		<section id="IDd8785af63e994187bad21304726b5dc2" section-type="section-one"><enum>1.</enum><header>Preserving recall rights of
			 airline employees</header>
			<subsection id="IDabd35aac269a43ceb79bc78c432f0854"><enum>(a)</enum><header>Definitions</header><text>In
			 this Act:</text>
				<paragraph id="IDcc17064e2b454780975ef11a1dd5feaf"><enum>(1)</enum><header>Air
			 carrier</header><text>The term <term>air carrier</term> means an air carrier
			 that holds a certificate issued pursuant to chapter 411 of title 49, United
			 States Code.</text>
				</paragraph><paragraph id="IDd0240c22d65f4756917d46ed7b3ea23c"><enum>(2)</enum><header>Covered
			 employee</header><text>The term <term>covered employee</term> means an employee
			 who—</text>
					<subparagraph id="IDc2d7ddf7229f4b2f9da7f951d310daff"><enum>(A)</enum><text>is not a
			 temporary employee; and</text>
					</subparagraph><subparagraph id="IDbdfa79e7f31d420fb63a6c5de782494e"><enum>(B)</enum><text>is a member of a
			 craft or class that is subject to the provisions of the Railway Labor Act (45
			 U.S.C. 151 et seq.).</text>
					</subparagraph></paragraph><paragraph id="IDb9f7096204654a3d8b1a50e3ea8874f7"><enum>(3)</enum><header>Furlough</header><text>The
			 term <term>furlough</term> has the meaning given the term in section 7511 of
			 title 5, United States Code.</text>
				</paragraph><paragraph id="idDBB5BC0FBE7E4AE3BB4E17E37F4D1D2B"><enum>(4)</enum><header>Recall
			 list</header><text>The term <term>recall list</term> means a list of employees
			 placed on furlough by an air carrier and is organized—</text>
					<subparagraph id="id171115FAF13B4BE69AE2D052A614A98E"><enum>(A)</enum><text>by type of
			 employment; and</text>
					</subparagraph><subparagraph id="idE66F0559F0EC4E7888EEC59877AA9BF6"><enum>(B)</enum><text>in descending
			 order of seniority.</text>
					</subparagraph></paragraph></subsection><subsection id="ID77dd6fff89e04224a0e86199dad53de7"><enum>(b)</enum><header>Retention of
			 furloughed employees</header><text>An air carrier that places a covered
			 employee on furlough shall retain such employee on a recall list for not less
			 than 10 years after the date on which the air carrier placed such employee on
			 furlough, if the air carrier—</text>
				<paragraph id="idCF8E31BB1A73417F82A06D307F8C3184"><enum>(1)</enum><text>receives more
			 than $100,000,000 in financial assistance from the Federal Government;
			 and</text>
				</paragraph><paragraph id="id4CE982E676B74B8189803192061B6788"><enum>(2)</enum><text>places such
			 employee on furlough not later than 2 years after receiving such financial
			 assistance.</text>
				</paragraph></subsection><subsection id="ID385cbe261d944c41b6392663d0b4dca6"><enum>(c)</enum><header>Preference</header><text>An
			 air carrier described in subsection (b) shall, before employing a person who is
			 not on the recall list, recall a covered employee from the recall list required
			 by subsection (b) if the employee was employed in a position comparable to the
			 position the air carrier seeks to fill.</text>
			</subsection><subsection id="IDc06f761571dc427eb7db6258cefb26cb"><enum>(d)</enum><header>Enforcement</header>
				<paragraph id="id7531C7AFF7F54BD0AAF6A2AD62D5ABDA"><enum>(1)</enum><header>In
			 general</header><text>A covered employee (including any labor organization that
			 represents such employee) may bring an action to enforce this Act, or the terms
			 of an award or agreement resulting from arbitration or a settlement relating to
			 the requirements of this Act, in an appropriate district court of the United
			 States.</text>
				</paragraph><paragraph id="idB9E0E08CC2DE4AF9955F071CF0CE882E"><enum>(2)</enum><header>Appropriate
			 district court</header><text>The appropriate district court of the United
			 States referred to in paragraph (1) shall be determined in accordance with
			 section 1391 of title 28, United States Code.</text>
				</paragraph></subsection><subsection id="id6D6BAE2AB8094C34A7F414F616261D7C"><enum>(e)</enum><header>Effective
			 date</header>
				<paragraph id="idEC991DC50ECE453595C6CA6BDA931436"><enum>(1)</enum><header>In
			 general</header><text>The provisions of this Act shall take effect on the date
			 of the enactment of this Act.</text>
				</paragraph><paragraph id="idD12A4C06F6A248C1B240544E14DD076C"><enum>(2)</enum><header>Retroactive
			 application</header><text>This Act shall apply to a covered employee of an air
			 carrier, or successor air carrier, that received financial assistance before
			 September 22, 2002, pursuant to section 101(a) of the Air Transportation Safety
			 and System Stabilization Act (49 U.S.C. 40101 note).</text>
				</paragraph></subsection></section></legis-body>
