		<official-title>To amend title 5, United States Code, to deny Federal
		  retirement benefits to individuals convicted of certain offenses, and for other
		  purposes.</official-title>

		<section id="idB7947A98B1174770AE43D652E57E5C47" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Congressional Pension Accountability
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H8F7920D893AE4283B58EA18F9D6657F6" section-type="subsequent-section"><enum>2.</enum><header>Denial of retirement
			 benefits</header>
			<subsection id="H385190BD10FE4172896E952C8193E2D9"><enum>(a)</enum><header>In
			 general</header><text>Section 8312(a) of title 5, United States Code, is
			 amended—</text>
				<paragraph id="H9620C95341BB4652B203004859FCBA29"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of paragraph (1), by striking the period at the
			 end of paragraph (2) and inserting <quote>; or</quote>, and by inserting after
			 paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H487AC16899EF4F2F88C5530095E5365B" style="USC">
						<paragraph id="H2E5B11BFB5A0422B9FEAD3046043A318"><enum>(3)</enum><text>was convicted of
				an offense described in subsection (d), to the extent provided by that
				subsection.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HEADE266D95704221B694E1D50054B1FA"><enum>(2)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (A), by striking the period at
			 the end of subparagraph (B) and inserting <quote>; and</quote>, and by
			 inserting after subparagraph (B) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7A7D9522E8D34AFFA9C39BA4DF5113B9" style="USC">
						<subparagraph id="HE76EC0DD69D548AEBDCF5CE92E86312F" indent="up1"><enum>(C)</enum><text>with respect to the offenses described
				in subsection (d), to the period after the date of
				conviction.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE926FBD6441548989CB13CF178DF2F4F"><enum>(b)</enum><header>Offenses
			 described</header><text>Section 8312 of such title 5 is amended by
			 redesignating subsection (d) as subsection (e), and by inserting after
			 subsection (c) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAE6C5824D08741D2A75FE044E060564C" style="USC">
					<subsection id="H58411FB200BE46AC9572CE59D39048C8"><enum>(d)</enum><text>The offenses to
				which subsection (a)(3) applies are the following:</text>
						<paragraph id="H4160A918AE6C4855A5E6359C06F009C"><enum>(1)</enum><text>An offense within
				the purview of—</text>
							<subparagraph id="H9FFCDEA530684DFD9907A93748D589DC"><enum>(A)</enum><text>section 201 of
				title 18 (bribery of public officials and witnesses); or</text>
							</subparagraph><subparagraph id="HE4E683B4920E4539A98B1C384D5E63D7"><enum>(B)</enum><text>section 371 of
				title 18 (conspiracy to commit offense or to defraud United States), to the
				extent of any conspiracy to commit an act which constitutes an offense within
				the purview of such section 201.</text>
							</subparagraph></paragraph><paragraph id="H8A74D6FFDF85424F86B45810B206D1CA"><enum>(2)</enum><text>Perjury committed
				under the statutes of the United States or the District of Columbia in falsely
				denying the commission of any act which constitutes an offense within the
				purview of a statute named by paragraph (1), but only in the case of the
				statute named by subparagraph (B) of paragraph (1).</text>
						</paragraph><paragraph id="H41D7142CE8B34AFA87B9B28C5B96316B"><enum>(3)</enum><text>Subornation of
				perjury committed in connection with the false denial or false testimony of
				another individual as specified by paragraph (2).</text>
						</paragraph><continuation-text continuation-text-level="subsection">An
				offense shall not be considered to be an offense described in this subsection
				except if or to the extent that it is committed by a Member of Congress (as
				defined by section 2106, including a Delegate to
				Congress).</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8AD89185FD9A498EBAA64C8E642F0006"><enum>(c)</enum><header>Absence from
			 United States to avoid prosecution</header><text>Section 8313(a)(1) of such
			 title 5 is amended by striking <quote>or</quote> at the end of subparagraph
			 (A), by striking <quote>and</quote> at the end of subparagraph (B) and
			 inserting <quote>or</quote>, and by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD5A2822A1E044FABBF5640A732CAB837" style="USC">
					<subparagraph id="HCA9571287C0A4ABD88DB2BFBEE8CF803"><enum>(C)</enum><text>for an offense
				described under subsection (d) of section 8312;
				and</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9B641D2C7FFA40EBAA61AFBFC9CDED70"><enum>(d)</enum><header>Nonaccrual of
			 interest on refunds</header><text>Section 8316(b) of such title 5 is amended by
			 striking <quote>or</quote> at the end of paragraph (1), by striking the period
			 at the end of paragraph (2) and inserting <quote>; or</quote>, and by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAA6F8E4D4CE3454EB973CEB62371BDDE" style="USC">
					<paragraph id="H99BD75D000504E31B1B3001BBFD0911C"><enum>(3)</enum><text>if the individual
				was convicted of an offense described in section 8312(d), for the period after
				the
				conviction.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HCE6FAD006161491E898154232526737C"><enum>3.</enum><header>Constitutional
			 authority</header><text display-inline="no-display-inline">The Constitutional
			 authority for this title is the power of Congress to make all laws which shall
			 be necessary and proper as enumerated in Article I, Section 8 of the United
			 States Constitution, and the power to ascertain compensation for Congressional
			 service under Article I, Section 6 of the United States Constitution.</text>
		</section><section id="idCFDFD8F4F8E640FC8288DB70B53AB81D"><enum>4.</enum><header>Effective
			 Date</header>
			<subsection id="idBC4C5D8A2ABC4381A492ACD80A185193"><enum></enum><text>This Act,
			 including the amendments made by this Act, shall take effect on January 1,
			 2009.</text>
