><text>biomonitoring and other relevant exposure technologies; and</text> </subclause><subclause id="IDDE4F76D3881D413A8013C8A2C0E88012"><enum>(V)</enum><text>human disease genetics; and</text> </subclause></clause><clause id="idFB6E4EB71E44405D976CE8232F5E7F40"><enum>(ii)</enum><text>1 member representing nonprofit organizations with expertise in environmental health, community-based participatory research, and developing a community response to priority chronic conditions and health effects.</text> </clause></subparagraph></paragraph><paragraph id="IDD768C62136CE4A7CB6D63C61126DAAAB"><enum>(3)</enum><header>Reporting</header><text>The Advisory Committee shall not later than 12 months after the date of the enactment of this title, and at least once every 12 months thereafter, report to Congress on the progress of the Coordinated Network.</text> </paragraph><paragraph id="IDAE1EB36B4E6C4494B5800734203F3DE4"><enum>(4)</enum><header>Hearings</header><text>The Advisory Committee shall hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Committee considers appropriate to carry out the objectives of the Coordinated Network.</text> </paragraph><paragraph id="ID42D73A289754474D8984A4FDB63CF6F6"><enum>(5)</enum><header>Duties</header><text>The Advisory Committee shall—</text> <subparagraph id="ID1498FB14D99343AD836E732E72DF40F7"><enum>(A)</enum><text>review and provide input for each Status Report and Coordinated Network Health and Environment Report prior to publication, and make recommendations as to the progress of the Coordinated Network, including identifying information gaps in the network;</text> </subparagraph><subparagraph id="ID60943E5D504C4912B35A3C2E69E85136"><enum>(B)</enum><text>assist in developing the minimum standards and procedures for the State Networks under subsection (a)(4) and developing coordinated and standardized guidelines to respond to priority chronic conditions and health effects; and</text> </subparagraph><subparagraph id="IDCFB04F4217384B6A808BFD1ADB69E491"><enum>(C)</enum><text>provide ongoing public input to the Coordinated Network.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="idA8CB09F5BED94A4AB130B8B0C8BF551A"><enum>(e)</enum><header>Privacy</header><text>In establishing and operating the Coordinated Network under subsection (a), and in making grants under subsections (b) and (c), the Secretary shall ensure the protection of privacy of individually identifiable health information, including ensuring protection consistent with the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (42 U.S.C. 1320d–2 note).</text> </subsection><subsection id="ID838F28B1714844C48D28A3009F06A296"><enum>(f)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated to carry out this section $100,000,000 for fiscal year 2008 and such sums as may be necessary for each of fiscal years 2009 through 2012.</text> </subsection></section><section id="IDF26C630074F749A3A1F6F782931BCF0C"><enum>3002.</enum><header>Increasing public health personnel capacity</header> <subsection id="ID753D2C614E1C4236BF224596838B14AE"><enum>(a)</enum><header>Schools or Programs of Public Health Centers of Excellence</header> <paragraph id="ID8DF4EF8A3AF84F87A1E5582EB5A496A4"><enum>(1)</enum><header>Grants</header><text>Beginning in fiscal year 2008, the Secretary may award grants to at least 5 accredited schools or programs of public health for the establishment, maintenance, and operation of Centers of Excellence for research and demonstration with respect to priority chronic conditions and health effects and relevant environmental factors.</text> </paragraph><paragraph id="ID2D95A16F34B64C9FBD88230FBE0D6BC2"><enum>(2)</enum><header>Activities</header><text>A Center of Excellence established or operated under paragraph (1) shall undertake research and development projects in at least 1 of the following areas:</text> <subparagraph id="IDC143929C796D4904B1882A96FE00C1C0"><enum>(A)</enum><text>Investigating causal connections between priority chronic conditions and health effects and environmental factors.</text> </subparagraph><subparagraph id="ID92354DCFD98045B98CA0FF40BC0A08FF"><enum>(B)</enum><text>Increasing the understanding of the causes of higher than expected incidence and prevalence rates of priority chronic conditions and health effects and developing more effective intervention methods for when such elevated rates occur.</text> </subparagraph><subparagraph id="IDFEEE34A549B647D2A4E4EB40B8EC2137"><enum>(C)</enum><text>Identifying additional chronic conditions and environmental factors that could be tracked by the Coordinated Network.</text> </subparagraph><subparagraph id="ID5CD81C2F03B7495AB903D72C6B674783"><enum>(D)</enum><text>Improving translation of Coordinated Network tracking results into effective prevention activities.</text> </subparagraph><subparagraph id="IDF047E4D00D644428804BA50F8DA5F806"><enum>(E)</enum><text>Improving training of the public health workforce in environmental epidemiology, public health surveillance, and effective risk communication.</text> </subparagraph><subparagraph id="IDA0BD56BAC3B74EEA8320D6FCF99EE299"><enum>(F)</enum><text>Establishing links to the Coordinated Network and the State Networks to identify associations that warrant further study.</text> </subparagraph></paragraph><paragraph id="ID2BF289C4F6204F7392F0E081BFDC5B38"><enum>(3)</enum><header>Requirements for centers of excellence</header><text>To be eligible to receive a grant under paragraph (1), a school or program of public health shall provide assurances that the school or program—</text> <subparagraph id="IDF19394FDB2B747EEBA077E52630D9F0B"><enum>(A)</enum><text>meets the minimum requirements as established by the Secretary in consultation with the Director;</text> </subparagraph><subparagraph id="ID1EFC358FB7B946489EF5ADE53CE89C5E"><enum>(B)</enum><text>maintains privacy for public health information if appropriate to the project, including the protections described in section 3001(e); and</text> </subparagraph><subparagraph id="ID70664D7D1499472A832CDC0FE5860A5F"><enum>(C)</enum><text>makes public information regarding the findings and results of the programs.</text> </subparagraph></paragraph><paragraph id="IDB119AE5D4152444F9C34E82A0CEA7A0C"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $5,000,000 for each of fiscal years 2008 through 2012.</text> </paragraph></subsection><subsection id="ID70EF25550F3E45B7B94458DE6E083DFD"><enum>(b)</enum><header>John H. Chafee Public Health Scholar Program</header> <paragraph id="ID3EDBB39629774EFB84C11B8B072B186E"><enum>(1)</enum><header>In general</header><text>The Secretary shall award scholarships, to be known as John H. Chafee Public Health Scholarships, to eligible students who are enrolled in an accredited school of public health or medicine. The Secretary shall determine both the criteria and eligibility requirements for such scholarships, after consultation with the Committee.</text> </paragraph><paragraph id="ID261F8B5E292B4F8188A032E945F5CDEB"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $2,500,000 for each of fiscal years 2008 through 2012.</text> </paragraph></subsection><subsection id="IDB10C25C7E50B45FE98864BE51D5EB987"><enum>(c)</enum><header>Applied Epidemiology Fellowship Programs</header> <paragraph id="IDC611E1BEBF2B428793D5A5BEB903DF25"><enum>(1)</enum><header>In general</header><text>Beginning in fiscal year 2008, the Secretary, acting through the Director, shall enter into a cooperative agreement with the Council of State and Territorial Epidemiologists to train and place, in State and local health departments, applied epidemiology fellows to enhance State and local public health capacity in the areas of environmental health, chronic and other noninfectious diseases and conditions, and public health surveillance.</text> </paragraph><paragraph id="ID41ACE28E3E834F4DB702AEB8C0A33C4F"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $2,500,000 for fiscal year 2008, and such sums as may be necessary in each of fiscal years 2009 through 2012.</text> </paragraph></subsection></section><section id="IDB76B46181ED54C338F67BAAE91778A3D"><enum>3003.</enum><header>General provisions</header> <subsection id="IDD344A7BA67A04AC5B6791E8CA695C9AB"><enum>(a)</enum><header>Appropriations Account</header><text>All authorizations of appropriations established in this title are authorizations exclusively for appropriations to the account that, among appropriations accounts for the Centers for Disease Control and Prevention, is designated <quote>Environmental Health</quote>.</text> </subsection><subsection id="ID478AFCDF4D344A35818E409952123404"><enum>(b)</enum><header>Date Certain for Obligation of Appropriations</header><text>With respect to the process of receiving applications for and making awards of grants, cooperative agreements, and contracts under this title, the Secretary, acting through the Director, shall to the extent practicable design the process to ensure that amounts appropriated under this title for such awards for a fiscal year are obligated not later than the beginning of the fourth quarter of the fiscal year, subject to compliance with section 1512 of title 31, United States Code (relating to deficiency or supplemental appropriations), and other applicable law regarding appropriations accounting.</text> </subsection><subsection id="ID87CCCCC8EF3B4A11BEC5D027D9B03035"><enum>(c)</enum><header>Coordination With Agency for Toxic Substances and Disease Registry</header><text>In carrying out this title, the Secretary, acting through the Director, shall coordinate activities and responses with the Agency for Toxic Substances and Disease Registry.</text> </subsection><subsection id="ID5A613375859D4D908DC6F4C4545C27F0"><enum>(d)</enum><header>Coordination With Existing Tracking Program Through CDC</header><text>The Secretary shall integrate the enactment of this title with all environmental health tracking programs funded prior to the date of enactment of this title, including by integrating the programs, in existence on the date of enactment of this title, to develop State Network enhancements and to develop programs to address specific local and regional concerns.</text> </subsection></section><section id="IDC6933C38FDB042B597F93EF958941AC9"><enum>3004.</enum><header>Expansion of biomonitoring capabilities and data collection</header> <subsection id="ID990aa83d53f542ad819ceca12b96c0f8"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to expand the scope and amount of biomonitoring data collected by the Centers for Disease Control and Prevention, State laboratories, and consortia of State laboratories, in order to obtain robust information, including information by geographically defined areas and subpopulations, about a range of environmental exposures.</text> </subsection><subsection id="IDbd51c6b3e9794e09ac246675796ea5e5"><enum>(b)</enum><header>In general</header><text>In meeting the purpose of this section, the Secretary shall ensure that biomonitoring data are collected through appropriate sources, including the National Health and Nutrition Examination Survey, and shall, as appropriate, enter into collaboration or partnerships with other entities to obtain additional information regarding vulnerable subpopulations or other subpopulations.</text> </subsection><subsection id="ID949e93ee58aa4b56ac153814e658e7c6"><enum>(c)</enum><header>Cooperative agreements</header> <paragraph id="IDc2e1ba985309484f9bbf3872750795d5"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall enter into cooperative agreements with States or consortia of States to support the purposes of this title.</text> </paragraph><paragraph id="IDc0ed0daf68a44514a491dea64690318d"><enum>(2)</enum><header>Applications</header><text>Applications for such cooperative agreements by consortia of States shall address the manner in which such States will coordinate activities with other States in the region, and shall designate a lead State for administrative purposes.</text> </paragraph><paragraph id="ID87e4c18785ec4e12a1324dc263784331"><enum>(3)</enum><header>Geographic distribution</header><text>In entering into cooperative agreements under this section, the Secretary shall, to the extent practicable, take appropriate measures to provide for an equitable geographic distribution of such agreements.</text> </paragraph></subsection><subsection commented="no" id="id02440CE0625F4CD7A357CBE163BB9008"><enum>(d)</enum><header>Privacy</header><text>In carrying out this section, the Secretary shall ensure the protection of privacy of individually identifiable health information, including ensuring protection consistent with the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996 (42 U.S.C. 1320d–2 note).</text> </subsection><subsection id="ID39a3e4f07f97449da26977fac19f7f8b"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section, $50,000,000 for fiscal year 2008, and such sums as may be necessary for each of fiscal years 2009 through 2012.</text> </subsection></section>
