<section id="ID930cee41d8eb4a0bb018b924bb39b0ea" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="IDaa392738a42e4dbe8329553076432e6d"><enum>(1)</enum><text>there are approximately 4,000,000,000 screw-based sockets in the United States that contain traditional, energy-inefficient, incandescent light bulbs;</text> </paragraph>
<paragraph id="ID36a40a47878b474c883d10936deb4705"><enum>(2)</enum><text>incandescent light bulbs are based on technology that is more than 125 years old; and</text> </paragraph>
<paragraph id="IDb639b70fc4ff4e2982b37af0bc64a8bc"><enum>(3)</enum><text>it is in the national interest to encourage the use of more energy-efficient lighting products in the market through energy conservation standards that become effective during the 8-year period beginning on the date of enactment of this Act and—</text> 
<subparagraph id="ID5e6a122ae033436badc50c8dee21132a"><enum>(A)</enum><text>establish the efficiency requirements to ensure that replacement lamps will provide consumers with the same quantity of light while using significantly less energy;</text> </subparagraph>
<subparagraph id="ID7112ed8a27a64509ac5803e03823bcff"><enum>(B)</enum><text>ensure that consumers will continue to have multiple product choices, including energy-saving halogen, incandescent, compact fluorescent, and LED light bulbs; and</text> </subparagraph>
<subparagraph id="ID765ade643e2b431980bd6adf5af0c3e6"><enum>(C)</enum><text>work with industry and key stakeholders on measures that can assist consumers and businesses in making the important transition to more efficient lighting.</text> </subparagraph></paragraph></section>
<section id="idF26BAD0DB27C4664944D1755221C0D77"><enum>3.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Energy.</text> </section>
<title id="idA835D7FCD67C491099740C464B06AB6F"><enum>I</enum><header>General service incandescent lamps</header> 
<section id="ID4e93408ae8bc4634b5ccc81b23bee99d"><enum>101.</enum><header>Energy efficiency standards for general service incandescent lamps</header> 
<subsection id="idA08326E5E3104F359F1CFB9CB1D9230E"><enum>(a)</enum><header>Definition of general service incandescent lamp</header><text>Section 321(30) of the Energy Policy and Conservation Act (42 U.S.C. 6291(30)) is amended—</text> 
<paragraph id="ID4d040d2447c947ee8339343a9562a668"><enum>(1)</enum><text>by striking subparagraph (D) and inserting the following:</text>

<subparagraph id="ID01f123e8db2e49a9beefd0f7d44167e2"><enum>(D)</enum><header>General service incandescent lamp</header> 
<clause id="id232B85B3E622424B92A002A3D79E299A"><enum>(i)</enum><header>In general</header><text>The term <term>general service incandescent lamp</term> means a standard incandescent or halogen type lamp that—</text> 
<subclause id="id9BBE788EC60C4F14AFBFD6F39E671363"><enum>(I)</enum><text>is intended for general service applications;</text> </subclause>
<subclause id="id550CA41EE3764EB4AB36B436252FF60E"><enum>(II)</enum><text>has a medium screw base;</text> </subclause>
<subclause id="idF9BC870177764032BFAE014347C64ADC"><enum>(III)</enum><text>has a lumen range of not less than 200 lumens and not more than 3,000 lumens;</text> </subclause>
<subclause id="idCA2E518D5A184AD0BCF77754CD0BC7E2"><enum>(IV)</enum><text>has a voltage range at least partially within 110 and 130 volts;</text> </subclause>
<subclause id="idD2676E5FBCF44737B9ED3742808023C6"><enum>(V)</enum><text>has an A–15, A–19, A–21, A–23, A–25, PS–25, PS–30, BT–14.5, BT–15, CP–19, TB–19, CA–22, or equivalent shape (as defined in ANSI C78.20–2003); and</text> </subclause>
<subclause id="id3EC1FC2A79EB4A4A924C2A8437287D6E"><enum>(VI)</enum><text>has a bulb finish of the frosted, clear, soft white, or modified spectrum type.</text> </subclause></clause>
<clause id="id455EBB2FCA124498AEA494AB56437319"><enum>(ii)</enum><header>Exclusions</header><text>The term <term>general service incandescent lamp</term> does not include the following incandescent lamps:</text> 
<subclause id="ID723c8b9cf9c343628b6774e16a4e0c50"><enum>(I)</enum><text>An appliance lamp.</text> </subclause>
<subclause id="IDfd7c809da9fa437699d60ba856c2e9e7"><enum>(II)</enum><text>A black light lamp.</text> </subclause>
<subclause id="ID85cd5e57a0de4becb381051c06504c6f"><enum>(III)</enum><text>A bug lamp.</text> </subclause>
<subclause id="ID302388610d0b474eab4d8fe27aae67d8"><enum>(IV)</enum><text>A colored lamp.</text> </subclause>
<subclause id="IDcd00792a145c4cf58304556a85d81a7c"><enum>(V)</enum><text>An infrared lamp.</text> </subclause>
<subclause id="ID71ca90ec9d8b4e4093e5f11472342f18"><enum>(VI)</enum><text>A left-hand thread lamp.</text> </subclause>

<subclause id="ID6646387006cb47c4b0249592ab583110"><enum>(XVIII)</enum><text>A traffic signal lamp.</text> </subclause>
<subclause id="ID1cd1f7c660414fd49594f7bc26dace9c"><enum>(XIX)</enum><text>A vibration service lamp.</text> </subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="ID1d094e6e975d486188fd28fa35032ad4"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id80D7A81D768B4839A87C155E8EBA731D" style="OLC"> 
<subparagraph id="id0BE86AF16AE4459B9B4DF28D75350F59"><enum>(T)</enum><header>Appliance lamp</header><text>The term <term>appliance lamp</term> means any lamp that—</text> 
<clause id="idBFB97152C5D144249476FA433AAEE4ED"><enum>(i)</enum><text>is specifically designed to operate in a household appliance, has a maximum wattage of 40 watts, and is sold at retail, including an oven lamp, refrigerator lamp, and vacuum cleaner lamp; and</text> </clause>
<clause id="idFE5D509340934E09B50E55619CF99CE6"><enum>(ii)</enum><text>is designated and marketed for the intended application, with—</text> 
<subclause id="id229F5F5081B84AF387E6812BADC6660F"><enum>(I)</enum><text>the designation on the lamp packaging; and</text> </subclause>
<subclause id="idCD2A21B33C644239B4FF1E3AA54D4BC5"><enum>(II)</enum><text>marketing materials that identify the lamp as being for appliance use.</text> </subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id97936874A0E448C2B6ECC305FCAE900C"><enum>(U)</enum><header display-inline="yes-display-inline">Candelabra base incandescent lamp</header><text display-inline="yes-display-inline">The term <term>candelabra base incandescent lamp</term> means a lamp that uses candelabra screw base as described in ANSI C81.61–2006, Specifications for Electric Bases, common designations E11 and E12.</text> </subparagraph>
<subparagraph id="ID6e27ec826724474795006f05557740d2"><enum>(V)</enum><header>Intermediate base incandescent lamp</header><text>The term <term>intermediate base incandescent lamp</term> means a lamp that uses an intermediate screw base as described in ANSI C81.61–2006, Specifications for Electric Bases, common designation E17.</text> </subparagraph>
<subparagraph id="ID98f7ea995d604b0ba67a2350d21b3bdf"><enum>(W)</enum><header>Modified spectrum</header><text>The term <term>modified spectrum</term> means, with respect to an incandescent lamp, an incandescent lamp that—</text> 
<clause id="id4D0AA55AC75548BEBB09911D56CE2AA0"><enum>(i)</enum><text>is not a colored incandescent lamp; and</text> </clause>
<clause id="id243EE20D10F8401FBF7AB52FDAE0CE51"><enum>(ii)</enum><text>when operated at the rated voltage and wattage of the incandescent lamp—</text> 
<subclause id="ID25f7058481884ba18aab808742565e39"><enum>(I)</enum><text>has a color point with (x,y) chromaticity coordinates on the Commission Internationale de l’Eclairage (C.I.E.) 1931 chromaticity diagram that lies below the black-body locus; and</text> </subclause>
<subclause id="IDd027292a564f425aa953b0d1ebe26d90"><enum>(II)</enum><text>has a color point with (x,y) chromaticity coordinates on the C.I.E. 1931 chromaticity diagram that lies at least 4 MacAdam steps (as referenced in IESNA LM16) distant from the color point of a clear lamp with the same filament and bulb shape, operated at the same rated voltage and wattage.</text> </subclause></clause></subparagraph>
<subparagraph id="ID967416594b5a48b88e1cc1f83decb37a"><enum>(X)</enum><header>Rough service lamp</header><text>The term <term>rough service lamp</term> means a lamp that—</text> 
<clause id="id5C6E77A321C44314BA54D92F8284FC37"><enum>(i)</enum><text>has a minimum of 5 supports with filament configurations similar to but not limited to C–7A, C–11, C–17, and C–22 as listed in Figure 6–12 of the 9th edition of the IESNA Lighting handbook, where lead wires are not counted as supports; and</text> </clause>
<clause id="idB134F3E8EA6C4B548AA33D0CB4A601C9"><enum>(ii)</enum><text>is designated and marketed specifically for <quote>rough service</quote> applications, with—</text> 
<subclause id="id0ACBE574CED64191AD51760AD77C98F3"><enum>(I)</enum><text>the designation appearing on the lamp packaging; and</text> </subclause>
<subclause id="id77EDB3B0BA474511A582E6064B1AD5C1"><enum>(II)</enum><text>marketing materials that identify the lamp as being for rough service.</text> </subclause></clause></subparagraph>
<subparagraph id="ID2a383ad4f87c4975a96e2cf1fc7b750c"><enum>(Y)</enum><header>3-way incandescent lamp</header><text>The term <term>3-way incandescent lamp</term> includes an incandescent lamp that—</text> 
<clause id="idC69ADB1508D841AABD6971BFFA08A5A3"><enum>(i)</enum><text>employs 2 filaments, operated separately and in combination, to provide 3 light levels; and</text> </clause>
<clause id="id8806A9ACBBEC429A871FA98CD0B135AA"><enum>(ii)</enum><text>is designated on the lamp packaging and marketing materials as being a 3-way incandescent lamp.</text> </clause></subparagraph>
<subparagraph id="idC50BE294973E42A38C1DD7BD2AC148A4"><enum>(Z)</enum><header>Shatter-resistant lamp, shatter-proof lamp, or shatter-protected lamp</header><text>The terms <term>shatter-resistant lamp</term>, <term>shatter-proof lamp</term>, and <term>shatter-protected lamp</term> mean a lamp that—</text> 
<clause id="id3C78107A082741A98D60610690013F90"><enum>(i)</enum><text>has a coating or equivalent technology that is compliant with NSF/ANSI 51 and is designed to contain the glass if the glass envelope of the lamp is broken; and</text> </clause>
<clause id="id64D0CA36026343A1A20B1A694CFB1464"><enum>(ii)</enum><text>is designated and marketed for the intended application, with—</text> 
<subclause id="id50C4725A006F495A821F242B6F27A10B"><enum>(I)</enum><text>the designation on the lamp packaging; and</text> </subclause>
<subclause id="idEE7942658FD44B33961870BF9A8F6302"><enum>(II)</enum><text>marketing materials that identify the lamp as being shatter-resistant, shatter-proof, or shatter-protected.</text> </subclause></clause></subparagraph>
<subparagraph id="ID55bc8f4fd6314534a002fcffaa81c1c8"><enum>(AA)</enum><header>Vibration service lamp</header><text>The term <term>vibration service lamp</term> means a lamp that—</text> 
<clause id="idAC3C903DB6A84625B22088827C2647E4"><enum>(i)</enum><text>has filament configurations that are similar to but not limited to C–5, C–7A, or C–9, as listed in Figure 6–12 of the 9th Edition of the IESNA Lighting Handbook;</text> </clause>
<clause id="id369C23214FAF48C9AC45F4C8D36EBA0A"><enum>(ii)</enum><text>has a maximum wattage of 60 watts;</text> </clause>
<clause id="id32AFA4A6529A4DC7920065B08297F2F8"><enum>(iii)</enum><text>is sold at retail in packages of 4 lamps or less; and</text> </clause>
<clause id="id3B8BCA95EF5C457D80EA626599B627A4"><enum>(iv)</enum><text>is designated and marketed specifically for vibration service or vibration-resistant applications, with—</text> 
<subclause id="idC723EC2038CF4570B811C4377CC67D62"><enum>(I)</enum><text>the designation appearing on the lamp packaging; and</text> </subclause>
<subclause id="id97CAA4C2BD0E48948F0DA11C7348FB67"><enum>(II)</enum><text>marketing materials that identify the lamp as being vibration service only.</text> </subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="IDd7553f5b7001440388958f68b8d6ce80"><enum>(b)</enum><header>Coverage</header><text>Section 322(a)(14) of the Energy Policy and Conservation Act (42 U.S.C. 6292(a)(14)) is amended by inserting <quote>, general service incandescent lamps,</quote> after <quote>fluorescent lamps</quote>.</text> </subsection>
<subsection id="ID70eaf789fc914969b78d719b6f965f51"><enum>(c)</enum><header>Energy conservation standards</header><text>Section 325 of the Energy Policy and Conservation Act (42 U.S.C. 6295) is amended—</text>

<clause id="id814D0CF073164399BE35D827B0E87D0B"><enum>(i)</enum><header>Application</header><text>This subparagraph applies to each lamp that—</text> 
<subclause id="id6AC4EA7C5EE24E459CE85470CD17D727"><enum>(I)</enum><text>is intended for a general service or general illumination application (whether incandescent or not);</text> </subclause>
<subclause id="id3FC4FA6C392441D3B450BB924BD54139"><enum>(II)</enum><text>has a medium screw base;</text> </subclause>
<subclause id="id98AD3A0E3EC442C2B0B7CF8CB442AF97"><enum>(III)</enum><text>has a voltage range that is at least partially within 110 and 130 volts;</text> </subclause>
<subclause id="idA7FBD741688C4AD9A562B479A15E825E"><enum>(IV)</enum><text>has no external bulb or a bulb of the frosted, clear, soft white, or modified spectrum type; and</text> </subclause>
<subclause id="id0E86A3BB35C3451995CE645B897EB2C4"><enum>(V)</enum><text>is manufactured or imported after December 31, 2011.</text> </subclause></clause>
<clause id="id10A55F6A33054E1682D9A4D156F29565"><enum>(ii)</enum><header>Requirement</header><text>For purposes of this paragraph, each lamp described in clause (i) shall have a color rendering index that is greater than or equal to—</text> 
<subclause id="id74B9BB2BDC104DCCB58DD14CBEFCFF7C"><enum>(I)</enum><text>80 for frosted, clear, and soft white lamps; or</text> </subclause>
<subclause id="idC1FE492B31754B029CB488D3B10B656B"><enum>(II)</enum><text>75 for modified spectrum lamps.</text> </subclause></clause></subparagraph>
<subparagraph commented="no" id="IDca5010024c6349ff9b10b480f5f0b7b6"><enum>(C)</enum><header>Candelabra incandescent lamps and intermediate base incandescent lamps</header> 
<clause commented="no" id="IDa812997f30494751877eea8b9ed2c5e7"><enum>(i)</enum><header>Candelabra base incandescent lamps</header><text>A candelabra base incandescent lamp shall not exceed 60 rated watts.</text> </clause>
<clause commented="no" id="ID19810a1c1684418a9f42bf1982695b4b"><enum>(ii)</enum><header>Intermediate base incandescent lamps</header><text>An intermediate base incandescent lamp shall not exceed 40 rated watts.</text> </clause></subparagraph>
<subparagraph id="ID57f161c9e7034ce287eeda7ccf62587f"><enum>(D)</enum><header>Exemptions</header> 
<clause id="id04BE354AEA1D4E45A777263110D8D2BD"><enum>(i)</enum><header>Petition</header><text>Any person may petition the Secretary for an exemption for a type of general service lamp from the requirements of this subsection.</text> </clause>
<clause id="id0F256E491CCD46E3A8B05D96458B0D68"><enum>(ii)</enum><header>Criteria</header><text>The Secretary may grant an exemption under clause (i) only to the extent that the Secretary finds, after a hearing and opportunity for public comment, that it is not technically feasible to serve a specialized lighting application (such as a military, medical, public safety, or certified historic lighting application) using a lamp that meets the requirements of this subsection.</text> </clause>
<clause id="id6AD7714C21154239B681834697E69321"><enum>(iii)</enum><header>Additional criterion</header><text>To grant an exemption for a product under this subparagraph, the Secretary shall include, as an additional criterion, that the exempted product is unlikely to be used in a general service lighting application.</text> </clause></subparagraph>
<subparagraph id="ID94b4551d14a043d4b319f2327754f58c"><enum>(E)</enum><header>Extension of coverage</header> 
<clause id="id31B26CE7043B48428C2FE51C215E567F"><enum>(i)</enum><header>Petition</header><text>Any person may petition the Secretary to establish standards for lamp types that are excluded from the definition of general service lamps.</text> </clause>
<clause id="id97B5DD16A09D4271A71A6558DAC061DF"><enum>(ii)</enum><header>Increased sales of exempted lamps</header><text>The petition shall include evidence that the availability or sales of exempted incandescent lamps have increased significantly since the date on which the standards on general service incandescent lamps were established.</text> </clause>
<clause id="idC1E05FDFA1374E4D8AD8C501A9E41299"><enum>(iii)</enum><header>Criteria</header><text>The Secretary shall grant a petition under clause (i) if the Secretary finds that the petition presents evidence that (assuming no other evidence is considered) demonstrates that sales of exempted incandescent lamp types have increased significantly since the standards on general service lamps were established and are being widely used in general lighting applications.</text> </clause>
<clause id="idA068D6CFD5AB48ABA5FDB06F4915868A"><enum>(iv)</enum><header>No presumption</header><text>The grant of a petition under this subparagraph shall create no presumption with respect to the determination of the Secretary with respect to any criteria under a rulemaking conducted under this section.</text> </clause>
<clause id="IDf57820d4566a44bf8c417e443ac81a4e"><enum>(v)</enum><header>Expedited proceeding</header><text>If the Secretary grants a petition for a lamp type under this subparagraph, the Secretary shall—</text> 
<subclause id="idE64608E5751C48EDBF2260D8FF78EFAC"><enum>(I)</enum><text>conduct a rulemaking to determine standards for the exempted lamp type; and</text> </subclause>
<subclause id="id4E9F005C7D8D417BB1AAA6FF3FE8D180"><enum>(II)</enum><text>complete the rulemaking not later than 18 months after the date on which notice is provided granting the petition.</text> </subclause></clause></subparagraph>
<subparagraph id="id3FF0561F49D5425D92FEB26EF8A35C3E"><enum>(F)</enum><header>Definition of effective date</header><text>In this paragraph, except as otherwise provided in a table contained in subparagraph (A), the term <term>effective date</term> means the last day of the month specified in the table that follows October 24, 1992.</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </clause></subparagraph>
<subparagraph id="id3F3B031BDBD94EE28559DDC9E4ACCDF6"><enum>(C)</enum><text>in paragraph (5), in the first sentence, by striking <quote>and general service incandescent lamps</quote>;</text> </subparagraph>
<subparagraph id="id84B0F2030BFB4B3CBBAAFCFDAB24F4CC"><enum>(D)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (7) and (8), respectively; and</text> </subparagraph>
<subparagraph id="idF8D292F23B784A828903C1A9BD78BFAB"><enum>(E)</enum><text>by inserting after paragraph (5) the following:</text>

<paragraph id="ID87765598cb1c4459b4012214c9d07a10"><enum>(6)</enum><header>Standards for general service incandescent lamps</header> 
<subparagraph id="idE5553741EE194CD98C6948315D7A3521"><enum>(A)</enum><header>Rulemaking before January 1, 2015</header> 
<clause id="id25AE6A08267F4CD186565FB19ACDDC3E"><enum>(i)</enum><header>In general</header><text>Not later than January 1, 2015, the Secretary shall initiate a rulemaking procedure to determine whether—</text> 
<subclause id="id78BACCA008ED4612B3682E64D875676C"><enum>(I)</enum><text>standards in effect for general service incandescent lamps should be amended to establish more stringent maximum wattage than the standards specified in paragraph (1)(A); and</text> </subclause>
<subclause id="id4E6407C8E7F948BFBAE303A5EE58AE71"><enum>(II)</enum><text>the exemptions for certain incandescent lamps should be maintained or discontinued.</text> </subclause></clause>
<clause id="id8F47237729A14734B2356B6F00623839"><enum>(ii)</enum><header>Scope</header><text>The rulemaking—</text> 
<subclause id="id21719AB9056F492BB640F615264B52CB"><enum>(I)</enum><text>shall not be limited to incandescent lamp technologies; and</text> </subclause>
<subclause id="id2E174A07D17F4FF393E386FADCFA47DD"><enum>(II)</enum><text>shall include consideration of a minimum efficacy standard of 45 lumens per watt.</text> </subclause></clause>
<clause id="id103A218D636E4D92867251763EA3333D"><enum>(iii)</enum><header>Amended standards</header><text>If the Secretary determines that the standards in effect for general service incandescent lamps should be amended, the Secretary shall publish a final rule not later than January 1, 2017, with an effective date that is not earlier than 3 years after the date on which the final rule is published.</text> </clause>
<clause id="idD09CA4D5F6FD4DF3B685BB1A5A4C5830"><enum>(iv)</enum><header>Phased-in effective dates</header><text>The Secretary shall consider phased-in effective dates under this subparagraph after considering—</text> 
<subclause id="idB78BDC24AFFE4706BA15B439B1D0C75E"><enum>(I)</enum><text>the impact of any amendment on manufacturers, retiring and repurposing existing equipment, stranded investments, labor contracts, workers, and raw materials; and</text> </subclause>
<subclause id="idD128F38A633B4D4C9792D1D5747DE5A5"><enum>(II)</enum><text>the time needed to work with retailers and lighting designers to revise sales and marketing strategies.</text> </subclause></clause>
<clause id="ID50ba8d1bd4e44fc8a97ac4fdeeed9815"><enum>(v)</enum><header>Backstop requirement</header><text>If the Secretary fails to complete a rulemaking in accordance with clauses (i) through (iv) or if the final rule does not produce savings that are greater than or equal to the savings from a minimum efficacy standard of 45 lumens per watt, effective beginning January 1, 2020, the Secretary shall prohibit the sale of any general service lamp that emits less than 300 percent of the average lumens per watt emitted by a 100-watt incandescent general service lamp that is commercially available on the date of enactment of this clause.</text> </clause></subparagraph>
<subparagraph id="idD11AD76FB01B48319F3D0E6B9323C147"><enum>(B)</enum><header>Rulemaking before January 1, 2020</header> 
<clause id="id44E7B116AB9B4B79AAFA26909FFC3CB3"><enum>(i)</enum><header>In general</header><text>Not later than January 1, 2020, the Secretary shall initiate a rulemaking procedure to determine whether—</text> 
<subclause id="id04754165238042889DC4297C91148BFC"><enum>(I)</enum><text>standards in effect for general service incandescent lamps should be amended to reflect lumen ranges with more stringent maximum wattage than the standards specified in paragraph (1)(A); and</text> </subclause>
<subclause id="id6BFB009F9117453A9D0F604E695527F6"><enum>(II)</enum><text>the exemptions for certain incandescent lamps should be maintained or discontinued.</text> </subclause></clause>
<clause id="idB8877967D80A4B29B6F9D728791D910F"><enum>(ii)</enum><header>Scope</header><text>The rulemaking shall not be limited to incandescent lamp technologies.</text> </clause>
<clause id="idE554A587172944C99116727651A1B663"><enum>(iii)</enum><header>Amended standards</header><text>If the Secretary determines that the standards in effect for general service incandescent lamps should be amended, the Secretary shall publish a final rule not later than January 1, 2022, with an effective date that is not earlier than 3 years after the date on which the final rule is published.</text> </clause>
<clause id="id1B5F329DE8F74921B6A4E5F32E51AA15"><enum>(iv)</enum><header>Phased-in effective dates</header><text>The Secretary shall consider phased-in effective dates under this subparagraph after considering—</text> 
<subclause id="id8F615FBC38FA49F9BDD30B7BC95F44F4"><enum>(I)</enum><text>the impact of any amendment on manufacturers, retiring and repurposing existing equipment, stranded investments, labor contracts, workers, and raw materials; and</text> </subclause>
<subclause id="id2B81E84C3E98474FB75E601B91CE3D2F"><enum>(II)</enum><text>the time needed to work with retailers and lighting designers to revise sales and marketing strategies.</text> </subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="id4F3932028BFC4F48A19180500EE3AB58"><enum>(2)</enum><text>in subsection (l), by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id45FA3FED00D24BF4B945667B27ED7382" style="OLC"> 
<paragraph id="IDdcdddf143b5f483cb6ec450228f629bd"><enum>(4)</enum><header>Energy efficiency standards for certain lamps</header> 
<subparagraph id="idC6FC74671CB147EBAAB7455638C3A137"><enum>(A)</enum><header>In general</header><text>The Secretary shall prescribe an energy efficiency standard for rough service lamps, vibration service lamps, 3-way incandescent lamps, 150-watt general service incandescent lamps, and shatter-resistant lamps only in accordance with this paragraph.</text> </subparagraph>
<subparagraph id="ID8234e6511d944e4f8fa050c9224f3f8d"><enum>(B)</enum><header>Benchmarks</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary, in consultation with the National Electrical Manufacturers Association, shall—</text> 
<clause id="id45BAC2E5D1D14FE19623CB3FAA954A26"><enum>(i)</enum><text>collect actual data for United States unit sales for each of calendar years 1990 through 2006 for each of the 5 types of lamps described in subparagraph (A) to determine the historical growth rate of the type of lamp; and</text> </clause>
<clause id="idBCDA8AAD3EC94652B2EC6DA8A148DAC6"><enum>(ii)</enum><text>construct a model for each type of lamp based on coincident economic indicators that closely match the historical annual growth rate of the type of lamp to provide a neutral comparison benchmark to model future unit sales after calendar year 2006.</text> </clause></subparagraph>
<subparagraph id="ID77088e4a0f50484d8702944eca9635d7"><enum>(C)</enum><header>Actual sales data</header> 
<clause id="idBC8D582D00E443F09927F7A809DAE9A5"><enum>(i)</enum><header>In general</header><text>Effective for each of calendar years 2010 through 2025, the Secretary, in consultation with the National Electrical Manufacturers Association, shall—</text> 
<subclause id="id1C5D4DF30F7B421CB112B425D49BB772"><enum>(I)</enum><text>collect actual United States unit sales data for each of 5 types of lamps described in subparagraph (A); and</text> </subclause>
<subclause id="id3FE6CFD4C4BF4D6BBBB1A437CE33AB81"><enum>(II)</enum><text>not later than 90 days after the end of each calendar year, compare the lamp sales in that year with the sales predicted by the comparison benchmark for each of the 5 types of lamps described in subparagraph (A).</text> </subclause></clause>
<clause id="ID402fc3b31df34b11a6889a7ee28cebd3"><enum>(ii)</enum><header>Continuation of tracking</header> 
<subclause id="idB88F10129080469D83E4684A5E321FD3"><enum>(I)</enum><header>Determination</header><text>Not later than January 1, 2023, the Secretary shall determine if actual sales data should be tracked for the lamp types described in subparagraph (A) after calender year 2025.</text> </subclause>
<subclause id="idDCB4D380853C4AF8A7E1683D2D41B77E"><enum>(II)</enum><header>Continuation</header><text>If the Secretary finds that the market share of a lamp type described in subparagraph (A) could significantly erode the market share for general service lamps, the Secretary shall continue to track the actual sales data for the lamp type.</text> </subclause></clause></subparagraph>
<subparagraph id="IDb38cf95c951a4c9c80b947f781ff6de5"><enum>(D)</enum><header>Rough service lamps</header> 
<clause id="id2E26139C185344A8B8B1F00A16EF203E"><enum>(i)</enum><header>In general</header><text>Effective beginning with the first year that the reported annual sales rate for rough service lamps demonstrates actual unit sales of rough service lamps that achieve levels that are at least 100 percent higher than modeled unit sales for that same year, the Secretary shall—</text> 
<subclause id="id1C62FF72166B4DBC9E5D7741C102B0E1"><enum>(I)</enum><text>not later than 90 days after the end of the previous calendar year, issue a finding that the index has been exceeded; and</text> </subclause>
<subclause id="id6D93FC3ED9184023A479C6ADC4B6D329"><enum>(II)</enum><text>not later than the date that is 1 year after the end of the previous calendar year, complete an accelerated rulemaking to establish an energy conservation standard for rough service lamps.</text> </subclause></clause>
<clause id="id327E4FCCDE5D44FA90E3266F9BE3F294"><enum>(ii)</enum><header>Backstop requirement</header><text>If the Secretary fails to complete an accelerated rulemaking in accordance with clause (i)(II), effective beginning 1 year after the date of the issuance of the finding under clause (i)(I), the Secretary shall require rough service lamps to—</text> 
<subclause id="id5D7892E5D98A45EFB1C854640C0CA34B"><enum>(I)</enum><text>have a shatter-proof coating or equivalent technology that is compliant with NSF/ANSI 51 and is designed to contain the glass if the glass envelope of the lamp is broken and to provide effective containment over the life of the lamp;</text> </subclause>
<subclause id="ID79d1d9ba080e40d0a23aa1125fa1d0df"><enum>(II)</enum><text>have a maximum 40-watt limitation; and</text> </subclause>
<subclause id="ID1fe5ef46233d476c8b65503887e8fdd0"><enum>(III)</enum><text>be sold at retail only in a package containing 1 lamp.</text> </subclause></clause></subparagraph>
<subparagraph id="ID2ae36996d74e48c38ec662fc28a75ee0"><enum>(E)</enum><header>Vibration service lamps</header> 
<clause id="idD1D73D7F54F04C898ED1FC51EF23F135"><enum>(i)</enum><header>In general</header><text>Effective beginning with the first year that the reported annual sales rate for vibration service lamps demonstrates actual unit sales of vibration service lamps that achieve levels that are at least 100 percent higher than modeled unit sales for that same year, the Secretary shall—</text> 
<subclause id="id500271FDB2A84B4CB5967FE533F104EA"><enum>(I)</enum><text>not later than 90 days after the end of the previous calendar year, issue a finding that the index has been exceeded; and</text> </subclause>
<subclause id="idFA76549FF09C4EA1BA265D428B4B9BBF"><enum>(II)</enum><text>not later than the date that is 1 year after the end of the previous calendar year, complete an accelerated rulemaking to establish an energy conservation standard for vibration service lamps.</text> </subclause></clause>
<clause id="id5089AFAC82004EA7BCF4BD51FF83C24E"><enum>(ii)</enum><header>Backstop requirement</header><text>If the Secretary fails to complete an accelerated rulemaking in accordance with clause (i)(II), effective beginning 1 year after the date of the issuance of the finding under clause (i)(I), the Secretary shall require vibration service lamps to—</text> 
<subclause id="id86618D5787074212850649F7620A471E"><enum>(I)</enum><text>have a maximum 40-watt limitation; and</text> </subclause>
<subclause id="idBD6364779A7746F998FA035400E0577C"><enum>(II)</enum><text>be sold at retail only in a package containing 1 lamp.</text> </subclause></clause></subparagraph>
<subparagraph id="ID07559d63371f4fbd886def4df76b144a"><enum>(F)</enum><header>3-way incandescent lamps</header> 
<clause id="id6AAC185F6DBA4D13B8194FFF2FC026A2"><enum>(i)</enum><header>In general</header><text>Effective beginning with the first year that the reported annual sales rate for 3-way incandescent lamps demonstrates actual unit sales of 3-way incandescent lamps that achieve levels that are at least 100 percent higher than modeled unit sales for that same year, the Secretary shall—</text> 
<subclause id="id02242D03A7AB467B828CC55B3B9B8D26"><enum>(I)</enum><text>not later than 90 days after the end of the previous calendar year, issue a finding that the index has been exceeded; and</text> </subclause>
<subclause id="id2BC3EA8AABE04BEE95CD7E73F0EB55F3"><enum>(II)</enum><text>not later than the date that is 1 year after the end of the previous calendar year, complete an accelerated rulemaking to establish an energy conservation standard for 3-way incandescent lamps.</text> </subclause></clause>
<clause id="idF69E791D54494A7A8B739E92682A16BA"><enum>(ii)</enum><header>Backstop requirement</header><text>If the Secretary fails to complete an accelerated rulemaking in accordance with clause (i)(II), effective beginning 1 year after the date of issuance of the finding under clause (i)(I), the Secretary shall require that—</text> 
<subclause id="id95EE05A701F04BE2916C2D7F5B781621"><enum>(I)</enum><text>each filament in a 3-way incandescent lamp meet the new maximum wattage requirements for the respective lumen range established under subsection (i)(1)(A); and</text> </subclause>
<subclause id="id3DBA85395A024D2793704C9CB100A16A"><enum>(II)</enum><text>3-way lamps be sold at retail only in a package containing 1 lamp.</text> </subclause></clause></subparagraph>
<subparagraph id="IDa84bf07e9c884381a07c394aab05d28d"><enum>(G)</enum><header>150-watt general service incandescent lamps</header> 
<clause id="id0D1646FD746F435A9028819CB05D80F4"><enum>(i)</enum><header>In general</header><text>Effective beginning with the first year that the reported annual sales rate demonstrates actual unit sales of 150-watt general service incandescent lamps in the lumen range of 2,601 through 3,300 lumens (or, in the case of a modified spectrum, in the lumen range of 1,951 through 2,475 lumens) that achieve levels that are at least 100 percent higher than modeled unit sales for that same year, the Secretary shall—</text> 
<subclause id="id1393A121BD5A409F9A900748DBB4ED21"><enum>(I)</enum><text>not later than 90 days after the end of the previous calendar year, issue a finding that the index has been exceeded; and</text> </subclause>
<subclause id="idA9581B96F58B4469B98F89179C5509ED"><enum>(II)</enum><text>not later than the date that is 1 year after the end of the previous calendar year, complete an accelerated rulemaking to establish an energy conservation standard for those 150-watt general service incandescent lamps.</text> </subclause></clause>
<clause id="idE52BFA44080C49BB9EA01084FD0F2770"><enum>(ii)</enum><header>Backstop requirement</header><text>If the Secretary fails to complete an accelerated rulemaking in accordance with clause (i)(II), effective beginning 1 year after the date of issuance of the finding under clause (i)(I), the Secretary shall impose—</text> 
<subclause id="id3796FC23DC7C40F9AA184EE024AD221A"><enum>(I)</enum><text>a maximum 95-watt limitation on general service incandescent lamps in the lumen range of 2,601 through 3,300 lumens; and</text> </subclause>
<subclause id="id8BB66982B4D640618D1E7355C904CD7B"><enum>(II)</enum><text>a requirement that those lamps be sold at retail only in a package containing 1 lamp.</text> </subclause></clause></subparagraph>
<subparagraph id="id3B800499B6B543D88514FFEC2E8D7DA4"><enum>(H)</enum><header>Shatter-resistant lamps</header> 
<clause id="idFE5EBE4F1D864102935F413599B6BF31"><enum>(i)</enum><header>In general</header><text>Effective beginning with the first year that the reported annual sales rate for shatter-resistant lamps demonstrates actual unit sales of shatter-resistant lamps that achieve levels that are at least 100 percent higher than modeled unit sales for that same year, the Secretary shall—</text> 
<subclause id="id2EF022C995414953AD6BE3DEA788BCDE"><enum>(I)</enum><text>not later than 90 days after the end of the previous calendar year, issue a finding that the index has been exceeded; and</text> </subclause>
<subclause id="id2CE99140DF8F41BA86382B39174D50C7"><enum>(II)</enum><text>not later than the date that is 1 year after the end of the previous calendar year, complete an accelerated rulemaking to establish an energy conservation standard for shatter-resistant lamps.</text> </subclause></clause>
<clause id="id2866CB8DA0C94F9EA3A91B47345158DC"><enum>(ii)</enum><header>Backstop requirement</header><text>If the Secretary fails to complete an accelerated rulemaking in accordance with clause (i)(II), effective beginning 1 year after the date of issuance of the finding under clause (i)(I), the Secretary shall impose—</text> 
<subclause id="idAA8DEECA9AEF418F809BC719164BDBC8"><enum>(I)</enum><text>a maximum wattage limitation of 40 watts on shatter resistant lamps; and</text> </subclause>
<subclause id="idFB3B9D7EB7C5437DA3BAD751F4F912DF"><enum>(II)</enum><text>a requirement that those lamps be sold at retail only in a package containing 1 lamp.</text> </subclause></clause></subparagraph>
<subparagraph id="id89E361C1C200431C88536E3350BA3B6B"><enum>(I)</enum><header>Rulemakings before January 1, 2025</header> 
<clause id="id75A5F43280394BD78FFAF3619BE0348E"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), if the Secretary issues a final rule prior to January 1, 2025, establishing an energy conservation standard for any of the 5 types of lamps for which data collection is required under any of subparagraphs (D) through (G), the requirement to collect and model data for that type of lamp shall terminate unless, as part of the rulemaking, the Secretary determines that continued tracking is necessary.</text> </clause>
<clause id="idBBB36DA96B454EE486AC36FEFE4ED03C"><enum>(ii)</enum><header>Backstop requirement</header><text>If the Secretary imposes a backstop requirement as a result of a failure to complete an accelerated rulemaking in accordance with clause (i)(II) of any of subparagraphs (D) through (G), the requirement to collect and model data for the applicable type of lamp shall continue for an additional 2 years after the effective date of the backstop requirement.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
<section id="IDc3d486c5ec1e43fc8f0e734563ad57cb"><enum>102.</enum><header>Consumer education and lamp labeling</header><text display-inline="no-display-inline">Section 324(a)(2)(C) of the Energy Policy and Conservation Act (42 U.S.C. 6294(a)(2)(C)) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id1FEE91CDCB7A4E70B07364714EACAFBB" style="OLC"> 
<clause id="IDbccd4943bd7f4c4bad1779d22aaaffc6"><enum>(iii)</enum><header>Rulemaking to consider effectiveness of lamp labeling</header> 
<subclause id="idB9A24B265A964084AD844EF7497B5BD3"><enum>(I)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this clause, the Commission shall initiate a rulemaking to consider—</text> 
<item id="id82955A7335914D9CB3BEB574D664B2AF"><enum>(aa)</enum><text>the effectiveness of current lamp labeling for power levels or watts, light output or lumens, and lamp lifetime; and</text> </item>
<item id="id1A383F3801EA404BA16187E3DBE087FA"><enum>(bb)</enum><text>alternative labeling approaches that will help consumers to understand new high-efficiency lamp products and to base the purchase decisions of the consumers on the most appropriate source that meets the requirements of the consumers for lighting level, light quality, lamp lifetime, and total lifecycle cost.</text> </item></subclause>
<subclause id="ID5a4804b4dd924693a17ceaa6ee10f67f"><enum>(II)</enum><header>Completion</header><text>The Commission shall—</text> 
<item id="id2AD296CD7B984F84AB85C175C446FD50"><enum>(aa)</enum><text>complete the rulemaking not later than the date that is 30 months after the date of enactment of this clause; and</text> </item>
<item id="idDAE1FF1B78444F19A9063D1B8E10C5C5"><enum>(bb)</enum><text>consider reopening the rulemaking not later than 180 days before the effective dates of the standards for general service incandescent lamps established under section 325(i)(1)(A), if the Commission determines that further labeling changes are needed to help consumers understand lamp alternatives.</text> </item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="ID58705b2864954c5e96817aa28bccfbd9"><enum>103.</enum><header>Market assessments and consumer awareness program</header> 
<subsection id="idBA0AB9040D064D939D35641AE2268D13"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In cooperation with the Administrator of the Environmental Protection Agency, the Secretary of Commerce, the Federal Trade Commission, lighting and retail industry associations, energy efficiency organizations, and any other entities that the Secretary determines to be appropriate, the Secretary shall—</text> 
<paragraph id="ID5d8ad72650e24601923def7982dc5627"><enum>(1)</enum><text>conduct an annual assessment of the market for general service lamps and compact fluorescent lamps to—</text> 
<subparagraph id="id8D697FB0FCD14A69ABFF0C7454984948"><enum>(A)</enum><text>identify trends in the market shares of lamp types, efficiencies, and light output levels purchased by residential and nonresidential consumers; and</text> </subparagraph>
<subparagraph id="id42FD038CED744ECB8181DDB55A4B8F8E"><enum>(B)</enum><text>better understand the degree to which consumer decisionmaking is based on lamp power levels or watts, light output or lumens, lamp lifetime, and other factors, including information required on labels mandated by the Federal Trade Commission;</text> </subparagraph></paragraph>
<paragraph id="IDab318b44c8d74ac9a0af0f4940e08135"><enum>(2)</enum><text>provide the results of the market assessment to the Federal Trade Commission for consideration in the rulemaking described in section 324(a)(2)(C)(iii) of the Energy Policy and Conservation Act (42 U.S.C. 6294(a)(2)(C)(iii)); and</text> </paragraph>
<paragraph id="IDd264b475a33545e1a2d48029a0d82447"><enum>(3)</enum><text>in cooperation with industry trade associations, lighting industry members, utilities, and other interested parties, carry out a proactive national program of consumer awareness, information, and education that broadly uses the media and other effective communication techniques over an extended period of time to help consumers understand the lamp labels and make energy-efficient lighting choices that meet the needs of consumers.</text> </paragraph></subsection>
<subsection id="IDbcd7148164c347e984479f9a66e30458"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2009 through 2012.</text> </subsection></section>
<section id="id8B0B11ADAC3C4287B19866CEE4E94DF9"><enum>104.</enum><header>General rule of preemption for energy conservation standards before Federal standard becomes effective for a product</header><text display-inline="no-display-inline">Section 327(b)(1) of the Energy Policy and Conservation Act (42 U.S.C. 6297(b)(1)) is amended—</text> 
<paragraph id="id3094E8A329E64C9D8B3BA29185D9C0F7"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(A)</quote> after <quote>(1)</quote>;</text> </paragraph>
<paragraph id="idFD6F3E70144E42DABDD61E323AF3173D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>or</quote> after the semicolon at the end; and</text> </paragraph>
<paragraph id="id2909B0B73E684D2E94DCFE1BF38DAA52"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="idA935F5DCB3CE4488B420C06681232280" style="OLC"> 
<subparagraph commented="no" display-inline="no-display-inline" id="id5A5453D75DC44EF698FEEDB70EECCC93" indent="up1"><enum>(B)</enum><text>in the case of any portion of any regulation that establishes requirements for general service incandescent lamps, intermediate base incandescent lamps, or candelabra base lamps, was enacted or adopted before the date of enactment of this subparagraph, except that—</text> 
<clause commented="no" display-inline="no-display-inline" id="idE4762DEF48C444E8A78F46604E1096AD"><enum>(i)</enum><text>the regulation shall only be effective until the effective date of the Federal standard for the applicable lamp category under subparagraphs (A), (B), and (C) of section 325(i)(1); and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id119AA27F15DD499BB9239256321FA50D"><enum>(ii)</enum><text>a State may, at any time, modify or adopt a State standard for general service lamps to conform with Federal standards and effective dates.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="id4CF9BDFDD37B424F8F3BFF3021ED25F9"><enum>105.</enum><header>Prohibited acts</header><text display-inline="no-display-inline">Section 332(a) of the Energy Policy and Conservation Act (42 U.S.C. 6302(a)) is amended—</text> 
<paragraph id="id90B4B8B061624D87B31BB3EA24983E27"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>or</quote> at the end;</text> </paragraph>
<paragraph id="id0502D20FE798490C9DC5CD752ABEB760"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; or</quote>; and</text> </paragraph>
<paragraph id="id133508860753466287D37DE9477A36B7"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id68ECA4826DAB4E16B1DAC702AFE0C936" style="OLC"> 
<paragraph id="id95069256B2BB4DF197BCF45730C8306F"><enum>(6)</enum><text>for any manufacturer, distributor, retailer, or private labeler to distribute in commerce an adapter that—</text> 
<subparagraph id="id043892213F3C4604928DA70264F1F8B4"><enum>(A)</enum><text>is designed to allow an incandescent lamp that does not have a medium screw base to be installed into a fixture or lampholder with a medium screw base socket; and</text> </subparagraph>
<subparagraph id="id3968034919FC43E0B631472805C36693"><enum>(B)</enum><text>has a voltage range that includes 110 and 130 volts.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="IDad6571bc0365497ea849b30d16b6c5cd"><enum>106.</enum><header>Enforcement</header><text display-inline="no-display-inline">Section 334 of the Energy Policy and Conservation Act (42 U.S.C. 6304) is amended by inserting after the second sentence the following: <quote>Any such action to restrain any person from distributing in commerce a general service incandescent lamp that does not comply with the applicable standard established under section 325(i) or an adapter prohibited under section 332(a)(6) may also be brought by the attorney general of a State in the name of the State.</quote>.</text> </section>
<section id="idED00A6A8042B4F729AD55CFEC7142BA4"><enum>107.</enum><header>Research and development program</header> 
<subsection id="idCE67F0C34DE24D209073F3268BBFD2E6"><enum>(a)</enum><header>In General</header><text>The Secretary may carry out a lighting technology research and development program—</text> 
<paragraph id="id6BD614FC229747CDB14E2ADA824E7057"><enum>(1)</enum><text>to support the research, development, demonstration, and commercial application of lamps and related technologies sold, offered for sale, or otherwise made available in the United States; and</text> </paragraph>
<paragraph id="id1BDB58BC063042B89BF0D10B438460CF"><enum>(2)</enum><text>to assist manufacturers of general service lamps in the manufacturing of general service lamps that, at a minimum, achieve the wattage requirements imposed as a result of the amendments made by section 101.</text> </paragraph></subsection>
<subsection id="id4A794124CF0D483E94FC7D41C513A5EC"><enum>(b)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2008 through 2013.</text> </subsection>
<subsection id="idB898553540FF4E10964DC2719132B881"><enum>(c)</enum><header>Termination of authority</header><text>The program under this section shall terminate on September 30, 2015.</text> </subsection></section>
<section commented="no" display-inline="no-display-inline" id="id4BBE502F691B4A02B226C7CB862FE16A" section-type="subsequent-section"><enum>108.</enum><header>Report on mercury use and release</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary, in cooperation with the Administrator of the Environmental Protection Agency, shall submit to Congress a report describing recommendations relating to the means by which the Federal Government may reduce or prevent the release of mercury during the manufacture, transportation, storage, or disposal of light bulbs.</text> </section></title>
<title id="id58F58258AF444E429811AAAD8D866468"><enum>II</enum><header>Standards for metal halide lamp fixtures</header> 
<section id="idECC9D161FF2C45639CB796E7B3EE237F"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 321 of the Energy Policy and Conservation Act (42 U.S.C. 6291) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id8465A294BC4C4777A3043AB2714A3705" style="OLC"> 
<paragraph id="ID9bcba84ecaa94ad4b52dd0ecea762299"><enum>(52)</enum><header>Ballast</header><text>The term <term>ballast</term> means a device used with an electric discharge lamp to obtain necessary circuit conditions (including voltage, current, and waveform) for starting and operating.</text> </paragraph>
<paragraph id="ID0a1cb3c3fb324652bb6b875de02f6537"><enum>(53)</enum><header>Ballast efficiency</header> 
<subparagraph id="id9DBC61BD1E7D4B2C9A00DCC6F35EAEA2"><enum>(A)</enum><header>In general</header><text>The term <term>ballast efficiency</term> means, with respect to a high intensity discharge fixture, the efficiency of a lamp and ballast combination this is equal to the percentage obtained by dividing P<subscript>out</subscript>/P<subscript>in</subscript>, as measured, with—</text> 
<clause id="idE4A39E56BACD4377B71F4156A52E3F6E"><enum>(i)</enum><text>P<subscript>out</subscript> equal to the measured operating lamp wattage; and</text> </clause>
<clause id="idC064647A036248E2B8A6BCE2B93FF845"><enum>(ii)</enum><text>P<subscript>in</subscript> equal to the measured operating input wattage.</text> </clause></subparagraph>
<subparagraph id="idDABFDB38A97D450BAFE73CA76FC5EA09"><enum>(B)</enum><header>Administration</header><text>In calculating ballast efficiency under subparagraph (A)—</text> 
<clause id="id90DD4C23C1314527837A3CD0424B18B6"><enum>(i)</enum><text>the lamp and (if provided) the capacitor shall constitute a nominal system in accordance with the ANSI Standard C78.43–2004; and</text> </clause>
<clause id="id285C5C1BC4F2493B935B54A554C6EA10"><enum>(ii)</enum><text>P<subscript>in</subscript> and P<subscript>out</subscript> shall be measured after lamps have been stabilized according to section 4.4 of ANSI Standard C82.6–2005 using a wattmeter with—</text> 
<subclause id="idDADD1FE96EC042C482AF9928998571EF"><enum>(I)</enum><text>in the case of ballast with a frequency of 60 hertz, accuracy specified in section 4.5 of ANSI Standard C82.6–2005; and</text> </subclause>
<subclause id="idCE837214AA86437785352B535BF6883A"><enum>(II)</enum><text>in the case of ballast with a frequency greater than 60 hertz, a basic accuracy of ± 0.5 percent at the higher of 3 times the output operating frequency of the ballast, or 2 kilohertz.</text> </subclause></clause></subparagraph>
<subparagraph id="id3FE416F2B02947CE82715A5B6ADAA901"><enum>(C)</enum><header>Modification</header><text>The Secretary may, by rule, modify the definition of <term>ballast efficiency</term> if the Secretary determines that the modification is necessary or appropriate to carry out this Act.</text> </subparagraph></paragraph>
<paragraph id="ID10fdfb553bc24f6d90e164ec28b24bd4"><enum>(54)</enum><header>Electronic ballast</header><text>The term <term>electronic ballast</term> means a device that use semiconductors as the primary means to control lamp starting and operation.</text> </paragraph>
<paragraph id="ID1d50ed10cfee40899d1aa99abc35b8fd"><enum>(55)</enum><header>General lighting application</header><text>The term <term>general lighting application</term> means lighting that provides an interior or exterior area with overall illumination.</text> </paragraph>
<paragraph id="ID719f49e969ed45e9ad6c3c2ab7979aab"><enum>(56)</enum><header>Metal halide ballast</header><text>The term <term>metal halide ballast</term> means a ballast that is used to start and operate metal halide lamps.</text> </paragraph>
<paragraph id="ID6dbe619266f44280b1a5f565af2f8dff"><enum>(57)</enum><header>Metal halide lamp</header><text>The term <term>metal halide lamp</term> means a high intensity discharge lamp with the major portion of the light produced by radiation of metal halides and the products of dissociation of metal halides, possibly in combination with metallic vapors.</text> </paragraph>
<paragraph id="ID23da137b19c444ff87ff2fb0631a015f"><enum>(58)</enum><header>Metal halide lamp fixture</header><text>The term <term>metal halide lamp fixture</term> means a light fixture for general lighting application that is designed to be operated with a metal halide lamp and a ballast for a metal halide lamp.</text> </paragraph>
<paragraph id="IDa56b903a4d114f18b6f12d5809f0b0c5"><enum>(59)</enum><header>Probe-start metal halide ballast</header><text>The term <term>probe-start metal halide ballast</term> means a ballast that—</text> 
<subparagraph id="id5E4C3C3CD1E047E586176F74940C7610"><enum>(A)</enum><text>starts a probe-start metal halide lamp that contains a third starting electrode (probe) in the arc tube; and</text> </subparagraph>
<subparagraph id="idAAB3522D9351474DA5B7746C61A2DF8C"><enum>(B)</enum><text>does not generally contain an igniter and instead starts lamps with high ballast open circuit voltage.</text> </subparagraph></paragraph>
<paragraph id="ID1aea1036aff4424d9cefdb2904292f05"><enum>(60)</enum><header>Pulse-start metal halide ballast</header><text>The term <term>pulse-start metal halide ballast</term> means an electronic or electromagnetic ballast that starts a pulse start metal halide lamp with high voltage pulses, with—</text> 
<subparagraph id="id8D05FE4E8F184C758011E3D79AEE65DE"><enum>(A)</enum><text>the lamp started by first providing a high voltage pulse for ionization of the gas to produce a glow discharge; and</text> </subparagraph>
<subparagraph id="idB28B60AB011F4C72B6EE2EC2CAB495F1"><enum>(B)</enum><text>to complete the starting process, power provided by the ballast to sustain the discharge through the glow-to-arc transition.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<clause id="idD68D3A04957445A8B0AA36BA6D4FE7B8"><enum>(ii)</enum><header>Labeling</header><text>The rules shall provide that the labeling of any metal halide lamp fixture manufactured on or after the later of January 1, 2009, or the date that is 270 days after the date of enactment of this subparagraph, shall indicate conspicuously, in a manner prescribed by the Commission under subsection (b) by July 1, 2008, a capital letter <quote>E</quote> printed within a circle on the packaging of the fixture, and on the ballast contained in the fixture.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="idECF370E0FEF24B81B7DF7007CAE8EFBC"><enum>205.</enum><header>Energy conservation standards</header><text display-inline="no-display-inline">Section 325 of the Energy Policy and Conservation Act (42 U.S.C. 6295) is amended—</text> 
<paragraph id="id967FAA5BE59E4A1D862CAE4648C86187"><enum>(1)</enum><text>by redesignating subsection (gg) as subsection (hh);</text> </paragraph>
<paragraph id="id77C997804A8647D590EDD89ABA97E339"><enum>(2)</enum><text>by inserting after subsection (ff) the following:</text> 
<quoted-block display-inline="no-display-inline" id="id0389732B1E534591891A9B3AAF029E76" style="OLC"> 
<subsection id="IDe9a4acb0a8fa467b92d48db69cd7fb4e"><enum>(gg)</enum><header>Standards for metal halide lamp fixtures</header> 
<paragraph id="idF47A9226DBC9415D8B60C0AE542AFAB3"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) through (5), a metal halide lamp fixture designed to be operated with a lamp that is rated greater than or equal to 150 watts, but less than or equal to 500 watts, shall contain—</text> 
<subparagraph id="ID2f720b9f51fe404a9381c64c861d2a2f"><enum>(A)</enum><text>a pulse-start metal halide ballast with a minimum ballast efficiency of 88 percent;</text> </subparagraph>
<subparagraph id="ID18b5a24f39dd4d6f8291bea96422c39b"><enum>(B)</enum><text>a magnetic probe-start ballast with a minimum ballast efficiency of 94 percent; or</text> </subparagraph>
<subparagraph id="ID5fff22b60aa840538bfe4d5219be9dc5"><enum>(C)</enum><text>a non-pulse-start electronic ballast with a minimum ballast efficiency of—</text> 
<clause id="id16B69C3A9DD443F09956C65EB6B3E145"><enum>(i)</enum><text>92 percent for wattages greater than 250 watts; and</text> </clause>
<clause id="idDF9DDC5C58A24D0F825879798CD6D4FE"><enum>(ii)</enum><text>90 percent for wattages less than or equal to 250 watts.</text> </clause></subparagraph></paragraph>
<paragraph id="ID8bda4347010644f58725fb91178ef492"><enum>(2)</enum><header>Exceptions</header><text>The standards established under paragraph (1) shall not apply to—</text> 
<subparagraph id="id4814B4A6E2EE4094904AC00831A1349F"><enum>(A)</enum><text>fixtures with regulated lag ballasts;</text> </subparagraph>
<subparagraph id="id56D4F3E162774B64ADBBFB98CB1BEC5B"><enum>(B)</enum><text>fixtures that use electronic ballasts that operate at 480 volts; or</text> </subparagraph>
<subparagraph id="idD699A3F9B3A3460890F8A1CB565E3BA3"><enum>(C)</enum><text>fixtures that—</text> 
<clause id="id9C68CAE2001A4D8CB4E8810F19699895"><enum>(i)</enum><text>are rated only for 150 watt lamps;</text> </clause>
<clause id="id1A6BF38B92C5403F9DAC0ED1E7836F26"><enum>(ii)</enum><text>are rated for use in wet locations, as specified by section 410.4(A) of the National Electrical Code (2002); and</text> </clause>
<clause id="idE29150253293426EBD811CE1E6D8B60C"><enum>(iii)</enum><text>contain a ballast that is rated to operate at ambient air temperatures above 50º celsius, as specified by UL 1029–2001.</text> </clause></subparagraph></paragraph>
<paragraph id="IDe030ce579cdc421abcc203e60e3f2cda"><enum>(3)</enum><header>Amended standards</header> 
<subparagraph id="id355ED5417CD14C0CA98B57C5A26747F7"><enum>(A)</enum><header>Products manufactured after January 1, 2015</header> 
<clause id="id4ADD7B3F2D6242D698752222CDD67720"><enum>(i)</enum><header>In general</header><text>Not later than January 1, 2012, the Secretary shall publish a final rule to determine whether the standards established under paragraph (1) should be amended.</text> </clause>
<clause id="idD5CAF0F511C9447BA3B2217A0EB1353E"><enum>(ii)</enum><header>Administration</header><text>The final rule shall—</text> 
<subclause id="id7C6486D107FE48DA91B4AE7D6CCC7EF0"><enum>(I)</enum><text>contain the amended standards, if any; and</text> </subclause>
<subclause id="idE8F08D412E4D43F898BE86D74318094D"><enum>(II)</enum><text>apply to products manufactured after January 1, 2015.</text> </subclause></clause></subparagraph>
<subparagraph id="ID8bd6594567444230806100b7bef4a589"><enum>(B)</enum><header>Products manufactured after January 1, 2022</header> 
<clause id="idD637A32520894A2E9378118752052F0D"><enum>(i)</enum><header>In general</header><text>Not later than January 1, 2019, the Secretary shall publish a final rule to determine whether the standards then in effect should be amended.</text> </clause>
<clause id="id7B579E55B9204CE79379182BCD4433CC"><enum>(ii)</enum><header>Administration</header><text>The final rule shall—</text> 
<subclause id="idE05A9C283A6A439AAFCA6A7384F94E1F"><enum>(I)</enum><text>contain the amended standards, if any; and</text> </subclause>
<subclause id="id0EE600D8C9B14C74BF93E028100EBEF8"><enum>(II)</enum><text>apply to products manufactured after January 1, 2022.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="IDfb9f763569d7462fa75eaaed0402c034"><enum>(4)</enum><header>Design and performance requirements</header><text>Notwithstanding any other provision of law, any standard established under this subsection may contain both design and performance requirements.</text> </paragraph>
<paragraph id="IDea9ad4648faf4ed4b2eff7cc5b0b97bd"><enum>(5)</enum><header>Effective date</header><text>The standards established under paragraph (1) shall apply to metal halide lamp fixtures manufactured on or after the later of—</text> 
<subparagraph id="idE7B60F7E370245C1AC42D7456D21DCA8"><enum>(A)</enum><text>January 1, 2009; or</text> </subparagraph>
<subparagraph id="id3ABF5FD95B6F4DA4873A93E3CBBFA743"><enum>(B)</enum><text>the date that is 270 days after the date of enactment of the <short-title>Energy Efficient Lighting for a Brighter Tomorrow Act of 2007</short-title>.</text> </subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="ID612a3a7295d746f4ba63d34a5e189654"><enum>(3)</enum><text>in paragraph (2) of subsection (hh) (as redesignated by paragraph (1)), by striking <quote>(ff)</quote> each place it appears and inserting <quote>(gg)</quote>.</text> </paragraph></section>
<section id="id212B885C6EEF4064A6D93234A94BB661"><enum>206.</enum><header>Effect on other law</header><text display-inline="no-display-inline">Section 327(c) of the Energy Policy and Conservation Act (42 U.S.C. 6297(c)) is amended—</text> 
<paragraph id="id1CD0A5FD913D4352B20BFF7EBE6EF44C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>or</quote> after the semicolon at the end;</text> </paragraph>
<paragraph id="idC65D7FB15BBA434DBF268D630DF2D708"><enum>(2)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>; or</quote>; and</text> </paragraph>
<paragraph id="id4F29BE3080E54D77BBAF9E8CC8F4CC49"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id6812E77809DC4BE388F34021AFEB2C42" style="OLC"> 
<paragraph id="IDb729b90739d942dfbd3666b9951561f8"><enum>(9)</enum><text>is a regulation concerning metal halide lamp fixtures adopted by the California Energy Commission on or before January 1, 2011, except that (notwithstanding any other provision of this section)—</text> 
<subparagraph id="idCD9293CA66994C17AB41DD53FF3362AF"><enum>(A)</enum><text>if the Secretary fails to issue a final rule within the 180-day period beginning on the date of the deadline for rulemaking under section 325(gg)(3)(A)(i), preemption shall not apply to a regulation concerning metal halide lamp fixtures adopted by the California Energy Commission on or before July 1, 2015; or</text> </subparagraph>
<subparagraph id="idD9609155C42042739ACC4B58C2C33BED"><enum>(B)</enum><text>if the Secretary fails to issue a final rule within the 180-day period beginning on the deadline specified in section 325(gg)(3)(B)(i), preemption shall not apply to a regulation concerning metal halide lamp fixtures adopted by the California Energy Commission or on or before July 1, 2022.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section></title>
