			 Finance</committee-name></action-desc></action><legis-type display="yes">A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to
		  improve access to pharmacies under part D.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" display-inline="no-display-inline" commented="no"><enum>1.</enum><header display-inline="yes-display-inline">Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Pharmacy Access Improvement
			 (PhAIm) Act of 2007</short-title></quote>.</text></section><section id="idFB0778304C7D45FD99E9C0FC98ADB29A" display-inline="no-display-inline" commented="no" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Strengthening
			 standards for access to pharmacies</header><subsection id="id61AD9DA433D648339032FAF17533A73B" display-inline="no-display-inline" commented="no"><enum>(a)</enum><header display-inline="yes-display-inline">In
			 general</header><text display-inline="yes-display-inline">Section
			 1860D–4(b)(1)(C) of the Social Security Act (42 U.S.C. 1395w–104(b)(1)(C)) is
			 amended—</text><paragraph id="idE2F4C3FA977F4648B6B063F5B73C4F78" display-inline="no-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">in clause
			 (i)—</text><subparagraph id="id1EC7E76E033642BCBBAB985507008290" display-inline="no-display-inline" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting
			 <quote>that are accessible to the general public (not including closed
			 pharmacies, such as pharmacies that dispense drugs by mail order only or are
			 located in a hospital or nursing home, except that a closed pharmacy shall be
			 included if the pharmacy is operated by the Indian Health Service, an Indian
			 tribe or tribal organization, or an urban Indian organization (as defined in
			 section 4 of the Indian Health Care Improvement Act))</quote> after
			 <quote>sufficient number of pharmacies</quote>; and</text></subparagraph><subparagraph id="id2CDDF8299C4F471CAB44CFFB02972355" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">by striking
			 <quote>(other than by mail order)</quote>; and</text></subparagraph></paragraph><paragraph id="id9DE76FF3906D495989DEBA6F8A07BEC2" display-inline="no-display-inline" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (ii),
			 by adding at the end the following new sentence: <quote>If the PDP sponsor of a
			 prescription drug plan designates in-network pharmacies as either preferred or
			 non-preferred pharmacies (or any designation other than preferred or any other
			 distinction between or among pharmacies with respect to participation status),
			 only in-network preferred pharmacies shall be counted in determining if the
			 requirements of such rules are met.</quote>.</text></paragraph></subsection><subsection id="id21F944AA041F43D49B7C3CB06152C6EE" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header display-inline="yes-display-inline">Expanding
			 participation by any willing pharmacy</header><text display-inline="yes-display-inline">Section 1860D–4(b)(1)(A) of
			 the Social Security Act (42 U.S.C. 1395w–104(b)(1)(A)) is amended—</text><paragraph id="idB45B2F31A8294F119B9784DA828BA866" display-inline="no-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">by striking
			 <quote><header-in-text level="subparagraph" style="OLC">Pharmacy</header-in-text>.—A prescription drug plan</quote> and
			 inserting <header-in-text level="subparagraph" style="OLC">“Pharmacy</header-in-text>.—</text><quoted-block display-inline="no-display-inline" id="id8C63D972CC7B423AB905329600CD5A99" style="OLC"><clause id="idCE27B23975E44E9AB1690F5100597587" display-inline="no-display-inline" commented="no"><enum>(i)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">Subject to clause (ii), a prescription drug
				plan</text></clause><after-quoted-block display="yes">;</after-quoted-block></quoted-block></paragraph><paragraph id="idB7333898C2AE42019F9106C88F387DC9" display-inline="no-display-inline" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (i), as
			 added by paragraph (1), by adding at the end the following new sentence:
			 <quote>A previous refusal by a pharmacy of an offer to participate, or the
			 expiration of such an offer, shall not be grounds to exclude a pharmacy from
			 participation under this subparagraph.</quote>; and</text></paragraph><paragraph id="idE7A58D06403948ED82B50AAF4E9ECEF8" display-inline="no-display-inline" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the
			 end the following new clause:</text><quoted-block display-inline="no-display-inline" id="idEBA29FAB8F784581B5CD857328F6308D" style="OLC"><clause id="id0E78C4AED654476197388828CA84150F" display-inline="no-display-inline" commented="no"><enum>(ii)</enum><header display-inline="yes-display-inline">Participation
				of 340B entities</header><subclause id="id7A5D45245C0A467181D825141C83707A" display-inline="no-display-inline" commented="no"><enum>(I)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">A prescription drug plan shall not exclude a pharmacy
				from participation solely on the basis that such pharmacy is a covered entity
				under section 340B of the Public Health Service Act.</text></subclause><subclause id="id9851AD2AA7B74B90B7237B49BAD6CF51" display-inline="no-display-inline" commented="no"><enum>(II)</enum><header display-inline="yes-display-inline">Reasonable
				terms and conditions for 340B entities</header><text display-inline="yes-display-inline">In the case of a pharmacy
				that is a covered entity under such section 340B, if such an entity requests
				that the terms and conditions of the appropriate version (as determined by the
				Secretary) of the Model Safety Net Pharmacy Addendum to Pharmacy Contract apply
				to a contract to dispense covered part D drugs under such plan, subject to
				subclause (III), the terms and conditions of such contract shall be the terms
				and conditions for participation of such pharmacy under clause (i).</text></subclause><subclause id="id13A9180D1CB047368F25111166FC9E5F" display-inline="no-display-inline" commented="no"><enum>(III)</enum><header display-inline="yes-display-inline">Permitting
				waiver of cost-sharing</header><text display-inline="yes-display-inline">In the case of a pharmacy that is a
				covered entity under such section 340B, if such an entity requests that the
				terms and conditions of a contract to dispense covered part D drugs under such
				plan permit the pharmacy to waive or reduce cost-sharing under this part,
				consistent with the requirements of section 1128B(b)(3)(G), such permission
				shall be included in the terms and conditions for participation of such
				pharmacy under clause
				(i).</text></subclause></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id3E753F0AB71842D198FB5A92A35CA7C7" display-inline="no-display-inline" commented="no"><enum>(c)</enum><header display-inline="yes-display-inline">Strengthening
			 convenient access standards</header><paragraph id="id21DC832D3B5E4BE3BC584DFCE27707EA" display-inline="no-display-inline" commented="no"><enum>(1)</enum><header display-inline="yes-display-inline">Access in
			 long-term care facilities and to pharmacies serving
			 indians</header><text display-inline="yes-display-inline">Section 1860D–4(b)(1)(C) of the Social Security Act (42
			 U.S.C. 1395w–104(b)(1)(C)) is amended by striking clause (iv) and inserting the
			 following new clauses:</text><quoted-block display-inline="no-display-inline" id="id3B002DE8626946B988EBCA42F6730606" style="OLC"><clause id="id79B5C3D908744B54A301238013A4BB09" display-inline="no-display-inline" commented="no"><enum>(iv)</enum><header display-inline="yes-display-inline">Convenient
				access in long-term care facilities</header><text display-inline="yes-display-inline">Such rules shall include
				standards with respect to access for enrollees who are residing in long-term
				care facilities to ensure that such enrollees have access to a long-term care
				network pharmacy.</text></clause><clause id="idDC80D0AF73DC4472B6EBFD789BA68204" display-inline="no-display-inline" commented="no"><enum>(v)</enum><header display-inline="yes-display-inline">Convenient
				access to pharmacies serving Indians</header><text display-inline="yes-display-inline">Such rules may include
				standards with respect to access for enrollees to pharmacies operated by the
				Indian Health Service, Indian tribes and tribal organizations, and urban Indian
				organizations (as defined in section 4 of the Indian Health Care Improvement
				Act.</text></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="id9385CF7694DC43E5B5C7D66401E56ABC" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Convenient
			 access to extended supplies at retail pharmacies</header><text display-inline="yes-display-inline">Section
			 1860D–4(b)(1)(C) of the Social Security Act (42 U.S.C. 1395w–104(b)(1)(C)), as
			 amended by paragraph (1), is amended—</text><subparagraph commented="no" id="id363A15248C54400AB888BB1DA7CFE1AF" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii),
			 by striking <quote>The Secretary</quote> and inserting <quote>Subject to clause
			 (vi), the Secretary</quote>; and</text></subparagraph><subparagraph commented="no" id="id66AE40B6649F4B13AC7FF5788AF7DA67" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the
			 end the following new clause:</text><quoted-block display-inline="no-display-inline" id="idDEB6BCB95926420DAEBB7B42D1F0FC59" style="OLC"><clause commented="no" id="id358469E2AA9240A19218A859403AE217" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">The Secretary
				shall establish rules for convenient access to in-network pharmacies under this
				subparagraph that dispense extended supplies of covered part D drugs that are
				modeled after the rules for convenient access to pharmacies included in the
				statement of work described in clause
				(ii).</text></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2382C7E18D4449F0AAA2216106277552"><enum>(d)</enum><header display-inline="yes-display-inline">Disclosure of
			 maximum allowable cost pricing</header><text display-inline="yes-display-inline">Section 1860D–4(b)(1) of the
			 Social Security Act (42 U.S.C. 1395w–104(b)(1)) is amended by adding at the end
			 the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="idC91558999D744E11B702900A7C27C0C1" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="idF67316E336AA47859AE63E570AD4B517"><enum>(F)</enum><header display-inline="yes-display-inline">Disclosure of
				maximum allowable cost pricing</header><text display-inline="yes-display-inline">If a contract for a pharmacy to
				dispense covered part D drugs under a prescription drug plan references maximum
				allowable cost lists or pricing, the PDP sponsor of such plan shall disclose,
				through (at a minimum) an Internet website and a toll-free telephone
				number—</text><clause commented="no" display-inline="no-display-inline" id="idE22AC64CCE1240579487F90446055395"><enum>(i)</enum><text display-inline="yes-display-inline">any such lists or
				pricing to the pharmacy at the time of offering such contract; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idFD60C2E039724127BD2EA343C99EBFEC"><enum>(ii)</enum><text display-inline="yes-display-inline">information
				updated not less frequently than every 7 days on such lists or pricing to
				pharmacies that have entered into such a
				contract.</text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id46BDFEEBFEC04BB297A17662297011E1" display-inline="no-display-inline" commented="no"><enum>(e)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the
			 date that is 180 days after the date of enactment of this Act.</text></subsection></section><section id="id0E9A2EBA81604665882F70444F3B3D26" display-inline="no-display-inline" commented="no" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Prompt payment
			 by prescription drug plans and MA–PD plans under part D</header><subsection id="id44EEFB1E5F1A458AA1D9892E5421D087" display-inline="no-display-inline" commented="no"><enum>(a)</enum><header display-inline="yes-display-inline">Prompt payment
			 by prescription drug plans</header><text display-inline="yes-display-inline">Section 1860D–12(b) of the Social
			 Security Act (42 U.S.C. 1395w–112(b)) is amended by adding at the end the
			 following new paragraph:</text><quoted-block display-inline="no-display-inline" id="id27ED188ED4864E1588AFF2673A1C0A38" style="OLC"><paragraph id="idF22B92D567D842E6B21D765B18B79E28" display-inline="no-display-inline" commented="no"><enum>(4)</enum><header display-inline="yes-display-inline">Prompt payment
				of clean claims</header><subparagraph id="idCAFCF758E1594AE897C30F9BEEE95180" display-inline="no-display-inline" commented="no"><enum>(A)</enum><header display-inline="yes-display-inline">Prompt
				payment</header><clause id="idE05B04E91A4E463BADF6056B87FAD4F9" display-inline="no-display-inline" commented="no"><enum>(i)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">Each contract entered into with a PDP sponsor under this
				part with respect to a prescription drug plan offered by such sponsor shall
				provide that payment shall be issued, mailed, or otherwise transmitted with
				respect to all clean claims submitted by pharmacies (other than pharmacies that
				dispense drugs by mail order only or are located in, or contract with, a
				long-term care facility) under this part within the applicable number of
				calendar days after the date on which the claim is received.</text></clause><clause id="id872CC4E299AD4F63A2280ED6645A96A8" display-inline="no-display-inline" commented="no"><enum>(ii)</enum><header display-inline="yes-display-inline">Clean claim
				defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>clean claim</term>
				means a claim that has no defect or impropriety (including any lack of any
				required substantiating documentation) or particular circumstance requiring
				special treatment that prevents timely payment from being made on the claim
				under this part.</text></clause></subparagraph><subparagraph id="id1839923A714E410CB7C01104B29419EB" display-inline="no-display-inline" commented="no"><enum>(B)</enum><header display-inline="yes-display-inline">Applicable
				number of calendar days defined</header><text display-inline="yes-display-inline">In this paragraph, the term
				<term>applicable number of calendar days</term> means—</text><clause id="id49356D51E80248BEBE86041B43F42BDE" display-inline="no-display-inline" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to
				claims submitted electronically, 14 days; and</text></clause><clause id="idC862A0C47BB34105B68DAA974FF2077F" display-inline="no-display-inline" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to
				claims submitted otherwise, 30 days.</text></clause></subparagraph><subparagraph id="ID083D0AF0E0F148B88B6DDDB4A1EB6508" display-inline="no-display-inline" commented="no"><enum>(C)</enum><header display-inline="yes-display-inline">Interest
				payment</header><text display-inline="yes-display-inline">If payment is not issued, mailed, or otherwise
				transmitted within the applicable number of calendar days (as defined in
				subparagraph (B)) after a clean claim is received, the PDP sponsor shall pay
				interest to the pharmacy that submitted the claim at a rate equal to the
				weighted average of interest on 3-month marketable Treasury securities
				determined for such period, increased by 0.1 percentage point for the period
				beginning on the day after the required payment date and ending on the date on
				which payment is made (as determined under subparagraph (D)(iv)). Interest
				amounts paid under this subparagraph shall not be counted against the
				administrative costs of a prescription drug plan or treated as allowable risk
				corridor costs under section 1860D–15(e).</text></subparagraph><subparagraph id="id335AA06BC26C4A9498C782C4E1C617F2" display-inline="no-display-inline" commented="no"><enum>(D)</enum><header display-inline="yes-display-inline">Procedures
				involving claims</header><clause id="ID054871334AE6439BA658649FD1D64010" display-inline="no-display-inline" commented="no"><enum>(i)</enum><header display-inline="yes-display-inline">Claim deemed to
				be clean</header><text display-inline="yes-display-inline">A claim is deemed to be a clean claim if the PDP sponsor
				involved does not provide notice to the claimant of any deficiency in the claim
				within 10 days of the date on which the claim is submitted.</text></clause><clause id="ID33546D9F96CF4BA5B94F5F4D3A2EC0D2" display-inline="no-display-inline" commented="no"><enum>(ii)</enum><header display-inline="yes-display-inline">Claim
				determined to not be a clean claim</header><subclause id="ID8EA2142C083A4B66AD78F50FC9021A81" display-inline="no-display-inline" commented="no"><enum>(I)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">If a PDP sponsor determines that a submitted claim is not
				a clean claim, the PDP sponsor shall, not later than the end of the period
				described in clause (i), notify the claimant of such determination. Such
				notification shall specify all defects or improprieties in the claim and shall
				list all additional information or documents necessary for the proper
				processing and payment of the claim.</text></subclause><subclause id="ID9CC4DD300A104BD4A41D86FF59F27652" display-inline="no-display-inline" commented="no"><enum>(II)</enum><header display-inline="yes-display-inline">Determination
				after submission of additional information</header><text display-inline="yes-display-inline">A claim is deemed to
				be a clean claim under this paragraph if the PDP sponsor involved does not
				provide notice to the claimant of any defect or impropriety in the claim within
				10 days of the date on which additional information is received under subclause
				(I).</text></subclause><subclause id="ID16DD1418816648D2B6BF57709831BD89" display-inline="no-display-inline" commented="no"><enum>(III)</enum><header display-inline="yes-display-inline">Payment of
				clean portion of a claim</header><text display-inline="yes-display-inline">A PDP sponsor shall, as appropriate, pay
				any portion of a claim that would be a clean claim but for a defect or
				impropriety in a separate portion of the claim in accordance with subparagraph
				(A).</text></subclause></clause><clause id="IDD41513F4C1DE407292E079009622CC15" display-inline="no-display-inline" commented="no"><enum>(iii)</enum><header display-inline="yes-display-inline">Obligation to
				pay</header><text display-inline="yes-display-inline">A claim submitted to a PDP sponsor that is not paid or
				contested by the sponsor within the applicable number of days (as defined in
				subparagraph (B)) shall be deemed to be a clean claim and shall be paid by the
				PDP sponsor in accordance with subparagraph (A).</text></clause><clause id="IDD5DCC79FD9364D92BB74F09A2B20A27F" display-inline="no-display-inline" commented="no"><enum>(iv)</enum><header display-inline="yes-display-inline">Date of
				Payment of Claim</header><text display-inline="yes-display-inline">Payment of a clean claim under such subparagraph
				is considered to have been made on the date on which—</text><subclause id="id66A2E08AA5DA449D839F2811E9C2B689" display-inline="no-display-inline" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to
				claims paid electronically, the payment is transferred; and</text></subclause><subclause id="idB479D055B3F9452CAA2F14C3936B9755" display-inline="no-display-inline" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to
				claims paid otherwise, the payment is submitted to the United States Postal
				Service or common carrier for delivery.</text></subclause></clause></subparagraph><subparagraph id="IDACA3EFAF0AEA45FC8051A531C1F654C7" display-inline="no-display-inline" commented="no"><enum>(E)</enum><header display-inline="yes-display-inline">Electronic
				transfer of funds</header><text display-inline="yes-display-inline">A PDP sponsor shall pay all clean claims
				submitted electronically by electronic transfer of funds if the pharmacy so
				requests or has so requested previously. In the case where such payment is made
				electronically, remittance may be made by the PDP sponsor electronically as
				well.</text></subparagraph><subparagraph id="id4BBC4B39C58F4ED19B13A7443A1D2AF2" display-inline="no-display-inline" commented="no"><enum>(F)</enum><header display-inline="yes-display-inline">Protecting the
				rights of claimants</header><clause id="id714AC95CBAF74A04A161577CA6252764" display-inline="no-display-inline" commented="no"><enum>(i)</enum><header display-inline="yes-display-inline">In
				general</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be construed to prohibit
				or limit a claim or action not covered by the subject matter of this section
				that any individual or organization has against a provider or a PDP
				sponsor.</text></clause><clause id="ID71BCFC945CEE4CDF8AAB66E80CAFC7D8" display-inline="no-display-inline" commented="no"><enum>(ii)</enum><header display-inline="yes-display-inline">Anti-Retaliation</header><text display-inline="yes-display-inline">Consistent
				with applicable Federal or State law, a PDP sponsor shall not retaliate against
				an individual or provider for exercising a right of action under this
				subparagraph.</text></clause></subparagraph><subparagraph id="ID427c639c26f341dcac8856f30c404e80" display-inline="no-display-inline" commented="no"><enum>(G)</enum><header display-inline="yes-display-inline">Rule of
				construction</header><text display-inline="yes-display-inline">A determination under this paragraph that a claim
				submitted by a pharmacy is a clean claim shall not be construed as a positive
				determination regarding eligibility for payment under this title, nor is it an
				indication of government approval of, or acquiescence regarding, the claim
				submitted. The determination shall not relieve any party of civil or criminal
				liability with respect to the claim, nor does it offer a defense to any
				administrative, civil, or criminal action with respect to the
				claim.</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id5A4E7AAF14404825AB00327408A0A187" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header display-inline="yes-display-inline">Prompt payment
			 by MA–PD plans</header><text display-inline="yes-display-inline">Section 1857(f) of the Social Security Act (42
			 U.S.C. 1395w–27) is amended by adding at the end the following new

			 Human Services pharmacy hotline</header><text display-inline="yes-display-inline">The Secretary of Health and Human
			 Services shall—</text><paragraph id="id2C11F6727CF34ED5A46893177D0E5A34" display-inline="no-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">establish a
			 toll-free telephone number that is dedicated to providing information regarding
			 the Medicare prescription drug benefit under part D of title XVIII of the
			 Social Security Act to pharmacists and pharmacy staff; and</text></paragraph><paragraph id="id702DAB0FD54544309FD9DB09DB69AB01" display-inline="no-display-inline" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">staff such
			 telephone number in order to ensure that the toll-free number is available to

			 general</header><text display-inline="yes-display-inline">Section 1860D–4 of the Social Security Act (42 U.S.C.

				telephone number in order to ensure compliance with customer service standards

				toll-free telephone number that is dedicated to providing information regarding
				the plan to physicians and providers; and</text></subparagraph><subparagraph id="id3C9CA39B06E343A3889425125F6396B1" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">staff such
				telephone number in order to ensure compliance with customer service standards
				(as established by the

			 general</header><text display-inline="yes-display-inline">Section 1860D–4 of
			 the Social Security Act (42 U.S.C. 1395w–104), as amended by section 4(b), is

				has a co-branding relationship with a pharmacy with respect to such a plan
				shall include a disclaimer in large, off-set, bold-face type of the following:

				network.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id69642AFFBCEE46AC9EF1DB61AF202DA3"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to cards and marketing materials distributed on or

				days) to submit claims to the sponsor for reimbursement under the

			 report on dispensing fees</header><subsection id="id03E446DD75964067A29AA894ADDDEBE9" display-inline="no-display-inline" commented="no"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The
			 Inspector General of the Department of Health and Human Services shall conduct
			 an analysis of the cost of dispensing covered part D drugs (as defined in
			 section 1860D–2(e) of the Social Security Act (42 U.S.C. 1395w–102(e)) under a
			 prescription drug plan under part D of title XVIII of such Act or an MA–PD plan
			 under part C of such title that takes into consideration the following:</text><paragraph id="idD9C102EF22984E6A92C166B75335EF10" display-inline="no-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Any reasonable
			 costs associated with a pharmacist’s time in—</text><subparagraph id="idBFB4C475B9B442438BB584541792D8DD" display-inline="no-display-inline" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">checking for
			 information about an individual’s coverage; and</text></subparagraph><subparagraph id="idA711B1EC5BF2418A975E8427B80A4C0F" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">performing
			 necessary clinical review and quality assurance activities, such as activities
			 to identify and reduce the frequency of patterns of fraud, abuse, gross
			 overuse, or inappropriate or medically unnecessary care, among physicians,
			 pharmacists, and patients, or associated with specific drugs or groups of
			 drugs, as well as potential and actual severe adverse reactions to drugs
			 including education on therapeutic appropriateness, overutilization and
			 underutilization, appropriate use of generic products, therapeutic duplication,
			 drug-disease contraindications, drug-drug interactions, incorrect drug dosage
			 or duration of drug treatment, drug-allergy interactions, and clinical
			 abuse/misuse, and any other clinical review and quality assurance activities
			 required under Federal or State law.</text></subparagraph></paragraph><paragraph id="ID44BD81E7FAB046CCB2159813BD148438" display-inline="no-display-inline" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Costs incurred by
			 the pharmacist that are associated with—</text><subparagraph id="ID7142FF451BBD4C5CB7FDC01BB776FCDA" display-inline="no-display-inline" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the measurement
			 or mixing of a covered part D drug;</text></subparagraph><subparagraph id="ID780E7110FDA743EEB22311A4E6AE0445" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">filling the
			 container for such a drug;</text></subparagraph><subparagraph id="ID7BA7672764C448ABA002217C87A6FDEB" display-inline="no-display-inline" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">physically
			 providing the completed prescription to an individual enrolled in such a
			 plan;</text></subparagraph><subparagraph id="IDD7CFA675259543B3A47140F85C46E755" display-inline="no-display-inline" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">delivery;</text></subparagraph><subparagraph id="ID0C9B9FD51670453D8F6049ACC943EAF4" display-inline="no-display-inline" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">special
			 packaging;</text></subparagraph><subparagraph id="IDBE82F8D0B6D14196BD35D688D9B4867C" display-inline="no-display-inline" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">overhead related
			 to the pharmacy, or the section of the facility that is devoted to a pharmacy,
			 and its maintenance (including the equipment necessary to operate such pharmacy
			 or such section and the salaries of pharmacists and other pharmacy workers);
			 and</text></subparagraph><subparagraph id="ID8661753DDC7642B0B759B2CB4F454AF7" display-inline="no-display-inline" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">geographic
			 factors that impact operational costs.</text></subparagraph></paragraph><paragraph id="id74CCC0A223854EA99B2D2480B7392409" display-inline="no-display-inline" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The variation in
			 costs described in paragraph (2) based on—</text><subparagraph id="idF610A50B758A44C48B0F93D5E5F9D31E" display-inline="no-display-inline" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">whether the
			 pharmacist is dispensing a standard or extended supply of a covered part D
			 drug;</text></subparagraph><subparagraph id="id3C0379522D594CCCB509340A830CE34A" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">whether the
			 pharmacy is an independent or chain pharmacy;</text></subparagraph><subparagraph id="idC08E0477D19C4BB092BA4B4528F1B417" display-inline="no-display-inline" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">whether a product
			 dispensed is a specialty pharmacy product; and</text></subparagraph><subparagraph id="idA87C725EEF124174AE9B5C374B79D3E2" display-inline="no-display-inline" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">whether the
			 pharmacy is located in, or contracts with, a long-term care facility.</text></subparagraph></paragraph><paragraph id="id7A52761BEB1449B98206E4D0845BFF10" display-inline="no-display-inline" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The increase in
			 dispensing fees, taking into consideration the costs described in paragraphs
			 (1), (2), and (3), that is sufficient to create an incentive for a pharmacist
			 to promote the substitution of covered general alternative therapies.</text></paragraph></subsection><subsection id="id1B762FF3A505446781C5D0798490FF9F" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not
			 later than December 1, 2008, the Inspector General of the Department of Health
			 and Human Services shall submit a report to the Secretary of Health and Human
			 Services on the study conducted under subsection (a). The report shall include
			 the following:</text><paragraph id="id1B79DE96BAD24B65919E7DF1A85963AC" display-inline="no-display-inline" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The average cost
			 to dispense a prescription drug under part D of title XVIII of the Social
			 Security Act determined with respect to the area in which a prescription drug
			 plan or an MA–PD plan is offered, including with respect to each PDP region (as
			 determined under section 1860D–11(a)(2) of such Act (42 U.S.C. 1395w–111(a)(2))
			 and each MA region (as determined under section 1858(a) of such Act (42 U.S.C.
			 1395w–27(a)).</text></paragraph><paragraph id="id5F7ADE5974924F22AB0CCF8F11D46F2E" display-inline="no-display-inline" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The findings of
			 the study conducted under subsection (a) with respect to—</text><subparagraph id="id62555DE1CD154E2ABCE7D41EC6325515" display-inline="no-display-inline" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the variation in
			 costs studied under subparagraphs (A) through (D) of paragraph (3) of such
			 subsection; and</text></subparagraph><subparagraph id="id479031B602794F1487A2ACEB2A54A599" display-inline="no-display-inline" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the increase in
			 dispensing fees studied under paragraph (4) of such subsection.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id1E1CFB1E356C49109F9391097AD7BB1D" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Regular update

				to the plan shall provide that the sponsor shall update such standard not less
				frequently than once every 7 days, beginning with an initial update on January
				1 of each year, to accurately reflect the market price of acquiring the
