		  coordinated followup care once newborn screening has been conducted, to
		  reauthorize programs under part A of title XI of such Act, and for other

		<section changed="deleted" committee-id="SSHR00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Newborn Screening Saves Lives Act of
			 2007</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSHR00" id="IDB582F0EE4C394D50B59BA47E2F15CB98" reported-display-style="strikethrough"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID72fb1709026844818067a637843af5ee"><enum>(1)</enum><text>Each year more
			 than 4,000,000 babies born in the United States are screened by State and
			 private laboratories to detect some conditions that may threaten their
			 long-term health.</text>
			</paragraph><paragraph id="IDd8e3709c1c5c44058cfe24c545606591"><enum>(2)</enum><text>However, there is
			 a lack of uniformity in the number of conditions for which newborns are
			 screened throughout the United States. While a newborn may be screened and
			 treated for a debilitating condition in one State, in another State, the
			 condition may go undetected and result in permanent disability or even
			 death.</text>
			</paragraph><paragraph id="IDa51cf104009942e9b39476b56ff4ca8c"><enum>(3)</enum><text>Approximately
			 4,000 infants born each year are diagnosed with these detectable and treatable
			 disorders. If diagnosed early, these conditions can be successfully managed or
			 treated to prevent severe and often lifelong health consequences.</text>
			</paragraph><paragraph id="IDe0fb5cd564594a63ac73ea8cbf6dc406"><enum>(4)</enum><text>In 2004, the
			 American College of Medical Genetics (ACMG) completed a report commissioned by
			 the Department of Health and Human Services which recommended that every baby
			 born in the United States be screened for 29 specific disorders, including
			 certain metabolic conditions and hearing deficiencies.</text>
			</paragraph><paragraph id="ID36b927ea4c6e4832927d3f72eb6627fd"><enum>(5)</enum><text>Currently only 11
			 States and the District of Columbia require infants to be screened for all 29
			 of these recommended disorders.</text>
			</paragraph><paragraph id="ID70d10c34ba094cd58f23ea270341c963"><enum>(6)</enum><text>Continuity,
			 especially during a public health emergency, plays a critical role in the
			 screening, diagnosis, referral, and treatment of these disorders. Currently
			 there is no national contingency plan for maintaining continuity of newborn
			 screening systems following a public health emergency.</text>
			</paragraph></section><section changed="deleted" committee-id="SSHR00" id="ID8DC2DF36F0D4431F882C16B2AA00C1B4" reported-display-style="strikethrough"><enum>3.</enum><header>Amendment to
			 title III of the <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name></header><text display-inline="no-display-inline">Part Q of title
			 III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>
			 (42 U.S.C. 280h et seq.) is amended by adding at the end the following:</text>

				<section id="ID975AF3E572284D01BB7CD8CE327C373C"><enum>399Z–1.</enum><header>Newborn
				screening</header>
					<subsection id="ID83A1BDB02D724E9EA94FC7946E6719B0"><enum>(a)</enum><header>Authorization of
				grant programs</header><text>From funds appropriated under subsection (h), the
				Secretary, acting through the Administrator of the Health Resources and
				Services Administration (referred to in this section as the
				<quote>Administrator</quote>) and in consultation with the Advisory Committee
				on Heritable Disorders in Newborns and Children (referred to in this section as
				the <quote>Advisory Committee</quote>), shall award grants to eligible entities
				to enable such entities to assist in providing health care professionals and
				newborn screening laboratory personnel with—</text>
						<paragraph id="ID77B1720031F349E9B76CC53809F0FE64"><enum>(1)</enum><text>education in
				newborn screening; and</text>
						</paragraph><paragraph id="IDC187DE7E720B45AE83EA62D84B00BB74"><enum>(2)</enum><text>training
				in—</text>
							<subparagraph id="ID0F78D224B40944EFA248611C4176143C"><enum>(A)</enum><text>relevant and new
				technologies in newborn screening; and</text>
							</subparagraph><subparagraph id="ID2262D08042A34A96AC30C8DCA5BE1C36"><enum>(B)</enum><text>congenital,
				genetic, and metabolic disorders.</text>
							</subparagraph></paragraph></subsection><subsection id="ID88BECA0BCDAF4903AEB1E41EF9EF87E5"><enum>(b)</enum><header>Application</header><text>An
				eligible entity that desires to receive a grant under this section shall submit
				an application to the Secretary at such time, in such manner, and accompanied
				by such information as the Secretary may require.</text>
					</subsection><subsection id="ID63911A75451E4D61AE1FAAFEDABB4E00"><enum>(c)</enum><header>Selection of
				grant recipients</header>
						<paragraph id="ID9B899664B9234904922C83ABA7D9EEBD"><enum>(1)</enum><header>In
				general</header><text>Not later than 120 days after receiving an application
				under subsection (b), the Secretary, after considering the approval factors
				under paragraph (2), shall determine whether to award the eligible entity a
				grant under this section.</text>
						</paragraph><paragraph id="IDEBE4EA609D7B4E29AC4319C2C6338989"><enum>(2)</enum><header>Approval
				factors</header>
							<subparagraph id="IDDC4F3BAC302C4E4889956D248F001062"><enum>(A)</enum><header>Requirements for
				approval</header><text>An application submitted under subsection (b) may not be
				approved by the Secretary unless the application contains assurances that the
				eligible entity—</text>
								<clause id="IDAF501DBEBD5B499E82FBD939C992EC16"><enum>(i)</enum><text>will use grant
				funds only for the purposes specified in the approved application and in
				accordance with the requirements of this section; and</text>
								</clause><clause id="IDD9A71A869D4340BCAC011BE72360765E"><enum>(ii)</enum><text>will establish
				such fiscal control and fund accounting procedures as may be necessary to
				assure proper disbursement and accounting of Federal funds paid to the eligible
				entity under the grant.</text>
								</clause></subparagraph><subparagraph id="IDD7F600B9258F42719700C18BD9BCAC8D"><enum>(B)</enum><header>Existing
				programs</header><text>Prior to awarding a grant under this section, the
				Secretary shall—</text>
								<clause id="ID03AAAB53283B4B84B200379237B0AEBE"><enum>(i)</enum><text>conduct an
				assessment of existing educational resources and training programs with respect
				to newborn screening; and</text>
								</clause><clause id="ID97FB150052DB4DC58E8EB4B0FC954D12"><enum>(ii)</enum><text>take all
				necessary steps to minimize the duplication of the resources and programs
				described in clause (i) and ensure that funding under this section will
				supplement, not supplant, existing funding for such activities.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="ID12FBB455010D4A90980021F38BA72891"><enum>(d)</enum><header>Coordination</header><text>The
				Secretary shall take all necessary steps to coordinate programs funded with
				grants received under this section and to coordinate with existing newborn
				screening activities.</text>
					</subsection><subsection id="ID1D19E389DA2F4A6F9C02EBE307C00543"><enum>(e)</enum><header>Use of grant
				funds</header><text>An eligible entity that receives a grant under subsection
				(a)(1) may use the grant funds to work with appropriate medical schools,
				nursing schools, schools of public health, schools of genetic counseling,
				internal education programs in State agencies, nongovernmental organizations,
				and professional organizations and societies to develop and deliver education
				and training programs that include—</text>
						<paragraph id="ID526577AAB7B347A7BCB987B39BE95281"><enum>(1)</enum><text>continuing medical
				education programs for health care professionals and newborn screening
				laboratory personnel in newborn screening;</text>
						</paragraph><paragraph id="ID9078183337004F71AD2CA9E5DEB5523D"><enum>(2)</enum><text>education,
				technical assistance, and training on new discoveries in newborn screening and
				the use of any related technology;</text>
						</paragraph><paragraph id="IDBF6565774ED4461A9B6EE8622369B0ED"><enum>(3)</enum><text>models to evaluate
				the prevalence of, and assess and communicate the risks of, congenital
				conditions, including the prevalence and risk of some of these conditions based
				on family history;</text>
						</paragraph><paragraph id="ID9D1BBA9D192F460A933ED9C0C119B6D9"><enum>(4)</enum><text>models to
				communicate effectively with parents and families about—</text>
							<subparagraph id="IDE2DA048BA3644FC7B40057539D41357B"><enum>(A)</enum><text>the process and
				benefits of newborn screening and the meaning of screening results, including
				the possibility of false positive findings;</text>
							</subparagraph><subparagraph id="IDE5FCF131274B4D69A54FAB663F2036D5"><enum>(B)</enum><text>how to use
				information gathered from newborn screening;</text>
							</subparagraph><subparagraph id="ID02EB459D90FB4DB7BC54818B2E9F47BF"><enum>(C)</enum><text>the right of
				refusal of newborn screening, if applicable; and</text>
							</subparagraph><subparagraph id="IDBF6A72B5097749919E562FEE2F625446"><enum>(D)</enum><text>the potential need
				for followup care after newborns are screened;</text>
							</subparagraph></paragraph><paragraph id="ID237249CDA89642D2A5D50277D159E204"><enum>(5)</enum><text>information and
				resources on coordinated systems of followup care after newborns are
				screened;</text>
						</paragraph><paragraph id="ID286D319AF9D94B43B703AA0718497411"><enum>(6)</enum><text>information on the
				disorders for which States require and offer newborn screening and options for
				newborn screening relating to conditions in addition to such disorders;</text>
						</paragraph><paragraph id="ID0AB02F9D69B14C86AB5BB83B80D30949"><enum>(7)</enum><text>information on
				additional newborn screening that may not be required by the State, but that
				may be available from other sources; and</text>
						</paragraph><paragraph id="ID607D18FA32B54DFABF718F1EBA1E042C"><enum>(8)</enum><text>other items to
				carry out the purpose described in subsection (a)(1) as determined appropriate
				by the Secretary.</text>
						</paragraph></subsection><subsection id="ID09A782ACA3AC4A71BC59318502ABFF79"><enum>(f)</enum><header>Reports to
				Congress</header>
						<paragraph id="ID4A88BF975FD2492382BC7EE35DB76D13"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the Secretary shall submit to
				the relevant committees of Congress reports—</text>
							<subparagraph id="IDDD7BCACC7CE0497DBCB07619BA91CF60"><enum>(A)</enum><text>evaluating the
				effectiveness and the impact of the grants awarded under this section—</text>
								<clause id="ID7D06F7332A4041F8003E478787A3A92B"><enum>(i)</enum><text>in promoting
				newborn screening education, resources, and training for health care
				professionals;</text>
								</clause><clause id="IDBDE6F2068F574CC68F02A51832CCDEF5"><enum>(ii)</enum><text>on the successful
				diagnosis and treatment of congenital, genetic, and metabolic disorders;
				and</text>
								</clause><clause id="ID07332D71DA1E436980680562E5D70041"><enum>(iii)</enum><text>on the continued
				development of coordinated systems of followup care after newborns are
				screened;</text>
								</clause></subparagraph><subparagraph id="ID1D97D8D31A974E56BF59662D58741FAF"><enum>(B)</enum><text>describing and
				evaluating the effectiveness of the activities carried out with grant funds
				received under this section; and</text>
							</subparagraph><subparagraph id="ID3128FDD4CDD544BBAB14C9C57873D9DF"><enum>(C)</enum><text>that include
				recommendations for Federal, State, and local actions to support—</text>
								<clause id="IDE979AC7C17924953A71922E42D20EAB6"><enum>(i)</enum><text>education and
				training in newborn screening; and</text>
								</clause><clause id="ID9E6F4A8D691F4CFEAABF5415E3A448B6"><enum>(ii)</enum><text>followup care
				after newborns are screened.</text>
								</clause></subparagraph></paragraph><paragraph id="ID90FB86C131E04BA6BB2EDEE89098D9DC"><enum>(2)</enum><header>Timing of
				reports</header><text>The Secretary shall submit—</text>
							<subparagraph id="IDAAA339CCAC45477AA51C515484313209"><enum>(A)</enum><text>an interim report
				that includes the information described in paragraph (1), not later than 30
				months after the date on which the first grant funds are awarded under this
				section; and</text>
							</subparagraph><subparagraph id="ID2FBBDF7DC743442B88E3E23B2E74B9B2"><enum>(B)</enum><text>a subsequent
				report that includes the information described in paragraph (1), not later than
				60 months after the date on which the first grant funds are awarded under this
				section.</text>
							</subparagraph></paragraph></subsection><subsection id="ID5DEB89BBF6D34C2089ED2D101B7FB29F"><enum>(g)</enum><header>Definition of
				eligible entity</header><text>In this section, the term <term>eligible
				entity</term> means—</text>
						<paragraph id="ID9A20266DB30A4F3E95143505A4660333"><enum>(1)</enum><text>a State or a
				political subdivision of a State;</text>
						</paragraph><paragraph id="ID2706724BC8A94400B9CE81EB6F2CBF4E"><enum>(2)</enum><text>a consortium of 2
				or more States or political subdivisions of States;</text>
						</paragraph><paragraph id="ID28054475615F42F284D7CA86966F51D1"><enum>(3)</enum><text>a
				territory;</text>
						</paragraph><paragraph id="ID51AD9C5B134D4CFB97E7D73ED01E10C6"><enum>(4)</enum><text>an Indian tribe or
				a hospital or outpatient health care facility of the Indian Health Service;
				or</text>
						</paragraph><paragraph id="ID11E4A251B5BA4694995FAD7F4EAA2948"><enum>(5)</enum><text>other entities
				with appropriate expertise in newborn screening, as determined by the
				Secretary.</text>
						</paragraph></subsection><subsection id="IDf20af19a6d4144ae9c48587968493453"><enum>(h)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section—</text>
						<paragraph id="ID8986ec4706a84918b81e1b134ca6922e"><enum>(1)</enum><text>$5,000,000 for
				fiscal year 2008; and</text>
						</paragraph><paragraph id="IDf47c397c02fa4058a11b8ed9b975621f"><enum>(2)</enum><text>such sums as may
				be necessary for each of fiscal years 2009 through
				2012.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSHR00" id="id71E374968FCE47A5A798C721163F40DD" reported-display-style="strikethrough"><enum>4.</enum><header>Improved newborn
			 and child screening for heritable disorders</header><text display-inline="no-display-inline">Section 1109 of the Public Health Service
			 Act (42 U.S.C. 300b–8) is amended—</text>
			<paragraph id="idD79A1E6F170742A382BFC26E72027A1D"><enum>(1)</enum><text>in subsection
			 (c)(2)—</text>
				<subparagraph id="idC5AA1F11767B4E76BBBB52EFC5E32873"><enum>(A)</enum><text>in subparagraph
			 (E), by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="id8A85D32B8DAC4FD1A0BDA805F1E49C98"><enum>(B)</enum><text>by redesignating
			 subparagraph (F) as subparagraph (G); and</text>
				</subparagraph><subparagraph id="idCEEA9D9C90434A9ABA080B6AF35A77CB"><enum>(C)</enum><text>by inserting after
			 subparagraph (E) the following:</text>
					<quoted-block changed="deleted" committee-id="SSHR00" display-inline="no-display-inline" id="idD0819CA7D6E248C1A7B92781988C2FCF" reported-display-style="strikethrough" style="OLC">
						<subparagraph commented="no" id="idDAEDCE61DB0747CF9B33DEA125222A7A"><enum>(F)</enum><text>an assurance that
				the entity has adopted and implemented, is in the process of adopting and
				implementing, or will use grant amounts received under this section to adopt
				and implement the guidelines and recommendations of the Advisory Committee on
				Heritable Disorders in Newborns and Children established under section 1111
				(referred to in this section as the <quote>Advisory Committee</quote>) that are
				adopted by the Secretary and in effect at the time the grant is awarded or
				renewed under this section, which shall include the screening of each newborn
				for the heritable disorders recommended by the Advisory Committee and adopted
				by the Secretary and the reporting of results;
				and</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id54ED25B23FCB4EF7880CDE035A2954C7"><enum>(2)</enum><text>in subsection (i),
			 by striking <quote>such sums</quote> and all that follows through the period at
			 the end and inserting <quote>$15,000,000 for fiscal year 2008 and such sums as
			 may be necessary for each of the fiscal years 2009 through
			 2012.</quote>.</text>

			 committee on heritable disorders in newborns and children</header><text display-inline="no-display-inline">Section 1111 of the Public Health Service
			 Act (42 U.S.C. 300b–10) is amended—</text>
			<paragraph id="id9CA567E1E52C4B2B862B6246FCDF5C8B"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="IDbfb0ca145bc145a29564440249320241"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>and grants awarded under section 399Z–1</quote> before the
			 semicolon;</text>
				</subparagraph><subparagraph id="id4014693D9A474C79AB957D4C13DBF106"><enum>(B)</enum><text>by redesignating
			 paragraph (3) as paragraph (6);</text>
				</subparagraph><subparagraph id="idB08CCB9376B0419D974FDDAEFD8BAB19"><enum>(C)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="idAEE20F9ECCD943438A9FF57A016868D0"><enum>(D)</enum><text>by inserting after
			 paragraph (2) the following:</text>

				evidence-based and peer-reviewed recommendations that include the heritable
				disorders for which all newborns should be screened, including secondary
				conditions that may be identified as a result of the laboratory methods used
				for screening;</text>
						</paragraph><paragraph id="IDf83f9e5c67de4349969231a54280f4c6"><enum>(4)</enum><text>develop a model
				decision-matrix for newborn screening program expansion, and periodically
				update the recommended uniform screening panel, as appropriate, based on such
				decision-matrix;</text>
						</paragraph><paragraph id="id93C252A804994EFCBEEFDC539F143ECB"><enum>(5)</enum><text>consider ways to
				ensure that States attain the capacity to screen for the conditions described
				in paragraph (3), and include in such consideration the results of grant
				funding under section 1109;
				and</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="IDd7d7a4a6b91b458bb55dc38e18332625"><enum>(E)</enum><text>in paragraph (6)
			 (as so redesignated by subparagraph (A)), by striking the period at the end and
			 inserting “, which may include recommendations, advice, or information dealing
			 with—</text>
					<quoted-block changed="deleted" committee-id="SSHR00" display-inline="no-display-inline" id="id850A10CB31EA42468ABBF635486971FA" reported-display-style="strikethrough" style="OLC">
						<subparagraph id="ID7a17f3b974c54aac8f115d54f2117f94"><enum>(A)</enum><text>followup
				activities, including those necessary to achieve rapid diagnosis in the short
				term, and those that ascertain long-term case management outcomes and
				appropriate access to related services;</text>
						</subparagraph><subparagraph id="ID973b47c6ea424abf94e737abec18e930"><enum>(B)</enum><text>implementation,
				monitoring, and evaluation of newborn screening activities, including
				diagnosis, screening, follow-up, and treatment activities;</text>
						</subparagraph><subparagraph id="ID86c20533742e4efd82792b72cabfd560"><enum>(C)</enum><text>diagnostic and
				other technology used in screening;</text>
						</subparagraph><subparagraph id="IDf1407c09cf9c43e2aafb6606e2d69f9a"><enum>(D)</enum><text>the availability
				and reporting of testing for conditions for which there is no existing
				treatment;</text>
						</subparagraph><subparagraph id="ID714d834386924eecbac82ce27ed01a41"><enum>(E)</enum><text>conditions not
				included in the recommended uniform screening panel that are treatable with
				Food and Drug Administration-approved products;</text>
						</subparagraph><subparagraph id="IDa9a97bf3f4674f139f040c348c2f5ec9"><enum>(F)</enum><text>minimum standards
				and related policies and procedures used by State newborn screening programs,
				such as language and terminology used by State newborn screening programs to
				include standardization of case definitions and names of disorders for which
				newborn screening tests are performed;</text>
						</subparagraph><subparagraph id="ID6f8e230dc9384d568b8769bd325d1ad6"><enum>(G)</enum><text>quality assurance,
				oversight, and evaluation of State newborn screening programs, including
				ensuring that tests and technologies used by each State meet established
				standards for detecting and reporting positive screening results;</text>
						</subparagraph><subparagraph id="ID0124caf2cdba4749890e298f91920724"><enum>(H)</enum><text>public and
				provider awareness and education;</text>
						</subparagraph><subparagraph id="IDa778d626523f44f79c938a6845bafd19"><enum>(I)</enum><text>the cost and
				effectiveness of newborn screening and medical evaluation systems and
				intervention programs conducted by State-based programs;</text>
						</subparagraph><subparagraph id="ID658a853f80714beca4557ac2fe32889f"><enum>(J)</enum><text>identification of
				the causes of, and risk factors for heritable disorders; and</text>
						</subparagraph><subparagraph id="ID144cd2b71638416791a5d0954f598583"><enum>(K)</enum><text>coordination of
				surveillance activities, including standardized data collection and reporting,
				harmonization of laboratory definitions for heritable disorders and testing
				results, and confirmatory testing and verification of positive results, in
				order to assess and enhance monitoring of newborn
				diseases.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="ID4ca40946f7c64e0ba760ff9811cd6a23"><enum>(2)</enum><text>in subsection
			 (c)(2)—</text>
				<subparagraph id="IDa9904a3493e74874bbdfa66e85b5481d"><enum>(A)</enum><text>by redesignating
			 subparagraphs (E), (F) and (G) as subparagraphs (F), (H), and (I);</text>

						<paragraph id="idD7558F35CC804E50BFE12111C171B372"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the Advisory Committee
				issues a recommendation pursuant to this section, the Secretary shall adopt or
				reject such recommendation.</text>
						</paragraph><paragraph id="id39745A9A15254356BADB6AB057B85479"><enum>(2)</enum><header>Pending
				recommendations</header><text>The Secretary shall adopt or reject any
				recommendation issued by the Advisory Committee that is pending on the date of
				enactment of the <short-title>Newborn Screening Saves
				Lives Act of 2007</short-title> by not later than 180 days after the date of
				enactment of such Act.</text>
						</paragraph><paragraph id="id076FEF7B98EC403C8FFB769EEBFC7FE5"><enum>(3)</enum><header>Determinations
				to be made public</header><text>The Secretary shall publicize any determination
				on adopting or rejecting a recommendation of the Advisory Committee pursuant to
				this subsection, including the justification for the determination.</text>
						</paragraph></subsection><subsection id="IDb770fd45f5be4b3d9b775c5cff8e95a5"><enum>(e)</enum><header>Annual
				report</header><text>Not later than 2 years after the date of enactment of the
				<short-title>Newborn Screening Saves Lives Act of
				2007</short-title>, and each fiscal year thereafter, the Advisory Committee
				shall—</text>
						<paragraph id="ID0f518f368bc445f381fccff7ba539bf5"><enum>(1)</enum><text>publish a report
				on peer-reviewed newborn screening guidelines in the United States;</text>
						</paragraph><paragraph id="ID4ecd3e17082a4568bdab3de96c6be92f"><enum>(2)</enum><text>submit such report
				to the appropriate committees of Congress, the Secretary, and the State
				departments of health; and</text>
						</paragraph><paragraph id="ID36db30252bcd47f1bd3e6ed16c1f5cc1"><enum>(3)</enum><text>disseminate such
				report on as wide a basis as practicable, including through posting on the
				internet clearinghouse established under section 1112.</text>
						</paragraph></subsection><subsection id="id62BB18482D004E1588A959FA4C6AE0F9"><enum>(f)</enum><header>Continuation of
				operation of committee</header><text>Notwithstanding section 14 of the Federal
				Advisory Committee Act (5 U.S.C. App.), the Advisory Committee shall continue
				to operate during the 5-year period beginning on the date of enactment of the
				<short-title>Newborn Screening Saves Lives Act of
				2007</short-title>.</text>
					</subsection><subsection id="id04206A0275B64489BA4AA5FAAA5DA97F"><enum>(g)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section—</text>
						<paragraph id="idB68F1C5BA10D413383E492F31C595392"><enum>(1)</enum><text>$1,000,000 for
				fiscal year 2008; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCFF882F917246D6805A8F8926AB8B43"><enum>(2)</enum><text>such sums as may
				be necessary for each of the fiscal years 2009 through
				2012.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="deleted" committee-id="SSHR00" id="IDe9857b9393a1434cafbcfa61ef9994c0" reported-display-style="strikethrough"><enum>7.</enum><header>Information
			 clearinghouse</header><text display-inline="no-display-inline">Part A of title
			 XI of the Public Health Service Act (42 U.S.C. 300b–1 et seq.) is amended by
			 adding at the end the following:</text>

				of newborn screening information</header>
					<subsection id="ID5419b41f673e4cf59ec24b5b970e2788"><enum>(a)</enum><header>In
				general</header><text>The Secretary, acting through the Administrator of the
				Health Resources and Services Administration (referred to in this part as the
				<quote>Administrator</quote>), in consultation with the Director of the Centers
				for Disease Control and Prevention and the Director of the National Institutes
				of Health, shall establish and maintain a central clearinghouse of current
				educational and family support and services information, materials, resources,
				research, and data on newborn screening to—</text>
						<paragraph id="ID7a54983eecf5437f97b27d51e43439ce"><enum>(1)</enum><text>enable parents and
				family members of newborns, health professionals, industry representatives, and
				other members of the public to increase their awareness, knowledge, and
				understanding of newborn screening;</text>
						</paragraph><paragraph id="IDe129c6280fba4d96a780c355bf46b048"><enum>(2)</enum><text>increase
				awareness, knowledge, and understanding of newborn diseases and screening
				services for individuals wanting to have children and expectant families;
				and</text>
						</paragraph><paragraph id="IDd5890769a9cb46beb03f20fa0812b05d"><enum>(3)</enum><text>develop and
				maintain current data on quality indicators to measure performance of newborn
				screening, such as false-positive rates and other quality indicators as
				determined by the Advisory Committee under section 1111.</text>
						</paragraph></subsection><subsection id="ID7705af259e134a079a929561e504b8b7"><enum>(b)</enum><header>Internet
				availability</header><text>The Secretary, acting through the Administrator,
				shall ensure that the clearinghouse described under subsection (a)—</text>
						<paragraph id="ID763e21f5d428446ab27bcbf21ee85f76"><enum>(1)</enum><text>is available on
				the Internet;</text>
						</paragraph><paragraph id="IDc01d2c54e1fe4ac19fdc99bf74688abe"><enum>(2)</enum><text>includes an
				interactive forum;</text>
						</paragraph><paragraph id="ID756f03d3e3ea474ab083cb3846e2fb06"><enum>(3)</enum><text>is updated on a
				regular basis, but not less than quarterly; and</text>
						</paragraph><paragraph id="IDe8eef70da6e74267a2725b5efe7615f6"><enum>(4)</enum><text>provides—</text>
							<subparagraph id="ID8e1741ee2a7b42698565c456ae2506f5"><enum>(A)</enum><text>links to
				Government-sponsored, non-profit, and other Internet websites of laboratories
				as determined appropriate by the Secretary that have demonstrated expertise in
				newborn screening that supply research-based information on newborn screening
				tests currently available throughout the United States;</text>
							</subparagraph><subparagraph id="ID311ef7035c624b65b5104b762fd7d96b"><enum>(B)</enum><text>information about
				newborn conditions and screening services available in each State from
				laboratories certified under subpart 2 of part F of title III, including
				information about supplemental screening that is available but not required, in
				the State where the infant is born;</text>
							</subparagraph><subparagraph id="IDb4fa7ee8c63b4b48888add999609115d"><enum>(C)</enum><text>current research
				on both treatable and not-yet treatable conditions for which newborn screening
				tests are available;</text>
							</subparagraph><subparagraph id="ID832f7373f43b4cc8981579d715a314a0"><enum>(D)</enum><text>the availability
				of Federal funding for newborn and child screening for heritable disorders
				including grants authorized under the <short-title>Newborn
				Screening Saves Lives Act of 2007</short-title>; and</text>
							</subparagraph><subparagraph id="ID972d258d6757425681dceb3a0eebae03"><enum>(E)</enum><text>other relevant
				information as determined appropriate by the Secretary.</text>
							</subparagraph></paragraph></subsection><subsection id="ID7f3a5cdb3e3c4bc1b2d310b462a8106a"><enum>(c)</enum><header>Nonduplication</header><text>In
				developing the clearinghouse under this section, the Secretary shall ensure
				that such clearinghouse minimizes duplication and supplements, not supplants,
				existing information sharing efforts.</text>
					</subsection><subsection id="IDb69fba32bb2b4ed1a983661e14380d65"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section—</text>
						<paragraph id="ID803045b8e5e14a3e862e91a0460ffce9"><enum>(1)</enum><text>$2,500,000 for
				fiscal year 2008; and</text>
						</paragraph><paragraph id="IDf8a4b47deac5463bb5d7e0925dace5c8"><enum>(2)</enum><text>such sums as may
				be necessary for each of the fiscal years 2009 through
				2012.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSHR00" id="idDA5430E7376A40A091D56BD56CFA17C7" reported-display-style="strikethrough"><enum>8.</enum><header>Laboratory
			 quality and surveillance</header><text display-inline="no-display-inline">Part
			 A of title XI of the Public Health Service Act (42 U.S.C. 300b–1 et seq.), as
			 amended by section 7, is further amended by adding at the end the
			 following:</text>

				quality</header>
					<subsection id="id4B5447A43B0C4602BC54DC5917C55919"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, acting
				through the Director of the Centers for Disease Control and Prevention and in
				consultation with the Advisory Committee on Heritable Disorders in Newborns and
				Children established under section 1111, shall provide for—</text>
						<paragraph id="id2CF1BCD4E97D4ED1AF0D09ACC8291596"><enum>(1)</enum><text>quality assurance
				for laboratories involved in screening newborns and children for heritable
				disorders, including quality assurance for newborn-screening tests, performance
				evaluation services, and technical assistance and technology transfer to
				newborn screening laboratories to ensure analytic validity and utility of
				screening tests; and</text>
						</paragraph><paragraph commented="no" id="ID2e00af530ae447eea64782c7e45321b2"><enum>(2)</enum><text>population-based
				pilot testing for new screening tools for evaluating use on a mass
				scale.</text>
						</paragraph></subsection><subsection commented="no" id="idA8682911116245CA86C1F1C8749EF009"><enum>(b)</enum><header>Authorization of
				appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated $5,000,000 for fiscal year 2008 and
				such sums as may be necessary for each of the fiscal years 2009 through
				2012.</text>
					</subsection></section><section id="idEC6AD2BAD49544B791EACC27911A0EDC"><enum>1114.</enum><header>Surveillance
				programs for heritable disorders screening</header>
					<subsection id="id7855A7B2D3624C0C9E5AA2976032C8EB"><enum>(a)</enum><header>In
				general</header><text>The Secretary, acting through an Interagency Group
				consisting of the Director of the Agency for Healthcare Research and Quality,
				the Director of the Centers for Disease Control and Prevention, the
				Administrator, and the Director of the National Institutes of Health, shall
				build upon existing activities and infrastructure to carry out programs—</text>
						<paragraph id="ID6BE2D2D873C0486CB28D34669BDD7DDD"><enum>(1)</enum><text>to collect,
				analyze, and make available data on the heritable disorders recommended by the
				Advisory Committee on Heritable Disorders in Newborns and Children established
				under section 1111, including data on the incidence and prevalence of, as well
				as poor health outcomes resulting from, such disorders;</text>
						</paragraph><paragraph commented="no" id="ID4B237F90C46A4AA8BEDDDFA3C176358F"><enum>(2)</enum><text>to operate
				regional centers for the conduct of applied epidemiological research on
				effective interventions for such disorders for the prevention of poor health
				outcomes;</text>
						</paragraph><paragraph id="ID02E0421231B74E63BBB221215753A3E1"><enum>(3)</enum><text>to provide
				information and education to the public on effective interventions for the
				prevention of poor health outcomes resulting from such disorders; and</text>
						</paragraph><paragraph id="ID634BDDCA564641B2B4CCDC2A4C6395F4"><enum>(4)</enum><text>to conduct
				research on and to promote the prevention of poor health outcomes resulting
				from such disorders, and secondary health conditions among individuals with
				such disorders.</text>
						</paragraph></subsection><subsection id="IDF672D6453BDE44E2A8C71FB22C030860"><enum>(b)</enum><header>Grants and
				Contracts</header>
						<paragraph id="IDB11D3D9866834953A00CBAFEDC0ABB8E"><enum>(1)</enum><header>In
				general</header><text>In carrying out subsection (a), the Secretary may make
				grants to and enter into contracts with public and nonprofit private
				entities.</text>
						</paragraph><paragraph id="ID2CBE1868355B49F895FEADDBF8DDE377"><enum>(2)</enum><header>Supplies and
				services in lieu of award funds</header>
							<subparagraph id="ID64E29509B9164059A5548D44D641CD2A"><enum>(A)</enum><header>In
				general</header><text>Upon the request of a recipient of an award of a grant or
				contract under paragraph (1), the Secretary may, subject to subparagraph (B),
				provide supplies, equipment, and services for the purpose of aiding the
				recipient in carrying out the purposes for which the award is made and, for
				such purposes, may detail to the recipient any officer or employee of the
				Department of Health and Human Services.</text>
							</subparagraph><subparagraph id="IDF5580679E0E646ED8080D6ABB98B784C"><enum>(B)</enum><header>Reduction</header><text>With
				respect to a request described in subparagraph (A), the Secretary shall reduce
				the amount of payments under the award involved by an amount equal to the costs
				of detailing personnel and the fair market value of any supplies, equipment, or
				services provided by the Secretary. The Secretary shall, for the payment of
				expenses incurred in complying with such request, expend the amounts
				withheld.</text>
							</subparagraph></paragraph><paragraph id="IDEA803C5F6B03418583035224CEF606A4"><enum>(3)</enum><header>Application for
				award</header><text>The Secretary may make an award of a grant or contract
				under paragraph (1) only if an application for the award is submitted to the
				Secretary and the application is in such form, is made in such manner, and
				contains such agreements, assurances, and information as the Secretary
				determines to be necessary to carry out the purposes for which the award is to
				be made.</text>
						</paragraph></subsection><subsection id="IDee9dbd3746da40c285250106672b1450"><enum>(c)</enum><header>Reports to
				Congress</header>
						<paragraph id="IDf56026dd2d5d45a293ce03377af8e46f"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the Secretary shall submit to
				the relevant committees of Congress reports—</text>
							<subparagraph id="ID018b19b4f74c49e0bd9d52f0291787ad"><enum>(A)</enum><text>containing
				information under paragraph (1) that is specific to various racial, ethnic, and
				socioeconomic groups;</text>
							</subparagraph><subparagraph id="ID650c03ed2d4140dabe66b38a371234a5"><enum>(B)</enum><text>containing an
				assessment of the extent to which various approaches of preventing heritable
				disorders and secondary health conditions among individuals with such disorders
				have been effective;</text>
							</subparagraph><subparagraph id="ID17393ba8cc0746d0bc45e63048460011"><enum>(C)</enum><text>describing the
				activities carried out under this section;</text>
							</subparagraph><subparagraph id="ID55ad82833b8f49bba1cc8b2e66d2e6e0"><enum>(D)</enum><text>containing
				information on the incidence and prevalence of individuals living with
				heritable disorders, information on the health status of individuals with such
				disorders including the extent to which such disorders have contributed to the
				incidence and prevalence of infant mortality, information on any health
				disparities experienced by such individuals, and recommendations for improving
				the health and wellness and quality of life of such individuals;</text>
							</subparagraph><subparagraph id="ID92c6808fcfeb434bb9384ede98ce43e0"><enum>(E)</enum><text>containing a
				summary of recommendations from all heritable disorders research conferences
				sponsored by the Centers for Disease Control and Prevention; and</text>
							</subparagraph><subparagraph id="IDb970c0659acd48e295f006e31379393c"><enum>(F)</enum><text>containing any
				recommendations of the Secretary regarding this section.</text>
							</subparagraph></paragraph><paragraph id="IDc7ee60743a0e480cacc325774fdb2b85"><enum>(2)</enum><header>Timing of
				reports</header><text>The Secretary shall submit—</text>
							<subparagraph id="ID6a0d5aaccc67426188a6073138475ef9"><enum>(A)</enum><text>an interim report
				that includes the information described in paragraph (1), not later than 30
				months after the date on which the first grant funds are awarded under this
				section; and</text>
							</subparagraph><subparagraph id="IDddfb0a9d3667426ba1ef0d54565b04ab"><enum>(B)</enum><text>a subsequent
				report that includes the information described in paragraph 1, not later than
				60 months after the date on which the first grant funds are awarded under this
				section.</text>
							</subparagraph></paragraph></subsection><subsection id="IDAD4DA9BD558B456886120BBBCD7E3D40"><enum>(d)</enum><header>Applicability of
				Privacy Laws</header><text>The provisions of this section shall be subject to
				the requirements of section 552a of title 5, United States Code. All Federal
				laws relating to the privacy of information shall apply to the data and
				information that is collected under this section.</text>
					</subsection><subsection id="id45D9B7D3B8CF4A0086DD49BAF020A480"><enum>(e)</enum><header>Coordination</header>
						<paragraph id="idD92423A373FC42D193F5674DE6CE6297"><enum>(1)</enum><header>In
				general</header><text>In carrying out this section, the Secretary shall
				coordinate, to the extent practicable, programs under this section with
				programs on birth defects and developmental disabilities authorized under
				section 317C.</text>
						</paragraph><paragraph id="id5F7EE58B68A741B9B368AD6DD07BDAD3"><enum>(2)</enum><header>Priority in
				grants and contracts</header><text>In making grants and contracts under this
				section, the Secretary shall give priority to entities that demonstrate the
				ability to coordinate activities under a grant or contract made under this
				section with existing birth defects surveillance activities.</text>
						</paragraph></subsection><subsection id="id3BC9E45C14624D26B8CF8685109D7CF5"><enum>(f)</enum><header>Authorization of
				Appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated $15,000,000 for fiscal year 2008 and
				such sums as may be necessary for each of the fiscal years 2009 through
				2012.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSHR00" id="id8FBE1B57B21B4927A4695DB67CC26ABD" reported-display-style="strikethrough"><enum>9.</enum><header>Grants</header><text display-inline="no-display-inline">Part A of title XI of the Public Health
			 Service Act (42 U.S.C. 300b–1 et seq.), as amended by section 8, is further
			 amended by adding at the end the following:</text>

				general</header><text>From funds appropriated under subsection (h), the
				Secretary, acting through the Administrator and in consultation with the
				Advisory Committee, shall award grants to eligible entities to—</text>
							<subparagraph id="ID971ceb06527b43d6a48586d4311e6309"><enum>(A)</enum><text>enable such
				entities to develop and deliver educational programs about newborn screening to
				parents, families, and patient advocacy and support groups, such educational
				materials accompanying such educational programs to be provided at appropriate
				literacy levels; and</text>
							</subparagraph><subparagraph id="IDb3b73ff04b0d4b749e1236d415c4e98e"><enum>(B)</enum><text>enable such
				entities to establish, maintain, and operate a system to assess and coordinate
				treatment relating to congenital, genetic, and metabolic disorders.</text>
							</subparagraph></paragraph><paragraph id="ID97215214c825484dbac6ccb3cdcd019b"><enum>(2)</enum><header>Awareness of the
				availability of programs</header><text>To the extent practicable, the Secretary
				shall make relevant health care providers aware of the availability of the
				educational programs supported pursuant to paragraph (1).</text>
						</paragraph></subsection><subsection id="IDf00f0159a6244b08b68f4005d70403c6"><enum>(b)</enum><header>Application</header><text>An
				eligible entity that desires to receive a grant under this section shall submit
				an application to the Secretary at such time, in such manner, and accompanied
				by such information as the Secretary may require.</text>
					</subsection><subsection id="ID3f7307362485448298367db7acb1c270"><enum>(c)</enum><header>Selection of
				grant recipients</header>
						<paragraph id="ID25e92bb60c864cd39cc9462206a15a33"><enum>(1)</enum><header>In
				general</header><text>Not later than 120 days after receiving an application
				under subsection (b), the Secretary, after considering the approval factors
				under paragraph (2), shall determine whether to award the eligible entity a
				grant under this section.</text>
						</paragraph><paragraph id="ID24202233a7f74dff949ac5933635eba7"><enum>(2)</enum><header>Approval
				factors</header>
							<subparagraph id="IDae9001bd0ed4403088510497e3fe82cb"><enum>(A)</enum><header>Requirements</header><text>An
				application submitted under subsection (b) may not be approved by the Secretary
				unless the application contains assurances that the eligible entity—</text>
								<clause id="ID83917c5c9d80496e8e1d328f678be044"><enum>(i)</enum><text>will use grant
				funds only for the purposes specified in the approved application and in
				accordance with the requirements of this section; and</text>
								</clause><clause id="IDa4fd1a789863433c8b847b3308b40be9"><enum>(ii)</enum><text>will establish
				such fiscal control and fund accounting procedures as may be necessary to
				assure proper disbursement and accounting of Federal funds paid to the eligible
				entity under the grant.</text>
								</clause></subparagraph><subparagraph id="ID0f95d2fb025a4f0fb1e77f1216270deb"><enum>(B)</enum><header>Existing
				programs</header><text>Prior to awarding a grant under this section, the
				Secretary shall—</text>
								<clause id="ID877ba751c82440cfacf7c64207388ee6"><enum>(i)</enum><text>conduct an
				assessment of existing educational resources and training programs and
				coordinated systems of followup care with respect to newborn screening;
				and</text>
								</clause><clause id="ID5fdb5053dd2b49dbb63e2d28083182d5"><enum>(ii)</enum><text>take all
				necessary steps to minimize the duplication of the resources and programs
				described in clause (i) and ensure that funding under this section will
				supplement, not supplant, existing funding for such activities.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="IDa8ccbce64d1b4ab2a92b37b245edc320"><enum>(d)</enum><header>Coordination</header><text>The
				Secretary shall take all necessary steps to coordinate programs funded with
				grants received under this section and to coordinate with existing newborn
				screening activities.</text>
					</subsection><subsection id="IDae628004b9604558bc4fe8d1a84d692e"><enum>(e)</enum><header>Use of grant
				funds</header>
						<paragraph id="ID842661fb5c154c7dbf0a16ca58be9c5d"><enum>(1)</enum><header>In
				general</header><text>An eligible entity that receives a grant under this
				section may use the grant funds—</text>
							<subparagraph id="ID57410251772349e9a0f41f0d2b4f7027"><enum>(A)</enum><text>for purposes of
				grants under subsection (a)(1)(A), to develop and deliver to parents, families,
				and patient advocacy and support groups, educational programs about newborn
				screening that include information on—</text>
								<clause id="IDb7ab7353c164436685f3d4fd55906ba0"><enum>(i)</enum><text>what newborn
				screening is and how it is performed;</text>
								</clause><clause id="ID83947fe62f144ce6a6e6d7fb0d2294af"><enum>(ii)</enum><text>who performs
				newborn screening;</text>
								</clause><clause id="IDe687d29713e04edfab4c34810f550ae1"><enum>(iii)</enum><text>where newborn
				screening is performed;</text>
								</clause><clause id="IDe0aa5abb0fac4d92b588ec716e9a7eb4"><enum>(iv)</enum><text>the disorders for
				which the State requires newborns to be screened;</text>
								</clause><clause id="IDdf60da05470c412699975766a64a5647"><enum>(v)</enum><text>different options
				for newborn screening for disorders other than those included by the State in
				the mandated newborn screening program;</text>
								</clause><clause id="IDd85c58d6ec224b18b41d99c6a1368b7e"><enum>(vi)</enum><text>the meaning of
				various screening results, including the possibility of false positive and
				false negative findings;</text>
								</clause><clause id="ID7bbc61ec41d24d69aa263f382012d1d2"><enum>(vii)</enum><text>the prevalence
				and risk of newborn disorders, including the increased risk of disorders that
				may stem from family history;</text>
								</clause><clause id="ID65800d241f6348b185ae0b2cca640f25"><enum>(viii)</enum><text>coordinated
				systems of followup care after newborns are screened; and</text>
								</clause><clause id="ID7bd104ab789342c1a73e4a705cb37455"><enum>(ix)</enum><text>other items to
				carry out the purpose described in subsection (a)(1) as determined appropriate
				by the Secretary; and</text>
								</clause></subparagraph><subparagraph id="IDa886e0e1e78f4607bca20a509fe075f4"><enum>(B)</enum><text>for purposes of
				grants under subsection (a)(1)(B), to—</text>
								<clause id="IDf927f1edfb734b788b84d10a688383fb"><enum>(i)</enum><text>expand on existing
				procedures and systems, where appropriate and available, for the timely
				reporting of newborn screening results to individuals, families, primary care
				physicians, and appropriate subspecialists such as in congenital, genetic, and
				metabolic disorders;</text>
								</clause><clause id="ID0a29cf04140c40da8d56c16487b93365"><enum>(ii)</enum><text>coordinate
				ongoing followup treatment with individuals, families, primary care physicians,
				and appropriate subspecialists such as in congenital, genetic, and metabolic
				disorders after a newborn receives an indication of the presence or increased
				risk of a disorder on a screening test;</text>
								</clause><clause id="IDd957878a4e1c42bc81216325537592f0"><enum>(iii)</enum><text>ensure the
				seamless integration of confirmatory testing, tertiary care medical services,
				comprehensive genetic services including genetic counseling, and information
				about Food and Drug Administration-approved treatments as well as access to
				developing therapies by participation in approved clinical trials involving the
				primary health care of the infant;</text>
								</clause><clause id="IDe25bf05859d846869ac5ae9ba4c9e20e"><enum>(iv)</enum><text>analyze data, if
				appropriate and available, collected from newborn screenings to identify
				populations at risk for disorders affecting newborns, examine and respond to
				health concerns, recognize and address relevant environmental, behavioral,
				socioeconomic, demographic, and other relevant risk factors;</text>
								</clause><clause id="IDa970a3b5fc914d879c2163a665cc78bd"><enum>(v)</enum><text>collect, analyze
				and report data on the costs, benefits and effectiveness of such tests;
				and</text>
								</clause><clause id="IDb51baeb42cef474c802d6bb693823569"><enum>(vi)</enum><text>carry out such
				other activities as the Secretary may determine necessary.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="IDdcdc028e62e442afb768bfe2d10df809"><enum>(f)</enum><header>Reports to
				Congress</header>
						<paragraph id="IDc62a72850648483aa0c1364e92153f08"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the Secretary shall submit to
				the relevant committees of Congress reports—</text>
							<subparagraph id="ID70404a2860f9424d911bfdba7532fa94"><enum>(A)</enum><text>evaluating the
				effectiveness and the impact of the grants awarded under this section—</text>
								<clause id="ID10da915f09de45b79f1f711fd686ed10"><enum>(i)</enum><text>in promoting
				newborn screening—</text>
									<subclause id="IDc711fe90c4b544a6b2cc070bbbf1d051"><enum>(I)</enum><text>education and
				resources for families; and</text>
									</subclause><subclause id="IDe249a18022e9404f9d492e9619a5eb02"><enum>(II)</enum><text>education,
				resources, and training for health care professionals;</text>
									</subclause></clause><clause id="ID1546a7b899574eebb79c50db7119dc50"><enum>(ii)</enum><text>on the successful
				diagnosis and treatment of congenital, genetic, and metabolic disorders;
				and</text>
								</clause><clause id="ID1049f893b11e41839dd588c3f3792753"><enum>(iii)</enum><text>on the continued
				development of coordinated systems of followup care after newborns are
				screened;</text>
								</clause></subparagraph><subparagraph id="ID8f69cc694c214fffb174254e3777609f"><enum>(B)</enum><text>describing and
				evaluating the effectiveness of the activities carried out with grant funds
				received under this section; and</text>
							</subparagraph><subparagraph id="ID8fc036ab8d71403ea002858ade01b800"><enum>(C)</enum><text>that include
				recommendations for Federal, State, and local actions to support—</text>
								<clause id="IDadff7980e60642dda0e4144d3f2a969b"><enum>(i)</enum><text>education and
				training in newborn screening; and</text>
								</clause><clause id="IDcb9509fb4eb54c46bcfa17b764003ed3"><enum>(ii)</enum><text>followup care
				after newborns are screened.</text>
								</clause></subparagraph></paragraph><paragraph id="ID68806a87bcd44de79003dcaef802d473"><enum>(2)</enum><header>Timing of
				reports</header><text>The Secretary shall submit—</text>
							<subparagraph id="ID96038630cb9b4b8c8b3fa354de9c3d3b"><enum>(A)</enum><text>an interim report
				that includes the information described in paragraph (1), not later than 30
				months after the date on which the first grant funds are awarded under this
				section; and</text>
								<clause id="ID91c7f11c34504e8c88aa272165ba2e86"><enum>(i)</enum><text>a subsequent
				report that includes the information described in paragraph (1), not later than
				60 months after the date on which the first grant funds are awarded under this
				section.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="IDe1aca45fe8e644f6a21847672966d868"><enum>(g)</enum><header>Eligible
				entity</header><text>In this section, the term <term>eligible entity</term>
				means—</text>
						<paragraph id="ID172222b380d34564943b98a6c31a7b0b"><enum>(1)</enum><text>a State or a
				political subdivision of a State;</text>
						</paragraph><paragraph id="ID1077b2012b094631ae11cd41f0fc4035"><enum>(2)</enum><text>a consortium of 2
				or more States or political subdivisions of States;</text>
						</paragraph><paragraph id="IDde741f33585649baa227927f3e131183"><enum>(3)</enum><text>a
				territory;</text>
						</paragraph><paragraph id="ID6b7216250f314345ba3e9334b94f3816"><enum>(4)</enum><text>an Indian tribe or
				a hospital or outpatient health care facility of the Indian Health Service;
				or</text>
						</paragraph><paragraph id="ID189a39438b7942ca9a81b7aeb17d5a65"><enum>(5)</enum><text>other entities
				with appropriate expertise in newborn screening, as determined by the
				Secretary.</text>
						</paragraph></subsection><subsection id="IDbd70121e45eb48e397f4b5f2b9456ecb"><enum>(h)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this section—</text>
						<paragraph id="IDf1d097dd785840ed82d9b644df013b0b"><enum>(1)</enum><text>$10,000,000 for
				fiscal year 2008; and</text>
						</paragraph><paragraph id="IDe8a612f436cd4b35a4c56b1ec2d23e13"><enum>(2)</enum><text>such sums as may
				be necessary for each of fiscal years 2009 through
				2012.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSHR00" id="ID6ca4f2cced1340ffb6eee578d5769d12" reported-display-style="strikethrough"><enum>10.</enum><header>Contingency
			 planning</header><text display-inline="no-display-inline">Part A of title XI of
			 the Public Health Service Act (42 U.S.C. 300b–1 et seq.), as amended by section
			 9, is further amended by adding at the end the following:</text>

				<section id="IDc987b7ceab6a4728a3d3efb4b35a04cb"><enum>1116.</enum><header>National
				contingency plan for newborn screening</header>
					<subsection id="ID1ea51323527444ffb7ce325e368273da"><enum>(a)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				this section, the Secretary, acting through the Director of the Centers for
				Disease Control and Prevention and in consultation with the Administrator and
				State departments of health (or related agencies), shall develop a national
				contingency plan for newborn screening for use by a State, region, or consortia
				of States in the event of a public health emergency.</text>
					</subsection><subsection id="ID9d27e34b455c4cfa92f23463f011109f"><enum>(b)</enum><header>Contents</header><text>The
				contingency plan developed under subsection (a) shall include a plan
				for—</text>
						<paragraph id="IDf20dbc2d01f94389b6120041a54f4f65"><enum>(1)</enum><text>the collection and
				transport of specimens;</text>
						</paragraph><paragraph id="ID102d6c1574484db09a903d84f76d1479"><enum>(2)</enum><text>the shipment of
				specimens to State newborn screening laboratories;</text>
						</paragraph><paragraph id="IDa1cf503a96c54e5898262090c8804028"><enum>(3)</enum><text>the processing of
				specimens;</text>
						</paragraph><paragraph id="IDdb55eb074b8f41868d824e747c30290d"><enum>(4)</enum><text>the reporting of
				screening results to physicians and families;</text>
						</paragraph><paragraph id="ID33cc6c82cf16410785f2580c5969e4e8"><enum>(5)</enum><text>the diagnostic
				confirmation of positive screening results;</text>
						</paragraph><paragraph id="IDb3c9f1494a3e492490ad80eea3bb4000"><enum>(6)</enum><text>ensuring the
				availability of treatment and management resources;</text>
						</paragraph><paragraph id="ID5e62340727804c1eb10ba7772c073d2a"><enum>(7)</enum><text>educating families
				about newborn screening; and</text>
						</paragraph><paragraph id="IDcc84ce91d7c74d6abf5706c7c12c8710"><enum>(8)</enum><text>carrying out other
				activities determined appropriate by the Secretary.</text>
						</paragraph></subsection></section><section commented="no" id="ID5908bead2edf4bf1922c47cf6e64a885"><enum>1117.</enum><header>Hunter Kelly
				research program</header>
					<subsection commented="no" id="ID262e8c74742f496faceb0117ec272703"><enum>(a)</enum><header>Additional
				newborn screening tests grants</header>
						<paragraph commented="no" id="IDc9084efca91a4a4ab67f235545bd6571"><enum>(1)</enum><header>In
				general</header><text>The Secretary, in conjunction with the Director of the
				National Institutes of Health and taking into consideration the recommendations
				of the Advisory Committee, shall establish a research program (to be known as
				<quote>Hunter Kelly Newborn Screening Research Program</quote>) by expanding,
				carrying out, and coordinating research in—</text>
							<subparagraph id="IDb77eed11f5a34bbca1671408f44215cf"><enum>(A)</enum><text>identifying,
				developing, and testing the most promising new screening technologies, in order
				to improve already existing screening tests, which may include tests for Krabbe
				Disease and Insulin Dependent Diabetes Mellitus, and Turner Syndrome, increase
				the specificity of newborn screening, and expand the number of conditions for
				which screening tests are available;</text>
							</subparagraph><subparagraph id="IDccf7074fcc664301a37250e3e3db944d"><enum>(B)</enum><text>experimental
				treatments and disease management strategies for additional newborn conditions,
				and other genetic, metabolic, hormonal and/or functional conditions that can be
				detected through newborn screening for which treatment is not yet available;
				and</text>
							</subparagraph><subparagraph id="ID44c89f4b11674d198f2247b14a7f1302"><enum>(C)</enum><text>other activities
				that would improve newborn screening, as identified by the Director.</text>
							</subparagraph></paragraph><paragraph commented="no" id="IDa646754217f240759081445f43ec3905"><enum>(2)</enum><header>Additional
				newborn condition</header><text>For purposes of this subsection, the term
				<term>additional newborn condition</term> means any condition that is not one
				of the core conditions designated by the Advisory Committee.</text>
						</paragraph></subsection><subsection id="ID47e634cebcb64736ba0e6a7c8055b3b8"><enum>(b)</enum><header>Funding</header><text>In
				carrying out the research program under this section, the Secretary and the
				Director shall ensure that entities receiving funding through the program will
				provide assurances, as practicable, that such entities will work in
				consultation with the appropriate State departments of health, and, as
				practicable, focus their research on screening technology not currently
				performed in the States in which the entities are located, and the conditions
				on the uniform screening panel (or the standard test existing on the uniform
				screening panel).</text>
					</subsection><subsection id="ID8d422cf4581041ba8f173948b5d6b541"><enum>(c)</enum><header>Monitoring and
				results</header><text>The Director shall—</text>
						<paragraph id="ID2447665e527c4303998b7abbecb2ee3d"><enum>(1)</enum><text>monitor and report
				on the activities resulting from any funding distributed under this section;
				and</text>
						</paragraph><paragraph id="IDad4fbe3cf3274b8798cc96e20a1d9fa5"><enum>(2)</enum><text>on an annual
				basis—</text>
							<subparagraph id="ID3bf7a45f54ab47d789797b9c6a87f522"><enum>(A)</enum><text>publish and
				disseminate the results of such monitoring on as wide a basis as is
				practicable, which may include incorporation of these results in other newborn
				screening reports and posting on the Internet Clearinghouse established under
				section 1112;</text>
							</subparagraph><subparagraph id="ID0ab648cfcb0d47f381161f958af2cf25"><enum>(B)</enum><text>submit to the
				relevant committees of Congress the results of such evaluation, which may
				include incorporation of such results in other newborn screening reports being
				submitted to Congress.</text>
							</subparagraph></paragraph></subsection><subsection id="ID341a37afa66c47bd807db02893351077"><enum>(d)</enum><header>Nonduplication</header><text>In
				carrying out programs under this section, the Secretary shall minimize
				duplication and supplement, not supplant, existing efforts of the type carried
				out under this section.</text>
					</subsection><subsection id="IDafbb521dc3534b5abb1aeb6cbdc79994"><enum>(e)</enum><header>Peer
				review</header><text>Nothing in this section shall be construed to interfere
				with the scientific peer-review process at the National Institutes of
				Health.</text>
					</subsection><subsection commented="no" id="IDa2c6d83c3bf14bf1ac54e32c06ad6668"><enum>(f)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section—</text>
						<paragraph commented="no" id="ID1b3267e9b07743d7a4ec4bb1d5a9ff3b"><enum>(1)</enum><text>$7,000,000 for
				fiscal year 2008; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8e88441c6bbf44468e936622c57f5192"><enum>(2)</enum><text>such sums as may
				be necessary for fiscal years 2009 through
				2012.</text>

			 child screening for heritable disorder</header><text display-inline="no-display-inline">Section 1109 of the Public Health Service
			 Act (42 U.S.C. 300b–8) is amended—</text>
			<paragraph id="ID8ef83604ee684b76841ec5ddec6e6d54"><enum>(1)</enum><text>by striking subsections
			 (a), (b), and (c) and inserting the following:</text>
				<quoted-block changed="added" committee-id="SSHR00" display-inline="no-display-inline" id="idE1ECCFB126C24C23942B56B7A565B2F3" reported-display-style="italic" style="OLC">
					<subsection id="ID123e689a8aef4fa49cc30e0863241083"><enum>(a)</enum><header>Authorization of grant
				program</header><text>From amounts appropriated under subsection (j), the
				Secretary, acting through the Administrator of the Health Resources and
				Services Administration (referred to in this section as the
				<term>Administrator</term>) and in consultation with the Advisory Committee on
				Heritable Disorders in Newborns and Children (referred to in this section as
				the <term>Advisory Committee</term>), shall award grants to eligible entities
				to enable such entities—</text>
						<paragraph id="ID9678da78a6c54b018a8190391af67cd2"><enum>(1)</enum><text>to enhance, improve or
				expand the ability of State and local public health agencies to provide
				screening, counseling, or health care services to newborns and children having
				or at risk for heritable disorders;</text>
						</paragraph><paragraph id="IDa96684b5136145afa14afcbe7d060968"><enum>(2)</enum><text>to assist in providing
				health care professionals and newborn screening laboratory personnel with
				education in newborn screening and training in relevant and new technologies in
				newborn screening and congenital, genetic, and metabolic disorders;</text>
						</paragraph><paragraph id="ID95c40a87b01c47f58b0936d0db7f2193"><enum>(3)</enum><text>to develop and deliver
				educational programs (at appropriate literacy levels) about newborn screening
				counseling, testing, follow-up, treatment, and specialty services to parents,
				families, and patient advocacy and support groups; and</text>
						</paragraph><paragraph id="ID135c9bf92ab5416e8a7ae926d508d957"><enum>(4)</enum><text>to establish, maintain,
				and operate a system to assess and coordinate treatment relating to congenital,
				genetic, and metabolic disorders</text>
						</paragraph></subsection><subsection id="IDb908e2be67a04d6398e434efbfcdddde"><enum>(b)</enum><header>Eligible
				entity</header><text>In this section, the term <term>eligible entity</term>
				means—</text>
						<paragraph id="ID48af364fc65d48109ddc9e38c99354d6"><enum>(1)</enum><text>a State or a political
				subdivision of a State;</text>
						</paragraph><paragraph id="ID95d7e71e589246859869e9ee1184d9c4"><enum>(2)</enum><text>a consortium of 2 or more
				States or political subdivisions of States;</text>
						</paragraph><paragraph id="IDc34354360b2c4c86b8e38cbf0f30f46d"><enum>(3)</enum><text>a territory;</text>
						</paragraph><paragraph id="ID64cda4be2617408dbc48e7969dbe58e2"><enum>(4)</enum><text>a health facility or
				program operated by or pursuant to a contract with or grant from the Indian
				Health Service; or</text>
						</paragraph><paragraph id="IDfbfe5a50bce04a94b5da4c3166dfd5ce"><enum>(5)</enum><text>any other entity with
				appropriate expertise in newborn screening, as determined by the
				Secretary.</text>
						</paragraph></subsection><subsection id="ID5e025a7b20b84f5c98db4b62a9838e58"><enum>(c)</enum><header>Approval
				factors</header><text>An application submitted for a grant under subsection
				(a)(1) shall not be approved by the Secretary unless the application contains
				assurances that the eligible entity has adopted and implemented, is in the
				process of adopting and implementing, or will use amounts received under such
				grant to adopt and implement the guidelines and recommendations of the Advisory
				Committee that are adopted by the Secretary and in effect at the time the grant
				is awarded or renewed under this section, which shall include the screening of
				each newborn for the heritable disorders recommended by the Advisory Committee
				and adopted by the
				Secretary.</text>
					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idB2577AAFE5AE484F924D2EB4C25285B3"><enum>(2)</enum><text>by redesignating
			 subsections (d) through (i) as subsections (e) through (j),
			 respectively;</text>
			</paragraph><paragraph id="idBCD98D78A2E94382A2BB0BDD00006823"><enum>(3)</enum><text>by inserting after
			 subsection (c), the following:</text>
				<quoted-block changed="added" committee-id="SSHR00" display-inline="no-display-inline" id="id7571A0E392AC4C07BF4998ED348D01CA" reported-display-style="italic" style="OLC">
					<subsection id="ID17b2eb51104641d0b2a219e532419205"><enum>(d)</enum><header>Coordination</header><text>The
				Secretary shall take all necessary steps to coordinate programs funded with

				paragraph (3), and include in such consideration the results of grant funding

				technology used in screening;</text>

				reporting of testing for conditions for which there is no existing
				treatment;</text>
						</subparagraph><subparagraph id="id196dc04f-c316-4aec-bf0d-5fccbe6ad99b"><enum>(E)</enum><text>conditions not included
				in the recommended uniform screening panel that are treatable with Food and
				Drug Administration-approved products or other safe and effective treatments,
				as determined by scientific evidence and peer review;</text>
						</subparagraph><subparagraph id="idc3ef970d-70a5-4c62-8f98-7b417745f960"><enum>(F)</enum><text>minimum standards and
				related policies and procedures used by State newborn screening programs, such
				as language and terminology used by State newborn screening programs to include
				standardization of case definitions and names of disorders for which newborn
				screening tests are performed;</text>
						</subparagraph><subparagraph id="id547b7eef-fb3f-457d-b916-10f7a08f9f1d"><enum>(G)</enum><text>quality assurance,
				oversight, and evaluation of State newborn screening programs, including
				ensuring that tests and technologies used by each State meet established
				standards for detecting and reporting positive screening results;</text>
						</subparagraph><subparagraph id="id4f9be9a6-ee97-4106-9d1f-34c745426c62"><enum>(H)</enum><text>public and provider
				awareness and education;</text>
						</subparagraph><subparagraph id="id6c80522f-e8ee-4697-b36a-e394e1856743"><enum>(I)</enum><text>the cost and
				effectiveness of newborn screening and medical evaluation systems and
				intervention programs conducted by State-based programs;</text>
						</subparagraph><subparagraph id="id9d747fa4-4923-4c30-9779-8c921bcaa681"><enum>(J)</enum><text>identification of the
				causes of, public health impacts of, and risk factors for heritable disorders;
				and</text>
						</subparagraph><subparagraph id="id0c8bb881-0b33-4713-bb35-13e48d44f457"><enum>(K)</enum><text>coordination of
				surveillance activities, including standardized data collection and reporting,
				harmonization of laboratory definitions for heritable disorders and testing
				results, and confirmatory testing and verification of positive results, in
				order to assess and enhance monitoring of newborn
				diseases.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="idffb47533-24b9-4d89-a9c0-6cd969bf2986"><enum>(2)</enum><text>in subsection
			 (c)(2)—</text>

				general</header><text>Not later than 180 days after the Advisory Committee
				issues a recommendation pursuant to this section, the Secretary shall adopt or
				reject such recommendation.</text>
						</paragraph><paragraph id="id027c0b3e-97c1-4547-8706-7b13be1f7c57"><enum>(2)</enum><header>Pending
				recommendations</header><text>The Secretary shall adopt or reject any
				recommendation issued by the Advisory Committee that is pending on the date of
				enactment of the <short-title>Newborn Screening Saves
				Lives Act of 2007</short-title> by not later than 180 days after the date of
				enactment of such Act.</text>
						</paragraph><paragraph id="ide68181c3-8464-416f-a300-1c00904474bb"><enum>(3)</enum><header>Determinations to be
				made public</header><text>The Secretary shall publicize any determination on
				adopting or rejecting a recommendation of the Advisory Committee pursuant to
				this subsection, including the justification for the determination.</text>
						</paragraph></subsection><subsection id="idd3c67a90-b394-4573-9d87-7f29681557bf"><enum>(e)</enum><header>Annual
				report</header><text>Not later than 3 years after the date of enactment of the
				<short-title>Newborn Screening Saves Lives Act of
				2007</short-title>, and each fiscal year thereafter, the Advisory Committee
				shall—</text>
						<paragraph id="idd9225e05-f76f-4070-8e85-daf95a3642c2"><enum>(1)</enum><text>publish a report on
				peer-reviewed newborn screening guidelines, including follow-up and treatment,
				in the United States;</text>
						</paragraph><paragraph id="id7dff0fb9-f2a2-4ed6-a639-6fc55f4e9ce1"><enum>(2)</enum><text>submit such report to the
				appropriate committees of Congress, the Secretary, and the State departments of
				health; and</text>
						</paragraph><paragraph id="id18b94407-6a62-4080-a59c-1e599b3be811"><enum>(3)</enum><text>disseminate such report
				on as wide a basis as practicable, including through posting on the internet
				clearinghouse established under section 1112.</text>
						</paragraph></subsection><subsection id="id9e174108-69e4-4237-8183-dee72447e86d"><enum>(f)</enum><header>Continuation of
				operation of committee</header><text>Notwithstanding section 14 of the Federal
				Advisory Committee Act (5 U.S.C. App.), the Advisory Committee shall continue
				to operate during the 5-year period beginning on the date of enactment of the
				<short-title>Newborn Screening Saves Lives Act of
				2007</short-title>.</text>
					</subsection><subsection id="idc6cd0737-e170-47ee-9262-23c640ce6ba4"><enum>(g)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section, $1,000,000 for fiscal year 2008, $1,012,500 for fiscal year
				2009, $1,025,000 for fiscal year 2010, $1,037,500 for fiscal year 2011, and
				$1,050,000 for fiscal year
				2012.</text>

				Health Resources and Services Administration (referred to in this part as the
				<term>Administrator</term>), in consultation with the Director of the Centers
				for Disease Control and Prevention and the Director of the National Institutes
				of Health, shall establish and maintain a central clearinghouse of current
				educational and family support and services information, materials, resources,
				research, and data on newborn screening to—</text>
						<paragraph id="id4ba67bf2-49b9-4b80-86c4-83e0569595d0"><enum>(1)</enum><text>enable parents and family
				members of newborns, health professionals, industry representatives, and other
				members of the public to increase their awareness, knowledge, and understanding
				of newborn screening;</text>
						</paragraph><paragraph id="id12985343-041e-437c-afed-1cfd797cb761"><enum>(2)</enum><text>increase awareness,
				knowledge, and understanding of newborn diseases and screening services for
				expectant individuals and families; and</text>
						</paragraph><paragraph id="id79f5800a-dd8e-4763-8623-6d70ba330340"><enum>(3)</enum><text>maintain current data on
				quality indicators to measure performance of newborn screening, such as
				false-positive rates and other quality indicators as determined by the Advisory
				Committee under section 1111.</text>
						</paragraph></subsection><subsection id="idb7dde4fd-07d3-4357-9c77-c7b8b3c2326e"><enum>(b)</enum><header>Internet
				availability</header><text>The Secretary, acting through the Administrator,
				shall ensure that the clearinghouse described under subsection (a)—</text>
						<paragraph id="id409354dd-c668-4350-8111-ad549fa88dd7"><enum>(1)</enum><text>is available on the
				Internet;</text>
						</paragraph><paragraph id="idb1b4b6d4-3408-4e1e-bc07-15045cfd9484"><enum>(2)</enum><text>includes an interactive
				forum;</text>
						</paragraph><paragraph id="id01a057bc-03dd-43b8-aac2-de5110d854e5"><enum>(3)</enum><text>is updated on a regular
				basis, but not less than quarterly; and</text>
						</paragraph><paragraph id="id59d32fc0-b122-434d-8ac9-f291309fffe2"><enum>(4)</enum><text>provides—</text>
							<subparagraph id="id591b97fe-387f-41c6-a357-b66c15c81a33"><enum>(A)</enum><text>links to
				Government-sponsored, non-profit, and other Internet websites of laboratories
				that have demonstrated expertise in newborn screening that supply
				research-based information on newborn screening tests currently available
				throughout the United States;</text>
							</subparagraph><subparagraph id="idc315043c-7208-407a-a1f4-2a09a712a945"><enum>(B)</enum><text>information about newborn
				conditions and screening services available in each State from laboratories
				certified under subpart 2 of part F of title III, including information about
				supplemental screening that is available but not required, in the State where
				the infant is born;</text>
							</subparagraph><subparagraph id="idf47fff7c-1ecd-4564-96ea-13b81be9b9d8"><enum>(C)</enum><text>current research on both
				treatable and not-yet treatable conditions for which newborn screening tests
				are available;</text>
							</subparagraph><subparagraph id="id3c3c40d0-17bb-4e80-849d-a58941fa7cc2"><enum>(D)</enum><text>the availability of
				Federal funding for newborn and child screening for heritable disorders
				including grants authorized under the <short-title>Newborn
				Screening Saves Lives Act of 2007</short-title>; and</text>
							</subparagraph><subparagraph id="id9df53dcb-84ba-4254-8219-c4adf449eaa9"><enum>(E)</enum><text>other relevant
				information as determined appropriate by the Secretary.</text>
							</subparagraph></paragraph></subsection><subsection id="id7bb186e2-0d6a-4bc6-9aa1-e4b51b324291"><enum>(c)</enum><header>Nonduplication</header><text>In
				developing the clearinghouse under this section, the Secretary shall ensure
				that such clearinghouse minimizes duplication and supplements, not supplants,
				existing information sharing efforts.</text>
					</subsection><subsection id="id0c5173b0-4c2c-4522-805d-464e80e1198b"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section, $2,500,000 for fiscal year 2008, $2,531,250 for fiscal year
				2009, $2,562,500 for fiscal year 2010, $2,593,750 for fiscal year 2011, and
				$2,625,000 for fiscal year
				2012.</text>

				general</header><text display-inline="yes-display-inline">The Secretary, acting
				through the Director of the Centers for Disease Control and Prevention and in
				consultation with the Advisory Committee on Heritable Disorders in Newborns and
				Children established under section 1111, shall provide for—</text>
						<paragraph id="idadc0a87b-c662-4ac4-930b-9ae8e786c04d"><enum>(1)</enum><text>quality assurance for
				laboratories involved in screening newborns and children for heritable
				disorders, including quality assurance for newborn-screening tests, performance
				evaluation services, and technical assistance and technology transfer to
				newborn screening laboratories to ensure analytic validity and utility of
				screening tests; and</text>
						</paragraph><paragraph commented="no" id="idda02b1c8-dfc0-4866-a97d-17e77f456d9a"><enum>(2)</enum><text>appropriate quality
				control and other performance test materials to evaluate the performance of new
				screening tools.</text>
						</paragraph></subsection><subsection commented="no" id="ide80c7756-caef-42d9-8e01-0bdd1dc23911"><enum>(b)</enum><header>Authorization of
				appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated $5,000,000 for fiscal year 2008,
				$5,062,500 for fiscal year 2009, $5,125,000 for fiscal year 2010, $5,187,500
				for fiscal year 2011, and $5,250,000 for fiscal year 2012.</text>
					</subsection></section><section id="idc8cc1c3f-80e7-4a0a-b405-8c8698f929f7"><enum>1114.</enum><header>Surveillance programs
				for heritable disorders screening</header>
					<subsection id="idedba5ba1-a53a-450d-9d79-8962b29a545a"><enum>(a)</enum><header>In
				general</header><text>The Secretary, acting through an Interagency Group
				consisting of the Director of the Agency for Healthcare Research and Quality,
				the Director of the Centers for Disease Control and Prevention, the
				Administrator, and the Director of the National Institutes of Health, shall
				build upon existing activities and infrastructure to carry out programs—</text>
						<paragraph id="id111e9b25-0125-46e0-9baf-6d066cb60fb5"><enum>(1)</enum><text>to collect, analyze, and
				make available data on the heritable disorders recommended by the Advisory
				Committee on Heritable Disorders in Newborns and Children established under
				section 1111, including data on the incidence and prevalence of, as well as
				poor health outcomes resulting from, such disorders;</text>
						</paragraph><paragraph commented="no" id="id871698ad-ec8c-45a9-bf9a-7f0f613dfd9a"><enum>(2)</enum><text>to identify regional
				centers for the conduct of applied epidemiological research on effective
				interventions for such disorders for the prevention of poor health
				outcomes;</text>
						</paragraph><paragraph id="idb309fe3e-b990-4745-b680-d6a3223b5f8b"><enum>(3)</enum><text>to provide information
				and education to the public on effective interventions for the prevention of
				poor health outcomes resulting from such disorders; and</text>
						</paragraph><paragraph id="idb3eacdf8-409f-4c5a-a3ef-c878a8da042c"><enum>(4)</enum><text>to conduct research on
				and to promote the prevention of poor health outcomes resulting from such
				disorders, and secondary health conditions among individuals with such
				disorders.</text>
						</paragraph></subsection><subsection id="id7baa41d8-ab5e-4634-9576-41a3a6bd608e"><enum>(b)</enum><header>Grants and
				Contracts</header>
						<paragraph id="id3ca95043-ae3d-44c7-875c-c5fddb701dc1"><enum>(1)</enum><header>In
				general</header><text>In carrying out subsection (a), the Secretary may make
				grants to and enter into contracts with public and nonprofit private
				entities.</text>
						</paragraph><paragraph id="idbe30cab1-2229-4553-90bc-ae968c247b79"><enum>(2)</enum><header>Supplies and services
				in lieu of award funds</header>
							<subparagraph id="id17ed72ba-3918-4a82-8a5f-3084fe69c869"><enum>(A)</enum><header>In
				general</header><text>Upon the request of a recipient of an award of a grant or
				contract under paragraph (1), the Secretary may, subject to subparagraph (B),
				provide supplies, equipment, and services for the purpose of aiding the
				recipient in carrying out the purposes for which the award is made and, for
				such purposes, may detail to the recipient any officer or employee of the
				Department of Health and Human Services.</text>
							</subparagraph><subparagraph id="ide6ea62b0-05e6-4e2f-86e5-1f4b604e4ce6"><enum>(B)</enum><header>Reduction</header><text>With
				respect to a request described in subparagraph (A), the Secretary shall reduce
				the amount of payments under the award involved by an amount equal to the costs
				of detailing personnel and the fair market value of any supplies, equipment, or
				services provided by the Secretary. The Secretary shall, for the payment of
				expenses incurred in complying with such request, expend the amounts
				withheld.</text>
							</subparagraph></paragraph><paragraph id="id40484d76-3284-4c9c-8986-9fcecf6ef50e"><enum>(3)</enum><header>Application for
				award</header><text>The Secretary may make an award of a grant or contract
				under paragraph (1) only if an application for the award is submitted to the
				Secretary and the application is in such form, is made in such manner, and
				contains such agreements, assurances, and information as the Secretary
				determines to be necessary to carry out the purposes for which the award is to
				be made.</text>
						</paragraph></subsection><subsection id="id91a43ca1-8c66-4e0e-b29e-b4bd68e1cbe8"><enum>(c)</enum><header>Reports to
				Congress</header>
						<paragraph id="idb5f08f51-7b76-4796-b3f3-060460ad70ab"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the Secretary shall submit to
				the relevant committees of Congress reports—</text>
							<subparagraph id="id18d118dc-5a83-405b-87e5-6fcf465c7c81"><enum>(A)</enum><text>containing information
				under paragraph (1) that is specific to various racial, ethnic, and
				socioeconomic groups;</text>
							</subparagraph><subparagraph id="id4a19bc0f-0876-4aac-8bad-204fe76aa842"><enum>(B)</enum><text>containing an assessment
				of the extent to which various approaches of preventing heritable disorders and
				secondary health conditions among individuals with such disorders have been
				effective;</text>
							</subparagraph><subparagraph id="idf06d2104-b421-44ff-bbbc-9b10464b129d"><enum>(C)</enum><text>describing the activities
				carried out under this section;</text>
							</subparagraph><subparagraph id="ida59f1403-eb2a-4576-804e-527be45f3cac"><enum>(D)</enum><text>containing information on
				the incidence and prevalence of individuals living with heritable disorders,
				information on the health status of individuals with such disorders including
				the extent to which such disorders have contributed to the incidence and
				prevalence of infant mortality, information on any health disparities
				experienced by such individuals, and recommendations for improving the health
				and wellness and quality of life of such individuals;</text>
							</subparagraph><subparagraph id="idcffbf6ec-8d46-4778-9b5e-70fc73adf6ea"><enum>(E)</enum><text>containing a summary of
				recommendations from all heritable disorders research conferences sponsored by
				the Centers for Disease Control and Prevention or the National Institutes of
				Health; and</text>
							</subparagraph><subparagraph id="id9666eac7-8bf9-4fc1-b641-22976a52cbd5"><enum>(F)</enum><text>containing any
				recommendations of the Secretary regarding this section.</text>
							</subparagraph></paragraph><paragraph id="id19c2f35e-a736-4b79-8637-2216f0989548"><enum>(2)</enum><header>Timing of
				reports</header><text>The Secretary shall submit—</text>
							<subparagraph id="id3224355f-7cd4-4b44-b0d5-f5a765a64c96"><enum>(A)</enum><text>an interim report that
				includes the information described in paragraph (1), not later than 30 months
				after the date on which the first grant funds are awarded under this section;
				and</text>
							</subparagraph><subparagraph id="id4fec87e2-191e-43ff-8d48-0011cb86fb46"><enum>(B)</enum><text>a subsequent report that
				includes the information described in paragraph (1), not later than 60 months
				after the date on which the first grant funds are awarded under this
				section.</text>
							</subparagraph></paragraph></subsection><subsection id="id2950d404-ea3c-42a3-9b12-217c46e666a4"><enum>(d)</enum><header>Coordination</header>
						<paragraph id="id3ce6924d-03dd-44d6-be46-855eff4e05a5"><enum>(1)</enum><header>In
				general</header><text>In carrying out this section, the Secretary shall
				coordinate, to the extent practicable, programs under this section with
				programs on birth defects and developmental disabilities authorized under
				section 317C.</text>
						</paragraph><paragraph id="id2ff42943-5b30-4788-9c58-75660f3fc4f6"><enum>(2)</enum><header>Priority in grants and
				contracts</header><text>In making grants and contracts under this section, the
				Secretary shall give priority to entities that demonstrate the ability to
				coordinate activities under a grant or contract made under this section with
				existing birth defects surveillance activities.</text>
						</paragraph></subsection><subsection id="id62ee7cff-32d1-4485-b722-d4b8941f40f5"><enum>(e)</enum><header>Authorization of
				Appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated $15,000,000 for fiscal year 2008,
				$15,187,500 for fiscal year 2009, $15,375,000 for fiscal year 2010, $15,562,500
				for fiscal year 2011, and $15,750,000 for fiscal year
				2012.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" committee-id="SSHR00" id="id9f3f4d61-b20c-4e4c-bff1-1eff8585583a" reported-display-style="italic"><enum>7.</enum><header>Contingency
			 planning</header><text display-inline="no-display-inline">Part A of title XI of
			 the Public Health Service Act (42 U.S.C. 300b–1 et seq.), as amended by section
			 6, is further amended by adding at the end the following:</text>

				<section id="id0c21f600-c9d9-4e66-b0bc-e08e4a68bc16"><enum>1115.</enum><header>National contingency
				plan for newborn screening</header>
					<subsection id="id3354c841-6f5b-493f-a817-2378a5ee61cf"><enum>(a)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				this section, the Secretary, acting through the Director of the Centers for
				Disease Control and Prevention and in consultation with the Administrator and
				State departments of health (or related agencies), shall develop a national
				contingency plan for newborn screening for use by a State, region, or consortia
				of States in the event of a public health emergency.</text>
					</subsection><subsection id="idce47a9b1-c11f-4826-8102-2c3b60427ee6"><enum>(b)</enum><header>Contents</header><text>The
				contingency plan developed under subsection (a) shall include a plan
				for—</text>
						<paragraph id="id46025e01-1c01-4cad-ac78-03ae7ac5ceb4"><enum>(1)</enum><text>the collection and
				transport of specimens;</text>
						</paragraph><paragraph id="idd142a267-4987-4f95-a6fd-6c86b31457f8"><enum>(2)</enum><text>the shipment of specimens
				to State newborn screening laboratories;</text>
						</paragraph><paragraph id="id0d602a11-0d52-4cc6-8f49-64a75327aeac"><enum>(3)</enum><text>the processing of
				specimens;</text>
						</paragraph><paragraph id="idbf3bf0a8-8c04-4a06-aa0c-c4bb424fe1ee"><enum>(4)</enum><text>the reporting of
				screening results to physicians and families;</text>
						</paragraph><paragraph id="idbd62f950-98c1-4308-afe1-cab8acad00d0"><enum>(5)</enum><text>the diagnostic
				confirmation of positive screening results;</text>
						</paragraph><paragraph id="idaeb1e428-4eb1-4bd8-b2f9-fb7c7dee21eb"><enum>(6)</enum><text>ensuring the availability
				of treatment and management resources;</text>
						</paragraph><paragraph id="ide85f4e42-1af3-4d71-85d0-0b45057559cf"><enum>(7)</enum><text>educating families about
				newborn screening; and</text>
						</paragraph><paragraph id="id55563777-ec97-4ec0-a5d2-cd391f11ffa3"><enum>(8)</enum><text>carrying out other
				activities determined appropriate by the Secretary.</text>
						</paragraph></subsection></section><section id="id2E60FA8AB2F24CE98567538861C8D75E"><enum>1116.</enum><header>Hunter Kelly research
				program</header>
					<subsection commented="no" id="idF8D77A18040C4BE396273BFAB91AEEB9"><enum>(a)</enum><header>Newborn screening
				activities</header>
						<paragraph commented="no" id="idC40FB97B5558494ABAD617786BEA8280"><enum>(1)</enum><header>In
				general</header><text>The Secretary, in conjunction with the Director of the
				National Institutes of Health and taking into consideration the recommendations
				of the Advisory Committee, may continue carrying out, coordinating, and
				expanding research in newborn screening (to be known as <term>Hunter Kelly
				Newborn Screening Research Program</term>) including—</text>
							<subparagraph id="id4E7A6CDBB75948FFAB902AB5EB61274F"><enum>(A)</enum><text>identifying, developing,
				and testing the most promising new screening technologies, in order to improve
				already existing screening tests, increase the specificity of newborn
				screening, and expand the number of conditions for which screening tests are
				available;</text>
							</subparagraph><subparagraph id="idE4FA1ADE58BF440683F784323736170F"><enum>(B)</enum><text>experimental treatments
				and disease management strategies for additional newborn conditions, and other
				genetic, metabolic, hormonal and or functional conditions that can be detected
				through newborn screening for which treatment is not yet available; and</text>
							</subparagraph><subparagraph id="id92242AFC931940B5B81CE3043F51ADCE"><enum>(C)</enum><text>other activities that
				would improve newborn screening, as identified by the Director.</text>
							</subparagraph></paragraph><paragraph commented="no" id="id9D556A80E37241EB9CC293A46B45D5A2"><enum>(2)</enum><header>Additional newborn
				condition</header><text>For purposes of this subsection, the term
				<term>additional newborn condition</term> means any condition that is not one
				of the core conditions recommended by the Advisory Committee and adopted by the
				Secretary.</text>
						</paragraph></subsection><subsection id="idAEF9C4AE1EF5448688AC77EABDBB8442"><enum>(b)</enum><header>Funding</header><text>In
				carrying out the research program under this section, the Secretary and the
				Director shall ensure that entities receiving funding through the program will
				provide assurances, as practicable, that such entities will work in
				consultation with the appropriate State departments of health, and, as
				practicable, focus their research on screening technology not currently
				performed in the States in which the entities are located, and the conditions
				on the uniform screening panel (or the standard test existing on the uniform
				screening panel).</text>
					</subsection><subsection id="id4C5AEFFFAB5740F58BF1EA76FEABE497"><enum>(c)</enum><header>Reports</header><text>The
				Director is encouraged to include information about the activities carried out
				under this section in the biennial report required under section 403 of the
				National Institutes of Health Reform Act of 2006. If such information is
				included, the Director shall make such information available to be included on
				the Internet Clearinghouse established under section 1112.</text>
					</subsection><subsection id="id0717E810AE2F4EFE8883A1459405D474"><enum>(d)</enum><header>Nonduplication</header><text>In
				carrying out programs under this section, the Secretary shall minimize
				duplication and supplement, not supplant, existing efforts of the type carried
				out under this section.</text>
					</subsection><subsection id="id9DBD44194ADF494480963E5F77E1828E"><enum>(e)</enum><header>Peer
				review</header><text>Nothing in this section shall be construed to interfere
				with the scientific peer-review process at the National Institutes of
				Health.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
