(a)This Act may be cited as the Meth Mouth Prevention and Community Recovery
Act
.
(b)The
purposes of this Act are—
(1)to investigate and
report on all aspects of meth mouth, including its causes, public health
impact, innovative models for its prevention, and new and improved methods for
its treatment;
(2)to ensure dentists
and allied dental personnel are able to recognize the signs of substance abuse
in their patients, discuss the nature of addiction as it relates to oral health
and dental care, and facilitate appropriate help for patients (and family
members of patients) who are affected by a substance use disorder;
(3)to determine
whether, how, and to what degree educating youth about meth mouth is an
effective strategy for preventing or reducing the prevalence of methamphetamine
use; and
(4)to underscore the
many ways that dentists and other oral health professionals can contribute to
the general health of their patients, their communities, and the country as a
whole.

<subsection id="H950865294CB644B0AF7DAEDE43E8B1E4"><enum>(a)</enum><header>Findings</header><text>The
Congress finds as follows:</text>
<paragraph id="HE28086271549475AA2D03106FDCD432D"><enum>(1)</enum><text>According to the
Substance Abuse and Mental Health Services Administration, first-time
methamphetamine use is most likely to occur between the ages of 18 and 25.
Prevention efforts must therefore begin during the teen years.</text>
</paragraph><paragraph id="HF28904B637454B358200C9DDA13BC500"><enum>(2)</enum><text>Most young people
do not realize that methamphetamine use can quickly leave their teeth
blackened, stained, rotting, and crumbling or falling apart and that the
treatment options are often limited.</text>
</paragraph><paragraph id="HC24B8369BAD14A628DC06CD42F486FE6"><enum>(3)</enum><text>By educating youth
about meth mouth, oral health advocates can play a substantial role in helping
to prevent first-time methamphetamine use.</text>
</paragraph></subsection><subsection id="H848311C388EC4F688753E8ED60E82F51"><enum>(b)</enum><header>Purpose</header><text>The
purpose of this title is to provide for a number of projects to evaluate
whether, how, and to what degree educating youth about meth mouth is an
effective strategy for preventing or reducing methamphetamine use.</text>
</subsection><subsection id="H1B67CD0307A24A1DA9F7C2C18CCCC4"><enum>(c)</enum><header>Definitions</header><text>In
this title:</text>
<paragraph id="H894B81C0323D494F8482D819EF4FD329"><enum>(1)</enum><header>Anti-drug
coalition</header><text>The term <term>anti-drug coalition</term> has the
meaning given to the term <term>eligible coalition</term> in section 1023 of
the National Narcotics Leadership Act of 1988 (21 U.S.C. 1523).</text>
</paragraph><paragraph id="HCD7DACA2B4A1400F9C85C869928BEEE4"><enum>(2)</enum><header>Dental
organization</header><text>The term <term>dental organization</term> means a
group of persons organized to represent the art and science of dentistry or who
are otherwise associated for the primary purpose of advancing the public’s oral
health.</text>
</paragraph><paragraph id="H235E534E88804E63A7EE49077BF0EBB"><enum>(3)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the
Director of the Center for Substance Abuse Prevention.</text>
</paragraph><paragraph id="HE2638703AEDC474DA925035C3550009E"><enum>(4)</enum><header>Elementary
school; secondary school</header><text>The terms <term>elementary school</term>
and <term>secondary school</term> have the meanings given to such terms in
section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
7801).</text>
</paragraph><paragraph id="H8E8E926B3AE34BB3AC25D351FEA52C1C"><enum>(5)</enum><header>Indian; indian
tribe; tribal organization</header><text>The terms <term>Indian</term>,
<term>Indian tribe</term>, and <term>tribal organization</term> have the
meanings given to such terms in section 4 of the Indian Self-Determination and
Education Assistance Act (25 U.S.C. 450b).</text>
</paragraph><paragraph id="H74468970EC8E4AC3B7A2640032EBC02E"><enum>(6)</enum><header>Meth
mouth</header><text>The term <term>meth mouth</term> means a distinct and often
severe pattern of oral decay that is commonly associated with methamphetamine
use.</text>
</paragraph><paragraph id="HF4D40860E3DC46D7B004CA50FF288DB6"><enum>(7)</enum><header>Substance use
disorder</header><text>The term <term>substance use disorder</term> means any
harmful pattern of alcohol or drug use that leads to clinically significant
impairment in physical, psychological, interpersonal, or vocational
functioning.</text>
</paragraph><paragraph id="H481B2E860F9F44DDB2A6E49E971BE15B"><enum>(8)</enum><header>Youth</header><text>The
term <term>youth</term> has the meaning given to such term in section 1023 of
the National Narcotics Leadership Act of 1988 (21 U.S.C. 1523).</text>
</paragraph></subsection></section><section id="H2C837756C4DC4D439000C3CBF9160786"><enum>102.</enum><header>Methamphetamine
prevention demonstration projects</header>
<subsection id="H0F99167935C54E508CCD28CA8EDC241D"><enum>(a)</enum><header>In
general</header><text>In carrying out section 519E of the Public Health Service
Act (42 U.S.C. 290bb–25e), the Director of the Center for Substance Abuse
Prevention shall make grants to public and private nonprofit entities to enable
such entities to determine whether, how, and to what degree educating youth
about meth mouth is an effective strategy for preventing or reducing
methamphetamine use.</text>
</subsection><subsection id="H9248E331AA374AF9B2E1A215BE25F4BF"><enum>(b)</enum><header>Use of
funds</header>
<paragraph id="HA28AB043267345A89B82B58C13C45DCB"><enum>(1)</enum><header>Mandatory
uses</header><text>Amounts awarded under this title shall be used for projects
that focus on, or include specific information about, the oral health risks
associated with methamphetamine use.</text>
</paragraph><paragraph id="H3C5191F8084D41D8B66F6BE4117CF5A"><enum>(2)</enum><header>Authorized
uses</header><text>Amounts awarded under this title may be used—</text>
<subparagraph id="HB13428C57C84408E83A940E64FC2F999"><enum>(A)</enum><text>to develop or
acquire instructional aids to enhance the teaching and learning process
(including audiovisual items, computer-based multimedia, supplemental print
material, and similar resources);</text>
</subparagraph><subparagraph id="H8047B3BAE35244188E6EE5064EFCC8AF"><enum>(B)</enum><text>to develop or
acquire promotional items to be used for display or distribution on school
campuses (including posters, flyers, brochures, pamphlets, message-based
apparel, buttons, stickers, and similar items);</text>
</subparagraph><subparagraph id="HEF0C9820AAB84B5C9D001E3300A152B4"><enum>(C)</enum><text>to facilitate or
directly furnish school-based instruction concerning the oral health risks
associated with methamphetamine use;</text>
</subparagraph><subparagraph id="H166D6655751E4179A3BCC79C865BDB5C"><enum>(D)</enum><text>to train State and
local health officials, health professionals, members of anti-drug coalitions,
parents, and others how to carry messages about the oral health risks
associated with methamphetamine use to youth; and</text>
</subparagraph><subparagraph id="HBB545B886ACB48CC96E285EC904E35E4"><enum>(E)</enum><text>to support other
activities deemed appropriate by the Director.</text>
</subparagraph></paragraph></subsection><subsection id="HAB647B63AA5745A9A1A4ED74170533E7"><enum>(c)</enum><header>Grant
eligibility</header>
<paragraph id="HA9726050511A458BB2CE0084E53573C"><enum>(1)</enum><header>Application</header><text>To
be eligible for grants under this title, an entity shall prepare and submit an
application at such time, in such manner, and containing such information as
the Director may reasonably require.</text>
</paragraph><paragraph id="H16D13265C32E453FBA9C2392DE78D596"><enum>(2)</enum><header>Contents</header><text>Each
application submitted pursuant to paragraph (1) shall include—</text>
<subparagraph id="H334AE86B7DE54BF4A56EEB4F623444CB"><enum>(A)</enum><text>a description of
the objectives to be attained;</text>
</subparagraph><subparagraph id="HA711363FF8A649D3AFB34F4056942BD1"><enum>(B)</enum><text>a description of
the manner in which the grant funds will be used; and</text>
</subparagraph><subparagraph id="HDC06D28D47B14FA9ABD231D1887F035"><enum>(C)</enum><text>a plan for
evaluating the project’s success using methods that are evidence-based.</text>
</subparagraph></paragraph><paragraph id="H9F68CA3BC99749FFA73CE665FC6FBD55"><enum>(3)</enum><header>Preference</header><text>In
awarding grants under this title, the Director shall give preference to
applicants that intend to—</text>
<subparagraph id="HC5C5C13D4010409EB429BA4326C4E33"><enum>(A)</enum><text>collaborate with
one or more dental organizations;</text>
</subparagraph><subparagraph id="H80AD31CEE6514B4AB2DA10C292DE2F1"><enum>(B)</enum><text>partner with one or
more anti-drug coalitions; and</text>
</subparagraph><subparagraph id="H417C2BF892234AA0BE4CAFB872B08B80"><enum>(C)</enum><text>coordinate their
activities with one or more national, State, or local methamphetamine
prevention campaigns or oral health promotion initiatives.</text>
</subparagraph></paragraph></subsection><subsection id="H6D57C158E9D84EB6BBF618CCD1DEB313"><enum>(d)</enum><header>Limitations</header>
<paragraph id="HFD41D358FB4B42CCBEB000F634ECFDD4"><enum>(1)</enum><header>Grant
amounts</header><text>The amount of an award under this title may not exceed
$50,000 per grantee.</text>
</paragraph><paragraph id="H51A13064161A4DA9A523C8E0558FD403"><enum>(2)</enum><header>Duration</header><text>The
Director shall award grants under this title for a period not to exceed 3
years.</text>
</paragraph></subsection><subsection id="H381794DBF67444C89F3C7BD2BCE86D00"><enum>(e)</enum><header>Evaluation and
dissemination</header><text>The Director shall collect and widely disseminate
information about the effectiveness of the demonstration projects assisted
under this title.</text>
</subsection></section><section id="H6149C46019644F09BAE1A36C8E2DD753"><enum>103.</enum><header>Education for
American Indian and Alaska native children</header><text display-inline="no-display-inline">Not less than 5 percent of the funds
appropriated pursuant to section 104 for a fiscal year shall be awarded to
Indian tribes and tribal organizations for the purpose of educating Indian
youth about the oral health risks associated with methamphetamine use.</text>
</section><section id="H8B38E643FB49408F8BDD58B770F04012"><enum>104.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated for the purpose of carrying out this title
$1,000,000 for each of fiscal years 2009 through 2011. Amounts authorized to be
appropriated under this section are in addition to any other amounts authorized
to be appropriated for such purpose.</text>
</section><enum>II</enum><header>METH
MOUTH RESEARCH INVESTMENT ACT</header>
<section id="HE4E16AEA646042DA83E6B836140041CE"><enum>201.</enum><header>Findings;
purpose; definitions</header>
<subsection id="H61A65771217C43C1850143784DD59447"><enum>(a)</enum><header>Findings</header><text>The
Congress finds as follows:</text>
<paragraph id="HA1066CE39FB54701868CD659EBDBA07"><enum>(1)</enum><text>As
the number of regular methamphetamine users has increased, so has a peculiar
set of dental problems linked to the drug. The condition (known as <quote>meth
mouth</quote>) develops rapidly and is attributed to the drug’s acidic nature,
its ability to dry the mouth, the tendency of users to grind and clench their
teeth, and a drug-induced craving for sugar-laden soft drinks.</text>
</paragraph><paragraph id="H2E189E34B40B48728BD0A300B49C474B"><enum>(2)</enum><text>Meth mouth is
regarded by many as an anecdotal phenomenon. Few peer-reviewed studies have
been published that examine its causes, its physical effects, its prevalence,
or its public health costs.</text>
</paragraph><paragraph id="HA6F487D21DBB49279881EA4DD111B920"><enum>(3)</enum><text>Enhanced research
would help to identify the prevalence and scope of meth mouth. Such research
would also help determine how substances of abuse can damage the teeth and
other oral tissues, and offer the possibility of developing new and improved
prevention, harm-reduction, and cost management strategies.</text>
</paragraph></subsection><subsection id="HA754CE525A524DC697D400F503C9DCE7"><enum>(b)</enum><header>Purpose</header><text>The
purpose of this title is to provide for enhanced research examining all aspects
of meth mouth, including its causes, its public health impact, innovative
models for its prevention, and new and improved methods for its
treatment.</text>
</subsection><subsection id="H852DC72150874E9DAF71C4E27B7D5837"><enum>(c)</enum><header>Definitions</header><text>In
this title:</text>
<paragraph id="HAD1A509B38D04003A0AD138D21C1A429"><enum>(1)</enum><header>Clinical
research; health services research</header><text>The terms <term>clinical
research</term> and <term>health services research</term> shall have the
meanings given to such terms in section 409 of the Public Health Service Act
(42 U.S.C. 284d).</text>
</paragraph><paragraph id="H8BCA08BEA4BD4E66AAF5615DEF09A61D"><enum>(2)</enum><header>Indian; indian
tribe; tribal organization</header><text>The terms <term>Indian</term>,
<term>Indian tribe</term>, and <term>tribal organization</term> shall have the
meanings given to such terms in section 4 of the Indian Self-Determination and
Education Assistance Act (25 U.S.C. 450b).</text>
</paragraph><paragraph id="H1C007DE9745541948331CE1F4DE2AD00"><enum>(3)</enum><header>Meth
mouth</header><text>The term <term>meth mouth</term> means a distinct and often
severe pattern of oral decay that is commonly associated with methamphetamine
use.</text>
</paragraph><paragraph id="HEF1416B183784BDD9507FB8F84B19F94"><enum>(4)</enum><header>Public health
research</header><text>The term <term>public health research</term> means
research that focuses on population-based health measures.</text>
</paragraph><paragraph id="H48B32F1C44224814A8C5AB9C838030F4"><enum>(5)</enum><header>Secretary</header><text>The
term <term>Secretary</term> means the Secretary of Health and Human
Services.</text>
</paragraph><paragraph id="H4780336E5D70443A9B208D1728B23B72"><enum>(6)</enum><header>Substance use
disorder</header><text>The term <term>substance use disorder</term> means any
harmful pattern of alcohol or drug use that leads to clinically significant
impairment in physical, psychological, interpersonal, or vocational
functioning.</text>
</paragraph></subsection></section><section id="HAFEBAFE881414563950322A9300F203"><enum>202.</enum><header>Research on
substance abuse, oral health, and dental care</header>
<subsection id="H08AE57DE01D94CD998267EC8D77EACEA"><enum>(a)</enum><header>Expansion of
activity</header><text>In carrying out part A of title III of the Public Health
Service Act (42 U.S.C. 241 et seq.), the Secretary shall expand and intensify
the clinical research, health services research, and public health research on
associations between substance use disorders, oral health, and the provision of
dental care.</text>
</subsection><subsection id="H6D1A11465E2240A089A7004847EA001F"><enum>(b)</enum><header>Administration</header><text>In
carrying out subsection (a), the Secretary—</text>
<paragraph id="H3ECC3C6F69A4465BBB029C8E8D61ED9B"><enum>(1)</enum><text>may enter into
contracts or agreements with other Federal agencies, including interagency
agreements, to delegate authority for the execution of grants and for such
other activities as may be necessary to carry out this section;</text>
</paragraph><paragraph id="H4D024D2178184B64BA23DAFB7FDCEE5C"><enum>(2)</enum><text>may carry out this
section directly or through grants or cooperative agreements with State, local,
and territorial units of government, Indian tribes, and tribal organizations,
or other public or nonprofit private entities; and</text>
</paragraph><paragraph id="H97E1D397A24048E8A06183043D598C6C"><enum>(3)</enum><text>may request and
use such information, data, and reports from any Federal, State, local, or
private entity as may be required to carry out this section, with the consent
of such entity.</text>
</paragraph></subsection></section><section id="HAF72DBB8CD00439DB8B8859C88BF3899"><enum>203.</enum><header>Study of
methamphetamine-related oral health costs</header>
<subsection id="H3AB52E35490144D6BFF88F2B92AB8288"><enum>(a)</enum><header>In
general</header><text>In carrying out section 202, the Secretary shall conduct
a study to determine whether, how, and to what degree methamphetamine use
affects the demand for (and provision of) dental care. The study shall account
for both genders, all racial and ethnic groups (and subgroups), and persons of
all ages and from all geographic areas as appropriate for the scientific goals
of the research.</text>
</subsection><subsection id="H79BCD844CC8244FAA57C00007F69DA2"><enum>(b)</enum><header>Report</header><text>Not
later than 1 year after the date of enactment of this Act, the Secretary shall
publish a special report detailing the results of the study described in
subsection (a), with findings that address—</text>
<paragraph id="H48948B43306A41CE93F7F1D8BFC71519"><enum>(1)</enum><text>the prevalence and
severity of oral health problems believed to be associated with methamphetamine
use;</text>
</paragraph><paragraph id="H7A6A4F10A5A841C1A89C8E3369C72F46"><enum>(2)</enum><text>the criteria most
commonly used to determine whether a patient’s oral health problems are
associated with methamphetamine use;</text>
</paragraph><paragraph id="HA571EB8E9C2D4BE089B7A89BF229B13F"><enum>(3)</enum><text>the therapies most
commonly used to treat patients with meth mouth;</text>
</paragraph><paragraph id="H5DD81B7070824B339B021C2FFAAAD27"><enum>(4)</enum><text>the clinical
prognosis for patients who received care for meth mouth; and</text>
</paragraph><paragraph id="H46073D1742B342D48DC7FB844BD7D7CA"><enum>(5)</enum><text>the financial
impact of meth mouth on publicly financed dental programs.</text>
</paragraph></subsection></section><section id="HE6D651C4D71A42CE90FD65B08B95BE0"><enum>204.</enum><header>Authorization of
appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated for the purpose of carrying out this title,
$200,000 for each of fiscal years 2009 through 2011. Amounts authorized to be
appropriated under this section are in addition to any other amounts authorized
to be appropriated for such purpose.</text>
</section><enum>III</enum><header>SUBSTANCE ABUSE
EDUCATION FOR DENTAL PROFESSIONALS</header>
<section id="HC7D14D66CF4B4A4C8C1B88DBE5FC8874"><enum>301.</enum><header>Findings;
purpose; definitions</header>
<subsection id="H6033DE9DB420491C002F8CD4FCD44714"><enum>(a)</enum><header>Findings</header><text>The
Congress finds as follows:</text>
<paragraph id="H3110C9DC07DF4314B4F286000170193"><enum>(1)</enum><text>The use of certain
therapeutic agents in dental treatment can jeopardize the health and affect the
relapse potential of patients with substance use disorders.</text>
</paragraph><paragraph id="H371D3F3EA9CA4A458F78469475DFCFA6"><enum>(2)</enum><text>Screening patients
for substance abuse is not a common practice among dentists, according to
several peer-reviewed articles published in the <quote>Journal of the American
Dental Association</quote>. Limited time, inadequate training, and the
potential for alienating patients are among the reasons often cited.</text>
</paragraph><paragraph id="HF77487D6A11443758E2E28117CAE1454"><enum>(3)</enum><text>Dentists receive
little formal education and training in screening patients for substance abuse,
discussing the nature of addiction as it relates to oral health and dental
care, and facilitating appropriate help for patients, and family members of
patients, who are affected by a substance use disorder.</text>
</paragraph><paragraph id="H49614A7C5C0840E1977C8D256BEE00EB"><enum>(4)</enum><text>The American
Dental Association maintains that dentists should be knowledgeable about
substance use disorders in order to safely administer and prescribe controlled
substances and other medications. The American Dental Association further
recommends that dentists become familiar with their community’s substance abuse
treatment resources and be able to make referrals when indicated.</text>
</paragraph><paragraph id="HC586816FC34B4A89B300BBFC00B00FA"><enum>(5)</enum><text>Training can
greatly increase the degree to which dentists, allied dental personnel, and
other health professionals can screen patients for substance abuse, discuss the
nature of addiction as it relates to oral health and dental care, and
facilitate appropriate help for patients, and family members of patients, who
are affected by a substance use disorder.</text>
</paragraph></subsection><subsection id="HD83B632D63DE4ADD91053BD9F87916F4"><enum>(b)</enum><header>Purpose</header><text>The
purpose of this title is to provide for enhanced training and technical
assistance to ensure that dentists and allied dental personnel are able to
recognize the signs of substance abuse in their patients, discuss the nature of
addiction as it relates to oral health and dental care, and facilitate
appropriate help for patients, and family members of patients, who are affected
by a substance use disorder.</text>
</subsection><subsection id="HA4389FB65AAD4B738F7B395013CDF74B"><enum>(c)</enum><header>Definitions</header><text>For
the purposes of this title:</text>
<paragraph id="H59C72AFC8FA1415EBB27EB655F83331F"><enum>(1)</enum><header>Allied dental
personnel</header><text display-inline="yes-display-inline">The term
<term>allied dental personnel</term> means individuals who assist the dentist
in the provision of oral health care services to patients, including dental
assistants, dental hygienists, and dental laboratory technicians who are
employed in dental offices or other patient care facilities.</text>
</paragraph><paragraph id="HF922EA47A1FE4EC181EDF36337B976B3"><enum>(2)</enum><header>Continuing
education</header><text>The term <term>continuing education</term> means
extracurricular learning activities (including classes, lecture series,
conferences, workshops, seminars, correspondence courses, and other programs)
whose purpose is to incorporate the latest advances in science, clinical, and
professional knowledge into the practice of health care (and whose completion
is often a condition of professional licensing).</text>
</paragraph><paragraph id="HC27A4D7E364341E2A83F2D05CF811E49"><enum>(3)</enum><header>Continuing
education credit</header><text>The term <term>continuing education
credit</term> means a unit of study that is used to officially certify or
recognize the successful completion of an activity that is consistent with
professional standards for continuing education.</text>
</paragraph></subsection></section><section id="H8C1623D83851417882BE04434E07D38"><enum>302.</enum><header>Substance abuse
training for dental professionals</header>
<subsection id="H914D3B816ED748B99E6500002E02D824"><enum>(a)</enum><header>In
general</header><text>In carrying out title V of the Public Health Service Act
(42 U.S.C. 290 et seq.), the Administrator of the Substance Abuse and Mental
Health Services Administration shall support training and offer technical
assistance to ensure that dentists and allied dental personnel are prepared
to—</text>
<paragraph id="HB9C0B2B3A850421B8987159B842F3C44"><enum>(1)</enum><text>recognize signs of
alcohol or drug addiction in their patients and the family members of their
patients;</text>
</paragraph><paragraph id="H062F9405D6964DCC8C0004F39C15DC87"><enum>(2)</enum><text>discuss the nature
of substance abuse as it relates to their area of expertise;</text>
</paragraph><paragraph id="HEA24B1132304411CACDBF0F1B044034E"><enum>(3)</enum><text>understand how
certain dental therapies can affect the relapse potential of substance
dependent patients; and</text>
</paragraph><paragraph id="HA869878285FE4B3FA2C70606A1B9D806"><enum>(4)</enum><text>help those
affected by a substance use disorder to find appropriate treatment for their
condition.</text>
</paragraph></subsection><subsection id="H09656C74610548E09E61C695506D2CC9"><enum>(b)</enum><header>Continuing
education credits</header><text>The Administrator of the Substance Abuse and
Mental Health Services Administration may collaborate with professional
accrediting bodies—</text>

support substance abuse training courses for oral health professionals;

the activities described in paragraph (1) be recognized for continuing
education purposes.</text>

of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated for the purpose of carrying out this title,
$500,000 for each of fiscal years 2009 through 2011. Amounts authorized to be
appropriated under this section are in addition to any other amounts authorized
to be appropriated for such purpose.</text>
