		<official-title>To award grants to establish Advanced Multidisciplinary
		  Computing Software Centers, which shall conduct outreach, technology transfer,
		  development, and utilization programs in specific industries and geographic
		  regions for the benefit of small- and medium-size manufacturers and
		  businesses.</official-title>

		<section id="idC37E656D92344C48A019972E65E5042E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Blue Collar Computing and Business
			 Assistance Act of 2007</short-title></quote>.</text>
		</section><section id="ID9742533bf1584e9293a18987d0438844" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDfd8bedc4b0b448c18e4b0abadb865d60"><enum>(1)</enum><header>Advanced
			 multidisciplinary computing software center; center</header><text>The terms
			 <term>Advanced Multidisciplinary Computing Software Center</term> and
			 <term>Center</term> mean a center created by an eligible entity with a grant
			 awarded under section 3.</text>
			</paragraph><paragraph id="id7C9B447116AA42D5ACAA2B44BAFEDF49"><enum>(2)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means any—</text>
				<subparagraph id="IDd2e13ccbcfa5465aa92607ba1dc259c5"><enum>(A)</enum><text>nonprofit
			 organization;</text>
				</subparagraph><subparagraph id="IDf6d18732c3e44d798f9b0b19daf700f7"><enum>(B)</enum><text>consortium of
			 nonprofit organizations; or</text>
				</subparagraph><subparagraph id="IDd93dae9f7d454e4b93a8fd61ebba73f1"><enum>(C)</enum><text>partnership
			 between a for profit and a nonprofit organization.</text>
				</subparagraph></paragraph><paragraph id="IDde4f566e4e8e46bba4cc60ad70316f95"><enum>(3)</enum><header>Nonprofit
			 organization</header><text>The term <term>nonprofit organization</term> means
			 any organization that—</text>
				<subparagraph id="idBC7EFBBC92224C99A1900E3C3C721DC5"><enum>(A)</enum><text>is described in
			 section 501(c)(3) of the Internal Revenue Code of 1986; and</text>
				</subparagraph><subparagraph id="id0E8C67BD2651454F8F88CB48D27FFFBD"><enum>(B)</enum><text>is exempt from
			 taxation under section 501(a) of such Code.</text>
				</subparagraph></paragraph><paragraph id="ID67e22d8002f949018208676aa23b06eb"><enum>(4)</enum><header>Small business
			 or manufacturer</header><text>The term <term>small business or
			 manufacturer</term> has the meaning given the term <term>small business
			 concern</term> in section 3(a) of the Small Business Act (15 U.S.C. 632(a)),
			 including a small manufacturing concern.</text>
			</paragraph><paragraph id="ID76873591ca3e4eb1bd289cf7e159811e"><enum>(5)</enum><header>Under
			 secretary</header><text>The term <term>Under Secretary</term> means the Under
			 Secretary for Technology of the Department of Commerce.</text>
			</paragraph></section><section id="ID09ad2556f88e416d98267a5a95ce4129"><enum>3.</enum><header>Advanced
			 multidisciplinary computing software center grants</header>
			<subsection id="IDd30489f6f8184db58ba52e77c1b4bda3"><enum>(a)</enum><header>In
			 general</header><text>The Under Secretary shall award grants to eligible
			 entities to establish up to 5 Advanced Multidisciplinary Computing Software
			 Centers throughout the United States.</text>
			</subsection><subsection id="idEEC3DEF5F7FF4E0F9297C0A7FBFFBCA8"><enum>(b)</enum><header>Purposes</header><text>Each
			 Center established with grant funds awarded under subsection (a) shall—</text>
				<paragraph id="ID9d4d585c80b040ccbed385e851c23e07"><enum>(1)</enum><text>conduct general
			 outreach to small businesses and manufacturers in all industry sectors within
			 the geographic region assigned to the Center by the Under Secretary; and</text>
				</paragraph><paragraph id="ID2b8d929055b54d6c92323dcd316b5b26"><enum>(2)</enum><text>conduct
			 technology transfer, development, and utilization programs for businesses
			 throughout the United States in the specific industry sector assigned to the
			 Center by the Under Secretary.</text>
				</paragraph></subsection><subsection id="ID07db3316183342678c6fbc9f46c21ff8"><enum>(c)</enum><header>Application</header>
				<paragraph id="ID6709a0a8d8664ad5a98cc18e95c2028f"><enum>(1)</enum><header>In
			 general</header><text>Each eligible entity desiring a grant under this section
			 shall submit an application to the Under Secretary at such time, in such
			 manner, and accompanied by such additional information as the Under Secretary
			 may reasonably require.</text>
				</paragraph><paragraph id="IDdc1add6e7b90434185812b85c167aa64"><enum>(2)</enum><header>Publication in
			 federal register</header><text>Not later than 6 months after the date of the
			 enactment of this Act, the Under Secretary shall publish the application
			 requirements referred to in paragraph (1) in the Federal Register.</text>
				</paragraph><paragraph id="ID9050a1d4a13547f09b22582d748d1674"><enum>(3)</enum><header>Contents</header><text>Each
			 application submitted under paragraph (1) shall—</text>
					<subparagraph id="ID1f09770ff06b40a8bb7b4c258967c9db"><enum>(A)</enum><text>conform to the
			 requirements prescribed by the Under Secretary under this subsection;
			 and</text>
					</subparagraph><subparagraph id="ID2fbe4137a1784902bf033f983065ad11"><enum>(B)</enum><text>a proposal for
			 the allocation of the legal rights associated with any invention that may
			 result from the activities of the proposed Center.</text>
					</subparagraph></paragraph><paragraph id="ID49d25b0b157343bf886ce4db42d6bf53"><enum>(4)</enum><header>Selection
			 criteria</header><text>In evaluating each application submitted under paragraph
			 (1) on the basis of merit, the Under Secretary shall consider—</text>
					<subparagraph id="IDce178bd792594bc68389ab61ff717542"><enum>(A)</enum><text>the extent to
			 which the eligible entity—</text>
						<clause id="IDb9dc8eeb39884210aa17381fa87743c1"><enum>(i)</enum><text>has
			 a partnership with nonprofit organizations, businesses, software vendors, and
			 academia recognized for relevant expertise in its selected industry
			 sector;</text>
						</clause><clause id="ID3595e6567dbc467abbb0b4842b83aab1"><enum>(ii)</enum><text>uses
			 State-funded academic supercomputing centers and universities or colleges with
			 expertise in the computational needs of the industry assigned to the eligible
			 entity under subsection (b)(1);</text>
						</clause><clause id="ID462d3f935a4943279329c6047e606e95"><enum>(iii)</enum><text>has a history
			 of working with small businesses and manufacturers;</text>
						</clause><clause id="ID08db317acf39469f857dc6a6389e0acb"><enum>(iv)</enum><text>has experience
			 providing educational programs aimed at helping organizations adopt the use of
			 high-performance computing and computational science;</text>
						</clause><clause id="ID118bbda58d5e48f596768f41a8bc4611"><enum>(v)</enum><text>has
			 partnerships with education or training organizations that can help educate
			 future workers on the application of computational science to industry
			 needs;</text>
						</clause><clause id="ID342410767aad4338a2b00a2e31a030c7"><enum>(vi)</enum><text>is
			 accessible to businesses, academia, incubators, or other economic development
			 organizations via high-speed networks; and</text>
						</clause><clause id="IDa4d3b309f8b84f7b8274c73317b1551c"><enum>(vii)</enum><text>is capable of
			 partnering with small businesses and manufacturers to enhance the ability of
			 such entities to compete in the global marketplace;</text>
						</clause></subparagraph><subparagraph id="ID181dfdbeda614529a237676ed3b52cec"><enum>(B)</enum><text>the ability of
			 the eligible entity to enter successfully into collaborative agreements with
			 small businesses and manufacturers to experiment with new high performance
			 computing and computational science technologies; and</text>
					</subparagraph><subparagraph id="ID5e4efe8b2f5f439b9cde329ada24a7a2"><enum>(C)</enum><text>such other
			 factors that the Under Secretary considers relevant.</text>
					</subparagraph></paragraph></subsection><subsection id="ID1062de8b5a6b46869a904890d1e1d880"><enum>(d)</enum><header>Maximum
			 amount</header><text>The Under Secretary may not award a grant under this
			 section in an amount which exceeds $5,000,000 for any year of the grant
			 period.</text>
			</subsection><subsection id="ID71ef688cd2fe4cfca132d428d571f6be"><enum>(e)</enum><header>Duration</header>
				<paragraph id="ID0835a46e07cf40c9811b146504e9d47e"><enum>(1)</enum><header>In
			 general</header><text>Except as provided under paragraph (2), a grant may not
			 be awarded under this section for a period exceeding 5 years.</text>
				</paragraph><paragraph id="ID2d9384a1d5a54867bbb2dea27ae49fc2"><enum>(2)</enum><header>Renewal</header><text>The
			 Under Secretary may renew any grant awarded under this section.</text>
				</paragraph></subsection><subsection id="IDc2fadaa460fb43a683fac553bdb4aec5"><enum>(f)</enum><header>Matching
			 requirement</header>
				<paragraph id="ID66a04f458b6e4d0aa6b07cff8c61e5d6"><enum>(1)</enum><header>In
			 general</header><text>The Under Secretary may not award a grant under this
			 section unless the eligible entity receiving such grant agrees to provide not
			 less than 50 percent of the capital and annual operating and maintenance funds
			 required to create and maintain the Center established with such grant
			 funds.</text>
				</paragraph><paragraph id="ID8434dc8757b24c6da3cb4e58dced79c3"><enum>(2)</enum><header>Funding from
			 other federal, state, or local government agencies</header><text>The funds
			 provided by the eligible entity under paragraph (1) may include amounts
			 received by the eligible entity from the Federal Government (other than the
			 Department of Commerce), a State, or a unit of local government.</text>
				</paragraph></subsection><subsection id="IDc0ab144d5b8b40678aa4c7a801cdf1b6"><enum>(g)</enum><header>Limitation on
			 administrative expenses</header><text>The Under Secretary may establish a
			 reasonable limitation on the portion of each grant awarded under this section
			 that may be used for administrative expenses or other overhead costs.</text>
			</subsection><subsection id="ID0d747af4a43a46d68e87d8bb3f166e3b"><enum>(h)</enum><header>Fees and
			 alternative funding sources authorized</header>
				<paragraph id="ID6746225b6565423897f90d39a01391f5"><enum>(1)</enum><header>In
			 general</header><text>A Center established with a grant awarded under this
			 section may, in accordance with regulations established by the Under
			 Secretary—</text>
					<subparagraph id="ID424b8752a4db4aa29a1517715375b0ad"><enum>(A)</enum><text>collect a nominal
			 fee from a small business or manufacturer for a service provided under this
			 section, if such fee is utilized for the budget and operation of the Center;
			 and</text>
					</subparagraph><subparagraph id="IDd2268bf6ae614d4ca99435a319fee72b"><enum>(B)</enum><text>accept financial
			 assistance from the Federal Government (other than the Department of Commerce)
			 for capital costs and operating budget expenses.</text>
					</subparagraph></paragraph><paragraph id="ID13d4576061b0468ca3c3878a4ec740df"><enum>(2)</enum><header>Condition</header><text>Any
			 Center receiving financial assistance from the Federal Government (other than
			 the Department of Commerce) may be selected, and if selected shall be operated,
			 in accordance with this section.</text>
				</paragraph></subsection></section><section id="ID27c294b1d7ef410e8cfc57e725a97ed0"><enum>4.</enum><header>Use of
			 funds</header><text display-inline="no-display-inline">Grant funds received
			 under section 3 shall be used for the benefit of businesses in the industry
			 sector designated by the Under Secretary under section 3(b)(1) to—</text>
			<paragraph id="ID6102a10d9ddd43bf82edfa85b4169b18"><enum>(1)</enum><text>create a
			 repository of nonclassified, nonproprietary new and existing federally funded
			 software and algorithms;</text>
			</paragraph><paragraph id="IDafc8fe5c0b574b2484780b16cf0a8add"><enum>(2)</enum><text>test and validate
			 software in the repository;</text>
			</paragraph><paragraph id="IDf060bfe9b56d44919b507109c758dcb6"><enum>(3)</enum><text>determine when
			 and how the industry sector it serves could benefit from resources in the
			 repository;</text>
			</paragraph><paragraph id="IDf2a9b09a18d74aada27f9b270858666e"><enum>(4)</enum><text>work with
			 software vendors to commercialize repository software and algorithms from the
			 repository;</text>
			</paragraph><paragraph id="IDf869e0ced43c4f14a2678f51f48f66b6"><enum>(5)</enum><text>make software
			 available to small businesses and manufacturers where it has not been
			 commercialized by a software vendor;</text>
			</paragraph><paragraph id="ID7bc60fdbf4c34832ae06b7bf1e48097e"><enum>(6)</enum><text>help software
			 vendors, small businesses, and manufacturers test or utilize the software on
			 high-performance computing systems; and</text>
			</paragraph><paragraph id="ID022ee459d17a4802be6dcde36b9b14b0"><enum>(7)</enum><text>maintain a
			 research and outreach team that will work with small businesses and
			 manufacturers to aid in the identification of software or computational science
			 techniques which can be used to solve challenging problems, or meet
			 contemporary business needs of such organizations.</text>
			</paragraph></section><section id="ID9070ac90e21c4caca4adc44238d74dda"><enum>5.</enum><header>Reports and
			 evaluations</header>
			<subsection id="ID4803d1e0d187484b9f69de2ae1463647"><enum>(a)</enum><header>Annual
			 report</header><text>Each eligible entity that receives a grant under section 3
			 shall submit an annual report to the Under Secretary that describes—</text>
				<paragraph id="idB73BE26C67E648AF8D30EE717F30DF98"><enum>(1)</enum><text>the goals of the
			 Center established by the eligible entity; and</text>
				</paragraph><paragraph id="id7FF4F358F6BC4C6B897000772ECB55BE"><enum>(2)</enum><text>the progress made
			 by the eligible entity in achieving the purposes described in section
			 3(b).</text>
				</paragraph></subsection><subsection id="ID904e372a87204e56afe4fa7e711c4e72"><enum>(b)</enum><header>Evaluation</header><text>The
			 Under Secretary shall establish a peer review committee, composed of
			 representatives from industry and academia, to review the goals and progress
			 made by each Center during the grant period.</text>
			</subsection></section><section id="ID94bc5b33e6624e64b2e825a10a4b1163"><enum>6.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="ID42f5b97ee62546fb9f03b79125ecc070"><enum>(a)</enum><header>In
			 general</header><text>There are authorized to be appropriated $25,000,000 for
			 each of the fiscal years 2008 through 2012 to carry out this Act.</text>
			</subsection><subsection id="ID3d3126b40fb14524aace7eb96164151a"><enum>(b)</enum><header>Availability</header><text>Funds
			 appropriated pursuant to subsection (a) shall remain available until
			 expended.</text>
