		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Water Security Act of
			 2007</short-title></quote>.</text>
		</section><section id="id2B046BFF04AE4C3DBA316C9BE3294833"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id3C19E452A10E474EA98B5F421FA29DF3"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
			</paragraph><paragraph id="id5F6F5326501C4E488AC215EBEE9B203F"><enum>(2)</enum><header>Community water
			 system</header><text>The term <term>community water system</term> has the
			 meaning given the term in section 1401 of the Safe Drinking Water Act (42
			 U.S.C. 300f).</text>
			</paragraph><paragraph id="ID117E32C4AEC44F0280FB523529121A54"><enum>(3)</enum><header>Disruption of
			 service event</header><text>The term <term>disruption of service event</term>
			 means a natural disaster or event, or a terrorist attack or other intentional
			 or accidental harmful act, that—</text>
				<subparagraph id="ID6B0AD0E4376E42579880C2EC2EB16C9B"><enum>(A)</enum><text>substantially
			 disrupts the ability of a treatment works or community water system to provide
			 safe and reliable—</text>
					<clause id="ID7E80EF1D983041C1B85BA01EF1CA62F5"><enum>(i)</enum><text>conveyance and
			 treatment of wastewater;</text>
					</clause><clause id="ID80571C11A65E452C82A8BF76C173DF97"><enum>(ii)</enum><text>disposal of
			 effluent;</text>
					</clause><clause id="ID894594B2CE064922991BFF8300403ADE"><enum>(iii)</enum><text>storage of any
			 potentially hazardous chemical used to treat wastewater or drinking water;
			 or</text>
					</clause><clause id="id7CD3D63ADB2C476299D7FC981E4B9D3D"><enum>(iv)</enum><text>distribution of
			 drinking water;</text>
					</clause></subparagraph><subparagraph id="ID5A31AFBF1DC7412B90DFDA28E9A8F999"><enum>(B)</enum><text>damages critical
			 infrastructure associated with a treatment works or community water
			 system;</text>
				</subparagraph><subparagraph id="ID094A9680A3DC4F4188CEBF97D3C750C8"><enum>(C)</enum><text>has a substantial
			 adverse effect on the environment as a result of harm caused to a treatment
			 works or community water system; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF4A86D91BC0746EDB8E8A09CA36B4BB2"><enum>(D)</enum><text>otherwise poses a
			 significant threat to public health or safety as a result of harm caused to a
			 treatment works or community water system.</text>
				</subparagraph></paragraph><paragraph id="idE0327A3558EB4A9881F0B2EFCAADAE30"><enum>(4)</enum><header>Treatment
			 works</header><text>The term <term>treatment works</term> has the meaning given
			 the term in section 212 of the Federal Water Pollution Control Act (33 U.S.C.
			 1292).</text>
			</paragraph></section><section id="IDF34E052BBAFE4DABBFB042297F896A41"><enum>3.</enum><header>Treatment works
			 and community water systems security</header>
			<subsection id="IDCDFAF15E23DF4D9DAF2E598CEE38EF7B"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="IDCC4771E554714CEEB562CA82D02D7FC1"><enum>(1)</enum><header>Emergency
			 response plan</header>
					<subparagraph id="ID0D3B23E4186F4260BE94D4A781D42267"><enum>(A)</enum><header>In
			 general</header><text>The term <term>emergency response plan</term> means a
			 plan or set of plans developed by or in cooperation with a treatment works or
			 community water system that may include the procedures the treatment works or
			 community water system will use when a disruption of service event occurs,
			 including procedures for ensuring continued service and protection of the
			 public health and environment.</text>
					</subparagraph><subparagraph id="ID6C3F2261C9DD45E38ED07F30C0FDE162"><enum>(B)</enum><header>Inclusions</header>
						<clause id="id23070AD1B5F247C987A9BFC70BE03A24"><enum>(i)</enum><header>Publicly owned
			 treatment works</header><text>With respect to a publicly owned treatment works,
			 the term <term>emergency response plan</term> includes a plan or set of plans
			 that may describe, for a case in which a disruption of service event
			 occurs—</text>
							<subclause id="IDDEC24FDCB2554C339C27DEDC9BED65CE"><enum>(I)</enum><text>the means by
			 which a publicly owned treatment works will provide information regarding risks
			 to—</text>
								<item id="ID4C05B23C67A94ADB8DABB007B78AEE57"><enum>(aa)</enum><text>the
			 media;</text>
								</item><item id="IDC35C1DC40B2D4B4A8D10DE1443D1F715"><enum>(bb)</enum><text>municipal
			 emergency personnel;</text>
								</item><item id="ID0957DA3AFF0F40309C080881D2E07A68"><enum>(cc)</enum><text>health
			 officials;</text>
								</item><item id="IDECFEA4E2CC794F20AF733F00A429F184"><enum>(dd)</enum><text>the
			 general public;</text>
								</item><item id="ID4D54E96DF5C94FDBA75AA8BFAC08FE98"><enum>(ee)</enum><text>Federal and
			 State environmental authorities; and</text>
								</item><item id="IDC79D4D41ADF24A4F8889CC39AA1BE34F"><enum>(ff)</enum><text>other
			 potentially impacted water utilities;</text>
								</item></subclause><subclause id="IDE8D1F263A687430099DCC602CCF6447C"><enum>(II)</enum><text>the means by
			 which a publicly owned treatment works will limit contamination of public water
			 supplies, including temporary treatment and other mitigation measures;</text>
							</subclause><subclause id="IDA8ECD4C429674F76B64D4E7C47CD1B5A"><enum>(III)</enum><text>the means by
			 which a publicly owned treatment works will address contaminants entering the
			 treatment works or its collection system, including any contaminants added by
			 emergency response personnel in responding to a natural disaster or terrorist
			 event;</text>
							</subclause><subclause id="ID9D222383298B471DBB5F02E273F64DD6"><enum>(IV)</enum><text>the means by
			 which a publicly owned treatment works will secure backup generation if a loss
			 of power accompanies the disruption of service event; or</text>
							</subclause><subclause id="ID020F7F4E4F014006A7D3FD6C01B78C86"><enum>(V)</enum><text>any additional
			 means of collecting or treating wastewater.</text>
							</subclause></clause><clause id="id745AD6B608924DBCA1FECF96697CBA75"><enum>(ii)</enum><header>Community
			 water system</header><text>With respect to a community water system, the term
			 <term>emergency response plan</term> includes the elements described in section
			 1433(b) of the Safe Drinking Water Act (42 U.S.C. 300i–2(b)).</text>
						</clause></subparagraph><subparagraph id="ID7B5785DFC93E4C43A0F04761BDEE30F6"><enum>(C)</enum><header>Certain other
			 plans</header><text>The term <term>emergency response plan</term> may
			 include—</text>
						<clause id="ID8CD9E1FF7BFD47A09D0249466225682E"><enum>(i)</enum><text>an
			 emergency response plan conducted in accordance with a Federal statute that
			 addresses each element identified under subparagraphs (A) and (B); and</text>
						</clause><clause id="ID3813BD0DC22242A3AC74F6E1CE4A8F8C"><enum>(ii)</enum><text>an
			 emergency response plan in existence on the date of enactment of this Act that
			 is modified to include each element identified under subparagraphs (A) and
			 (B).</text>
						</clause></subparagraph></paragraph><paragraph id="ID3641BCD4F9604DF7BAA1EFBF0310C9EF"><enum>(2)</enum><header>Site security
			 plan</header><text>The term <term>site security plan</term> means a plan for
			 risk reduction or any other plan to implement, to the maximum extent
			 practicable, changes at a treatment works or community water system based on
			 information in a vulnerability assessment to address risks posed by a
			 disruption of service event.</text>
				</paragraph><paragraph id="IDD0790369D8CA43A5B047EB134979FEBE"><enum>(3)</enum><header>Vulnerability
			 assessment</header>
					<subparagraph id="id32DA07B81EB34BF78927F7EBD095996E"><enum>(A)</enum><header>Treatment
			 works</header>
						<clause id="IDC2F97BF9412E46F6B06A378934C3BAE8"><enum>(i)</enum><header>In
			 general</header><text>With respect to a treatment works, the term
			 <term>vulnerability assessment</term> means an assessment of the vulnerability
			 of a treatment works to a disruption of service event.</text>
						</clause><clause id="ID84D5FD7BBACF4DC2874EB079D9105052"><enum>(ii)</enum><header>Inclusions</header><text>With
			 respect to a treatment works, the term <term>vulnerability assessment</term>
			 may include—</text>
							<subclause id="ID4734E0CF415F4D1982FC44FF5FF521D9"><enum>(I)</enum><text>a
			 characterization of the treatment works, including, with respect to the
			 treatment works—</text>
								<item id="IDAD01B0BF7740438FAB58215C5372CCE9"><enum>(aa)</enum><text>mission and
			 objective;</text>
								</item><item id="ID44C0EE761D844BAABE710D5795E08CAD"><enum>(bb)</enum><text>customer
			 base;</text>
								</item><item id="ID1CC50EA427CD4125A52D01971ED8AFF6"><enum>(cc)</enum><text>the
			 facilities that comprise the treatment works, including—</text>
									<subitem id="ID1BE80F9ACB3B410EB7961E1A5CDAAA30"><enum>(AA)</enum><text>the collection
			 system;</text>
									</subitem><subitem id="ID766B1752508A4E69A1A296899408CC00"><enum>(BB)</enum><text>the pumping
			 station;</text>
									</subitem><subitem id="IDFCE9DA30A3EA4E10B5895EBB03D04980"><enum>(CC)</enum><text>the power
			 supply;</text>
									</subitem><subitem id="ID3D91ABE6C1DC4B9296A482944666DDD3"><enum>(DD)</enum><text>electronic and
			 computer systems; and</text>
									</subitem><subitem id="IDF634E22322324D3EA1C81491078CF546"><enum>(EE)</enum><text>chemical
			 containers;</text>
									</subitem></item><item id="ID6E9E458E235B45B2A82276D177327FDE"><enum>(dd)</enum><text>processes;
			 and</text>
								</item><item id="IDEF98959BA3D347C2A2C23089CB51A004"><enum>(ee)</enum><text>assets for
			 achieving treatment works objectives;</text>
								</item></subclause><subclause id="ID6CA9F4CA726647E4B7288306D21C3EB9"><enum>(II)</enum><text>an
			 identification and prioritization of adverse consequences to avoid at the
			 treatment works, including—</text>
								<item id="IDA2EC489C9F314824AD8C100A23CFDA69"><enum>(aa)</enum><text>substantial
			 disruptions of service;</text>
								</item><item id="IDFCD04341820B4E28833678B3CF9D3A9B"><enum>(bb)</enum><text>economic
			 impacts;</text>
								</item><item id="IDF574FC3CA3AD4C1C9154E0E9D28A271E"><enum>(cc)</enum><text>loss
			 of life; and</text>
								</item><item id="IDF622AA7D3EFD4D1E9AC2DDFEC3DA62BE"><enum>(dd)</enum><text>negative health
			 consequences for staff at the treatment works;</text>
								</item></subclause><subclause id="ID49EFF0F0A88D40D281D69D66711D6EC5"><enum>(III)</enum><text>an
			 identification of adverse consequences to the public health and safety and the
			 environment and natural resources;</text>
							</subclause><subclause id="IDFCECCC7C06D84385BAED2905A1E4B6E1"><enum>(IV)</enum><text>a determination
			 of critical assets of the treatment works that may be subject to a disruption
			 of service event, including—</text>
								<item id="IDCFE7C0A6419845E09981FB595F5701A5"><enum>(aa)</enum><text>pumping
			 stations;</text>
								</item><item id="IDA42208BD870248B597503C6AE9A06A1F"><enum>(bb)</enum><text>power
			 sources;</text>
								</item><item id="IDEAD97A932346442286C8E7B71DE5EF3C"><enum>(cc)</enum><text>electronic and
			 computer systems; and</text>
								</item><item id="ID8E4783F29D234D24972D5D7AF643540C"><enum>(dd)</enum><text>disinfection
			 processes;</text>
								</item></subclause><subclause id="ID93C55E22AD0E4F209CAF780FD85A9334"><enum>(V)</enum><text>an assessment
			 of—</text>
								<item id="ID6D74E9FB458D4D4B97D8AC73A52D2FFA"><enum>(aa)</enum><text>the
			 qualitative probability of a disruption of service event; and</text>
								</item><item id="IDE8EE849E9566496C8B4111F05C2CA448"><enum>(bb)</enum><text>whether the
			 disruption of service event is the result of a natural or an intentional
			 occurrence;</text>
								</item></subclause><subclause id="ID3843CC2FC7FC4F4E96E44AEB8910E31F"><enum>(VI)</enum><text>an evaluation of
			 existing countermeasures relating to the treatment works; and</text>
							</subclause><subclause id="IDC9BF22C3576E456680B37489F26302F2"><enum>(VII)</enum><text>an analysis of
			 current risk relating to the treatment works and the development of a
			 prioritized plan for risk reduction at the treatment works.</text>
							</subclause></clause></subparagraph><subparagraph id="id97CFED50455946629F06E027C51DA67A"><enum>(B)</enum><header>Community water
			 system</header><text>With respect to a community water system, the term
			 <term>vulnerability assessment</term> means an assessment conducted in
			 accordance with section 1433(a) of the Safe Drinking Water Act (42 U.S.C.
			 300i–2(a)).</text>
					</subparagraph></paragraph></subsection><subsection id="IDA3FC42E7B1014434971AB16D31EEEB03"><enum>(b)</enum><header>Grants for
			 Vulnerability Assessments and Security Enhancements</header><text>The
			 Administrator may provide grants to any State, municipality, intermunicipal or
			 interstate agency, or privately owned utility that principally treats municipal
			 wastewater, or that principally provides municipal drinking water—</text>
				<paragraph id="IDBE57022DF8A944FEB010886B2FE464EC"><enum>(1)</enum><text>to conduct or
			 update a vulnerability assessment of a publicly owned treatment works or a
			 community water system;</text>
				</paragraph><paragraph id="IDC36574215C9A429DA7E78FAB2C97A8FB"><enum>(2)</enum><text>to implement
			 security enhancements to reduce vulnerabilities identified in a vulnerability
			 assessment;</text>
				</paragraph><paragraph id="ID744BFC7FE45E41FFAD1E8BFBCC48A898"><enum>(3)</enum><text>for the
			 development, expansion, or upgrading of an emergency response plan and site
			 security plan; and</text>
				</paragraph><paragraph id="IDB7F8DA1AC3B74503AB6F5C2D33FB13C5"><enum>(4)</enum><text>for the voluntary
			 creation by a State or network of treatment works of, or voluntary
			 participation by a treatment works or community water system in, a mutual aid
			 and emergency network preparedness agreement developed in accordance with the
			 National Incident Management System established pursuant to presidential
			 directive number 5 of the Department of Homeland Security.</text>
				</paragraph></subsection><subsection id="IDBE13B598D07F4D01B47DE33A08A4A45D"><enum>(c)</enum><header>Grants for
			 Security Enhancements</header>
				<paragraph id="ID1371C1E155294C1F91ECC8BA46C42BBF"><enum>(1)</enum><header>Security
			 enhancements</header><text>On certification by a State, municipality,
			 intermunicipal or interstate agency, or privately owned utility that
			 principally treats municipal wastewater that a vulnerability assessment has
			 been completed for a treatment works, and that the security enhancement for
			 which assistance is sought is for the purpose of reducing vulnerabilities of
			 the treatment works identified in the vulnerability assessment, the
			 Administrator may provide grants under this subsection to the State,
			 municipality, intermunicipal or interstate agency, or privately owned
			 utility.</text>
				</paragraph><paragraph id="idF32661EE77B14C029C789294BEC7B474"><enum>(2)</enum><header>Community water
			 system grants</header>
					<subparagraph id="id3B9CCA85A9BB4BB3AE9DF8AA0694BA27"><enum>(A)</enum><header>In
			 general</header><text>On certification by the owner or operator of a community
			 water system that a vulnerability assessment has been conducted for the
			 community water system in accordance with section 1433(a) of the Safe Drinking
			 Water Act (42 U.S.C. 300i–2(a)), and that the security enhancement for which
			 assistance is sought is for the purpose of reducing vulnerabilities of the
			 community water system identified in the vulnerability assessment, the
			 Administrator may provide a grant under this section for the community water
			 system.</text>
					</subparagraph><subparagraph id="idD5E822759E0B4A2C92C72148179871DC"><enum>(B)</enum><header>Treatment of
			 certain certification</header><text>A certification provided to the
			 Administrator under section 1433 of the Safe Drinking Water Act (42 U.S.C.
			 300i–2) shall be considered to satisfy the certification requirement under
			 subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="id20E7FAFC4AE741A782EF18FAC2DC0385"><enum>(3)</enum><header>Joint
			 wastewater and drinking water facilities</header><text>A facility that is both
			 a treatment works and a community water system may—</text>
					<subparagraph id="id7E585F37EF2647279BEACFADFC827319"><enum>(A)</enum><text>conduct a single
			 assessment of both the facilities; and</text>
					</subparagraph><subparagraph id="id8807B875FA0E4C1BACDF62455C71A79A"><enum>(B)</enum><text>submit a single
			 certification to meet the requirements of paragraphs (1) and (2).</text>
					</subparagraph></paragraph><paragraph id="ID4658108E6F734A43AE338C6434C000EE"><enum>(4)</enum><header>Limitations</header>
					<subparagraph id="IDFCA0E925003146A0837B0ACE38F8C966"><enum>(A)</enum><header>Use of
			 funds</header><text>A grant provided under this subsection or subsection (b)
			 shall not be used for—</text>
						<clause id="ID04FF4CF41FC14B6A98B7D6F52A8ABCC0"><enum>(i)</enum><text>payment of
			 personnel costs; or</text>
						</clause><clause id="IDBD33BF73A2184B63A14344E0853A6CFE"><enum>(ii)</enum><text>operation or
			 maintenance of facilities, equipment, or systems.</text>
						</clause></subparagraph><subparagraph id="ID6DECB9E9C3D043D0A52732E923F73FC7"><enum>(B)</enum><header>Disclosure of
			 vulnerability assessment</header>
						<clause id="IDCA9B91533CCB48FD99B22AFCC9A2EE6F"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in clause (ii), as a condition of
			 applying for or receiving a grant under this subsection, the Administrator may
			 not require an applicant to provide the Administrator with a copy of a
			 vulnerability assessment.</text>
						</clause><clause id="ID012160307D6844B0B06BA6624926CAB6"><enum>(ii)</enum><header>Exception</header><text>To
			 ensure compliance with any applicable Federal grant requirement, the
			 Administrator or a designee of the Administrator—</text>
							<subclause id="ID8ADE5E953B18472AB64271A1241E713C"><enum>(I)</enum><text>may request and
			 view a copy of a vulnerability assessment associated with a grant under this
			 section; but</text>
							</subclause><subclause id="ID0DF48E6DF4E44060BC8778EB7B40E760"><enum>(II)</enum><text>shall not take
			 possession or control of the copy.</text>
							</subclause></clause></subparagraph><subparagraph id="IDB68CF31622044D3F82B40A3C661F4053"><enum>(C)</enum><header>Responsibility
			 of administrator</header><text>Not later than December 31, 2008, the
			 Administrator, in consultation with appropriate Federal law enforcement and
			 intelligence officials, shall incorporate into existing protocols for
			 protection of sensitive information a method by which the Administrator will
			 protect from unauthorized disclosure vulnerability assessment information
			 viewed by the Administrator or a designee of the Administrator pursuant to
			 subparagraph (B)(ii).</text>
					</subparagraph><subparagraph id="ID6068947DB27841EE92DF255663C2D11F"><enum>(D)</enum><header>Penalties</header>
						<clause id="ID9FA7BA66E77F4A43959CD2944E08EB70"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in clause (ii), any individual who
			 views a vulnerability assessment, a reproduction of a vulnerability assessment,
			 or any information derived from a vulnerability assessment, pursuant to
			 subparagraph (B)(ii) and who knowingly or recklessly reveals the vulnerability
			 assessment, reproduction, or information other than to the Administrator or an
			 individual designated by the Administrator, or for use in an administrative or
			 judicial proceeding to impose a penalty for failure to comply with this
			 section, shall, on conviction—</text>
							<subclause id="IDC675BEC014CA4636B4FDA6E98BEAEEDC"><enum>(I)</enum><text>be imprisoned for
			 not more than 1 year or fined in accordance with chapter 227 of title 18,
			 United States Code, as applicable to class A misdemeanors, or both; and</text>
							</subclause><subclause id="ID1B62A38995F64FA2AC167217B59D1B72"><enum>(II)</enum><text>be removed from
			 Federal office or employment.</text>
							</subclause></clause><clause id="IDF7C9DFB123AB4CDDB3FF30888CAE4520"><enum>(ii)</enum><header>Exception</header><text>Notwithstanding
			 clause (i), a designee of the Administrator who is an officer or employee of
			 the United States may discuss with any State or local government official the
			 contents of a vulnerability assessment viewed under this paragraph.</text>
						</clause></subparagraph><subparagraph id="ID2254AF04670542D08B9A59946B44313F"><enum>(E)</enum><header>Effect of
			 paragraph</header><text>Nothing in this paragraph authorizes any person to
			 withhold any information from Congress or any committee or subcommittee of
			 Congress.</text>
					</subparagraph></paragraph><paragraph id="ID90D5920FDA8D45419E12C6AD287D7C60"><enum>(5)</enum><header>False
			 certifications</header><text>An applicant that knowingly submits to the
			 Administrator a false certification or material statement under this subsection
			 shall be subject to a criminal penalty under section 309(c)(4) of the Federal
			 Water Pollution Control Act (33 U.S.C. 1319(c)(4)).</text>
				</paragraph><paragraph id="ID3FB8A9D093034887B4E78676465CFF00"><enum>(6)</enum><header>Exemption under
			 foia and related laws</header><text>Except for information in a certification
			 under this subsection identifying the system for which the certification is
			 submitted and the date of certification of the system, all information
			 contained in a vulnerability assessment certified by an applicant or derived
			 from a vulnerability assessment under this section shall be exempt from the
			 disclosure requirements under—</text>
					<subparagraph id="IDD7CD37A325004A84960BFF8D32624CE9"><enum>(A)</enum><text>section 552 of
			 title 5, United States Code (commonly known as the <quote>Freedom of
			 Information Act</quote>); and</text>
					</subparagraph><subparagraph id="IDA507B0E23DA0482890834E7C7A84301B"><enum>(B)</enum><text>any State or
			 local law providing for public access to information.</text>
					</subparagraph></paragraph></subsection><subsection id="ID6C5504E1109E4F9AAB4633F95582B3E0"><enum>(d)</enum><header>Grant
			 requirements</header>
				<paragraph id="ID7909A3D9DCE14E3D97A68AD3A964D69F"><enum>(1)</enum><header>Federal
			 share</header><text>The Federal share of the cost of an activity funded by a
			 grant under subsection (b) shall not exceed 50 percent, as determined by the
			 Administrator.</text>
				</paragraph><paragraph id="ID4BBBF8E534E54071A983BDF33467BF1F"><enum>(2)</enum><header>Minimum number
			 of grants</header><text>The Administrator shall ensure that grants under this
			 section are provided to more than 1 grant applicant.</text>
				</paragraph></subsection><subsection id="ID997D223AEACB4E7E9D788287366717FA"><enum>(e)</enum><header>Technical
			 Assistance for Small Publicly Owned Treatment Works</header>
				<paragraph id="IDBEF2C9A3166344E787A22FFF9D8B1B6C"><enum>(1)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="idE761A56D3BCA4BDA99C54AC807E1369A"><enum>(A)</enum><header>Small community
			 water system</header><text>The term <term>small community water system</term>
			 means a community water system that services a population of fewer than 10,000
			 individuals.</text>
					</subparagraph><subparagraph id="id96F9383C3665494A924274A6BB601745"><enum>(B)</enum><header>Small publicly
			 owned treatment works</header><text>The term <term>small publicly owned
			 treatment works</term> means a publicly owned treatment works that services a
			 population of fewer than 10,000 individuals.</text>
					</subparagraph></paragraph><paragraph id="IDDCDCDE2BC7E4433EB02BC9E043C38156"><enum>(2)</enum><header>Security
			 assessment and planning assistance</header>
					<subparagraph id="ID922C552555624241A89F61EA3919E547"><enum>(A)</enum><header>In
			 general</header><text>The Administrator, in coordination with the States, may
			 provide technical guidance and assistance to small publicly owned treatment
			 works and small community water systems for—</text>
						<clause id="ID861B9D663EB6460C94EF06CDB7E5260C"><enum>(i)</enum><text>the
			 conduct of a vulnerability assessment, emergency response plan, or site
			 security plan; and</text>
						</clause><clause id="IDB888C80E44804020BEDBDC069D47FA28"><enum>(ii)</enum><text>the
			 implementation of security enhancements to reduce vulnerabilities identified in
			 a vulnerability assessment.</text>
						</clause></subparagraph><subparagraph id="IDE1C0AA3689204F879113ACA985FFCD39"><enum>(B)</enum><header>Inclusions</header><text>Technical
			 guidance and assistance provided under subparagraph (A) may include technical
			 assistance programs, training, and preliminary engineering evaluations.</text>
					</subparagraph></paragraph><paragraph id="IDF379B63F69AB48D0AE98AD7BA707F0FC"><enum>(3)</enum><header>Participation
			 by nonprofit organizations</header><text>The Administrator may provide grants
			 to nonprofit organizations to assist in accomplishing the purposes of this
			 subsection.</text>
				</paragraph></subsection><subsection id="ID956866ABB14047DEBCA7B2309649090A"><enum>(f)</enum><header>Refinement of
			 Vulnerability Assessment Methodology for Publicly Owned Treatment Works and
			 community water systems</header>
				<paragraph id="ID58468586236D422A94160A0C53199FA2"><enum>(1)</enum><header>Grants</header><text>The
			 Administrator may provide to nonprofit organizations 1 or more grants to be
			 used in improving vulnerability self-assessment methodologies and tools for
			 publicly owned treatment works or community water systems.</text>
				</paragraph><paragraph id="IDBB811784D5A64752B3CB26017C7E5FA6"><enum>(2)</enum><header>Eligible
			 activities</header><text>A grant provided under this subsection may be
			 used—</text>
					<subparagraph id="IDADB618CD9EB2477CA8B3D103027E2BF2"><enum>(A)</enum><text>to develop and
			 distribute vulnerability self-assessment methodology software upgrades;</text>
					</subparagraph><subparagraph id="IDF19753BC2B2F40A894DA700BFA952EFB"><enum>(B)</enum><text>to improve and
			 enhance critical technical and user support functions;</text>
					</subparagraph><subparagraph id="ID0D897C29944C40B1A76FC824889FD031"><enum>(C)</enum><text>to expand
			 libraries of information addressing threats and countermeasures; and</text>
					</subparagraph><subparagraph id="ID24DB474BF27D48578A44B61F74B061AC"><enum>(D)</enum><text>to implement user
			 training initiatives.</text>
					</subparagraph></paragraph><paragraph id="IDFFD1FA90514B4E03BBD64D836D04EF6F"><enum>(3)</enum><header>Cost</header><text>A
			 service described in paragraph (2) that is funded by a grant under this
			 subsection shall be provided at no cost to the recipients of the
			 service.</text>
				</paragraph></subsection><subsection id="ID2642838241504F0FBD443543AAA85578"><enum>(g)</enum><header>Training
			 Grants</header>
				<paragraph id="IDCACE4E02A0984F08BA74A2647BA35EA9"><enum>(1)</enum><header>In
			 general</header><text>The Administrator may provide grants to nonprofit
			 organizations to be used in accordance with paragraph (2) to implement a
			 comprehensive training program for—</text>
					<subparagraph id="id35501390B3824BCBA88711CE27B773E2"><enum>(A)</enum><text>treatment works
			 or privately owned utilities that principally treat municipal wastewater;
			 or</text>
					</subparagraph><subparagraph id="id01F92E97A18F4D96B66E0C76B9DAA6CC"><enum>(B)</enum><text>community water
			 systems.</text>
					</subparagraph></paragraph><paragraph id="ID9AD002121BA5471CB6D85C9FF709DA98"><enum>(2)</enum><header>Eligible
			 activities</header><text>A grant provided under paragraph (1) may be
			 used—</text>
					<subparagraph id="ID9DB7AB1634D94FC384325334AECC11C2"><enum>(A)</enum><text>to develop and
			 implement a training program to assist treatment works and community water
			 systems in—</text>
						<clause id="IDF9859EDB5BDB422097CE6BEA8792ED00"><enum>(i)</enum><text>conducting
			 vulnerability assessments using vulnerability self-assessment methodology
			 software;</text>
						</clause><clause id="ID75A458816C9C4E79BD121B15DAF022C7"><enum>(ii)</enum><text>developing
			 emergency response plans; and</text>
						</clause><clause id="ID9AF05DB2D8D749319BEB9CF11C0F0B6D"><enum>(iii)</enum><text>identifying
			 security enhancements; and</text>
						</clause></subparagraph><subparagraph id="IDC7CCD486E1D94E73AECED9C725E897C6"><enum>(B)</enum><text>to develop and
			 disseminate to treatment works or community water system information on best
			 practices for emergency response plans and security enhancements.</text>
					</subparagraph></paragraph><paragraph id="ID427D6035BDFD42C987BAD90EA248C69D"><enum>(3)</enum><header>Cost</header><text>Training
			 and technical assistance provided pursuant to a grant under paragraph (1) shall
			 be provided at no cost to the recipients of the assistance.</text>
				</paragraph></subsection><subsection id="ID0219CBAA61D74C5BACA345A6F35623DC"><enum>(h)</enum><header>Authorization
			 of Appropriations</header><text>There is authorized to be appropriated—</text>
				<paragraph id="ID402DA1A9AB974E9D885083707B42276C"><enum>(1)</enum><text>$200,000,000 for
			 use in making grants under subsection (b), to remain available until
			 expended;</text>
				</paragraph><paragraph id="IDE6E367219E4642528DF60D31648463D9"><enum>(2)</enum><text>$15,000,000 for
			 use in providing assistance under subsections (e) and (g); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBF853300F55F4247B129F491859263F9"><enum>(3)</enum><text>to carry out
			 subsection (f), $1,000,000 for each of fiscal years 2007 through 2011.</text>
				</paragraph></subsection></section><section id="IDDB05E7E8638648DBA4F8AF3EBC167A61"><enum>4.</enum><header>Research and
			 review of collection systems and distribution systems</header>
			<subsection id="ID926F24A565BB4D9B895D707F96C64E14"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id42F317C82B2A4542B15874C5ED968346"><enum>(1)</enum><header>Collection
			 system</header><text>The term <term>collection system</term> means the
			 underground network of sewers, including sanitary and storm water collection
			 lines.</text>
				</paragraph><paragraph id="idC9128AE90E614E4687E983012761E046"><enum>(2)</enum><header>Distribution
			 system</header><text>The term <term>distribution system</term> means the
			 underground network of pipes that deliver drinking water from a community water
			 system to consumers.</text>
				</paragraph></subsection><subsection id="IDA30B807BECC540A6A4380FB913C2622D"><enum>(b)</enum><header>Research and
			 Review</header><text>The Administrator, in consultation with appropriate
			 Federal agencies, shall conduct research and a review, or enter into a contract
			 or cooperative agreement for the conduct of research and a review, of—</text>
				<paragraph id="IDFF08E2F9D52D49A3B9BC4AB041C59D65"><enum>(1)</enum><text>means of
			 providing alternative processes to convey, treat, and dispose of wastewater if
			 a disruption of service event occurs;</text>
				</paragraph><paragraph id="id1E5E7ACE3F0242DE9E64C99B1A06D7CF"><enum>(2)</enum><text>in coordination
			 with assessments carried out under section 1434 of the Safe Drinking Water Act
			 (42 U.S.C. 300i–3), the means of providing alternative processes to treat and
			 deliver drinking water if a disruption of service event occurs;</text>
				</paragraph><paragraph id="IDF021580AA4184F35B38C0A80AA1FA55A"><enum>(3)</enum><text>the means by
			 which the collection system of a treatment works could—</text>
					<subparagraph id="ID878624381E1144D4A6999FC9558FC30E"><enum>(A)</enum><text>be used to convey
			 hazardous chemicals or substances (including explosive devices), including a
			 comprehensive analysis of the types of hazardous chemicals, substances, and
			 explosive devices that could be placed in the collection system; and</text>
					</subparagraph><subparagraph id="ID5E6B2112EB8C4196BE26DA7D0036BBE8"><enum>(B)</enum><text>be secured to
			 prevent and respond to an intentional harmful act;</text>
					</subparagraph></paragraph><paragraph id="id15C25A6A2F0A4DE884A2E88DFBEDDE50"><enum>(4)</enum><text>the means by
			 which a distribution system of a community water system could be compromised to
			 allow the delivery of any hazardous chemical or substance;</text>
				</paragraph><paragraph id="IDC162799AE66141B395800D1AE35321D3"><enum>(5)</enum><text>methods for
			 monitoring—</text>
					<subparagraph id="ID70946111FF97450D894702B29A27F80D"><enum>(A)</enum><text>the collection
			 systems of treatment works and the distribution systems of community water
			 systems for hazardous chemicals or substances, including explosive devices;
			 and</text>
					</subparagraph><subparagraph id="IDF0E23043E7C748F9A4DA2D620E54B294"><enum>(B)</enum><text>unauthorized
			 entry into the collection systems of treatment works and the distribution
			 systems of community water systems; and</text>
					</subparagraph></paragraph><paragraph id="ID25c1b3f3f9ca4e71b91d581a33f9d607"><enum>(6)</enum><text>strategies for
			 recovery from, and restoration of services after, a disruption of service
			 event.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID98F18C337D8342AB8519C68EDBD1D760"><enum>(c)</enum><header>Authorization
			 of Appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $5,000,000 for each of fiscal years 2007 through 2011.</text>
