		<official-title>To amend the Lacey Act Amendments of 1981 to prevent
		  illegal logging practices, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Combat Illegal Logging Act of
			 2007</short-title></quote>.</text>
		</section><section id="id60012C36DD104518BDAA61DB532BEF19"><enum>2.</enum><header>Prevention of
			 illegal logging practices</header><text display-inline="no-display-inline">The
			 Lacey Act Amendments of 1981 are amended—</text>
			<paragraph id="idBDEB616E6A214DAFAD8FA366C5A0072D"><enum>(1)</enum><text>in section 2 (16
			 U.S.C. 3371)—</text>
				<subparagraph id="idA1A123BD0AC7426CA4A978DD4BD0D229"><enum>(A)</enum><text>by striking
			 subsection (f) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4D86AA12556441A5A0E89024007FB024" style="OLC">
						<subsection id="id347DD8FFCECD4E2990F71B3DA7D56F5E"><enum>(f)</enum><header>Plant</header>
							<paragraph id="id50020BCAD60D4C03B3ED9556F5B3A946"><enum>(1)</enum><header>In
				general</header><text>The term <term>plant</term> means any wild member of the
				plant kingdom, including roots, seeds, parts, and products thereof.</text>
							</paragraph><paragraph id="idDEDE8B6933E3493BA33B8AE3CD20913B"><enum>(2)</enum><header>Exclusions</header><text>The
				term <term>plant</term> excludes any common food crop or cultivar that is a
				species not listed—</text>
								<subparagraph id="id27E101E017244BD69065E2927AD228C4"><enum>(A)</enum><text>in the Convention
				on International Trade in Endangered Species of Wild Fauna and Flora, done at
				Washington on March 3, 1973 (27 UST 1087; TIAS 8249); or</text>
								</subparagraph><subparagraph id="id3E6ECC5E60D24C0E88465DA4C1725784"><enum>(B)</enum><text>as an endangered
				or threatened species under the Endangered Species Act of 1973 (16 U.S.C. 1531
				et
				seq.).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idB760BD06B0204508A874AB138F5F62A4"><enum>(B)</enum><text>in subsection
			 (h), by inserting <quote>also</quote> after <quote>plants the term</quote>;
			 and</text>
				</subparagraph><subparagraph id="id8971185C729D4B66A1C6E3D91C7C7350"><enum>(C)</enum><text>by striking
			 subsection (j) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6B517B6B32F44C2FA4F53DB7A137DD12" style="OLC">
						<subsection id="id86B39D58311F4D4ABE96BF12630EB140"><enum>(j)</enum><header>Take</header><text>The
				term <term>take</term> means—</text>
							<paragraph id="id8D40FF0E65BE4CAABEFD818DC4784778"><enum>(1)</enum><text>to capture, kill,
				or collect; and</text>
							</paragraph><paragraph id="idB531ADC296574EEC8E25E2521281AAA6"><enum>(2)</enum><text>with respect to a
				plant, also to harvest, cut, log, or
				remove.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id9427CE11A81741E19005F024BD01806B"><enum>(2)</enum><text>in section 3 (16
			 U.S.C. 3372)—</text>
				<subparagraph id="idB3712AD90726463C8FCCF33DCD8FCC3A"><enum>(A)</enum><text>in subsection
			 (a)—</text>
					<clause id="id0524DFC2C2CF4F1C920BD9CF7AE872EF"><enum>(i)</enum><text>in
			 paragraph (2), by striking subparagraph (B) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id5EB7941F382E4F5F830CBB879694803C" style="OLC">
							<subparagraph id="idD485DAA172434A5089B41CEA23EE53D1"><enum>(B)</enum><text>any plant—</text>
								<clause id="idDDF2A21E50154262A8B21B7FD574EF69"><enum>(i)</enum><text>taken,
				transported, possessed, or sold in violation of any foreign law or any law or
				regulation of any State that protects plants or that regulates—</text>
									<subclause id="ID9af45013e20b4f89a08fafd9e1e31845"><enum>(I)</enum><text>the theft of
				plants;</text>
									</subclause><subclause id="ID71085f898bf34e1984cbf242007312e9"><enum>(II)</enum><text>the taking of
				plants from a park, forest reserve, or other officially protected area;</text>
									</subclause><subclause id="ID39d1df01e1014799a203c18632870d4c"><enum>(III)</enum><text>the taking of
				plants from an officially designated area; or</text>
									</subclause><subclause id="ID16f6ae0637a3485cbdf8fe6ff5b081a8"><enum>(IV)</enum><text>the taking of
				plants without, or contrary to, required authorization;</text>
									</subclause></clause><clause id="IDd2fb2a848df749c381221a2d0987b767"><enum>(ii)</enum><text>taken,
				transported, or exported without the payment of appropriate royalties, taxes,
				or stumpage fees required by any foreign law or by any law or regulation of any
				State; or</text>
								</clause><clause id="IDec9cd7ff5d76470eb4266422576ae58d"><enum>(iii)</enum><text>exported or
				transshipped in violation of any limitation under any foreign law or by any law
				or regulation of any State; or</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause><clause id="idD8C568299EC84376BD8431A537F8711A"><enum>(ii)</enum><text>in
			 paragraph (3), by striking subparagraph (B) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idC4F0EA2582064210AE464C8518909B5E" style="OLC">
							<subparagraph id="id7E82A549FEBA42589AE138CE82256963"><enum>(B)</enum><text>to possess any
				plant—</text>
								<clause id="idF8FA29C93A984151A1A0526D2733A01F"><enum>(i)</enum><text>taken,
				transported, possessed, or sold in violation of any foreign law or any law or
				regulation of any State that protects plants or that regulates—</text>
									<subclause id="id353794CDE22441ECA466493A96A4B65F"><enum>(I)</enum><text>the theft of
				plants;</text>
									</subclause><subclause id="idD4D2A1B7B5D74F6187EF396D52697E85"><enum>(II)</enum><text>the taking of
				plants from a park, forest reserve, or other officially protected area;</text>
									</subclause><subclause id="id3CABA448E09D40808DBE44F9D94F5F71"><enum>(III)</enum><text>the taking of
				plants from an officially designated area; or</text>
									</subclause><subclause id="id00EA5055AE364278A53AFD7D2357DFDF"><enum>(IV)</enum><text>the taking of
				plants without, or contrary to, required authorization;</text>
									</subclause></clause><clause id="idAD2FFC8AB5704A398EC6F72EF2AA56BF"><enum>(ii)</enum><text>taken,
				transported, or exported without the payment of appropriate royalties, taxes,
				or stumpage fees required by any foreign law or by any law or regulation of any
				State; or</text>
								</clause><clause id="idB87207BA69BF4737A80EDDBE78E27D48"><enum>(iii)</enum><text>exported or
				transshipped in violation of any limitation under any foreign law or by any law
				or regulation of any State; or</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="idCD941F4817D5447FA69E5211A315C6D5"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBE9A1C243D0D46BDBB0B7A255F398C57" style="OLC">
						<subsection id="id5B81AF8792ED44278CE1E5F3BDB55018"><enum>(f)</enum><header>Plant
				declarations</header>
							<paragraph id="id4BFD071997C64E4E9A2198BF5F1F87BC"><enum>(1)</enum><header>In
				general</header><text>Effective 180 days from the date of enactment of this
				subsection, it shall be unlawful for any person to import any plant unless the
				person files upon importation where clearance is requested a declaration that
				contains—</text>
								<subparagraph id="id3FB426B879C144E09E1B9C1BA6E7B3AC"><enum>(A)</enum><text>the scientific
				name of any plant (including the genus and species of the plant) contained in
				the importation;</text>
								</subparagraph><subparagraph id="idDAD968C3EA8A4FF7B9F5A8F365651CDC"><enum>(B)</enum><text>a description
				of—</text>
									<clause id="id8E653ECD7A6948A6906A7C6450847968"><enum>(i)</enum><text>the value of the
				importation; and</text>
									</clause><clause id="id6B8B3652BF464D18A7E76463E5032F36"><enum>(ii)</enum><text>the quantity,
				including the unit of measure, of the plant; and</text>
									</clause></subparagraph><subparagraph id="idBC149135E16341A392068A1F50B79346"><enum>(C)</enum><text>the name of the
				country from which the plant was taken.</text>
								</subparagraph></paragraph><paragraph id="id61F55AD8A9154C238321CAA1048DF24F"><enum>(2)</enum><header>Declaration
				relating to plant products</header><text>Until the date on which the Secretary
				promulgates a regulation under paragraph (5), a declaration relating to a plant
				product shall—</text>
								<subparagraph id="id7F3B7C3807CF4F198575CE99A76F1A4B"><enum>(A)</enum><text>in the case in
				which the species of plant used to produce the plant product that is the
				subject of the importation varies, and the species used to produce the plant
				product is unknown, contain the name of each species of plant that may have
				been used to produce the plant product; and</text>
								</subparagraph><subparagraph id="id09AFC0AAAEE54D5385ED829023F349D3"><enum>(B)</enum><text>in the case in
				which the species of plant used to produce the plant product that is the
				subject of the importation is commonly taken from more than 1 country, and the
				country from which the plant was taken and used to produce the plant product is
				unknown, contain the name of each country from which the plant may have been
				taken.</text>
								</subparagraph></paragraph><paragraph id="id82827F5CD5E74C589C47DDFA59B09961"><enum>(3)</enum><header>Review</header><text>Not
				later than 2 years after the date of enactment of this subsection, the
				Secretary shall review the implementation of each requirement described in
				paragraphs (1) and (2).</text>
							</paragraph><paragraph id="id374CA7C4F3DC4C92BDE521D352ADE9E9"><enum>(4)</enum><header>Report</header>
								<subparagraph id="idD8572D393BC146009682BA5F0D1BFA73"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date on which the
				Secretary completes the review under paragraph (3), the Secretary shall submit
				to the appropriate committees of Congress a report containing—</text>
									<clause id="id76A49192AE09499295DDCB07EAED5315"><enum>(i)</enum><text>an evaluation
				of—</text>
										<subclause id="idBC3E71E554134E9C8034B23DE5B64797"><enum>(I)</enum><text>the effectiveness
				of each type of information required under paragraphs (1) and (2) in assisting
				enforcement of section 3; and</text>
										</subclause><subclause id="idC0C23E42014040949267346151F7F801"><enum>(II)</enum><text>the potential to
				harmonize each requirement described in paragraphs (1) and (2) with other
				applicable import regulations in existence as of the date of the report;</text>
										</subclause></clause><clause id="id7BD7BFAABE0145279F18E1A68ACCAF1D"><enum>(ii)</enum><text>recommendations
				for such legislation as the Secretary determines to be appropriate to assist in
				the identification of plants that are imported into the United States in
				violation of section 3; and</text>
									</clause><clause id="id9D41400D2EB2465FB90177D7993862DD"><enum>(iii)</enum><text>an analysis of
				the effect of the provisions of subsection (a) and (f) on—</text>
										<subclause id="id15E55837AB934EE6981442F82313417C"><enum>(I)</enum><text>the cost of legal
				plant imports; and</text>
										</subclause><subclause id="idFD07D3F2C28B4076AB793000F04CDB6B"><enum>(II)</enum><text>the extent and
				methodology of illegal logging practices and trafficking.</text>
										</subclause></clause></subparagraph><subparagraph id="idF0888D731F8D419DA829CE7AC906FC6D"><enum>(B)</enum><header>Public
				participation</header><text>In conducting the review under paragraph (3), the
				Secretary shall provide public notice and an opportunity for comment.</text>
								</subparagraph></paragraph><paragraph id="idB0C012E4128F4D35B3EBF5317A01BD5C"><enum>(5)</enum><header>Promulgation of
				regulations</header><text>Not later than 180 days after the date on which the
				Secretary completes the review under paragraph (3), the Secretary may
				promulgate regulations—</text>
								<subparagraph id="id83E51EA3FEF142AEA2B7DD7A79E1C1D1"><enum>(A)</enum><text>to limit the
				applicability of any requirement described in paragraph (2) to specific plant
				products; and</text>
								</subparagraph><subparagraph id="idE9A017EB4F9B49F5B5D91FBF3141E7C6"><enum>(B)</enum><text>to make any other
				necessary modification to any requirement described in paragraph (2), as
				determined by the Secretary based on the review under paragraph
				(3).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="idD1C90A82A81F45158C119794341CB644"><enum>(3)</enum><text>in section
			 7(a)(1) (16 U.S.C. 3376(a)(1)), by striking <quote>section 4</quote> and
			 inserting <quote>section 3(f), section 4,</quote>.</text>
