			 amended—</text>

			 striking <quote>agricultural firm)</quote> and inserting <quote>agricultural

				articles which are produced, or services which are provided by such firm,
				subdivision, or public agency; or</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id7A316D714F5A4EDDBEA576E95E5F392E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">such workers' firm, subdivision, or public
				agency has obtained or is likely to obtain such services from a foreign
				country.</text>
											</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB4DC45FD27AB450CBB3957DB55DB2914"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>

			 after <quote>for articles</quote>;</text>

			 subdivision)</quote> after <quote>such other firm</quote>; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id72D6064892904D708C10F93F5F8D5A40"><enum>(v)</enum><text>by striking
			 <quote>, if the certification of eligibility</quote> and all that follows
			 through <quote>Canada or Mexico</quote>; and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID85DB6D89E8D84B559F726C4BA75817F1"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID1166B598632340F9882CEA85E47F0CCC"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>for articles</quote> and
			 inserting <quote>, or services, used in the production of articles or in the
			 provision of services</quote>; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID4DEFA8A267A14C1FAB7F758FAB61B2C2"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>(or

								<subsection commented="no" display-inline="no-display-inline" id="ID66B6ADF79F144F438CD3245A36F4D9A8"><enum>(d)</enum><header>Basis for
				secretary’s determinations</header>
									<paragraph commented="no" display-inline="no-display-inline" id="IDA2AE86E54C054468B591FF181DB420B7"><enum>(1)</enum><header>Increased
				imports</header><text display-inline="yes-display-inline">For purposes of
				subsection (a)(2)(A)(ii), the Secretary may determine that increased imports of
				like or directly competitive articles or services exist if the workers’ firm or
				subdivision, or customers of the workers’ firm or subdivision accounting for
				not less than 20 percent of the sales of the workers’ firm or subdivision,
				certify to the Secretary that such customers are obtaining such articles or
				services from a foreign country.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID03F6399EC37C4A118A5D0F1453441EC6"><enum>(2)</enum><header>Obtaining
				services abroad</header><text display-inline="yes-display-inline">For purposes
				of subsection (a)(2)(B)(ii), the Secretary may determine that the workers’
				firm, subdivision, or public agency has obtained or is likely to obtain like or
				directly competitive services from a foreign country based on a certification
				thereof from the workers’ firm, subdivision, or public agency.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA6BB3849E7D449D2821D10865C02AC48"><enum>(3)</enum><header>Authority of
				the Secretary</header><text display-inline="yes-display-inline">The Secretary
				may obtain the certifications under paragraphs (1) and (2) through
				questionnaires or in such other manner as the Secretary determines is
				appropriate.</text>
									</paragraph></subsection><subsection id="HF43B341BEDF447AF8B94E28D00D8D9BA"><enum>(e)</enum><header>Additional
				information</header><text>In determining whether to certify a group of workers
				under subsection (a) or (b) pursuant to a petition filed under section 221, the
				Secretary should confirm information furnished in the petition and elicit other
				relevant information by contacting—</text>
									<paragraph id="idD07365BE980343B980380FD5D6B95D76"><enum>(1)</enum><text>officials of
				firms and unions;</text>
									</paragraph><paragraph id="id5444B96882F7466BB6BD0790DCFA659D"><enum>(2)</enum><text>employees and any
				other persons;</text>
									</paragraph><paragraph id="id61FF60A1483A49C1A632740BF7C17921"><enum>(3)</enum><text>Federal and State
				agencies; and</text>
									</paragraph><paragraph id="id1D1908A191E446ED8171DD564CF34B4E"><enum>(4)</enum><text>public and
				private
				organizations.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBAB062DA7B6244808680B281EC4BAD5E"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="TA74/247">Section 247</external-xref> of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319</external-xref>) is
			 amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDCA53655A261A480CB8F6CFC59B48EDE1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDBA038DB5E5F64ED38CDF138ADC5DCD59"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or public

				services, including methods to identify increased imports due to the relocation
				of United States firms to foreign countries, and increased imports due to
				United States firms obtaining services from firms in foreign

					</paragraph></section><section commented="no" display-inline="no-display-inline" id="idCFB9ACADDDF44156BD9346424E0E3B1E" section-type="subsequent-section"><enum>103.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this subtitle shall take effect on the date that is 90 days after the date of
			 the enactment of this Act.</text>

			 determination</header><text display-inline="no-display-inline">Section 223 of
			 the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>) is
			 amended by adding at the end the following:</text>

				180-day period on behalf of groups of workers in a domestic industry or
				occupation, the Secretary shall—</text>

				determination, under subsection (a), of the eligibility of all adversely
				affected workers in that domestic industry or occupation; or</text>
								</subparagraph><subparagraph id="H1DD13FF43C144579A973BF4C4F517B9"><enum>(B)</enum><text>make a
				determination, under subsection (a), of the eligibility of all adversely
				affected workers in that domestic industry or occupation who are located in one
				or more States or regions of the United States.</text>
								</subparagraph></paragraph><paragraph id="H4E502B2C333D4F8BA4C782172D1C40AD"><enum>(2)</enum><header>Publication</header><text>Upon
				making a determination of the eligibility for adjustment assistance under this
				chapter of a group of workers or all workers in an industry or occupation under
				paragraph (1), the Secretary shall—</text>
								<subparagraph id="H1F241EBDA3AD40B7875026CB972D32AF"><enum>(A)</enum><text>notify each State
				in which the workers are located of the determination; and</text>
								</subparagraph><subparagraph id="H46629CAB42F3438F832BD7B9FBFC0530"><enum>(B)</enum><text>promptly publish a

				</section><section commented="no" display-inline="no-display-inline" id="id6B95F67B73064214AE485FD0029C56EA" section-type="subsequent-section"><enum>114.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary of Labor may promulgate such
			 regulations as may be necessary to carry out the amendments made by this
			 subtitle.</text>
				</section></subtitle><subtitle id="id35C955C72CD3473EAD0DCEE0F962E7AB"><enum>C</enum><header>Training</header>
				<section id="id2808ECFD7195401BB6D1F1D43D3C424A"><enum>121.</enum><header>Prerequisite
			 education; approved training programs</header>
					<subsection id="idA049F0538C0F452D879B5C7D3564747E"><enum>(a)</enum><header>In
			 general</header><text>Section 236(a)(5) of the Trade Act of 1974 (19 U.S.C.
			 2296(a)(5)) is amended—</text>
						<paragraph id="id48A4973705F24465B87DCEA547AC079E"><enum>(1)</enum><text>by redesignating
			 subparagraphs (E) and (F) as subparagraphs (F) and (G), respectively;</text>
						</paragraph><paragraph id="id69D0BAD65C2541A0AE61B804C74CBE27"><enum>(2)</enum><text>by inserting
			 after subparagraph (D) the following:</text>
							<quoted-block display-inline="no-display-inline" id="idDB405A5AD8FD4E9CBF55029C8D6AF3C2" style="OLC">
								<subparagraph commented="no" id="id5C681B463625484387BD4AF521B641B3" indent="up1"><enum>(E)</enum><text>any program of prerequisite education
				or coursework required to enroll in training that may be approved under this
				section,</text>

						</paragraph><paragraph id="id5D1BF26619E94464BE8374B02247C9A2"><enum>(3)</enum><text>in subparagraph
			 (F)(ii), as redesignated by paragraph (1), by striking <quote>and</quote> at
			 the end;</text>
						</paragraph><paragraph id="id3BFB035CA27F4000B08B1EBDE429EA32"><enum>(4)</enum><text>in subparagraph
			 (G), as redesignated by paragraph (1), by striking the period at the end and

				reemployment upon completion of the training program or coursework, including a
				training program or coursework for the purpose of—</text>
									<clause commented="no" id="id0B4EC5BE90524230A01E236F1A96272B"><enum>(i)</enum><text>obtaining a degree or
				certification; or</text>
									</clause><clause commented="no" id="id309E675D75434C9D8F38F0C5F7ECB4C9"><enum>(ii)</enum><text>completing a degree or
				certification that the worker had previously begun at an accredited institution
				of higher
				education.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="id116B5DD01EE14B749D9C0A68D4791757"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 233 of the Trade Act of 1974 (19 U.S.C. 2293)
			 is amended—</text>
						<paragraph id="idCA4706DAC63543B1A8EEE40CC57B0962"><enum>(1)</enum><text>in subsection
			 (a)(2), by inserting <quote>prerequisite education or</quote> after
			 <quote>requires a program of</quote>; and</text>
						</paragraph><paragraph id="id2CDC3BAEB17446498FEC8226020D68BB"><enum>(2)</enum><text>in subsection
			 (g), by inserting <quote>prerequisite education or</quote> after
			 <quote>includes a program of</quote>.</text>
						</paragraph></subsection></section><section id="idD3FCC01C19AA4B7D9D845E94C8A6DFB9"><enum>122.</enum><header>Enrollment
			 period; waivers</header>
					<subsection commented="no" id="idAFE16B9BD3464FA996BAE985A573F8A3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 231 of the
			 Trade Act of 1974 (19 U.S.C. 2291) is amended—</text>

			 (a)(5)(A)(ii)—</text>

				an institution of higher education (as defined in section 101(a) of the Higher
				Education Act of 1965) and there is a reasonable expectation of
				reemployment.</text>
								</subparagraph><subparagraph commented="no" id="id72D844D51A68483DB2F74AA487DDFF57"><enum>(H)</enum><header>Administrative
				error</header><text>The worker did not enroll in training before the date
				described in subsection (a)(5) as a result of an administrative error made by a
				State.</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" id="id66214C11F57F45299C32EB2B89EA5A71"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 233(b) of the Trade Act of 1974 (19 U.S.C.
			 2293(b)) is amended by striking <quote>within 210 days after the date of the
			 worker's first certification</quote> and all that follows through the end
			 period and inserting <quote>in accordance with section
			 231(a)(5).</quote>.</text>
					</subsection></section><section id="idFAD3078FF32E475CB992A62162A5AC76"><enum>123.</enum><header>Temporary
			 employment and on-the-job training accountability</header><text display-inline="no-display-inline">Section 236(d) of the Trade Act of 1974 (19
			 U.S.C. 2296(d)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idDB13F34546B24BF78CFFEBC554C793E3" style="OLC">
						<subsection id="idE0F6701AA758495C86AFD69949953B0C"><enum>(d)</enum><header>Eligibility</header>
							<paragraph id="idB0ECE26BBC764CF781C247A99F12AF12"><enum>(1)</enum><header>In
				general</header><text>A worker may not be determined to be ineligible or
				disqualified for unemployment insurance or benefits under this
				subchapter—</text>
								<subparagraph id="idDB61E998CE694584876D3B9A1BD2D29E"><enum>(A)</enum><text>because the
				worker—</text>
									<clause id="id92A2943E2F7247A49D692B1B752C473C"><enum>(i)</enum><text>is in training
				approved under subsection (a);</text>
									</clause><clause id="idAC06A3686D234714A3BF6E2A9F775F10"><enum>(ii)</enum><text>left work that
				was not suitable employment to enter such training;</text>
									</clause><clause id="id79A10D3270D8465DBA1EEB8FC61092C0"><enum>(iii)</enum><text>left work that
				the worker engaged in on a temporary basis during a break in such training or a
				delay in the commencement of such training;</text>
									</clause><clause id="id77F769C2A7FD42DA8A1B58A3CA63D59B"><enum>(iv)</enum><text>left or refused
				on-the-job training that was not suitable on-the-job training; or</text>
									</clause><clause id="idF81F374F3508452B991F8AE12DCDB178"><enum>(v)</enum><text>refused
				on-the-job training to attend a classroom training course approved under
				subsection (a); or</text>
									</clause></subparagraph><subparagraph id="id36104A40BE3945BD9FDF772F7EC1A59F"><enum>(B)</enum><text>because the
				provisions of State law or Federal unemployment insurance law relating to
				availability for work, active search for work, or refusal to accept work apply
				to a week of training approved under subsection (a).</text>
								</subparagraph></paragraph><paragraph commented="no" id="id4007FF7DD6B549A2901B325F09056B9F"><enum>(2)</enum><header>Election of
				trade readjustment allowance over unemployment insurance</header><text>A worker
				may elect to receive benefits under this subchapter instead of receiving
				unemployment insurance if—</text>
								<subparagraph commented="no" id="id4CBE34477DD34C0AB8F17C7A3F1887DD"><enum>(A)</enum><text>the worker leaves
				work that the worker engaged in on a temporary basis during a break in
				training, as described in paragraph (1)(A)(iii);</text>
								</subparagraph><subparagraph commented="no" id="idBD2E54460F444DC583D0FCDDBEE83B10"><enum>(B)</enum><text>the worker is
				eligible for benefits under this subchapter for which the worker was eligible
				before engaging in such work; and</text>
								</subparagraph><subparagraph commented="no" id="id8E025901AF204983AEA0000C229C0B04"><enum>(C)</enum><text>the worker is
				eligible for unemployment insurance based on leaving such work.</text>
								</subparagraph></paragraph><paragraph id="id6247D2EB4255462485DE20D751AFF1BD"><enum>(3)</enum><header>Suitable
				on-the-job training</header><text>For purposes of this subsection, the term
				<term>suitable on-the-job training</term> means on-the-job training—</text>
								<subparagraph id="id1080980394264DA08DEDA0026EE7B561"><enum>(A)</enum><text>that can
				reasonably be expected to lead to suitable employment;</text>
								</subparagraph><subparagraph id="idA978578E740F4570A2458A91A8CAFBE1"><enum>(B)</enum><text>that is
				compatible with the skills of the worker;</text>
								</subparagraph><subparagraph id="idB0E64F0A865240608495E719D0F773EC"><enum>(C)</enum><text>that—</text>
									<clause commented="no" id="id4C05D165843B4FC89048FAD7C0B87427"><enum>(i)</enum><text>involves a
				curriculum through which the worker learns the skills necessary for the job for
				which the worker is being trained; and</text>
									</clause><clause commented="no" id="id895AC08CF7234BA3872FAC8A5B38B979"><enum>(ii)</enum><text>can be measured
				by benchmarks that indicate that the worker is learning such skills; and</text>
									</clause></subparagraph><subparagraph id="id378E0717BAD341AEA0196F5CB365CC80"><enum>(D)</enum><text>that is certified
				by the State as an on-the-job training program that meets the requirements of
				subparagraph
				(C).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="idD611433BF9E14BD7A9B1720CD9C0CD11"><enum>124.</enum><header>Training
			 funds</header><text display-inline="no-display-inline">Section 236(a)(2) of the
			 Trade Act of 1974 (19 U.S.C. 2296(a)(2)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id027A95866B4D444494C6D7548EE97D2E" style="OLC">
						<paragraph id="id9566FE7C1C3643BD9F0F1919CF8BB62B"><enum>(2)</enum><header>Total payments;
				allocation of payments</header>
							<subparagraph id="idC626A49769F24C179F75B84905A35B2D"><enum>(A)</enum><header>Total payments
				for fiscal year 2008 and succeeding fiscal years</header>
								<clause id="id1650FC341E454D9881FECEE10613DB8C"><enum>(i)</enum><header>Fiscal year
				2008</header><text>The total amount of payments that may be made under
				paragraph (1) for fiscal year 2008 shall not exceed $440,000,000.</text>
								</clause><clause id="id1B9224CD21B34F498A85B1F53C753E5D"><enum>(ii)</enum><header>Fiscal year
				2009 and succeeding fiscal years</header><text>The following shall apply to
				fiscal year 2009 and each fiscal year thereafter:</text>
									<subclause id="id77301960732C417FAB992F893A086331"><enum>(I)</enum><header>In
				general</header><text>The amount of the total payments that may be made for a
				fiscal year shall be 110 percent of the total payments authorized to be made
				for the preceding fiscal year, if during the preceding fiscal year the total
				amount obligated or expended by States was equivalent to 90 percent or more of
				the total payments authorized to be made for such preceding fiscal year.</text>
									</subclause><subclause id="id92EC1434C7994F649C5D0EE43706530A"><enum>(II)</enum><header>Exception</header><text>The
				amount of the total payments that may be made for a fiscal year shall be 100
				percent of the total payments authorized to be made for the preceding fiscal
				year, if during the preceding fiscal year the total amount obligated or
				expended by States was equivalent to less than 90 percent of the total payments
				authorized to be made for such preceding fiscal year.</text>
									</subclause></clause></subparagraph><subparagraph id="id1F9451DAD2C7409CA981057A9A6D6DA1"><enum>(B)</enum><header>Allocation of
				total payments</header>
								<clause commented="no" id="id1D28C43E51974805ABD5014B586330AF"><enum>(i)</enum><header>Plan and
				rulemaking</header>
									<subclause commented="no" id="id943B2BEADF604C28B5FE6864CB736514"><enum>(I)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				the enactment of the <short-title>Trade and Globalization
				Adjustment Assistance Act of 2007</short-title>, the Secretary shall submit to
				Congress a plan—</text>
										<item commented="no" id="id2262E197FD5D4B3EAD542690280D4446"><enum>(aa)</enum><text display-inline="yes-display-inline">for allocating and disbursing payments
				among States in a manner that takes into account—</text>
											<subitem commented="no" id="idD424CDA2D299462D8F3190709C739699"><enum>(AA)</enum><text display-inline="yes-display-inline">historic trends in the number of workers
				covered by certifications under this chapter in each State, including the most
				recent 6-month period for which data are available;</text>
											</subitem><subitem commented="no" id="id2F15D79C66424FF9BBEF2855398F2E69"><enum>(BB)</enum><text>historic trends
				in the number of workers enrolled in training under this section in each State,
				including the most recent 6-month period for which data are available;</text>
											</subitem><subitem commented="no" id="idEE35DA68FABB4363B8D5228B78707B66"><enum>(CC)</enum><text>the obligations
				of States to make payments with respect to training under this section for
				workers in the following fiscal year; and</text>
											</subitem><subitem commented="no" id="idDC160D8453434B7A9E4A30519483FA69"><enum>(DD)</enum><text>the ability of
				States to respond to unanticipated demands for training under this section;
				and</text>
											</subitem></item><item commented="no" id="id38962B03757E450FB603B777BF5267E0"><enum>(bb)</enum><text>for ensuring
				that States collect and report accurate information on the trends, obligations,
				and demands described in subclause (I).</text>
										</item></subclause><subclause commented="no" id="idED4E75B64C284D688AD748A1C92EAC23"><enum>(II)</enum><header>Rulemaking</header>
										<item commented="no" id="idE309B60E7EFA4355AB64D281C7CE8E54"><enum>(aa)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				prescribe regulations, pursuant to section 553 of title 5, United States Code,
				to carry out the plan required by subclause (I).</text>
										</item><item commented="no" id="id71D23D8B621B4828B327297F2ED4E985"><enum>(bb)</enum><header>Timing of
				rulemaking</header><text display-inline="yes-display-inline">The Secretary
				shall issue the notice of proposed rulemaking with respect to the regulations
				required by item (aa) not earlier than the date that is 90 days after the date
				on which the Secretary submits the plan under subclause (I).</text>
										</item></subclause></clause><clause commented="no" id="id97ABBB2DA6CC4916A3C8ED325CD146D5"><enum>(ii)</enum><header>Distribution
				of remaining funds</header><text display-inline="yes-display-inline">If, in any
				fiscal year, the Secretary does not distribute all of the funds authorized for
				payments under subparagraph (A), the Secretary shall distribute the remaining
				funds in a manner to be determined by the Secretary—</text>
									<subclause commented="no" id="idB2E34ED1E20547CBAC7EE32F651E0744"><enum>(I)</enum><text display-inline="yes-display-inline">to any State that requests the distribution
				of such funds and has—</text>
										<item commented="no" id="id3080D6B2E67D4AF0A135AB26940C422C"><enum>(aa)</enum><text display-inline="yes-display-inline">expended more than 50 percent of the funds
				already distributed; or</text>
										</item><item commented="no" id="id9271205DF28A4455AE8907BC3D357572"><enum>(bb)</enum><text display-inline="yes-display-inline">obligated more than 75 percent of the funds
				already distributed; and</text>
										</item></subclause><subclause commented="no" id="idE2955D40C65E496E85C79A5D781F8140"><enum>(II)</enum><text display-inline="yes-display-inline">to any State that the Secretary determines
				needs additional funds.</text>
									</subclause></clause><clause id="idA3284E7DDB5040CE9E1E0C9A43CB797B"><enum>(iii)</enum><header>Allocation of
				payments if costs estimated to exceed total payments</header><text>If, during a
				fiscal year, the Secretary estimates that the amount of funds necessary to pay
				the costs of training approved under this section will exceed the amount of
				limitations imposed under subparagraph (A), the Secretary shall decide how the
				portion of such limitations that has not been expended at the time of such
				estimate is to be apportioned among the States for the remainder of such fiscal
				year.</text>
								</clause></subparagraph><subparagraph commented="no" id="id14BE46329CDC449C8B0308C7E90F099E"><enum>(C)</enum><header>Use of training
				funds for caseworker services</header><text>Notwithstanding any other provision
				of law, a State may expend not more than 5 percent of the funds allocated to
				the State in a fiscal year for the costs of training approved under this
				section to provide services related to benefits under this chapter.</text>
							</subparagraph><subparagraph id="idF8E1602C9086488AB3CF96BFF1A3E156"><enum>(D)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				the enactment of the <short-title>Trade and Globalization
				Adjustment Assistance Act of 2007</short-title>, and every 90 days thereafter,
				the Secretary shall submit to the Committee on Finance of the Senate and the
				Committee on Ways and Means of the House of Representatives a report on—</text>
								<clause id="id839D19A8A29A42C085924185F6F798C8"><enum>(i)</enum><text display-inline="yes-display-inline">the allocation among States of funds for
				training approved under section 236;</text>
								</clause><clause commented="no" id="id38B86A8F8A11408E8B3F1CF06C0A37EF"><enum>(ii)</enum><text>the amount of
				funds obligated or expended to provide training under subsection (a), including
				obligations accrued for the following fiscal year, during the preceding quarter
				and cumulatively during the fiscal year;</text>
								</clause><clause id="idA12ED1B2B8E94DBD88009B55EFB99352"><enum>(iii)</enum><text display-inline="yes-display-inline">the demand for such funds anticipated for
				any remaining quarters in the fiscal year; and</text>
								</clause><clause id="id8A714D96CB644C21A326B0C0C7D57321"><enum>(iv)</enum><text display-inline="yes-display-inline">the efforts of the Department of Labor to
				ensure that each State receives funds sufficient to provide training approved
				under section 236 to all eligible
				workers.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.

			 premiums paid prior to certification of eligibility for credit</header>

			 premiums due prior to certification of eligibility for the credit</header><text display-inline="yes-display-inline">Section 7527 of the Internal Revenue Code
			 of 1986 (relating to advance payment of credit for health insurance costs of
			 eligible individuals) is amended by adding at the end the following new
			 subsection:</text>
						<quoted-block display-inline="no-display-inline" id="IDDE3CDD29CF1D42A894A14D88E259C0C4" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="IDFF5646F70F0C4CF6AA6972F99980476E"><enum>(e)</enum><header>Payment for
				premiums due prior to issuance of certificate</header><text display-inline="yes-display-inline">The program established under subsection
				(a) shall provide that the Secretary shall make 1 or more retroactive payments
				on behalf of a certified individual in an aggregate amount equal to 85 percent
				of the premiums for coverage of the taxpayer and qualifying family members
				under qualified health insurance for eligible coverage months (as defined in
				section 35(b)) occurring prior to the issuance of a qualified health insurance
				costs credit eligibility
				certificate.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1E8356A3760F446CA1935698190FDEE6"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to months beginning after the date of the enactment of
			 this Act in taxable years ending after such date.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="ID08F22C75DE654D5C840A5560E7C078EB" section-type="subsequent-section"><enum>134.</enum><header>TAA recipients not
			 enrolled in training programs eligible for credit</header>
					<subsection commented="no" display-inline="no-display-inline" id="id9C93346413AB4B888F6B6E35C6132690"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (2) of section 35(c) of the Internal Revenue

			 section 35 of the Internal Revenue Code of 1986 is amended by redesignating
			 paragraph (9) as paragraph (10) and inserting after paragraph (8) the following

				amount of the credit under this section with respect to any qualifying family
				member of such individual.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBE4788A0A1F4402AAF0599F5F06CC7F7"><enum>(B)</enum><header>Divorce</header><text display-inline="yes-display-inline">In the case of a month which would be an
				eligible coverage month with respect to a former spouse of a taxpayer but for
				the finalization of a divorce between the spouse and the taxpayer that occurs
				during the period in which the taxpayer is an eligible individual, such month
				shall be treated as an eligible coverage month with respect to such former
				spouse.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA8D95F82E13947AAB02C85212970DB85"><enum>(C)</enum><header>Death</header><text display-inline="yes-display-inline">In the case of a month which occurs after
				the death of an eligible individual and which would be an eligible coverage
				month with respect to such eligible individual if the individual had survived
				and met any applicable eligibility requirements for the maximum permissible
				period, such month shall be treated as an eligible coverage month with respect
				to the spouse of such eligible
				individual.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDDA3AD413136A4270B24FA73FCE605FE1"><enum>(b)</enum><header>Conforming

				provided to employees by an employer who normally employs between 2 and 50

					</subsection></section><section commented="no" display-inline="no-display-inline" id="IDEC2539B1B0E24E0AB0F93B6FA9DA4275" section-type="subsequent-section"><enum>140.</enum><header>Notice
			 requirements</header><text display-inline="no-display-inline">Section 7527 of
			 the Internal Revenue Code of 1986 (relating to advance payment of credit for
			 health insurance costs of eligible individuals), as amended by this Act, is
			 amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="IDFCDED83428E74D8691CBCBF8A49F1C74" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID5530D67478664C99A6AEFAC52044A4F9"><enum>(f)</enum><header>Inclusion of
				certain information</header><text display-inline="yes-display-inline">The
				notice by the Secretary (or by any person or entity designated by the
				Secretary) that an individual is eligible for a qualified health insurance
				costs credit eligibility certificate shall include—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID155D2A268A9A4455AA47DFDB5C15F941"><enum>(1)</enum><text display-inline="yes-display-inline">the name, address, and telephone number of
				the State office or offices responsible for determining that the individual is
				eligible for such certificate and for providing the individual with assistance
				with enrollment in qualified health insurance (as defined in section
				35(e)),</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID664267D1564743E2B6595EB133EC6D9C"><enum>(2)</enum><text display-inline="yes-display-inline">a list of the coverage options that are
				treated as qualified health insurance (as so defined) by the State in which the
				individual resides, and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF0608551CA934A59BBED225BC0D6C7FB"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of a TAA-eligible individual
				(as defined in section 4980B(f)(5)(C)(iv)(II)), a statement informing the
				individual that the individual has 63 days from the date that is 5 days after
				the date of such notice to enroll in such insurance without a lapse in
				creditable coverage (as defined in section
				9801(c)).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section commented="no" display-inline="no-display-inline" id="IDEF4CE4AE4CFF462FB300D379212AF1F1" section-type="subsequent-section"><enum>141.</enum><header>Annual report on
			 enhanced TAA benefits</header><text display-inline="no-display-inline">Not
			 later than October 1 of each year (beginning in 2007) the Secretary of the
			 Treasury, after consultation with the Secretary of Labor, shall report to the
			 Committee on Finance and the Committee on Health, Education, Labor, and
			 Pensions of the Senate and the Committee on Ways and Means and the Committee on
			 Education and Labor of the House of Representatives the following information
			 with respect to the most recent taxable year ending before such date:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDA27B7A1E8A55472884AD14AA53898FFD"><enum>(1)</enum><text display-inline="yes-display-inline">The total number of participants utilizing
			 the health insurance tax credit under section 35 of the Internal Revenue Code
			 of 1986, including a measurement of such participants identified—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDEA495722AEFC4C478EC71CCF3F1ABFEB"><enum>(A)</enum><text display-inline="yes-display-inline">by State, and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE7D94D4A0153464692D1AB9142E72370"><enum>(B)</enum><text display-inline="yes-display-inline">by coverage under COBRA continuation
			 provisions (as defined in section 9832(d)(1) of such Code) and by non-COBRA
			 coverage (further identified by group and individual market).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID056D5ABA37CF41F68885EEFA8951C0F5"><enum>(2)</enum><text display-inline="yes-display-inline">The range of monthly health insurance
			 premiums offered and the average and median monthly health insurance premiums
			 offered to TAA-eligible individuals (as defined in section
			 4980B(f)(5)(C)(iv)(II) of such Code) under COBRA continuation provisions (as
			 defined in section 9832(d)(1) of such Code), State-based continuation coverage
			 provided under a State law that requires such coverage, and each category of
			 coverage described in section 35(e)(1) of such Code, identified by State and by
			 the actuarial value of such coverage and the specific benefits provided and
			 cost-sharing imposed under such coverage.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD5A3510896EE43A9B574A1116F7941CB"><enum>(3)</enum><text display-inline="yes-display-inline">The number of States applying for and
			 receiving national emergency grants under section 173(f) of the Workforce
			 Investment Act of 1998 (29 U.S.C. 2918(f)) and the time necessary for
			 application approval of such grants.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA6A995DEA26344809FCCA8741C30A037"><enum>(4)</enum><text display-inline="yes-display-inline">The cost of administering the health credit
			 program under section 35 of such Code, by function, including the cost of
			 subcontractors.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID4DE435A2300747D7820E01A19EE9630C" section-type="subsequent-section"><enum>142.</enum><header>Extension of
			 national emergency grants</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID6F9C04E6D7AC4C69B336B11C24F0D1FF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 173(f) of the
			 Workforce Investment Act of 1998 (29 U.S.C. 2918(f)), as amended by this Act,
			 is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDB557CD290F804671B78091F1512AB0AC"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the
			 following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="ID5345B6A6C9EE40B7BBB3C7C5D15F8D00" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="IDCAFE3D19F30441F982BACD456F25DA1C"><enum>(1)</enum><header>Use of
				funds</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID0D760B4D8CAF4C50AD3FB2BCD04CCFBA"><enum>(A)</enum><header>Health
				insurance coverage for eligible individuals in order to obtain qualified health
				insurance that has guaranteed issue and other consumer
				protections</header><text display-inline="yes-display-inline">Funds made
				available to a State or entity under paragraph (4)(A) of subsection (a) shall
				be used to provide an eligible individual described in paragraph (4)(C) and
				such individual’s qualifying family members with health insurance coverage for
				the 3-month period that immediately precedes the first eligible coverage month
				(as defined in section 35(b) of the Internal Revenue Code of 1986) in which
				such eligible individual and such individual’s qualifying family members are
				covered by qualified health insurance that meets the requirements described in
				clauses (i) through (v) of section 35(e)(2)(A) of the Internal Revenue Code of
				1986 (or such longer minimum period as is necessary in order for such eligible
				individual and such individual’s qualifying family members to be covered by
				qualified health insurance that meets such requirements).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC974E22605664157B3D45F77A6140EA7"><enum>(B)</enum><header>Additional
				uses</header><text display-inline="yes-display-inline">Funds made available to
				a State or entity under paragraph (4)(A) of subsection (a) may be used by the
				State or entity for the following:</text>
										<clause commented="no" display-inline="no-display-inline" id="ID8360041BC84241DB82240D5A78B0C145"><enum>(i)</enum><header>Health
				insurance coverage</header><text display-inline="yes-display-inline">To assist
				an eligible individual and such individual’s qualifying family members with
				enrolling in health insurance coverage and qualified health insurance or paying
				premiums for such coverage or insurance.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDC6F6C39D491848F69AC2E621470ECFC8"><enum>(ii)</enum><header>Administrative
				expenses and start-up expenses to establish group health plan coverage options
				for qualified health insurance</header><text display-inline="yes-display-inline">To pay the administrative expenses related
				to the enrollment of eligible individuals and such individuals’ qualifying
				family members in health insurance coverage and qualified health insurance,
				including—</text>
											<subclause commented="no" display-inline="no-display-inline" id="ID7806453A2887498986502935E8E130D7"><enum>(I)</enum><text display-inline="yes-display-inline">eligibility verification activities;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID085F6D248C0042468CB7816D4029D2C2"><enum>(II)</enum><text display-inline="yes-display-inline">the notification of eligible individuals of
				available health insurance and qualified health insurance options;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID250CC8CA5E2A443BB56072720A599149"><enum>(III)</enum><text display-inline="yes-display-inline">processing qualified health insurance costs
				credit eligibility certificates provided for under section 7527 of the Internal
				Revenue Code of 1986;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID814D9687213E46DB9B8FF2C290D6648B"><enum>(IV)</enum><text display-inline="yes-display-inline">providing assistance to eligible
				individuals in enrolling in health insurance coverage and qualified health
				insurance;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4E656C958D1C45199EDDF64C092E5B91"><enum>(V)</enum><text display-inline="yes-display-inline">the development or installation of
				necessary data management systems; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7A17F59CC03145CF9E9DD46ECA80607E"><enum>(VI)</enum><text display-inline="yes-display-inline">any other expenses determined appropriate
				by the Secretary, including start-up costs and on going administrative
				expenses, in order for the State to treat the coverage described in
				subparagraphs (C) through (H) of section 35(e)(1) of the Internal Revenue Code
				of 1986 as qualified health insurance under that section.</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDA5B1A81908E0469B979BF8ADEA619A79"><enum>(iii)</enum><header>Outreach</header><text display-inline="yes-display-inline">To pay for outreach to eligible individuals
				to inform such individuals of available health insurance and qualified health
				insurance options, including outreach consisting of notice to eligible
				individuals of such options made available after the date of enactment of this
				clause and direct assistance to help potentially eligible individuals and such
				individual’s qualifying family members qualify and remain eligible for the
				credit established under section 35 of the Internal Revenue Code of 1986 and
				advance payment of such credit under section 7527 of such Code.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDD62F1CE8AEAD4515939AA014C2DF1C98"><enum>(iv)</enum><header>Bridge
				funding</header><text display-inline="yes-display-inline">To assist potentially
				eligible individuals purchase qualified health insurance coverage prior to
				issuance of a qualified health insurance costs credit eligibility certificate
				under section 7527 of the Internal Revenue Code of 1986 and commencement of
				advance payment, and receipt of expedited payment, under subsections (a) and
				(e), respectively, of that section.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD08129EBE7424DDDB524C81CFFB6AF81"><enum>(C)</enum><header>Rule of
				construction</header><text display-inline="yes-display-inline">The inclusion of
				a permitted use under this paragraph shall not be construed as prohibiting a
				similar use of funds permitted under subsection
				(g).</text>
									</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC53E06BB638C480B95C8B91D91778A82"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the

										<subparagraph id="ID0842B27E70BE4A3097494D50458B3DA2"><enum>(A)</enum><text>is at least 40
				years of age;</text>
										</subparagraph><subparagraph id="ID01821BAA566E4662B10C384D88A18CD8"><enum>(B)</enum><text>does not earn
				more than $60,000 a year in wages from reemployment; and</text>
										</subparagraph><subparagraph id="ID56142EA1CA7D4898BF12AF1E98CDE493"><enum>(C)</enum><text>does not return
				to the employment from which the worker was separated and—</text>
											<clause id="id3EC94A70C8DD48B1B0D069181A3C42BA"><enum>(i)</enum><text>obtains
				reemployment on a full-time basis as defined by State law in the State in which
				the worker is employed;</text>
											</clause><clause id="id6E46BDFC6F4D49FAB877C3E34AD679B7"><enum>(ii)</enum><text>obtains
				reemployment of not less than 20 hours a week and is enrolled in training
				approved under section 236; or</text>
											</clause><clause id="id45E8BC1ABE7F4F6BADF6D0DEF408137E"><enum>(iii)</enum><text>received a
				trade readjustment allowance under part I of subchapter B for less than the
				total number of weeks for which the worker was eligible to receive such
				allowance under section 233 and obtains reemployment not later than 26 weeks
				after successfully completing a training program approved under section
				236.</text>
											</clause></subparagraph></paragraph><paragraph commented="no" id="id18CF4D0306B34DCFBD1D78392BEEA81F"><enum>(4)</enum><header>Eligibility
				period</header>
										<subparagraph commented="no" id="id39D2B04229DB4101A80FF77822783C4F"><enum>(A)</enum><header>Worker who has
				not received trade adjustment allowance</header><text>In the case of a worker
				described in paragraph (3) who has not received a trade readjustment allowance
				under part I of subchapter B, the worker may receive wage insurance under this
				section for a period not to exceed 2 years from the date that is the earlier
				of—</text>
											<clause commented="no" id="id16CD7F9D3E9F431CA320647AECD08690"><enum>(i)</enum><text>the date on which
				the worker exhausts all rights to unemployment insurance based on the
				separation of the worker from adversely affected employment; or</text>
											</clause><clause commented="no" id="id9EEF637759794B8E8D404024FEE008A2"><enum>(ii)</enum><text>the date on
				which the worker obtains reemployment.</text>
											</clause></subparagraph><subparagraph commented="no" id="id85926BEF771A4006AF37DF3E0A046BBE"><enum>(B)</enum><header>Worker who has
				received trade adjustment allowance</header><text>In the case of a worker
				described in paragraph (3) who received a trade readjustment allowance under
				part I of subchapter B, the worker may receive wage insurance under this
				section for a period—</text>
											<clause commented="no" id="id6CF9C1319DDE4778813967AD66E1240F"><enum>(i)</enum><text>beginning on the
				date on which the worker obtains reemployment; and</text>
											</clause><clause commented="no" id="id1E46C378D8BF478EB507B4D62B281F9D"><enum>(ii)</enum><text>not to
				exceed—</text>
												<subclause commented="no" id="id255D2FFCD6AE4E09AEAEE38827A7AE80"><enum>(I)</enum><text>the total number
				of weeks for which the worker is eligible for such allowance, less</text>
												</subclause><subclause commented="no" id="id5DD04B7D66034FD1AA6EB7CE1C82037E"><enum>(II)</enum><text>the total number
				of weeks for which the worker received such allowance.</text>
												</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="idBB0487D2E20442EA861DCCE99BE62AC2"><enum>(5)</enum><header>Total amount of
				payments</header><text>The payments described in paragraph (2)(A) made to a
				worker may not exceed $12,000 per worker during the eligibility period under
				paragraph (4).</text>

					<paragraph id="idEAACB0D880C942799CF3F62713F0EFF5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f), by striking
			 <quote>30</quote> and inserting <quote>90</quote>; and</text>
					</paragraph><paragraph id="idA92C4C90D3D54E5C9AA01EC9C48402BB"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="IDC4520C2E2DAB4A358BF0B014279EA829" style="OLC">
							<subsection id="ID0BEAC44D1F394CA7820E4C68086791C6"><enum>(h)</enum><header>Extension of
				allowance</header><text>Notwithstanding any other provision of this section, a
				trade readjustment allowance may be paid to a worker for a period equivalent to
				the period the worker’s enrollment in training was extended beyond the deadline
				applicable under section 231(a)(5)(A)(ii) pursuant to a waiver granted under
				subparagraph (D), (E), or (F) of section 231(c)(1).</text>
							</subsection><subsection id="IDE76681C59F7D46AF8FC4FF565A87066B"><enum>(i)</enum><header>Special rule
				for calculating separation</header><text>Notwithstanding any other provision of
				this chapter, any period during which a judicial or administrative appeal is
				pending with respect to the denial by the Secretary of a petition under section
				223 shall not be counted for purposes of calculating the period of separation
				under subsection (a)(2) and an adversely affected worker that would otherwise
				be entitled to a trade readjustment allowance shall not be denied such
				allowance because of such appeal.</text>
							</subsection><subsection id="id8251FEB3D751456ABA760FBDE565997C"><enum>(j)</enum><header>Special rule
				for active duty military service</header>
								<paragraph id="id0AE0CA7BFA764827874DAFF18BF500DC"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of this section, an
				adversely affected worker described in paragraph (2) shall be eligible for a
				trade readjustment allowance and other benefits under this subchapter in the
				same manner and to the same extent as if a petition that resulted in a
				certification under section 223 for that worker was filed on the date described
				in paragraph (3).</text>
								</paragraph><paragraph id="id40D7264483C443FB88D4BEAD81456CF0"><enum>(2)</enum><header>Worker
				described</header><text>A worker described in this paragraph means a worker
				who—</text>
									<subparagraph id="id81C34246A56D48E2975758EF2891BD69"><enum>(A)</enum><text>is a member of a
				reserve component of the Armed Forces; and</text>
									</subparagraph><subparagraph id="id6F9B0D63E9AA48ABB0DB2A1797B67824"><enum>(B)</enum><text>serves on active
				duty—</text>
										<clause id="idB8120503CDB4405B84863ED14D63EF73"><enum>(i)</enum><text>after the date on
				which the worker became totally separated, or partially separated, from the
				adversely affected employment; and</text>
										</clause><clause id="idA2BC6F63070848348DB20941A8DBF4A5"><enum>(ii)</enum><text>before the
				worker completes training approved under section 236.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8F6442582C654D6FAE61A3064F6E7929"><enum>(3)</enum><header>Date
				described</header><text>The date described in this paragraph is a date that is
				on or before the 30th day after the worker returns from active duty or such
				later date as determined on a case-by-case basis by the
				Secretary.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="idF7EF3D901ABB475FA415A24156127354"><enum>162.</enum><header>Job search and
			 relocation allowances</header>
					<subsection id="id7F55077C126E44FEB717526A64CA2C51"><enum>(a)</enum><header>Job search
			 allowances</header><text>Section 237(b) of the Trade Act of 1974 (19 U.S.C.
			 2297(b)) is amended—</text>

			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>), as
			 amended by section 113, is further amended by adding at the end the
			 following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id5752FF38D3D4476AB1CA231E0C0EE6D7"><enum>(1)</enum><header>Certification</header><text display-inline="yes-display-inline">If an employer submits a petition on behalf
				of a group of workers pursuant to section 221(a)(1) or if the Secretary
				requests evidence or information from an employer in order to make a
				determination under this section, the accuracy and completeness of any evidence
				or information submitted by the employer shall be certified by the employer’s
				legal counsel or by an officer of the employer.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8747A459D1444D8BAD96B3EC4F226DFF"><enum>(2)</enum><header>Subpoenas</header><text display-inline="yes-display-inline">It is the sense of Congress that the
				Secretary should require an employer to provide evidence or information
				requested by the Secretary under paragraph (1) by subpoena pursuant to section
				249 if, within 20 days of such request, the employer does not—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idBAFCEC8A88184E1FA47F112AD01CF430"><enum>(A)</enum><text display-inline="yes-display-inline">provide such evidence or information;
				or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC789C0954EEF410BB024EDB5992EF65F"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrate to the satisfaction of the
				Secretary that the employer will provide such evidence or information within a
				reasonable time.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id865B9435A7EE49DC82BAACE324E66EFC"><enum>(g)</enum><header>Standards for
				investigations and determinations</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idA68CA6E68C5B4E74B1FEA4D797AB6B86"><enum>(1)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				the enactment of the <short-title>Trade and Globalization
				Adjustment Assistance Act of 2007</short-title>, the Secretary shall submit to
				Congress a plan for establishing standards, including data requirements, for
				investigations of petitions filed under section 221 and criteria for making
				determinations under subsection (a).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86E37C4D52DC4F21B0174245BF49B95D"><enum>(2)</enum><header>Rulemaking</header>
								<subparagraph commented="no" id="id7BBA691F059D4F169DE1F7D4638CCC7C"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				prescribe regulations, pursuant to section 553 of title 5, United States Code,
				to carry out the plan required by paragraph (1).</text>
								</subparagraph><subparagraph commented="no" id="id7A17F84CD31A4CDCB1E9BC6A3E03C76A"><enum>(B)</enum><header>Timing of
				rulemaking</header><text display-inline="yes-display-inline">The Secretary
				shall issue the notice of proposed rulemaking with respect to the regulations
				required by subparagraph (A) not earlier than the date that is 90 days after
				the date on which the Secretary submits the plan under paragraph
				(1).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="idA8C0E28534834D2087A01C60BF3EC37F"><enum>164.</enum><header>Establishment
			 of the Office of the Ombudsman for the Trade Adjustment Assistance
			 program</header>
					<subsection id="id65D021048E5B4B5686222AB09F5915E6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter A of
			 chapter 2 of title II of the Trade Act of 1974 (19 U.S.C. 2271 et seq.) is
			 amended by inserting after section 221 the following:</text>
						<quoted-block display-inline="no-display-inline" id="idC56C8F6A34C84D428272AEF8820728EE" style="OLC">
							<section id="idEA1149BB53AE4A46A5C7A2972D1CE9C1"><enum>221A.</enum><header>Establishment
				of the Office of the Trade Adjustment Assistance Ombudsman</header>
								<subsection id="IDbf43213e37fe4474971760a8e5143691"><enum>(a)</enum><header>Establishment</header><text>There
				is established in the Department of Labor an office to be known as the
				<quote>Office of the Trade Adjustment Assistance Ombudsman</quote> (in this
				section referred to as the <quote>Office</quote>).</text>
								</subsection><subsection id="ID025446da81de497face74352d4f7f05b"><enum>(b)</enum><header>Head</header><text>The
				head of the Office shall be the Ombudsman. The individual serving as Ombudsman
				shall be either of the following:</text>
									<paragraph id="ID7a3b3abb490f4604984bf6d94e74b58c"><enum>(1)</enum><text>An officer or
				employee of the Department of Labor designated by the Secretary from among
				officers and employees of the Department who have experience and expertise
				necessary to carry out the duties of the Office specified in subsection
				(c).</text>
									</paragraph><paragraph id="ID896e116a1de74f81929a57489e774dcd"><enum>(2)</enum><text>An individual
				employed by the Secretary from the private sector from among individuals in the
				private sector who have experience and expertise necessary to carry out the
				duties of the Office specified in subsection (c).</text>
									</paragraph></subsection><subsection id="ID442a58de0d854eaba5280f938e15d8e1"><enum>(c)</enum><header>Duties</header><text>The
				duties of the Office shall be as follows:</text>
									<paragraph id="IDc0ae157444744c25a9c48c0961306e73"><enum>(1)</enum><text>To provide
				information on—</text>
										<subparagraph id="id8D1D084A83764B71A6CACBFA6AABE3C0"><enum>(A)</enum><text>the benefits
				available under this chapter;</text>
										</subparagraph><subparagraph id="idF08D1435474B44BDBC7B033805DF3B0B"><enum>(B)</enum><text>the requirements
				and procedures applicable to the provision of such benefits; and</text>
										</subparagraph><subparagraph commented="no" id="id1F76B8EEFBBA432AB130901B0462FF51"><enum>(C)</enum><text>the tax credit
				for health insurance costs under section 35 of the Internal Revenue Code of
				1986.</text>
										</subparagraph></paragraph><paragraph id="IDef406952f1464bed9eba69070279849d"><enum>(2)</enum><text>To provide
				technical assistance to individuals, groups of workers, and other parties
				seeking to file petitions with the Secretary for benefits under section
				221.</text>
									</paragraph><paragraph id="id61B409CE9AA348AC87F7D240E0BB1DC2"><enum>(3)</enum><text>To provide
				assistance to employers to provide information required by the Secretary
				related to a pending petition.</text>
									</paragraph><paragraph commented="no" id="id3C7ED6EF905E41DE8A0404151AEA3B2C"><enum>(4)</enum><text>To receive
				complaints, grievances, and requests for assistance from workers seeking
				benefits under this chapter with respect to the administration of such
				benefits.</text>
									</paragraph><paragraph id="id3114B4A144D3449D8DBBAF1EBDBAEFD5"><enum>(5)</enum><text>To carry out such
				other duties with respect to this chapter as the Secretary shall specify for
				purposes of this section.</text>
									</paragraph></subsection><subsection id="IDd2cca6e9151c4b4fb47586c1b0eeffec"><enum>(d)</enum><header>Independent
				office</header><text>The Secretary shall take appropriate actions to ensure the
				independence of the Office within the Department of Labor, including
				independence from other officers and employees of the Department engaged in
				activities relating to the administration of the provisions of this
				chapter.</text>
								</subsection><subsection id="ID80914806e35848b8a89bfe81c082759a"><enum>(e)</enum><header>Annual
				report</header>
									<paragraph id="IDfeb6d89aee3147129155d0d304a68967"><enum>(1)</enum><header>In
				general</header><text>Not later than February 15 each year, the Ombudsman shall
				submit to Congress a report on the activities of the Office under this
				section.</text>
									</paragraph><paragraph id="ID2c543e3467c3442b8f589f6d470bf11e"><enum>(2)</enum><header>Contents</header><text>Each
				report under paragraph (1) shall set forth the following:</text>
										<subparagraph id="IDb3073e22128f4294805354598be89af9"><enum>(A)</enum><text>The number and
				types of complaints, grievances, and requests for assistance received by the
				Ombudsman under this chapter during the preceding year.</text>
										</subparagraph><subparagraph id="IDd5a4cefcc76f415cb163aa2f97b2aa39"><enum>(B)</enum><text>An assessment of
				the most common difficulties encountered by workers seeking benefits under this
				chapter during the preceding year.</text>
										</subparagraph></paragraph><paragraph id="ID739fcfa3fec248efaa546494eb30c812"><enum>(3)</enum><header>Initial
				report</header><text>The first report under paragraph (1) shall be the report
				submitted in 2008.</text>
									</paragraph></subsection><subsection id="IDa691e615e1b24f2cb9633f51f15705ea"><enum>(f)</enum><header>Outreach</header><text>The
				Secretary of Labor (and the Secretary of the Treasury, with respect to the tax
				credit for health insurance costs under section 35 of the Internal Revenue Code
				of 1986) shall undertake outreach to advise the public of the existence and
				duties of the
				Office.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="id5EA4593737FD4E8EA86AB360702503F7"><enum>(b)</enum><header>Technical
			 amendment</header><text>The table of contents for title II of the Trade Act of
			 1974 is amended by inserting after the item relating to section 221 the
			 following:</text>

				processing petitions filed under section 221.</text>
									</paragraph><paragraph id="ID1BEC04CA965C47649852AAE114CE2632"><enum>(3)</enum><text>The number of
				training waivers granted under section 231(c), classified by the type of waiver
				granted.</text>
									</paragraph><paragraph id="ID6BA616CBCA974CB38041036FA1F6DA5C"><enum>(4)</enum><text>The number of
				workers receiving benefits and the type of benefits being received.</text>
									</paragraph><paragraph id="ID1ACB5A1E44C24A42870453B743EF2F3F"><enum>(5)</enum><text>The number of
				workers enrolled in, and the duration of, training approved under section 236
				by major types of training.</text>
									</paragraph><paragraph id="IDC86186532A044E7DAB485F3012E4264D"><enum>(6)</enum><text>Earnings history
				of workers that reflects wages before separation and wages in any job obtained
				after receiving benefits under this chapter.</text>
									</paragraph><paragraph id="ID5DC8BD9027A246E1ACB068F4922F853E"><enum>(7)</enum><text>Reemployment
				rates and sectors in which dislocated workers have been employed.</text>
									</paragraph><paragraph id="IDCF11E5E1D1B44CA6997FD7C6448862E9"><enum>(8)</enum><text>The cause of
				dislocation identified in each petition that resulted in a certification under
				this chapter.</text>
									</paragraph><paragraph id="IDE64FB94BC8DF4606BDBA09344D64FE8E"><enum>(9)</enum><text>The number of
				petitions filed and workers certified in each congressional district of the
				United States.</text>
									</paragraph></subsection><subsection id="IDC8D2C2A51C374CEEA2A3346B7EFEB51E"><enum>(b)</enum><header>State
				participation</header><text>The Secretary shall ensure, to the extent
				practicable, through oversight and effective internal control measures, the
				following:</text>
									<paragraph id="ID98CB5C3494B74605963283450744284A"><enum>(1)</enum><header>State
				participation</header><text>Participation by each State in the collection of
				data required under subsection (a) and incentives for States to supplement
				employment and wage data obtained through the use of unemployment insurance
				wage records.</text>
									</paragraph><paragraph id="ID964A0B904BDD4EB8AE4530694480235E"><enum>(2)</enum><header>Monitoring</header><text>Monitoring
				by each State of internal control measures with respect to program measurement
				data collected by each State.</text>
									</paragraph><paragraph id="ID440EBD605A294843BEE4C95D127318AA"><enum>(3)</enum><header>Response</header><text>The
				quality and speed of the rapid response provided by each State under section
				134(a)(2)(A) of the Workforce Investment Act of 1998 (29 U.S.C.
				2864(a)(2)(A)).</text>
									</paragraph></subsection><subsection commented="no" id="ID84838591FFF64DA6BF4A0A49B0667850"><enum>(c)</enum><header>Report</header>
									<paragraph commented="no" id="idD907AE5FC6704FA4B09060C6A8208B85"><enum>(1)</enum><header>In
				general</header><text>Not later than 1 year after the date of the enactment of
				the <short-title>Trade and Globalization Adjustment
				Assistance Act of 2007</short-title>, and annually thereafter, the Secretary
				shall submit to the Committee on Finance of the Senate and the Committee on
				Ways and Means of the House of Representatives a report that includes the
				information collected under this section.</text>
									</paragraph><paragraph commented="no" id="idD3EEF842923B4295AFDF7E9D96A740AC"><enum>(2)</enum><header>Availability</header><text>The
				Secretary shall make a report required by paragraph (1) available to each State
				and to the
				public.</text>

			 for distribution of information to workers</header>
					<subsection commented="no" display-inline="no-display-inline" id="id1E6E35CDB0874304B3B043F5820A3EF6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 September 30, 2008, the Secretary of Labor shall fully implement a pilot
			 program to provide information on the availability of trade adjustment
			 assistance under chapter 2 of title II of the Trade Act of 1974 (19 U.S.C. 2271
			 et seq.) to workers who inquire about or receive unemployment insurance
			 benefits. The pilot program shall use telephone, Internet, and in-person
			 communication to distribute such information to workers.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id94F3C3BBF8C249B98CF58503AF13AFD8"><enum>(b)</enum><header>Study and
			 report by Comptroller General</header><text>Not later than March 31, 2011, the
			 Comptroller General of the United States shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id4BC1A7A146254D42874EB8D05EA388F9"><enum>(1)</enum><text>conduct a study
			 of the implementation and outcomes of the pilot program under subsection (a);
			 and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF018F1A6EC2C4CA384655F76A7D2818A"><enum>(2)</enum><text>submit to the
			 Committee on Finance of the Senate and the Committee on Ways and Means of the
			 House of Representatives a report on the findings of the study conducted under
			 paragraph (1).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB760C6C00D4042ACBFB4CAC8D6092ED7"><enum>(c)</enum><header>Regulations</header><text>The
			 Secretary of Labor shall prescribe such regulations as may be necessary to

			<section id="ID8F79885815C24AF79E961BCF2ABEFB1B"><enum>201.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to assist
			 communities negatively impacted by trade with economic adjustment through the
			 integration of political and economic organizations, the coordination of
			 Federal, State, and local resources, the creation of community-based
			 development strategies, and the provision of economic transition
			 assistance.</text>
			</section><section id="ID82AAD1D5F39247569878F86B17981B03"><enum>202.</enum><header>Trade
			 Adjustment Assistance for communities</header><text display-inline="no-display-inline">Chapter 4 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2371 et
			 seq.) is amended to read as follows:</text>

						<section id="IDA9012193EF13405CBDC9AEE637D8E306"><enum>271.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text>
							<paragraph id="ID5DF8E279803F444CA81C7D3477398994"><enum>(1)</enum><header>Agricultural
				commodity producer</header><text>The term <term>agricultural commodity
				producer</term> has the same meaning as the term <term>person</term> as
				prescribed by regulations promulgated under section 1001(e) of the Food
				Security Act of 1985 (7 U.S.C. 1308(e)).</text>
							</paragraph><paragraph id="IDBE65B3289BDF4EAC833591B29BE23E82"><enum>(2)</enum><header>Community</header><text>The
				term <term>community</term> means a city, county, or other political
				subdivision of a State or a consortium of political subdivisions of a State
				that the Secretary certifies as being negatively impacted by trade.</text>
							</paragraph><paragraph id="ID2607B43EA0824C4DAA4A24FC2F05CD34"><enum>(3)</enum><header>Community
				negatively impacted by trade</header><text>A community negatively impacted by
				trade means a community with respect to which a positive determination has been
				made under section 273.</text>
							</paragraph><paragraph id="ID7BC93D23096C49CCBCA1FEDE116855BA"><enum>(4)</enum><header>Eligible
				community</header><text>The term <term>eligible community</term> means a
				community certified under section 273 for assistance under this chapter.</text>
							</paragraph><paragraph id="ID0E0223592EA1441183E580C6A91B7E35"><enum>(5)</enum><header>Fisherman</header>
								<subparagraph id="IDFED29B6A52DB4A73B2A135F3F09C574D"><enum>(A)</enum><header>In
				general</header><text>The term <term>fisherman</term> means any person
				who—</text>
									<clause id="IDD2C7B10B4AB34AC3B7F5141CB7BB4AEB"><enum>(i)</enum><text>is engaged in
				commercial fishing; or</text>
									</clause><clause id="ID3F23FBC39DA74F42B8A320E136CF3FF4"><enum>(ii)</enum><text>is a United
				States fish processor.</text>
									</clause></subparagraph><subparagraph id="IDA12616DF53AF4B7EB251A34406E22F06"><enum>(B)</enum><header>Commercial
				fishing, fish, fishery, fishing, fishing vessel, person, and united states fish
				processor</header><text>The terms <term>commercial fishing</term>,
				<term>fish</term>, <term>fishery</term>, <term>fishing</term>, <term>fishing
				vessel</term>, <term>person</term>, and <term>United States fish
				processor</term> have the same meanings as such terms have in section 3 of the
				Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C.
				1802).</text>
								</subparagraph></paragraph><paragraph id="ID4A5EA205FC9B4BD4B74EAFD7B9E8662B"><enum>(6)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Commerce.</text>
							</paragraph></section><section id="ID1148E79F3863467EB4D7B79C0F7447B5"><enum>272.</enum><header>Community
				Trade Adjustment Assistance Program</header>
							<subsection id="ID98D693EFCE8049D29D45BDE8CDC80F4F"><enum>(a)</enum><header>Establishment</header><text>Within
				6 months after the date of the enactment of the
				<short-title>Trade and Globalization Adjustment Assistance
				Act of 2007</short-title>, the Secretary shall establish a trade adjustment
				assistance for communities program at the Department of Commerce.</text>
							</subsection><subsection id="IDD35CD74D46394F6FA08B3F0E3474BA26"><enum>(b)</enum><header>Personnel</header><text>The
				Secretary shall designate such staff as may be necessary to carry out the
				responsibilities described in this chapter.</text>
							</subsection><subsection id="ID04E5E7A6CD1F401092BF13D642049EB1"><enum>(c)</enum><header>Coordination of
				Federal Response</header><text>The Secretary shall—</text>
								<paragraph id="ID79E5C9037D874726AA381F5EDE7718E4"><enum>(1)</enum><text>provide
				leadership, support, and coordination for a comprehensive management program to
				address economic dislocation in eligible communities;</text>
								</paragraph><paragraph id="ID546A4B6C6A254E439F35EFFFDDCB2A34"><enum>(2)</enum><text>coordinate the
				Federal response to an eligible community—</text>
									<subparagraph id="ID398928F7421D48648A93BE9FF908E32F"><enum>(A)</enum><text>by identifying
				all Federal, State, and local resources that are available to assist the
				eligible community in recovering from economic distress;</text>
									</subparagraph><subparagraph id="ID425ED3284C9D46AC9BE6ECC3CFF73B2F"><enum>(B)</enum><text>by ensuring that
				all Federal agencies offering assistance to an eligible community do so in a
				targeted, integrated manner that ensures that an eligible community has access
				to all available Federal assistance;</text>
									</subparagraph><subparagraph id="IDC4E5C2810D8F40E88052DDAE5F804DB6"><enum>(C)</enum><text>by assuring
				timely consultation and cooperation between Federal, State, and regional
				officials concerning economic adjustment for an eligible community; and</text>
									</subparagraph><subparagraph id="ID4E4CEBA517C64630BD0059C054CFBBA5"><enum>(D)</enum><text>by identifying
				and strengthening existing agency mechanisms designed to assist eligible
				communities in their efforts to achieve economic adjustment and workforce
				reemployment;</text>
									</subparagraph></paragraph><paragraph id="ID08E302908D8F431A8A52D73F92A2B804"><enum>(3)</enum><text>provide
				comprehensive technical assistance to any eligible community in the efforts of
				that community to—</text>
									<subparagraph id="ID3DDAA1882855476B9A4CA73782A06B9C"><enum>(A)</enum><text>identify serious
				economic problems in the community that are the result of negative impacts from
				trade;</text>
									</subparagraph><subparagraph id="IDE78ACF6165524C52863DA4ED218D19B9"><enum>(B)</enum><text>integrate the
				major groups and organizations significantly affected by the economic
				adjustment;</text>
									</subparagraph><subparagraph id="ID7392A63E93944776A3BCCEC396296579"><enum>(C)</enum><text>access Federal,
				State, and local resources designed to assist in economic development and trade
				adjustment assistance;</text>
									</subparagraph><subparagraph id="ID1CEADBD5BAE840A8A6EBC9D2667AD5AD"><enum>(D)</enum><text>diversify and
				strengthen the community economy; and</text>
									</subparagraph><subparagraph id="ID4C0E71A26A774FADA56AA0AA2AA61007"><enum>(E)</enum><text>develop a
				community-based strategic plan to address economic development and workforce
				dislocation, including unemployment among agricultural commodity producers and
				fishermen;</text>
									</subparagraph></paragraph><paragraph id="IDF667BFC1A6164D379424F41EA5B864F4"><enum>(4)</enum><text>establish
				specific criteria for submission and evaluation of a strategic plan submitted
				under section 274(d);</text>
								</paragraph><paragraph id="IDCCEF890D53C042D7A5B4C8D158086A10"><enum>(5)</enum><text>establish
				specific criteria for submitting and evaluating applications for grants under
				section 275;</text>
								</paragraph><paragraph id="ID22FB1044A348475FAD8A4D50040B2C19"><enum>(6)</enum><text>administer the
				grant programs established under sections 274 and 275; and</text>
								</paragraph><paragraph id="IDC4AF34B7229E4C32949E4DB76CC9B221"><enum>(7)</enum><text>establish an
				interagency Trade Adjustment Assistance for Communities Working Group, chaired
				by the Secretary or a designee of the Secretary, consisting of the
				representatives of any Federal department or agency with responsibility for
				economic adjustment assistance, including the Department of Agriculture, the
				Department of Education, the Department of Labor, the Department of Housing and
				Urban Development, the Department of Health and Human Services, the Small
				Business Administration, the Department of the Treasury, the Department of
				Commerce, and any other Federal, State, or regional department or agency the
				Secretary determines necessary or appropriate.</text>
								</paragraph></subsection></section><section id="IDD41375BA5862404A843AF3845AE6A401"><enum>273.</enum><header>Certification
				and notification</header>
							<subsection id="IDD4CD45C0ECD343479770AF15D68E1B27"><enum>(a)</enum><header>Certification</header><text>Not
				later than 180 days after an event described in subsection (c)(1), a community
				described in subsection (b)(1) may submit a petition to the Secretary for a
				determination under subsection (b)(2) that the community is negatively impacted
				by trade, as described in subsection (b)(2). If the Secretary makes a positive
				determination, the Secretary shall certify the community as eligible for
				assistance under this chapter.</text>
							</subsection><subsection id="ID3DA380E4F32749D1830F33698866379C"><enum>(b)</enum><header>Determination
				that community is eligible</header>
								<paragraph id="ID2218CD97BBDA45F18AECBBE729D8BA59"><enum>(1)</enum><header>Community
				described</header><text>A community described in this paragraph means a
				community with respect to which, on or after October 1, 2008—</text>
									<subparagraph id="IDC17210BDDFB24A3889127B071987C44B"><enum>(A)</enum><text>the Secretary of
				Labor certifies a group of workers (or their authorized representative) in the
				community as eligible to apply for assistance pursuant to section 223;</text>
									</subparagraph><subparagraph id="ID2CF3C4B51B7F4AE48D13C2F57B26437F"><enum>(B)</enum><text>the Secretary of
				Commerce certifies a firm located in the community as eligible to apply for
				adjustment assistance under section 251; or</text>
									</subparagraph><subparagraph id="ID103738E02B9E4F49A762727C65C8E597"><enum>(C)</enum><text>the Secretary of
				Agriculture certifies a group of agricultural commodity producers (or their
				authorized representative) in the community as eligible to apply for adjustment
				assistance under section 293.</text>
									</subparagraph></paragraph><paragraph id="ID0CF9AE805E1B47C281C25A65444F4890"><enum>(2)</enum><header>Negatively
				impacted by trade</header><text>The Secretary shall determine that a community
				is negatively impacted by trade, after taking into consideration—</text>
									<subparagraph id="IDBA2ABD9FE8944538A9E040D0BCE668CD"><enum>(A)</enum><text>the number of
				jobs affected compared to the size of the workforce in the community;</text>
									</subparagraph><subparagraph id="ID8002C380EA524DB1BA3C69953A673E56"><enum>(B)</enum><text>the severity of
				the rate of unemployment in the community and the duration of the unemployment
				in the community;</text>
									</subparagraph><subparagraph id="IDA2699E76EBA24B3A9F91CD0AE67BBB9B"><enum>(C)</enum><text>the income levels
				and the extent of underemployment in the community;</text>
									</subparagraph><subparagraph id="ID56DC4488920946C4AFCBB704DAB87C3E"><enum>(D)</enum><text>the out-migration
				of population from the community and the extent to which the out-migration is
				causing economic injury in the community; and</text>
									</subparagraph><subparagraph id="IDCF6A12687D3C4D15B3C75CEAFB5D46DD"><enum>(E)</enum><text>the unique
				problems and needs of the community.</text>
									</subparagraph></paragraph></subsection><subsection id="ID520DE4125B044E729C926BF892EC6B6C"><enum>(c)</enum><header>Definition and
				Special Rules</header>
								<paragraph id="ID3E03085FFB39495D99D09B476BB5E2BF"><enum>(1)</enum><header>Event
				described</header><text>An event described in this paragraph means one of the
				following:</text>
									<subparagraph id="ID16F9EFDA05CB41209DF0A200F761CFED"><enum>(A)</enum><text>A notification
				described in paragraph (2).</text>
									</subparagraph><subparagraph id="IDF6C5EACB943D406BA633D46AD2B912FD"><enum>(B)</enum><text>A certification
				of a firm under section 251.</text>
									</subparagraph><subparagraph id="ID404C0605A6C64915B63F717DFA04B229"><enum>(C)</enum><text>A determination
				by the Secretary that a significant number of fishermen in a community have
				been negatively impacted by trade.</text>
									</subparagraph></paragraph><paragraph id="ID4176C0352228432FB9D1DCCE74DE1391"><enum>(2)</enum><header>Notification</header><text>The
				Governor of a State shall be notified immediately—</text>
									<subparagraph id="idAD4E0E9E99534730B7DC7A69EFCF1918"><enum>(A)</enum><text>by the Secretary
				of Labor, upon making a determination that a group of workers in the State is
				eligible for trade adjustment assistance under section 223;</text>
									</subparagraph><subparagraph id="id73B1EAA540534DEFA20F14E9ABE47267"><enum>(B)</enum><text>by the Secretary
				of Commerce, upon making a determination that a firm in the State is eligible
				for adjustment assistance under section 251; and</text>
									</subparagraph><subparagraph id="id2D443BD5012D457AAB2CE6AC118C61D7"><enum>(C)</enum><text>by the Secretary
				of Agriculture, upon making a determination that a group of agricultural
				commodity producers in the State is eligible for adjustment assistance under
				section 293.</text>
									</subparagraph></paragraph><paragraph commented="no" id="id5E579AEFF05C40F69F6D2619AB46AC75"><enum>(3)</enum><header>Look
				back</header>
									<subparagraph commented="no" id="id397E3BD095EA4B8CADD99A765C93C885"><enum>(A)</enum><header>In
				general</header><text>Not later than 210 days after the date described in
				clause (ii), a community described in subsection (b)(1) may petition the
				Secretary for a determination that the community is negatively impacted by
				trade, as described in subsection (b)(2), in any case in which an event
				described in paragraph (1) occurs—</text>
										<clause commented="no" id="id4BFA24FE8A64476788FC69F264FF4096"><enum>(i)</enum><text>on or after
				January 1, 2007; and</text>
										</clause><clause commented="no" id="id94C5C9E1AA964FC7880EDA6CD2B1CB59"><enum>(ii)</enum><text>before the date
				on which the Secretary completes the implementation of the program established
				pursuant to section 272(a).</text>
										</clause></subparagraph><subparagraph commented="no" id="id9AAD6E83FF6848769D592FC69DC09451"><enum>(B)</enum><header>Notifications</header>
										<clause commented="no" id="id23720A81166F4C7C8A10089DBA32B8BF"><enum>(i)</enum><header>Notifications
				to the Secretary of Commerce</header><text>If, during the period described in
				subparagraph (A), the Secretary of Labor makes a determination that a group of
				workers is eligible for trade adjustment assistance under section 223 (or the
				Secretary of Agriculture makes a determination that a group of agricultural
				commodity producers is eligible for adjustment assistance under section 293, as
				the case may be) the Secretary of Labor (or the Secretary of Agriculture, as
				the case may be) shall notify the Secretary of the determination not later than
				30 days after the date described in subparagraph (A)(ii).</text>
										</clause><clause commented="no" id="idF0313B8A32D64532B877B95933C877B6"><enum>(ii)</enum><header>Notifications
				to States</header><text>The Secretary shall notify the Governor of a State
				of—</text>
											<subclause commented="no" id="id2110C543D3144CE5A0540CF6CA1A2319"><enum>(I)</enum><text>a
				determination—</text>
												<item commented="no" id="idF5755E770D89458AB7CC1E304E36C103"><enum>(aa)</enum><text>described in
				clause (i) made during the period described in subparagraph (A) in the State
				immediately upon receiving the notification required by clause (i); or</text>
												</item><item commented="no" id="idB08E598D7EBA4684AD7376DF6B2A0B08"><enum>(bb)</enum><text>made by the
				Secretary during the period described in subparagraph (A) that a firm in the
				State is eligible for adjustment assistance under section 251; and</text>
												</item></subclause><subclause commented="no" id="idB53BEE6E65E342D39A228BC2BB207D7A"><enum>(II)</enum><text>the ability of a
				community affected by such a determination to petition under subparagraph (A)
				for a determination that the community is negatively impacted by trade.</text>
											</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID19AABE8111EF4D73837AD2C7E08AC9CA"><enum>(d)</enum><header>Notification to
				Eligible Communities</header><text>Immediately upon certification by the
				Secretary that a community is eligible for assistance under subsection (b), the
				Secretary shall notify the community—</text>
								<paragraph id="IDDFEA19CF327B4F24915B5AB66C21C1FD"><enum>(1)</enum><text>of the
				determination under subsection (b);</text>
								</paragraph><paragraph id="ID0380030E8CF348E1AF4F426BD2B3BC2C"><enum>(2)</enum><text>of the provisions
				of this chapter;</text>
								</paragraph><paragraph id="ID7C320BB52A354C9BB0F1F7BC18A94993"><enum>(3)</enum><text>how to access the
				clearinghouse established by the Department of Commerce regarding available
				economic assistance;</text>
								</paragraph><paragraph id="ID99D1DE08123E49DFA509891D9FA24FF8"><enum>(4)</enum><text>how to obtain
				technical assistance provided under section 272(c)(3); and</text>
								</paragraph><paragraph id="IDFC732A2902FA4B65B1DA3659C92782DD"><enum>(5)</enum><text>how to obtain
				grants, tax credits, low income loans, and other appropriate economic
				assistance.</text>
								</paragraph></subsection></section><section id="IDC79DF9D256194CE8A28CECF07BC96EBD"><enum>274.</enum><header>Strategic
				plans</header>
							<subsection id="ID9A6109FA9EFB4776925A21BEFF0ADCD5"><enum>(a)</enum><header>In
				general</header><text>An eligible community may develop a strategic plan for
				community economic adjustment and diversification.</text>
							</subsection><subsection id="IDF8BDE6AE4651473D950D6782D7782076"><enum>(b)</enum><header>Requirements
				for strategic plan</header><text>A strategic plan shall contain, at a minimum,
				the following:</text>
								<paragraph id="IDD3BEC1620303409ABD1229FED0C0BE5C"><enum>(1)</enum><text>A description and
				justification of the capacity for economic adjustment, including the method of
				financing to be used.</text>
								</paragraph><paragraph id="IDC74F3730B77543BBB66D6FF5727EB5E7"><enum>(2)</enum><text>A description of
				the commitment of the community to the strategic plan over the long term and
				the participation and input of groups affected by economic dislocation.</text>
								</paragraph><paragraph id="IDF0743E0F85DF41DD91951A55DDFD2BA4"><enum>(3)</enum><text>A description of
				the projects to be undertaken by the eligible community.</text>
								</paragraph><paragraph id="ID6326B3B4B31C46058358633034C564CF"><enum>(4)</enum><text>A description of
				how the plan and the projects to be undertaken by the eligible community will
				lead to job creation and job retention in the community.</text>
								</paragraph><paragraph id="ID9EC058B5EC2241A095666F08D19ED24C"><enum>(5)</enum><text>A description of
				how the plan will achieve economic adjustment and diversification.</text>
								</paragraph><paragraph id="IDC1F281EBB9AF46C5BEECDEAC51524BE8"><enum>(6)</enum><text>A description of
				how the plan and the projects will contribute to establishing or maintaining a
				level of public services necessary to attract and retain economic
				investment.</text>
								</paragraph><paragraph id="IDDCD495A065EC403482AC71DA3D21FF3D"><enum>(7)</enum><text>A description and
				justification for the cost and timing of proposed basic and advanced
				infrastructure improvements in the eligible community.</text>
								</paragraph><paragraph id="ID2C1DF49ED4474FAB8652326E324FD623"><enum>(8)</enum><text>A description of
				how the plan will address the occupational and workforce conditions in the
				eligible community.</text>
								</paragraph><paragraph id="ID16A9A644655F4ABAABF4A73A5BED88BC"><enum>(9)</enum><text>A description of
				the educational programs available for workforce training and future employment
				needs.</text>
								</paragraph><paragraph id="IDB5B4B3FED689454194003C7C4092661D"><enum>(10)</enum><text>A description of
				how the plan will adapt to changing markets and business cycles.</text>
								</paragraph><paragraph id="IDF55BAB0C36E445E593C237C7D7BD62C0"><enum>(11)</enum><text>A description
				and justification for the cost and timing of the total funds required by the
				community for economic assistance.</text>
								</paragraph><paragraph id="ID8B78809FFD90458881BDD09B58B921A5"><enum>(12)</enum><text>A graduation
				strategy through which the eligible community demonstrates that the community
				will terminate the need for Federal assistance.</text>
								</paragraph></subsection><subsection id="IDC19F6DA7616B4FBEAA6EE573E8F0E7DE"><enum>(c)</enum><header>Grants to
				develop strategic plans</header><text>The Secretary, upon receipt of an
				application from an eligible community, may award a grant to that community to
				be used to develop the strategic plan under subsection (a).</text>
							</subsection><subsection id="IDBF43872F902E4974A545AABA46722DB4"><enum>(d)</enum><header>Submission of
				plan</header><text>A strategic plan developed under subsection (a) shall be
				submitted to the Secretary for evaluation and approval.</text>
							</subsection></section><section id="ID1B3733CED40A4710A148B94BC4513A7E"><enum>275.</enum><header>Grants for
				economic development</header>
							<subsection id="ID900D185E3F0D4F57B65797D85FFBE32A"><enum>(a)</enum><header>In
				general</header><text>The Secretary, upon approval of a strategic plan from an
				eligible community, may award a grant to that community to carry out any
				project or program that is certified by the Secretary to be included in the
				strategic plan approved under section 274(d), or consistent with that
				plan.</text>
							</subsection><subsection id="ID081520181B5D4E3D8FC3BD1AC31A6881"><enum>(b)</enum><header>Additional
				grants</header>
								<paragraph id="ID4C99F50270F14CF0B59084EA850A1A6D"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), in order to assist eligible
				communities to obtain funds under Federal grant programs, other than the grants
				provided for in section 274(c) or subsection (a) of this section, the Secretary
				may, upon the application of an eligible community, make a supplemental grant
				to the community if—</text>
									<subparagraph id="ID0AF45BDC0090436284CC683B1E4C31CA"><enum>(A)</enum><text>the purpose of
				the grant program from which the grant is made is to provide technical or other
				assistance for planning, constructing, or equipping public works facilities or
				to provide assistance for public service projects; and</text>
									</subparagraph><subparagraph id="ID9517BFADCD6A457391C0B11BC7B670EC"><enum>(B)</enum><text>the grant is one
				for which the community is eligible except for the community’s inability to
				meet the non-Federal share requirements of the grant program.</text>
									</subparagraph></paragraph><paragraph id="IDD51FEBDC81C142329B1299BD07797489"><enum>(2)</enum><header>Use as
				non-Federal share</header><text>A supplemental grant made under this subsection
				may be used to provide the non-Federal share of a project, unless the total
				Federal contribution to the project for which the grant is being made exceeds
				80 percent and that excess is not permitted by law.</text>
								</paragraph></subsection><subsection id="IDA96F7E1771D44724A1119EB38F2D39DA"><enum>(c)</enum><header>Rural community
				preference</header><text>The Secretary shall develop guidelines to ensure that
				rural communities receive preference in the allocation of resources.</text>
							</subsection></section><section id="ID184D9F29D3464B14B829F4EB1890AFB6"><enum>276.</enum><header>General
				provisions</header>
							<subsection id="ID0A29717977664B00AB44DD3A1830E6A9"><enum>(a)</enum><header>Regulations</header><text>The
				Secretary shall prescribe such regulations as are necessary to carry out the
				provisions of this chapter. The Secretary may not implement any regulation or
				guideline proposed by the Secretary with respect to this chapter, until the
				date that is 60 days after the date the Secretary submits the regulation or
				guideline to the Committee on Finance of the Senate and the Committee on Ways
				and Means of the House of Representatives.</text>
							</subsection><subsection id="ID68CED1204E844F58AAA41DC96C56DFD5"><enum>(b)</enum><header>Supplement Not
				Supplant</header><text>Funds appropriated under this chapter shall be used to
				supplement and not supplant other Federal, State, and local public funds
				expended to provide economic development assistance for communities.</text>
							</subsection><subsection id="ID59697553478742DC814B1416E2AEB4B4"><enum>(c)</enum><header>Authorization
				of Appropriations</header><text>There are authorized to be appropriated to the
				Secretary $300,000,000 for each of fiscal years 2009 through 2013 to carry out
				this chapter. Amounts appropriated pursuant to this subsection shall remain
				available until
				expended.</text>

				agricultural commodity that has no officially designated marketing year, the
				national average price paid to an agricultural commodity producer for that

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idC6351DEF7B874A48825BDFBBF6E81FE7"><enum>402.</enum><header>Application to
			 fisherman</header><text display-inline="no-display-inline">Notwithstanding any
			 other provision of law, for purposes of chapter 2 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2271 et
			 seq.), fishermen and aquaculture producers shall be eligible for adjustment
			 assistance without regard to whether such fishermen seek such assistance based
			 on an increase in imports of wild stock or an increase of imports of
			 farm-raised stock.</text>
			</section><section id="ID0E13A54F8EB540A4A98E393BA2F4C4AE"><enum>403.</enum><header>Eligibility</header>
				<subsection id="ID6984522319E84AA9ACAF9809A5328C2F"><enum>(a)</enum><header>In
			 general</header><text>Section 292(c)(1) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401a(c)(1)) is
			 amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idA67A7516BC64457D89098F3A72816E34" style="OLC">

				for the 5 marketing years preceding the most recent marketing year; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2C0635C6CCC949099CAE11BC9DFD3E60"><enum>(B)</enum><text display-inline="yes-display-inline">the national average price for the
				agricultural commodity for the most recent 2 marketing years for which the
				national average price is available is less than 90 percent of the average of
				the national average price for such agricultural commodity, or such class of
				goods, for the 3 marketing years preceding the 2 most recent marketing years;
				and</text>
							</subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
				</subsection><subsection id="id3F4274D48BE04040BB738791AE941C26"><enum>(b)</enum><header>Special rule
			 for qualified subsequent years</header><text>Paragraph (2) of section 292(d) of
			 the Trade Act of 1974 (19 U.S.C. 2401a(d)(2)) is amended to read as
			 follows:</text>

				</subsection><subsection id="idEA7B013BC4B64DF496E644DD4DCA7CB6"><enum>(c)</enum><header>Eligibility of
			 certain other producers</header><text>Section 292 of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401a)
			 is amended by adding at the end the following:</text>

				<subsection id="idEBE8D07ABE984E6AB15FCD735F3C6645"><enum>(a)</enum><header>Amount of cash
			 benefits</header><text>Section 296(b)(1) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2401e(b)(1)) is
			 amended—</text>
					<paragraph commented="no" id="id93C4F7FCE57343A3BACF9E37187FACC1"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>one-half</quote> and inserting <quote>85
			 percent</quote>; and</text>
					</paragraph><paragraph id="id0D7821B174A84CE88C149E064EF6C36D"><enum>(2)</enum><text>in clause (i) of
			 subparagraph (A), by striking <quote>80 percent</quote> and inserting <quote>90
			 percent</quote>.</text>
					</paragraph></subsection><subsection id="idBA0D5CD5FB7A4568B6D6D24DE2AD572F"><enum>(b)</enum><header>Intensive
			 technical assistance</header><text>Section 295 of the Trade Act of 1974 (19
			 U.S.C. 2401d) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idCA14AFBEA9B5400D861F0D19D1F33C28" style="OLC">
						<subsection id="id54714C3E041B4189AA1520D899B189E0"><enum>(c)</enum><header>Intensive
				technical training</header>
							<paragraph id="idC95B482702854683AB52BB25DA1FAC17"><enum>(1)</enum><header>In
				general</header><text>An adversely affected agricultural producer that fulfills
				the requirements set forth in subparagraphs (A), (B), and (D) of section
				296(a)(1) may opt to receive intensive technical assistance from the Secretary
				for a period not to exceed 2 years from the date of certification of a petition
				described in section 292(a).</text>
							</paragraph><paragraph id="idD95D3B00CC2442E985BEAC05EAE48314"><enum>(2)</enum><header>Designation of
				Agricultural Extension Service Center</header><text>The Secretary shall
				designate a Cooperative State Research, Education, and Extension Service to
				develop and coordinate an intensive technical assistance curriculum for
				adversely affected agricultural commodity producers.</text>
							</paragraph><paragraph id="IDb517b424843144bcada5b8523137ed6b"><enum>(3)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated
				$5,000,000 in each of the fiscal years 2008 through 2012 to the Secretary for
				the purpose of delivering the intensive technical assistance described in
				paragraph
				(1).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="id9635BFA7D294403C8363F124690C9538"><enum>(c)</enum><header>Clerical
			 amendment</header><text>Section 295(a) of the Trade Act of 1974 (19 U.S.C.
			 2401d(a)) is amended by striking <quote>groups</quote> and inserting
			 <quote>agricultural commodity producers (or groups of such
			 producers)</quote>.</text>
				</subsection></section><section id="id37A853619558455BACBD048EEE49851B"><enum>405.</enum><header>Audits and
			 reports</header><text display-inline="no-display-inline">Section 293 of the
			 Trade Act of 1974 (19 U.S.C. 2401b) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id696F13152CF747A2897A7BF80F562AFE" style="OLC">
					<subsection id="id06C9D172AB3F48C0A2E124B825D6963C"><enum>(d)</enum><header>Audit and
				report by the Comptroller General</header>
						<paragraph id="idE3C346B47FBA42CCA29B776DD30855A8"><enum>(1)</enum><header>In
				general</header><text>Not later than January 31, 2012, the Comptroller General
				of the United States shall conduct an evaluation of the program under this
				chapter and shall report the results of the evaluation to the Committee on
				Finance of the Senate and the Committee on Ways and Means of the House of
				Representatives.</text>
						</paragraph><paragraph id="id0C5A4B0F2E0A49E692AD06C43D5D680E"><enum>(2)</enum><header>Contents of
				evaluation and report</header><text>The evaluation and report shall
				include—</text>
							<subparagraph id="id4840AA1725F5458FAEFBA7C44424208C"><enum>(A)</enum><text>an assessment of
				the extent to which the Department of Agriculture is fulfilling its obligations
				under this chapter;</text>
							</subparagraph><subparagraph id="id0BE8B9C3504646B387F06E3149A5E5EF"><enum>(B)</enum><text>an assessment of
				the outreach to potentially eligible agricultural commodity producers and
				groups of such producers;</text>
							</subparagraph><subparagraph id="id49311629826340CCB7FDB33A74772940"><enum>(C)</enum><text>an assessment of
				the effectiveness and outcomes of the benefits received; and</text>
							</subparagraph><subparagraph id="id936DD728F8FE4EC48B4DACDBD6381E6C"><enum>(D)</enum><text>recommendations
				for improving the program.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEB406716BA9D41B9A53DFC03E6598F69"><enum>(e)</enum><header>Report by
				Secretary</header><text>Not later than November 15, 2008, and annually
				thereafter, the Secretary of Agriculture shall report to the Committee on
				Finance of the Senate and the Committee on Ways and Means of the House of
				Representatives on, for the 12-month period ending October 31 of the current
				calendar year—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idAE151AECD0DF4EF1974C866E303550F9"><enum>(1)</enum><text>the agricultural
				commodities covered by a certification under this chapter and the States or
				regions in which such commodities are produced;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7D4E02CF6C0D492490E4077C92F05A44"><enum>(2)</enum><text>the total number
				of such commodities, by State;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88CFC06074C1453A88344C7D30E6D385"><enum>(3)</enum><text>the total number
				of agricultural commodity producers, by congressional district, receiving cash
				benefits under section 296(b); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1682ADAAE23B4AAE9BF4B44E1B1B3059"><enum>(4)</enum><text>the total number
				of agicultural commodity producers, by congressional district, receiving
				intensive technical training under section
				296(c).</text>

				<subsection commented="no" display-inline="no-display-inline" id="idF9299D6A113F417EA13279932D3D04A9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 298(a) of the
			 Trade Act of 1974 (19 U.S.C. 2401g(a)) is amended by striking
			 <quote>2007</quote> and inserting <quote>2012</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id1F7845EBE7E94CFE8D0B54F30D86AF2D"><enum>(b)</enum><header>Termination</header><text>Section
			 285(b)(2) of the Trade Act of 1974 (19 U.S.C. 2271 note) is amended by striking
			 <quote>2007</quote> each place it appears and inserting
