		<official-title>To amend the Family and Medical Leave Act of 1993 to
		  provide family and medical leave to primary caregivers of servicemembers with
		  combat-related injuries.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Support for Injured Servicemembers
			 Act of 2007</short-title></quote>.</text>
		</section><section id="ID8964C70690E942869049820D5EE01705"><enum>2.</enum><header>Servicemember
			 family leave</header>
			<subsection id="ID4A5B58F5DFA8437783449D913E7ECCE4"><enum>(a)</enum><header>Definitions</header><text>Section
			 101 of the Family and Medical Leave Act of 1993 (29 U.S.C. 2611) is amended by
			 adding at the end the following:</text>
				<quoted-block id="IDFCBADB33D74B45C4B014A0B40BB89518" style="OLC">
					<paragraph id="ID5CFA3A44F44B46E9BB20788F80302CA0"><enum>(14)</enum><header>Combat-related
				injury</header><text>The term <term>combat-related injury</term> means an
				injury or illness that was incurred (as determined under criteria prescribed by
				the Secretary of Defense)—</text>
						<subparagraph id="id005252A72B7149099EAC947DA47001F5"><enum>(A)</enum><text>as a direct
				result of armed conflict;</text>
						</subparagraph><subparagraph id="id58A9C940B61C4154B7F5D3D9CA7BA3E1"><enum>(B)</enum><text>while an
				individual was engaged in hazardous service;</text>
						</subparagraph><subparagraph id="id6184FAC7CFA34E8AB40DD72B9C1958DB"><enum>(C)</enum><text>in the
				performance of duty under conditions simulating war; or</text>
						</subparagraph><subparagraph id="idAC83A073FF7F48D3B907891DE5738ED9"><enum>(D)</enum><text>through an
				instrumentality of war.</text>
						</subparagraph></paragraph><paragraph id="id989CABF9332A4245AAC5450322746BB9"><enum>(15)</enum><header>Servicemember</header><text>The
				term <term>servicemember</term> means a member of the Armed
				Forces.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID00D4CB7330904DD59772B073C17FB280"><enum>(b)</enum><header>Entitlement to
			 leave</header><text>Section 102(a) of such Act (29 U.S.C. 2612(a)) is amended
			 by adding at the end the following:</text>
				<quoted-block id="IDDE48518AF63C4772A4BE00B20A59FE39" style="OLC">
					<paragraph id="IDDCAF020188BB463CAE7D6E29D3BEA445"><enum>(3)</enum><header>Servicemember
				family leave</header><text>Subject to section 103, an eligible employee who is
				the primary caregiver for a servicemember with a combat-related injury shall be
				entitled to a total of 26 workweeks of leave during any 12-month period to care
				for the servicemember.</text>
					</paragraph><paragraph id="idA1FD54772C884FA5A5182EB7B228EE7F"><enum>(4)</enum><header>Combined leave
				total</header><text>An eligible employee shall be entitled to a combined total
				of 26 workweeks of leave under paragraphs (1) and
				(3).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id0FBE61DD417B4D46A1A72471D19396AA"><enum>(c)</enum><header>Requirements
			 relating to leave</header>
				<paragraph id="ID32D6125CBC194E3DB019D2BCB782C9D3"><enum>(1)</enum><header>Schedule</header><text>Section
			 102(b) of such Act (29 U.S.C. 2612(b)) is amended—</text>
					<subparagraph id="id5BE9E62C7FD84FDE81B30809A75E7A92"><enum>(A)</enum><text>in paragraph (1),
			 by inserting after the second sentence the following: <quote>Subject to
			 paragraph (2), leave under subsection (a)(3) may be taken intermittently or on
			 a reduced leave schedule</quote>; and</text>
					</subparagraph><subparagraph id="idC0AD5212F09D4F7AA2F6438421AE05EC"><enum>(B)</enum><text>in paragraph (2),
			 by inserting <quote>or subsection (a)(3)</quote> after <quote>subsection
			 (a)(1)</quote>.</text>
					</subparagraph></paragraph><paragraph id="IDC98E3B02060146A0BF56966EED313C7F"><enum>(2)</enum><header>Substitution of
			 paid leave</header><text>Section 102(d) of such Act (29 U.S.C. 2612(d)) is
			 amended—</text>
					<subparagraph id="id3BE9506422744171A53CA81A686DEAA4"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="id1852DB82F35046DA94F799808BD9EDB5"><enum>(i)</enum><text>by
			 inserting <quote>(or 26 workweeks in the case of leave provided under
			 subsection (a)(3))</quote> after <quote>12 workweeks</quote> the first place it
			 appears; and</text>
						</clause><clause id="id2D9B124C8E1044AFBD14F6A53F3D6F44"><enum>(ii)</enum><text>by
			 inserting <quote>(or 26 workweeks, as appropriate)</quote> after <quote>12
			 workweeks</quote> the second place it appears; and</text>
						</clause></subparagraph><subparagraph id="idD8078927A8884CED8060ACA9380C33D0"><enum>(B)</enum><text>in paragraph
			 (2)(B), by adding at the end the following: <quote>An eligible employee may
			 elect, or an employer may require the employee, to substitute any of the
			 accrued paid vacation leave, personal leave, family leave, or medical or sick
			 leave of the employee for leave provided under subsection (a)(3) for any part
			 of the 26-week period of such leave under such subsection.</quote>.</text>
					</subparagraph></paragraph><paragraph id="IDA8EDB998257E467AA0BCC5CAC1391DB0"><enum>(3)</enum><header>Notice</header><text>Section
			 102(e) of such Act (29 U.S.C. 2612(e)) is amended by adding at the end the
			 following:</text>
					<quoted-block id="IDC8A8F435268445A6B7778CE4FDF66BF8" style="OLC">
						<paragraph id="ID46B610A5576F4A80B8F7E0D726FE310C"><enum>(3)</enum><header>Notice for
				servicemember family leave</header><text>In any case in which an employee seeks
				leave under subsection (a)(3), the employee shall provide such notice as is
				practicable.</text>
						</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID268E209B3B1C4DE09956E778C2C6666B"><enum>(4)</enum><header>Certification</header><text>Section
			 103 of such Act (29 U.S.C. 2613) is amended by adding at the end the
			 following:</text>
					<quoted-block id="ID52D2745E83044A6B99980F5D5BDD2276" style="OLC">
						<subsection id="IDE2522AF003844C38A1F282D842E6AF28"><enum>(f)</enum><header>Certification
				for Servicemember Family Leave</header><text>An employer may require that a
				request for leave under section 102(a)(3) be supported by a certification
				issued at such time and in such manner as the Secretary may by regulation
				prescribe.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idE1B86CAB957440EA9186276A39174BB0"><enum>(5)</enum><header>Failure to
			 return</header><text>Section 104(c) of such Act (29 U.S.C. 2614(c)) is
			 amended—</text>
					<subparagraph id="idEEA975B3AB61451FB149466BEA6F1833"><enum>(A)</enum><text>in paragraph
			 (2)(B)(i), by inserting <quote>or section 102(a)(3)</quote> before the
			 semicolon; and</text>
					</subparagraph><subparagraph id="id54E500E37481417DB06019E458DAC9ED"><enum>(B)</enum><text>in paragraph
			 (3)(A)—</text>
						<clause id="id8D80B776EC1547DCA80B5E16BFE4D6FF"><enum>(i)</enum><text>in
			 clause (i), by striking <quote>or</quote> at the end;</text>
						</clause><clause id="id67BB97AC5B4E43C08686F8B77DD5CD81"><enum>(ii)</enum><text>in
			 clause (ii), by striking the period and inserting <quote>; or</quote>;
			 and</text>
						</clause><clause id="idDBF058EC4C1E4B8FB95F37A1F0570DFB"><enum>(iii)</enum><text>by adding at
			 the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id0A2913A194314A83B10CD3EF605A0AEC" style="OLC">
								<clause id="id9F2BF3FD30AF42E594FE222B930BBF65"><enum>(iii)</enum><text>a certification
				issued by the health care provider of the person for whom the employee is the
				primary caregiver, in the case of an employee unable to return to work because
				of a condition specified in section
				102(a)(3).</text>
								</clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="id158D25721367476E91B0C781D39E432F"><enum>(6)</enum><header>Enforcement</header><text>Section
			 107 of such Act (29 U.S.C. 2617) is amended, in subsection (a)(1)(A)(i)(II), by
			 inserting <quote>(or 26 weeks, in a case involving leave under section
			 102(a)(3))</quote> after <quote>12 weeks</quote>.</text>
				</paragraph><paragraph id="id7431E5C9086549B89CFBCED48317E82E"><enum>(7)</enum><header>Instructional
			 employees</header><text>Section 108 of such Act (29 U.S.C. 2618) is amended, in
			 subsections (c)(1), (d)(2), and (d)(3), by inserting <quote>or section
			 102(a)(3)</quote> after <quote>section 102(a)(1)</quote>.</text>
				</paragraph></subsection></section><section id="ID9AA2365B0A7A44AD8BCD83BF49E9080F"><enum>3.</enum><header>Servicemember
			 family leave for civil service employees</header>
			<subsection id="IDDC544E0D4B5942BF86175377897100E5"><enum>(a)</enum><header>Definitions</header><text>Section
			 6381 of title 5, United States Code, is amended—</text>
				<paragraph id="IDAD50D85AFF294F75A1571DA848BEBA5A"><enum>(1)</enum><text>in paragraph (5),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="IDA82A0F95BA504620849602D04FD17185"><enum>(2)</enum><text>in paragraph (6),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="IDF65EA6B05377480B81A0694F0F4FFA24"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="ID93CADE0CA97F496AB0D3C7222427270E" style="OLC">
						<paragraph id="id2E68AE7A4E684C5C941F751111FADB20"><enum>(7)</enum><text>the term
				<term>combat-related injury</term> means an injury or illness that was incurred
				(as determined under criteria prescribed by the Secretary of Defense)—</text>
							<subparagraph id="idF74F227835A440D081A8A0D65D770F4A"><enum>(A)</enum><text>as a direct
				result of armed conflict;</text>
							</subparagraph><subparagraph id="id660164353E994DB5817F23F445AEA94D"><enum>(B)</enum><text>while an
				individual was engaged in hazardous service;</text>
							</subparagraph><subparagraph id="id27856C0055C145239D39D050BE5A45F0"><enum>(C)</enum><text>in the
				performance of duty under conditions simulating war; or</text>
							</subparagraph><subparagraph id="idD57100E2DAAE4867850100E20ED411C9"><enum>(D)</enum><text>through an
				instrumentality of war; and</text>
							</subparagraph></paragraph><paragraph id="ID5C1E35C34D8846B38838F26F6B9C4970"><enum>(8)</enum><text>the term
				<term>servicemember</term> means a member of the Armed
				Forces.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID1F598F931FFB40BA84689106A6C18155"><enum>(b)</enum><header>Entitlement to
			 leave</header><text>Section 6382(a) of such title is amended by adding at the
			 end the following:</text>
				<quoted-block id="id127653A7D4AE4989B15565AACE0686DB" style="OLC">
					<paragraph id="idDF1D7BC38533494BB3DA5A9315568ED2"><enum>(3)</enum><text>Subject to
				section 6383, an employee who is the primary caregiver for a servicemember with
				a combat-related injury shall be entitled to a total of 26 administrative
				workweeks of leave during any 12-month period to care for the
				servicemember.</text>
					</paragraph><paragraph id="id85509FE74D014D8CA976A0332FFB6C05"><enum>(4)</enum><text>An employee shall
				be entitled to a combined total of 26 administrative workweeks of leave under
				paragraphs (1) and
				(3).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id439BB83E7F814F9B9EB008AEF1639212"><enum>(c)</enum><header>Requirements
			 relating to leave</header>
				<paragraph id="ID15E0741F2AEE45BAB82BF3780991D624"><enum>(1)</enum><header>Schedule</header><text>Section
			 6382(b) of such title is amended—</text>
					<subparagraph id="id3AB44BCE0D824B4ABA8C670623A011CB"><enum>(A)</enum><text>in paragraph (1),
			 by inserting after the second sentence the following: <quote>Subject to
			 paragraph (2), leave under subsection (a)(3) may be taken intermittently or on
			 a reduced leave schedule.</quote>; and</text>
					</subparagraph><subparagraph id="id6FA14EB25E6042B491B2BA6B362661B2"><enum>(B)</enum><text>in paragraph (2),
			 by inserting <quote>or subsection (a)(3)</quote> after <quote>subsection
			 (a)(1)</quote>.</text>
					</subparagraph></paragraph><paragraph id="ID2AD0A0E4D52D48F0B979906678CFB828"><enum>(2)</enum><header>Substitution of
			 paid leave</header><text>Section 6382(d) of such title is amended by adding at
			 the end the following: <quote>An employee may elect to substitute for leave
			 under subsection (a)(3) any of the employee's accrued or accumulated annual or
			 sick leave under subchapter I for any part of the 26-week period of leave under
			 such subsection.</quote>.</text>
				</paragraph><paragraph id="IDA2C72AED84BC4A2C8E1264D0B12E4865"><enum>(3)</enum><header>Notice</header><text>Section
			 6382(e) of such title is amended by adding at the end the following:</text>
					<quoted-block id="IDB326078CF30544FFA3EE95F99CA1379B" style="OLC">
						<paragraph id="IDCFC4F4AB39864CEDA5EE54EF47C06CB0" indent="up1"><enum>(3)</enum><text>In any case in which an employee
				seeks leave under subsection (a)(3), the employee shall provide such notice as
				is
				practicable.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID5E232D61E0E14010ACF6801A2773A25A"><enum>(4)</enum><header>Certification</header><text>Section
			 6383 of such title is amended by adding at the end the following:</text>
					<quoted-block id="ID00E08D1513A74A27A9057BA16ADB92DB" style="OLC">
						<subsection id="ID70071028979E45BEBFB612EA48524BD7"><enum>(f)</enum><text>An employing
				agency may require that a request for leave under section 6382(a)(3) be
				supported by a certification issued at such time and in such manner as the
				Office of Personnel Management may by regulation
				prescribe.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section></legis-body>
