<subsection id="HCF48028D74DD4BAC9383178E61F3E2B6" commented="no"><enum>(a)</enum><header>Very Senior Executive Personnel</header><text>The matter after subparagraph (C) in <external-xref legal-doc="usc" parsable-cite="usc/18/207">section 207(d)(1)</external-xref> of title 18, United States Code, is amended by striking <quote>within 1 year</quote> and inserting <quote>within 2 years</quote>.</text></subsection> 
<subsection id="HB3AF333D368A4D5DB1ECC0E3C6D39865" commented="no"><enum>(b)</enum><header>Restrictions on Lobbying by Members of Congress and Employees of Congress</header><text>Subsection (e) of <external-xref legal-doc="usc" parsable-cite="usc/18/207">section 207</external-xref> of title 18, United States Code, is amended—</text>

<clause id="H3D8644F572E04425A39B8B9739C34014" display-inline="yes-display-inline" commented="no"><enum>(i)</enum><text>Any person who is a Member of the House of Representatives or an elected officer of the House of Representatives and who, within 1 year after that person leaves office, knowingly makes, with the intent to influence, any communication to or appearance before any of the persons described in clause (ii) or (iii), on behalf of any other person (except the United States) in connection with any matter on which such former Member of Congress or elected officer seeks action by a Member, officer, or employee of either House of Congress, in his or her official capacity, shall be punished as provided in section 216 of this title.</text></clause> 
<clause id="H5F776046B4614235B6C1E5DE3BA076C6" indent="up1" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">The persons referred to in clause (i) with respect to appearances or communications by a former Member of the House of Representatives are any Member, officer, or employee of either House of Congress and any employee of any other legislative office of the Congress.</text></clause>

<section id="H1B9A2649124142A79154EFDC15E8DE84" commented="no"><enum>102.</enum><header>Wrongfully influencing a private entity’s employment decisions or practices</header> 
<subsection id="HE6B4B2795D944361ADE763C720AC08DB" commented="no"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/11">Chapter 11</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H3E58CF8ECB6448488F3900B655AC9CEA"> 
<section id="H208A176BED5C4174839D06672EE4F37B" commented="no"><enum>227.</enum><header>Wrongfully influencing a private entity’s employment decisions by a Member of Congress</header><text display-inline="no-display-inline">Whoever, being a Senator or Representative in, or a Delegate or Resident Commissioner to, the Congress or an employee of either House of Congress, with the intent to influence, solely on the basis of partisan political affiliation, an employment decision or employment practice of any private entity—</text> 
<paragraph id="HFF2C44CB6CB643C88644426E28CE5039" commented="no"><enum>(1)</enum><text>takes or withholds, or offers or threatens to take or withhold, an official act, or</text></paragraph> 
<paragraph id="H97269E88528542CB864B19BDB2930DB" commented="no"><enum>(2)</enum><text>influences, or offers or threatens to influence, the official act of another,</text><continuation-text continuation-text-level="section" commented="no">shall be fined under this title or imprisoned for not more than 15 years, or both, and may be disqualified from holding any office of honor, trust, or profit under the United States.</continuation-text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4C89CA17CF6C484B94AB93FAD38C8D" commented="no"><enum>(b)</enum><header>No Inference</header><text display-inline="yes-display-inline">Nothing in <external-xref legal-doc="usc" parsable-cite="usc/18/227">section 227</external-xref> of title 18, United States Code, as added by this section, shall be construed to create any inference with respect to whether the activity described in <external-xref legal-doc="usc" parsable-cite="usc/18/227">section 227</external-xref> of title 18, United States Code, was a criminal or civil offense before the enactment of this Act, including under section 201(b), 201(c), any of sections 203 through 209, or <external-xref legal-doc="usc" parsable-cite="usc/18/872">section 872,</external-xref> of title 18, United States Code.</text></subsection> 
<subsection id="H074583FC1C4841B6A1C5C92410F843E2" commented="no"><enum>(c)</enum><header>Conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/11">chapter 11</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="HF9B8DBE6F58D497983DD755BB9C3AADB"><enum>(a)</enum><header>Notification of post-employment restrictions</header><text display-inline="yes-display-inline">After a Member of Congress or an elected officer of either House of Congress leaves office, or after the termination of employment with the House of Representatives or the Senate of an employee who is covered under paragraph (2), (3), (4), or (5) of <external-xref legal-doc="usc" parsable-cite="usc/18/207">section 207(e)</external-xref> of title 18, United States Code, the Clerk of the House of Representatives, after consultation with the Committee on Standards of Official Conduct, or the Secretary of the Senate, as the case may be, shall notify the Member, officer, or employee of the beginning and ending date of the prohibitions that apply to the Member, officer, or employee under section 207(e) of that title.</text></subsection> 
<subsection id="H9399FE23499C4B3C8F2F66CFD057F8AF"><enum>(b)</enum><header>Posting on internet</header><text>The Clerk of the House of Representatives, with respect to notifications under subsection (a) relating to Members, officers, and employees of the House, and the Secretary of the Senate, with respect to such notifications relating to Members, officers, and employees of the Senate, shall post the information contained in such notifications on the public Internet site of the Office of the Clerk or the Secretary of the Senate, as the case may be, in a format that, to the extent technically practicable, is searchable, sortable, and downloadable.</text></subsection></section> 
<section id="HB96ED5BCCF8F4D65BAAB37366769DE29" display-inline="no-display-inline" commented="no"><enum>104.</enum><header>Exception to restrictions on former officers, employees, and elected officials of the executive and legislative branch</header>

<paragraph id="HD42FA7E374054D8CB0BD727304383607" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">an officer or employee of the United States assigned to a tribal organization (as defined in section 4(l)) or an inter-tribal consortium (as defined in section 501), as authorized under <external-xref legal-doc="usc" parsable-cite="usc/5/3372">section 3372</external-xref> of title 5, United States Code, or section 2072 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/48">25 U.S.C. 48</external-xref>) may act as agent or attorney for, and appear on behalf of, such tribal organization or inter-tribal consortium in connection with any matter related to a tribal governmental activity or Federal Indian program or service pending before any department, agency, court, or commission, including any matter in which the United States is a party or has a direct and substantial interest: <italic>Provided</italic>, That such officer or employee must advise in writing the head of the department, agency, court, or commission with which the officer or employee is dealing or appearing on behalf of the tribal organization or inter-tribal consortium of any personal and substantial involvement with the matter involved; and</text></paragraph> 
<paragraph id="HECD7C6D5C57F4B1DBCD0036616C695B" commented="no"><enum>(2) </enum><text display-inline="yes-display-inline">a former officer or employee of the United States who is carrying out official duties as an employee or as an elected or appointed official of a tribal organization (as defined in section 4(l)) or inter-tribal consortium (as defined in section 501) may act as agent or attorney for, and appear on behalf of, such tribal organization or intra-tribal consortium in connection with any matter related to a tribal governmental activity or Federal Indian program or service pending before any department, agency, court, or commission, including any matter in which the United States is a party or has a direct and substantial interest: <italic>Provided,</italic> That such former officer or employee must advise in writing the head of the department, agency, court, or commission with which the former officer or employee is dealing or appearing on behalf of the tribal organization or inter-tribal consortium of any personal and substantial involvement the he or she may have had as an officer or employee of the United States in connection with the matter involved. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6A839302775B46C490B37F5FE1177506"><enum>(c)</enum><header>Effect of section</header><text display-inline="yes-display-inline">Except as expressly identified in this section and in the amendments made by this section, nothing in this section or the amendments made by this section affects any other provision of law. </text></subsection></section> 
<section id="H549BCA7FB449420284A9948718000445" commented="no"><enum>105.</enum><header>Effective date</header> 
<subsection id="HD49928B33C2241FA9299281CAB0038B8"><enum>(a)</enum><header>Section <enum-in-header>101</enum-in-header></header><text display-inline="yes-display-inline">The amendments made by section 101 shall apply to individuals who leave Federal office or employment to which such amendments apply on or after the date of adjournment of the first session of the 110th Congress sine die or December 31, 2007, whichever date is earlier. </text></subsection> 
<subsection id="H92BFDD154E134BDFB8A016D5AE05F521" commented="no"><enum>(b)</enum><header>Section <enum-in-header>102</enum-in-header></header><text display-inline="yes-display-inline">The amendments made by section 102 shall take effect on the date of the enactment of this Act. </text></subsection> 
<subsection id="HFA6EA2CBADAF4302A4F18000DEA08DB1" commented="no"><enum>(c)</enum><header>Section <enum-in-header>103</enum-in-header></header> 
<paragraph id="H5395AFB41EA3412895C3A6F3F58077AE" commented="no"><enum>(1)</enum><header>Notification of post-employment restrictions</header><text>Subsection (a) of section 103 shall take effect on the 60th day after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H4010AD3C67974569A88859B705467E6E" commented="no"><enum>(2)</enum><header>Posting of information</header><text display-inline="yes-display-inline">Subsection (b) of section 103 shall take effect January 1, 2008, except that the Secretary of the Senate and the Clerk of the House of Representatives shall post the information contained in notifications required by that subsection that are made on or after the effective date provided under paragraph (1) of this subsection. </text></paragraph></subsection> 
<subsection id="H99B4F030753D4BB8A44616B5F443F619" commented="no"><enum>(d)</enum><header>Section <enum-in-header>104</enum-in-header></header><text display-inline="yes-display-inline">The amendments made by section 104 shall take effect on the date of the enactment of this Act, except that section 104(j)(2) of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (as amended by section 104(b)) shall apply to individuals who leave Federal office or employment to which such amendments apply on or after the 60th day after the date of the enactment of this Act. </text></subsection></section></title>

<subsection id="H24999BDEEA91411EADCC1935C32213BF" commented="no"><enum>(a)</enum><header>Other Contributions</header><text display-inline="yes-display-inline">Section 5 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>) is further amended by adding at the end the following:</text>

<subparagraph id="H0B4B7049B244496298EC30DA29AEDA41" commented="no"><enum>(A)</enum><text>the name of the person or organization;</text></subparagraph> 
<subparagraph id="H7A44CB5350F1476498DDFF7989D98430" commented="no"><enum>(B)</enum><text>in the case of an employee, his or her employer;</text></subparagraph> 
<subparagraph id="H665D96FDF470487F825B7BC000E18E80" commented="no"><enum>(C)</enum><text>the names of all political committees established or controlled by the person or organization;</text></subparagraph> 
<subparagraph id="H273D57363C054500AA3E852B75F5EF82" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">the name of each Federal candidate or officeholder, leadership PAC, or political party committee, to whom aggregate contributions equal to or exceeding $200 were made by the person or organization, or a political committee established or controlled by the person or organization within the semiannual period, and the date and amount of each such contribution made within the semiannual period; </text></subparagraph> 
<subparagraph id="H945297E0E1AB48FB87007995E319E5F" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">the date, recipient, and amount of funds contributed or disbursed during the semiannual period by the person or organization or a political committee established or controlled by the person or organization—</text> 
<clause id="H897644C48CF14B36B977391623C7AD97" commented="no"><enum>(i)</enum><text>to pay the cost of an event to honor or recognize a covered legislative branch official or covered executive branch official;</text></clause> 
<clause id="H309A012786C84C87B17F4FC98F98C14B" commented="no"><enum>(ii)</enum><text>to an entity that is named for a covered legislative branch official, or to a person or entity in recognition of such official;</text></clause> 
<clause id="H51F0DFAAD7C847FF9D74DE1D5CB50036" commented="no"><enum>(iii)</enum><text>to an entity established, financed, maintained, or controlled by a covered legislative branch official or covered executive branch official, or an entity designated by such official; or</text></clause> 
<clause id="HC8100A4D6098417F932477475280174E" commented="no"><enum>(iv)</enum><text>to pay the costs of a meeting, retreat, conference, or other similar event held by, or in the name of, 1 or more covered legislative branch officials or covered executive branch officials,</text></clause><continuation-text continuation-text-level="subparagraph" commented="no">except that this subparagraph shall not apply if the funds are provided to a person who is required to report the receipt of the funds under section 304 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434</external-xref>);</continuation-text></subparagraph> 
<subparagraph id="H1BC255F28BA5484D8556A4C409B4D18E" commented="no"><enum>(F)</enum><text>the name of each Presidential library foundation, and each Presidential inaugural committee, to whom contributions equal to or exceeding $200 were made by the person or organization, or a political committee established or controlled by the person or organization, within the semiannual period, and the date and amount of each such contribution within the semiannual period; and</text></subparagraph> 
<subparagraph id="HFA4C7DE3C6C044EBA6B1F5E2117C4BB" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">a certification by the person or organization filing the report that the person or organization—</text> 
<clause id="H51068396216C4E959CA4E78516786B72" commented="no"><enum>(i)</enum><text>has read and is familiar with those provisions of the Standing Rules of the Senate and the Rules of the House of Representatives relating to the provision of gifts and travel; and</text></clause> 
<clause id="H58D20426EE0D420DA882F8F42912F1F" commented="no"><enum>(ii)</enum><text>has not provided, requested, or directed a gift, including travel, to a Member of Congress or an officer or employee of either House of Congress with knowledge that receipt of the gift would violate rule XXXV of the Standing Rules of the Senate or rule XXV of the Rules of the House of Representatives.</text></clause></subparagraph></paragraph> 
<paragraph id="H3C6228F08064477E9594F35B6C495130" commented="no"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>leadership PAC</term> has the meaning given such term in section 304(i)(8)(B) of the Federal Election Campaign Act of 1971. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB16A1567587348F690ECA8D07BA2AE7F" commented="no"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to the first semiannual period described in section 5(d)(1) of the Lobbying Disclosure Act of 1995 (as added by this section) that begins after the date of the enactment of this Act and each succeeding semiannual period.</text></subsection> 
<subsection id="HDADF105657164C21882413331CC6E2D9"><enum>(c)</enum><header>Report on requiring quarterly reports</header><text display-inline="yes-display-inline">The Clerk of the House of Representatives and the Secretary of the Senate shall submit a report to the Congress, not later than 1 year after the date on which the first reports are required to be made under section 5(d) of the Lobbying Disclosure Act of 1995 (as added by this section), on the feasibility of requiring the reports under such section 5(d) to be made on a quarterly, rather than a semiannual, basis.</text></subsection> 
<subsection id="H06A1BC040827464DB3F53C3512B68692"><enum>(d)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of the Congress that after the end of the 2-year period beginning on the day on which the amendment made by subsection (a) of this section first applies, the reports required under section 5(d) of the Lobbying Disclosure Act of 1995 (as added by this section) should be made on a quarterly basis if it is practicably feasible to do so. </text></subsection></section> 
<section id="HC1F632196ADD40EAB509684906ADF5A2" section-type="subsequent-section" display-inline="no-display-inline"><enum>204.</enum><header>Disclosure of bundled contributions</header> 
<subsection id="H191565E3F564441DA38D2400B71B9607"><enum>(a)</enum><header>Disclosure</header><text>Section 304 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HA4ACB4B4CC6249FFA74E4000F63F493B" display-inline="no-display-inline"> 
<subsection id="H04419011C0384D5F9F769B0037C04981"><enum>(i)</enum><header>Disclosure of Bundled Contributions</header> 
<paragraph id="H753977DBC88440449B3F729E87883CB1"><enum>(1)</enum><header>Required disclosure</header><text display-inline="yes-display-inline">Each committee described in paragraph (6) shall include in the first report required to be filed under this section after each covered period (as defined in paragraph (2)) a separate schedule setting forth the name, address, and employer of each person reasonably known by the committee to be a person described in paragraph (7) who provided 2 or more bundled contributions to the committee in an aggregate amount greater than the applicable threshold (as defined in paragraph (3)) during the covered period, and the aggregate amount of the bundled contributions provided by each such person during the covered period.</text></paragraph> 
<paragraph id="H16C215CF7CD54E1386698510862D5FA4"><enum>(2)</enum><header>Covered period</header><text>In this subsection, a <quote>covered period</quote> means, with respect to a committee—</text> 
<subparagraph id="H34E497B6BDB14E9F8BDD0083FB909F22"><enum>(A)</enum><text>the period beginning January 1 and ending June 30 of each year;</text></subparagraph> 
<subparagraph id="HAC7D58F2DAC84433B593E0BAEA1CBE55"><enum>(B)</enum><text display-inline="yes-display-inline">the period beginning July 1 and ending December 31 of each year; and</text></subparagraph> 
<subparagraph id="HD99B84C087EA4B428BEAECCBA643BDC"><enum>(C)</enum><text display-inline="yes-display-inline">any reporting period applicable to the committee under this section during which any person described in paragraph (7) provided 2 or more bundled contributions to the committee in an aggregate amount greater than the applicable threshold. </text></subparagraph></paragraph> 
<paragraph id="HBF345486D02A40FA93F50036CE207B77"><enum>(3)</enum><header>Applicable threshold</header> 
<subparagraph id="H2947D09F03634D26B4141B873F2909B8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In this subsection, the <quote>applicable threshold</quote> is $15,000, except that in determining whether the amount of bundled contributions provided to a committee by a person described in paragraph (7) exceeds the applicable threshold, there shall be excluded any contribution made to the committee by the person or the person’s spouse. </text></subparagraph> 
<subparagraph id="H69FDF5543C4B46C3A8BECF798D2409C2"><enum>(B)</enum><header>Indexing</header><text>In any calendar year after 2007, section 315(c)(1)(B) shall apply to the amount applicable under subparagraph (A) in the same manner as such section applies to the limitations established under subsections (a)(1)(A), (a)(1)(B), (a)(3), and (h) of such section, except that for purposes of applying such section to the amount applicable under subparagraph (A), the <quote>base period</quote> shall be 2006.</text></subparagraph></paragraph> 
<paragraph id="H892109027E4E42978390965E005E4F57"><enum>(4)</enum><header>Public availability</header><text display-inline="yes-display-inline">The Commission shall ensure that, to the greatest extent practicable—</text> 
<subparagraph id="H85182706356241A7A5A27FCBAFFF0056"><enum>(A)</enum><text display-inline="yes-display-inline">information required to be disclosed under this subsection is publicly available through the Commission website in a manner that is searchable, sortable, and downloadable; and</text></subparagraph> 
<subparagraph id="H245D15A2883D40D6002081B4352E4FAD"><enum>(B)</enum><text display-inline="yes-display-inline">the Commission’s public database containing information disclosed under this subsection is linked electronically to the websites maintained by the Secretary of the Senate and the Clerk of the House of Representatives containing information filed pursuant to the Lobbying Disclosure Act of 1995.</text></subparagraph></paragraph> 
<paragraph id="HA52065A2384C468D80ABD34EAFDA801C"><enum>(5)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of the Honest Leadership and Open Government Act of 2007, the Commission shall promulgate regulations to implement this subsection. Under such regulations, the Commission—</text> 
<subparagraph id="H3E9C1196D4EA4EBC83D4F7E32D7727D"><enum>(A)</enum><text display-inline="yes-display-inline">may, notwithstanding paragraphs (1) and (2), provide for quarterly filing of the schedule described in paragraph (1) by a committee which files reports under this section more frequently than on a quarterly basis;</text></subparagraph> 
<subparagraph id="HB373C76879A446268E229612F6469EA3"><enum>(B)</enum><text display-inline="yes-display-inline">shall provide guidance to committees with respect to whether a person is reasonably known by a committee to be a person described in paragraph (7), which shall include a requirement that committees consult the websites maintained by the Secretary of the Senate and the Clerk of the House of Representatives containing information filed pursuant to the Lobbying Disclosure Act of 1995; </text></subparagraph> 
<subparagraph id="HE55DF4787166433F99EF0094547F9233"><enum>(C)</enum><text display-inline="yes-display-inline">may not exempt the activity of a person described in paragraph (7) from disclosure under this subsection on the grounds that the person is authorized to engage in fundraising for the committee or any other similar grounds; and</text></subparagraph> 
<subparagraph id="HE9B162FC75744260B0DE629960C128FE"><enum>(D)</enum><text>shall provide for the broadest possible disclosure of activities described in this subsection by persons described in paragraph (7) that is consistent with this subsection.</text></subparagraph></paragraph> 
<paragraph id="HACEC3AA49EB84D2E88194DBB4CA7F784"><enum>(6)</enum><header>Committees described</header><text>A committee described in this paragraph is an authorized committee of a candidate, a leadership PAC, or a political party committee.</text></paragraph> 
<paragraph id="HB6191FB413CF43FE9CA375B0CDB06E6"><enum>(7)</enum><header>Persons described</header><text display-inline="yes-display-inline">A person described in this paragraph is any person, who, at the time a contribution is forwarded to a committee as described in paragraph (8)(A)(i) or is received by a committee as described in paragraph (8)(A)(ii), is—</text> 
<subparagraph id="H314D1D8EAC0842DE9EB16751A8FA57B7"><enum>(A)</enum><text>a current registrant under section 4(a) of the Lobbying Disclosure Act of 1995;</text></subparagraph> 
<subparagraph id="H2F42438C3FD54C0C95AF63E7F207669"><enum>(B)</enum><text>an individual who is listed on a current registration filed under section 4(b)(6) of such Act or a current report under section 5(b)(2)(C) of such Act; or</text></subparagraph> 
<subparagraph id="H384289753F6945C7AAAD1B7583F082BA"><enum>(C)</enum><text>a political committee established or controlled by such a registrant or individual.</text></subparagraph></paragraph> 
<paragraph id="H1AB173781E7B47418200BD5489724228"><enum>(8)</enum><header>Definitions</header><text>For purposes of this subsection, the following definitions apply:</text> 
<subparagraph id="H1BF1E3C69A36488BB7523D9EA7E3FBF6"><enum>(A)</enum><header>Bundled contribution</header><text display-inline="yes-display-inline">The term <quote>bundled contribution</quote> means, with respect to a committee described in paragraph (6) and a person described in paragraph (7), a contribution (subject to the applicable threshold) which is—</text> 
<clause id="HC9EA4FB03AD044F59303EB1710675E4D"><enum>(i)</enum><text display-inline="yes-display-inline">forwarded from the contributor or contributors to the committee by the person; or </text></clause> 
<clause id="H0EC04FB954A44258993517B9B17D99A2"><enum>(ii)</enum><text display-inline="yes-display-inline">received by the committee from a contributor or contributors, but credited by the committee or candidate involved (or, in the case of a leadership PAC, by the individual referred to in subparagraph (B) involved) to the person through records, designations, or other means of recognizing that a certain amount of money has been raised by the person.</text></clause></subparagraph> 
<subparagraph id="H2AE5C23AE2764039BCE7691B94F6747"><enum>(B)</enum><header>Leadership PAC</header><text>The term <quote>leadership PAC</quote> means, with respect to a candidate for election to Federal office or an individual holding Federal office, a political committee that is directly or indirectly established, financed, maintained or controlled by the candidate or the individual but which is not an authorized committee of the candidate or individual and which is not affiliated with an authorized committee of the candidate or individual, except that such term does not include a political committee of a political party.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H86B053A89E2E4CDF8E04A267A13E2877"><enum>(b)</enum><header>Effective Date</header><text>The amendment made by subsection (a) shall apply with respect to reports filed under section 304 of the Federal Election Campaign Act after the expiration of the 3-month period which begins on the date that the regulations required to be promulgated by the Federal Election Commission under section 304(i)(5) of such Act (as added by subsection (a)) become final.</text></subsection></section> 
<section id="H3D0ED4241DBA4882878D3FEC164975F"><enum>205.</enum><header>Electronic filing of lobbying disclosure reports</header><text display-inline="no-display-inline">Section 5 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>) is further amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="H5EFF7DDE8410478AB79BD9AAD11D264C" display-inline="no-display-inline"> 
<subsection id="HF50411A589B241598686639FC51F69EA"><enum>(e)</enum><header>Electronic Filing Required</header><text display-inline="yes-display-inline">A report required to be filed under this section shall be filed in electronic form, in addition to any other form that the Secretary of the Senate or the Clerk of the House of Representatives may require or allow. The Secretary of the Senate and the Clerk of the House of Representatives shall use the same electronic software for receipt and recording of filings under this Act. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H44D396A199834FFFA615FD96BD0E719"><enum>206.</enum><header>Prohibition on provision of gifts or travel by registered lobbyists to Members of Congress and to congressional employees</header> 
<subsection id="H8E03B78678944091B597000700CA709"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H92FA77E9F1014E43815E00A8A81333FF" display-inline="no-display-inline"> 
<section id="H35D6C60C04514AFDA22784227DC1774D"><enum>25.</enum><header>Prohibition on provision of gifts or travel by registered lobbyists to Members of Congress and to congressional employees</header> 
<subsection id="H79DBAAE8442E49F4B500CC0038EED104"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Any person described in subsection (b) may not make a gift or provide travel to a covered legislative branch official if the person has knowledge that the gift or travel may not be accepted by that covered legislative branch official under the Rules of the House of Representatives or the Standing Rules of the Senate (as the case may be). </text></subsection> 
<subsection id="HB85612EC45CF4802A3CDE4A8208EE5CA"><enum>(b)</enum><header>Persons subject to prohibition</header><text display-inline="yes-display-inline">The persons subject to the prohibition under subsection (a) are any lobbyist that is registered or is required to register under section 4(a)(1), any organization that employs 1 or more lobbyists and is registered or is required to register under section 4(a)(2), and any employee listed or required to be listed as a lobbyist by a registrant under section 4(b)(6) or 5(b)(2)(C). </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2F83B9980C8E4F1998F1BEAA3DAADE00"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section id="H966F8AB9CA904D6E9B5B157600798CAF" commented="no"><enum>207.</enum><header>Disclosure of lobbying activities by certain coalitions and associations</header> 
<subsection id="HC7C3E72FCF6346A1BCA9354BD1006FA" commented="no"><enum>(a)</enum><header>In General</header> 
<paragraph id="HDC376EF27A1B4CE090100070B02B6858" commented="no"><enum>(1)</enum><header>Disclosure</header><text>Section 4(b)(3) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(b)(3)</external-xref>) is amended—</text> 
<subparagraph id="HCA1B663CC88A425796037BF6BA2C6654" commented="no"><enum>(A)</enum><text>by amending subparagraph (A) to read as follows:</text>

<subparagraph id="H89812273D052412986C6B8BA9009BA37" commented="no"><enum>(B)</enum><text>by amending subparagraph (B) to read as follows:</text>

<subparagraph id="H7B0F3D6F62284A289EE027A40086AF00" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">actively participates in the planning, supervision, or control of such lobbying activities;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HAF82C4ACFF854CC1AC2CD0C5FA40C58D" commented="no"><enum>(2)</enum><header>Updating of information</header><text display-inline="yes-display-inline">Section 5(b)(1) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604(b)(1)</external-xref>) is amended by inserting <quote>, including information under section 4(b)(3)</quote> after <quote>initial registration</quote>. </text></paragraph></subsection> 
<subsection id="H8F301F54285A4BD200D606E5B8F9DD91" commented="no"><enum>(b)</enum><header>No Donor or Membership List Disclosure</header><text display-inline="yes-display-inline">Section 4(b) of The Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(b)</external-xref>) is amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="H5AECF017CD3D40AD8D845837531D21F3" display-inline="no-display-inline"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="subsection" commented="no">No disclosure is required under paragraph (3)(B) if the organization that would be identified as affiliated with the client is listed on the client’s publicly accessible Internet website as being a member of or contributor to the client, unless the organization in whole or in major part plans, supervises, or controls such lobbying activities.  If a registrant relies upon the preceding sentence, the registrant must disclose the specific Internet address of the web page containing the information relied upon. Nothing in paragraph (3)(B) shall be construed to require the disclosure of any information about individuals who are members of, or donors to, an entity treated as a client by this Act or an organization identified under that paragraph. </quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H4F1AC95EA5D044C0959FE26FF300ADED"><enum>208.</enum><header>Disclosure by registered lobbyists of past executive branch and congressional employment</header><text display-inline="no-display-inline">Section 4(b)(6) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(b)(6)</external-xref>) is amended by striking <quote>in the 2 years</quote> and all that follows through <quote>Act)</quote> and inserting <quote>in the 20 years before the date on which the employee first acted</quote>.</text></section> 
<section id="HD7FFC3F832FE48C8A602BB3264FC70B7"><enum>209.</enum><header>Public availability of lobbying disclosure information; maintenance of information</header> 
<subsection id="H568F2F24B47A4436832400D2F2CDCC"><enum>(a)</enum><header>Public availability</header><text>Section 6 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605</external-xref>) is further amended—</text> 
<paragraph id="H4E546D1C1C5C4C49988E259245FA5B02"><enum>(1)</enum><text>in paragraph (7), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H08E35BEC0A6C438BA99DD43391C886D0"><enum>(2)</enum><text>in paragraph (8), by striking the period at the end and inserting a semicolon; and</text></paragraph> 
<paragraph id="H6D4FABC52D8B4849B942106413F76492"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text>

<paragraph id="H7C9C436198AA402DA17BB52FF77A4CB"><enum>(9)</enum><text>maintain all registrations and reports filed under this Act, and make them available to the public over the Internet, without a fee or other access charge, in a searchable, sortable, and downloadable manner, to the extent technically practicable, that—</text> 
<subparagraph id="H3CC42A70887B4B8382ED68F122970051"><enum>(A)</enum><text>includes the information contained in the registrations and reports;</text></subparagraph> 
<subparagraph id="HB214562D1A6E4C5699A7C103E7A271D0"><enum>(B)</enum><text>is searchable and sortable to the maximum extent practicable, including searchable and sortable by each of the categories of information described in section 4(b) or 5(b); and</text></subparagraph> 
<subparagraph id="H5069884B57EA425E88311F390001C32E"><enum>(C)</enum><text display-inline="yes-display-inline">provides electronic links or other appropriate mechanisms to allow users to obtain relevant information in the database of the Federal Election Commission; and</text></subparagraph></paragraph> 
<paragraph id="HB389FB331436443CBE047788760068E9"><enum>(10)</enum><text>retain the information contained in a registration or report filed under this Act for a period of 6 years after the registration or report (as the case may be) is filed.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H785B304E564D4607BE055943EE143523"><enum>(b)</enum><header>Availability of Reports</header><text display-inline="yes-display-inline">Section 6(4) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605</external-xref>) is amended by inserting before the semicolon at the end the following: <quote>and, in the case of a report filed in electronic form under section 5(e), make such report available for public inspection over the Internet as soon as technically practicable after the report is so filed</quote>.</text></subsection> 
<subsection id="H12CE523808324CF8A98D19B3B94D517"><enum>(c)</enum><header>Authorization of Appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out paragraph (9) of section 6 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605</external-xref>), as added by subsection (a) of this section.</text></subsection></section> 
<section id="H0D1E8559CB5E4644B32D8F988DEADB40" display-inline="no-display-inline" section-type="subsequent-section" commented="no"><enum>210.</enum><header>Disclosure of enforcement for noncompliance</header><text display-inline="no-display-inline">Section 6 of The Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1605">2 U.S.C. 1605</external-xref>) is further amended—</text>

<section id="H4686ED2776854461ABC30039F6FE284E"><enum>211.</enum><header>Increased civil and criminal penalties for failure to comply with lobbying disclosure requirements</header> 
<subsection id="H21168FB193C74748B5EA05C417E61282"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1606">2 U.S.C. 1606</external-xref>) is amended—</text> 
<paragraph id="H56230D70A04B495C8B6693928494175D"><enum>(1)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">Civil Penalty</header-in-text>.—Whoever</quote>;</text></paragraph> 
<paragraph id="H996C9ECE3F2D4B799BAAACC02C2500AC"><enum>(2)</enum><text>by striking <quote>$50,000</quote> and inserting <quote>$200,000</quote>; and</text></paragraph>

<subsection id="H9D1BE11EFE7540A8BAEF98EC8FCCA65"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to any violation committed on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="H7C494AFA8B99485F82822DB8CBDE09B1" display-inline="no-display-inline" section-type="subsequent-section"><enum>212.</enum><header>Electronic filing and public database for lobbyists for foreign governments</header> 
<subsection id="H81FEFD037DA64F5584968065CA47D342"><enum>(a)</enum><header>Electronic Filing</header><text>Section 2 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/612">22 U.S.C. 612</external-xref>), is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HEDF5C353DCA349B0A9FB888B8C5E7C7E"> 
<subsection id="HD7B4D302BCB848E09D7F16BA9019E2F1"><enum>(g)</enum><header>Electronic filing of registration statements and supplements</header><text>A registration statement or supplement required to be filed under this section shall be filed in electronic form, in addition to any other form that may be required by the Attorney General.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6C9C9C7D3B69478186C4FC75C718C88B"><enum>(b)</enum><header>Public Database</header><text>Section 6 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/616">22 U.S.C. 616</external-xref>), is amended by adding at the end the following new subsection:</text>

<subsection id="HE751E9C6E8B64AF89ECCAC296EF082DC"><enum>(d)</enum><header>Public Database of Registration Statements and Updates</header> 
<paragraph id="HBAB025119483414BAB1CD440EE167328"><enum>(1)</enum><header>In general</header><text>The Attorney General shall maintain, and make available to the public over the Internet, without a fee or other access charge, in a searchable, sortable, and downloadable manner, to the extent technically practicable, an electronic database that—</text> 
<subparagraph id="H1C9C9B599FFF4471A6F17D007716F541"><enum>(A)</enum><text>includes the information contained in registration statements and updates filed under this Act; and</text></subparagraph> 
<subparagraph id="H4A72A83F5E9F403888007B4977D07810"><enum>(B)</enum><text>is searchable and sortable, at a minimum, by each of the categories of information described in section 2(a).</text></subparagraph></paragraph> 
<paragraph id="HF79D0B2ACACF453C8E5366F81576F508"><enum>(2)</enum><header>Accountability</header><text>The Attorney General shall make each registration statement and update filed in electronic form pursuant to section 2(g) available for public inspection over the Internet as soon as technically practicable after the registration statement or update is filed.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6210AF1AA534484FA141A99CFE8119D"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the 90th day after the date of the enactment of this Act.</text></subsection></section> 
<section id="HD9C02FC562F34C0A92A91F83D68EB14E"><enum>213.</enum><header>Comptroller General audit and annual report</header> 
<subsection id="HD081D3621E404E8599AA27EE03CFB2FA"><enum>(a)</enum><header>Annual audits and reports</header><text>The Lobbying Disclosure Act of 1995 ( <external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>) is further amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H2BF1C8BC55A54FC3A2E6C16DF983F6C7" display-inline="no-display-inline"> 
<section id="H66EA0BCF5B4D4D0FBA979FBAB0CB35B1"><enum>26.</enum><header>Annual audits and reports by Comptroller General</header> 
<subsection id="H714A2FBD2A2944E400A213505170D689"><enum>(a)</enum><header>Audit</header><text display-inline="yes-display-inline">On an annual basis, the Comptroller General shall audit the extent of compliance or noncompliance with the requirements of this Act by lobbyists, lobbying firms, and registrants through a random sampling of publicly available lobbying registrations and reports filed under this Act during each calendar year.</text></subsection> 
<subsection id="H0ABBE0821F6C4E6F001CAC8D81976232"><enum>(b)</enum><header>Reports to Congress</header> 
<paragraph id="HE5F40238B64E4A6395793C22CA003823"><enum>(1)</enum><header>Annual reports</header><text>Not later than April 1 of each year, the Comptroller General shall submit to the Congress a report on the review required by subsection (a) for the preceding calendar year. The report shall include the Comptroller General’s assessment of the matters required to be emphasized by that subsection and any recommendations of the Comptroller General to—</text> 
<subparagraph id="H777C4AF1CB4742E49E37C049C9908AA"><enum>(A)</enum><text display-inline="yes-display-inline">improve the compliance by lobbyists, lobbying firms, and registrants with the requirements of this Act; and</text></subparagraph> 
<subparagraph id="HC3FD3890360A4212BFD5276F6B531C60" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">provide the Department of Justice with the resources and authorities needed for the effective enforcement of this Act.</text></subparagraph></paragraph> 
<paragraph id="H59B58ADA9DD8403080D089FF44C1CED"><enum>(2)</enum><header>Assessment of compliance</header><text>The annual report under paragraph (1) shall include an assessment of compliance by registrants with the requirements of section 4(b)(3).</text></paragraph></subsection> 
<subsection id="H05B34B868D5F46049EE31385B4A2973"><enum>(c)</enum><header>Access to information</header><text display-inline="yes-display-inline">The Comptroller General may, in carrying out this section, request information from and access to any relevant documents from any person registered under paragraph (1) or (2) of section 4(a) and each employee who is listed as a lobbyist under section 4(b)(6) or section 5(b)(2)(C) if the material requested relates to the purposes of this section. The Comptroller General may request such person to submit in writing such information as the Comptroller General may prescribe. The Comptroller General may notify the Congress in writing if a person from whom information has been requested under this subsection refuses to comply with the request within 45 days after the request is made.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection> 
<subsection id="H1EFA4CC074774C7199C58544E926D511"><enum>(b)</enum><header>Initial audit and report</header><text>The initial audit under subsection (a) of section 26 of the Lobbying Disclosure Act of 1995 (as added by subsection (a) of this section) shall be made with respect to lobbying registrations and reports filed during the first calendar quarter of 2008, and the initial report under subsection (b) of such section shall be filed, with respect to those registrations and reports, not later than 6 months after the end of that calendar quarter.</text></subsection></section> 
<section id="H66ED87591C704083BADFADB2296F6FB4" display-inline="no-display-inline" section-type="subsequent-section" commented="no"><enum>214.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that—</text> 
<paragraph id="H9BBB2635E9BE40849312BFDEE24C17" commented="no"><enum>(1)</enum><text>the use of a family relationship by a lobbyist who is an immediate family member of a Member of Congress to gain special advantages over other lobbyists is inappropriate; and</text></paragraph> 
<paragraph id="H504C1304297649308E2900BBCFCC3911" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the lobbying community should develop proposals for multiple self-regulatory organizations which could—</text> 
<subparagraph id="H85DD151D95B644FE94C6171B963DD021" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">provide for the creation of standards for the organizations appropriate to the type of lobbying and individuals to be served; </text></subparagraph> 
<subparagraph id="H0BC7DDEA5D2F4C41B3C6F67266EE005C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">provide training for the lobbying community on law, ethics, reporting requirements, and disclosure requirements; </text></subparagraph> 
<subparagraph id="HA419F73311C24635B4583000BBD40075" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">provide for the development of educational materials for the public on how to responsibly hire a lobbyist or lobby firm; </text></subparagraph> 
<subparagraph id="H4E91E7B291304054A300F8B4B9767959" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">provide standards regarding reasonable fees charged to clients; </text></subparagraph> 
<subparagraph id="H9641E976AB39438FB647E87415AADB1F" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">provide for the creation of a third-party certification program that includes ethics training; and </text></subparagraph> 
<subparagraph id="HE44A42AF5A7645EAA461EF2E7A87D00" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">provide for disclosure of requirements to clients regarding fee schedules and conflict of interest rules.</text></subparagraph></paragraph></section> 
<section id="H40AA9CD351004212BEB23D1CD4527862" commented="no"><enum>215.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided in sections 203, 204, 206, 211, 212, and 213, the amendments made by this title shall apply with respect to registrations under the Lobbying Disclosure Act of 1995 having an effective date of January 1, 2008, or later and with respect to quarterly reports under that Act covering calendar quarters beginning on or after January 1, 2008.</text></section></title> 
<title id="H9402A87887284125B6C1A4A7892BB75F"><enum>III</enum><header>Matters Relating to the House of Representatives</header> 
<section id="H85A232E5D96844F0B882C4AAFA81BA27"><enum>301.</enum><header>Disclosure by Members and staff of employment negotiations</header> 
<subsection id="H34338A5A29D54B9F9E6219EBC3AB8015"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Rules of the House of Representatives are amended by redesignating rules XXVII and XXVIII as rules XXVIII and XXIX, respectively, and by inserting after rule XXVI the following new rule: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H88F854D5317B4F1D8CD000A2486B91AE"><rule id="HCCBC5237577B4E8894AD15B54900362B"><enum>Rule XXVII</enum><header display-inline="no-display-inline">Disclosure by Members and staff of employment negotiations</header><rules-clause id="HCCF2A020A63E4938ACBCC831907B3393"><enum>1.</enum><text display-inline="yes-display-inline">A Member, Delegate, or Resident Commissioner shall not directly negotiate or have any agreement of future employment or compensation until after his or her successor has been elected, unless such Member, Delegate, or Resident Commissioner, within 3 business days after the commencement of such negotiation or agreement of future employment or compensation, files with the Committee on Standards of Official Conduct a statement, which must be signed by the Member, Delegate, or Resident Commissioner, regarding such negotiations or agreement, including the name of the private entity or entities involved in such negotiations or agreement, and the date such negotiations or agreement commenced. </text></rules-clause><rules-clause id="H0942C41392C24B1B8BE96239A929C9DA"><enum>2.</enum><text>An officer or an employee of the House earning in excess of 75 percent of the salary paid to a Member shall notify the Committee on Standards of Official Conduct that he or she is negotiating or has any agreement of future employment or compensation.</text></rules-clause><rules-clause id="HEA7FD82893EB4BF99072D2E8F2CFC017"><enum>3.</enum><text>The disclosure and notification under this rule shall be made within 3 business days after the commencement of such negotiation or agreement of future employment or compensation.</text></rules-clause><rules-clause id="HA9A7FBB738094F9088B28E505BC12650"><enum>4.</enum><text display-inline="yes-display-inline">A Member, Delegate, or Resident Commissioner, and an officer or employee to whom this rule applies, shall recuse himself or herself from any matter in which there is a conflict of interest or an appearance of a conflict for that Member, Delegate, Resident Commissioner, officer, or employee under this rule and shall notify the Committee on Standards of Official Conduct of such recusal. A Member, Delegate, or Resident Commissioner making such recusal shall, upon such recusal, submit to the Clerk for public disclosure the statement of disclosure under clause 1 with respect to which the recusal was made.</text></rules-clause></rule><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA24BAAFD0ED3406FB8E68C4F6D142C62"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect on the date of the enactment of this Act, and shall apply to negotiations commenced, and agreements entered into, on or after that date. </text></subsection></section> 
<section id="HB0D647982C294DA08D265382028F67C8" section-type="subsequent-section" display-inline="no-display-inline"><enum>302.</enum><header>Prohibition on lobbying contacts with spouse of Member who is a registered lobbyist</header><text display-inline="no-display-inline">Rule XXV of the Rules of the House of Representatives is amended by adding at the end the following new clause: </text> 
<quoted-block style="OLC" id="H21C0C996006A46DBA819C00F1D9A00" display-inline="no-display-inline"> 
<paragraph id="H98327598313E409DBF3EF500CC7E3118" indent="up1"><enum>7.</enum><text display-inline="yes-display-inline">A Member, Delegate, or Resident Commissioner shall prohibit all staff employed by that Member, Delegate, or Resident Commissioner (including staff in personal, committee, and leadership offices) from making any lobbying contact (as defined in section 3 of the Lobbying Disclosure Act of 1995) with that individual’s spouse if that spouse is a lobbyist under the Lobbying Disclosure Act of 1995 or is employed or retained by such a lobbyist for the purpose of influencing legislation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H88B20DE3FA694C20932F955E508EC92E" section-type="subsequent-section" display-inline="no-display-inline"><enum>303.</enum><header>Treatment of firms and other businesses whose members serve as House committee consultants</header><text display-inline="no-display-inline">Clause 18(b) of rule XXIII of the Rules of the House of Representatives is amended by adding at the end the following: <quote>In the case of such an individual who is a member or employee of a firm, partnership, or other business organization, the other members and employees of the firm, partnership, or other business organization shall be subject to the same restrictions on lobbying that apply to the individual under this paragraph.</quote>.</text></section> 
<section id="HBC7341368CC44C248B47069D0092329E"><enum>304.</enum><header>Posting of travel and financial disclosure reports on public website of Clerk of the House of Representatives</header> 
<subsection id="H99B86058EF3E45069C794FE288BAA7E"><enum>(a)</enum><header>Requiring Posting on Internet</header><text>The Clerk of the House of Representatives shall post on the public Internet site of the Office of the Clerk, in a format that is searchable, sortable, and downloadable, to the extent technically practicable, each of the following:</text> 
<paragraph id="HF14EAB466E20495ABE4412356BC43602"><enum>(1)</enum><text display-inline="yes-display-inline">The advance authorizations, certifications, and disclosures filed with respect to transportation, lodging, and related expenses for travel under clause 5(b) of rule XXV of the Rules of the House of Representatives by Members (including Delegates and Resident Commissioners to the Congress), officers, and employees of the House.</text></paragraph> 
<paragraph id="H566A88142185496A9E7641F9F22F9B44"><enum>(2)</enum><text display-inline="yes-display-inline">The reports filed under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Ethics in Government Act of 1978 /103">section 103(h)(1)</external-xref> of the Ethics in Government Act of 1978 by Members of the House of Representatives (including Delegates and Resident Commissioners to the Congress).</text></paragraph></subsection> 
<subsection id="HC0D92E5703044956B1CE8E7DD297A3E0"><enum>(b)</enum><header>Applicability and timing</header> 
<paragraph id="H78F917FC77314B29AC3BBDF0DFCE77"><enum>(1)</enum><header>Applicability</header><text>Subject to paragraph (2), subsection (a) shall apply with respect to information received by the Clerk of the House of Representatives on or after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H276CACEBAF3D42BE8EF0F7F135AB92E2"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">The Clerk of the House of Representatives shall—</text> 
<subparagraph id="HBC76F0F719C64215996F9010DE11D598"><enum>(A)</enum><text>not later than August 1, 2008, post the information required by subsection (a) that the Clerk receives by June 1, 2008; and</text></subparagraph> 
<subparagraph id="HFF9095EEA4574748988B9E04EB1395FA"><enum>(B)</enum><text>not later than the end of each 45-day period occurring after information is required to be posted under subparagraph (A), post the information required by subsection (a) that the Clerk has received since the last posting under this subsection.</text></subparagraph></paragraph> 
<paragraph id="H6982CB1B7D7F4C498094005419C1EC05" display-inline="no-display-inline"><enum>(3)</enum><header>Omission of personally identifiable information</header><text display-inline="yes-display-inline">Members of the House of Representatives (including Delegates and Resident Commissioners to the Congress) shall be permitted to omit personally identifiable information not required to be disclosed on the reports posted on the public Internet site under this section (such as home address, Social Security numbers, personal bank account numbers, home telephone, and names of children) prior to the posting of such reports on such public Internet site.</text></paragraph> 
<paragraph id="H9F07E16491BB45C6B576204F13BC2580"><enum>(4)</enum><header>Assistance in protecting personal information</header><text display-inline="yes-display-inline">The Clerk of the House of Representatives, in consultation with the Committee on Standards of Official Conduct, shall include in any informational materials concerning any disclosure that will be posted on the public Internet site under this section an explanation of the procedures for protecting personally identifiable information as described in this section.</text></paragraph></subsection> 
<subsection id="HD5DB684E7E044CD897EA4821435D3D8B"><enum>(c)</enum><header>Retention</header><text>The Clerk shall maintain the information posted on the public Internet site of the Office of the Clerk under this section for a period of 6 years after receiving the information.</text></subsection></section> 
<section id="HA9A5BB21AA6A40B580F9E78054EE9DC2" section-type="subsequent-section" display-inline="no-display-inline"><enum>305.</enum><header>Prohibiting participation in lobbyist-sponsored events during political conventions</header><text display-inline="no-display-inline">Rule XXV of the Rules of the House of Representatives, as amended by section 302, is amended by adding at the end the following new clause: </text> 
<quoted-block style="OLC" id="H0D537996851F4812AE37040166393E97" display-inline="no-display-inline"> 
<paragraph id="H22025661F295438980BA29A6F759F1D2" indent="up1"><enum>8.</enum><text display-inline="yes-display-inline">During the dates on which the national political party to which a Member (including a Delegate or Resident Commissioner) belongs holds its convention to nominate a candidate for the office of President or Vice President, the Member may not participate in an event honoring that Member, other than in his or her capacity as a candidate for such office, if such event is directly paid for by a registered lobbyist under the Lobbying Disclosure Act of 1995 or a private entity that retains or employs such a registered lobbyist. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H473BD3C6ADF045CA83EB9776388D2680"><enum>306.</enum><header>Exercise of rulemaking Authority</header><text display-inline="no-display-inline">The provisions of this title are adopted by the House of Representatives—</text> 
<paragraph id="HC5C64079AE6F43129D9425A1F7ABE235"><enum>(1)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of the House; and</text></paragraph> 
<paragraph id="HC9DE81A6D71847C494AFB70070D1B462"><enum>(2)</enum><text display-inline="yes-display-inline">with full recognition of the constitutional right of the House to change those rules at any time, in the same manner, and to the same extent as in the case of any other rule of the House.</text></paragraph></section></title> 
<title id="H75D6245B11C94603A866094D323E416D"><enum>IV</enum><header>Congressional Pension Accountability</header> 
<section display-inline="no-display-inline" id="HC5457FDDC8DC4C18001491F5F65E007B" section-type="subsequent-section"><enum>401.</enum><header>Loss of pensions accrued during service as a Member of Congress for abusing the public trust</header> 
<subsection id="HF8FAF9FCB7744F6A00BF4C2EB174337"><enum>(a)</enum><header>Civil Service Retirement System</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8332">Section 8332</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H1B2BC43A7CEC48DE98982974A1A5E97E" style="OLC"> 
<subsection id="HA86F2CFB7FA84AF28FA62701F00AAD7"><enum>(o)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H4E53E09F76AA44ADB700AB39DD003779"><enum>(1)</enum><text>Notwithstanding any other provision of this subchapter, the service of an individual finally convicted of an offense described in paragraph (2) shall not be taken into account for purposes of this subchapter, except that this sentence applies only to service rendered as a Member (irrespective of when rendered). Any such individual (or other person determined under section 8342(c), if applicable) shall be entitled to be paid so much of such individual’s lump-sum credit as is attributable to service to which the preceding sentence applies.</text></paragraph> 
<paragraph id="HFA698415BD3F4FEB8EB06B63881BC133" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HD4EA393D8D224D18993339DA2405E8CB"><enum>(A)</enum><text>An offense described in this paragraph is any offense described in subparagraph (B) for which the following apply:</text> 
<clause id="H2C5D7B0804BC49988567B25977F3C818" indent="up1"><enum>(i)</enum><text>Every act or omission of the individual (referred to in paragraph (1)) that is needed to satisfy the elements of the offense occurs while the individual is a Member.</text></clause> 
<clause id="HB0D0A8ECBDFF40B9B589AFE06CCDE4A6" indent="up1"><enum>(ii)</enum><text>Every act or omission of the individual that is needed to satisfy the elements of the offense directly relates to the performance of the individual’s official duties as a Member.</text></clause> 
<clause id="H102A3095A48147B7A9A2591D862BE401" indent="up1"><enum>(iii)</enum><text>The offense is committed after the date of enactment of this subsection.</text></clause></subparagraph> 
<subparagraph id="H1FA02C9ABFA943C58CD7100643FB2F51" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">An offense described in this subparagraph is only the following, and only to the extent that the offense is a felony:</text> 
<clause id="HA71D01B6CF424C689C0067C56D38D637"><enum>(i)</enum><text>An offense under <external-xref legal-doc="usc" parsable-cite="usc/18/201">section 201</external-xref> of title 18 (relating to bribery of public officials and witnesses).</text></clause> 
<clause id="H137728E85DB84D92ADB783C393D73312"><enum>(ii)</enum><text display-inline="yes-display-inline">An offense under <external-xref legal-doc="usc" parsable-cite="usc/18/219">section 219</external-xref> of title 18 (relating to officers and employees acting as agents of foreign principals).</text></clause> 
<clause id="H4EF041EB24E045AEA854BD91B4E6316F" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">An offense under <external-xref legal-doc="usc" parsable-cite="usc/18/1343">section 1343</external-xref> of title 18 (relating to fraud by wire, radio, or television, including as part of a scheme to deprive citizens of honest services thereby).</text></clause> 
<clause id="H023DCC3C55BB40E6A05FFBD7DFF63EDB"><enum>(iv)</enum><text display-inline="yes-display-inline">An offense under section 104(a) of the Foreign Corrupt Practices Act of 1977 (relating to prohibited foreign trade practices by domestic concerns).</text></clause> 
<clause id="HDBA26399802643C58053744122F27BCA"><enum>(v)</enum><text display-inline="yes-display-inline">An offense under <external-xref legal-doc="usc" parsable-cite="usc/18/1957">section 1957</external-xref> of title 18 (relating to engaging in monetary transactions in property derived from specified unlawful activity).</text></clause> 
<clause id="H04671E0E50A74ADFB6D788719CDFD9B0"><enum>(vi)</enum><text display-inline="yes-display-inline">An offense under <external-xref legal-doc="usc" parsable-cite="usc/18/1512">section 1512</external-xref> of title 18 (relating to tampering with a witness, victim, or an informant).</text></clause> 
<clause id="H04B7EDC84D554977B4181CF9C894E063"><enum>(vii)</enum><text display-inline="yes-display-inline">An offense under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/96">chapter 96</external-xref> of title 18 (relating to racketeer influenced and corrupt organizations).</text></clause> 
<clause id="H93A3BB04C7E048729579AE8300BA6601"><enum>(viii)</enum><text display-inline="yes-display-inline">An offense under <external-xref legal-doc="usc" parsable-cite="usc/18/371">section 371</external-xref> of title 18 (relating to conspiracy to commit offense or to defraud United States), to the extent of any conspiracy to commit an act which constitutes—</text> 
<subclause id="H6D320A6A24A9461F9FDB1DFAB0974C03"><enum>(I)</enum><text>an offense under clause (i), (ii), (iii), (iv), (v), (vi), or (vii); or</text></subclause> 
<subclause id="H685CC1FAFFE94C5BB158C6E0E5F8F492"><enum>(II)</enum><text>an offense under <external-xref legal-doc="usc" parsable-cite="usc/18/207">section 207</external-xref> of title 18 (relating to restrictions on former officers, employees, and elected officials of the executive and legislative branches).</text></subclause></clause> 
<clause id="HE29AEC14ACD549D4A9FDB27D3F513469"><enum>(ix)</enum><text>Perjury committed under <external-xref legal-doc="usc" parsable-cite="usc/18/1621">section 1621</external-xref> of title 18 in falsely denying the commission of an act which constitutes—</text> 
<subclause id="HCA2A171D126D4953A31370C2A4BD007E"><enum>(I)</enum><text>an offense under clause (i), (ii), (iii), (iv), (v), (vi), or (vii); or</text></subclause> 
<subclause id="HE172CE9B6F324C7AA2A456B84236A873"><enum>(II)</enum><text>an offense under clause (viii), to the extent provided in such clause.</text></subclause></clause> 
<clause id="H801ABDE69EDE470292645DE2ED21CF74"><enum>(x)</enum><text>Subornation of perjury committed under <external-xref legal-doc="usc" parsable-cite="usc/18/1622">section 1622</external-xref> of title 18 in connection with the false denial or false testimony of another individual as specified in clause (ix).</text></clause></subparagraph></paragraph> 
<paragraph id="HA5653AAED0F649969EC20912BE00CF44" indent="up1"><enum>(3)</enum><text>An individual convicted of an offense described in paragraph (2) shall not, after the date of the final conviction, be eligible to participate in the retirement system under this subchapter or chapter 84 while serving as a Member.</text></paragraph> 
<paragraph id="H5A349553D48040B2AB39CA74E6C7FE04" indent="up1"><enum>(4)</enum><text>The Office of Personnel Management shall prescribe any regulations necessary to carry out this subsection. Such regulations shall include—</text> 
<subparagraph id="H759B52643F16439884BB377447AD008C"><enum>(A)</enum><text>provisions under which interest on any lump-sum payment under the second sentence of paragraph (1) shall be limited in a manner similar to that specified in the last sentence of section 8316(b); and</text></subparagraph> 
<subparagraph id="H62178788AC6C4F9ABE9025E64DB2D806"><enum>(B)</enum><text>provisions under which the Office may provide for—</text> 
<clause id="H7A04C5C9F273480982CE419316489B52"><enum>(i)</enum><text>the payment, to the spouse or children of any individual referred to in the first sentence of paragraph (1), of any amounts which (but for this clause) would otherwise have been nonpayable by reason of such first sentence, subject to paragraph (5); and</text></clause> 
<clause id="H537A37115500483CB142E1159D1D139E"><enum>(ii)</enum><text>an appropriate adjustment in the amount of any lump-sum payment under the second sentence of paragraph (1) to reflect the application of clause (i).</text></clause></subparagraph></paragraph> 
<paragraph id="H9254EABD195F457799AC0081E3DE009F" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Regulations to carry out clause (i) of paragraph (4)(B) shall include provisions to ensure that the authority to make any payment to the spouse or children of an individual under such clause shall be available only to the extent that the application of such clause is considered necessary and appropriate taking into account the totality of the circumstances, including the financial needs of the spouse or children, whether the spouse or children participated in an offense described in paragraph (2) of which such individual was finally convicted, and what measures, if any, may be necessary to ensure that the convicted individual does not benefit from any such payment.</text></paragraph> 
<paragraph id="HB04CEB3C68184AAD8BBB33458072BD94" indent="up1"><enum>(6)</enum><text>For purposes of this subsection—</text> 
<subparagraph id="HB77A55D5B007419F91E8F4E7E6B0557"><enum>(A)</enum><text>the terms <quote>finally convicted</quote> and <quote>final conviction</quote> refer to a conviction (i) which has not been appealed and is no longer appealable because the time for taking an appeal has expired, or (ii) which has been appealed and the appeals process for which is completed; </text></subparagraph> 
<subparagraph id="H9F0C75454D4F4023A083FB9290E7E864"><enum>(B)</enum><text>the term <term>Member</term> has the meaning given such term by section 2106, notwithstanding section 8331(2); and</text></subparagraph> 
<subparagraph id="H6D397B821535410D8D1C4729C5C0001"><enum>(C)</enum><text>the term <term>child</term> has the meaning given such term by section 8341.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8CF672FF72B841EC8C7CD38D7700A0C3"><enum>(b)</enum><header>Federal Employees’ Retirement System</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8411">Section 8411</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H9B8D5189779A48118662AC7136E66962" style="OLC"> 
<subsection id="H271C487AADE94F3B988E78DC417D1D07"><enum>(l)</enum>

<subparagraph id="H38700FC5921D42FBB55071C86EA09DA"><enum>(A)</enum><text>Every act or omission of the individual (referred to in paragraph (1)) that is needed to satisfy the elements of the offense occurs while the individual is a Member.</text></subparagraph> 
<subparagraph id="HC3B273BFBBC34734A200D913A680A493"><enum>(B)</enum><text>Every act or omission of the individual that is needed to satisfy the elements of the offense directly relates to the performance of the individual’s official duties as a Member.</text></subparagraph> 
<subparagraph id="HCD93C3DC64864ADB9397672EC829EF7F"><enum>(C)</enum><text>The offense is committed after the date of enactment of this subsection.</text></subparagraph></paragraph> 
<paragraph id="H1E0E2BAE2A5D42338493A5CF66137900" indent="up1"><enum>(3)</enum><text>An individual convicted of an offense described in paragraph (2) shall not, after the date of the final conviction, be eligible to participate in the retirement system under this chapter while serving as a Member.</text></paragraph> 
<paragraph id="H6F25DD4495D2429CA44652571C7B7DCA" indent="up1"><enum>(4)</enum><text>The Office of Personnel Management shall prescribe any regulations necessary to carry out this subsection. Such regulations shall include—</text>

<subparagraph id="H7B563AF7FFA04BA1A668F6EE18486F00"><enum>(B)</enum><text>provisions under which the Office may provide for—</text> 
<clause id="HD121136339CB497099E447737886E0D2"><enum>(i)</enum><text>the payment, to the spouse or children of any individual referred to in the first sentence of paragraph (1), of any amounts which (but for this clause) would otherwise have been nonpayable by reason of such first sentence, subject to paragraph (5); and</text></clause> 
<clause id="H0C59FA96724B4D9D92D6859EEF0277A0"><enum>(ii)</enum><text>an appropriate adjustment in the amount of any lump-sum payment under the second sentence of paragraph (1) to reflect the application of clause (i).</text></clause></subparagraph></paragraph>

<paragraph id="H6967596687974760A91E68CC48E217E9" indent="up1"><enum>(6)</enum><text>For purposes of this subsection—</text> 
<subparagraph id="HF0D0B493B1D243A3A79572FDF4E3DF60"><enum>(A)</enum><text>the terms <quote>finally convicted</quote> and <quote>final conviction</quote> refer to a conviction (i) which has not been appealed and is no longer appealable because the time for taking an appeal has expired, or (ii) which has been appealed and the appeals process for which is completed; </text></subparagraph>

<subsection id="HAC0AE094460448D3BD00CF0068780872"><enum>(a)</enum><header>Out of scope material amendment</header><text>Rule XXVIII of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="H6C71C7F7774F438D941CF4A999F1522D"><enum>(1)</enum><text>redesignating paragraphs 4 through 6 as paragraphs 6 through 8, respectively; and</text></paragraph> 
<paragraph id="H287FADDD2063430B9172A2FFC4B94205"><enum>(2)</enum><text>striking paragraphs 2 and 3 and inserting the following:</text>

<subsection id="HE1972A7ACFF04E458B2D2643ECDD443"><enum>(c)</enum><text>If new matter is inserted in the report, a point of order may be made against the conference report and it shall be disposed of as provided under paragraph 4.</text></subsection> 
<subsection id="HFF512AFE22DE4F4BB33D9BB2C0743ECB"><enum>3. (a)</enum><text>In any case in which a disagreement to an amendment in the nature of a substitute has been referred to conferees—</text> 
<paragraph id="HB4FD58E6E6A449B8A4206EC79E05684D"><enum>(1)</enum><text>it shall be in order for the conferees to report a substitute on the same subject matter;</text></paragraph> 
<paragraph id="H71FEB57EA36746C7B0FF003B9B7CE76"><enum>(2)</enum><text>the conferees may not include in the report matter not committed to them by either House; and</text></paragraph> 
<paragraph id="H6717D4717C2B48879BB0FD65FAB59018"><enum>(3)</enum><text>the conferees may include in their report in any such case matter which is a germane modification of subjects in disagreement.</text></paragraph></subsection> 
<subsection id="H373593FB6C9F4760BE75A43546A1F235"><enum>(b)</enum><text>In any case in which the conferees violate subparagraph (a), a point of order may be made against the conference report and it shall be disposed of as provided under paragraph 4.</text></subsection> 
<subsection id="H12FE896EB7EA4DFE99009331F9DEF4B"><enum>4. (a)</enum><text>A Senator may raise a point of order that one or more provisions of a conference report violates paragraph 2 or paragraph 3, as the case may be. The Presiding Officer may sustain the point of order as to some or all of the provisions against which the Senator raised the point of order.</text></subsection> 
<subsection id="HD5F57C4448E84D3500439969CF00B7C6"><enum>(b)</enum><text>If the Presiding Officer sustains the point of order as to any of the provisions against which the Senator raised the point of order, then those provisions against which the Presiding Officer sustains the point of order shall be stricken. After all other points of order under this paragraph have been disposed of—</text> 
<paragraph id="H62019B3F3ECD42A58B76FB97F7F3D854"><enum>(1)</enum><text>the Senate shall proceed to consider the question of whether the Senate should recede from its amendment to the House bill, or its disagreement to the amendment of the House, and concur with a further amendment, which further amendment shall consist of only that portion of the conference report that has not been stricken;</text></paragraph> 
<paragraph id="HE79BF63FE12C459DAAE6DAC01215DAC"><enum>(2)</enum><text>the question in clause (1) shall be decided under the same debate limitation as the conference report; and</text></paragraph> 
<paragraph id="H5A62C0657ACF452FB6C5C146AE143E98"><enum>(3)</enum><text>no further amendment shall be in order.</text></paragraph></subsection> 
<subsection id="H9B230FA1A9324F938B8D1C30DB292327"><enum>5. (a)</enum><text>Any Senator may move to waive any or all points of order under paragraph 2 or 3 with respect to the pending conference report by an affirmative vote of three-fifths of the Members, duly chosen and sworn. All motions to waive under this paragraph shall be debatable collectively for not to exceed 1 hour equally divided between the Majority Leader and the Minority Leader or their designees. A motion to waive all points of order under this paragraph shall not be amendable.</text></subsection> 
<subsection id="HE00E0AE88A22447187CEC6754138FF00"><enum>(b)</enum><text>All appeals from rulings of the Chair under paragraph 4 shall be debatable collectively for not to exceed 1 hour, equally divided between the Majority and the Minority Leader or their designees. <paragraph id="H30C04E97C54D428EA848ED7104F9236B"><enum>(1)</enum><header>In general</header><text>Rule XXVIII of the Standing Rules of the Senate is amended by adding at the end the following:</text>

<subsection id="H9FBB3CE0B8F14D8BB42E3E52E2EFD86F"><enum>9. (a)(1)</enum><text>It shall not be in order to vote on the adoption of a report of a committee of conference unless such report has been available to Members and to the general public for at least 48 hours before such vote. If a point of order is sustained under this paragraph, then the conference report shall be set aside.</text></subsection> 
<subsection id="H65C766EDC6954C539C623E9703E96DD1"><enum>(2)</enum><text>For purposes of this paragraph, a report of a committee of conference is made available to the general public as of the time it is posted on a publicly accessible website controlled by a Member, committee, Library of Congress, or other office of Congress, or the Government Printing Office, as reported to the Presiding Officer by the Secretary of the Senate.</text></subsection> 
<subsection id="H39D8D96C759D44649C9347179D8BB396"><enum>(b)(1)</enum><text>This paragraph may be waived in the Senate with respect to the pending conference report by an affirmative vote of three-fifths of the Members, duly chosen and sworn. A motion to waive this paragraph shall be debatable for not to exceed 1 hour equally divided between the Majority Leader and the Minority Leader or their designees.</text></subsection> 
<subsection id="H39B45FBB26764134A7C3F4795D33BA77"><enum>(2)</enum><text>An affirmative vote of three-fifths of the Members, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order raised under this paragraph. An appeal of the ruling of the Chair shall be debatable for not to exceed 1 hour equally divided between the Majority and the Minority Leader or their designees</text></subsection>

<paragraph id="HAABF05BA7FAD48B4BD74F7239BB48454"><enum>(2)</enum><header>Implementation</header><text>Not later than 60 days after the date of enactment of this section, the Committee on Rules and Administration, in consultation with the Secretary of the Senate and the Clerk of the House of Representatives, and the Government Printing Office shall promulgate regulations for the implementation of the requirements of paragraph 9 of rule XXVIII of the Standing Rules of the Senate, as added by this section.</text></paragraph></subsection></section> 
<section id="H1646C0ED0D454E4095A678A7D53C2E29"><enum>512.</enum><header>Notice of objecting to proceeding</header> 
<subsection id="H4A64EF42F6024BDE9745C6FE6BCF9D9"><enum>(a)</enum><header>In general</header><text>The Majority and Minority Leaders of the Senate or their designees shall recognize a notice of intent of a Senator who is a member of their caucus to object to proceeding to a measure or matter only if the Senator—</text> 
<paragraph id="H0C93B7B731D84F2EB4A007D82C6A7C4"><enum>(1)</enum><text>following the objection to a unanimous consent to proceeding to, and, or passage of, a measure or matter on their behalf, submits the notice of intent in writing to the appropriate leader or their designee; and</text></paragraph> 
<paragraph id="H0AFFC442E1744F359B730083B01C4DFB"><enum>(2)</enum><text>not later than 6 session days after the submission under paragraph (1), submits for inclusion in the Congressional Record and in the applicable calendar section described in subsection (b) the following notice:</text></paragraph> 
<paragraph id="H78F53805BE30414287B0D22CE27C7D96" indent="up1"><enum></enum><text><quote>I, Senator ____, intend to object to proceedings to ____, dated ____ for the following reasons____.</quote>.</text></paragraph></subsection> 
<subsection id="HD10DFD2720D247F4B25D6ED111B020A6"><enum>(b)</enum><header>Calendar</header> 
<paragraph id="H2AF3561C02F6435D00DC406047ED428F"><enum>(1)</enum><header>In general</header><text>The Secretary of the Senate shall establish for both the Senate Calendar of Business and the Senate Executive Calendar a separate section entitled <quote>Notice of Intent to Object to Proceeding</quote>.</text></paragraph> 
<paragraph id="H37B1BAC11AAA471000002E00CE5E4900"><enum>(2)</enum><header>Content</header><text>The section required by paragraph (1) shall include—</text>

<subsection id="HCC434D4B90714F7A823C2ECAD250BD6E"><enum>(a)</enum><header>In general</header><text>Paragraph 5(e) of rule XXVI of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="H7FDAB3D05D3C4F2C89161EB84FF3D02"><enum>(1)</enum><text>inserting after <quote>(e)</quote> the following: <quote>(1)</quote>; and</text></paragraph>

<section commented="no" id="HE632B576DBD54CA29000DAF42E7221C"><enum>515.</enum><header>Sense of the Senate on conference committee protocols</header><text display-inline="no-display-inline">It is the sense of the Senate that—</text> 
<paragraph commented="no" id="H60D2BBCA29574F23B9B73B00DE534D82"><enum>(1)</enum><text>conference committees should hold regular, formal meetings of all conferees that are open to the public;</text></paragraph> 
<paragraph commented="no" id="H424F2FB9F4B2462E8CAE26CA958FD4"><enum>(2)</enum><text>all conferees should be given adequate notice of the time and place of all such meetings;</text></paragraph> 
<paragraph commented="no" id="H9AB98B3C1B164743AF42E1BBC300D14D"><enum>(3)</enum><text>all conferees should be afforded an opportunity to participate in full and complete debates of the matters that such conference committees may recommend to their respective Houses; and</text></paragraph> 
<paragraph commented="no" id="HB392DE4DFD6B40CB8377D7F59C6FCE9"><enum>(4)</enum><text>the text of a report of a committee of conference shall not be changed after the Senate signature sheets have been signed by a majority of the Senate conferees.</text></paragraph></section></subtitle> 
<subtitle id="H181D6B5F154041ADAF00A6ECD498969C"><enum>B</enum><header>Earmark reform</header> 
<section id="H91191DB6189B43A9904FA74B2B7BE601"><enum>521.</enum><header>Congressionally directed spending</header><text display-inline="no-display-inline">The Standing Rules of the Senate are amended by adding at the end the following:</text>

<subsection id="H671D87B8A1C74D16B3D2B5AF020582BE"><enum>1. (a)</enum><text>It shall not be in order to vote on a motion to proceed to consider a bill or joint resolution reported by any committee unless the chairman of the committee of jurisdiction or the Majority Leader or his or her designee certifies—</text> 
<paragraph id="H8D47CA426BCF4D4498561EBDCA3301AF"><enum>(1)</enum><text>that each congressionally directed spending item, limited tax benefit, and limited tariff benefit, if any, in the bill or joint resolution, or in the committee report accompanying the bill or joint resolution, has been identified through lists, charts, or other similar means including the name of each Senator who submitted a request to the committee for each item so identified; and</text></paragraph> 
<paragraph id="H2B991E6D40F9470ABB2026A523DE07D0"><enum>(2)</enum><text>that the information in clause (1) has been available on a publicly accessible congressional website in a searchable format at least 48 hours before such vote.</text></paragraph></subsection> 
<subsection id="HDED53099FD6443DEACFFA0F9E7F3769"><enum>(b)</enum><text>If a point of order is sustained under this paragraph, the motion to proceed shall be suspended until the sponsor of the motion or his or her designee has requested resumption and compliance with this paragraph has been achieved.</text></subsection> 
<subsection id="HDE273A4B7D8B488DACB8246F008536C7"><enum>2. (a)</enum><text>It shall not be in order to vote on a motion to proceed to consider a Senate bill or joint resolution not reported by committee unless the chairman of the committee of jurisdiction or the Majority Leader or his or her designee certifies—</text>

<paragraph id="H0C73291268AF4277883FCBFD64CE5199"><enum>(2)</enum><text>that the information in clause (1) has been available on a publicly accessible congressional website in a searchable format at least 48 hours before such vote.</text></paragraph></subsection> 
<subsection id="HDA3CDF6496E14363A1F88E6129164CE8"><enum>(b)</enum><text>If a point of order is sustained under this paragraph, the motion to proceed shall be suspended until the sponsor of the motion or his or her designee has requested resumption and compliance with this paragraph has been achieved.</text></subsection> 
<subsection id="H77C721AB3B0644AA9FF33FCC92F959A8"><enum>3. (a)</enum><text>It shall not be in order to vote on the adoption of a report of a committee of conference unless the chairman of the committee of jurisdiction or the Majority Leader or his or her designee certifies—</text> 
<paragraph id="HA197CBFE18984977A38FDCB866E6BD8B"><enum>(1)</enum><text>that each congressionally directed spending item, limited tax benefit, and limited tariff benefit, if any, in the conference report, or in the joint statement of managers accompanying the conference report, has been identified through lists, charts, or other means, including the name of each Senator who submitted a request to the committee of jurisdiction for each item so identified; and</text></paragraph> 
<paragraph id="H287411E26C264D38AF5827BCE2E6169"><enum>(2)</enum><text>that the information in clause (1) has been available on a publicly accessible congressional website at least 48 hours before such vote.</text></paragraph></subsection> 
<subsection id="H0EBE32B3E033477DA4EB86ED95DF3C20"><enum>(b)</enum><text>If a point of order is sustained under this paragraph, then the conference report shall be set aside.</text></subsection> 
<subsection id="HA901DECD8D734E2CA21272F1B515C9FA"><enum>4. (a)</enum><text>If during consideration of a bill or joint resolution, a Senator proposes an amendment containing a congressionally directed spending item, limited tax benefit, or limited tariff benefit which was not included in the bill or joint resolution as placed on the calendar or as reported by any committee, in a committee report on such bill or joint resolution, or a committee report of the Senate on a companion measure, then as soon as practicable, the Senator shall ensure that a list of such items (and the name of any Senator who submitted a request to the Senator for each respective item included in the list) is printed in the Congressional Record.</text></subsection> 
<subsection id="H77998F23AC534586BD22B92EDACE8DE3"><enum>(b)</enum><text>If a committee reports a bill or joint resolution that includes congressionally directed spending items, limited tax benefits, or limited tariff benefits in the bill or joint resolution, or in the committee report accompanying the bill or joint resolution, the committee shall as soon as practicable identify on a publicly accessible congressional website each such item through lists, charts, or other similar means, including the name of each Senator who submitted a request to the committee for each item so identified. Availability on the Internet of a committee report that contains the information described in this subparagraph shall satisfy the requirements of this subparagraph.</text></subsection> 
<subsection id="H76A9A9D3FE9647D7BA00FC4088B8C29"><enum>(c)</enum><text>To the extent technically feasible, information made available on publicly accessible congressional websites under paragraphs 3 and 4 shall be provided in a searchable format.</text></subsection> 
<subsection id="HB2EDE6B17B4A420999A12FD8DEB81DCA"><enum>5.</enum><text>For the purpose of this rule—</text> 
<paragraph id="H78AD954BD8954A5D811591F8342132A"><enum>(a)</enum><text>the term <term>congressionally directed spending item</term> means a provision or report language included primarily at the request of a Senator providing, authorizing, or recommending a specific amount of discretionary budget authority, credit authority, or other spending authority for a contract, loan, loan guarantee, grant, loan authority, or other expenditure with or to an entity, or targeted to a specific State, locality or Congressional district, other than through a statutory or administrative formula-driven or competitive award process;</text></paragraph> 
<paragraph id="H2542E95D7F36447797C7DD8C00F513E5"><enum>(b)</enum><text>the term <term>limited tax benefit</term> means—</text> 
<subparagraph id="H1DE5793931E943068D9EAA7D49E3DA38"><enum>(1)</enum><text>any revenue provision that—</text> 
<clause id="H1EDF407F245D4077B94B398499C6212E"><enum>(A)</enum><text>provides a Federal tax deduction, credit, exclusion, or preference to a particular beneficiary or limited group of beneficiaries under the Internal Revenue Code of 1986; and</text></clause> 
<clause id="H9D6EC4C44DD6485AB152818EF956BBC3"><enum>(B)</enum><text>contains eligibility criteria that are not uniform in application with respect to potential beneficiaries of such provision;</text></clause></subparagraph></paragraph> 
<paragraph id="H278C1BC3E8A647908817AA9BA562C700"><enum>(c)</enum><text>the term <term>limited tariff benefit</term> means a provision modifying the Harmonized Tariff Schedule of the United States in a manner that benefits 10 or fewer entities; and</text></paragraph> 
<paragraph id="H73C65E91484745B7A15DAF5083ABD0DC"><enum>(d)</enum><text>except as used in subparagraph 8(e), the term <term>item</term> when not preceded by <term>congressionally directed spending</term> means any provision that is a congressionally directed spending item, a limited tax benefit, or a limited tariff benefit.</text></paragraph></subsection> 
<subsection id="HB8FE00E7B546467AA58036C500768E00"><enum>6. (a)</enum><text>A Senator who requests a congressionally directed spending item, a limited tax benefit, or a limited tariff benefit in any bill or joint resolution (or an accompanying report) or in any conference report (or an accompanying joint statement of managers) shall provide a written statement to the chairman and ranking member of the committee of jurisdiction, including—</text> 
<paragraph id="H9D7AC1E2837D42948F679D22C100A824"><enum>(1)</enum><text>the name of the Senator;</text></paragraph> 
<paragraph id="H384C72B8402F410600644DF96807CBF4"><enum>(2)</enum><text>in the case of a congressionally directed spending item, the name and location of the intended recipient or, if there is no specifically intended recipient, the intended location of the activity;</text></paragraph> 
<paragraph id="H61757462D9724BB290306F5EE34600B9"><enum>(3)</enum><text>in the case of a limited tax or tariff benefit, identification of the individual or entities reasonably anticipated to benefit, to the extent known to the Senator;</text></paragraph> 
<paragraph id="HD2C7B56FFB3D414BB886D14D1D24F9EB"><enum>(4)</enum><text>the purpose of such congressionally directed spending item or limited tax or tariff benefit; and</text></paragraph> 
<paragraph id="H42C0FD9AADAF43699B378D2202C5768"><enum>(5)</enum><text>a certification that neither the Senator nor the Senator's immediate family has a pecuniary interest in the item, consistent with the requirements of paragraph 9.</text></paragraph></subsection> 
<subsection id="HC4ED130E2ABF4A40A69F153301BCAEF5"><enum>(b)</enum><text>With respect to each item included in a Senate bill or joint resolution (or accompanying report) reported by committee or considered by the Senate, or included in a conference report (or joint statement of managers accompanying the conference report) considered by the Senate, each committee of jurisdiction shall make available for public inspection on the Internet the certifications under subparagraph (a)(5) as soon as practicable.</text></subsection> 
<subsection id="H92327BBD61EE43498EDD357BC8B05358"><enum>7.</enum><text>In the case of a bill, joint resolution, or conference report that contains congressionally directed spending items in any classified portion of a report accompanying the measure, the committee of jurisdiction shall, to the greatest extent practicable, consistent with the need to protect national security (including intelligence sources and methods), include on the list required by paragraph 1, 2, or 3 as the case may be, a general program description in unclassified language, funding level, and the name of the sponsor of that congressionally directed spending item.</text></subsection> 
<subsection id="H4888ADD0CB6046EE8CA49E3D3B5BB1D"><enum>8. (a)</enum><text>A Senator may raise a point of order against one or more provisions of a conference report if they constitute new directed spending provisions. The Presiding Officer may sustain the point of order as to some or all of the provisions against which the Senator raised the point of order.</text></subsection> 
<subsection id="HB7A695420FEF41ABA2E5FA6D85F5697"><enum>(b)</enum><text>If the Presiding Officer sustains the point of order as to any of the provisions against which the Senator raised the point of order, then those provisions against which the Presiding Officer sustains the point of order shall be stricken. After all other points of order under this paragraph have been disposed of—</text> 
<paragraph id="HAEBF69D411FB4261A334A97193A5AC58"><enum>(1)</enum><text>the Senate shall proceed to consider the question of whether the Senate should recede from its amendment to the House bill, or its disagreement to the amendment of the House, and concur with a further amendment, which further amendment shall consist of only that portion of the conference report that has not been stricken; and</text></paragraph> 
<paragraph id="H9D07D475509C47058875822202E4A483"><enum>(2)</enum><text>the question in clause (1) shall be decided under the same debate limitation as the conference report and no further amendment shall be in order.</text></paragraph></subsection> 
<subsection id="H3735D491AD484369B2B7C4511885F556"><enum>(c)</enum><text>Any Senator may move to waive any or all points of order under this paragraph with respect to the pending conference report by an affirmative vote of three-fifths of the Members, duly chosen and sworn. All motions to waive under this paragraph shall be debatable collectively for not to exceed 1 hour equally divided between the Majority Leader and the Minority Leader or their designees. A motion to waive all points of order under this paragraph shall not be amendable.</text></subsection> 
<subsection id="HF24B120E34E24A62BA3F975B7841DBC5"><enum>(d)</enum><text>All appeals from rulings of the Chair under this paragraph shall be debatable collectively for not to exceed 1 hour, equally divided between the Majority and the Minority Leader or their designees. An affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, shall be required in the Senate to sustain an appeal of the ruling of the Chair under this paragraph.</text></subsection> 
<subsection id="H3E8E016E1B6C4AD5B4347584052C47D7"><enum>(e)</enum><text>The term <term>new directed spending provision</term> as used in this paragraph means any item that consists of a specific provision containing a specific level of funding for any specific account, specific program, specific project, or specific activity, when no specific funding was provided for such specific account, specific program, specific project, or specific activity in the measure originally committed to the conferees by either House.</text></subsection> 
<subsection id="HAA09234ADD894079BB356EB1D46388B1"><enum>9.</enum><text>No Member, officer, or employee of the Senate shall knowingly use his official position to introduce, request, or otherwise aid the progress or passage of congressionally directed spending items, limited tax benefits, or limited tariff benefits a principal purpose of which is to further only his pecuniary interest, only the pecuniary interest of his immediate family, or only the pecuniary interest of a limited class of persons or enterprises, when he or his immediate family, or enterprises controlled by them, are members of the affected class.</text></subsection> 
<subsection id="HF347335F31EB4E5D9BDFE055AC72241F"><enum>10.</enum><text>Any Senator may move to waive application of paragraph 1, 2, or 3 with respect to a measure by an affirmative vote of three-fifths of the Members, duly chosen and sworn. A motion to waive under this paragraph with respect to a measure shall be debatable for not to exceed 1 hour equally divided between the Majority Leader and the Minority Leader or their designees. With respect to points of order raised under paragraphs 1, 2, or 3, only one appeal from a ruling of the Chair shall be in order, and debate on such an appeal from a ruling of the Chair on such point of order shall be limited to one hour.</text></subsection> 
<subsection id="H1FC63BEDC49149EA80FD00A2C355DB7"><enum>11.</enum><text>Any Senator may move to waive all points of order under this rule with respect to the pending measure or motion by an affirmative vote of three-fifths of the Members, duly chosen and sworn. All motions to waive all points of order with respect to a measure or motion as provided by this paragraph shall be debatable collectively for not to exceed 1 hour equally divided between the Majority Leader and the Minority Leader or their designees. A motion to waive all points of order with respect to a measure or motion as provided by this paragraph shall not be amendable.</text></subsection> 
<subsection id="H61ACF2030FCE45AABFCB5DCE649139C8"><enum>12.</enum><text>Paragraph 1, 2, or 3 of this rule may be waived by joint agreement of the Majority Leader and the Minority Leader of the Senate upon their certification that such waiver is necessary as a result of a significant disruption to Senate facilities or to the availability of the Internet.</text></subsection></appropriations-intermediate></section></appropriations-major><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle> 
<subtitle id="H9839D55EECC140FDB145E2BC92BB98D"><enum>C</enum><header>Revolving door reform</header> 
<section id="H51D7122135FD4DD6923FC7E85FFFA18"><enum>531.</enum><header>Post-employment restrictions</header> 
<subsection id="H1061C6B57DD74F73952CF0F8445229CA"><enum>(a)</enum><header>Application to entity</header><text>Paragraph 8 of rule XXXVII of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="HBA7344F854F84F8682970630718416A2"><enum>(1)</enum><text>inserting after <quote>by such a registered lobbyist</quote> the following <quote>or an entity that employs or retains a registered lobbyist</quote>; and</text></paragraph> 
<paragraph id="H8BD693E4D80E468F96F1E51227752C6"><enum>(2)</enum><text>striking <quote>one year</quote> and inserting <quote>2 years</quote>.</text></paragraph></subsection> 
<subsection id="HE724D5DA51C844269FF6898FD33BADEB"><enum>(b)</enum><header>Prohibition</header><text>Paragraph 9 of rule XXXVII of the Standing Rules of the Senate is amended—</text> 
<paragraph id="HA17650632F594FE398BA079C5C72F3FA"><enum>(1)</enum><text>in the first sentence, by inserting after <quote>by such a registered lobbyist</quote> the following: <quote>or an entity that employs or retains a registered lobbyist</quote>;</text></paragraph>

<subsection id="H9DFD3763A1B1430DBE1B817DBB773BFA"><enum>(c)</enum><text>If an officer of the Senate or an employee on the staff of a Member or on the staff of a committee whose rate of pay is equal to or greater than 75 percent of the rate of pay of a Member and employed at such rate for more than 60 days in a calendar year, upon leaving that position, becomes a registered lobbyist, or is employed or retained by such a registered lobbyist or an entity that employs or retains a registered lobbyist for the purpose of influencing legislation, such employee may not lobby any Member, officer, or employee of the Senate for a period of 1 year after leaving that position.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6D0BDF9FD3DE4602AB00EEB1564F6CA"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">Paragraph 9(c) of rule XXXVII of the Standing Rules of the Senate shall apply to individuals who leave office or employment to which such paragraph applies on or after the date of adjournment of the first session of the 110th Congress sine die or December 31, 2007, whichever date is earlier.</text></subsection></section> 
<section id="HE20FEAEFE1AA4F389D66D99861C8003F"><enum>532.</enum><header>Disclosure by Members of Congress and staff of employment negotiations</header><text display-inline="no-display-inline">Rule XXXVII of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="HB0B86AC0289448D4B94F972BA1B9B54E"><enum>(1)</enum><text display-inline="yes-display-inline">redesignating paragraph 12 as paragraph 13; and</text></paragraph>

(a)</enum><text>A Member shall not negotiate or have any arrangement concerning prospective private employment until after his or her successor has been elected, unless such Member files a signed statement with the Secretary of the Senate, for public disclosure, regarding such negotiations or arrangements not later than 3 business days after the commencement of such negotiation or arrangement, including the name of the private entity or entities involved in such negotiations or arrangements, and the date such negotiations or arrangements commenced.</text></subsection> 
<subsection id="H8736E410C0E04C148C9210F189A545A3"><enum>(b)</enum><text>A Member shall not negotiate or have any arrangement concerning prospective employment for a job involving lobbying activities as defined by the Lobbying Disclosure Act of 1995 until after his or her successor has been elected.</text></subsection> 
<subsection id="HBC7DB8FF75EA4E0600E36129CDA7F06C"><enum>(c)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H846EBA1BB36D4FF3A180F38EF173BCE7"><enum>(1)</enum><text>An employee of the Senate earning in excess of 75 percent of the salary paid to a Senator shall notify the Select Committee on Ethics that he or she is negotiating or has any arrangement concerning prospective private employment.</text></paragraph> 
<paragraph id="H7ADE88722B014F1CAAE35BCF95E2D643" indent="up1"><enum>(2)</enum><text>The notification under this subparagraph shall be made not later than 3 business days after the commencement of such negotiation or arrangement.</text></paragraph> 
<paragraph id="H2A5CF9D019514444B4A28700004BCF00" indent="up1"><enum>(3)</enum><text>An employee to whom this subparagraph applies shall—</text> 
<subparagraph id="H81BF0DB58FCF4A9E8F44DF6E63CBC97E"><enum>(A)</enum><text>recuse himself or herself from—</text> 
<clause id="H826078CC762A44EFA270B7142899C35E"><enum>(i)</enum><text>any contact or communication with the prospective employer on issues of legislative interest to the prospective employer; and</text></clause> 
<clause id="H78D7767D1D714BE9A53DB94800350053"><enum>(ii)</enum><text>any legislative matter in which there is a conflict of interest or an appearance of a conflict for that employee under this subparagraph; and</text></clause></subparagraph> 
<subparagraph id="H9E4B6A866CFC4A42A8D15EDCF902000"><enum>(B)</enum><text>notify the Select Committee on Ethics of such recusal.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H20A1F3AAC07F4391B6FA2790534383F1"><enum>533.</enum><header>Elimination of floor privileges for former Members, Senate officers, and Speakers of the House who are registered lobbyists or seek financial gain</header><text display-inline="no-display-inline">Rule XXIII of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="H66EEAC6DF93A42E3B564DA119782D65B"><enum>(1)</enum><text>inserting <quote>1.</quote> before <quote>Other</quote>;</text></paragraph> 
<paragraph id="H79A8905C52394D7D9E6062C959770BB"><enum>(2)</enum><text>inserting after <quote>Ex-Senators and Senators-elect</quote> the following: <quote>, except as provided in paragraph 2</quote>;</text></paragraph> 
<paragraph id="H2A3E955C1DBF4899B677F519C22E9113"><enum>(3)</enum><text>inserting after <quote>Ex-Secretaries and ex-Sergeants at Arms of the Senate</quote> the following: <quote>, except as provided in paragraph 2</quote>;</text></paragraph> 
<paragraph id="H8E1109FB199D4D63BC062436686FA67B"><enum>(4)</enum><text>inserting after <quote>Ex-Speakers of the House of Representatives</quote> the following: <quote>, except as provided in paragraph 2</quote>; and</text></paragraph>

<paragraph commented="no" display-inline="yes-display-inline" id="HF751EBF3B7E440F5B311A1F68BCC4300"><enum>(a)</enum><text>The floor privilege provided in paragraph 1 shall not apply, when the Senate is in session, to an individual covered by this paragraph who is—</text></paragraph> 
<paragraph id="H02A78A44808C45B899B8369C8C998C94"><enum>(1)</enum><text>a registered lobbyist or agent of a foreign principal; or</text></paragraph> 
<paragraph commented="no" id="H7F77FA48C0A14A2B99007682903C7C79"><enum>(2)</enum><text>in the employ of or represents any party or organization for the purpose of influencing, directly or indirectly, the passage, defeat, or amendment of any Federal legislative proposal.</text></paragraph></subsection> 
<subsection id="H2C803EEDDDF0418EB84DA49C19002031"><enum>(b)</enum><text>The Committee on Rules and Administration may promulgate regulations to allow individuals covered by this paragraph floor privileges for ceremonial functions and events designated by the Majority Leader and the Minority Leader.</text></subsection> 
<subsection id="HB01EA0916D494EA5B71CCFD6183ED867"><enum>3.</enum><text>A former Member of the Senate may not exercise privileges to use Senate athletic facilities or Member-only parking spaces if such Member is—</text> 
<paragraph id="H2585C4F199A840C484BE005BD100FDC7"><enum>(a)</enum><text>a registered lobbyist or agent of a foreign principal; or</text></paragraph> 
<paragraph commented="no" id="HFB705E98915141B9AEB87161E3A501D9"><enum>(b)</enum><text>in the employ of or represents any party or organization for the purpose of influencing, directly or indirectly, the passage, defeat, or amendment of any Federal legislative proposal.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H0D85A35BDA8649A3832FA7DAAA87E424"><enum>534.</enum><header>Influencing hiring decisions</header><text display-inline="no-display-inline">Rule XLIII of the Standing Rules of the Senate is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HAD9101FBD3C14366B600C92B7CA550EB" style="OLC"> 
<subsection id="H6715051753574B398656F54F433FED15"><enum>6.</enum><text>No Member, with the intent to influence solely on the basis of partisan political affiliation an employment decision or employment practice of any private entity, shall—</text> 
<paragraph id="HB7C8888EA5D74C4E8EC059B4A95F61EB"><enum>(a)</enum><text>take or withhold, or offer or threaten to take or withhold, an official act; or</text></paragraph> 
<paragraph id="H3CF4ACE36F8841868B59907EB5E4954F"><enum>(b)</enum><text>influence, or offer or threaten to influence the official act of another.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H5D012761A4334365A2768E8BEF8B1C8C"><enum>535.</enum><header>Notification of post-employment restrictions</header> 
<subsection id="HC702DB5C584B42009017A316508BC0F1"><enum>(a)</enum><header>In general</header><text>After a Senator or an elected officer of the Senate leaves office or after the termination of employment with the Senate of an employee of the Senate, the Secretary of the Senate shall notify the Member, officer, or employee of the beginning and ending date of the prohibitions that apply to the Member, officer, or employee under rule XXXVII of the Standing Rules of the Senate.</text></subsection> 
<subsection id="HDD55FCE49BBA489C856BB1A500DEE28"><enum>(b)</enum><header>Effective date</header><text>This section shall take effect 60 days after the date of enactment of this Act.</text></subsection></section></subtitle> 
<subtitle id="H3CBB78421763411FBE801289DBB98F38"><enum>D</enum><header>Gift and travel reform</header> 
<section id="H6836D8F4BDDF44D99887A9D034007704"><enum>541.</enum><header>Ban on gifts from registered lobbyists and entities that hire registered lobbyists</header><text display-inline="no-display-inline">Paragraph 1(a)(2) of rule XXXV of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="H6C64187D230349EBB250976CA96F60F7"><enum>(1)</enum><text>inserting <quote>(A)</quote> after <quote>(2)</quote>; and</text></paragraph> 
<paragraph id="HACF9BEBC12E343B78B7C1BF6F7AF7FFD"><enum>(2)</enum><text>adding at the end the following:</text> 
<quoted-block id="H1CAF7C04A0254403B1C43B13C1BBDD45" style="OLC"> 
<subparagraph id="H62D8D1588C2A48D8AAB437AD230CE52" indent="up2"><enum>(B)</enum><text>A Member, officer, or employee may not knowingly accept a gift from a registered lobbyist, an agent of a foreign principal, or a private entity that retains or employs a registered lobbyist or an agent of a foreign principal, except as provided in subparagraphs (c) and (d).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HA5D7BE2B47BE4853A1003954A68EBB1B"><enum>542.</enum><header>National party conventions</header><text display-inline="no-display-inline">Paragraph (1)(d) of rule XXXV of the Standing Rules of the Senate is amended by adding at the end the following:</text> 
<quoted-block id="HA978630B138942FBAE44FA1652065CED" style="OLC"> 
<subsection id="H0B2A20E008354ACA9778F315CBC9E235"><enum></enum><text>(5) During the dates of the national party convention for the political party to which a Member belongs, a Member may not participate in an event honoring that Member, other than in his or her capacity as the party's presidential or vice presidential nominee or presumptive nominee, if such event is directly paid for by a registered lobbyist or a private entity that retains or employs a registered lobbyist.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8A65F110E16B4C38B3ED82DE0670C5FB"><enum>543.</enum><header>Proper valuation of tickets to entertainment and sporting events</header><text display-inline="no-display-inline">Paragraph 1(c)(1) of rule XXXV of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="HCB81D82E054D4ACDA535DDDA1FF9B9B9"><enum>(1)</enum><text display-inline="yes-display-inline">inserting <quote>(A)</quote> before <quote>Anything</quote>; and</text></paragraph> 
<paragraph id="H3AD4339C155E423A9D1600FAE1522E9E"><enum>(2)</enum><text display-inline="yes-display-inline">adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H97E6B92DD6FB44FF9F6FB3A2727B8376" style="OLC"> 
<paragraph id="H32F9EF8C741649B6BAA2004D5CCE00E4"><enum>(B)</enum><text display-inline="yes-display-inline">The market value of a ticket to an entertainment or sporting event shall be the face value of the ticket or, in the case of a ticket without a face value, the value of the ticket with the highest face value for the event, except that if a ticket holder can establish in advance of the event to the Select Committee on Ethics that the ticket at issue is equivalent to another ticket with a face value, then the market value shall be set at the face value of the equivalent ticket. In establishing equivalency, the ticket holder shall provide written and independently verifiable information related to the primary features of the ticket, including, at a minimum, the seat location, access to parking, availability of food and refreshments, and access to venue areas not open to the public. The Select Committee on Ethics may make a determination of equivalency only if such information is provided in advance of the event.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3A75C47296AA48B59EB9D0550DACFB5"><enum>544.</enum><header>Restrictions on registered lobbyist participation in travel and disclosure</header> 
<subsection id="HCF1F4723FFA64457897F9CD1A22BD600"><enum>(a)</enum><header>Prohibition</header><text>Paragraph 2 of rule XXXV of the Standing Rules of the Senate is amended—</text> 
<paragraph id="H7D9DDB051F2740B8B2E158432C3F1342"><enum>(1)</enum><text>in subparagraph (a)(1), by—</text> 
<subparagraph id="H739778F3A8AB4D1CB25D34F0C7DE29B3"><enum>(A)</enum><text>adding after <quote>foreign principal</quote> the following: <quote>or a private entity that retains or employs 1 or more registered lobbyists or agents of a foreign principal</quote>;</text></subparagraph> 
<subparagraph id="HC3615A97FDFF489DB112148086A51343"><enum>(B)</enum><text>striking the dash and inserting <quote>complies with the requirements of this paragraph.</quote>; and</text></subparagraph> 
<subparagraph id="HC917A57EA40F4CFF9DFFF06378796923"><enum>(C)</enum><text>striking clauses (A) and (B);</text></subparagraph></paragraph> 
<paragraph id="HA1CFE3FDE519444BA29F5BCF7981A521"><enum>(2)</enum><text>by redesignating subparagraph (a)(2) as subparagraph (a)(3) and adding after subparagraph (a)(1) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H4436826C261349D4AA826EA795C1EAC5" style="OLC"> 
<paragraph id="H65D24F1D28B746B900F3A9602883BA00" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H159C52B8FFE44261864069CFF9D7841E"><enum>(A)</enum><text>Notwithstanding clause (1), a reimbursement (including payment in kind) to a Member, officer, or employee of the Senate from an individual, other than a registered lobbyist or agent of a foreign principal, that is a private entity that retains or employs 1 or more registered lobbyists or agents of a foreign principal shall be deemed to be a reimbursement to the Senate under clause (1) if—</text> 
<clause id="HE088A583BCBD455F9F058DD6C068C6BE" indent="up1"><enum>(i)</enum><text>the reimbursement is for necessary transportation, lodging, and related expenses for travel to a meeting, speaking engagement, factfinding trip, or similar event described in clause (1) in connection with the duties of the Member, officer, or employee and the reimbursement is provided only for attendance at or participation for 1-day (exclusive of travel time and an overnight stay) at an event described in clause (1); or</text></clause> 
<clause id="H6DEEC1F0F5214C2697CCEB74BB895521" indent="up1"><enum>(ii)</enum><text>the reimbursement is for necessary transportation, lodging, and related expenses for travel to a meeting, speaking engagement, factfinding trip, or similar event described in clause (1) in connection with the duties of the Member, officer, or employee and the reimbursement is from an organization designated under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph> 
<subparagraph id="HC993448FD70D4A089732A33642B4968C" indent="up1"><enum>(B)</enum><text>When deciding whether to preapprove a trip under this clause, the Select Committee on Ethics shall make a determination consistent with regulations issued pursuant to section 544(b) of the Honest Leadership and Open Government Act of 2007. The committee through regulations to implement subclause (A)(i) may permit a longer stay when determined by the committee to be practically required to participate in the event, but in no event may the stay exceed 2 nights.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6A1267848E5B408BA28CAD7C9F6892F1"><enum>(3)</enum><text>in subparagraph (a)(3), as redesignated, by striking <quote>clause (1)</quote> and inserting <quote>clauses (1) and (2)</quote>;</text></paragraph> 
<paragraph id="H6F9AC0281D884BE4836EFACDFF68B5BF"><enum>(4)</enum><text>in subparagraph (b), by inserting before <quote>Each</quote> the following: <quote>Before an employee may accept reimbursement pursuant to subparagraph (a), the employee shall receive advance written authorization from the Member or officer under whose direct supervision the employee works.</quote>;</text></paragraph> 
<paragraph id="H849869A7BAC8414A935C9244382F5796"><enum>(5)</enum><text>in subparagraph (c)—</text> 
<subparagraph id="H102D6708D5194D9CB30937473655A54C"><enum>(A)</enum><text>by inserting before <quote>Each</quote> the following: <quote>Each Member, officer, or employee that receives reimbursement under this paragraph shall disclose the expenses reimbursed or to be reimbursed, the authorization under subparagraph (b) (for an employee), and a copy of the certification in subparagraph (e)(1) to the Secretary of the Senate not later than 30 days after the travel is completed.</quote>;</text></subparagraph> 
<subparagraph id="H740F29D4C02C40BFADE25832535684F1"><enum>(B)</enum><text>by striking <quote>subparagraph (a)(1)</quote> and inserting <quote>this subparagraph</quote>;</text></subparagraph> 
<subparagraph id="H8459F3DEF5CF48A7B79CE19200714FC6"><enum>(C)</enum><text>in clause (5), by striking <quote>and</quote> after the semicolon;</text></subparagraph> 
<subparagraph id="H004C538EC68E4DF186DCB23401147CE"><enum>(D)</enum><text>by redesignating clause (6) as clause (7); and</text></subparagraph> 
<subparagraph id="H530DEDF462FD4AE9959CB3452F1526B7"><enum>(E)</enum><text>by inserting after clause (5) the following:</text>

<paragraph id="H4699CEEB0B4F47A7B6A7E93BE8F26BFF"><enum>(7)</enum><text>by adding after subparagraph (c) the following:</text> 
<quoted-block id="H66EBBC7278174C37A5FD999CA675374" style="OLC"> 
<subsection id="HB54E965C7EBB4AE0B821277FA33FBE"><enum>(d)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H1BCC93D912164D3991471F92EE0B105"><enum>(1)</enum><text>A Member, officer, or employee of the Senate may not accept a reimbursement (including payment in kind) for transportation, lodging, or related expenses under subparagraph (a) for a trip that was—</text> 
<subparagraph id="H3F8C8ED04946410284FCDDDC9FCDBBB0" indent="up1"><enum>(A)</enum><text>planned, organized, or arranged by or at the request of a registered lobbyist or agent of a foreign principal; or</text></subparagraph> 
<subparagraph id="H3986D8984033421C83D500BC8D4C0000" indent="up1"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H9BFC4B85B4F94DB0849EC88C6650EAD2"><enum>(i)</enum><text>for trips described under subparagraph (a)(2)(A)(i) on which a registered lobbyist accompanies the Member, officer, or employee on any segment of the trip; or</text></clause></subparagraph> 
<subparagraph id="HF05E676C6220498D9C7DBFC8C5C5B662" indent="up1"><enum>(ii)</enum><text>for all other trips allowed under this paragraph, on which a registered lobbyist accompanies the Member, officer, or employee at any point throughout the trip.</text></subparagraph></paragraph> 
<paragraph id="H1CB86BDD93C14D12ADAC54A01572FAC" indent="up1"><enum>(2)</enum><text>The Select Committee on Ethics shall issue regulations identifying de minimis activities by registered lobbyists or foreign agents that would not violate this subparagraph.</text></paragraph></subsection> 
<subsection id="H9E51449F41564A33A7331CDFDA917C98"><enum>(e)</enum><text>A Member, officer, or employee shall, before accepting travel otherwise permissible under this paragraph from any source—</text> 
<paragraph id="H662226591B054C98A51900AC2534F24"><enum>(1)</enum><text>provide to the Select Committee on Ethics a written certification from such source that—</text> 
<subparagraph id="H2522534C2A8E4088837591E3E5660045"><enum>(A)</enum><text>the trip will not be financed in any part by a registered lobbyist or agent of a foreign principal;</text></subparagraph> 
<subparagraph id="HBF12CDEE1E2A41CC9ECC58D304A1FFA2"><enum>(B)</enum><text>the source either—</text> 
<clause id="H06C46B82EEBB4516BBC35823E9506984"><enum>(i)</enum><text>does not retain or employ registered lobbyists or agents of a foreign principal and is not itself a registered lobbyist or agent of a foreign principal; or</text></clause> 
<clause id="H8E4522F87FEE48EE93740349BD4078DC"><enum>(ii)</enum><text>certifies that the trip meets the requirements of subclause (i) or (ii) of subparagraph (a)(2)(A);</text></clause></subparagraph> 
<subparagraph id="HC6EC0AB85FF84D3CB65DA4D7CD94DDD"><enum>(C)</enum><text>the source will not accept from a registered lobbyist or agent of a foreign principal or a private entity that retains or employs 1 or more registered lobbyists or agents of a foreign principal, funds earmarked directly or indirectly for the purpose of financing the specific trip; and</text></subparagraph> 
<subparagraph id="H147C824321C2405200DFEB5EDCABE33"><enum>(D)</enum><text>the trip will not in any part be planned, organized, requested, or arranged by a registered lobbyist or agent of a foreign principal and the traveler will not be accompanied on the trip consistent with the applicable requirements of subparagraph (d)(1)(B) by a registered lobbyist or agent of a foreign principal, except as permitted by regulations issued under subparagraph (d)(2); and</text></subparagraph></paragraph> 
<paragraph id="HFB668501976A4582BAFC3D27ACDAD6B6"><enum>(2)</enum><text>after the Select Committee on Ethics has promulgated regulations pursuant to section 544(b) of the Honest Leadership and Open Government Act of 2007, obtain the prior approval of the committee for such reimbursement.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7AF8B2B00C5F465783180033B8787D2E"><enum>(8)</enum><text>by striking subparagraph (g), as redesignated, and inserting the following:</text> 
<quoted-block id="HE4B0FD2B9D9B4016BEBDBD8702C55E3" style="OLC"> 
<subsection id="HF79B287FE3104D49A969FEF59CAE8412"><enum>(g)</enum><text>The Secretary of the Senate shall make all advance authorizations, certifications, and disclosures filed pursuant to this paragraph available for public inspection as soon as possible after they are received, but in no event prior to the completion of the relevant travel.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H524FA7BBB0094CDA8190EEFBA6993B02"><enum>(b)</enum><header>Guidelines</header> 
<paragraph id="H3AC91EFD5B9A4D2FA7201E1698935B68"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (4) and not later than 60 days after the date of enactment of this Act and at annual intervals thereafter, the Select Committee on Ethics shall develop and revise, as necessary—</text> 
<subparagraph id="HD4643A34624A41439C6D958806183416"><enum>(A)</enum><text>guidelines, for purposes of implementing the amendments made by subsection (a), on evaluating a trip proposal and judging the reasonableness of an expense or expenditure, including guidelines related to evaluating—</text> 
<clause id="H58E82D50B4554F8100F9DEA326C4C531"><enum>(i)</enum><text>the stated mission of the organization sponsoring the trip;</text></clause> 
<clause id="HCFCB87764B6544D782D8F717F7569BFA"><enum>(ii)</enum><text>the organization's prior history of sponsoring congressional trips, if any;</text></clause> 
<clause id="H6DB4311A99F74D7C8770BBA08E654C49"><enum>(iii)</enum><text>other educational activities performed by the organization besides sponsoring congressional trips;</text></clause> 
<clause id="H12D0292352804277840044EBC73CBCCD"><enum>(iv)</enum><text>whether any trips previously sponsored by the organization led to an investigation by the Select Committee on Ethics;</text></clause> 
<clause id="HFE762BFE40CC45C69B6663AC627FCA4"><enum>(v)</enum><text>whether the length of the trip and the itinerary is consistent with the official purpose of the trip;</text></clause> 
<clause id="H579316FD925F41D3B34359BC6F7D30A3"><enum>(vi)</enum><text>whether there is an adequate connection between a trip and official duties;</text></clause> 
<clause id="H2A9786EAA496485783DE684CF465F445"><enum>(vii)</enum><text>the reasonableness of an amount spent by a sponsor of the trip;</text></clause> 
<clause id="HA54ADEFE64254A2EBE5318BF8745B01"><enum>(viii)</enum><text>whether there is a direct and immediate relationship between a source of funding and an event; and</text></clause> 
<clause id="HC98DC14139FB4E079E6B04F9C4FC9CA"><enum>(ix)</enum><text>any other factor deemed relevant by the Select Committee on Ethics; and</text></clause></subparagraph> 
<subparagraph id="H625CA95FB95745F1A7B8AE25CB44B6A"><enum>(B)</enum><text>regulations describing the information it will require individuals subject to the requirements of the amendments made by subsection (a) to submit to the committee in order to obtain the prior approval of the committee for travel under paragraph 2 of rule XXXV of the Standing Rules of the Senate, including any required certifications.</text></subparagraph></paragraph> 
<paragraph id="H5F3C86C3EBEA41DFB28DEFE57B97606F"><enum>(2)</enum><header>Consideration</header><text>In developing and revising guidelines under paragraph (1)(A), the committee shall take into account the maximum per diem rates for official Federal Government travel published annually by the General Services Administration, the Department of State, and the Department of Defense.</text></paragraph> 
<paragraph id="H03B3E1ACAF0B438FBFAF0636CCD1C2AC"><enum>(3)</enum><header>Unreasonable expense</header><text>For purposes of this subsection, travel on a flight described in paragraph 1(c)(1)(C)(ii) of rule XXXV of the Standing Rules of the Senate shall not be considered to be a reasonable expense.</text></paragraph> 
<paragraph id="H411B037DC97D4646922F366B03DC46F8"><enum>(4)</enum><header>Extension</header><text>The deadline for the initial guidelines required by paragraph (1) may be extended for 30 days by the Committee on Rules and Administration.</text></paragraph></subsection> 
<subsection id="HAA42CF5BB569448D8CAB6425AC2942F2"><enum>(c)</enum><header>Reimbursement for Noncommercial Air Travel</header> 
<paragraph id="H271F8C95F24C425C994607C49504D05"><enum>(1)</enum><header>Charter rates</header><text>Paragraph 1(c)(1) of rule XXXV of the Standing Rules of the Senate is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE717420F3CDF4DCBA8C537C6F4D600B4" style="OLC"> 
<subparagraph id="H75AF2C2D68814250006168C94D8B2CCA" indent="up1"><enum>(C)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H99B8E3EBC2824AA2A1859DE351A28099"><enum>(i)</enum><text>Fair market value for a flight on an aircraft described in item (ii) shall be the pro rata share of the fair market value of the normal and usual charter fare or rental charge for a comparable plane of comparable size, as determined by dividing such cost by the number of Members, officers, or employees of Congress on the flight.</text></clause> 
<clause id="H97CE689BA3A047CA95822D2641C100D" indent="up1"><enum>(ii)</enum><text>A flight on an aircraft described in this item is any flight on an aircraft that is not—</text> 
<subclause id="H6039D1DA346844D5B61F5B25D9EC444D"><enum>(I)</enum><text>operated or paid for by an air carrier or commercial operator certificated by the Federal Aviation Administration and required to be conducted under air carrier safety rules; or</text></subclause> 
<subclause id="HB89F507DB4F3458100AA2D4818C80846"><enum>(II)</enum><text>in the case of travel which is abroad, an air carrier or commercial operator certificated by an appropriate foreign civil aviation authority and the flight is required to be conducted under air carrier safety rules.</text></subclause></clause> 
<clause id="H20A436AC526A4F7982F731307CDA41E7" indent="up1"><enum>(iii)</enum><text>This subclause shall not apply to an aircraft owned or leased by a governmental entity or by a Member of Congress or a Member's immediate family member (including an aircraft owned by an entity that is not a public corporation in which the Member or Member's immediate family member has an ownership interest), provided that the Member does not use the aircraft anymore than the Member's or immediate family member's proportionate share of ownership allows.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9C305A4723924713A0195EFE9CA13F44"><enum>(2)</enum><header>Unofficial office accounts</header><text>Paragraph 1 of rule XXXVIII of the Standing Rules of the Senate is amended by adding at the end the following:</text>

<subsection id="HA8DD024CE7394CF08000AC58EAC05CF6"><enum>(c)</enum><text>For purposes of reimbursement under this rule, fair market value of a flight on an aircraft shall be determined as provided in paragraph 1(c)(1)(C) of rule XXXV.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEEEA42FDA77F429DAAACE4AAF2A66BE5"><enum>(d)</enum><header>Review of travel allowances</header><text>Not later than 90 days after the date of enactment of this Act, the Subcommittee on the Legislative Branch of the Senate Committee on Appropriations, in consultation with the Committee on Rules and Administration of the Senate, shall consider and propose, as necessary in the discretion of the subcommittee, any adjustment to the Senator’s Official Personnel and Office Expense Account needed in light of the enactment of this section, and any modifications of Federal statutes or appropriations measures needed to accomplish such adjustments.</text></subsection> 
<subsection commented="no" id="H8D9F86341C774D0AB956963166FDAA49"><enum>(e)</enum><header>Separately regulated expenses</header><text>Nothing in this section or section 541 is meant to alter treatment under law or Senate rules of expenses that are governed by the Foreign Gifts and Decorations Act or the Mutual Educational and Cultural Exchange Act.</text></subsection> 
<subsection commented="no" id="H51033A7D7B344DFB8371003DB72BB9D3"><enum>(f)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (b) shall take effect 60 days after the date of enactment of this Act or the date the Select Committee on Ethics issues new guidelines as required by subsection (b), whichever is later. Subsection (c) shall take effect on the date of enactment of this Act.</text></subsection></section> 
<section id="HE100E38AD3EF471A9410282200B39050"><enum>545.</enum><header>Free attendance at a constituent event</header> 
<subsection id="HBC1A08B4B7804D62B5C32B4BF4D82BFA"><enum>(a)</enum><header>In general</header><text>Paragraph 1(c) of rule XXXV of the Standing Rules of the Senate is amended by adding at the end the following:</text>

<subsection id="H19D2B33C831C4C72A860FFFE15D6E27"><enum>(b)</enum><header>In general</header><text>Paragraph 1 of rule XXXV of the Standing Rules of the Senate is amended by adding at the end the following:</text>

<subsection id="HA0CF5AAFAC2A4698BC3F00D413F5A4D7"><enum>(g)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H5FB0ED5728BB44F088AC00484E243907"><enum>(1)</enum><text>A Member, officer, or employee may accept an offer of free attendance in the Member's home State at a conference, symposium, forum, panel discussion, dinner event, site visit, viewing, reception, or similar event, provided by a sponsor of the event, if—</text> 
<subparagraph id="HC6DF7B25BCDD4B8FB81738BEE0E413F8" indent="up1"><enum>(A)</enum><text>the cost of meals provided the Member, officer, or employee is less than $50;</text></subparagraph> 
<subparagraph id="HE53E71C815454DB2846DA274F7FBB9B6" indent="up1"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HF2319190581546F08B009F0234ED9331"><enum>(i)</enum><text>the event is sponsored by constituents of, or a group that consists primarily of constituents of, the Member (or the Member by whom the officer or employee is employed); and</text></clause> 
<clause id="H6D041EF13EF2427A9BC35FBC63801358" indent="up1"><enum>(ii)</enum><text>the event will be attended primarily by a group of at least 5 constituents of the Member (or the Member by whom the officer or employee is employed) provided that a registered lobbyist shall not attend the event; and</text></clause></subparagraph> 
<subparagraph id="H7AA294982BA14C10B07E2C47825D3B78" indent="up1"><enum>(C)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H1E298979C72B44CB9095003835995CFA"><enum>(i)</enum><text>the Member, officer, or employee participates in the event as a speaker or a panel participant, by presenting information related to Congress or matters before Congress, or by performing a ceremonial function appropriate to the Member’s, officer’s, or employee’s official position; or</text></clause> 
<clause id="HB09F03E33FCD494BB1C065DE8FDE00E5" indent="up1"><enum>(ii)</enum><text>attendance at the event is appropriate to the performance of the official duties or representative function of the Member, officer, or employee.</text></clause></subparagraph></paragraph> 
<paragraph id="H7D9B7319419B4F348C445C46C3B64B09" indent="up1"><enum>(2)</enum><text>A Member, officer, or employee who attends an event described in clause (1) may accept a sponsor’s unsolicited offer of free attendance at the event for an accompanying individual if others in attendance will generally be similarly accompanied or if such attendance is appropriate to assist in the representation of the Senate.</text></paragraph> 
<paragraph id="HBE3D5D5375514AB6B5644B5E47320240" indent="up1"><enum>(3)</enum><text>For purposes of this subparagraph, the term <term>free attendance</term> has the same meaning given such term in subparagraph (d).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HE26863E76E6448668BF2C824AE55F661"><enum>546.</enum><header>Senate privately paid travel public website</header> 
<subsection id="HFF1E1C9BFA44470E9B2341A3ABC8297D"><enum>(a)</enum><header>Travel disclosure</header><text>Not later than January 1, 2008, the Secretary of the Senate shall establish a publicly available website without fee or without access charge, that contains information on travel that is subject to disclosure under paragraph 2 of rule XXXV of the Standing Rules of the Senate, that includes, with respect to travel occurring on or after January 1, 2008—</text> 
<paragraph id="H77F575D546E54A7B83346E42F7AC008D"><enum>(1)</enum><text>a search engine;</text></paragraph> 
<paragraph id="H23C850EEE7004C8384D14E297354A4A3"><enum>(2)</enum><text>uniform categorization by Member, dates of travel, and any other common categories associated with congressional travel; and</text></paragraph> 
<paragraph id="HC2BDD6B7F2F54E3087EA93FD173C0CF"><enum>(3)</enum><text>forms filed in the Senate relating to officially related travel.</text></paragraph></subsection> 
<subsection id="H1F699AF35DEC47A189B5557C07B029E8"><enum>(b)</enum><header>Retention</header><text>The Secretary of the Senate shall maintain the information posted on the public Internet site of the Office of the Secretary under this section for a period not longer than 4 years after receiving the information.</text></subsection> 
<subsection id="HB735A9266161447D8FBD035050010030"><enum>(c)</enum><header>Extension of Authority</header><text>If the Secretary of the Senate is unable to meet the deadline established under subsection (a), the Committee on Rules and Administration of the Senate may grant an extension of the Secretary of the Senate.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HAB876C0B15C74C1497BF0CE3D4FC7BB"><enum>(e)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section></subtitle> 
<subtitle id="HDB6DC40A1B8A47D981A7E0D81EA51F01"><enum>E</enum><header>Other reforms</header> 
<section id="HFEF7B04CC7B946EE89CCAE8553604F33"><enum>551.</enum><header>Compliance with lobbying disclosure</header><text display-inline="no-display-inline">Rule XXXVII of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="H7B9F47D3CAE04FA4B9A580F3F3A9828"><enum>(1)</enum><text>redesignating paragraphs 10 through 13 as paragraphs 11 through 14, respectively; and</text></paragraph> 
<paragraph id="HD5AE6D817A3B4CEFBED33D936D8CD357"><enum>(2)</enum><text>inserting after paragraph 9, the following:</text> 
<quoted-block display-inline="no-display-inline" id="H7CA7C487C725457187306768339E1518" style="OLC"> 
<subsection id="H96D2D8DE25B94928BF1835E090562F9B"><enum></enum><text>10. Paragraphs 8 and 9 shall not apply to contacts with the staff of the Secretary of the Senate regarding compliance with the lobbying disclosure requirements of the Lobbying Disclosure Act of 1995.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H25190EB4C1A74F329EA96E443E967117"><enum>552.</enum><header>Prohibit official contact with spouse or immediate family member of Member who is a registered lobbyist</header><text display-inline="no-display-inline">Rule XXXVII of the Standing Rules of the Senate is amended by—</text> 
<paragraph id="HB8624735C3934DB7A6AE8B98F66EB98"><enum>(1)</enum><text>redesignating paragraphs 11 through 14 as paragraphs 12 through 15, respectively; and</text></paragraph> 
<paragraph id="HCBF470FD83DC4E30A1D9137CD0602595"><enum>(2)</enum><text>inserting after paragraph 10, the following:</text> 
<quoted-block id="H9041C47F1AC34E5B8DEB175EAB6224B" style="OLC"> 
<subsection id="H43C392EA338B445C846B39E4003620F9"><enum></enum><text>11. (a) If a Member’s spouse or immediate family member is a registered lobbyist, or is employed or retained by such a registered lobbyist or an entity that hires or retains a registered lobbyist for the purpose of influencing legislation, the Member shall prohibit all staff employed or supervised by that Member (including staff in personal, committee, and leadership offices) from having any contact with the Member’s spouse or immediate family member that constitutes a lobbying contact as defined by section 3 of the Lobbying Disclosure Act of 1995 by such person.</text></subsection> 
<subsection id="H7D92A9AB69804173B191C525C6A6C8E5"><enum>(b)</enum><text>Members and employees on the staff of a Member (including staff in personal, committee, and leadership offices) shall be prohibited from having any contact that constitutes a lobbying contact as defined by section 3 of the Lobbying Disclosure Act of 1995 by any spouse of a Member who is a registered lobbyist, or is employed or retained by such a registered lobbyist.</text></subsection> 
<subsection id="HF6DB1D72F96649B19F52491175B59F74"><enum>(c)</enum><text>The prohibition in subparagraph (b) shall not apply to the spouse of a Member who was serving as a registered lobbyist at least 1 year prior to the most recent election of that Member to office or at least 1 year prior to his or her marriage to that Member.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3DC9FCC7191E4EEF98D900B315E0C84F"><enum>553.</enum><header>Mandatory Senate ethics training for Members and staff</header> 
<subsection id="H61ED2214D1A5473FBA64F9C284A6096B"><enum>(a)</enum><header>Training program</header><text>The Select Committee on Ethics shall conduct ongoing ethics training and awareness programs for Members of the Senate and Senate staff.</text></subsection> 
<subsection id="H2A01027E6F964D358EF618A2A9591FBD"><enum>(b)</enum><header>Requirements</header><text>The ethics training program conducted by the Select Committee on Ethics shall be completed by—</text> 
<paragraph id="HFE7B6DE43F124F9AA897A1B31CAF846B"><enum>(1)</enum><text>new Senators or staff not later than 60 days after commencing service or employment; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5F815FC15AEB436EBFA4315F0081FB41"><enum>(2)</enum><text>Senators and Senate staff serving or employed on the date of enactment of this Act not later than 165 days after the date of enactment of this Act.</text></paragraph></subsection></section> 
<section id="H43445A2424144FC5BB9926C900BC04C1"><enum>554.</enum><header>Annual report by Select Committee on Ethics</header><text display-inline="no-display-inline">The Select Committee on Ethics of the Senate shall issue an annual report due no later than January 31, describing the following:</text> 
<paragraph id="H0F6AA869F881491C9067A3F5606DA8F6"><enum>(1)</enum><text>The number of alleged violations of Senate rules received from any source, including the number raised by a Senator or staff of the committee.</text></paragraph> 
<paragraph id="H2A4638E7C9A845B88DF644123D55E1FE"><enum>(2)</enum><text>A list of the number of alleged violations that were dismissed—</text> 
<subparagraph id="HC3F0CAD49A0346588CAE979009F1C539"><enum>(A)</enum><text>for lack of subject matter jurisdiction or, in which, even if the allegations in the complaint are true, no violation of Senate rules would exist; or</text></subparagraph> 
<subparagraph id="HA2E1D55E751247C99D485EEC523EFAB9"><enum>(B)</enum><text>because they failed to provide sufficient facts as to any material violation of the Senate rules beyond mere allegation or assertion.</text></subparagraph></paragraph> 
<paragraph id="H23FF34F154984C3B0009031700FE4574"><enum>(3)</enum><text>The number of alleged violations in which the committee staff conducted a preliminary inquiry.</text></paragraph> 
<paragraph id="H80E83643211043C9919431B471086581"><enum>(4)</enum><text>The number of alleged violations that resulted in an adjudicatory review.</text></paragraph> 
<paragraph id="H7108E4F12700470586B3D6035426DB5D"><enum>(5)</enum><text>The number of alleged violations that the committee dismissed for lack of substantial merit.</text></paragraph> 
<paragraph id="H67DF73A714184BF2874300239EAEEA67"><enum>(6)</enum><text>The number of private letters of admonition or public letters of admonition issued.</text></paragraph> 
<paragraph id="H49687844EF914E82B2FFE1BFA1C4B2D"><enum>(7)</enum><text>The number of matters resulting in a disciplinary sanction.</text></paragraph> 
<paragraph id="HB3441E8141A8441B8D9E6F19AAE29D6D"><enum>(8)</enum><text>Any other information deemed by the committee to be appropriate to describe its activities in the preceding year.</text></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H4085F77753AF45E0B65834CF69370056"><enum>555.</enum><header>Exercise of rulemaking powers</header><text display-inline="no-display-inline">The Senate adopts the provisions of this title—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H2002CFE1B33E4EF685076C24DE1600A1"><enum>(1)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of the Senate; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H189FB039E2BD4C8987CEC64EB2FDC600"><enum>(2)</enum><text>with full recognition of the constitutional right of the Senate to change those rules at any time, in the same manner, and to the same extent as in the case of any other rule of the Senate.</text></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H56BA04BDAD044AF29931A547FE25E955" section-type="subsequent-section"><enum>555.</enum><header>Effective date and general provisions</header><text display-inline="no-display-inline">Except as otherwise provided in this title, this title shall take effect on the date of enactment of this title.</text></section></subtitle></title> 
<title id="HD24E1CF0DB144083B7CD674747C5B3A6"><enum>VI</enum><header>Prohibited use of Private Aircraft</header> 
<section id="H167CEF294E0F47AEAE743EE7D626000" section-type="subsequent-section" display-inline="no-display-inline"><enum>601.</enum><header>Restrictions on Use of Campaign Funds for Flights on Noncommercial Aircraft</header> 
<subsection id="H80AC34C5A942467F0067993EF4249059"><enum>(a)</enum><header>Restrictions</header><text>Section 313 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/439a">2 U.S.C. 439a</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HD7370C3EFC3F427BAA75FD24BF01005F" display-inline="no-display-inline"> 
<subsection id="H7AA120CE03794666933C7D6ECB00B197"><enum>(c)</enum><header>Restrictions on Use of Campaign Funds for Flights on Noncommercial Aircraft</header> 
<paragraph id="HD0AB16B71985455DBABE9D22F700D63"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this Act, a candidate for election for Federal office (other than a candidate who is subject to paragraph (2)), or any authorized committee of such a candidate, may not make any expenditure for a flight on an aircraft unless—</text> 
<subparagraph id="HEAEE23F863BB4DFA81B1098B5C7B5EEF"><enum>(A)</enum><text>the aircraft is operated by an air carrier or commercial operator certificated by the Federal Aviation Administration and the flight is required to be conducted under air carrier safety rules, or, in the case of travel which is abroad, by an air carrier or commercial operator certificated by an appropriate foreign civil aviation authority and the flight is required to be conducted under air carrier safety rules; or</text></subparagraph> 
<subparagraph id="H010619361B1641938EA8F7E5BFF7668F"><enum>(B)</enum><text>the candidate, the authorized committee, or other political committee pays to the owner, lessee, or other person who provides the airplane the pro rata share of the fair market value of such flight (as determined by dividing the fair market value of the normal and usual charter fare or rental charge for a comparable plane of comparable size by the number of candidates on the flight) within a commercially reasonable time frame after the date on which the flight is taken.</text></subparagraph></paragraph> 
<paragraph id="HFB0481CDB9B6495086726E88184429D7"><enum>(2)</enum><header>House candidates</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, in the case of a candidate for election for the office of Representative in, or Delegate or Resident Commissioner to, the Congress, an authorized committee and a leadership PAC of the candidate may not make any expenditure for a flight on an aircraft unless—</text> 
<subparagraph id="H8B5ABD14F6244855B524591CB89894AD"><enum>(A)</enum><text display-inline="yes-display-inline">the aircraft is operated by an air carrier or commercial operator certificated by the Federal Aviation Administration and the flight is required to be conducted under air carrier safety rules, or, in the case of travel which is abroad, by an air carrier or commercial operator certificated by an appropriate foreign civil aviation authority and the flight is required to be conducted under air carrier safety rules; or</text></subparagraph> 
<subparagraph id="H45265F48B5094A8B84F4B173BC9300FB"><enum>(B)</enum><text display-inline="yes-display-inline">the aircraft is operated by an entity of the Federal government or the government of any State.</text></subparagraph></paragraph> 
<paragraph id="H52776F735D94444DB6D007DB7CB612FB"><enum>(3)</enum><header>Exception for aircraft owned or leased by candidate</header> 
<subparagraph id="HF781E133E46147A491B1174500D4578C"><enum>(A)</enum><header>In general</header><text>Paragraphs (1) and (2) do not apply to a flight on an aircraft owned or leased by the candidate involved or an immediate family member of the candidate (including an aircraft owned by an entity that is not a public corporation in which the candidate or an immediate family member of the candidate has an ownership interest), so long as the candidate does not use the aircraft more than the candidate's or immediate family member’s proportionate share of ownership allows.</text></subparagraph> 
<subparagraph id="H96CB03BDC43046A3B7EFDD9F005D1599"><enum>(B)</enum><header>Immediate family member defined</header><text display-inline="yes-display-inline">In this subparagraph (A), the term <quote>immediate family member</quote> means, with respect to a candidate, a father, mother, son, daughter, brother, sister, husband, wife, father-in-law, or mother-in-law.</text></subparagraph></paragraph> 
<paragraph id="HE862757293024C739ECDB0F7555C139C"><enum>(4)</enum><header>Leadership PAC defined</header><text>In this subsection, the term <quote>leadership PAC</quote> has the meaning given such term in section 304(i)(8)(B). </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H01FFAF4A26EA4997B5FBFF2F000062F"><enum>(b)</enum><header>Effective Date</header><text>The amendment made by subsection (a) shall apply with respect to flights taken on or after the date of the enactment of this Act.</text></subsection></section></title> 
<title id="HEECEB26712E740C28B456BA17DD7D4EE"><enum>VII</enum><header>Miscellaneous Provisions</header> 
<section id="H35AB8EBB61DA4E35A89760DCEA622A7"><enum>701.</enum><header>Sense of the Congress that any applicable restrictions on congressional officials and employees should apply to the executive and judicial branches</header><text display-inline="no-display-inline">It is the sense of the Congress that any applicable restrictions on congressional officials and employees in this Act should apply to the executive and judicial branches.</text></section> 
<section id="HDCD7E5A050554B3A9335F17E5C326F94"><enum>702.</enum><header>Knowing and willful falsification or failure to report</header><text display-inline="no-display-inline">Section 104(a) of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended—</text> 
<paragraph id="H031954A2D1704AB794C0F13B34E50093"><enum>(1)</enum><text>by inserting <quote>(1)</quote> after <quote>(a)</quote>;</text></paragraph> 
<paragraph id="HF2D5482CA7014ED594B7E29E1F952616"><enum>(2)</enum><text>in paragraph (1), as so designated, by striking <quote>$10,000</quote> and inserting <quote>$50,000</quote>; and</text></paragraph> 
<paragraph id="HABD110A267854FEDA4829DD196F3CFA5"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="H342822C70A7A4627893842293C9ECCA2" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HD175E2C26414445EB1DA6C03EC3BFD20"><enum>(A)</enum><text>It shall be unlawful for any person to knowingly and willfully—</text> 
<clause id="H8E41333929EB4E4FAE2D42C77187EB00" indent="up1"><enum>(i)</enum><text>falsify any information that such person is required to report under section 102; and</text></clause> 
<clause id="HAC218577412341A68B12B4C3CB0020E4" indent="up1"><enum>(ii)</enum><text>fail to file or report any information that such person is required to report under section 102.</text></clause></subparagraph> 
<subparagraph id="HCA2FD5B0368B48729F0562EFE2A6D1D" indent="up1"><enum>(B)</enum><text>Any person who—</text> 
<clause id="H4829E643FFAB4B25B4F5D49C83C57D82"><enum>(i)</enum><text>violates subparagraph (A)(i) shall be fined under title 18, United States Code, imprisoned for not more than 1 year, or both; and</text></clause> 
<clause id="HD81D3C23471B4AF3BC9800C60079B0CE"><enum>(ii)</enum><text>violates subparagraph (A)(ii) shall be fined under title 18, United States Code.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H2665B46CBF7B4B5B00AD446122F2B038" commented="no"><enum>703.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to prohibit any expressive conduct protected from legal prohibition by, or any activities protected by the free speech, free exercise, or free association clauses of, the First Amendment to the Constitution. </text></section></title>
