		<legis-type display="yes">AN ACT</legis-type>
		<official-title display="yes">To amend the Public Health Service Act to
		  establish grant programs to provide for education and outreach on newborn
		  screening and coordinated followup care once newborn screening has been
		  conducted, to reauthorize programs under part A of title XI of such Act, and
		  for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idc17fc334-5463-40d2-ace3-6e7901e351a8" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Newborn Screening Saves Lives Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idFF2CD25F211A48998A098EDA048FB6B2" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Improved newborn and child screening for
			 heritable disorder</header><text display-inline="no-display-inline">Section
			 1109 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-8">42 U.S.C. 300b–8</external-xref>) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID8ef83604ee684b76841ec5ddec6e6d54"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsections (a), (b), and (c)
			 and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE1ECCFB126C24C23942B56B7A565B2F3" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID123e689a8aef4fa49cc30e0863241083"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of grant
				program</header><text display-inline="yes-display-inline">From amounts
				appropriated under subsection (j), the Secretary, acting through the
				Administrator of the Health Resources and Services Administration (referred to
				in this section as the <quote>Administrator</quote>) and in consultation with
				the Advisory Committee on Heritable Disorders in Newborns and Children
				(referred to in this section as the <quote>Advisory Committee</quote>), shall
				award grants to eligible entities to enable such entities—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID9678da78a6c54b018a8190391af67cd2"><enum>(1)</enum><text display-inline="yes-display-inline">to enhance, improve or expand the ability
				of State and local public health agencies to provide screening, counseling, or
				health care services to newborns and children having or at risk for heritable
				disorders;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa96684b5136145afa14afcbe7d060968"><enum>(2)</enum><text display-inline="yes-display-inline">to assist in providing health care
				professionals and newborn screening laboratory personnel with education in
				newborn screening and training in relevant and new technologies in newborn
				screening and congenital, genetic, and metabolic disorders;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID95c40a87b01c47f58b0936d0db7f2193"><enum>(3)</enum><text display-inline="yes-display-inline">to develop and deliver educational programs
				(at appropriate literacy levels) about newborn screening counseling, testing,
				follow-up, treatment, and specialty services to parents, families, and patient
				advocacy and support groups; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID135c9bf92ab5416e8a7ae926d508d957"><enum>(4)</enum><text display-inline="yes-display-inline">to establish, maintain, and operate a
				system to assess and coordinate treatment relating to congenital, genetic, and
				metabolic disorders.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb908e2be67a04d6398e434efbfcdddde"><enum>(b)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">In this section, the term <quote>eligible
				entity</quote> means—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID48af364fc65d48109ddc9e38c99354d6"><enum>(1)</enum><text display-inline="yes-display-inline">a State or a political subdivision of a
				State;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID95d7e71e589246859869e9ee1184d9c4"><enum>(2)</enum><text display-inline="yes-display-inline">a consortium of 2 or more States or
				political subdivisions of States;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc34354360b2c4c86b8e38cbf0f30f46d"><enum>(3)</enum><text display-inline="yes-display-inline">a territory;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID64cda4be2617408dbc48e7969dbe58e2"><enum>(4)</enum><text display-inline="yes-display-inline">a health facility or program operated by or
				pursuant to a contract with or grant from the Indian Health Service; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfbfe5a50bce04a94b5da4c3166dfd5ce"><enum>(5)</enum><text display-inline="yes-display-inline">any other entity with appropriate expertise
				in newborn screening, as determined by the Secretary.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5e025a7b20b84f5c98db4b62a9838e58"><enum>(c)</enum><header display-inline="yes-display-inline">Approval factors</header><text display-inline="yes-display-inline">An application submitted for a grant under
				subsection (a)(1) shall not be approved by the Secretary unless the application
				contains assurances that the eligible entity has adopted and implemented, is in
				the process of adopting and implementing, or will use amounts received under
				such grant to adopt and implement the guidelines and recommendations of the
				Advisory Committee that are adopted by the Secretary and in effect at the time
				the grant is awarded or renewed under this section, which shall include the
				screening of each newborn for the heritable disorders recommended by the
				Advisory Committee and adopted by the
				Secretary.</text>
					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB2577AAFE5AE484F924D2EB4C25285B3"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (d) through
			 (i) as subsections (e) through (j), respectively;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBCD98D78A2E94382A2BB0BDD00006823"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (c), the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id7571A0E392AC4C07BF4998ED348D01CA" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID17b2eb51104641d0b2a219e532419205"><enum>(d)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">The Secretary shall take all necessary
				steps to coordinate programs funded with grants received under this section and
				to coordinate with existing newborn screening
				activities.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEEBA35131CA34D68B68A820496575BDC"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsection (j) (as so
			 redesignated) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id59FDFFEE165D4BB4A2EA86545F07AC5F" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID713d43a6358d46679dd6cdc866670f6d"><enum>(j)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDc62cfed4dd6241558e0ca6de9767535d"><enum>(1)</enum><text display-inline="yes-display-inline">to provide grants for the purpose of
				carrying activities under section (a)(1), $15,000,000 for fiscal year 2008;
				$15,187,500 for fiscal year 2009, $15,375,000 for fiscal year 2010, $15,562,500
				for fiscal year 2011, and $15,750,000 for fiscal year 2012; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID99c41aef3eba455a81d9f84582e96ec3"><enum>(2)</enum><text display-inline="yes-display-inline">to provide grant for the purpose of
				carrying out activities under paragraphs (2), (3), and (4) of subsection (a),
				$15,000,000 for fiscal year 2008, $15,187,500 for fiscal year 2009, $15,375,000
				for fiscal year 2010, $15,562,500 for fiscal year 2011, and $15,750,000 for
				fiscal year
				2012.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ida8cd9e6f-0be0-4c89-a172-7c2802f4020a" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Evaluating the effectiveness of newborn and
			 child screening programs</header><text display-inline="no-display-inline">Section 1110 of the Public Health Service
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-9">42 U.S.C. 300b–9</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id94b04a01-568a-4b98-bcc5-cbfae5e691ca" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="id49be3968-1c6f-42e2-856b-c6bc00a32f8e"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section $5,000,000 for fiscal
				year 2008, $5,062,500 for fiscal year 2009, $5,125,000 for fiscal year 2010,
				$5,187,500 for fiscal year 2011, and $5,250,000 for fiscal year
				2012.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id5a420e0e-1aec-4b5c-9c53-228cd845afcd" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Advisory committee on heritable disorders
			 in newborns and children</header><text display-inline="no-display-inline">Section 1111 of the Public Health Service
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-10">42 U.S.C. 300b–10</external-xref>) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idcfd8a756-7fea-46ce-8107-1f4d95091ee8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id67708da4-b48b-47a1-9b20-b520e4a7d4f1"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph
			 (6);</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3498f4c4-261f-46b2-9ee2-c51e81a9cae0"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0c0cb33-e4e0-45ec-b72e-17bb8b1afbc6"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id2ae09522-7212-439a-9c7e-b6c98dc331b5" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="idf47cc7e8-ca82-4dcc-9980-a0d86e873612"><enum>(3)</enum><text display-inline="yes-display-inline">make systematic evidence-based and
				peer-reviewed recommendations that include the heritable disorders that have
				the potential to significantly impact public health for which all newborns
				should be screened, including secondary conditions that may be identified as a
				result of the laboratory methods used for screening;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8c5f047-05d1-4219-b436-da57823ca990"><enum>(4)</enum><text display-inline="yes-display-inline">develop a model decision-matrix for newborn
				screening expansion, including an evaluation of the potential public health
				impact of such expansion, and periodically update the recommended uniform
				screening panel, as appropriate, based on such decision-matrix;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0c859b5-e10d-4925-9ded-77bd8d36c282"><enum>(5)</enum><text display-inline="yes-display-inline">consider ways to ensure that all States
				attain the capacity to screen for the conditions described in paragraph (3),
				and include in such consideration the results of grant funding under section
				1109;
				and</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85f068e6-8f26-4761-81cf-2db2f55828ba"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (6) (as so redesignated by
			 subparagraph (A)), by striking the period at the end and inserting “, which may
			 include recommendations, advice, or information dealing with—</text>
					<quoted-block display-inline="no-display-inline" id="id3d11b757-62c0-442f-8466-751733b7517f" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id04d746dd-d793-4fc9-9915-6be3a3f14360"><enum>(A)</enum><text display-inline="yes-display-inline">follow-up activities, including those
				necessary to achieve rapid diagnosis in the short-term, and those that
				ascertain long-term case management outcomes and appropriate access to related
				services;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3fbc6ef8-1308-4b98-8f7e-e8ff73c944a7"><enum>(B)</enum><text display-inline="yes-display-inline">implementation, monitoring, and evaluation
				of newborn screening activities, including diagnosis, screening, follow-up, and
				treatment activities;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7014c57c-d5ed-44b2-a376-9c8674d16bd3"><enum>(C)</enum><text display-inline="yes-display-inline">diagnostic and other technology used in
				screening;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0cd9fb66-7388-4904-af58-8e5fbbaf58f3"><enum>(D)</enum><text display-inline="yes-display-inline">the availability and reporting of testing
				for conditions for which there is no existing treatment;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id196dc04f-c316-4aec-bf0d-5fccbe6ad99b"><enum>(E)</enum><text display-inline="yes-display-inline">conditions not included in the recommended
				uniform screening panel that are treatable with Food and Drug
				Administration-approved products or other safe and effective treatments, as
				determined by scientific evidence and peer review;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc3ef970d-70a5-4c62-8f98-7b417745f960"><enum>(F)</enum><text display-inline="yes-display-inline">minimum standards and related policies and
				procedures used by State newborn screening programs, such as language and
				terminology used by State newborn screening programs to include standardization
				of case definitions and names of disorders for which newborn screening tests
				are performed;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id547b7eef-fb3f-457d-b916-10f7a08f9f1d"><enum>(G)</enum><text display-inline="yes-display-inline">quality assurance, oversight, and
				evaluation of State newborn screening programs, including ensuring that tests
				and technologies used by each State meet established standards for detecting
				and reporting positive screening results;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f9be9a6-ee97-4106-9d1f-34c745426c62"><enum>(H)</enum><text display-inline="yes-display-inline">public and provider awareness and
				education;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c80522f-e8ee-4697-b36a-e394e1856743"><enum>(I)</enum><text display-inline="yes-display-inline">the cost and effectiveness of newborn
				screening and medical evaluation systems and intervention programs conducted by
				State-based programs;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d747fa4-4923-4c30-9779-8c921bcaa681"><enum>(J)</enum><text display-inline="yes-display-inline">identification of the causes of, public
				health impacts of, and risk factors for heritable disorders; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0c8bb881-0b33-4713-bb35-13e48d44f457"><enum>(K)</enum><text display-inline="yes-display-inline">coordination of surveillance activities,
				including standardized data collection and reporting, harmonization of
				laboratory definitions for heritable disorders and testing results, and
				confirmatory testing and verification of positive results, in order to assess
				and enhance monitoring of newborn
				diseases.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idffb47533-24b9-4d89-a9c0-6cd969bf2986"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(2)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id902fe07b-610e-4903-a1af-72a41a0dac7e"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (E), (F) and
			 (G) as subparagraphs (F), (H), and (I);</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb4d1301b-2461-42ea-aaca-da085a84b87c"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (D) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id9f6528a9-ddc6-4363-9c5b-b0994e0431a0" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="ide7c2775e-9eb0-46d1-a060-c2b7ee7e63f2"><enum>(E)</enum><text display-inline="yes-display-inline">the Commissioner of the Food and Drug
				Administration;</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba14c9eb-07c7-4fcd-9194-a9e4b95c5b8c"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (F), as so
			 redesignated, the following:</text>
					<quoted-block display-inline="no-display-inline" id="idbc37c8d2-144f-4335-a590-c881238141c2" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id1d4969f4-9659-47cd-90cd-1cc605c34b0f"><enum>(G)</enum><text display-inline="yes-display-inline">individuals with expertise in ethics and
				infectious diseases who have worked and published material in the area of
				newborn screening;</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc64d7447-fd2f-4431-9b03-04a2191f0ddf"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id74af6cbb-344c-4a45-967e-0cc04aee42bd" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="idb1c45f03-7c03-4715-88b9-0b1602aee02d"><enum>(d)</enum><header display-inline="yes-display-inline">Decision on recommendations</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id55a92ae1-85dd-467a-8214-b206f9601479"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the Advisory
				Committee issues a recommendation pursuant to this section, the Secretary shall
				adopt or reject such recommendation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id027c0b3e-97c1-4547-8706-7b13be1f7c57"><enum>(2)</enum><header display-inline="yes-display-inline">Pending recommendations</header><text display-inline="yes-display-inline">The Secretary shall adopt or reject any
				recommendation issued by the Advisory Committee that is pending on the date of
				enactment of the <short-title>Newborn Screening Saves
				Lives Act of 2007</short-title> by not later than 180 days after the date of
				enactment of such Act.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide68181c3-8464-416f-a300-1c00904474bb"><enum>(3)</enum><header display-inline="yes-display-inline">Determinations to be made
				public</header><text display-inline="yes-display-inline">The Secretary shall
				publicize any determination on adopting or rejecting a recommendation of the
				Advisory Committee pursuant to this subsection, including the justification for
				the determination.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd3c67a90-b394-4573-9d87-7f29681557bf"><enum>(e)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of the <short-title>Newborn Screening Saves
				Lives Act of 2007</short-title>, and each fiscal year thereafter, the Advisory
				Committee shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idd9225e05-f76f-4070-8e85-daf95a3642c2"><enum>(1)</enum><text display-inline="yes-display-inline">publish a report on peer-reviewed newborn
				screening guidelines, including follow-up and treatment, in the United
				States;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7dff0fb9-f2a2-4ed6-a639-6fc55f4e9ce1"><enum>(2)</enum><text display-inline="yes-display-inline">submit such report to the appropriate
				committees of Congress, the Secretary, the Interagency Coordinating Committee
				established under Section 1114, and the State departments of health; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18b94407-6a62-4080-a59c-1e599b3be811"><enum>(3)</enum><text display-inline="yes-display-inline">disseminate such report on as wide a basis
				as practicable, including through posting on the internet clearinghouse
				established under section 1112.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9e174108-69e4-4237-8183-dee72447e86d"><enum>(f)</enum><header display-inline="yes-display-inline">Continuation of operation of
				committee</header><text display-inline="yes-display-inline">Notwithstanding
				<external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /14">section 14</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.), the Advisory
				Committee shall continue to operate during the 5-year period beginning on the
				date of enactment of the <short-title>Newborn Screening
				Saves Lives Act of 2007</short-title>.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="idc6cd0737-e170-47ee-9262-23c640ce6ba4"><enum>(g)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section, $1,000,000 for fiscal
				year 2008, $1,012,500 for fiscal year 2009, $1,025,000 for fiscal year 2010,
				$1,037,500 for fiscal year 2011, and $1,050,000 for fiscal year

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id65433fde-db72-428f-95ce-4fa9446ca6b7" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Information clearinghouse</header><text display-inline="no-display-inline">Part A of title XI of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-1">42 U.S.C. 300b–1 et seq.</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idb0f7dd41-810e-4b6f-8fe6-e58269121074" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="id1c7674ec-6d84-417b-b784-0d82bed8ba7d" section-type="subsequent-section"><enum>1112.</enum><header display-inline="yes-display-inline">Clearinghouse of newborn screening
				information</header>
					<subsection commented="no" display-inline="no-display-inline" id="id129cecfe-6d86-47f7-8b23-003bdaf507bc"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the
				Administrator of the Health Resources and Services Administration (referred to
				in this part as the <quote>Administrator</quote>), in consultation with the
				Director of the Centers for Disease Control and Prevention and the Director of
				the National Institutes of Health, shall establish and maintain a central
				clearinghouse of current educational and family support and services
				information, materials, resources, research, and data on newborn screening
				to—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id4ba67bf2-49b9-4b80-86c4-83e0569595d0"><enum>(1)</enum><text display-inline="yes-display-inline">enable parents and family members of
				newborns, health professionals, industry representatives, and other members of
				the public to increase their awareness, knowledge, and understanding of newborn
				screening;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12985343-041e-437c-afed-1cfd797cb761"><enum>(2)</enum><text display-inline="yes-display-inline">increase awareness, knowledge, and
				understanding of newborn diseases and screening services for expectant
				individuals and families; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79f5800a-dd8e-4763-8623-6d70ba330340"><enum>(3)</enum><text display-inline="yes-display-inline">maintain current data on quality indicators
				to measure performance of newborn screening, such as false-positive rates and
				other quality indicators as determined by the Advisory Committee under section
				1111.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb7dde4fd-07d3-4357-9c77-c7b8b3c2326e"><enum>(b)</enum><header display-inline="yes-display-inline">Internet availability</header><text display-inline="yes-display-inline">The Secretary, acting through the
				Administrator, shall ensure that the clearinghouse described under subsection
				(a)—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id409354dd-c668-4350-8111-ad549fa88dd7"><enum>(1)</enum><text display-inline="yes-display-inline">is available on the Internet;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1b4b6d4-3408-4e1e-bc07-15045cfd9484"><enum>(2)</enum><text display-inline="yes-display-inline">includes an interactive forum;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01a057bc-03dd-43b8-aac2-de5110d854e5"><enum>(3)</enum><text display-inline="yes-display-inline">is updated on a regular basis, but not less
				than quarterly; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59d32fc0-b122-434d-8ac9-f291309fffe2"><enum>(4)</enum><text display-inline="yes-display-inline">provides—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id591b97fe-387f-41c6-a357-b66c15c81a33"><enum>(A)</enum><text display-inline="yes-display-inline">links to Government-sponsored, non-profit,
				and other Internet websites of laboratories that have demonstrated expertise in
				newborn screening that supply research-based information on newborn screening
				tests currently available throughout the United States;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc315043c-7208-407a-a1f4-2a09a712a945"><enum>(B)</enum><text display-inline="yes-display-inline">information about newborn conditions and
				screening services available in each State from laboratories certified under
				subpart 2 of part F of title III, including information about supplemental
				screening that is available but not required, in the State where the infant is
				born;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf47fff7c-1ecd-4564-96ea-13b81be9b9d8"><enum>(C)</enum><text display-inline="yes-display-inline">current research on both treatable and
				not-yet treatable conditions for which newborn screening tests are
				available;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3c3c40d0-17bb-4e80-849d-a58941fa7cc2"><enum>(D)</enum><text display-inline="yes-display-inline">the availability of Federal funding for
				newborn and child screening for heritable disorders including grants authorized
				under the <short-title>Newborn Screening Saves Lives Act
				of 2007</short-title>; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9df53dcb-84ba-4254-8219-c4adf449eaa9"><enum>(E)</enum><text display-inline="yes-display-inline">other relevant information as determined
				appropriate by the Secretary.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7bb186e2-0d6a-4bc6-9aa1-e4b51b324291"><enum>(c)</enum><header display-inline="yes-display-inline">Nonduplication</header><text display-inline="yes-display-inline">In developing the clearinghouse under this
				section, the Secretary shall ensure that such clearinghouse minimizes
				duplication and supplements, not supplants, existing information sharing
				efforts.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id0c5173b0-4c2c-4522-805d-464e80e1198b"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section, $2,500,000 for fiscal
				year 2008, $2,531,250 for fiscal year 2009, $2,562,500 for fiscal year 2010,
				$2,593,750 for fiscal year 2011, and $2,625,000 for fiscal year
				2012.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id05d2f1e8-2165-45ec-9db0-05e4b230d644" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Laboratory quality and
			 surveillance</header><text display-inline="no-display-inline">Part A of title
			 XI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-1">42 U.S.C. 300b–1 et seq.</external-xref>), as amended by
			 section 5, is further amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id9a525cb0-9c6a-48ea-8f62-884f7d030023" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="id1ee0f0f5-ecd2-4897-9916-f8f4a271fdb1" section-type="subsequent-section"><enum>1113.</enum><header display-inline="yes-display-inline">Laboratory quality</header>
					<subsection commented="no" display-inline="no-display-inline" id="idd589a96c-c7ff-44a7-804b-47d6a7ad189a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of the Centers for Disease Control and Prevention and in consultation with the
				Advisory Committee on Heritable Disorders in Newborns and Children established
				under section 1111, shall provide for—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idadc0a87b-c662-4ac4-930b-9ae8e786c04d"><enum>(1)</enum><text display-inline="yes-display-inline">quality assurance for laboratories involved
				in screening newborns and children for heritable disorders, including quality
				assurance for newborn-screening tests, performance evaluation services, and
				technical assistance and technology transfer to newborn screening laboratories
				to ensure analytic validity and utility of screening tests; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda02b1c8-dfc0-4866-a97d-17e77f456d9a"><enum>(2)</enum><text display-inline="yes-display-inline">appropriate quality control and other
				performance test materials to evaluate the performance of new screening
				tools.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide80c7756-caef-42d9-8e01-0bdd1dc23911"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">For the
				purpose of carrying out this section, there are authorized to be appropriated
				$5,000,000 for fiscal year 2008, $5,062,500 for fiscal year 2009, $5,125,000
				for fiscal year 2010, $5,187,500 for fiscal year 2011, and $5,250,000 for
				fiscal year 2012.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="idc8cc1c3f-80e7-4a0a-b405-8c8698f929f7" section-type="subsequent-section"><enum>1114.</enum><header display-inline="yes-display-inline">Interagency coordinating committee on
				newborn and child screening</header>
					<subsection commented="no" display-inline="no-display-inline" id="id7990409A9A5F41038D1307A9BF59BD61"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">It is the purpose of this section
				to—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id7F75B0E78C04421891FA9641C1F113C5"><enum>(1)</enum><text display-inline="yes-display-inline">assess existing activities and
				infrastructure, including activities on birth defects and developmental
				disabilities authorized under section 317C, in order to make recommendations
				for programs to collect, analyze, and make available data on the heritable
				disorders recommended by the Advisory Committee on Heritable Disorders in
				Newborns and Children under section 1111, including data on the incidence and
				prevalence of, as well as poor health outcomes resulting from, such disorders;
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9FE202FBECAB46939A577DD10A889C63"><enum>(2)</enum><text display-inline="yes-display-inline">make recommendations for the establishment
				of regional centers for the conduct of applied epidemiological research on
				effective interventions to promote the prevention of poor health outcomes
				resulting from such disorders as well as providing information and education to
				the public on such effective interventions.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa7fe4b9ff3ad48b7bf10cb00796c941b"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish an
				Interagency Coordinating Committee on Newborn and Child Screening (referred to
				in this section as the <quote>Interagency Coordinating Committee</quote>) to
				carry out the purpose of this section.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID530cde47b74a4dc4b03d9a1b70eaf72f"><enum>(c)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Interagency Coordinating Committee
				shall be composed of the Director of the Centers for Disease Control and
				Prevention, the Administrator, the Director of the Agency for Healthcare
				Research and Quality, and the Director of the National Institutes of Health, or
				their designees.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf7033477d9124bbf986be123ba27cc81"><enum>(d)</enum><header display-inline="yes-display-inline">Activities</header><text display-inline="yes-display-inline">The Interagency Coordinating Committee
				shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID584342bf16184bbdb34a8f9cdcb2c66a"><enum>(1)</enum><text display-inline="yes-display-inline">report to the Secretary and the appropriate
				committees of Congress on its recommendations related to the purpose described
				in subsection (a); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID411d1b6b6f21494eabc5c984f7450db0"><enum>(2)</enum><text display-inline="yes-display-inline">carry out other activities determined
				appropriate by the Secretary.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa5d90e99cba94394935a3e756bc89f42"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">For the
				purpose of carrying out this section, there are authorized to be appropriated
				$1,000,000 for fiscal year 2008, $1,012,500 for fiscal year 2009, $1,025,000
				for fiscal year 2010, $1,037,500 for fiscal year 2011, and $1,050,000 for
				fiscal year
				2012.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id9f3f4d61-b20c-4e4c-bff1-1eff8585583a" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Contingency planning</header><text display-inline="no-display-inline">Part A of title XI of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-1">42 U.S.C. 300b–1 et seq.</external-xref>), as amended by section 6, is further
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idba797bec-3f1a-43ed-a10f-1ec2ee9c95fa" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="id0c21f600-c9d9-4e66-b0bc-e08e4a68bc16" section-type="subsequent-section"><enum>1115.</enum><header display-inline="yes-display-inline">National contingency plan for newborn
				screening</header>
					<subsection commented="no" display-inline="no-display-inline" id="id3354c841-6f5b-493f-a817-2378a5ee61cf"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this section, the Secretary, acting through the Director of the
				Centers for Disease Control and Prevention and in consultation with the
				Administrator and State departments of health (or related agencies), shall
				develop a national contingency plan for newborn screening for use by a State,
				region, or consortia of States in the event of a public health
				emergency.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="idce47a9b1-c11f-4826-8102-2c3b60427ee6"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The contingency plan developed under
				subsection (a) shall include a plan for—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id46025e01-1c01-4cad-ac78-03ae7ac5ceb4"><enum>(1)</enum><text display-inline="yes-display-inline">the collection and transport of
				specimens;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd142a267-4987-4f95-a6fd-6c86b31457f8"><enum>(2)</enum><text display-inline="yes-display-inline">the shipment of specimens to State newborn
				screening laboratories;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d602a11-0d52-4cc6-8f49-64a75327aeac"><enum>(3)</enum><text display-inline="yes-display-inline">the processing of specimens;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf3bf0a8-8c04-4a06-aa0c-c4bb424fe1ee"><enum>(4)</enum><text display-inline="yes-display-inline">the reporting of screening results to
				physicians and families;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd62f950-98c1-4308-afe1-cab8acad00d0"><enum>(5)</enum><text display-inline="yes-display-inline">the diagnostic confirmation of positive
				screening results;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaeb1e428-4eb1-4bd8-b2f9-fb7c7dee21eb"><enum>(6)</enum><text display-inline="yes-display-inline">ensuring the availability of treatment and
				management resources;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide85f4e42-1af3-4d71-85d0-0b45057559cf"><enum>(7)</enum><text display-inline="yes-display-inline">educating families about newborn screening;
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55563777-ec97-4ec0-a5d2-cd391f11ffa3"><enum>(8)</enum><text display-inline="yes-display-inline">carrying out other activities determined
				appropriate by the Secretary.</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id2E60FA8AB2F24CE98567538861C8D75E" section-type="subsequent-section"><enum>1116.</enum><header display-inline="yes-display-inline">Hunter Kelly research program</header>
					<subsection commented="no" display-inline="no-display-inline" id="idF8D77A18040C4BE396273BFAB91AEEB9"><enum>(a)</enum><header display-inline="yes-display-inline">Newborn screening activities</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idC40FB97B5558494ABAD617786BEA8280"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in conjunction with the
				Director of the National Institutes of Health and taking into consideration the
				recommendations of the Advisory Committee, may continue carrying out,
				coordinating, and expanding research in newborn screening (to be known as
				<quote>Hunter Kelly Newborn Screening Research Program</quote>)
				including—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id4E7A6CDBB75948FFAB902AB5EB61274F"><enum>(A)</enum><text display-inline="yes-display-inline">identifying, developing, and testing the
				most promising new screening technologies, in order to improve already existing
				screening tests, increase the specificity of newborn screening, and expand the
				number of conditions for which screening tests are available;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE4FA1ADE58BF440683F784323736170F"><enum>(B)</enum><text display-inline="yes-display-inline">experimental treatments and disease
				management strategies for additional newborn conditions, and other genetic,
				metabolic, hormonal and or functional conditions that can be detected through
				newborn screening for which treatment is not yet available; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id92242AFC931940B5B81CE3043F51ADCE"><enum>(C)</enum><text display-inline="yes-display-inline">other activities that would improve newborn
				screening, as identified by the Director.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9D556A80E37241EB9CC293A46B45D5A2"><enum>(2)</enum><header display-inline="yes-display-inline">Additional newborn condition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term
				<term>additional newborn condition</term> means any condition that is not one
				of the core conditions recommended by the Advisory Committee and adopted by the
				Secretary.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAEF9C4AE1EF5448688AC77EABDBB8442"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">In carrying out the research program under
				this section, the Secretary and the Director shall ensure that entities
				receiving funding through the program will provide assurances, as practicable,
				that such entities will work in consultation with the appropriate State
				departments of health, and, as practicable, focus their research on screening
				technology not currently performed in the States in which the entities are
				located, and the conditions on the uniform screening panel (or the standard
				test existing on the uniform screening panel).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id4C5AEFFFAB5740F58BF1EA76FEABE497"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Director is encouraged to include
				information about the activities carried out under this section in the biennial
				report required under section 403 of the National Institutes of Health Reform
				Act of 2006. If such information is included, the Director shall make such
				information available to be included on the Internet Clearinghouse established
				under section 1112.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id0717E810AE2F4EFE8883A1459405D474"><enum>(d)</enum><header display-inline="yes-display-inline">Nonduplication</header><text display-inline="yes-display-inline">In carrying out programs under this
				section, the Secretary shall minimize duplication and supplement, not supplant,
				existing efforts of the type carried out under this section.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id9DBD44194ADF494480963E5F77E1828E"><enum>(e)</enum><header display-inline="yes-display-inline">Peer review</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to interfere with the scientific peer-review process at the National Institutes
				of
				Health.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
