		  of 1946 to require labeling of raw agricultural forms of ginseng, including the
		  country of harvest, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idF9C9A2D8CD3D4A42A79BD205BC20B9AD" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ginseng Harvest Labeling Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDD4BF6FF82F28475EA697E0CF95A0BE58" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Disclosure of country of harvest for
			 ginseng</header><text display-inline="no-display-inline">The Agricultural
			 Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> et seq.) is amended by
			 adding at the end the following:</text>

				<subtitle commented="no" id="ID9987597224FD4B73B896CE240EFAA196" level-type="subsequent" style="OLC"><enum>E</enum><header display-inline="yes-display-inline">Ginseng</header>
					<section commented="no" display-inline="no-display-inline" id="IDF8A92A9B915F4914AF167F314F4E8840" section-type="subsequent-section"><enum>291.</enum><header display-inline="yes-display-inline">Disclosure of country of harvest</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDB7497DB8C866474388EFF10D56BDAF7C"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id1527B12F45794692810D45C656A31AC9"><enum>(1)</enum><header display-inline="yes-display-inline">Ginseng</header><text display-inline="yes-display-inline">The term <term>ginseng</term> means an herb
				or herbal ingredient that is derived from a plant classified within the genus
				Panax.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91EC65ACF89B43E99A7A19C4978E75A7"><enum>(2)</enum><header display-inline="yes-display-inline">Raw agricultural commodity</header><text display-inline="yes-display-inline">The term <term>raw agricultural
				commodity</term> has the meaning given the term in section 201 of the Federal
				Food, Drug, and Cosmetic Act (21 U.S.C. 321).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF81DA094E234BDB80B6CB44A4CEBDBB"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
				Secretary of Agriculture.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDCB36F1793CE0449AADBB5631EDB226B2"><enum>(b)</enum><header display-inline="yes-display-inline">Disclosure</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4298861F57044447A5AF6BFC0C294124"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A person that offers ginseng for sale as a
				raw agricultural commodity shall disclose to a potential purchaser the country
				of harvest of the ginseng.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52EF28FEF1FF4D95929552B20A93264A"><enum>(2)</enum><header display-inline="yes-display-inline">Importation</header><text display-inline="yes-display-inline">A person that imports ginseng as a raw
				agricultural commodity into the United States shall disclose at the point of
				entry into the United States, in accordance with section 304 of the
				<act-name parsable-cite="TA30">Tariff Act of 1930</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/1304">19 U.S.C. 1304</external-xref>),
				the country in which the ginseng was harvested.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID11C4F9457CA94E459DEDCA09CD87DBAB"><enum>(c)</enum><header display-inline="yes-display-inline">Manner of disclosure</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDEE15606243694B528DDC264A18DA1DB0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The disclosure required by subsection (b)
				shall be provided to a potential purchaser by means of a label, stamp, mark,
				placard, or other easily legible and visible sign on the ginseng or on the
				package, display, holding unit, or bin containing the ginseng.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7B6496460D8A4A3FB357F407AAEED765"><enum>(2)</enum><header display-inline="yes-display-inline">Retailers</header><text display-inline="yes-display-inline">A retailer of ginseng as a raw agricultural
				commodity shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDAE91D18367924D6FAD324633DED585AA"><enum>(A)</enum><text display-inline="yes-display-inline">retain the means of disclosure provided
				under subsection (b); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID61D9379EDF0143E89DC912F529B40B1C"><enum>(B)</enum><text display-inline="yes-display-inline">provide the received means of disclosure to
				a retail purchaser of the ginseng.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD80A46CD45024B5692EC34BA5594E654"><enum>(3)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary shall by regulation prescribe
				with specificity the manner in which disclosure shall be made in a transaction
				at the wholesale or retail level (including a transaction by mail, telephone,
				internet, or in retail stores).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID26190BB55D36484EAA3EA1FBBAC9B369"><enum>(d)</enum><header display-inline="yes-display-inline">Failure To disclose</header><text display-inline="yes-display-inline">The Secretary may impose on a person that
				fails to comply with subsection (b) a civil penalty in an amount of not more
				than—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4BB41D16DC3B485C8645D0D8EF353F0B"><enum>(1)</enum><text display-inline="yes-display-inline">$1,000 for the first day on which the
				failure to disclose occurs; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE4C31F83DD264F708866DE26196516EA"><enum>(2)</enum><text display-inline="yes-display-inline">$250 for each subsequent day on which the
				failure to disclose continues.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFC8549DA60A54FD8A1B65EF9C424D613"><enum>(e)</enum><header display-inline="yes-display-inline">Information</header><text display-inline="yes-display-inline">The Secretary shall make information
				available to wholesalers, importers, retailers, trade associations, and other
				interested persons concerning the requirements of this section (including
				regulations promulgated to carry out this
				section).</text>
						</subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id02B58FFE92054E0289618BE58709CEEE" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act take effect on the date that is 180 days after the
			 date of enactment of this Act.</text>
